Village water project funding runs dry BY JEFF CUTLER On the last day of this year’s Florida legislative session, funding for the Pinecrest Potable Water Project was pulled from the state budget. As all residents of Pinecrest know from the construction and road work being conducted in mostly the eastern portion of Pinecrest, the Village has been in the process of installing water pipes (a “backbone”) in the areas of the Village that do not have access to potable water, along with the fire hydrants that go with them. Phase One of this project is twothirds complete, on budget and should be completed on time by July 19. Of the approximately 1,500 homes that did not have any access to county water before, the installation of the water backbone will give about 360 homes direct access to potable water and bring many more homes closer to the water lines for future access and expansion. A reminder to those interested, “access” to this water does not mean that such a homeowner must hook up immediately. The Village was able to obtain from Miami-Dade Water and Sewer a 10-year moratorium, with −−−−−−−−−−−−−−

The co-designation recognizes John Murray Stritter, who was a pilot for Pan American World Airways and served in the Pan American Air Transport Command Group during World War II. Stritter was the long-time owner of a 20-acre Mango farm on Kendall Drive. He passed away at the age of 84 in 2002. Positive PEOPLE in Pinecrest

JORDAN ROSEN Palmetto High School junior Jordan Rosen is happy that his grandfather Irving Zambrofsky is alive and well. Zambrofsky suffered from a kidney problem that was resolved by a kidney transplant in 2001. “He’s doing great,” Rosen says. “I’m really close to my grandfather and I was volunteering at all these (transplant) events. I’m a diehard basketball fan. What a great way to combine it and raise awareness and raise money. It’s been a great experience.” As a result of the experience, Rosen organized the Miracle Game Three-onThree Basketball Tournament as his freshman community-service project. It was such a success that he decided to continue with it. “We’ve raised more than $11,000 over three years,” he says. “This year I raised just over $4,000.” The first year, the tournament was at his home and, while it was successful, it needed a larger venue. Since then, Suniland has donated the use of their basketball courts for the event. So now they have four hoops for simultaneous play. “We have about 50 people participating every year,” Rosen says. To promote the event, Rosen creates a Facebook page and sends out invitations to family and friends. For the 2010 tournament, he hopes to bring in additional people to run the show. He says

there are three freshmen in his debate class who are interested in taking over the tournament when he leaves for college in a year. “The freshmen have been trying to help as much as they can,” he says. “I would love to make it bigger.” This year’s tournament included brackets for the over 50 players and a raffle with cool prizes. Players can register right up to the day of the event and Rosen makes up the brackets the morning of the tournament, “My entire family is big, big basketball people,” he says. “My dad is in his 50s and he still plays.” Organizing a basketball tournament isn’t enough to satisfy Rosen’s love of basketball. He also coaches the game at Pinecrest Elementary through MiamiDade County Sports. “This is my first year,” he says. “We meet two times a week for practice and one day a week for games.” Rosen coaches the team made up of kids from first to third grades, along with three teens who attend Coral Reef High. The team doesn’t win many games, but the kids have fun. Rosen says he hopes to coach again, depending on his schedule. This is not the first time Rosen has dealt with kids, as he worked as a counselor during the summer at the Dave and Mary Alper Jewish Community Center summer camp. However, this is the first time that he has tried to teach kids how to play a sport. At school, Rosen has been an officer in Key Club since his freshman year. He was just elected next year’s president and he’s also going to be vice president of the National Forensic Team (debate). He is a member of Mu Alpha Theta, the Social Science Honor Society and the Science National Honor Society. He also won the Outstanding Debate Student Award in his freshman and sophomore years, and the Outstanding Service Award this year. Rosen played lacrosse for Palmetto for two years, but says he just could not continue because of his hectic schedule. He hopes to return to the lacrosse team next year. This summer, Rosen will take classes at Northwestern University and work on a clinical research internship.

