ATASCADERO — On Tuesday, Jun. 22, the Atascadero City Council members stood on the steps of City Hall and issued a formal proclamation in support and appreciation of
Atascadero’s first responders. At their regular meeting on Tuesday, Jun. 8, the city council had received and read many emails from Atascadero citizens who expressed their frustration and disappointment with the removal of signs and banners meant to support law enforcement officers. City Manager Rachelle Rickard addressed the matter and thanked the community for their support of law enforcement officers.
“The city’s sign ordinance does allow us to take down signs placed by the public, but we must do so in a manner that’s consistent with the first amendment,” said Rickard. She went on to explain that, according to the first amendment, the content of the signs must remain irrelevant in the decision to leave it up or take it down. As a result, city council can not determine one sign to be a “good” sign that they like and another to be a “bad” sign

voted on before Jul. 1 in order to change the rate and the next regular meeting is not scheduled until Jul. 13 Measure B-18 was on the ballot in June of 2018 and passed with a 76 percent vote in favor of authorizing San Luis Obispo County to impose a tax on gross receipts of marijuana business beginning at 4 percent and increasing annually to a maximum of 10 percent for general revenue purposes. However, many in the industry called in the regular meeting to suggest holding the rate, as those in the industry have not had sufficient time to operate due to slow legislative processes approving cannabis businesses operations. SAN LUIS OBISPO — The Board of Supervisors held a special meeting on Friday, Jun. 25, at 8:30 a.m. to discuss the cannabis tax rate and decide whether or not to hold the rate at the current six percent or increase it to the proposed eight percent. The special meeting was held as the rate would have to be

efore there was the Your Own Backyard podcast, there was The California Register Newspaper. In January of 2014, David Smallwood printed his first issue of The California Register with, “Protected by the First Amendment: ‘Congress shall make no law...abridging the freedom of speech, or of the press…’ Ratified: December 15, 1791” printed on the top left corner of the front page. In large bold print, read the headline, “The Unsolved Mystery of Cal Poly Student Kristin Smart Law Enforcement Still Baffled After 17 Years of Investigating.” The first eight pages of the paper covered the Kristin Smart case. Photos of Kristin growing up lined the bottom of the page, a tip he received from an FBI agent. Let the suspect know that the person they murdered was more than just a college student. Smallwood worked as the paper’s editor, writer, and publisher. He did it all and with no background in the industry—just the desire for justice and the willingness to know more. The first issue of The California Register was mailed to Central Coast residents for free. The paper even read, “For Inquisitive Readers, the Price is Free!” Smallwood’s goal was to get people talking about the case again. And boy, talk about the case they did. Like many cases, Kristin’s disappearance went years without any progress. Only to be mentioned during the 6 o’clock news on her birthday or anniversary of her disappearance.

PISMO BEACH — Local charity 17 Strong is happy to announce that they recently received a $10,000 donation from Pureinfluencer! “It is donations from companies like Pureinfluencer that help 17 Strong continue to fulfill Ryan’s vision of providing Victory Trips to young adults who have battled catastrophic illness,” says Steve Teixeira. 17 Strong is geared toward those ages to 18-40, who have suffered the trauma of catastrophic illness. Ryan Teixeira, their son, was diagnosed with cancer at the age of 18. He started planning a trip from another organization in the hospital as something to look forward to after treatment but was denied due to age cutoffs. Since most wish-ful-
fillment organizations cut off at 18, it then became his goal to create a foundation for young adults like him who are often forgotten. The name 17 Strong came from when Ryan was eight years old; he wanted to pick a number that he could keep with him through his sports journey. He researched Biblical meanings of numbers and discovered that 17 stands for Victory. From then on, 17 became Ryan’s number. After his initial cancer diagnosis, his cousin Charlie coined the name “17 Strong” to show his support for Ryan, and the name stuck. This job fair is a joint effort by the Paso Robles Chamber of Commerce, the Paso Robles Downtown Main Street Association, and the Paso Robles Wine Country Alliance. The fair provides a platform for businesses that are hiring to meet potential employees and for job seekers to learn vital skills and land their next gig. SAN LUIS OBISPO — The Central Coast Film Society is excited to announce “They’ll Be Back” for in-person events starting with the 30th Anniversary screening of Terminator 2: Judgement Day at 1 p.m. on Jul. 3, at The Movie Experience in San Luis Obispo. After the screening, there will also be a 30-minute Q & A with Brad Fiedel, a film and television composer who is most known for his collaboration with director James Cameron on Terminator and Terminator 2: Judgement Day. Terminator 2 debuted on Jul. 3, 1991, and the plot is that a cyborg, identical to the one who failed to kill Sarah Connor, must now protect her ten-year-old son, John Connor, from a more advanced and powerful cyborg. Terminator 2 was directed and co-written by
Cameron, who is also a Central Coast resident, as his property is on the Gaviota coast at Hollister Ranch near Santa Barbara. Fiedel composed other top movies such as True Lies (1994) starring Arnold Schwarzenegger and Jamie Lee Curtis and Johnny Mnemonic (1995) starring Keanu Reeves. He currently lives in Santa Barbara with his wife, actress Ann Dusenberry. “We are so thrilled that Brad will be joining us. Mounted Unit Rides Into Annual Training Exercise Unit is recruiting for more members who have their own horse and trailer STAFF REPORT
CAMP SAN LUIS OBISPO — Members of the 26th Mounted Operations Detachment (MOD), Operations Group, mounted their horses and participated in an annual training exercise here Jun. 11 and 12. The training exercise involved the 26th MOD conducting Search and Rescue operations for a simulated downed aircraft with evacuated survivors, a situation they may encounter in the future. The unit is currently working to obtain SARTECH-2 certification through the National Association for Search and Rescue (NASAR). “We’re a fully-mounted rescue team on horseback,” said 1st Lt. Kathleen King, who retired from the Army Reserve and now serves in the California State Guard as a member of the 26th MOD. “Since we are mounted, we can cover terrain a little bit faster than people on the ground. And our visibility is a little bit higher, we can see things better than someone on foot.” King, a biochemist, has been riding horses since she was four years old and rides a rope horse named Sunny. She originally joined the CSG as an environmental science compliance officer but transferred to the 26th MOD when she found out about the mounted unit. “I heard about this detachment,
and I said ‘Horses? You gotta sign me up!’” said King. The 26th MOD officially stood up in 2020 with the help of its commander, Maj. Frank Quiambao, whose father served in the 26th Cavalry Regiment (Philippine Scouts) during World War II alongside Lt. Col. Edwin Ramsey, a guerilla leader who led the last charge of the United States Cavalry in military history in January 1942. When Quiambao’s father and Ramsey both passed away, Quiambao formed the 26th Cavalry Philippine Scouts Heritage Society Ceremonial Mounted Group as a way to honor their legacy. “We wanted to do something to remember them, commemorate them, and honor them,” said Quiambao, who rides a 22-yearold mare named Jewel, a half-Arab, half-Welsh Cob who has participated in 40 parades, including Pasadena’s annual Rose Parade. The mounted group participated in parades, ceremonies, and educational events. When Maj. Gen. Jay Coggan, CSG commanding general, formed the Operations Group, Quiambao approached him about adding a mounted unit to assist with Search and Rescue (SAR). “Horses can be used for all kinds of things too. Why not Search and Rescue?” said Quiambao. “Mounted searchers can travel far more ground. If the ground SAR team needs supplies, we can always go back to the base very quickly and bring the supplies and equipment to the ground SAR. And

