Floaters Psychological Emotional and Visual

Patricia C. Frank FRANKLY SPEAKING Floaters, among other things, are a visual occurrence. They move on the surface of the liquid in your eyes. They can be cloudy or they can be black specks that drift around in your field of vision. They distort what you see and perceive. They can be distracting and annoying. They can make it difficult to read and to do other important things that require you to focus. Floaters in your eye can be a signal that something else more dangerous is happening like a tear in your retina. Floaters in your psychological and emotional life can be a signal that something else more dangerous might be happening as well. You need to be aware that you might not be seeing things clearly. Your perceptions about yourself and others might be distorted. If you can’t see things as they really are, you may make decisions that are not appropriate. Your life and your relationships may not be authentic.

Floaters in your life can be; the loss of a loved one, an illness, a tragedy, or a major disappointment or set back. Floaters while challenging may bring subtle compensations. They increase your endurance. They increase your ability to withstand prolonged discomfort and strain in your life. Floaters force you to be more tolerant. You have to allow something to exist without struggle or interference. You have to become resigned to the situation and accept it. Floaters force you to be patient and to bear with it while you wait for the resolution and improvement that will come. The situation is usually not permanent. A floater can also be a person who does not attach to other people psychologically or emotionally. Like the floater in your eye they drift in and out. They are inconsistent and fickle. Their inability to remain constant to you will make them difficult to deal with. These individuals should be considered one of the variables in your life. Martin was brought to Germany, later transferred to Bethesda Naval Medical then to the Tampa VA, and after to Camp Pendleton’s Wounded Warrior Battalion for eight months. Afterwards, he was medically and honorably discharged with a Purple Heart. Martin Escoto is a humble man, not comfortable being seen as a hero. “So many others have lost so much more,” he said. When the Aventura Marketing Council (AMC) partnered with the Dania Beach Design District on their multi-community “Military Room Makeover” project, the VA nominated Martin to receive the Council’s room makeover. Nine Miami-Dade and Broward organizations each selected a veteran and designer to donate their talents and resources to the project. Designer Dalia Berlin, Berlin Designs, was selected by the AMC to create the room makeover for their honored veteran. “Who better than Dalia to represent the AMC on this outstanding project for the military!” said president Elaine Adler. Dalia recently completed extensive interior work for Martin’s older home that he lives in with his mother and sisters. Dalia’s room makeover

included painting, installing new crown and base moldings, window sills, doors, lighting, hardware and draperies. Developer/Architect Fernando Levy Hara of mckafka Development Group generously provided beautiful model furnishings and accessories. AMC member and iReachAmerica Foundation CEO Peter Caspari brought in Steve Costa, Suddath United Van Lines, to donate the transportation of the furniture from Levy Hara’s Fort Lauderdale showroom to Martin’s home. Caspari also coordinated Broward Sherriff Officers to escort the Suddath truck and a military vehicle. Janette Chandler, Family Readiness Support Ass’t. for the US Army, invited US Army and US Navy officers to help move the furniture into the Escoto home. Both TV channels 10 and 7 were there to capture an emotional ceremony. “It’s truly been a heartwarming and remarkable team effort for an individual who is so deserving,” said Dalia. We are so fortunate to be able to give from the heart!”

Don’t blink, you might miss the moment Julia Yarbough SEASON OF CHANGE Have you ever started a morning with that heavy I-don’t-want-to-get-up kind of feeling and at some point you hear yourself saying, “I woke up on the wrong side of the bed and my bed is against a wall?” Don’t lie. You know at some point you have! That thought then sets a bumpy pace for the rest of the day. Well, I am issuing a challenge to everyone (including myself). Let’s all make a conscious choice to be fully aware of the thoughts kicking around in our heads; to no longer allow potentially energy-killing thoughts such as the one above to cloud our thinking. Positive, positive, positive!!! What inspired me to be more in-tune with the constant voice and chatter going on upstairs? Several events which have taken place within the past few weeks. First - an emotionally painful and draining break-up with my boyfriend of 15 months. (So much for being able to exit the Highway to a Husband!) In the days following the split, I found myself being controlled by a series of negative thoughts - a cornucopia of “woe-is -me” feelings, which quite frankly sent me into a tailspin. My friends have provided wonderful support but quickly reached their limits of listening to my “dribbledrabble” of a failed romance. Then, as I joined my friends for lunch

