n Sat. Apr. 17 a candlelight vigil was held in the downtown Paso Robles City Park in honor of Kristin Smart. In May 1996, 19-year-old Kristin Smart, a Cal Poly freshman from Stockton, had vanished over the Memorial Day weekend. Over the years, the San Luis Obispo County Sheriff ’s department completed endless searches, countless interviews, investigated one lead after another, all with no prevail until last Tuesday when Justice for Kris-

tin finally began with the arrest of Paul Flores for Kristin’s murder and his father Ruben Flores for accessory after the fact. Members of the community gathered around the park gazebo, where a gold hoop stood adorned with flowers in the center. “Justice for Kristin” banners were hung, and candles were available for the crowd. Local resident Trish Butcher hosted the event. Special speakers included Carla Clawson Hoffman, a Smart family advocate, and “Find Kristin Smart,” social media administrator. The newly appointed interim Paso Robles City Manager, Greg Carpenter, was sworn in. Carpenter will be working as city manager until the council chooses a permanent replacement for the prior Tom Frutchey. Frutchey’s last day as the city manager was on Friday. A public hearing was held for the proposed sewer rate increases for Paso Robles residents. City staff presented what they have already done to minimize costs for sewer. Through his podcast “Your Own Backyard,” Lambert walks through the details of the night Smart disappeared and the events that transpired in the years after. Local officials have credited Lambert for bringing renewed life to the case, which led to new leads and evidence. Lambert thanked everyone who has helped in bringing the Kristin Smart case to life. Paso Robles Press spoke with Lambert before the vigil about the case and his podcast.

Chris Lambert, creator of the “Your Own Backyard” podcast, received a standing ovation from the crowd when he walked up to speak. In late September 2019, Lambert, a Santa Maria native, started looking into Smart’s disappearance. With the lack of information he found

Paso Robles when his wife had to visit the area several times for work. When the city manager position opened up, he decided to apply. Mayor Steve Martin said, “I think the thing that impressed me the most when it came to appointing him was I think number one he’s got a very varied background. He is not just public service. He has a very strong experience in the private sector, in business.” Police officers, firefighters, citizens, and other city departments came by the city hall to give their farewell to Frutchey at his “goodbye drive-thru.” The Paso Robles Fire and Emergency Services awarded Frutchey with a bronze fire-

fighter helmet for his “outstanding service and dedication to the citizens of Paso Robles.” The award read a quote that Frutchey added to the swearing-in oath for public officials and service members, “For leaving the city of Paso Robles greater and better than when it was entrusted to you.” That very saying was something that Mayor Martin admired about Frutchey. “I think he’s done that—were better down than when he was first hired,” said Martin. By CAMILLE DeVAUL PASO ROBLES — As of Apr. 16, Tom Frutchey has officially retired as Paso Robles City Manager after over 49 years in public and private service. After five years of being Paso Robles City Manager, Frutchey decided it was time to slow down, retire, and let someone else take his place. So what is next for Frutchey? He and his wife are planning to spend more time with their grandchildren in Camarillo and take a few months to recharge and “veg out.” “What I want to do is volunteer—working on democracy in America because we’ve got issues. We’ve all been blessed by being born in this country and this era, and just looking around, I think we’ve forgotten how lucky we are and how it’s absolutely crucial that we invest in democracy and we invest in our communities and the people who need help,” says Frutchey. Frutchey was introduced to

SAN LUIS OBISPO — The San Luis Obispo County Board of Supervisors met on Tuesday, Apr. 20, for a regularly scheduled meeting. The meeting opened with the consent agenda, of which Supervisor John Peschong requested to pull item two, the introduction of an ordinance amending section 2.48.095 of the County Ordinance Code regarding compensation increases for the Board of Supervisors. The consent agenda passed 5-0, and 4-0 for item three, which Chairperson Lynn Compton recused herself from for undisclosed reasons. Item two was voted in favor 3-2, with Peschong and Compton against the item. SLO County Public Health Officer Dr. Penny Borenstein presented a current update on COVID, which to date has had 20,972 cases in the
county, and of that, only 211 are currently active five hospitalizations, and two people in the ICU. To read the full report on the COVID update, read SLO County 0.1 Percent From Orange Tier on page A5. Borenstein then proceeded with going over the state’s Blueprint Metrics. She stated, “unfortunately, the case count numbers place the county at 6 percent adjusted case positivity rate when it would need to be at 5.9 to move the county into the Orange Tier.” Borenstein explained that she has already begun a dialogue with the state to see if there are any missing test numbers from the week in question that could move the county into the Orange Tier. By returning to the Red Tier in case positivity, it would require that the county start over the process of achieving two weeks of low numbers before moving into the Orange Tier. Borenstein also addressed nonfactual responses to the vaccine and encouraged everyone to do their homework to learn the truths and decide what’s right for them. Bearcats Drop First Game of Season To Morro Bay Bounce back with two-hit shutout By CONNOR ALLEN PASO ROBLES — The Paso Robles baseball team hosted the Morro Bay Pirates on Apr. 10 and dropped their first game of the season 11-2 as their bats were finally cooled off follow-
ing a 5-0 start. Tuesday night, the Bearcats bounced back with solid performances both behind the plate and on the field, defeating Bakersfield Christian 3-0 at home. It was a cold and windy night on Saturday at Barnhart Field, but there was an excitement in the small crowd allowed into the stadium as it was the first game back for senior Jakob Wright,
who is committed to playing baseball for the Cal Poly Mustangs once he graduates in the spring. Wright was yet to pitch this season as he dealt with some lower-body injuries to start the year. The left-handed fireballer took the mound but had trouble locating his fastball, which in turn affected all of his pitches. While Wright had a tough time finding the strike zone, the
Pirates could still not catch up to his heater but took their walks which put them ahead early. Even though Morro Bay was able to score five runs in the first inning, no one had the Bearcats written off as they had outscored their opponents 46-15 in the first five games of the season. Saturday night just seemed to be Morro Bay’s night, as is sometimes the case in baseball. After seven innings, the Bearcats only recorded two runs on two hits—each of the hits coming from a senior, one from Wright, and one from Chase Stratman. Tuesday night, the Bearcats were back out on the field, this time taking on Bakersfield Christian, and bounced back to their old form as juniors Carson Turnquist and Anthony Garcia combined for a two-hit shutout at Barnhart Field. Turquoise, who has been the Bearcats ace so far in the young season, dazzled on the mound, pitching five innings of one-hit ball while also striking out eight and only walking a single batter. Following his magnificent performance, Garcia came on to close things out, pitching two innings, also giving up just a single hit and striking out one. Offensively Paso Robles recorded seven total hits but none more significant than junior Bryson Hoier’s two-run bomb to left field in the bottom of the fourth inning that extended the Bearcats lead from 1-0 to 3-0. Haier would finish the game 1-for-3 with a home run and two RBI. Wright and Stratman once again led the team in hits, each going 2-for-3 on the evening. Maxpreps.com currently has the Bearcats baseball team ranked inside the top 10 in Division 1 of the Central Section. Paso Robles presently holds the no. 8 spot overall, San Joaquin Memorial and Buchanan have the top two spots, both with a record of 7-1. Paso Robles will play their final tune-up game this Saturday against Carmel before they start their Mountain League season on Wednesday. Bearcats will begin Mountain League play with a series against the SLO Tigers, followed by the St. Joseph Knights and Atascadero Greyhounds.

