29 Hopkinsville Female Academy Certificate American (Kentucky), 19th century. A silk graduation certificate from Hopkinsville Female Academy (incorporated 1839), awarded to Miss Marga W. Gant (1834-1914) in 1852 and signed by educator James D. Rumsey, with the adage Wisdom is better than Rubies, presented in a frame; 18.5 x 11.5 in. (sight). According to a history of Christian County, published in 1884, James D. Rumsey was a “classical scholar” who educated students in the area from 1824-1854. Rumsey had a reputation for excellence and drew students from all over the Nation. A Millenial Harbinger volume, published in 1859, recognizes the Hopkinsville Female Academy as one of the best in the country, and notes that the leadership is “devoted to the science and art of teaching young ladies, and has, in theory and practice, obtained a thorough knowledge of the whole art and mystery of educating them”. The same publication recommended the Academy as “worthy of the patronage of all who desire for their daughters the advantages of a thorough intellectual, scientific, religious, and moral training.” Records show that Marga W. Gant was born in 1834 in Hopkinsville, Kentucky (she is also listed as Margie, Margaret, and Margaretta on various documents). She married James Clark “Posey” Glass (18281893), a slaveholder, and had four children. Both she and her husband had family ties to Virginia, but they remained in Christian County, Kentucky for the remainder of their lives. Sources: Perrin, William Henry, ed. (sight). Mary Jane Keifer (ca. 1838-1935) was the daughter of John (1802-1865) and Elizabeth (Donnels) Keifer (d. 1865) of Clark County, Ohio. They were early settlers in the area and the cabin site for their home was recently unearthed in an archaeological excavation. Mary Jane was one of three children born to John and Elizabeth. In 1859 she married Stephen Robert Cross, who served as a Private in the 19th Ohio Infantry in the Civil War. Eventually, Mary Jane and her husband moved to Kansas and later to Iowa, where they are both buried. 87 Carter Family Quilt American (Georgia), ca 1898. A 110 block quilt with borders between each square and around the margins, each square and border pieced of small squares of Civil War era fabrics, totaling approximately 16,733 pieces; 75 x 78 in. This quilt was made in the family of descendants of Wiley Carter (1798-1864), one of whom is the 39th President of the United States, James Earl Carter Jr. The makers of the quilt are Nancy Spivey Carter (Georgia, 1845-1899) and Jesse Floyd Carter (Georgia, 1883-1973), the wife and daughter of Jesse Taliaferro Carter (Georgia, 1846-1924). Jesse Taliaferro Carter, the son of Wiley Carter and uncle of President Carter, served the Confederacy in Company F during the Civil War. As a soldier he collected articles of clothing from other soldiers such as shirts and neckerchiefs, which were then used to make the quilt near the end of the 19th century. The quilt has descended in the family of the consignor, the great-grandson and grandson of the makers. $800 - $1,000 88 Woven Jacquard Coverlet American, 19th century. The William Turner Family Cowan’s is pleased to offer a significant selection of objects from the William Turner family of Newport, Rhode Island, some of which have been passed down by more than five generations. Below is an overview of Turner family history including a list of lots related to each family member. 1st Generation: Dr. William Turner (1712-1754) grew up in Newport, Rhode Island where, according to family history, he studied medicine under Dr. Norbent Vigneron (French, 1669-1764). After completing his apprenticeship, Dr. Turner relocated to Newark, New Jersey, where he opened a successful professional practice. William married Mehitable Foster (b. 1715) with whom he had four children, including Daniel (1750-1837) and Peter (1751-1822). See lots 98 and 99. 2nd Generation: Daniel Turner (1750-1837), known as Captain Daniel, married his first cousin Sarah Foster (1754-1809) before serving in the Continental Army during the Revolutionary War. Together, they had ten children, including William (1775-1837), Peter (1781-1812), and Daniel (1794-1850). 