Their solicitor´s firm were totally unconcerned and in fact one senior member of staff who was originally working for the legal firm moved to work for Monte Puchol raising concerns of collaboration. these plots believing all was well, but unbeknown to them the licences were never granted to build. The next thing Rodney and Brenda heard was that they needed to pay 10,000 euros per month, which was described as ‘instalments’. However, as little or no work had started Rodney and Brenda became suspicious. They refused to pay and returned to see Monte Puchol. After trying to ‘fob’ them off with excuses, the company finally admitted it was having ‘difficulties’ with the development. Rodney requested that their money be returned immediately, but instead was offered a different property but told it was an additional 40,000 euros over the price of their initial house and this house was only in the early stages of construction.

The builder eventually declared bankruptcy, leaving their clients thousands of euros out of pocket. Partners Rodney Fildes and Brenda Kershaw came to Spain in 2003 and fell in love with a rural plot to be developed by Monte Puchol in the Jalon Valley. The company referred them to a local solicitor, which, given the couple were still living in the UK at the time, arranged power of attorney to be able to complete the necessary steps on their behalf.