Bearcats Defeat Hounds 3-1 at War Memorial

Bearcats Offense Too Strong For Templeton By CONNOR ALLEN TEMPLETON — Paso Robles and Templeton met on the gridiron for the first time in 97 years on Friday night in a big game for both Mountain League standings and North County bragging rights, and it was the Bearcats that came out on top 34-20 on Erb Field. The longawaited matchup met the hype as each of the team’s bleachers were as full as allowed while students not permitted into the stadium lined the netting watching the game from the parking lot. Ultimately, the Bearcats were too big and too strong and ran downhill on the Eagles all night, who were missing two of their top players in big man Chase Richards and running back Josh Berna, who both sustained injuries against St. Joseph last week. The Bearcats were not flashy but were incredibly efficient as both running backs exploded for over 100 yards and ran with a nastiness not seen in the North County for some time. The tandem of sophomore running back Leo Kemp and junior running back Jake Morones battered and bruised their way to over 250 yards combined on the ground and kept the chains moving all night long. Morones got the Bearcats on the board first with a one-yard plunge on Paso Robles’ opening, which also set the tone for the game on Friday night. The Bearcats marched down the field, going 61-yards in 12 plays, controlling the tempo and the clock, and, in turn, wearing out the shorthanded Templeton defense that plays several of its top players on both offense and defense. The Bearcats took a 13-0 near the end of the second quarter thanks to another laborious drive (seven plays, 33-yards) that was capped off by a punishing 17-yard run by Kemp, who ran through two Eagle defenders that appeared to have him dead to rights until he lowered
his shoulder and kept on trucking. Paso Robles would get one more possession before the half, and Kemp would punch in another touchdown, giving the Bearcats a commanding 20-0 lead at the half. Although the Eagles were down three scores and several players, they never quit and battled the Bearcats till the bitter end. Templeton took their opening possession of the second half right down the field and scored through the air as quarterback Tyler Kaschewski hit Kale Loppnow on a bubble screen, taking it 32-yards to for the score. The Bearcats answered with another long drive, this one finished with another Morones dive, and Paso Robles was once again up 20 points with just over four minutes to go in the third quarter. Kaschewski would add two more late touchdowns on the ground for the Eagles in the fourth quarter, but it would not be enough as the Bearcats won the game 34-20. Kemp and his ability to always fall forward led the Bearcats, and at the final buzzer, the sophomore had accumulated 164 yards on 40 carries, scoring three touchdowns for the Crimson Cats. His running mate, Morones, ended with a great evening of his own, running for 112 yards and two touchdowns on 19 carries. The Bearcats are now 3-2 on the season and have completed their Mountain League schedule, and currently sit in third place. Paso Robles will finish their season with two non-league games against Santa Maria this Friday and the rivalry game against Atascadero to close out the 2021 spring season. After jumping out to a 3-0 start, the Eagles have now dropped two straight and are 1-2 in their first Mountain League season. Templeton still has two league games to go with San Luis Obispo up first before finishing their season against the Righetti Warriors at home.

Both Atascadero and Paso back in action on Tuesday By CONNOR ALLEN NORTH COUNTY — Girls soccer began on Tuesday last week in the North County, and the second game of the season featured a matchup between the Atascadero Greyhounds and Paso Robles Bearcats on Apr. 15. It was the second game of the season for both teams that entered the matchup 0-1 after dropping their opening, and it was the Bearcats that left with the 3-1 victory at home in War Memorial Stadium. The soccer season will look different from years past and far more condensed due to the COVID-19 pandemic. This spring, the girl’s soccer season will only last ten total games, all of which will be league competitions between Apr. 13 and May 13. “We didn’t have any preseason games,” PRHS head coach Dillon Simoulis told the Paso Robles Press. “We tried some intrasquad, but we don’t have 22 on the team. The JV stepped up, and we got to scrimmage against them and figured things out, but we are really figuring it out on the fly, and they are doing a great job of adjusting.” As fans are slowly allowed into the stadiums this spring, the game between the two rivals brought back some of the

familiar sounds coming from the stands as parents and family members shouted instructions and congratulations all over the field. While many Atascadero versus Paso Robles games are seen as a great rivalry, these two teams have many girls who have grown up playing club together for various teams in the area, making for a fun and interesting matchup between the two teams. The fans didn’t have to wait long for action on Thursday as the Bearcats jumped out to a 1-0 lead early thanks to a goal from sophomore Lucy Pritchard, who came down the sideline on a long ball delivered to the wing and was able to cut into the box and finish with the ball in the back of the net. Less than 10 minutes into the game and the Bearcats were up 1-0. For the next 30 minutes, the game stayed mainly in the middle of the field as both teams tried to establish and impose their style of play on their opponent. Both teams had chances to score but just couldn’t connect in the final third, which is expected in only the second game of the season with minimal practice. With around 10 minutes to go in the first half, the Greyhounds answered the Bearcats with a goal on their own when Bella Valentine drew a penalty kick in the box. After the dust settled, Valentine took the PK herself and slotted it right into the bottom right corner of the net, and the game was tied. For the next nine minutes before half-

time, the Bearcats took over the game. Paso Robles earned two corner kicks that were both saved by Atascadero goalkeeper MaKaylie Howell. However, with less than a minute to go before the halftime buzzer, Paso Robles’ Ava Berezay was finally able to break through and powered one through the Greyhound keeper. The Bearcats would go into halftime up 2-1 with all the moment in the stadium on their side. Paso Robles kept the pressure on in the second half and added one more goal thanks to the right foot of freshman Audree Lerma and the final would end 3-1. “We are a pretty balanced team this year. We have two freshmen, about four seniors, and the majority of them are sophomores and juniors. So, we have a lot of new faces, and they are really coming together; there is a lot of good chemistry,” Stamoulis said. “We are happy to be out here; we are super pumped to play our ten league games.” The two rivals will play once more this season on May 4; this time, the Greyhounds will have the home-field advantage. The girls soccer season will continue this Tuesday. Paso Robles will make a trip over the grade to face the favorites in the Mountain League, San Luis Obispo. Atascadero will look to pick up their first win of the season in Santa Maria when they play the Righetti Warriors, who are also 0-2 on the season.

TUSD Plans for In-person Learning for Fall District looks to create virtual academy to replace distance learning By MELISSA MATTSON TEMPLETON — Templeton Unified School District (TUSD) School Board held a regular meeting on Apr. 15. The meeting opened with the superintendent’s report about the planning for the Fall 2021/2022 school year. He spoke about the vision for daily in-person learning, restoring traditional elements, and a multidimensional view of safety and wellness, which would focus on academic, social, emotional, and physical development. In learning from the past year’s run on technology equipment when schools shifted to distance learning, they are proactively securing the needed desk furniture for students to return to in person at six or three feet. With regard to distance learning, the district recognizes that this has become a good option for some families. As there will likely be continued interest in distance learning, they are looking into a transition by creating a close equivalent such as a virtual academy that other schools have had success with. The first step will be in determining how much interest there is in continuing distance learning. The California Assessment of Student Performance and Progress spoke about the current year’s assessments that the state was not waiving them and the minor freedoms the schools had in how they choose to administer assessments. Summer school was presented as a Monday to Thursday course to account for long weekends that families may want to take during summer vacation. Additionally, Monday, Jul. 5, would be a holiday from summer school. Jackie Bobsin, the Director of Nutritional Services at TUSD, spoke on the school meal programs. She suggested an increase in meal prices. The school is required to meet the school meal price equity index in order to maintain sufficient funds. The meal price equity index is defined as the difference in the dollar amount between the Federal reimbursement rate and the paid rate for the school lunch program. In order to maintain the balance, the school lunches were proposed to be raised to $3.50, with the breakfasts raising to $2.25. The last increase was in 2016. The suggested change was approved by the district. Lastly, the meeting highlighted the upcoming important football game between the Eagles and Bearcats. Gavin Taber Signs With Providence Christian College By CONNOR ALLEN TEMPLETON — Templeton second baseman Gavin Taber signed his National Letter of Intent to Providence Christian College on Wednesday afternoon on the field at Vineyard Elementary School following a 5-0 victory over the San Luis Obispo Tigers in the Eagles first Mountain League game of the season. “It is a crazy feeling,” Taber said on the field after the ceremony. “I have been working towards this for a long time. It is just awesome to have so much support in the community that you move to your freshman year. Everybody comes out and supports you and your family. It is a crazy feeling, and I am going to miss it a lot.” The Templeton senior moved into town at the end of the first semester of his freshman year from Orange County and has worked tirelessly with the baseball coaches to improve his game. Taber, who brings a great glove to the Eagles defense, has experienced some significant setbacks during his Templeton career but has never let it affect his work ethic. As a sophomore, Taber broke his finger and then lost his junior season to the COVID-19 pandemic. This season, as a senior, Taber finally has his chance to shine and is making the most of his opportunities. “It’s awesome to see for him,” Templeton head coach Rob Tompkins said. “He was actually down on the JV team with me his sophomore year for the first ten days in 2019, he was sent down, and I couldn’t understand why. So, when I ended up getting the job, I brought him back up, and he proved to me and the coaching staff that he is very capable of playing at the varsity level and he has earned everything.” Defensively, Taber is a jack of all trades. While he routinely starts at second base, he has the capability to play anywhere in the infield, especially the two middle spots. “He can play middle infield—he can really play

