Colmore BID’s proposed third five year term will generate over £5m of additional business led investment. We’ve been listening to our members on how we can continue to ensure our District is the beating heart of business in Birmingham. As one of the UK’s leading Business Improvement Districts, we intend to continue our current work and to add new and ambitious projects to enhance the District. Proposed third term runs from 1 April 2019 to 31 March 2024 1.5% BID Levy, generating over £1 million annual investment. Boundary will be expanded to include Paradise Maximum £25,000 levy cap Ballot will run from 15 October 2018 to 20 November 2018, and the result will be announced 21 November 2018

CHAIR’S WELCOME As Chair of the Colmore Business Improvement District (Colmore BID) I have had a front row seat as Colmore Business District has become a thriving, nationally recognised business community and the commercial heart of Birmingham. Across our two five-year terms Colmore BID has invested over £8 million to achieve and expand on our goal of being the place to do business in Birmingham. Our reputation for excellence has led to us expanding our BID boundary to include the landmark Paradise development. The credit should go to the Board and Executive Team who continue to deliver new projects, exciting events for workers and visitors, and improve local services for Colmore BID’s members. The Colmore Food Festival is now an integral part of the city’s social calendar, attracting 30,000 hungry patrons. During this BID term, the Colmore BID Ambassadors have welcomed over 53,000 visitors, and our security team has dealt with over 3,500 incidents of anti-social behaviour. Colmore BID has also leveraged £10 million from an investment of £1.4 million for the District’s public realm – a return of over

700%. For these reasons and more, on 15 October 2018, we will be asking businesses to Vote Yes for our third five-year term. We have been talking to members and partners about how Colmore BID should evolve to meet the priorities you have today and may face in the future. I am delighted to present the outcome of this in our Business Plan for 2019 to 2024. I am excited at the prospect of a third term for Colmore Business District and look forward to delivering our ambitious plans in the coming five years.

EMBRACING PARADISE After engaging with the Paradise Development Board

and consulting our members, Colmore BID is proposing to expand the BID boundary for our third term to embrace one of the key developments in the city. Paradise is a natural extension to the professional core with its additional Grade A office space, and Colmore BID’s aspirations are a natural fit to integrate the development into the city. Paradise will also offer key pedestrian routes through the city, extending the east to west walking route across the city centre with an improved public realm experience.

CONSULTING OUR LEVY PAYERS For the past twelve months, Colmore BID has given Levy Payers the opportunity to have their say on how our next term can improve Colmore Business District. The results have formed our Business Plan for 2019 to 2024. To do this, we have: • Published Ambition magazine, highlighting key projects and setting out potential future projects, including options relating to our levy and boundary. • Held 21 focus groups • Engaged in 150 hours of one-to-one levy payer meetings • Met with key external stakeholders • Distributed 1000 copies of the BID 3 Consultation document • Ran a mid-term review in 2017 to provide initial guidance for our 2017/2018 consultation

BID LEVY CHANGES An overwhelming message from Levy Payers was for Colmore BID to continue to be ambitious. It was recognised that this requires suitable investment. Three levy options were presented to members: • Remain at 1%, • A ‘status quo’ 1.25%, or • An increase to 1.5%. The feedback told us to increase our levy to 1.5% and reflect this in an ambitious business plan with a clear remit to invest in projects that deliver a safe and secure business area and an improved street scene. The change will result in an annual BID budget of over £1 million, but 84% of current members will pay cumulatively less in our third term, compared to our second term because of the reduction in their business rates. 10 12

OUTSTANDING PLACES Colmore BID looks after the physical aspects of the District by delivering, influencing and partnering on public realm projects to make an outstanding place made up of outstanding places. As well as our standard services such as deep cleaning and floral features, Colmore BID has held an ongoing commitment to improving the public realm to leave a lasting legacy of ambition and investment made by businesses across Colmore Business District.

Colmore BID will continue to build on public realm successes such as Church Street Square and Colmore Square, delivering transformative projects that redefine the District, while adding value to the everyday maintenance of our streets.