MICHAEL GREY Although he is just finishing his junior year at Palmetto High, Michael Grey already has his own charitable foundation. Grey runs the Michael Grey Wheelchair Repair Fund, which works with the Community Committee for Developmental Handicaps. Grey became interested in the problems of the handicapped when he had reconstructive surgery on both feet. After the surgery, he was in a wheelchair for 22 weeks. During that time, he experienced the challenges people in wheelchairs face. “It’s a completely different side of life,” he says. Because of his experiences, he wanted to do something to help students who are wheelchair dependent. “Students who want to go to school here must have wheelchairs that meet certain specifications,” Grey says. “If it breaks, you have a kid who can’t get an education because he can’t go to school.” Often, the very students who need the most help are not financially able to pay for the repair costs. So, as his bar mitzvah project when he was in the seventh grade, Grey organized a poker tournament at Bet Shira to raise money to be put toward wheelchair repairs. That tournament has become an annual event. “For the past five years, we’ve raised around $10,000,” he says. “The community committee, they contact the per-

son, find out the part that they need and they reach into the fund. The kid is allowed to go to school. It really has an impact. There are no other funds available right now that they can apply for.” The poker tournament usually starts with 10 tables of players. It’s tournament style, the same as the World Series of Poker. “It’s a full-day event,” he says. “You help a really good cause. It’s something people of all ages can do and it’s an event that’s open to the entire community.” Grey says they usually draw 50 to 60 people for the poker tournament and side mahjong tournament. They ask for a donation from those who want to play, somewhere around $18. They also sell pizza to participants for $1 a slice and they solicit prizes from community sponsors. “Best Buy came in and gave prizes,” he says. “”There is a Simon (Mall) gift card. It can range from $25 to $75 and what place you get in the tournament.” The tournament will continue even after Grey goes on to college. He already has a friend who will take it over. The poker tournament is not the only community service Grey performs. This year he was the regional coordinator for community for the B’nai B’rith Youth Organization that meets at the Dave and Mary Alper Jewish Community Center. The BBYO works closely with the Greater Miami Jewish Federation and they deliver food for the Jewish holidays to the elderly who cannot get out and get the traditional items to celebrate the holidays. “This year I worked with the National Honor Society as vice president for service,” Grey says. “Next year, I’m president.” NHS this year helped decorate the children’s wing at Baptist Hospital for the holidays and they helped the Community Partnership for the Homeless decorate for Valentine’s Day. Grey is also an officer in Key Club. This year he was director at large and next year he will head up the public relations for the service club. His senior year will be busy. Along with applying for colleges, Grey will be on the Pinecrest Youth Advisory Council created by Mayor Cindy Lerner. “We’re trying to get the youth of Pinecrest involved on the local level,” he says.

NOAH GRAY The 2008 Presidential elections inspired Palmetto High School junior Noah Gray to go out and make a difference. “I’ve always been interested in politics and filmmaking,” Gray says.

After he watched films by Michael Moore and Morgan Spurlock, Gray realized he could use the media to make people think and speak about a cause. The 2008 presidential election was the cause and the vehicle was a documentary called Virgin Voting. “I spoke with all the presidential candidates except Barak Obama and John McCain,” Gray says. “I also spoke with college students. It became more than just a video, it became a whole project.” For the documentary, Gray went to as many political events as he could, including the presidential debates at the University of Miami and one at Hofstra University. “It was pretty much my camera in my right hand and my microphone in my left,” he says. Gray entered versions of the video into several contests, including the C-Span StudentCam 2008, where it received an honorable mention. It was an official selection of the Student Television Network Film Festival 2009 and at the Miami Children’s Museum Film Festival it took the top prize for Best Picture-High School, Best Cinematography and Best Documentary. But it didn’t stop there. While attending

eight Obama events, several McCain events and a Chris Dodd press conference, Gray met a reporter from the Associated Press who decided to write a story about his project. When it hit the wires, Gray was featured on Fox, CBS and several local stations. They were interested because he was only 16 years old at the time; too young to vote, yet challenging other young people to step up and have their voices heard at the ballot box. Doing the documentary altered his thinking. “Things were changing in my mind,” he says. “I wanted to make it more than just a film. I wanted to get people to actually vote.” So he started the website <Virginvoting.com>. He partnered with the retail chain Hot Topic and had tee shirts made that were sold in stores around the country. “I also decided to come up with the Virgin Voting, Doing It for the First Time video contest,” he says. “I encouraged young people from 18-24 to document their first time voting and upload it to the Virgin Voting You Tube page.” He paid for the $900 in prizes out of his

own pocket. He sent the AP reporter an email about the contest and after that story ran, he was interviewed on CNN, which led to CNN asking him to become a youth correspondent. So, for the rest of the election season, Gray made 10 reports for CNN that also aired on the Palmetto TV station. Without tickets or credentials, Gray went to Washington for the inauguration and produced a piece for CNN. He also entered another C-Span StudentCam contest, this one about sending a message to the president. His piece won third place out of 1,000 entries. The Special Olympics had him speak at a Youth Activation Summit on how to use different kinds of media to get your message across. Afterward, he met Arnold Schwarzenegger, his wife, Maria Shriver, and Tim Shriver, head of the Special Olympics. This summer, Gray will intern with the Special Olympics and he says he will continue to get involved in causes. “I’m a born activist,” he says. “I see problems and I want to tackle them.”