SAN LUIS OBISPO — When it comes to climate change, not all organisms will lose out. A new Cal Poly study finds that rattlesnakes are likely to benefit from a warming climate. A combination of factors makes a warming climate beneficial to rattlesnakes that are found in almost every part of the continental United States but are especially common in the Southwest. Rattlers are experts at thermoregulation. When given a choice, researchers found that the snakes prefer a body temperature of 86-89 degrees Fahrenheit, a much warmer temperature than they generally experience in nature. The average body temperature of coastal rattlesnakes in the study was 70 degrees, and for inland rattlers, it was 74 degrees Fahrenheit. “We were surprised to see how much lower the body temperatures of wild snakes were relative to their preferred body temperatures in the lab,” said Hayley Crowell, a graduate student researcher, and project lead. “There are a lot of ecological pressures in nature that could prevent rattlesnakes from basking, such as the risk of increased exposure to predators. A warmer
climate may help these snakes heat up to temperatures that are more optimal for digestion or reproduction.” The study, Thermal Ecology and Baseline Energetic Requirements of a Large-Bodied Ectotherm Suggest Resilience to Climate Change, was published in the journal Ecology and Evolution in May. Longer periods of warmer temperatures would also give rattlesnakes a longer active season, giving them more time to hunt and feed. Because snakes are ectothermic or cold-blooded, they cannot regulate their body temperatures like warm-blooded animals. Instead, they rely on their surroundings to provide heat, which restricts their activity in cold weather. In addition to seasonal changes, rattlers could spend more active hours during a given day. A possible lack of prey — rattlesnakes eat mostly rodents but may also eat insects, and other reptiles —resulting from a warming climate may not be a big problem for the snakes either. The research team discovered that the snakes use energy extremely efficiently. To subsist, an adult male rattlesnake needs only 500-600 calories for an entire year, which is about one ground squirrel, the equivalent of only about half a large burrito. Though in the real world, a rattler needs additional calories to hunt and bear young, among other activities, the calculations point to the snakes’
ability to survive even if prey isn’t plentiful. Humans, by comparison, need about 1,300 times as many calories to survive. “Rattlesnakes require very little energy to exist,” said Crowell, who earned a master’s degree in biological sciences at Cal Poly. Rattlesnakes are widespread throughout California, and the seven species of these vipers in the Golden State can be found from the coast to the desert. An increase in the number of snakes could affect entire ecosystems. Rattlesnakes are a keystone predator for ground squirrels in California and are prey for raptors and many other animals. “We are so used to climate change studies that forecast negative impacts on wildlife — it was interesting to see such starkly different findings for these snakes,” said Crowell, who is seeking a doctorate at the University of Michigan.

Judge Duffy asked Paul Flores if he understood his attorney Sanger asked for a continuance because they are waiting for further outstanding evidence. MONTEREY COUNTY — Caltrans announced that it had called in a heavy-lift helicopter on Tuesday, Jun. 22, to remove tunneling equipment which had been instrumental in the installation of a 10 ft. diameter, 1.25-inch-thick steel pipe culvert beneath the roadway. Late last week, crews successfully completed their tunneling operation from the east side of Rat Creek Canyon, through the fill underneath the roadway, and broke through where the culvert will outlet on the coast side of Highway 1. This tunneling operation successfully installed the 10-foot diameter steel pipe culvert at a 30 percent slope, and it will serve as the centerpiece of redundant drainage infrastructure at Rat Creek, which will substantially improve water flow capacity during future storm events. Papich Construction and Caltrans engineers determined that tunneling the main culvert instead of installing it during the fill construction would allow for the reopening of the roadway 4 to 6 weeks earlier than originally planned. The roadway was successfully reopened just 86 days after a late January storm event and associated debris flows severed this scenic stretch

Dubbed “Operation Dry Water,” law enforcement entities will increase patrols and/or carry out BUI checkpoints on this holiday, known for being one of the deadliest holidays for recreational boating accidents. For the 12th straight year, the goal of the Operation Dry Water campaign is to reduce the number of alcohol and drug-related accidents and fatalities and educate water enthusiasts about the deadly consequences of BUI. California and U.S. Coast Guard recreational boating accident statistics repeatedly show alcohol as a contributing factor, accounting for more than 20 percent of California’s boating fatalities over the past five years, where testing was conducted. Nationally, alcohol is the leading contributing factor in fatal recreational boating accidents, according to the National Association of State Boating Law Administrators.