one afternoon (yet still feeling down in the dumps) it occurred to me, I may be overlooking valuable, precious and enriching moments with my friends and colleagues because my brain and thoughts are somewhere else. How easy it is to slip into a pattern of dissecting the past, wondering about the future and overlooking “the now.” A few days later I attended a friend’s wedding. Nothing like the joyous coming together of two people in love to renew one’s faith in relationships. Needless to say, being at such an event was somewhat of a challenge given my own current relationship status. But I reminded myself to stay in the moment. To not let any outside thoughts creep in. To simply enjoy the celebration, the guests, the friends and the happiness in the room. I knew if I let my mind wander - even for a split second - I might miss something; a word....a glance... a smile. Something that might have a long-lasting positive impact on my life. I’m glad I stayed “present.” It lifted my spirits, I made new friends and am more determined than ever to stay ‘in the now’ and enjoy life’s moments as they unfold!

Take it to the bank: They must pay as well BY MICHAEL A. FURSHMAN, ESQ.

As many banks are completing their foreclosures against their borrowers that purchased homes in communities with homeowner or condominium associations, such banks are frequently becoming the legal owners of such homes. At the moment in time the bank takes title to the home (whether through a completion of its foreclosure and the issuance of a certificate of title in the bank’s name or through a deed in lieu of foreclosure from the borrower), the bank becomes the legal owner of the home and, as such, becomes liable like every other owner in the community for the obligations that come along with home ownership in an association controlled community. Two of the most important aspects that the new bank owner needs to comply with are paying maintenance assessments no later than the due date and keeping the newly acquired home up to the maintenance standards that are imposed by the association. Some associations wonder whether they need to wait until the bank sells the home to an ultimate purchaser of the bank’s REO sale to get paid its assessments. The clear answer is that once the bank takes title, the bank is an owner and owes not only the assessments that are due under any cap that may be afforded to the bank under applicable statute, but the bank is also required to pay all assessments going forward as they become due. If a bank fails to pay the amounts that are due under the statutorily afforded cap (if applicable), the association is entitled under statute to then place a lien on the bank owned property, which lien secures not only the past due assessments, but also the late fees, interest and reasonable attorney’s fees incurred in connection with the collection efforts against the delinquent bank. After the applicable time period passes (30 or 45 days for a condominium or HOA, respectively), the association is then entitled by statute to foreclose its lien against the bank for the past due assessments, late fees, interest and reasonable attorney’s fees. If this occurs, it means that the association

could end up owning the bank owned unit free and clear for rental or a subsequent sale at which the Association would in almost all cases be made whole. As anyone that has ever owned property knows, electric bills, insurance bills, lawn maintenance, etc. need to be paid when the services are performed or billed. Associations need money on an ongoing basis to pay their day-to-day operating expenses and cannot wait six months, or in some of the most egregious cases, more than two years, for a bank to pay its assessments while the bank is looking for a buyer. If the bank fails to pay assessments as they become due, the association needs to be diligent in pursuing collections against the bank and commencing a foreclosure action against a non-paying bank just like it would against any other owner. If the bank still fails to timely pay the assessments, and the foreclosure action is filed and the property goes to sale, not only will the association be paid all past due bank assessments as well as any permitted late fees and interest from the purchaser at the foreclosure of the bank owned home, but in some cases, the association, if there is no purchaser at the foreclosure sale, could end up owning the unit that the bank previously foreclosed on free and clear of the bank’s mortgage. At such point, the association could either rent the now free and clear home or sell it to recoup the amounts that it previously did not receive from the delinquent bank. The alternative is for the association to sit and wait for the bank to find a buyer and during such time, increase assessments on the paying owners to pay for the costs that are accruing; however, not only is this not equitable to the homeowners that are paying, but under law, all owners are to be treated equally. If the association enforces collections against an owner for not paying his or her assessments, then the association should seek collections against a bank that takes title to a unit and is not paying. Even though it is a bank owned unit, the bank is still an owner and collections should be pursued just as for any other owner. Michael A. Furshman, Esq. Together, with the generosity of the Dania Beach Design District, they all became “favorites.” These wonderful compassionate, generous and honorable people, made a huge difference in the lives of military returns through the Military Room Makeover Program. Sunny Isles Beach Vice Mayor Lewis Thaler introduced me to the group. I was delighted to select a deserving veteran hero for SIB. We chose Jason Recio, a current Coral Gables Police Officer who served in Iraq and was