Public Realm The Snowhill Spatial Masterplan was the culmination of a detailed process of scoping, designing, and planning achieved in a dynamic, multi-partner environment. There are now two projects ready to be delivered because of this work: Cornwall Street will be repaved to empower the pedestrian, like Church Street, and to encourage a new café culture and al fresco dining location in a low traffic environment. Colmore Row will see an enhanced pedestrian space to create a simple, safe walking route from Snow Hill Station to Great Western Arcade. Changes made to Livery Street will reduce traffic on Colmore Row by limiting right turning vehicles. Colmore BID will continue to be ambitious in the delivery of projects envisaged in the Snow Hill Spatial Masterplan, with the help of our partners and willing property owners.

ACCESSIBLE AND CONNECTED

Throughout Colmore BID’s second term, the Accessible and Connected working group has taken a research and evidencebased approach, leading on two major strategic pieces of work. The Snow Hill Interchange Plan was the enabling research that led to the Snow Hill Gateway public realm works.

Colmore BID cares for the experience of moving around the District. The BID influences and partners on policy and researches long term projects that help people and goods move to, from, and around the District easily. This is done by incubating and testing projects and by developing evidence on how best to deliver these to benefit Colmore Business District and the wider city centre.

Freight Consolidation Research was completed, examining how freight vehicle movements around the District can be rationalised to improve air quality. In Colmore BID’s proposed third term, the Accessible and Connected working group will, together with existing partners, continue to progress a freight programme, exploring a business-led solution in the District.

The thought leadership shown by Accessible and Connected members inspires work that goes on elsewhere across Colmore BID’s delivery plan.

Alongside this major research, smaller scale projects have focused on promoting Sustainable Travel and public transport through our Green Travel District programme. In BID 3 the group will continue to lead the area as a Green Travel District. Colmore BID’s partnership with BT Openreach will be maintained to explore the business case for any potential opportunities to improve broadband speeds within the District. Colmore BID will improve way-finding leading to, from, and within the District, especially around train stations, and work with partners to promote Birmingham city centre as a walkable city. Colmore BID will also encourage the use of cycling in the city centre and improvements to the related infrastructure.

PLACE MARKETING

Colmore BID has continued to deliver the annual award winning Colmore Food Festival. A two day celebration of over 30 of our local venues, attracting over 30,000 visitors each year. Colmore BID has increased its presence on social media. Our website has been redesigned and we have continued to create our Colmore Life magazine with a weekly e-newsletter companion.

Colmore Business District is as much a brand as it is a place. Colmore BID works to promote the brand outwardly, adding to the external marketing offer of the city. We also promote the brand inwardly, contributing to the vibrancy of “Colmore Life” for those who live, work and play here.

Other events delivered in our second term include our cinema club, Birmingham International Dance Festival and the continuation of our popular partnership with Moseley Arts Market.

Developing, promoting, and delivering great events, curating exciting and engaging experiences, and raising awareness of hobby and interest groups, are essential parts of marketing the District internally through the #ColmoreLife brand.

In Colmore BID’s proposed third term, our place marketing activity will focus on keeping members better connected with ‘what’s on’, and working to create more great experiences and events.

It is also important to promote Colmore Business District beyond the area, positioning us nationally as Birmingham’s ambitious business destination and showcasing how #ColmoreLife can contribute to retaining exceptional employees.

LEISURE AND HOSPITALITY The Colmore Business District is a great place to work, but it is also a great place to spend a lunch hour or relax after work. It is thanks to the growing number of bars, restaurants, and cafes in the area that people who work in the District are increasingly spending more of their leisure time here too. But more can be done to support this part of the ‘Colmore economy’, which is why Colmore BID has developed a new working group to do just this. In our proposed third term, Colmore BID will celebrate and highlight member businesses while developing a public realm environment to allow them to flourish, and continue to promote the #ColmoreLife brand.