Have fun, but leave the alcohol at home.” It is against the law in California to operate a boat or water ski with a blood alcohol concentration (BAC) of 0.08 percent or more. Officers may also arrest boaters with a BAC less than 0.08 percent if conditions are deemed unsafe. BUI convictions can result in up to six months in jail and/or fines of up to $1,000. Two convictions within seven years could add a jail term of up to one year. Boaters caught operating under the influence may also have their voyage terminated and their vessel impounded. Outdoor enthusiasts are also reminded to recreate responsibly this summer by wearing life jackets and actively supervising children when recreating near or in California’s waterways. SAN LUIS OBISPO — San Luis Obispo County and the Department of Justice (DOJ) have reached an agreement regarding Americans with Disabilities Act (ADA) improvements to the County Jail. The DOJ found the Jail was not in compliance with current ADA regulations. The Sheriff ’s Department reports that they have taken immediate action to remedy the situation and that both the County and the Sheriff ’s Office have fully cooperated with the DOJ to ensure all inmates have equal access to accom-

identification, campfires, and aerial mapping. At this time, the drone will only be utilized in the Salinas Riverbed. This technology will assist us in the early detection of fires, containment, and extinguishment. ATASCADERO — On Jun. 30, at approximately 8:38 a.m., an Atascadero Police Officer was traveling near the area of US 101 and Morro Road when he observed a motorcyclist commit several traffic violations. The officer attempted to conduct a traffic stop for the violations, but the rider failed to yield, and a pursuit ensued. The pursuit traveled on surface streets at high speeds and was ultimately
public safety concerns as the rider rode into the Atascadero Lake Park area. A passerby reported seeing the subject hide the motorcycle on San Francisco Road and flee on foot. Officers established a perimeter, and the assistance of the California Highway Patrol Air Support Unit was requested. During a search of the area, Shaun Michael Riley, a 42-year-old resident of Bradley, was found hiding in a porta-potty on Azucena Avenue.

Senator John Laird Secures State Budget Funds for Atascadero STAFF REPORT
SACRAMENTO — Senator John Laird announced today nearly $22 million will be provided to address critical needs along California’s Central Coast. “This year’s budget will include necessary funds to support communities across California as we Build Back Boldly following the COVID-19 Pandemic,” said Laird. “For my district, we successfully advocated for nearly $22 million. Working with Assemblymember Mark Stone (D-Santa Cruz) we secured $14.5 million for the City and County of Santa Cruz to improve and expand the city’s response to housing and provide services to those experiencing homelessness. In addition, I secured $3 million for the City of Atascadero to improve and further develop critical downtown infrastructure and $4.5 million for infrastructure renovations to Point Sur State Historic Park.” Senator John Laird played a key role in formulating a budget that works for all Californians, serving as Chair of the Budget Subcommittee on Education and a member of the Senate Budget and Fiscal Review Committee. Beyond this critical one-time funding for district projects, Senator Laird advocated for budget allocations with statewide implications, such as money for food banks and as Education Budget Subcommittee Chair funding for student aid reform and fully funding a Cost of Living Adjustment for education funding. “These funds will not only provide emergency funding to the City and County of Santa Cruz for much-needed infrastructure and support to resolve current unsanctioned encampments on CalTrans and city public land while improving State, County and City coordination,” noted Laird, “but will also ensure additional funding for the City of Atascadero for more sustainable infrastructure projects that move us closer to California’s climate goals and a swift economic recovery for a small, rural California town. Also, due to Laird’s success, Point Sur Lighthouse, a California State Historic Park on the National Register of Historic Places and an iconic landmark, will be protected and preserved, safeguarding the park as a prime tourist attraction for all Californians. The budget has been approved by the standing Budget committees and must gain passage from the Senate and Assembly Floor to be signed for final approval by Governor Newsom. Further details regarding disbursement will be determined following the Governor’s signature. These historic investments will strengthen the economic footing of those living in and around California’s Central Coast for years to come.

SAN LUIS OBISPO — The Board of State and Community Corrections selected Restorative Partners, Inc. of San Luis Obispo to receive $497,294 in grant funding to provide reentry services to people newly released from state prison. A total of 37 community-based organizations were approved for $17.5 million in grant funding. Participants in Restorative Partners’ Warm Handoff Reentry Services Program will have access to two reentry support programs that will, in turn, provide access to additional services at our agency and in the community to lower recidivism. Fifty returned citizens will be served each year of the grant period. Through Mentorship and System Navigation, the program aims to maintain a recidivism rate below 25 percent for each year of the grant period. “I am thrilled about this great news. The grant cycle for this second round of Warm Handoff funding begins Jul. 1 and ends Feb. 28, 2025. The BSCC had received 106 proposals seeking more than $48 million. The CBO operates five recovery homes and provides substance-use disorder treatment and domestic violence and anger management classes.

Paso Robles Man Sentenced for Sex Crimes Against Child Victims SAN LUIS OBISPO — San Luis Obispo County District Attorney Dan Dow announced on Monday, Jun. 28, that Jason Robert Porter (49) has been sentenced. Porter is sentenced to 280 years to life plus five years for his conviction on 16 felony counts, including multiple sex crimes against four child victims and possession of child pornography. Porter was also convicted of 36 misdemeanor counts of unauthorized invasion of privacy. On Jun. 2, San Luis Obispo County Superior Court Judge Barry T. LaBarbera found Porter guilty of the charges after Porter waived his right to a jury trial and the matter was heard by the judge. Judge LaBarbera likewise imposed Jun. 28 lengthy sentence. The judge considered evidence that between February 2008 and June 2016, Porter sexually abused four female child victims between the ages of 1 and 13 and videotaped 36 victims without their knowledge. The crimes for which he was convicted began when Porter was 36 years old.
Parents of the young victims addressed the Court and the defendant describing the painful impact of Porter’s criminal conduct. “We sincerely applaud the courage of these young survivors in reporting the abuse and the parents of the survivors who appeared in court today to face the defendant and express the very real impact of his terrible crimes,” said District Attorney Dan Dow. “This sentence sends a clear message that we will prosecute child sexual predators to the maximum extent of the law.” This case was prosecuted by Deputy District Attorney Melissa Chabra, who is assigned to the District Attorney’s Office Sexual Assault and Child Abuse Unit. “I am pleased that after five long years, I was able to be a part of the team to finally deliver justice to all of the survivors involved. The young victim’s bravery while testifying in Court in front of her abuser inspires me to continue my work on these cases and fight for justice for all survivors of sexual abuse in our county,” said Deputy District

