A Chapter 7 bankruptcy allows the debtor to retain certain exempt property, but the debtor’s remaining property is gathered and sold by a trustee from which creditors will receive payment. It may also be used by businesses which wish to terminate their business. A Chapter 13 bankruptcy enables debtors, through court supervision and protection, to propose and carry out a repayment plan under which creditors are paid, in full or in part, in installments over a three-year period. Shoals farmers feud with state over weighing goods By DENNIS SHERER Times-Daily
FLORENCE — On most summer Saturdays, the Florence-Lauderdale Farmers Market is packed with vendors, but market manager Thurston Harper fears a state crackdown will prevent many farmers from selling at the market. An inspector from the Alabama Department of Agriculture visited the market in late May to test the accuracy of scales farmers use to weigh fruits and vegetables. Harper said the inspector told farmers they must begin using scales certified for commercial use. “He told me he would put me out of business if I didn’t start using a commercial scale,” said Waterloo farmer Mattie Lard. “I told him I would just start selling out of my home and he told me he would put out businesses there, too. I started looking for certified scales and found one down in Birmingham for $400 plus shipping and tax. To get one is going to wind up costing me about $450.” Most farmers at the market use household scales. Harper said many farmers who sell produce at the market cannot afford expensive commercial quality scales. “There’s no way someone who brings a few baskets of cucumbers and a few baskets or squash and maybe a few tomatoes that they grew in the garden and come down here
just on Saturdays is going to be able to afford to spend $400,” Harper said. The electronic postal scales Florence farmer Jack Goepfrich uses at the market were approved by the Department of Agriculture inspector, but Goepfrich was told to stop selling squash, cucumbers and other produce by the basket. “He told me I was going to have to weigh everything I sell,” Goepfrich said. “Sometimes I will have five, eight or 10 people standing in line waiting to buy produce, and if I have to starting taking time to weigh everything, it’s really going to slow things down. “When somebody asks how much a basket of something weighs, I give them a range of 1 3/4 to 2 pounds and I have never had anyone complain.” Commissioner of Agriculture Ron Sparks said the inspector visited the market after receiving a complaint about farmers not using commercial scales. “When we receive a complaint, we have to check it out,” Sparks said. “We want to make sure that when someone buys what they are told is a pound of produce, they get a pound of produce. Likewise we don’t want the farmers giving someone a pound and half of produce when they are only getting paid for a pound.” Jeanette Riggs, of Florence, said she has never worried about being shortchanged when she shops for fruits and vegetables at the market.