anywhere in the infield,” Tompkins explained. “He is an excellent second baseman, he can be a halfway decent shortstop, and he can play third if you need him to. Anything in the middle infield, he has great hands.” While Taber is fantastic in the field, he has also worked tirelessly on his offense which has shown in
the Eagles lineup this season. In the last five games, he is batting .455 with four RBI and three drawn walks. The Eagles are currently 6-2 and 1-0 in the Mountain League. TCSD Board Approve Replacement of the Memorial Colorado Blue Spruce
Briltz addresses requests for reservations of the community center By MELISSA MATTSON TEMPLETON — Templeton Community Services District (TCSD) Board of Directors met on Tuesday, Apr. 20, for a regularly scheduled meeting. The meeting opened with the reading of the consent agenda. Director Pam Jardini requested to pull item C, Ordinance 2021-2 Municode, for discussion, where some of the language was clarified before approving. Director Geoff English inquired about when the ordinances would be published, which was determined to be May 20, as it takes 30 days from approval to go into effect. Item F, removal of the Colorado Blue Spruce, was pulled for discussion by a member of the public, Nanette. The now diseased tree was planted in honor of a young girl who passed away in 1996. General Manager Jeff Briltz, who had recently spoken with the mother of the deceased, ensured that she understood that the tree had to be removed and that
the mother requested that whatever was planted there be well maintained, as well as the plaque that is there. The Templeton Fire Chief, Tom Peterson, has discussed options with a landscape architect and believes they have found a plant that will do well in that particular area. No further information was given or discussed about the young girl who passed out of sensitivity to the family. With acknowledgment to the family and keeping the space as a memorium, the motion to remove the current tree passed 5-0. Item I, Budget Amendment - Automated External Defibrillator And Hose Nozzles - Fire, was pulled for discussion by Navid Fardanesh. After first thanking Chief Peterson and his staff for applying for and securing a grant for supplies, Fardanesh inquired about the processes in place for purchases for the Fire Department to ensure that the team could secure the things they need in a timely manner without waiting weeks for approval. Briltz responded, confirming that while some purchases wait until budget approval is passed, any necessary items are purchased immediately, and if not approved, funding would be allocated from other sources. The budget amendment was passed 5-0. Briltz then addressed the COVID update, which has been five weeks since the last update. Youth sporting events were approved to 20 percent occupancy in early April, and signs have been posted
on the bleachers to let spectators know of the maximum limits. The rest of the park is not subject to the 20 percent but rather maintains the social distancing norms. Requests have begun coming in for the community center, and the new guidelines for such events are to keep events under 100 participants, no buffet-style dining, seating must be assigned, social distancing must be observed, and participants must show proof of all vaccinations or a negative COVID test within three days of the event. Based on these guidelines, the General Manager feels that most will choose to hold their events elsewhere until guidelines become looser. The guidelines that Briltz was referring to was an update from the California Department of Public Health (CDPH) on Apr. 13 that, added an addendum to the Activity & Business Tiers Chart. This was done in order to provide businesses with opportunities to adopt higher capacities by increasing capacity limits in facilities or sections of facilities where all guests have been tested or are fully vaccinated. However, according to the Health Insurance Portability and Accountability Act (HIPPA), Privacy Rule, a Federal law, gives a person the rights over their own personal health information and sets rules and limits on who can look at and receive private health information. The Privacy Rule applies to all forms of individuals’ protected health information, whether electronic, written, or oral.
In addition, the HIPPA Privacy Rule and federal civil rights laws protect Americans’ fundamental health rights against discrimination or violation. As of today, neither Governor Gavin Newsom nor the CDPH explained how local businesses, their personnel, or facilities would acquire personal health information from individuals. No mention of the current HIPPA laws were addressed by the Board or the General Manager. Currently, Concerts in the Park have not been approved, and while TCSD is hopeful of getting it running with a modified program and a late start, it is still not confirmed that it will be able to take place this summer. Next, the District discussed the District Code Modifications to get approval for submission. The General Manager welcomed the Directors to submit any other changes, typos, or clarifications they came across. The General Managers report highlighted the upcoming Clutter to Cash event, which currently has 137 registered households, which is believed to be the highest number of participants to date. SLO County 0.1 Percent From Orange Tier
CDPH introduces anonymous test mailed to residents to determine COVID-19 antibodies STAFF REPORT
SAN LUIS OBISPO – California Department of Public Health (CDPH) and San Luis Obispo County released the most recent statistics on COVID-19. Statewide COVID-19 Data as of Apr. 20 • California has 3,620,301 confirmed cases to date. Numbers may not represent true day-over-day change as reporting of test results can be delayed. • There were 1,606 newly recorded confirmed cases Monday. • The 7-day positivity rate is 1.3 percent. • There have been 58,075,920 tests conducted in California. This represents an increase of 141,833 during the prior 24-hour reporting period. • There have been 59,804 COVID-19 deaths since the start of the pandemic. • As of Apr. 20, providers have reported administering a total of 26,127,571 vaccine doses statewide. The CDC reports that 32,778,990 doses have been delivered to entities within the state.