The case was investigated by the Paso Robles Police Department with the assistance of the San Luis Obispo County Sheriff ’s Office, the District Attorney’s Bureau of Investigation, and Central Coast Cyber Forensic Laboratory (CCCFL). The CCCFL was formed out of a partnership between the District Attorney’s Office, the California Department of Justice, the California Military Department, and Cal Poly. The CCCFL was inaugurated on Mar. 1, 2017.
SAN LUIS OBISPO — San Luis Obispo County District Attorney Dan Dow announced on Monday, Jun. 28, that Cody Julian (31) of Arroyo Grande has been sentenced to 24 years to life for his conviction of five counts involving the sexual abuse of a child under the age of 10, which occurred in 2016. Julian was convicted by a San Luis Obispo County jury on Apr. 23. He had previously been convicted of the same offenses in March of 2018; however, the conviction was vacated by the Court of Appeal due to errors in the trial court. ‘Are Longtime Allies Newsom and Harris Destined to Clash?’

ice President Kamala Harris took a lot of heat for her performance in her first foreign trip as the nation’s No. 2 official, some bloggers calling her excursion into Latin America “a continuation of her failure theater.” That phrase came from a conservative website, but the far left also blasted Harris for telling the poorest of the Central American poor “Do not come” to the United States. The remark had future elec-
toral implications because Harris’ fellow Democrats of most stripes are sympathetic to poor but enterprising immigrants from countries like Guatemala, Honduras, and El Salvador. They blanched upon hearing her simple statement of the immigration preferences of the current administration and all other recent ones. Donald Trump, for example, took heat for his treatment of immigrants, especially children. But Barack Obama’s administration, with current President Joe Biden as vice president, actually deported more prospective newcomers to America. Whether Biden seeks a second term or becomes a caretaker president who leaves after just one, it’s all but certain Harris will one day run again for America’s highest office. If she does, she could collide with Gavin Newsom, provided

the governor survives this fall’s recall election, as every nonpartisan poll indicates he will – and by a handy margin. As a rule, politicians who triumph over recall attempts are strengthened, the best California example being Dianne Feinstein, an unbeatable U.S. Senate candidate after she trampled a recall attempt while mayor of San Francisco. If Newsom beats the recall and then wins reelection next year, he could choose to run for Feinstein’s Senate seat in 2024, when she will be 90, or he could opt to run for president and thus crash into Harris. That would be a huge change. Newsom and Harris have shared campaign managers for many years and have long had an informal understanding never to oppose each other’s ambitions. That’s why Newsom, then lieutenant governor, stood by
quietly awaiting a 2018 run for governor while Harris won an open Senate seat with little competition in 2016. But their understanding might not survive the reality that time is passing and neither is getting younger. Until Harris’ Latin American trip, Newsom had never uttered a critical word about the vice president, who – like Newsom -- got her start in San Francisco politics, winning two terms as district attorney before becoming California’s attorney general and then a senator. But Harris no sooner returned to Washington, D.C.. from her trip than Newsom checked in on the side of left-wing Democrats like Alexandria Ocasio-Cortez, who earlier blasted Harris for her anti-immigration remarks. In a press conference just after Harris’ return, Newsom observed that “California has long had a