some other triggers, for homeowners with direct access to water to be required to hook up. Phase Two of this project is comprised of nine additional sections of the Village representing another approximately 200 homes without access to water. It is going through the final planning and approval stages and is intended to be started immediately following Phase One while the contractor is still onsite in the Village. Whether all or only a portion of Phase Two can be finished depends on the amount of money we have available at that point. Any further immediate expansion of this water project is now in serious doubt due to lack of funding. By utilizing state lobbyists in the past, the Village has been successful in obtaining $1.5 million in state funding for our water project over the past two years. The fees paid to the state lobbyists amounted to about $240,000. Unfortunately, in this crazy state budget year, our Village was one of many funding projects cut on the last day of the legislative session. The 1.5 million dollars obtained from the state combined with monies originally pledged by Miami-Dade Water and Sewer (all our own tax money, by the way) has carried us this far without relying on the Village general revenue funds or any type of special assessment on homeowners. We are told that money may be available from the federal government for projects like this one, perhaps stimulus package monies. The reality of that representation needs to be tested. The Village Council recently authorized the Village Manager to issue a request for proposals from federal lobbyists to seek funding opportunities and grants from the feds. The

In the meantime, I urge Miami-Dade Water and Sewer to step up to the plate and provide additional funding to the Village so that this worthy project can continue without interruption. Village Council will have to weigh the cost and return of such lobbying services. But, on the other hand, if we do not seek other funding opportunities, we may never know if they really exist and how valuable such opportunities may be. In the meantime, I urge MiamiDade Water and Sewer to step up to the plate and provide additional funding to the Village so that this worthy project can continue without interruption. After all, Miami-Dade Water and Sewer’s money is our public money, too, and when residents hook up, it benefits from the income stream created by the quarterly fee it charges the homeowners for the water. Village police continue crackdown on water-use violators BY RON BEASLEY Even though the rainy season has arrived, South Florida remains under a severe drought and restrictions on water usage are in effect, imposed by the South Florida Water Management District. Meantime, Village police officers have issued more than 300 citations for water-use violations since the restrictions went into affect on March 20. Police Chief John Hohensee says his officers have been citing people they have either witnessed violating the restrictions or as a result of calls from residents making complaints. “I think our enforcement is more from the observation of the officers than from complaints,” he said. “But we do get a fair number of reports.” Hohensee said a firstoffense will result in a $75 Chief John Hohensee fine, while a –––––––––––––––––––– second violation nets a $250 fine and a third citation results in a $500 penalty. “It can get very expensive if you persist with the violation,” Hohensee said. “But, for the most part, people understand the importance of protecting our water supply. No one likes to get a citation – traffic or water violation or any other type — but people understand the necessity of it. Quite frankly, for the number of violations we’ve issued, there have not been many complaints.” Hohensee pointed out that people who use wells for their water supply are also bound by the water restrictions. “It doesn’t matter if you are using a municipal supply or your own private well,” he said. “We’re all drawing from the same water table. And ignorance is no excuse, because the district has done a pretty good job of trying to educate people that even if you aren’t using municipal water, you’re still depleting the water supply that’s in the ground.” Hohensee said he believes the water restrictions will remain in place far into the future. “Certainly, as long as the South Florida Water Management District feels that it’s imperative that we enforce