COVID-19 Household Survey CDPH announced on Tuesday, Apr. 20, a research study to help better understand the spread of COVID-19 in California. In partnership with Stanford University, Gauss Surgical, and seven county departments of public health, including Alameda, El Dorado, Kern, Los Angeles, Monterey, San Diego, and Shasta counties, CalScope will ask randomly selected households to complete an anonymous survey and a test using a finger-prick to draw a few drops of blood to see if they have COVID-19 antibodies. The study will not ask for identifying information such as name or date of birth. Mailed invitations will be sent to more than 45,000 households. In the SLO County Supervisors meeting on Tuesday, Apr. 20, Dr. Penny Borenstein, County Health Officer, addressed the COVID Update and Blueprint Metrics. “Unfortunately, the case count numbers place the county at 6 percent adjusted case positivity rate when it would need to be at 5.9 to move the county into the Orange Tier,” Borenstein said. Borenstein explained that she has already
begun a dialogue with the state to see if there are any missing test numbers from the week in question that could move the county into the Orange Tier. “By returning to the Red Tier in case positivity, it would require that the county start over the process of achieving two weeks of low numbers before moving into the Orange Tier,” Borenstein said. The county has administered 80,000 doses collectively, and 30 percent of residents have been fully vaccinated, and 15 percent have received the first dose. Statewide over half the population has received at least one dose. Borenstein then went on to say that the county will be shifting to the “My Turn” platform starting Wednesday, Apr. 21, at 8 a.m. The delay in joining the platform was to ensure that it was pilot tested before the county terminated the use of their own appointment registry system on readyslo. org. In addition to Borenstein’s COVID update, she explained that FEMA funeral assistance is available to anyone who lost a loved one to COVID-19. Paul and Ruben Flores Plea ‘Not Guilty’ in the Murder of Kristin Smart By CAMILLE DeVAUL SAN LUIS OBISPO — On Monday, Apr. 19, in a San Luis Obispo Superior Courtroom, continued the arraignment hearing from Friday, Apr. 16 of Paul and Ruben Flores. The Honorable Judge Craig Van Rooyen was presiding. The District Attorney’s office filed felony criminal complaints against Paul Flores (44) and his father Ruben Flores (80) on Wednesday, Apr. 14. The charge against Paul Flores is the murder of Kristin Smart. It is alleged that Flores caused Smart’s death while in the commission of or attempted rape, which is first-degree murder under California law. Ruben Flores is charged with accessory after the fact to murder; it is alleged that he helped to conceal Smart’s body after the murder was committed. The lead prosecutor Deputy District Attorney Chris Peuvrelle was present for the live virtual hearing. At Thursday’s arraignment, Paul Flores appeared dressed in a suit. Ruben Flores remained in the county orange jumpsuit and wore a blue surgical mask. Both defendants attended the hearing virtually from the county jail. All parties were present over Zoom. Attorney Robert Sanger, and Sarah Sanger, legal representatives for Paul Flores, requested to continue arraignment until Monday, Apr. 19, and wait to enter a plea until then. Harold Mesick, attorney for Ruben Flores, also requested to hold a plea until Monday’s hearing. After no objection from the prosecution, the Judge complied and set a continued arraignment for Monday afternoon. A protective order was submit-
ted that morning by Robert Sanger on behalf of Paul Flores. Judge Van Rooyen stated that they had discussed and would delete “public officials” from the order. No objection by either counsel. The Judge also clarified that public employees of the court would have to coordinate with the press now to let them know times and locations and how things are being broadcast. Neither of the attorneys objected to the administrative side of communication. No other details of the order were discussed at this time. The Judge stated that based on the motion that was filed and the high publicity of this case, he did find it reasonably necessary to enter the protective order and would sign it with the changes as discussed. The last topic they addressed on Thursday was bail; Peuvrelle requested that bail would remain as set. Sanger, on behalf of Paul Flores, stated they would hold any contested bail hearing for Monday or after. Mesick, on behalf of Ruben Flores, stated they are willing to wait until Monday as well. Paul Flores remained on zero bail, as to where Ruben Flores bail was set at $250,000. Shortly after the hearing on Thursday, the Smart family released a statement: “After nearly 25 years of waiting, today’s delay in the arraignment process was not unexpected or surprising. Make no mistake; we have begun the final quest to bring justice for Kristin. We know we are in good hands with the San Luis Obispo County District Attorney’s office, and we will wait patiently for the process to commence.” On Monday, Apr. 19, both
defendants appeared in court by video once again from the San Luis Obispo County Jail. The hearing started with Robert Sanger entering a plea for Paul Flores of not guilty for the murder of Kristin Smart. Ruben Flores, attorney Harold Mesick also entered a plea of not guilty for the accessory after the fact to the murder of Kristin Smart. Following the plea, Judge Van Rooyen moved to hearing arguments of bail. Paul Flores’s attorney, Robert Sanger, argued for bail to be set for his client. Paul Flores was previously set for zero bail. The attorney’s mentioned a reference to the White and Humphrey case to discuss bail; all documents are sealed; no further information available at this time to the general public. Robert Sanger argued that there is no evidence to support that his client is a danger to the public, nor is he a threat to flee if released. Sanger mentioned that Paul Flores is a homeowner and has remained in California even though he has been “under suspension” or even “assault” of some sort from the media, not necessarily the news media but “blogs” that have been accusing him over the last 20 years. Peuvrelle argued that substantial evidence was found during the searches of Flores’s homes in March and in the early 2000s. Peuvrelle added that Paul Flores is currently facing a charge of felony possession of a gun in Los Angeles County. Snippets of bail reports were posted online by media outlets with a statement from Detective Cole made on Apr. 15 and Peuvrelle on Apr. 16. According to a SLO County Superior Court Courtroom Oper-

After hearing arguments from the prosecution and the defense, Judge Van Rooyen ruled to continue no bail due to the possible life sentence in the case, which he stated that Paul Flores has not remained crime-free since the alleged offense to date. Harold Mesick then argued for the release of Ruben Flores due to his failing health and that he has no prior arrest. Mesick said Ruben would be a “medical nightmare” for the jail and stated he is a “fine upstanding citizen in his community” and mentions he previously served as a reserve officer for the Redondo Beach Police Department. The highest sentencing for a charge of accessory to murder after the fact in California is three years, a sentence Ruben Flores could serve just going through the evidence. Mesick then pleaded that Ruben Flores could not afford the current bail set due to his only asset being his
home and a retirement account and recently filed for bankruptcy. Ruben and Susan Flores did file for bankruptcy back in 1997. Judge Van Rooyen suggested the possible use of electronic monitoring and forbidding the defendant to leave the county, which in turn Mesick stated the defendant has no passport. After the submittal of financials, they will meet back on Wednesday to determine the bail amount for Ruben Flores. The next item of discussion was the preliminary hearing with a possible date of Jul. 6. Peuvrelle stated that the amount of discovery is enormous and will be sent over to the defendants expeditiously, but with the amount that the prosecution has, it would take up to three months to read through, so he wanted to be cautious with setting the date. Sanger responded to Peuvrelle by saying he is familiar with cases with a lot of discovery and is sure this case is one of those. Both defendants waived their right to a speedy preliminary hearing. When Ruben was asked if he understood what waiving time meant, he responded by saying, “I think so. I’m not too sure about that stuff.” Mesick could be seen smiling and

Judge Signs Protective Order Due to High Publicity in Smart Case By CAMILLE DeVAUL SAN LUIS OBISPO — After the first arraignment hearing for Paul and Ruben Flores on Apr. 15, Honorable Judge Craig Van Rooyen signed a protective order for the case. The District Attorney’s office filed felony criminal complaints against Paul Flores (44) and his father Ruben Flores (80) on Wednesday, Apr. 14. The charge against Paul Flores is the murder of Kristin Smart, and Ruben Flores is charged with accessory after the fact to murder. Attorney Robert Sanger submitted the protective order on behalf of his defendant Paul Flores. There was no objection from either counsel. The protective order states the order applies to the following people: • Parties to this action • Attorneys connected with this case, including prosecutors, defense counsel, and their investigators • Law enforcement officers, including deputies of the San Luis Obispo Sheriff ’s Department • Court clerks and bailiffs • Witnesses • Judicial officers or employees • Any agent, deputy, or employee of persons listed above
The protective order originally included public officials, however, Judge Van Rooyen requested public officials be removed. Judge Van Rooyen also clarified that public employees of the court would have to coordinate with the press to let them know the times and locations and how things are being broadcast. However, late at night on Apr. 19, two media sources shared snippets of bail reports for Paul and Ruben Flores. The snippets included statements made from Deputy District Attorney Christopher Peurville, Detective Cole, and the Smart family on Apr. 15 and Apr. 16. Detective Cole stated he was against bail for the defendant, Paul Flores because they [sheriffs] are in possession of “biological evidence that makes them believe the victim was buried under the defendant’s father’s deck at one time. Detective Cole stated that both the defendant and his father are involved, and it is a family crime. Detective Cole said that should the defendant be released, he could move the body again.” One statement from Peurvelle regarding Ruben Flores reads: “Ruben Flores has repeatedly lied over the course of 24 years and has been uncooperative with law enforcement with the specific intent of aiding Paul
Flores with escape prosecution. The excavation below his deck at 710 White Court showed damning evidence that a body had been buried in that location and then recently moved. Ruben Flores has done everything possible to help his son, Paul Flores, keep the remains of Kristin Smart hidden. Additionally, due to the evidence gleaned from the excavation, it is reasonable to believe that Ruben Flores currently knows the location of Kristin Smart’s remains. Should he be allowed bail, it is a virtual certainty that he would use his freedom to continue his attempts to help Paul Flores thwart the prosecution in this case and continue to hide her remains. In the strongest possible terms, the People request that bail for Ruben Flores be set at no-bail because $250,000 is insufficient.” Both statements reveal important information about the case that was unknown to the public, including the recent movement of the remains from the White Court home of Ruben Flores in Arroyo Grande. After reaching out to the Smart’s attorney’s office, Robert Sanger’s attorney office, and Harold Mesick, all were under the impression that these documents were meant to be sealed and not released to the public due to the protective order in place. Tony Cipolla, Public Information Officer for the SLO County Sheriff ’s Department, was only able to
confirm that the documents shared were not from the sheriff ’s department. According to all the parties contacted, each were aware of the “snippets” circling the web today but could not comment any further on the matter. According to the courthouse operations manager, the bail reports mentioned are not public information due to the protective order. Essentially, the protective order in place for the Flores case states that none of the mentioned persons shall release any documents, exhibits, or other evidence connected with this case in any way, shape, or form. This includes the possibility of any document, exhibit, or other evidence or the identity of witnesses. A more common or slang term for this would be a “gag order: a judge’s order that a case may not be discussed in public.” If any person listed “believes it is necessary to issue a public statement in response to adverse publicity, they can make an application to the court for permission to make such a statement.” The order is to remain in effect until further order of the court. We have reached out to the district attorney’s office for further detail in this matter and will update when new information is available.