SAFE AND SOUND We want everyone who works in or who visits Colmore Business District to feel safe and secure day and night. We work towards this by providing a visible team presence within the District, partnering on projects and delivering services that help to create a thriving and welcoming environment for everyone.

Our Security team works with partners to provide an active response to homelessness, helping both rough sleepers and businesses. Our Ambassadors help us to monitor the state of our street scene, and we partner with agencies to provide access to programmes on topics like counter-terrorism and business resilience.

As Colmore BID continues to promote the District as a premier UK destination for businesses: it is increasingly important to manage and monitor the on-street experience, so whether you are coming to work or visiting for the first time, the District makes a lasting, positive impression.

A Colmore Security Officer is employed to report and address anti-social behaviour and actively manage on-street activity within the District, such as begging and rough sleeping.

West Midlands Police to enhance the response to anti-social behaviour, and supported the delivery of Facewatch, an online reporting tool that was made available free of charge.

We work to tackle homelessness at a strategic level, for example, by working with Change into Action; a programme run by the Mayor of the West Midlands, that was part-devloped and supported by Colmore BID. We have also been working in partnership with Birmingham City Council to develop the Street Intervention Team.

The Security Officer scheme will be extended into the early morning and the evenings, and the Colmore Ambassadors will be maintained into our third term. We will continue to deliver Personal Safety Training sessions and offer targeted sessions for hospitality members operating later into the evening. We will also explore obtaining Purple Flag accreditation to highlight Colmore Business District as a safe night time destination.

Two Ambassadors are the eyes and ears of Colmore BID, providing a meet and greet service, visible reassurance and business visits. Counter Terrorism guidance and business resilience support is offered to relevant personnel. On-street charity collecting, or ‘chugging’, has been reduced thanks to continued partnership work. We have maintained strong links with

Colmore Chorus continues to grow, bringing people from across the District together through a passion for singing and music and our Community Games continue to facilitate friendly competition. Collective purchasing with First Mile has given local businesses a discount as a result of being part of the BID.

Over 35,000 people work in the Colmore Business District. This community of employees, business owners and decisionmakers are part of the fabric of the District. Outstanding people contribute to the personality of an outstanding place, which is why Colmore BID has, since 2009, offered people the opportunity to connect with social interest groups, find professional networks, and attend a range of events and activities designed to bring our community closer together.

SME support workshops have been delivered throughout the second term on topics from social media and tax advice, to team building and brand recognition. 84,000 copies of Colmore Life magazine have been distributed. The Bitesize email remains a key conduit of information. Over 30 workshops have been offered since 2015 free of charge, covering arts and craft, health and wellbeing. Colmore BID has supported Sifa Fireside by raising over £30,000 to support their crucial work in helping those sleeping on the streets of Birmingham.

BUSINESS MATTERS Colmore BID works to shape and articulate the strategic voice for Colmore Business District across the city, to make sure the collective voice of all businesses is received in the appropriate loci of influence. Birmingham city centre is in a process of renewal; from New Street Station and HS2 to the development of Paradise, it is more important than ever for Colmore Business District’s members to have a cohesive, collaborative and clear voice to make an impact on local, regional and national projects of importance and to work with others to amplify that message.

The Business Matters working group has been Colmore BID’s strategic business voice since 2009. It is a vital part of representing the collective view of Colmore Business District to Birmingham City Council, private developers, potential investors and stakeholders at a local and national level. The working group shapes Colmore BID’s strategic messages and amplifies other voices around the District to ensure the Colmore Business District community is well informed and able to influence the development of Birmingham.

Colmore BID has worked with the Greater Birmingham and Solihull LEP, by securing Local Growth Funding for our Snow Hill public realm schemes and continues to work with them on key strategic topics such as Freight and Transport.

Colmore BID has also developed a dedicated Property Owners and Agents Forum, in order to better engage with the needs of this key sector of the District.