the water shortage ban,” he said. “I know that there tends to be some fluctuation in the water table and the district gets more concerned as those water supplies diminish. If we have a wet season, they may feel that some relaxing of the restrictions might be in order, but my understanding is that the restrictions are going to remain in place permanently. “We have just grown so much and there is such a large demand for water that keeping the restrictions in place, managing the amount of water that’s consumed and – if you believe the people that are the experts – that plants can actually adjust to less frequent watering, all of those reasons would suggest that there is reason for keeping them in place permanently.” WATER RESTRICTIONS Current SFWMD regulations allow even-numbered residences to water plants and lawns from 12:01 to 10 a.m. and again from 4 to 11:59 p.m. on Thursdays and Sundays. Odd-numbered addresses have the same hours on Wednesdays and Saturdays. Limited hand watering (10 minutes per day for stressed plants with a hose equipped with an automatic shut off device) is also permitted. New landscaping can be watered without regard to restrictions on the first day it is installed. Landscaping that has been in place from two days to 30 days may be watered on Mondays, Tuesdays, Wednesdays, Thursdays, Saturdays and/or Sundays during the hours allowed for regular landscape irrigation. Landscaping that has been in place from 31 days to 60 days can be watered on Mondays, Wednesdays, Thursdays and Saturdays during the hours allowed for regular landscape irrigation. Additional watering days can only be used to benefit new landscaping. An entire irrigation system zone may only be watered if it contains at least 50 percent new landscaping. Less than 50 percent, use targeted or hand watering. If a resident has just planted one or two trees or a small area (less than 50 percent of what is being watered), then they must target only the newly-planted landscape. All wasteful and unnecessary watering is prohibited and all regulations are subject to change if the SFWMD deems the crisis has worsened and new restrictions are necessary.

The new bistro is located at 10205 S. Dixie Hwy. The first Anthony’s location opened in Fort Lauderdale in 2002 and the company has since expanded quickly around the state. ‘Applause Your Paws’ and the Doggie Dee-va BY LEE STEPHENS Denisa “Dee” Canales Hoult is the owner of Applause Your Paws, a dog training company in Miami that focuses on education for dog owners. With an emphasis on building a stronger relationship between human and canine, Applause Your Paws training techniques focus on teaching dog owners how to better communicate with their dogs to build trust and mutual respect. Through positive reinforcement training, Applause Your Paws specializes in modifying many common behavioral issues including aggression and excitability. Hoult is certified through the Certification Council of Pet Dog Trainers, an international testing and certification program for professional pet dog trainers. The CCPDT certification program is based on humane training practices and the latest scientific knowledge related to dog training. Competence and continued growth in training practices is promoted through recertification every three years. Hoult is just one of two trainers in MiamiDade with this credential. Hoult is also a professional member of the Association of Pet Dog Trainers, an organization of individual dog trainers committed to becoming better trainers through education. Hoult has been involved in Miami-Dade’s animal community for eight years through multiple animal organizations, includ-

ing Paws 4 You Rescue, a non-profit, mixed-breed dog rescue. Proceeds will be used to fund a special needs baseball field for mentally and physically challenged children, summer camp and baseball scholarships for underprivileged children and capital improvements to the Danny Berry baseball facility. Can you explain the new legislation regarding student aid? In September, Congress approved the largest overhaul of education funding in the past five decades. Subsidies to lenders were slashed by 20.9 billion over the last five years and have been slashed and redirected to boost financial aid to students and give them reduced interest payments on their loans. This bill would also offer debt forgiveness for students who enter certain public sector jobs and invest $510 million in minority colleges. Passage of the College Cost Reduction and Access Act is extremely significant. College cost has soared over 40 percent in the past 5 years. This bill would halve interest rates for students starting July 1, from 6.8 percent to 3.4 percent. At the beginning of the 2008-09 academic year, the bill would begin increasing the maximum Pell Grant from $4,300 to $5,400 by 2012. Starting by July 1, the bill will cap students’ monthly federal loan repayments to 15 percent of their discretionary income. Also, $285 million would be funneled to the Upward Bound College-Prep Program. I’m a junior and watching all my friends who are seniors do their college applications. Why don’t they just all do a Common Application and be done with it? It’s not that easy. The majority of schools who do use the Common Application will send you a supplemental application, which has their information and perhaps additional essays. In reality, if the school has their own application to begin with, you can just do that and it will

take the same amount of time as the Common Application and a supplement.