awarded the Purple Heart. Nothing could stop his determination to succeed; to return home to his adoring family AND to fulfill his dream of becoming a police officer. The Dania Beach Design District’s Military Room Makeover Program provided nine organizations veterans with free room makeovers by nine prominent interior designers. The City of Sunny Isles Beach honored veteran Jason Recio for his impeccable service record and for his commitment to helping returning veterans. Arnold Schulman Design Group served as Jason Recio’s Military Room Makeover Designer. Arnold learned that Jason and his wife Patricia wanted a “relaxing” new master bedroom that uniquely expressed their style. Schulman accomplished their objectives by

using calm hues, rich wood furniture, and detail moldings. They fixed warped floors boards from a leak, finished the walls, added door frames, new base- boards and new crown moldings. Arnold designed a beautiful custom made headboard, bed, bedding ensemble and selected furniture to accommodate their space, taste and needs. A contemporary shag rug added softness to their new sophisticated and relaxing master suite. The couple was thrilled! Gulfstream Park receives accreditation following review by NTRA Safety and Integrity Alliance Inspeection Team The National Thoroughbred Racing Association (NTRA) announced today that Gulfstream Park in Hallandale Beach, Fl., has been fully accredited by the NTRA Safety and Integrity Alliance following a complete review of all racing operations at the facility. The accreditation of Gulfstream was the culmination of a lengthy certification process that began with the track’s completion of a 48-page written application and continued as Gulfstream hosted several meetings with Alliance officials. The onsite review included inspections of all facets of the racing facility, and interviews with track executives, racetrack personnel, jockeys, owners, trainers, stewards and fans. The inspection team was comprised of Ronald Jensen, DVM; racing official Richard Lewis; Mike Kilpack of the Organization of Racetrack Investigators (ORI); and Mike Ziegler, Executive Director of the NTRA Safety and Integrity Alliance. “Gulfstream was reviewed during its current live meeting,” said Ziegler. “It received ‘Best Practice’ ratings in many areas including pre-race examination protocols; post-race observation protocols; fire safety planning and procedures; regular, weekly meetings with horsemen to discuss safety and other regulations; and its aftercare program, which is supported by the Gulfstream Park Thoroughbred After Racing Fund. “It was clear from the inspection that the Gulfstream Park management and staff place an extremely high emphasis on the safety of its human

Redesigned Kia Rio available in sedan, hatchback models Ron Beasley LET’S TALK CARS The Kia Rio has been completely redesigned for 2012 and it’s just the ticket for consumers looking for good, basic transportation. Available in four-door sedan and five-door hatchback models, the subcompact siblings share styling details, but have different grilles, rear ends and side scallops. They also are wider than most other cars in the class, have a longer wheelbase, a shorter overall length and a lower roofline. On the inside, the Rios are basic, but quite nice, with excellent front seat legroom (back seat passengers will have a problem). The cabins are nicely put together, but they don’t have a lot of extra styling. Both models have a lot of useful space; our test car for the week was the hatchback and we found that it had a lot of flexibility and maneuverability. Under the hood, the 2012 Kia Rio is powered by a nifty little 1.6-liter 138 hp engine

with direct injection, which gives it more power and better fuel economy (up to 40 mpg on the highway). An optional Idle Stop and Go system automatically turns the engine off and on at long stops, saving gas and reducing emissions. The engine is mated to a six-speed manual or automatic transmission. All-wheel disc brakes and available 17inch wheels are features offered on the Rio that are not found on others in this class. It comes with such standard features as air conditioning, power heated mirrors and Bluetooth on the midlevel models. Upgrades include navigation, infotainment by Microsoft, a rear camera, leather upholstery and heated front seats. The new Kia Rio Sedan and five-door Hatchback models are offered in LX, EX and SX trim lines. The LX Sedan lists for $13,400 and the five-door LX is slightly higher at $13,600. Both come standard with the six-speed manual transmission. Adding the six-speed automatic will cost you an extra $1,100. LX models come with cloth upholstery, air conditioning, wind-up windows and manual door locks, heated power mirrors, tilt steering, variable intermittent wipers, six-way manual