During the eight years of the American Revolution, many signers of the Declaration suffered financial devastation and the death of loved ones at the hands of the British Army. After the French and Indian War ended in 1763, the British Parliament demanded that Americans shoulder the heavy tax burden and debt encumbered by the war with the French. Americans had suffered terribly during that war, especially at the hands of French raiding parties allied with Indians who did not observe the rules of 18th-century warfare. After the war, the British refused provision of military protection to colonists against Indian depredations. The British also imposed extremely unfair trade practices that created severe economic hardships in the colonies and, worst of all, refused to submit corrupt British officials to colonial courts, spiriting them off to England
and immunity. Outrages against Colonial women by British troops and foreign mercenaries went unpunished. Finally, the events in New England at Lexington and Concord against colonial militias were escalated by the British Navy, which bombarded Falmouth, Massachusetts, and Norfolk, Virginia in an effort to cow the Colonials into submission. The latter events unified the Colonies as nothing before. Previously, the Continental Congress had sent delegations to Britain to plead their case for respecting their rights as free Englishmen. The British government ministers laughed at them: Colonists as Englishmen? What nonsense! Go home, obey your betters, pay your taxes or suffer the consequences was the response received. The bombardment of Colonial port cities, harassment of civilian shipping, unfair trade policies that practically bankrupted colonial merchants, and finally, military occupation and corruption of the legal system were the
different approach to immigration, a more inclusive approach.” He added that he has consulted with other federal officials about “how California can be more supportive in terms of the needs of asylum seekers.” That’s not exactly the Harris approach these days. In fact, her blunt advice for the Central American poor to stay put was reminiscent of her generally pro-police responses to law enforcement excesses while she was attorney general. So could Newsom and Harris ever face off in a presidential primary? Their mutual campaign manager, Dan Newman, did not respond to emails seeking to ask him about that possibility. For sure, it would be entirely unprecedented for two top politicos from the same state to vie for the same party’s nomination for president. It could set up a situation where they split
what amounts to a pro-California vote, letting someone else slip past and get the nomination. Right now, Harris is best positioned to win the next Democratic nomination race, whenever and however Biden leaves the Oval Office. But she could be weakened in a primary by alienating the party’s left, which demonstrated its clout by keeping Vermont Sen. Bernie Sanders a prominent candidate for most of the last decade. Newsom, of course, could also opt to play the waiting-his-turn game again and spend years in the Senate if he took the Feinstein seat. There’s a lot uncertain here for both Harris and Newsom, but the possibilities are entertaining, at the very least. The Declaration of Independence, essentially a declaration of war against the British Empire, set loose forces that changed the world for the next two-plus centuries and established a form of government that was the envy of and model for the world. It was and is a beacon of hope for untold millions who, to this very day, brave extreme hardship at risk of their lives to come here any way they can. In just the last two months of April and May of 2021, over 360,000 men, women, and children trekked over a thousand miles to reach our southern border in the hope they might be able to cross into the United States. Last week I watched women fall to their knees in tears, their hands reaching to the heav-
ens giving thanks as they waded ashore on the U.S. side in the Rio Grande Valley. From July 4, 1776, seven more bloody years of war followed, with more defeats than victories, many atrocities inflicted upon colonial civilians at the hands of brutal, professional soldiers, arrogant British commanders ultimately humiliated by a people who wouldn’t quit. In the end, tens of thousands of colonials loyal to the King fled to Canada, the British Army went home, and a new experiment in self-government, a Republic, was born. The experiment had many flaws, and it’s still a work in progress. LETTERS TO THE EDITOR GARBAGE TRUCKS: THE SOLUTION TO HOMELESSNESS Dear Editor, According to articles in the Los Angeles Times, garbage trucks were the answer to the homeless population in Echo Park, Los Angeles, and Venice Beach. Same answer but different approaches, the Echo Park approach in March was simply closing down and fencing the area, and arresting any resisters, bringing in garbage trucks to clear the homeless encampments. The current Venice Beach approach is trying to show more humanity by encouraging and assisting the homeless to take advantage of available housing alternatives while creating a more inviting beach experience for businesses, tourists, and local residents...then bringing in the garbage trucks. My takeaway from this is a mantra used in innovation by the tech community (and other industries): Get an idea, try it, tweak it, iterate...rinse and repeat. Recently, a few homeless individuals got into a fight at Centennial Plaza, near the pedestrian bridge across from Sunken Gardens, in
downtown Atascadero. Or, in the minds of some, a couple of derelict (probably drunk) addicts caused an unsightly disturbance right near our Middle School and City Hall . . . again. Both versions of this type of event end with “Something has to be done about the homeless situation!” yet we haven’t. Had the fight occurred down by the Salinas River (where some homeless call home), no one may have known about it, except maybe the urgent care or emergency facility that had to treat injuries. Maybe not even them. Maybe, if there were more newsworthy incidents, we would work harder at trying solutions. I rarely run into anyone who doesn’t have empathy for the situation homeless people find themselves in. The good part of us continually supports fantastic organizations like El Camino Homeless Organization (ECHO), whose 50 beds help the homeless who have conquered or don’t have addictions, which is about 20 percent of the estimated 250 homeless persons in Atascadero. The City of Atascadero has installed cameras and increased
police patrols to try and keep a lid on things, but I believe to be successful, we have to solve the problem of no home, at least for the chronic homeless, who are maybe addicts, and/or may have a mental illness. Depending on the source, this is probably 30 to 40 percent of the homeless population. If we solved the “home” problem for these (roughly) 75 homeless people in Atascadero, we might see a decline in the visual and actual disruption of business, the safety of our parks, and the growth of tourism. That must be worth some thoughtful idea trials and iteration. Homeless means simply not having a place to put your stuff and to put your head down. Imagine how well your son or daughter would cope with daily living if they had to carry all of their possessions around with them and never know that the place they slept last night will be there tonight? A phrase heard a lot goes something like this “If they just got a job and pulled themselves up by the bootstraps, there wouldn’t be any homeless people.” Fortunately, for some (mostly transitional homeless), ECHO helps
them pull up their bootstraps and gets them boots. Frankly, we don’t see them much. Who we see are [the ones] who fight or cause uneasiness, hurt business, and tourism are [the ones] who mostly are the chronic homeless. They are much less in numbers than episodic or transitional homeless, but they tend to be the group that costs the most in terms of health care, policing, and other public services. . .money. So maybe we can help just 75 of our citizens and save money while doing it. I do think we have tracts of land that could be used by the homeless to at least have a place, if not a home. How much can some porta-potties, water, and trash cost, that could centralize the chronic homeless for services and give them an alternative to the parks and the riverbed? My goal here is simply to open new conversations, or at least keep the topic alive, so we don’t only address homelessness when Atascadero News prints another story about an incident involving the homeless population. According to women, two of the biggest questions they have before “coupling” with a man is who will get custody of the money and, “Is this the man I want my children spending every other weekend with?” Scientists say that animals like cattle are incapable of love, and instead, they just temporarily bond with another who looks and acts like they do because in the animal kingdom, “like marries like.” We are told that domesticated animal’s emotions are simpler and cleaner than humans, and love and hate stay separate in their brains. They either hate or like another being, whereas humans can love and hate the same person. And often do, based on divorce statistics. The current divorce rate saddens me because I’ve been married only once in my life to the same wonderful woman for 47 years and can’t imagine life without her. I think we have a perfect marriage despite the fact that my father was no role model in how to be a good husband. My parents separated at least three times and actually filed for divorce on three different occasions, the third one finally ending the train wreck. In hindsight, I think the