2nd Generation: Dr. Peter Turner (1751-1822), Captain Daniel’s younger brother, served as a surgeon in the 1st Rhode Island Regiment of the Continental Army under General James Varnum (American, 1748-1789) and Colonel Christopher Greene (American, 1737-1781). Family tradition tells us that he was at the Battle of Red Bank and served on General George Washington’s staff at Valley Forge. Following the war, Peter and his wife Eliza Child settled in East Greenwich, Rhode Island at 21 Courthouse Lane, across the street from their brother-in-law General Varnum, whose wife Martha Child was Eliza’s sister. Family accounts describe Peter as a dear friend of General Lafayette (French, 1757-1834), who stayed for a time at General Varnum’s residence. Peter and Eliza had nine children, including Mehitable Foster (1780-1853). See lots 101 and 102. 3rd Generation: Commodore Daniel Turner (1794-1850), the son of Captain Daniel, began his career in the U.S. Navy as a midshipman at the age of fourteen, subsequently earning the rank of Lieutenant on March 12, 1813. Two days later, he joined Oliver Hazard Perry’s (American, 1785-1819) squadron at Sackett’s Harbor, New York where he took command of the brig Caledonia in the Battle of Lake Erie. On September 10, 1813, Turner distinguished himself by providing suppressive fire for Perry’s flagship Lawrence, thereby earning a Congressional medal and a sword from the State of New York. After serving under Perry’s command on the frigate Java and the schooner Nonsuch, Turner commanded the USS Erie and the USS Constitution. See lots 103, 105, 106, 107, 108, and 109. 3rd Generation: Dr. William Turner (1775-1837), the son of Captain Daniel and the older brother of Commodore Daniel, served as a surgeon in the United States Navy. William married his first cousin Mehitable Foster (1780-1853), the daughter of Dr. Peter (1751-1822), and they had nine children, including Peter (1803-1871). See lot 110. 4th Generation: Commodore Peter Turner (1803-1871) began his career in the U.S. Navy as a midshipman at the age of twenty, subsequently earning the rank of Lieutenant on December 20, 1832. From 1834 to 1835, he served on the USS Columbus within his uncle Commodore Daniel Turner’s (1794-1850) Brazil Squadron. He also served aboard the USS Constitution in the Pacific and afterward on special duty at Portsmouth Navy Yard. His final cruise was on the USS Southampton before serving as Commander of the U.S. Naval Asylum in Philadelphia, Pennsylvania. He was commissioned as a Commodore in 1867. He married Sarah Stafford Jones (1826-1875) and had five children, including Hettie Foster (1850-1937). See lots 104, 112, 113, and 114. 5th Generation: Hettie Foster Turner (1850-1937) married Henry Harlan (1848-1898) and they had three children, including James Turner (18811931), through whose descendants the Turner family collection is being offered for sale. 99 William Turner Family Queen Anne Dished Tilt-Top Tea Table American (Newport, Rhode Island), ca. 1750-1770. A Queen Anne tilt-top tea table in mahogany, having a single-board, dished top above stepped battens and a Doric column standard, all rising on a scalloped base with three serpentine legs ending in snake feet; ht. 26.25, dia. 33.25 x 33.75 in. In a journal entry written for her children, Hettie Foster Turner Harlan (1850-1937) related the history of the table as she knew it. “You have asked me to tell you of our old furniture. I will try to do so. The Turner furniture is from my grandfather’s time and is more or less interesting. The round center table is a valuable one. Having the rim round it denotes [sic] as much older than the ones you sometimes see without it. There are but four of them now in existence.” Tilt-top tables with similar features, including a dished top, stepped battens, a Doric column pedestal, a tripod base, and a stationary block supporting the tilting mechanism, have been related to other Newport tea tables, as illustrated in Patricia Kane’s article, The Palladian Style Furniture: Fly Tea Tables, published in American Furniture 1999, pages 1-16. Additionally, the Turner family example exhibits scalloping on the undersides of the legs near the pedestal. Similar shaping can be found on a tea table made by Newport cabinetmaker John Goddard (1723–1785), which is currently in the collection of the John Nicholas Brown Center for the study of