STAFF REPORT PASO ROBLES — Paso Robles Youth Arts Foundation (PRYAF) announced on Monday, Apr. 19, that it is growing, expanding, and rebranding. PRYAF proudly announces an official name change to “Paso Robles Youth Arts Center” (PRYAC), which is the next step in becoming one of the largest freearts campuses in the State of California. PRYAC explains that this year they will be growing the return of the Youth Arts’ in-person, Visual, and Performing Arts Program, more classes, working-artist instructors, and creative opportunities for youth 5-18. This week kicks off a new session of live classes alongside the new name and look. A generous marketing rebranding package was donated by the team at Motif Brands. A fresh new sign now graces the corner of 32nd and Spring, adding a pop of color as families make the return to classes this week. The sign-painting was donated by the talented Dot & Cross Studio and Gannage Design & Construction. The organization states that the decision to change the well-established name was carefully considered by Youth Arts Leadership. It was important to honor the past and mission of the organization. Paso Robles Youth Arts Foundation (PYRAF) was founded in 1998 by Community Visionary, Artist, and Philanthropist Donna Berg as a private foundation. Donna’s dream was the catalyst that inspired over 15,000 students and counting to find their voices through the arts and has provided
nearly 50 classes per week for 23 years. Berg is still the heart and soul behind the beloved after-school Center. Several years ago, PYRAF began the transition in becoming a public charity and the community-funded Arts Center it is today. Some of the original staff are still teaching at the Center after all these years. “The new name gives the Youth Arts a well-earned sense of place as we launch the public phase of our expansion project and prepare for all the exciting growth to come. It also clarifies that we are not a grantmaking foundation, but a charity that seeks grants to provide important services to the community,” explained Emily Jagger, Development Director/Interim Executive Director. harles S. Ferrell, 94, of Atascadero, died peacefully at home on March 25, 2021, with his daughter, Christine Allen, and son, Tom Ferrell, at his side. Charles was born on December 16, 1926, in Alhambra, California. Charles’ mother (Mabel W. Olson) passed away in 1934 of tuberculosis

pal “June” Hackney Moore passed away at home on March 30, 2021, with the love of her family surrounding her. She was born
when Charles was 7, and his father (Thomas Jefferson Ferrell) died in 1940 of a cardiac event at the age of 55, when Charles was 14. Charles completed High School while living with his older brother Cliff and his new wife, Maude Fifer. Charles’ life was forever changed while attending one year of UCLA, where he met Jesus Christ as his Savior while reading a Bible he was given. Charles moved to Oregon to attend Bible College. He met his future wife, Earline, at church during her senior year of high school. Charles was the President of the Southern Oregon Christian Endeavor and was the guest speaker at a youth event at the church. Charles
and Earline dated for two years before marrying on August 19, 1951, in Medford, Oregon. They celebrated their 68th anniversary just two months prior to Earline’s passing on October 21, 2019. Charles and Earline have three children, Laura Ferrell of Sparks, NV, Christine Allen of Santa Clara, CA and Tom Ferrell of Atascadero. They have five grandchildren and 12 great-grandchildren. Charles and Earline resided in Eugene, Oregon, for the first 13 years of their marriage, where Charles worked for the US Postal Service. It was while living in Eugene that their three children were born. They moved their family to Santa Clara, California, in 1964, where they resided for
the next 28 years. Charles worked for the Los Gatos Post office, eventually rising to the position of interim postmaster. He not only served in Los Gatos as the postmaster, but he also worked at several other post offices as an interim postmaster and chief problem solver. Charles enjoyed the challenge of reorganizing challenging operations and helping them return to efficiency. Charles was also very active at Los Gatos Christian Church as an elder and eventually served as the Chairman of the Board of Elders during some of that church’s most challenging days. Charles and Earline moved to Atascadero in 1992, where they built a beautiful home in Templeton on 2 acres. With a blank
slate, Charles applied himself to his passion for gardening and landscaping. He definitely had a green thumb and enjoyed the fruits of his labor, literally, from his fruit trees and gorgeous flower garden. Upon moving to Atascadero, Charles and Earline became active members at Atascadero Bible Church, where their son, Tom, served as senior pastor. Charles was a very popular adult Sunday School teacher for over 20 years, and he also served faithfully as the Atascadero Bible Church Hospital Chaplin for approximately 20 years as well. There will be a celebration of Charles’ life on Saturday, April 24 at 1 pm at the outdoor worship venue of Atascadero Bible Church.
in Washington County, Kansas, on June 2, 1932, to Edgar Carl Hackney and Opal Iola Raney Hackney. June’s younger years with her family were spent following the jobs along with many other families of the Depression Era. They moved around the Western States from Kansas, Nebraska, Wyoming, and California. They moved to the Paso Robles area in 1939. Her father worked on the many large grain farms and ranches in the north county. Her father and both grandfathers all worked at the Klau Mines in the Adelaida area. June attended several of the
small one-room schools, such as the Adelaida School and the Union School in the Geneseo area. When her family moved into Paso Robles, she attended the Grammar and Jr. High where the current Speck School stands today. She went on to attend Paso High as a proud “Bearcat” and graduated in 1950. June met the love of her life, Larry Moore, during their school years together. They married in May of 1951 and were to celebrate their 70th Wedding Anniversary. They had three children, Karen, Duane, and Debbie. June was a quiet and shy young woman who loved music and
reading. She sang with her family and many different groups learning to sing harmony in quartets and choirs. She was a majorette with the Bearcat High School Band all four years. One of her favorite places growing up was the old library, which was in the Carnegie Building in the downtown park. Her greatest passion was being a mother, grandmother, and great-grandmother. She was always willing to listen, lend a helping hand, or just a shoulder to cry on. She loved going camping with her family or just traveling the open road with Larry with their 5th wheel in tow.
June is survived by her loving husband, Larry Moore, children Karen (Bill) Roden, Duane (Ali) Moore, and Debbie ( Jerry) Vandergon. Her brother, Monte (Connie) Hackney, and her nephew Rod Smiley. Seven grandchildren and nine great-grandchildren. Brother and Sister in-laws’ Colene Bruce, Tom Moore, Cletis (Donna) Moore, Weldon (Alice) Moore, and Melba McKanna; and many, many nieces and nephews. She was preceded in death by her sister Peggy Hackney Smiley. A private family Celebration of Life will be held in May.