marriage ended because my father couldn’t stand my mom when he was drunk, and she couldn’t stand him when he was sober. Which, I might add, was an extremely rare occurrence. I got the impression they only stayed together because of the children... neither one of them wanted to get stuck with me. When I was a kid, divorces were much frowned upon, and children of divorced couples were shunned in higher society. And it took a lot more lawyerly work to get a divorce. You had to have a reason, and blame had to be assigned in court. Usually, it was because the husband wasn’t monogamous. But boys will be boys, whether it’s bulls or boyfriends. It wasn’t like the Cherokee culture where a woman could divorce her husband simply by tossing all his belongings out the front door. If that was all that was required to get a divorce, my parents would not have reached their second anniversary, and you wouldn’t be reading this column right now. ne of the most comforting truths in the Holy Bible is the fact that God has a wonderful plan for the life of every believer. Theologians refer to this as the “decree of God” and is commonly known as the “will of God.” The Bible teaches that God in His omniscience and omnipotence gives guidance to a believer who desires to do God’s will. These truths occurred in the life of the Old Testament patriarch Joseph. He was sold as a slave to Egypt by his brothers and then became a prisoner. God enabled Joseph to interpret two dreams that Pharaoh the
King of Egypt had concerning the future prosperity and famine in Egypt. As a result, Pharaoh made Joseph his prime minister in charge of storing and selling grain when seven years of famine came. This famine brought Joseph’s brothers to Egypt to buy grain. Joseph had not seen his brothers for over twenty years and when they met Joseph, they didn’t recognize him but Joseph knew who they were. Through a series of events that Joseph planned, his brothers acknowledged their past sin against him. In a personal meeting with all of his brothers, Joseph personally revealed his true identity (Genesis 45:1-4). When this occurred, his brothers were “terrified in his presence.” I’m sure they were afraid of what Joseph would do to them as the prime minister who had the authority to execute all of them. Joseph’s gracious
response to their fear is one of the greatest examples of kindness and forgiveness recorded in the Bible (Genesis 45:5-8). Joseph didn’t seek revenge or punishment because God had given him a divine perspective of the events of his life. God was the one responsible for sending him to Egypt for the purpose of preserving and prospering the lives of his family. God had exalted Joseph as the prime minister so that he could be a source of great blessing to his family. Joseph wept with great joy over being restored to his beloved father. Joseph’s plan with Pharaoh’s approval, was to bring his entire family to Egypt and settle them in the fertile land of Goshen. Joseph instructed his brothers to return to Canaan and tell his father Jacob his plans. Joseph would become the great deliverer and provider of his family (Genesis 45:9-28).
Lessons to be Learned 1. God’s divine plan for a believer will control everything that will occur in his life. 2. God’s divine plan can turn seemingly evil and harmful things into beneficial and blessed things. 3. God’s divine plan gives a believer the confidence that all things will work out for GOOD for those who love and serve God (Genesis 45:5-7, Romans 8:28). 4. Having a divine perspective of life will prevent a believer from seeking revenge and produce a kind and gracious spirit of forgiveness in his life. (Ephesians 4:31-32). A divine perspective of life will give a believer peace, joy and fearlessness. Counter-Human Trafficking Task Force
Anatomy of A Human Trafficking Prosecution By SAN LUIS OBISPO COUNTER-HUMAN TRAFFICKING TASK FORCE BOARD
T
he difficult nature of human trafficking cases is well known. They are complicated and can be hard to navigate. The same goes for the prosecution of a human trafficking case. Garnering cooperation from victims and witnesses can be tough, and often there is nothing more than “he said, she said” types of evidence for investigators and prosecutors to work with. An added complication is the standard of proof needed to prevail in a criminal prosecution. The standard of “beyond a reasonable doubt” is the highest legal standard, and it is that standard that a prosecutor must reach for someone to be convicted in a criminal proceeding. Recently, in the San Luis Obispo Superior Court, a human trafficking case reached a disposition after nearly two and a half years. In that case, a jury found Lucion Lee Edward Banks guilty beyond a reasonable doubt for the crime of human trafficking of a minor. He has since been sentenced to a prison term of fifteen years to life. This case was long and drawn out but had a positive outcome for the community, the justice system, and most importantly, the teenage victim who has transitioned from being a rescued victim to a survivor and now is a thriver. The disturbing facts of the case started in October 2018 with what could be termed a routine traffic stop in San Luis Obispo that was made after an officer viewed a variety of vehicle code violations. The driver of that vehicle, ultimately identified as Lucion Banks, was passing through San Luis Obispo on the way to Los Angeles from the Bay Area when he was contacted. In his vehicle was a fourteen-year-old female who was determined to be a human trafficking victim. Thus, it was from the point of the traffic contact that the investigation began. It was learned that the driver, Lucion Banks, a resident of Oakland, had a warrant for his arrest. Banks was arrested for the warrant as well as for human trafficking, and the female juvenile victim was taken into protective custody. This began the long process of offering and providing services, support, and reassurance to the victim that her trafficker would not be able to harm her any longer. It also began the long process of identifying, seizing, and analyzing potential items of evidentiary use that were found in the vehicle driven by Banks. These items included but were not limited to prostitution-related paraphernalia, cellular devices, paperwork, and documentation that provided a timeline and information as to locations that Banks trafficked the victim in. It was learned through the continuing investigation that Banks trafficked the victim in a multiride of geographical areas throughout northern California. Banks trafficked the victim on what is known in the pimping subculture as the “circuit.” Investigators determined that Banks trafficked the victim in communities such as San Francisco, Vallejo, Fresno, Oakland, and Salinas. It was learned that Banks transported the victim, who was only fourteen years old, to areas of high prostitution activity in these and other cities, forced her to walk the streets at all hours of the night. At these locations and others, Banks forced the victim to engage in acts of prostitution no matter the danger or risk, all for the sake of putting money in his pockets. These locations, often referred to as “the blade” or “the track,” are locations where prostitution and trafficking occur in broad daylight. They are locations where pimps and traffickers boldly operated with impunity. These “tracks” or “blades” are in plain sight, in our cities, big and small. Though they are easy to find, they are not necessarily areas that someone would visit unless the sole goal was to seek the services of a prostitute. It was discovered in talking with the victim that Banks was violent towards her, and in his continuing efforts to traffick her,