American Civilization at Brown University. An early hard paste porcelain tableware group by Newhall consisting of 52 pieces, including 17 saucers, 11 dessert plates, 10 consommé cups, 8 teacups, 1 lidded coffee pot, 1 lidded teapot, 1 lidded sugar bowl, 1 creamer, 1 footed bowl, and 1 oval platter. The entire group decorated with a band of patterned gilding interspersed with reddish pink flower heads against a milky white ground. Following the war, Peter and his wife Eliza Child settled in East Greenwich, Rhode Island at 21 Courthouse Lane, across the street from their brother-in-law General Varnum, whose wife Martha Child was Eliza’s sister. In a journal entry written to her children, Hettie Foster Turner Harlan (1850-1937), described how her family received the china. “General Lafayette was a dear friend of great grandfather’s and Uncle Varnum’s as he was taught to us [sic] to call the general. Lafayette was entertained at Uncle Varnum’s house and the room he occupied while with them and [sic] has always been kept as he used it. When General Lafayette returned to this country he brought many beautiful gifts to our great grandmother among them a beautiful set of dishes and a beautiful dress which I inherited. A Palmer & Bachelders coin silver tea service in three pieces, including a teapot, a lidded sugar bowl, and a creamer, having tapering, paneled bodies with applied foliate handles and bands of chased acanthus leaves around the rims, shoulders, pedestals, and feet, the lidded pieces with cast flower finials, the sugar bowl and creamer with maker’s marks on the undersides, the teapot unmarked; teapot ht. 12.5 in.; silver wt. 69.92ozt (2175g). According to family history, the present tea service was given to USS Erie Commander Daniel Turner (American, 1794-1850) by a captain in the Royal Netherlands Navy as a show of gratitude for protecting his ship from pirates. We believe this story to be apocryphal since Palmer and Bachelder were apparently not active during Turner’s service in the United States Navy. We believe it more likely that if the silver were given as a gift, it might have been received by Commodore Peter Turner (18031871) whose career more closely matches the history of the silversmiths. Two days later, he joined Oliver Hazard Perry’s (American, 1785-1819) squadron at Sackett’s Harbor, New York where he took command of the brig Caledonia in the Battle of Lake Erie. The lower margin with another inscription This representation of the United States ship ERIE in a Hurricane, which commenced on the 3rd and continued with unabated / violence until the 7th of September 1827, in Lat. 36.6 North Long de 67.45 West; is respectfully dedicated to Daniel / Turner Esq re Captain Commanding /By his most obedient / And very humble servant / Constantine Smith, the portrait and inscriptions applied to a paper backing with a hand-painted image of a patriotic spread-winged eagle applied in the middle of the inscription, the whole housed under glass in a wood frame; 18.75 x 21.5 in. Following his heroics at the Battle of Lake Erie, Turner continued his service under Oliver Hazard Perry (American, 1785-1819) on the frigate Java and the schooner Nonsuch, before taking command of the USS Erie. Originally launched on November 3, 1813, theErie patrolled the Mediterranean as part of Commodore William Bainbridge’s (American, 1774-1833) squadron, eventually returning to New York for repairs in 1820. Following another stint in the Mediterranean from 1823 to 1826, Turner succeeded to command the ship from 1827 to 1830. During this period, Turner and his crew protected American interests in the West Indies and Mexico while, at the same time, combating the slave trade. The Naval Register of 1826 lists Constantine Smith as a Second Lieutenant. It seems likely that he made or commissioned the present ship portrait for Turner as a reminder of the commander’s time aboard the USS Erie. An investigation of the inscribed coordinates pinpoints the ship to a spot in the North Atlantic Ocean approximately 600 kilometers northwest of Bermuda at the time of the hurricane. A finely detailed scrimshaw whale’s tooth, one side featuring a three-masted ship flying an American flag at the stern and labeled Lexington, below the ship is a list of ports including