––––––––––––––––––––––––––––––––– In Florida if you are injured due to the negligence of another, your spouse may have a claim for “loss of consortium.” Loss of consortium refers to the comfort, support, and services that the injured spouse is no longer able to provide to the non-injured spouse – including sex. Many of our clients who are able to make this claim emphatically desire us to do so under good intentions. In an ideal world, you should get the value of everything that was violently ripped away from you after an

injury caused by another. But as a litigation strategy, except under the direst circumstances, we usually advise our clients to avoid this claim. A brief history of the consortium claim is in order: A long time ago, in England, a proclamation of the monarchy established that a man’s wife was his property. Just as if you were to have negligently injured a man’s cattle, he would be entitled to the diminished value of those cattle. If you took away his wife’s ability to provide her services to him that man would, similarly, be entitled to the diminished value of his wife. Over the years, this law eventually evolved into the loss of consortium claim. Fast forward to just a few decades ago and you would find plaintiff’s attorneys abusing the loss of consortium law to place large values on the value of lost services and sex. Eventually, this claim became synonymous with “bad lawyers abusing the system.” The reality is – loss of consortium claims tend to draw attention away from the real value of the primary cause of action — the very reason we filed a law suit in the first place – which is to fairly compensate he/she who endured significant pain and suffering due to the negligence of another. Mount Sinai Medical Center Achieves Positive Net Income for the Third Consecutive Year

For the third year in a row, Mount Sinai Medical Center’s mission-driven operations have brought positive earnings and reinforced the medical center’s strong image as a healthcare leader and community resource. Mount Sinai’s 2011 audited net income was $13.3 million prior to a onetime charge resulting from the sale of the 4701 North Meridian Avenue hospital campus. Mount Sinai’s Net Revenues were $539.4 million in 2011, up from $521.3 million in the prior year, and Mount Sinai’s Days Cash on Hand grew from 137 to 147 days. The Mount Sinai Heart Institute, a partnership with New York’s Columbia University, continued to produce strong cardiac surgical volume, showing an increase of 2 percent. In addition, diagnostic cardiac catheterization procedures increased by 6.5 percent. The Florida Agency for Health Care Administration (AHCA) data shows that Mount Sinai continues to be the area’s leader in cardiovascular care. Mount Sinai has the best surgical outcomes in Florida among facilities that perform the highest volume of complex cases. In addition, Mount Sinai’s cardiac surgeons perform the most heart valve surgeries in the state. Mount Sinai’s emergency room visits increased by 3 percent, as compared to 2010, driven by the freestanding emergency room in Aventura which showed a 4.4 percent increase in visits over the prior year. Additionally, Mount Sinai’s satellite facilities in Hialeah, Coral Gables and Key Biscayne experienced continued outpatient growth. Philanthropy has always been an important part of Mount Sinai’s history and success, and the Foundation’s net assets grew to $92.1 million in 2011. In 2011, Mount Sinai was once again recognized by U.S.News & World Report among the best hospitals in America and the only high-performing heart hospital in Miami-Dade County. The Mount Sinai Comprehensive Cancer Center recently received the

American College of Surgeons Commission on Cancer (CoC) Outstanding Achievement Award for the third consecutive time. The CoC created this award to recognize cancer programs that strive for excellence in providing quality care. Only 23 out of more than 1,500 CoC-accredited cancer programs in the U.S. have received this award three times in a row, and Mount Sinai is the only Florida hospital on the list. Mount Sinai was also the first hospital in South Florida to receive accreditation in radiation oncology by the American College of Radiology (ACR) and The American Society for Radiation Oncology (ASTRO). The ACRASTRO seal of accreditation represents the highest level of quality and patient safety. Fewer than 10 percent of radiation oncology programs nation-wide are accredited. The medical center continues to be a leader in lifesaving research and remains committed to its teaching program, training 160 residents and fellows in 17 medical specialties.