What is the Miami Dade school system using instead of class rank? We now have a system that gives honors to a greater range of students. Students who graduate in the top five percent of their class will receive Suma Cum Laude honors. Students in the top 10 percent will be awarded Magna Cum Laude, and the Cum Laude designation will go to the top 15 percent of the students or any student who earns a grade point average of 4.0 or better. With all of your experience in reading college applications, could you please give me a few relatively easy essay questions that I might find on next year’s applications? The following are questions found this year on many applications that the majority of my students have found quite easy, although you may not. One: “The university takes pride in the contributions made by all members of our community. Briefly describe what you believe other students could learn from you both in and out of the classroom.” Two: “Identify one person who has had a significant influence on you and briefly describe that influence.” Three: “Briefly describe a significant event or circumstance and how it has impacted your personal and academic development.” When first reading these essays they may seem difficult to you, but in comparison to other essays, these are very easy. HISTORY BY DR. SCOTT KENWARD PART II Reaction to the death of Victor Chapman was enormous, both in France and in America. A funeral service was held at the American Church in Paris on July 4, a fitting accident of date that lent all the more international significance to the occasion. “America has sent us this sublime youth,” wrote a French woman in attendance, “and our gratitude for him is such that it flows back upon his country. Never since the outbreak of the war has public sentiment been more deeply aroused.” Chapman was posthumously awarded both the Médaille Militaire (Military Medal) and the Croix de Guerre (War Cross) for acts of bravery and heroism in action against an enemy force. Great-hearted, loyal, reckless for a friend; Not counting risks, cool handed, clear of sight, He gave himself to serve a lofty end, And, like an eagle soaring in the light, On wings unruffled by the wind’s chance breath He sought, and seeks his goal with steadfast flight, Victor, indeed, in name, in life, in death! — John Heard, Jr. CHAPMAN FIELD On Nov. 15, 1918, four days after the signing of the armistice that ended World War I, the Cutler Aerial Gunnery Field airfield was formally renamed the Victor Chapman Military Reservation by General W.L. Kenly, Chief of the Army’s Division of Military Aeronautics. The base was declared surplus in 1921 by the War Department and was to be put up for sale. Dr. David Fairchild, a plant explorer in charge of the Bureau’s Office of Foreign Seed and Plant Introduction, took interest in the abandoned base and believed that it could be developed into an “Ellis Island for plants” — a place where sensitive plants could be bred for resistance to colder temperatures prior to their introduction to areas of the northern

The story behind Chapman Field U.S. On April 26, 1923, the first trees were planted at the new USDA Plant Introduction Garden. The USDA acquired 95 acres of the old Army base initially, added another 65 acres in 1935, 37 more in 1947, and now occupies 197 acres on the northwest section of the original property. The station, renamed the Subtropical Horticultural Research Station in 1972, has evolved into a facility with three primary missions: To serve as a developer for improved and better environmentally-adapted tropical plants, including fruit and ornamental trees, for use by growers and other research facilities, to study the Caribbean fruit fly, which invaded Florida in 1965 and attacks many fruits, and to investigate changes to local agriculture that would result from the restoration of a natural flow of water in the Florida Everglades. As World War II began, the Army Air Corps planned to build a major air base in Dade County. The Chapman Field site was immediately considered for revival and the effort was supported by local land owners, real estate brokers, businessmen and politicians. Dr. Fairchild and Col. Robert J. Montgomery, an attorney and horticulturist who owned 80 acres at the intersection of Red Road and SW 120th Street (Montgomery Drive), led the fight against redevelopment. They argued that the thousands of acres of property that would be required for the new base would require flat land, something that the uneven coastal ridge of the area couldn’t provide. Furthermore, the area was rapidly developing, increasing property values and rendering the acreage prohibitively expensive for purchase. The Air Corps

agreed and as a result, we had the development of Homestead Air Force Base rather than Chapman Field Air Force Base. In August, 1942, the Army leased the airfield at Chapman Field to the EmbryRiddle Company for training of both civilian and military pilots. Women, including some University of Miami coeds, participated in the training at Chapman Field as WASPs (Women’s Air Force Service Pilots). Embry-Riddle eventually relocated their flight school to Opa-locka in 1947 after Dade County turned down a request to make Chapman Field a commercial airport. In November, 1947, the Chapman Field property that was not in possession of the USDA was declared surplus by the federal government. The University of Miami acquired 150 acres that included most of the old airfield and hanger area. Dade County received the remainder of the property to the northeast. Finding the Chapman Field property either unsuitable or too expensive for its purposes, the UM leased 128 acres to developer Ben Cooper in 1956. The following year, after Cooper agreed to spend $250,000 in improvements to the adjacent park property, the county leased him an additional 48 acres and he used the combined properties to build King’s Bay Yacht & Country Club, a semi-private golf course and clubhouse, for the neighboring community.