Lima, Callao, and Mazatlan, to the left of the ship is a list of names including Van Rensselaer, Partier, Sherburne, and Wilson. The opposite side of the tooth featuring a man paddling a pontoon boat over waves with a catch of fish on the deck, labeled Balsa of Peru directly below with Valparaiso and Toboga above and to the left respectively; lg. 4.5 in. It seems possible that Commodore Daniel Turner (American, 17941850) made or acquired the present scrimshaw tooth between 1839 and 1841, while commanding the USS Constitution. It seems possible that Commodore Daniel Turner (American, 17941850) made or acquired the present box while imprisoned by the British at Fort Mackinac in 1814. Following his heroics in the Battle of Lake Erie, Turner took command of USS Scorpion and, while attempting to blockade British forces on Lake Huron, he and his crew were overtaken by the recently captured American ship USS Tigress on September 6, 1814. 137 Elmira, Fulton County, Ohio Inlaid Secretary Bookcase American (Elmira, Fulton County, Ohio), late 19th century. An intricate two-piece secretary bookcase in mixed woods, primarily consisting of figured maple and walnut, with poplar secondary, the upper section having a projecting cornice and paneled sides above a pressed wood floral band and two glazed doors opening to an adjustable three-shelf interior, the glazed door panels inset with foliate valences and flanked by chamfered stiles, all over two aligned and dovetailed drawers fitted with mushroom knobs. The lower section having a pressed top edge and paneled sides above a slightly outset fall front opening to a desk interior fitted with drawers and dividers, all over three dovetailed and graduated long drawers, the fronts edged with pressed wood bands and fitted with carved, fruit-shaped pulls, the whole above a shaped apron centered by a pressed leaf design and rising on curved stiles with carved flower heads. The upper and lower sections inlaid with light and dark wood chevrons. The back of the upper section with a partially obscured inscription reading Mg. by. J Nofziger(?) and Co. / Elmira. / March 13. .1885(?) Ohio., the back of the lower section incised 7 Pines; ht. 88, wd. 45.25, dp. 21.5 in. According to the U.S. Federal Census of 1880, there were two J. Nofzigers living in Fulton County, Ohio. The first, Jacob D. Nofziger (German/American, 1842-1928), lived in the Village of Archbold, Fulton County, Ohio with his wife Barbara and four sons. Census records indicate his profession as a farmer, though it was common for many agricultural workers to subsidize their income as cabinetmakers. The other is Jacob J. Nofziger (American, 1847-1918), a Mennonite, who lived in German Township, Fulton County, Ohio with his wife Barbara and three children. He also worked as a farmer. The U.S. Federal Census of 1860 lists his post office as Elmira. This lot bears a striking resemblance to a secretary bookcase made by Jacob Werrey (American, 1838-1893), which sold during Cowan’s Spring Americana sale on June 23, 2007 (Figure 1). Like the Nofzigers, Werrey was a Mennonite farmer residing in German Township, Fulton County, Ohio. Living in such a close-knit community, it seems likely that the Nofzigers knew Werrey and were familiar with his work as a carpenter, possibly even emulating his designs. Printed by Durand & Lauvé. Leroux made the engraving from an 1822 life-sized oil portrait of Lafayette by French artist Ary Scheffer. Scheffer presented his oil portrait to U.S. House of Representatives in 1824 during Lafayette’s 1824-25 farewell tour of the U.S. The portrait still hangs in the U.S. Capitol. The portrait depicts Lafayette standing in front of a simple landscape. Lafayette was the first foreign dignitary to address a joint meeting of the Congress. 164 Rare Lithograph of the Cincinnati and Clifton Incline by McBrair & Sons Probably 1877-1878. Color lithograph. 