kept her isolated, kept her without any means to provide for herself and created a situation where she was completely reliant on Banks. The victim often had no idea where she was going day to day. She only knew that Banks was going to take her to some unknown destination, force her to engage in prostitution, and keep any proceeds for himself, essentially treating the victim as a commodity. Although this incident started in October 2018, it took nearly two and half years to make its way to a courtroom for a jury trial. During that two and half years, electronic devices were examined, cellular phone records were sought and scrutinized, the victim was interviewed in detail, and specific locations that Banks trafficked the victim at were visited by investigators. This long-term investigation culminated in a two-week jury trial in March of 2021, where an overwhelming amount of evidence was presented to a jury. Jurors were shown evidence of the prostitution-related paraphernalia such as wigs, condoms, and costumes that were taken from Banks’ vehicle at the time of the traffic stop in San Luis Obispo. The jury was presented evidence from a social media account operated by Banks which essentially served as a pimp advertising account. Phone records were examined in great detail, and the jurors received evidence showing that Banks took the victim to geographical areas on the circuit known for prostitution and human trafficking – the “blades” and “tracks” of California. The prosecution presented text messages and photographic evidence that proved human trafficking took place. Phone and text message information was shown that depicted Banks dropping the victim off in areas of high prostitution activity, waiting for her to “turn tricks,” directing her to bring “his” money back, only to put her back on the street again until his financial quota was met. Receipts and paperwork which could have been viewed as common car trash were seized from Banks’ vehicle and eventually presented to the jury. These items that included fast food receipts, a car wash card, and medical paperwork were introduced as evidence to provide a timeline of places visited, which in the end, corroborated the victim’s statement of where she recalled being trafficked. Perhaps the most compelling evidence provided came directly from the victim herself. The victim described with great specificity the places she was trafficked, the abuse she suffered at the hands of Banks, as well as the way she was forced into prostitution by Banks. The victim, described only as Jane Doe in court, courageously recalled how she was first contacted by Banks on International Boulevard in Oakland, and immediately taken to San Jose, where Banks first tried to pimp her out to sex purchasers in that area. This was the start of her victimization at the hands of Banks. In the end, the victim’s heart-wrenching testimony alone was sufficient to prevail in court; however, the volumes of corroborating evidence supported the tragic story that was related by Ms. Doe in court. The numerous items of evidence and Ms. Doe’s story of what took place, along with expert testimony that was provided by local investigators as well as an investigator from Alameda County, were submitted to the jury, who in just a few hours unanimously reached a guilty verdict. This verdict affirmed the investigators’ and prosecutors’ position that Banks was a human trafficker. But, more importantly, the jury verdict affirmed Jane Doe’s voice and her part in seeking justice and restoration for the wrongs that were done to her by Banks. On May 21, Lucion Banks was sentenced for human trafficking by use of force, fear, or coercion. During sentencing, Ms. Doe told the court that she no longer felt fear and that if she were not rescued in October 2018, she would have continued to live a life of abuse. However, in the end, because of the efforts and dedication of law enforcement, prosecutors, and a team of dedicated advocates and supporters, Ms. Doe has a better future and will continue to thrive. This, coupled with Ms. Doe’s own inner strength, fortitude, and desire to achieve great things, makes this a success story. One thing we know for sure, Ms. Doe has a future, and Lucion Banks will not be able to victimize anyone else for the foreseeable future. For that, we are grateful.

