COMPLAINT FOR DECLARATORY JUDGMENT I.

PARTIES 1.

Plaintiff Alabama Municipal Insurance Corporation (“AMIC”), is and

was at all times material herein an Alabama corporation, whose principal place of business is in Montgomery, Alabama. 2.

Defendant Ben Little is and was at all material times above the age of

nineteen (19) and a resident of Calhoun County, Alabama. 3.

Defendant John Spain above the age of nineteen (19) and a resident of

Calhoun County, Alabama. II.

JURISDICTION 4.

There is a real, substantial, and justiciable controversy between the

parties concerning their relationship with respect to insurance coverage.

This

Court has jurisdiction pursuant to Alabama Code (1975) §6-6-220 et.seq. and pursuant to Alabama Rules of Civil Procedure 57. Venue is proper in this Court