25.5 x 17.75 in. (sight). An important image of the incline which extended from the end of Elm Street (currently McMicken) to Bellevue Park in Clifton. The lithograph depicts Bellevue House, which was an amusement house for visitors who reached the top, and it was adjacent to Fairview School. An excerpt from The Bicentennial Guide to Greater Cincinnati (Giglierano and Overmeyer, 1988, pg. 236) describes the incline in its heyday: This land was largely undeveloped until Cincinnati & Clifton Incline Railway Company built an inclined plane on the site in 1876. The incline carried its platform from the end of Elm Street up to the level area on the hilltop where the power house, boiler room, machine shop, and unloading platform were located. The incline, along with several others in Cincinnati, no longer exists. This is the first time we have seen this lithograph from McBrair & Sons, and it was likely printed as a form of advertisement for the new incline. Property from the Collection of John A. Kaufmann & Co. / Liquor Dealers, stamped at the bottom F.I. Hoefle 179 Race St. Cin. O; 10 x 60 in. This wonderful advertising piece was engraved by Francis I. Hoefle, an engraver working in Cincinnati in the late 19th and early 20th centuries. The sign originally hung in Isaac Kaufmann’s liquor store in nearby Hillsboro, Ohio. In State Centennial History: The County of Highland, Kaufmann was described as “a public-spirited citizen of Hillsboro” and it was noted that despite his German birth, he was “decidedly American in his manners and methods. He combines the German level-headedness and prudence with the American push and originality, a combination that has enabled him to succeed and thrive, no matter what the obstacles might be.” Kaufmann opened his liquor store shortly after arriving in Hillsboro in 1875, and in 1880 his brother-in-law joined him in business. Business thrived and a wholesale store was operated in Cincinnati by Kaufmann’s son around the turn of the century. It is interesting to note that Kaufmann resided in Hillsboro, which played an important role in the history of the Women’s Christian Temperance Union and the prohibition movement. The WCTU was founded in Hillsboro in December 1873, and went on to become 50

243 A. Elmer Crowell (American, 1862-1952), Black Duck Decoy Massachusetts, late 19th century. A black duck decoy retaining original paint, having glass eyes and a slightly turned head. Underside signed with Crowell’s early brand, original owner’s initials JHD, inscription HOOVER in white paint, and label reading NE13, Black Duck, A. E. Crowell (1862-1952), Fine condition, from the Hoover rig; lg. 16.75 in. Anthony Elmer Crowell (1862-1952) grew up in East Harwich, Massachusetts. He became an accomplished sportsman and professional gunner at an early age. His interest in decoy carving began around 1882. By 1894, he was carving miniatures and decoys himself. At the time, he was employed as a caretaker at a gunning camp, offering access to nature for observation and clientele for his decoys. Around 1910, there was enough demand for Crowell’s decoys that he was able to support himself as a professional carver until his death in 1952. His son, Cleon (1891-1961), who became involved in his father’s business at a young age, continued making decoys in the Crowell style. 250 Rare Folk Art Painted Demorest Family Memorial and Folk Art Demorest Family Related Genealogical Scrapbooks American (Illinois) and Canadian, ca 1880s-1890s. Ten outstanding oil vignettes on wood panel mounted on black velvet decorated with painted floral motifs, surrounding a sepia family photographic portrait of David Lazier Demorest and his wife Elizabeth Leach Demorest, purported to be the artist, all encased in a black, gilt, and glass frame. The folk art vignettes depict various landscapes, including a bird’s eye view of Wolcottville, Connecticut, the birthplace of Elizabeth, a bird’s eye view of Demorestville, Ontario, Canada, the birthplace of David, two views of Niagara Falls, one from the American side, the other from the Canadian side, two views of Harrington, Ontario, Canada, a village founded by David, and depictions of the four seasons. Each vignette is titled but unsigned; 27 x 23 in. (full frame size). The lot also includes a voluminous collection of genealogical documents, notably featuring a folk art scrapbook with remarkable family tree drawings relating to the Demorest and Burdett, as well as Leach and Beach families, David and Elizabeth’s respective paternal and maternal genealogies, hand-written histories of these families, and hand-written biographies of David, his father and mother, Elizabeth, and their children. Also