Carjacking on Santa Ysabel Leads to Arrest STAFF REPORT ATASCADERO — The neighborhood around the 7400 block of Santa Ysabel was disrupted by shouting shortly after noon on Saturday when two people were victimized by an alleged carjacker who was later apprehended by Atascadero Police. A resident of the area, John Mattson, was alerted to the crime in progress due to the shouting near his home on the street. “I heard some doors slamming violently, and then someone shouted, ‘get out of the car,’” Mattson said. “The person in the car said ‘He’s robbing me, he’s got a gun.’” Mattson added that an unrelated vehicle came down Santa Ysabel behind the vehicle being stolen, and he recognized the red truck of local communications specialist John Whitford who followed the vehicle after it was stolen. “He took off after the vehicle,” Mattson said.
“I’m not sure how far he followed them.” Atascadero Police Department responded to the report of a stolen vehicle, and officers located the vehicle being driven in the 4600 block of Sycamore Road, according to the City release. In contacting the victim and witnesses, it was learned a suspect had robbed the person of personal property and taken their vehicle after brandishing a weapon. A short vehicle pursuit ensued, and the suspect abandoned the vehicle and fled on foot into the Salinas Riverbed. The suspect was captured shortly after. A 14-year-old juvenile was arrested and transported to the Juvenile Services Center in San Luis Obispo. Charges included 215 PC; Carjacking, 211 PC; Robbery, 2800.2 VC; Felony Evading an Officer, and 148(a)(1) PC; Resisting/Obstructing/Delaying an Officer. The two victims were treated for pepper spray exposure by personnel from the Fire Dept.

Salinas Riverbed Vegetation Fire STAFF REPORT PASO ROBLES – On Saturday, Apr. 17, at approximately 9:09 a.m. Paso Robles Fire and Emergency Services responded to a report of a vegetation fire in the riverbed adjacent to 3200 Sulphur Springs Road, just north of the Highway 46 East bridge. First arriving, firefighters found a 20x20 spot actively burning around trees and brush. Firefighters contained the fire within 10 minutes and worked to fully extinguish the fire over the next hour.
Two fire engines, one Paramedic Squad, and one Battalion Chief from Paso Robles responded. Paso Robles Police Department also responded for traffic control and investigation. The cause of the fire appeared to be intentionally set. First arriving firefighters noted a suspect fleeing the area upon initial arrival. Paso Robles Police officers were able to locate a local resident Samantha Parker, who was arrested for starting the fire and narcotic violations. Parker was transported to San Luis Obispo County Jail. This is an ongoing

he Atascadero Chamber’s Annual Gala and Awards Dinner was held last Saturday, and of course, it was nothing like any of those events we’ve attended in the past. But, then, nothing is like it was in the past. We were not at the beautiful Lake Pavilion, we were not seated at beautifully decorated tables visiting with our friends, and we were not looking at the silent auction items and trying to out-bid our buddies! When it came to announcing the Awards for Citizen of the Year, Business of the Year, Entrepreneur of the Year, and Community Organization of the Year, it too had to be virtual, just like the auction and everything else. We did pick up our dinners at either Guest House Grill or Don Q here in Atascadero. However, since the Citizen of the Year, Brenda May, is active with our Atascadero Performing Arts Center Committee and Quota of Atascadero, a group of us also involved in the organizations, gathered at the home of

With warmer days sneaking upon us, I’ve been thinking “ice cream.” I found this recipe in a

n our last meditation, we saw that the Hebrew slave Joseph was unjustly put in prison, having been falsely accused of raping his master’s wife. What we are going to learn is that God had a precise reason for Joseph’s imprisonment. Joseph would meet two very important men who had both personally known and served Pharaoh, the King of Egypt. One man was Pharaoh’s cupbearer and the other man was Pharaoh’s baker. Genesis tells us that these men were put into prison because they had offended Pharaoh. Both men had
different dreams but were sad because they didn’t understand the meaning of their dreams. Joseph told them that God would enable him to interpret each of their dreams. God was with Joseph (Genesis 39:21) and would supernaturally enable him to interpret each dream. Joseph told the cupbearer that his dream meant he would be restored as Pharaoh’s servant in three days. Joseph then told the baker the awful interpretation of his dream. In three days, he would be hung on a tree, and the birds would eat the flesh off his bones. Both dreams were literally fulfilled. Joseph did ask the cupbearer to do a favor for him: would he show kindness to Joseph and influence Pharaoh to get him out of prison (Genesis 40:14). He told the cupbearer that he had been put in prison and had done nothing to deserve being imprisoned.
Unfortunately for Joseph, when the cupbearer was restored as prophesied, he did not remember Joseph. In Genesis 40:23, it states that the cupbearer “FORGOT HIM” (Genesis 40:23). The cupbearer didn’t remember what Joseph had done for him for “TWO FULL YEARS”. Joseph had to patiently endure the trial of being forgotten and remaining in prison. Certainly, this was a long time for Joseph to wait to be delivered by God. Pharaoh had two dreams that needed to be interpreted (Genesis 41;1-15). The cupbearer finally remembered that Joseph could interpret dreams and told Pharaoh about Joseph’s ability. Pharaoh brought Joseph out of prison to interpret his dreams. God had not forsaken Joseph but would use him to assist Pharaoh. This would result in his great exaltation by Pharaoh.
Lessons to be Learned
1. God has a precise purpose and reason for putting His servants in trying circumstances. In God’s timing, He reveals His purposes to His servants. 2. God is omniscient and knows the future that He has decreed. Many times in the Bible, God reveals the future, which is biblical prophecy (one-fourth of the Bible is prophecy). 3. God will never forsake His children who are experiencing difficult trials. I
t seems like the only time in our lives we wished we were older is when we were young. “How old are you?” someone would ask. “I’m five and a half !” Those halves were important. But, when we approach the 40s, we begin to go backward. “I’m 39 and holding.” It’s true that aging is inevitable—there’s no stopping it. But what if I told you there is a way to slow the process, perhaps even reverse it? According to Dr. Michael Roizen in his book, RealAge: Are You as Young as You Can Be? most people age at a similar rate until they hit their late 20s or early 30s. Then we start the transition into “aging.” Generally, our biological functions
decrease 3-6 percent per decade after age 35. The problem with these statistics is that they’re based on averages; the truth is that people age at drastically different rates. Most of us could cite examples of people in their early 70s who are globe-trotting or running marathons. And yet we all know people in their 60s who are bedridden or have some major medical problem and are on the fast track to old age. What makes the difference? Good genes? True to a certain extent, but inherited genes account for less than 30 percent of all aging effects. The rest is lifestyle choices. Which means we have a choice about how we want to age or not age.
Myths About Aging People usually equate aging with loss or a decline in vitality, attractiveness, and health. Here are some other myths: • Aging = illness • Aging is purely genetic. It’s written in the genes. You can’t change that fact. • Older people should eat less calories as they get older, or they’ll gain weight. • Feeling depressed is a natural function of getting older. • By the time someone is 60 or older, the damage is done. So, why bother? Decline and disease are not inevitable outcomes of aging. If we begin to change our behavior, we can stay fit, vital, and healthy for decades. So, what keeps us younger or older?
Stress Busters On the other hand, other choices, like taking a new class, nutrition, humor, letting go of resentments, or having fun with friends, can help keep you younger. Some risks are unavoidable, but by choosing to decrease the risks, you build your own age-protection plan.
Immunity to Aging Our immune system is number one. Think of it as your protector. It keeps outside invaders like viruses and bacteria at bay by locating and destroying them. It also uproots cells that have become malignant. Certain things, like exercise, antioxidants, nutrition, our mental health, all play a vital role in boosting our immune system.