Whilst taking a practical approach to tackling homelessness, we have played a key role in the strategic work done by the Mayor of the West Midlands and were one of the first members of the

BEYOND THE TERM A BID term lasts for up to five years, but creating, maintaining and upgrading an outstanding place is a process that cannot be limited by time. There are major projects emerging in and around Colmore Business District that will shape the face of Birmingham city centre for the foreseeable future. The Snow Hill Spatial masterplan has a raft of projects ready for when a suitable window arises. Other gateways being considered include improving north-south pedestrian connectivity from the retail core to the Jewellery Quarter and enhancing Edmund Street as an emerging east-west walking route connecting Snow Hill to Brindleyplace. The Paradise development will begin occupancy in 2019, HS2 at Curzon Street is planned for completion by 2026, with the St Mary’s Place Learning Quarter planned for beyond 2028. While we are unlikely to see these realised in Colmore BID’s proposed third term, it is nonetheless important for the District to be represented in discussions around these developments as they begin to gather momentum.

THE BID EXPLAINED WHAT IS A BID? A Business Improvement District (BID) is a defined area, within which local businesses work together to invest collectively in additional projects and services to improve their business environment. BIDs are established and operate in accordance with the Local Government Act 2003 and the Business Improvement Districts (England) Regulations 2004, having been voted for by a majority of businesses in a defined area for a maximum of five years. At the end of the term, a Renewal Ballot may be held. There are now over 300 BIDs across the UK, with 11 of these in Birmingham alone.

THE COLMORE BUSINESS DISTRICT Colmore Business District will be run by Colmore BID Ltd (Colmore BID), an independent ‘not for profit’ company, limited by guarantee. BIDs like Colmore Business District succeed because they are businessled, proactive and efficient. They do not replace baseline public services provided by organisations such as Birmingham City Council and West Midlands Police, but deliver additional projects and services and can swiftly respond to business needs. The award-winning Colmore BID was established in 2009 to create a thriving, nationally recognised business community around the Colmore Row area of Birmingham city centre, by delivering new projects, exciting events for workers and visitors and improving services for local businesses. Colmore Business District is now established as the commercial heart of Birmingham, with over 500 companies employing around 35,000 people and occupying over 5 million square feet of office space. A Renewal Ballot will be held to determine whether Colmore BID can enter a third term and continue for a further five years. If successful, Colmore BID will operate from 1 April 2019 to 31 March 2024.

Historic performance suggests that 98% of the billed levy will be collected each year, and this rate has been applied to our budget projections. If successful at ballot, the new BID term will run for five years from 1 April 2019 to 31 March 2024 (The Term). The BID levy will become mandatory for all eligible ratepayers.

The BID levy will be applied to all eligible nondomestic hereditaments with a rateable value of £10,000 or more. The liability for the levy falls on the liable party for non-domestic rates, referred to in this document as the BID levy payer. The eligible non-domestic hereditaments are those located within Colmore Business District, as defined above. The levy will be set at 1.5% of the rateable value for each hereditament, as assessed in the Local Non-domestic Rating List 2017, as at 1 January 2019. No subsequent adjustments will be made to levy charges for outstanding proposals not reflected in the rating list as at 1 January 2019, including any future rating revaluations that occur during the term. The exception to this will be variations to rateable value due to any change of use or a physical change to a property or hereditament including inter alia; new construction, merger, subdivision, extension and refurbishment which result in the issue of a new entry (entries) in the Ratings List current at that time. The Ratings List will be examined for new entries each year prior to the issue of levy invoices.

Business premises with rateable values below £10,000 will be exempt from the BID levy.

vii.

The annual levy payment will be capped at £25,000 for any individual BID levy payer or incorporated group of companies.

Where a property is taken out of the Rating List, the BID levy will apply up to the day before the effective date of removal and the annual BID levy will be apportioned accordingly.

There will be no relief for vacant, untenanted premises; the liability for the levy will fall to the property owner until a new lease is confirmed. Where at the time of ballot, there is no current occupational lease, the owner will be entitled to vote in the ballot.

viii. The levy will be invoiced annually in advance to all eligible BID levy payers for each chargeable period from April to March each year (The Chargeable Period). No refunds will be made. ix.