The Club property changed hands several times over the next 30 years and eventually Edward Easton, Armando Codina and Jeb Bush partnered to form Deering Bay Associates, redeveloping the property in 1991, now 220 acres, into the Deering Bay Yacht & Country Club. Dade County had ambitious plans for Chapman Field Park in 1949, including a swimming beach, hiking trails and a boat marina. Envisioned as a companion to Matheson Hammock, development of the park was doomed from a lack of accessibility to the property, title acquisition problems, a lack of development funds and encroaching residential development. The county built a trash and recycling center for household trash, tree and yard cuttings and demolition debris on the northwest edge of the park, which is still in use today. Approval of the $3.9 million “Decade of Progress” bond issue in 1972 infused new life into the park development project. A 200-slip marina, bait and tackle facilities, dry boat storage, a boat ramp, utilities, restrooms and picnicking facilities were all planned initially, but the concerns of neighbors and environmental issues stalled and eventually dramatically altered the plan. near the park entrance, but the idea of a marina was abandoned in favor of boat ramps that would serve more people, and more ecologically friendly ideas were developed, including canoeing and sailing on the manmade lakes and canals. Between 2002 and 2006, the ball fields underwent extensive remodeling through the use of $580,000 in funds provided by the South Florida Water Management District (SFWMD). New clay and grass infields, dugouts, batting cages, lighting and shaded bleachers have all been completed. In November, 2008, the SFWMD Governing Board approved investing over $300,000 in additional funds to help restore the 566 acre, Chapman Field Park. The park project is intended to achieve several objectives, including

clearing exotic vegetation, removing solid waste, re-establishing red mangroves, restoring historic wildlife habitat and improving water quality in Biscayne Bay. In the decades since those 850 acres of wilderness were secured, the properties of Chapman Field have maintained the spirit of Victor Chapman. Likely too humble to be comfortable with the honor of having an air field named for him, Victor, ever the adventuring outdoorsman, would have certainly appreciated the diverse uses for the natural beauty found at the intersection of the Villages of Pinecrest, Coral Gables and Palmetto Bay. Dixie Hwy., has an expansive schedule and can accommodate even more adult students. “We have six classes a day,” Cocco says. “We also offer a few classes on Saturday mornings and I’m offering a womens’ only self-defense class twice a week on Tuesday and Thursday mornings from 9:15 to 10:15.” Cocco is a sixth degree black belt. “Black belts in Tae Kwon Do go to ninth degree,” he says. “Fourth is like a masters degree, fifth is like a doctorate,” Cocco taught both physical education and martial arts at several community centers, including the Dave and Mary Alper Jewish Community Center in Kendall for the past 10 years. He has also worked at private schools such as Temple Samu-El, Temple Beth Am and Bet Breira. He was the aftercare director at Bet Breira for several years. At the same time he’s running his own school, Cocco is working on a degree in exceptional student educa-

tion. He only has a year to go before he graduates. Even though it’s been a struggle juggling his college classes and opening his gym, he says he loves having his own school. “The school is incredible,” he says. “We offer a lot of services. I have 34 classes a week. We do different fundraisers, and different charitable events. We do competitions. Our kids continue to excel. We’re trying to prepare for the Junior Olympics and U.S. Nationals.” Tae Kwon Do is an official Olympic sport and those who place in the top four at the nationals can go to the Olympic team trials or to the Pan American Games or the World Championships. “Our kids are gearing up and preparing,” Cocco says. “We have a great group and a great program.” While they are not ready yet, going to the nationals is the eventual goal. Cocco says he has some students who are very close to a black belt and he thinks several students could be eligible for the U.S. nationals next year. At the same time, Cocco also teaches martial arts to special needs students. “We have one class on Saturdays dedicated to special needs students,” he says. “If I have an autistic child, depending on what level of autism, he may be able to participate in my regular program.” For information, call 305-232-4376.