Fortunately, you will not encounter any dinosaurs! Let us discover exactly what that means. The inland area of Avila Beach is an ancient arm of the sea. Ten million years ago, the land was completely submerged. The present-day rock formations were created from marine deposits. The landform in our region is a complex geology where you will find rocks and materials of various ages. There are three geological formations along the Bob Jones Trail. The Pismo Formation, Monterey Formation, and the Obispo Formation. A syncline is a structural feature defined as a fold formed long ago by layers with the youngest rocks closest to the center. Synclines are concave in shape like a bowl. The lay of the land defines the structure of rock. The so-called young rocks are about 2 million years old and located in the Pismo Formation. The Pismo Formation is a thick series of marine sediments. This formation can be found from the entrance of the pathway (Ontario Road) to See Canyon Creek Bridge. Simply glance up at the rock located along that section of the pathway. Notice the multiple layers, the color variance, and their angle. The direction of movement in rock strata can be noted. You are seeing years and years of rock building along with uplift. The layers were originally horizontal. Slowly, very slowly, the terrain repositions and bends. What was once horizontal may eventually become nearly vertical. Due to the massive activity in this locale, there is extraordinarily little continuous bedding that remains. The Monterey Formation, which is the second oldest, can be viewed along Blue Heron Drive, especially noticeable across from the Marre
Weir. The Monterey Formation consists of siliceous marine sediments. The wave-like lines that you see in the rock are examples of motion that continuously occurs. The layers or folds are designated by color or texture. Their surface can sometimes feel grainy from sand deposits. The process of building, uplifting, and moving is evident. Geological forces are happening all the time, mountains are building, the sea level is changing, but like the rotation of the earth, we are generally unaware. Normally one does not feel any activity unless there is an earthquake. When that happens, a surprise jolt is experienced that provides a keen reminder that the land beneath us does indeed move. The third formation is the roughly 20-million-year-old Obispo Formation. The Obispo Formation lithology varies but is dominated Rock layer, strata. Photos by Betty Hartig by lavas and tuffs. Tuffs are hardened volcanic ash. Just like the other previously mentioned formations, the Obispo Formation is comprised of marine deposits. If you venture off the Bob Jones Trail for 50-60 yards on Blue Heron Drive, the high road that leads to Mulligan’s restaurant, an excellent ancient rock sample is found on the north side. A reddish-orange rock structure is clearly visible. Stroke your hand along that rock, notice the smoothness of the surface. The slab appears to have been polished. That slick surface was formed by shifting land, better known as a fault. There are numerous faults in the area that all trend in the same direction. Fortunately, we have not had a significant earthquake in recent times. The topography of Avila has been significantly studied because of the Rock fault evidence. proximity to the nuclear plant. A detailed geology map colorfully indicates the makeup of the land. However, simply being on-the-lookout for stratified rock will create curiosity; no map required. The possibilities of what can be observed as you walk the Bob Jones Pathway are endless. We can go back in time by simply lacing up our hiking shoes.

him. His appreciation for the town is evident. “Paso is special because it has that spirit of community and the spirit of family,” said Frutchey. Frutchey admires the current city council’s ability to work together despite their differences. “This is a very special city council. I say that because they have different political philosophies, they have different approaches, they have core constituencies that are different, but all five of them do it for what’s best for the community in the long run, number one—They work hard to find a path that all of them can agree to even though they are on a full spectrum of political philosophies—that is so rare these days,” says Frutchey. Unfortunately, Frutchey will be unable to be a part of selecting the new city manager. Applications for the position ends at the end of May, and recruiters already feel they have some great candidates for the City. “Tom Frutchey is leaving very big shoes to fill, which means it’s our responsibility to find someone with very big feet to find them—I expect we’ll find somebody who is very successful in their own way,” Martin said. Frutchey’s advice for his future replacement is “Anybody who takes this job needs to recognize how special a place this is and build on the strengths of the people—whether it’s staff or the council or people in the community they give and they give, and they give and many times my job is to get out of the way and let people do what they love for the community they love.”

Staff received one written, and about four phoned in public comments on the sewer rates. Per the agenda recommendations, “If written protests are not filed for a majority of the 10,346 parcels affected by the proposed sewer rate increases.” This means 5,174 protests would have been required to stop the rate increases. All council members agreed that rate increases are, unfortunately, something they have to do. Council unanimously approved resolutions “21-XXX to establish new sewer rates effective Jul. 1, 2021.” and “Introduce and hold first reading of Ordinance No. XXX Amending Section 14.16.020 of the Paso Robles Municipal Code regarding Sewer (Wastewater) Service Charges, by title only and waive further reading, to implement the new sewer rates.” Darcy Delgado, an associate planner, presented the 2020 annual report on the implementation of the general plan. The State of California requires local jurisdictions to provide the annual status of their general plan. This report will be submitted in late April. Council approved, 5-0, the 2020 general plan and directed staff to forward the report to the State. A few items of progress that was made during 2020 for the general plan includes: • Out of the 240 General Plan policy action items (not including the Housing Element), 95 percent are completed, ongoing, or are in