The number of hereditaments required to make a levy payment for Colmore Business District is estimated at 680.

Where a new hereditament is brought into the Rating List after the start of The Term, liable parties will be liable to pay a BID Levy based on the new rateable value applying to such hereditaments. Where a new assessment is brought into the rating list, the BID Levy will apply from the effective date as shown in the applicable rating list, meaning any new entries in the rating list after the 2017 list ends will be subject to the rateable value and effective dates in any subsequent list. The annual levy will be apportioned on a daily basis.

xiii. The levy will be discounted for charitable organisations at the same level as their mandatory rate relief (currently 80%). There will be no other discounts, exemptions or allowances. The BID levy will not be affected by the small business rate relief scheme or any discretionary relief granted.

xvii. Birmingham City Council will be responsible for the collection of the levy. Collection and enforcement arrangements will be similar to those for non-domestic businesses rates, with the BID Company responsible for any debt write off. xviii. The City Council has confirmed that it will collect the levy at no charge to the BID and absorb the initial set up costs for Colmore BID’s third term, as well as being liable for the levy on its own premises within the BID area. The BID is extremely grateful for the continuing support of Birmingham City Council.

xiv. The BID levy will be adjusted in line with the annual inflationary or deflationary factor for Local Non-domestic rate bills as calculated by HM Government. xv.

The BID levy is not subject to VAT.

BID GOVERNANCE AND MANAGEMENT Colmore Business District is operated by Colmore BID Ltd (Colmore BID), an independent and private sector led ‘not for profit’ company limited by guarantee (Company Number 6181225) and this will continue for the Company’s third term. The Board of Directors The Company has a Board of Directors who serve voluntarily (without remuneration) and are accountable to the BID levy payers. The Board upholds and promotes the vision and objectives of the BID and oversees all elements including financial and contractual arrangements, human resources, standards and compliance, operational and service delivery, setting strategic direction, performance management and acting as a key consultative and advisory body on BID services. If successful at ballot, a Board of Directors that provides representation for businesses in the District will be constituted. The size and structure of the Board will be agreed prior to the commencement of The Term. Current Board Directors will be invited to retain their Board positions. If there is a surplus of Directors, Directors will be invited to step down. Alternatively, a transparent process will be undertaken to deselect Directors. If there are any vacancies, applications will be invited and a transparent selection process undertaken to elect Directors from April 2019. Additional members may be co-opted as required. Professionals may be invited to attend meetings as 50

required, but will not have voting rights. If a Board position becomes vacant, applications will be quickly sought.

FINANCIAL MANAGEMENT

The Board will include two nominated members from Birmingham City Council. Both members will be Councillors. One member will be an appropriate elected member for the ward that covers the City Centre. The other will be the Leader of Birmingham City Council, or an appropriate, delegated cabinet member. The Board will also include representation from West Midlands Police. This member will hold the rank of Superintendent or above. The Board will include a representative from Transport for West Midlands (TfWM) (or the relevant transport authority for the West Midlands). This member will be Director level or above. Each year, the BID Board will elect a Chair and ViceChair from amongst its private sector members. Both must be a Director of the Company and can be reelected. Nominated representatives from Birmingham City Council, West Midlands Police and TfWM are not eligible to hold the role of Chair or Vice-Chair.

Together with Birmingham City Council, the BID will ensure that all businesses within and around the BID area, whether included as levy payers or not, are engaged with its work and that communications activities that encourage inclusivity are undertaken. Colmore BID extends its gratitude to Board Directors, both past and present, who have committed their time to support the BID for the benefit of the whole District.