Derelict vessels are more than eyesores BY RODNEY BARRETO Chairman, Florida Freshwater Fish & Wildlife Commission Recreational boating is huge business in Florida. With so much water and year-round boating weather, it’s no wonder so many people in this state own boats and routinely take to our waters. As pleasurable as recreational boating can be, it’s not all fun and games. Owning and operating a boat is a huge responsibility. Vessels, like cars, need proper care and maintenance. If they don’t get it, they’ll run poorly or break down. When a vessel breaks down in the middle of the Intracoastal Waterway, a river or lake, it’s not always so easy to get it back to the marina or boat ramp. And, if the owner or operator is unprepared, it’s a good way to ruin a day in a hurry. Boats that are stored on the water — kept in a slip at a marina or tied to a mooring buoy — present other challenges for owners. If the vessels are improperly secured, they can break away during hurricanes or other severe storms. Sometimes these loose boats run aground or sink and become hazardous to boaters and the environment. When this happens, the vessel owner is responsible for finding and retrieving the boat as soon as possible, at his or her expense. Responsible boat owners know this and do what’s necessary to remove the hazard quickly. However, not every boat owner takes this responsibility seriously. Since removing a sunken vessel or one that has run aground is a lot more complicated and expensive than towing a broken-down car, some people choose to leave the boat in the water. In the eye of the law, these boats then become abandoned or derelict vessels. These vessels are more than ugly eyesores. Partially submerged vessels, or those submerged just below the surface can be real navigational hazards. In tidal waters during low tide a sunken vessel might be clearly visible, but when the tide comes in, it disappears just below the waterline. Many unsuspecting boaters have come to grief under just such circumstances. At the same time, damaged vessels can leak toxic chemicals and cause environmental concerns in which plants

FWC REPOR T and animals can die. So what happens to these unwanted, abandoned and potentially dangerous vessels? Eventually, most will be removed. But it’s a long, expensive process and taxpayers foot much of the bill. Here’s how it works: Law enforcement officers with the Florida Fish and Wildlife Conservation Commission bear responsibility for finding abandoned and derelict vessels. Once they find the vessels, they attempt to locate the owners. When they do, they work with boat owners to remove the vessels as quickly as possible. If the owners refuse to cooperate, they may face civil or criminal penalties, including possible fines and jail time, and ultimately will have to pay for the cost to remove the vessel. If vessel owners cannot be found, the taxpayer ends up footing the bill. The longer a derelict vessel sits in the water, the more it will likely cost to remove it. And that cost can vary from a few thousand dollars to hundreds of thousands of dollars. And, in many situations, moving a derelict vessel can cause environmental damage if not done properly. Last July, the Florida Legislature appropriated $1.55 million to the FWC to remove derelict vessels around the state. The FWC has contracted Post, Buckley, Schuh & Jernigan (PBS&J), a full-service planning and engineering consulting firm headquartered in Tampa, to assist with removing them. So far they’ve removed 22 derelict vessels from around the state. By the end of this fiscal year, June 30, the FWC hopes to remove 75 more, for a total of 97. If you know of a derelict vessel please report it to the FWC at 888-404-3922. An FWC officer will be assigned to investigate and initiate a derelict vessel case file.

Aston Martin DB9 sparks memories of James Bond Ron Beasley AUTOMOTIVE EDITOR

LET’S TALK CARS I had my James Bond moment recently when they delivered a gorgeous new 2009 charcoal grey Aston Martin DB9 as our test car for the week. Aston Martin is one of the most storied names in automotive history. Founded in 1913 by Lionel Martin and Robert Bamford, the company has a checkered past of fading in and out of bankruptcy and passing through a series of wealthy owners. The name was derived by combining one founder’s surname with the Aston Hill climb near Buckinghamshire, England. Today the British luxury sports car manufacturer is controlled by a joint venture company co-owned by a pair of Kuwaiti investment companies and English businessman John Sinders. Ford Motor Company owned the company from 1994 until 2007 before selling it for $848 million, but hanging on to a $77 million stake.