formation surrounding vaccinations, suggested a forum in which residents could ask questions and get more information. Next was a presentation read by Supervisor Dawn Ortiz-Legg, the submittal of the proclamation of the 75th birthday for cityhood in Pismo Beach, which was read to Mayor Ed Waage. Pismo was officially established on Apr. 25, 1946, by JM Price, after beginning its existence as a gold rush-era beach community. Mayor Waage then spoke about the celebration, which due to COVID, will be postponed until October, at which point he plans on inviting the Board of Supervisors for thanks for their part in establishing the city back at its origination. Following was item 31, the presentation of the annual report by the Commission on the status of women by Paulla Ufferheide. She expressed her pride in the Commission not missing a single meeting throughout the pandemic. The Commission advocates for equal rights for women and girls in the county and works with groups to educate them on the issues affecting women. “We also try to help with ideas in how to enhance the lives of women within our county,” Ufferheide said. Throughout this last year, the Commission saw a lot of growth and success, but they are requesting additional support from the Board in the California Assembly Bill AB367, which is the Menstrual Equality Act, which states that schools 6-12 grade, community college, college campuses, and state and municipal buildings shall stock 50 percent
of their public restrooms with free menstrual products. Supervisor Ortiz-Legg made a motion to bring AB367 up for discussion in a future meeting, which was seconded by Supervisor Gibson. The motion passed 5-0. Peschong made a motion for SLO county to do a cost and benefit analysis for the cost associated with the county taking over waste management and possibly using public works to take over waste disposal and recycling following state mandates. Arnold seconded the motion. The motion was approved 3-2, with Gibson and Ortiz-Legg in opposition. The next item was the update on the redistricting effort and request to authorize a budget adjustment in the amount of $150,139 from General Fund Contingencies. As mentioned in previous meetings, the census data will not be available until September 2021, and state-adjusted data may take until the end of October. Counties have to use state-adjusted data to create the maps and cannot publish or draft maps until that data is made public. Given those delays in data, the timeline for redistricting will be tough to complete, which is why staff is creating a website featuring a public-facing mapping tool where citizens can submit maps, suggestions, and community groups they want considered in the process. The earliest date for the draft of the maps is likely to be Nov. 20, with a turnaround the following week to revise and finalize the map. The request for additional funds is to assist county staff with consulting contracts, and any amounts not used would be returned to the general
the process of being completed. • As of Dec. 31, 2020, there were 110 completed residential units, 41 residences under construction, and 60 residential permits either ready to pick up or in plan check. • A total of 2,493 residential units that were entitled during 2020, with most of these units belonging to the Olsen South Chandler Ranch and Beechwood Specific Plans. The Redtail Apartment project, which contains 200-units, was also approved, as were several smaller multi-family residential projects throughout the City. David Athy, a city engineer, provided a “Local Roadway Safety Program Study Session.” City staff will be returning to council next month with the “Final Local Roadway Safety Plan” for adoption. Ryan Cornell, Administrative Services Director, presented the third quarter update on the general fund. Due to prolonged COVID impacts, the ending reserve balance decreased by $150,000, less than two percent, compared to the Mid-Year report. Much better than was anticipated in June 2020. However, the projected end of year revenue is expected to be $43,488,003, with our projected end of year expenditures at $45,429,026. That makes our expenditures $3,106,698 more than our projected revenue. Estimated revenues for the next five years were given for the Measure J-20 sales tax, passed in Nov. 2020. All revenue from the tax is prioritized towards fire and emergency response, public safety and police services, and street repair and maintenance. For the 20-21 fiscal year, we should have a revenue of $1,027,675 from J-20. Police Chief Ty Lewis and Fire Chief Jonathan Stornetta presented a basic police and emergency services needs package. Battalion Chief Randy Harris then presented a cost breakdown for the future Fire
fund at the end of the year. Staff recommendations are to receive and file and approve the $150,139 in funding to facilitate the redistricting efforts. A motion was made by Supervisor Peschong and seconded by Supervisor Bruce Gibson and passed 5-0. Item 34 was a report on the American Rescue Plan Act of 2021 (ARPA). A 1.9 trillion dollar package to address the health crisis and economic crisis that went along with the pandemic. While guidance from the Federal Government on how the money can be spent has yet to be issued, nor the exact amounts the county will be receiving. The expectation is that the county will receive 54.9 million split into two payments, one in May and one a year later. The deadline to spend the money will be Dec. 31, 2024. The current plan is to take a budget-like approach with the funds and allocate for a one-time use since it is not money that will be funded to the county year over year. The anticipation is to see guidance from the Federal Government for these funds on or about May 10. Item 35 to receive and file a presentation of the Paso Robles Basin Aerial Groundwater Mapping Pilot Study results. There were several objectives to the study, mainly to get a better understanding of groundwater conditions within the Paso Basin. By using state-of-the-art technology, attaching instruments to a low flying helicopter, the project was able to take MRI of the land up to 1400 feet deep. The takeaway from the study was the ability to identify potential recharge areas based on the coarseness of the soils underground. Item 36 was the county staff ’s
Station Three and training center. The total cost for the new fire station is estimated to be $6,950,000. This includes costs for all on-site grading/site improvements, phase one station and Apparatus Bay, and Ardmore Road improvements. Phase one of the fire station does not include the training center. Councilman Steve Gregory made the following motion for the resolution amending the budget for FY 20-21: Updates already approved by Council with: • Additional requests of appropriations $75,500 for the citizen’s option of public safety and the board of State Community Corrections. • Adding one records clerk position to the authorized positions listing • Extending the temporary outdoor dining program using the savings from the propane assistance program • Funding the Community Partner Contracts The motion was seconded by Councilman John Hamon and passed with a 5-0 vote. Gregory then motioned for the second recommendation to be brought back to the council for more in-depth discussion. The recommendation is as follows: “Approve conceptually the (a) FY 2021-2 Measure J-20 basic needs packages for Police, Emergency Services, and Streets, the (b) General Fund capital improvement program, and the (c) General Fund operating budget.” Motioned passed with a 5-0 vote. Mayor Steve Martin began a discussion on a third motion to be made when the video was cut off. The last item on the agenda that was not covered was item 17. Senior Downtown Parking Permit Program. The comparison of cost analysis between consultant verse county staff could not be fully completed due to the time constraints and inability to get quotes from consultants. Supervisor Arnold made a motion to pursue the consultant model, with a second by Peschong. The motion passed 5-0. Supervisor Debbie Arnold motioned on a non-agenda water topic to bring back before the Board on May 4, a letter from the Supervisors opposing two applications that were submitted to the California State Water Resource Board by the Shandon San Juan Water District to appropriate water from Lake Nacimiento and Lake Santa Margarita. In accordance with the Brown Act, this topic could not be discussed, except to schedule it for a future meeting with notice to the public. After a closed session, with nothing to report, the Board went to the hearings on land use permits. Starting with item 38, a hearing to consider an appeal by Maldonado of the planning department’s approval of a minor use permit for SLO Cal Root to establish 3.39 acres of outdoor cannabis cultivation and more. Due to some confusion of having received a request for a continuance from the appellant and then the applicant, the Board voted 5-0 to continue the discussion in the Jul. 13 meeting. In accordance with

As the vigil continued and the sun started to set, the crowd that gathered together for Kristin lit the wicks on their candles in her memory. Later, to conclude the vigil, Athena Sorenson sang Amazing Grace while the crowd lit their candles for a moment of silence for Smart. John Segale, the spokesperson for the Smart family, released a statement on the family’s behalf. “While we are not able to join you for the candlelight vigil, we are with you all in spirit. Your love for Kristin and your unwavering support for our family for the past 25 years has been amazing and deeply appreciated. Many became involved more than two decades ago, like the relentless Dennis Mahon and our outstanding legal team, Jim and Garin Murphy and Mark Connelly. You all have filled our hearts, helped pick us up, and powered us forward to this point in time. the Brown Act, the Board heard all public comment. Public comment on the matter ranged from opposition to support of the project, with the majority favoring denial of the project. The reasons stated for denying the project were largely due to the odor, the current use of the area, which is primarily single-family homes as well as some agriculture, and the water usage. During public comment, Christina Maldonado, the appellant, called in to explain that she did not want a continuance and that they had inquired about it only when it was under question as to the name on the application for the project. She also stated that her counsel had not only emailed on Apr. 19 but had also called in to say that they did not want a continuance. The Board ultimately upheld their decision, and the continuance is set for Jul. 13. The last item of the day was a hearing to consider the appeal by Cliff Bianchine of the Planning Department’s Hearing Officer to conditionally approve the application of Copper Creek Farms to cultivate 5.7 of the 54-acre plot for cannabis growth and cultivation. The project was approved based on compliance of all the Land Use Ordinances (LUO) in the area and the addressing of all appeal issues in the Mitigations Negative Declaration (MND) prepared April 2020 and revised July 2020. Brought up in the appeal was the deeded easement for ingress and egress to the property, past-due property taxes, and code violations that have existed on the site but have since been resolved. SLO County staff recommen-
dation was to deny the appeal and uphold the Planning Departments’ decision. In hearing public comment, the Board heard from several neighbors to the project, who brought up items both retaining to the project as well as the behavior and past actions of the owner. Peschong spoke on the matter, stating, “In weighing this, I’m not against cannabis being grown; we’ve put it on ag and rural lands… Looking at the code violation... unpermitted power and plumbing… I gotta be honest with you, very tough to get my arms around that.” His feeling around the structure was that it may have been for farmworkers. “I feel this code violation is big enough for me that I cannot support this project. Arnold spoke on the easement of the road and thought that commercial activity on the shared road was beyond what was ok to introduce into a neighborhood. The Board was split 3-2 in a decision to uphold the appeal, with Gibson and Ortiz-Legg in favor of the applicant. The finding of the hearing was that the Board denied the project on the finding that the size and scale of the development were incompatible with historical and neighboring uses, insufficient demonstration of effective methods to control offsite odors, and that the nature of the verified code violations on the site during the application processing may result in repeat code violations. The next meeting of the Supervisors will be held on May 4, and the links to join can be found on the district website at slocounty.ca.gov