BID MANAGEMENT A number of Working Groups will be established,

reporting to the Board and each consisting of a Board Director/Champion to drive forward the agreed priorities and programmes of the BID. Members of the groups will be drawn from businesses based in Colmore Business District. From time to time, members from outside of the District may also be invited to join a Working Group, where their particular knowledge and / or skills will be of benefit to the group. On a day to day basis, the BID will be managed through an Executive Team and led by a BID Executive Director, who will continue to work hard to support levy payers and deliver the additional projects and services required. The BID may need to purchase professional

Colmore BID will monitor financial performance at its Board meetings. Colmore BID will provide copies of statutory accounts and financial statements to the Local Billing Authority annually and to levy payers on request. A financial summary and Chair’s statement will be sent to all levy payers annually. Colmore BID will work closely with Birmingham City Council on matters such as levy collection and related financial management. Financial information will also be made available to members on the BID’s website. An annual presentation to levy payers and stakeholders will be held at which progress on BID objectives will be fed back to those in attendance. An Operating Agreement between the BID Company and the City Council, which includes the Council’s baseline service statements, is agreed and will be in place at the commencement of the new BID. This governs how the BID levy is collected and administered and handed over to the BID. A draft version of this agreement is available on our website, www. colmorebusinessdistrict.com. Colmore BID will meet with the Billing Authority on a quarterly basis to discuss service delivery, levy collection and financial management issues. 9 4 51


WORKING IN PARTNERSHIP Colmore BID works successfully in partnership with Birmingham City Council, West Midlands Police and others on a range of services and projects and this will continue into a proposed third term. Colmore BID also works closely with other city centre BIDs (Jewellery Quarter, Retail Birmingham, Southside and Westside BIDs) on activities to benefit Birmingham city centre as a whole. Specifically, the key services provided by Birmingham City Council and West Midlands Police have been baselined. An overview can be found on page 49 of this document. The full documents will be available at colmorebusinessdistrict.com and on request. These set out the minimum service standards, which will help to reassure levy payers that their BID levy is funding additional and not baseline services.

ALTERATIONS TO ARRANGEMENTS Provided that the BID is meeting its overall objectives, the BID Board will have the ability to vary service delivery and expenditure allocation, according to the changing demands of levy payers and the business environment. Changes to the BID boundary or to the levy rate would however require an Alteration Ballot.

HOW TO VOTE Between Monday 15 October 2018 and Tuesday 20 November 2018, BID levy payers will be given the opportunity to vote on the proposal for the renewal of the Colmore BID for a further five years. The confidential postal ballot will be conducted in line with the BID Regulations by Independent Scrutineer, Electoral Reform Services (ERS) on behalf of Birmingham City Council. Each property (hereditament) subject to the BID will be entitled to one vote. BID Levy Payers that are liable for more than one hereditament will be entitled to one vote per hereditament. Prior to this, the BID, working with Birmingham City Council, will have completed a canvass process to identify a voter list which will be used for the purposes of the ballot. In the case of an empty or partly refurbished property, where no occupational lease exists, the property owner will be entitled to vote.

A MESSAGE FROM NICOLA FLEET-MILNE In October 2018, we will be asking businesses to Vote Yes for our third five-year term. What you have read is Colmore BID’s ambitious Business Plan for 2019 to 2024. We believe this represents a raft of ambitious new projects alongside a refreshed set of core deliverables members expect from us – you told us so during our extensive consultation work. Colmore BID will not replace Council services - Business Improvement Districts are about additional services and support, and we will continue to follow this mantra. However, the need for the BID as a strong voice to protect and influence the management of the city centre is greater than ever. Colmore BID has enjoyed tremendous success since it was formed in 2009 and the projects delivered have changed the face of our District. But we must not become complacent. Local authorities across the country must still find financial savings across a raft of non-statutory services, and Birmingham is no different. Simply put, without Colmore BID, the District will lose over £1 million of business-led investment and place marketing work every year and levy payers will feel this loss at street level.

It remains vitally important for businesses to VOTE YES for a third term to ensure Colmore BID can continue to support members and influence the ongoing transformation of our District, our city and our region, in becoming a world-class experience for businesses, investors, and visitors.