Any James Bond aficionado will tell you that Aston Martin is 007’s preferred automobile. The car has been featured in many Bond films, which only served to heighten the Aston Martin mystique and appeal. Bond’s cinema love affair with the car started in Goldfinger (1964) when he drove a silver DB5 and continued in Thunderball (1965) and On Her Majesty’s Secret Service (1969), then later in GoldenEye (1995) and Tomorrow Never Dies (1997). After an interlude with Lotus cars, Bond returned to Aston Martin and drove a Volante and a Vantage in The Living Daylights (1987), and a Vanquish in Die Another Day (2002). In Casino Royale (2006), he drives the classic DB5, which becomes his personal vehicle after winning a poker game, and the new DBS in the latest Bond flick, Quantum of Solace. Our test car, a sleek and beautiful charcoal gray DB9 (The initials honor David Brown, who bought the company in 1947 and guided it until 1972, when it again went through a series of new owners.) is one of the best selling Aston Martins ever, with more than 10,000 sold around the world since its introduction in 2003. For 2009, the DB9 retains its classic design, but includes updates in both per-

formance and dynamics. The DB9 is perfectly proportioned, with a long hood and two-seat cabin that create a recognizable silhouette with short front and rear overhangs. A wide track pushes out the rear wheels and enhances the design and styling. Under the hood, there’s a 6.0 liter 470 bhp (20 more horses than last year) quadcam 32-valve engine mated to a refined automatic transmission that has a new hydraulic control unit for quicker and more precise low-speed gear changes and improved low speed maneuverability.

Downshifts in the Sports mode are also enhanced as a result of engine speed matching, which delivers smoother and more rapid gear changes in both paddle shift and drive mode. How is Florida going to reduce class size as mandated by law for school next year? • Asking students to take courses online. • Placing partitions in classrooms. • Mixing students of different ages in the same class. • Adding portable classrooms. • Stripping teachers of their classrooms. • Turning students away from some classes altogether.

State legislature should revise medical malpractive laws

LAW ––––––––––––––––––––––– BY BRETT PANTER ––––––––––––––––––––––– Is a hospital financially responsible for its doctors? The short answer is no. The Florida Supreme Court concluded in a lengthy opinion that “although it may be sound public policy for the legislature to impose an obligation on hospitals to monitor the financial responsibility of physicians who are granted staff privileges, it is outside this Court’s purview to imply a statutory cause of action against hospitals where none was intended by the legislature.” When you go to the hospital, you are often seen by physicians who you don’t know and you have no relationship with. Often times these are doctors with staff privileges. This means that those doctors work at the hospital and oftentimes have their own private offices, and you may think that the hospital would be financially responsible if those doctors are negligent in the care that they provide to you and your family. Think again, unfortunately, financial responsibility is the exception rather than the rule. Therefore, every time you enter the hospital, you may be treated by doctors who you later learn were considered independent contractors and/or doctors with staff privileges who the hospital does not accept any financial responsibility for. Unfortunately, this provides many patients with no financial remedy for malpractice committed upon them and their families. This is not to say there are not financial responsibilities created by the legislature for doctors. However, this legislation has a multitude of weak links in it. Number one, doctors are required to carry a minimal amount of insurance, which is $250,000. The physicians are also given alternatives to obtaining medical malpractice insurance; the alternatives include establishing and maintaining an escrow account in the amount of $250,000 or obtaining and maintaining an unexpired irrevocable letter of credit in the amount of $250,000 pursuant to Florida statutes. The reality of this is that doctors working inside the walls of most of the South Florida hos-

pitals have very little checks and balances if they fail to comply with these requirements. It should be noted that these financial responsibility requirements are mandated as a condition to maintaining staff privileges (although often not enforced). The Supreme Court has determined that there is no duty on the hospital to ensure physician compliance with these financial responsibility laws. The Supreme Court of Florida has stated that there is no recognized common law duty on the part of a hospital to monitor the financial responsibility of physicians and thus no common law cause of action against hospitals for breaching that duty. Arguments have been made to the Supreme Court that hospitals should have a duty to monitor the compliance of their doctors with hospital staff privileges so that patients could be adequately compensated if doctors committed malpractice. The Supreme Court has struck down this argument when interpreting the medical malpractice statutes and rendered an opinion stating that this was not the intent of the legislature. The Supreme Court has also declared that a physician who violates the financial responsibility requirements is subject to significant administrative penalties, including the possible revocation of his or her license and other discipline. The prospect of these administrative penalties provides a strong incentive to ensure that the physicians do comply with financial responsibility laws. Nevertheless, we have encountered doctor after doctor who fails to comply with the financial responsibility laws and, faced with a lawsuit, threaten their patients with bankruptcy and asset protection. Considering the current legislative scheme and the Supreme Court’s interpretation of the legislation, it seems that the legislature should take another look at the current medical malpractice laws and how they fail in many respects to provide an appropriate remedy despite negligence and harm that may be committed on Florida’s residents.