the tax rate as the bill proposed as the public had voted on this measure, and that was their direction. Additionally, the cannabis industry reports that had been presented had done so with estimates on the increased tax rate and would be impacted negatively if the rate was held at six percent.
Each Council member expressed their full support of law enforcement and of Council Member Dariz’s individual determination. Police Chief Bob Masterson was asked for his opinion, to which he expressed his approval and gratitude. The council voted 5-0 to approve. The proclamation recognizes the “extremely hazardous situations” and the “supreme efforts made of all of our first responders.” The proclamation ends with “Now, therefore, the City Council of the City of Atascadero hereby proclaims the sincerest respect, honor, support, and gratitude for all of Atascadero’s First Responders, for everything that they do to keep our community safe from harm.” Overall the supervisors were in favor of holding the rate and allowing the industry more time to solidify their businesses before increasing the rate, and the vote passed 4-1. The next regular meeting of the Supervisors will be held on Jul. 13 at 9 a.m., and links to the meeting can be found on the district website slocounty.ca.gov/Home/Meetings-Calendar.aspx.

“One week, you put together a certain type of plan, and you get your head around it thinking okay this is what the fair might look like, and then something would change,” Keffury explained. In May, California seemed to change its plan and begin reopening rapidly. That was when the CMSF board decided to go through with their plan to make the fair happen. Interim CEO Colleen Bojorquez said, “It’s been a rollercoaster ride of emotion. We have always wanted to do, at least, the livestock portion, so we were trying to figure out how we were going to support our 4-H and FFA and how they can show in person.” Since then, the CMSF board has had about six weeks to put together their finalized plan. “We had a lot of different ideas, but they were all based on what we thought might happen—I don’t think anybody thought California would open up as quickly as California had,” Bojorquez shared. Of course, planning a fair that usually takes six months and doing it in only six weeks has its challenges. “With people not expecting California to be open, a lot of entertainers and a lot of performers already made plans for the summer to be in other parts of the country,” Keffury said. According to Keffury, the CMSF accounts for nearly 90 percent of the event centers profits, so canceling the fair was detrimental for the center and Paso Robles local economy. “We need to have the fair. We need to have our events back, and we are ready to welcome them with open arms,” Bojorquez explained. The CMSF will be following State and County guidelines for COVID19 regulations. “We’re going to operate, but we’re going to operate safely. That is very important to us,” said Keffury. Bojorquez and Keffury explained fairgoers will see all the events they are used to seeing, just maybe at a smaller capacity. Because of California’s unexpected and rapid reopening, some vendors and entertainers made plans in other states during the CMSF’s usual time slot.
But that hasn’t stopped the fair board from putting on the best fair they can. “It will be a lot of fun to see a lot of people come out and support our fair, which is great because we feel like we have this little niche in our community that only our community can appreciate,” Bojorquez said. Keffury says, “We can’t wait to see you. Frustrated with seeing no results from the San Luis Obispo Sheriff ’s Department, Smallwood began investigating on his own, just like any other investigative reporter would. Paul Dostie, a retired police detective sergeant, contacted Smallwood after his sister who lives in the North County sent him a copy of the Register. He gladly offered his services. Dostie now works as a forensics investigator with grave detection (cadaver) dogs. In 2014, Dostie brought his cadaver dog Buster (who has since passed) to search the perimeter of Susan Flores’s home at 529 East Branch Street in Arroyo Grande. Buster himself is accredited with finding over 200 human bodies. His most known finding was in Tarawa, where he located over 35 WWII Marines lost after the Battle of Tarawa 72 years ago. It was on June 2, 2014, that Buster confirmed the corner of Susan’s backyard as a location of human remains. At that time, Dostie took soil samples from the neighbor’s property and sent them to Dr. Arpad Vass, who was the senior research scientist at Oak Ridge National Laboratories from 1989-2012. One of the soil samples Dostie sent came back as a “weak positive” for human remains. Dostie suspected the concrete block wall that separates the properties could have been interfering with the regular migration of human contaminants through the moisture in the soil. Smallwood brought these findings to the Smart Family’s attorney Mark Connely. Smallwood assumed that Connely then brought the findings to the SLO Sheriff ’s Department, where the evidence was deemed as insufficient and not enough to obtain a search warrant. Smallwood released this information in Issue 2 - Volume 2 of The California Register. But it would be the controversial headline on Issue 2 - Volume 2 that would grab the attention of anyone who had heard the name Kristin Smart. “Kristin Smart’s Body Finally Found? Two Dog Alerts and Positive Soil Sample!” The Smart Family and others called the headline misleading and understandably so. It is obvious that Smallwood is not shy about his feelings towards the SLO County Sheriff ’s office and the handling of the case. He is aggressive, sarcastic, and pointed in his accusations. For some, his methods to gain attention and tell the story have made him uncredible. Many had written Smallwood off as a little bit of a “nut” or just an internet sleuth before internet sleuths existed. But there is a lot about David Smallwood that people don’t know. There is a reason he is aggressive. There is a reason he has a need for justice. There is a reason he is the way he is. Just no one has ever asked him about it. Smallwood was a US Navy anti-submarine warfare pilot on the aircraft carrier USS Kitty Hawk in the South China Sea during the Carter administration. He served a total of ten years as a pilot in the Navy. After serving two deployments in the South China Sea, Smallwood joined the naval reserves where he was stationed at the tactical air base Dallas Naval Air Station in Texas. It was during his time in the reserves where Smallwood experienced an abundance of corruption within the military. His subordinate Chief Petty Officer Michael Tufariello brought him evidence of massive payroll fraud and reported his findings. On June 20, 1984, Tufariello was accused of being suicidal and seized by Marines to be put into a mental ward for four days. He was held in the mental ward just long enough to discredit his whistleblower assertions. “They made life miserable for both of us,” said Smallwood. Tufariello ended up being a critical testi-
mony for the Military Whistleblower Protection Act of 1988. Smallwood left the Navy in 1986, but he left a changed man. His time in the Navy left Smallwood with a thirst for justice to be served and an eye for governmental corruption. Fast forward to 2013, and Smallwood stepped into the Kristin Smart case. With a blessing from the Smart family, Smallwood begins piecing together Kristin’s disappearance and printing the story in his newly published paper, The California Register. Smallwood began conducting interviews. One of the first was with Joe Lassiter and Mary Lassiter (now Brown). The Lassiters rented Susan Flores’s home at 529 East Branch Street in Arroyo Grande following the disappearance of Kristin Smart. Mary and Joe signed paperwork in June 1996 but could not move in until July 1996 because the Flores family was finishing a concrete project in the backyard. Kristin Smart disappeared on May 25, 1996. Neither Mary nor Joe knew about the disappearance of Kristin Smart or the Flores family’s involvement when they moved in until they began receiving “hate mail.” Smallwood interviewed the now-divorced couple separately. Both recalled Ruben Flores’s strange behavior. While Mary and Joe lived in the East Branch Street home, Ruben would come by their home every day for up to six hours at a time and sometimes even drunk. Knowing the Lassiter’s are Raiders fans, Ruben would bring a Raider’s souvenir when he visited. Both Joe and Mary said Ruben was adamant about getting what Joe described as a metal “old school trash can” that was left in the backyard. Neither of them looked inside the trash can. It was after Ruben finally took the trash can that Mary found the infamous earring in the driveway. Mary, a nurse at Sierra Vista Hospital at the time, saw the dried blood on the back of the earring. After seeing Kristin’s billboard in front of Attorney James Murphy’s office, Mary believed the earring was very similar to the necklace in the billboard photo. Kristin’s hair in the photo concealed the earrings. Two detectives from the sheriff ’s office received the earring from the Lassiter’s as evidence. Mary and Joe each separately described the detectives taking a photo of the earring before placing it carefully in an evidence bag. This is the same earring that allegedly disappeared when the Smarts demanded to see it. Then, Mary described to Smallwood the watch beep she would hear every morning at 4:20 a.m. coming from the backyard. At the time, Mary told Smallwood she thought it was related to 420, a slang term
for marijuana. But when Chris Lambert, creator of Your Own Backyard podcast, asked Denise Smart about the watch alarm. Denise told Lambert Kristin was a lifeguard and would get up around 4:30 a.m. for work. Mary also claimed to have found dried blood on the shower curtain in the bathroom, which she claims to have taken a swab of with a Q-tip and still has in a box somewhere in her garage. At first, the Lassiters were visited by law enforcement and questioned on their involvement with the disappearance. Specifically, Joe was said to be harassed by officers asking him what his involvement was. The Lassiters were under the impression by Susan that they had no right as renters to let anyone on the property. Susan eventually evicted the Lassiters before their six-month lease was over. That was when the Lassiters learned as renters, they have the final say of who can do what on the property under Tenants Rights. So Mary and Joe let people begin searching the home. “I know that trash can had something to do with it,” said Mary, “Too many things threw up red flags.” Mary told people they could dig up the backyard then. But no one did. Smallwood said, “She [Kristin] is next to the concrete block wall, or she’s in the footing underneath the concrete wall. She’s there.” Of course, like any unsolved case, everyone has their own theory as to what happened to Kristin Smart. If you ask Smallwood, he says, “I don’t think they [SLO Sheriff Department] ever really wanted to solve the Kristin Smart case.” He continues, “I’m sure the police have more information than I do. They’re supposed to. That’s their job. But I’m a results-oriented kind of guy, and right now, still not too many results.” In essence, Smallwood undoubtedly believes Kristin’s remains are in Susan Flores’s backyard. And he isn’t the only one. This article specifically covered David Smallwood and the California Register’s part in the Kristin Smart case. We have reached out to Smart’s attorney Mark Connely for comment but have received no response. We did reach out to the SLO Sheriff ’s Office, who sent us the following statement, “As a result of Judge Van Rooyen’s suppression order in this case, the Sheriff ’s Office is unable to comment at this time.” In Part Two of this series, we will be sharing Paul Dostie’s involvement in the case, including his credentials to find clandestine graves worldwide. And soon, we will be speaking to Dr. Arpad Vass, where we will further explore the soil samples, his grave detection machine, and his conclusion as to why he firmly believes a human body, most likely Kristin Smart’s remains, is in Susan Flores’s backyard.