included are Memorial Books documenting the histories of the Beach and Leach families, and portfolios compiling family letters. Others documents included are additional family tree drawings, newspaper clippings, documents and forms related to the Demarest Family Association, and one tintype. A United Empire Loyalist, David Lazier Demorest (1814-1900), the son of Gilliam Demorest and Hannah Burdett, was born in Demoretsville, Ontario, Canada. He settled near London, On. in 1842, shortly before marrying Elizabeth Leach Demorest (1818-1900), the daughter of Benoni Leach and Rhoda Beach in 1845. He then founded the community of Harrington, On., in 1848, where he built a gristmill still standing today. In 1866, David, Elizabeth, and their children, moved to Elgin, near Aurora, IL., where they both died, only six weeks apart. The Demorests descended from David Desmarets, a French Huguenot, who settled in the English territory now known as New Jersey in 1677. The spelling of the family name has periodically evolved, at times spelled Demorest, Demarest, or Desmarets (its original spelling). According to the U.S. Federal Census of 1920, Samuel Hunt (American, 1874-1948) lived in Rush Creek Township, Fairfield County, Ohio with his wife Sarrah and daughter Helen. Census records indicate that Hunt worked as a merchant and owned his own store. It seems likely that the inscription on the back of the chest was used for shipping the chest to him rather than identifying him as the maker. Terms and Conditions By registering and bidding in an auction conducted by Cowan’s Auctions, Inc. (“Cowan’s”), bidders (whether present in person, by telephone, by agent, by written or telephone absentee bid instruction, or through a live internet connection) agree to be bound by these terms. These are the complete and only terms and conditions on which all property is offered for sale. Cowan’s retains the right to bar any bidder from participating in any auction and to exclude or reject any bid. 1) REGISTRATION. All bidders must register their name, permanent street address (no P.O. Boxes), and telephone number prior to the auction. Unless known to Cowan’s, all registrants are required to present two forms of identification, at least one of which must include a current photograph. Bidders may be required to present a valid Visa or MasterCard. By registering with Cowan’s or submitting an absentee bid form, an individual registrant authorizes Cowan’s to obtain a copy of his or her consumer credit report and authorizes Cowan’s, at its sole discretion, to use the information contained therein to make business decisions regarding the registrant’s participation in the bidding process. 2) ACCEPTANCE OF TERMS. Bidding on any item, whether in person, by phone, by absentee bid or via a live internet auction indicates the bidder’s agreement to be bound by these Terms and Conditions for Bidders. Any right of bidder under this agreement shall not be assignable and shall only be enforceable by the original buyer. The rights and obligations of the parties shall be governed by the laws of the state of Ohio. All bidders submit to the personal jurisdiction of the state and federal courts in Ohio. 3) TERMS OF SALE. Announcements made the day of auction take precedence over any previous communication. The auctioneer reserves the right to withdraw any lot at any time before its final sale and to reject any bid for any reason. The highest bidder for each lot acknowledged by the auctioneer shall be the “buyer”. If any dispute arises as to any bidding, or between two or more bidders, at the sole discretion of the auctioneer, the successful bidder will be determined or the disputed lot shall be put up again at the last undisputed bid and resold. 4) BUYER’S PREMIUM. (a) Buyer’s Premium for “Antique and Modern Firearms” auctions; the Auctioneer will collect and retain from the Buyer, as additional commission, a premium equal to 15% the Sale Price of each Lot up to and including $200,000, plus 10% of the amount by which the Sale Price exceeds $200,000. (b) Buyer’s Premium for “Fine and Decorative Art”, “Modern Ceramics”, “American Indian and Western Art”, “American History”, “Fine Jewelry and Timepieces” and any other specialized auctions; the Auctioneer will collect and retain from the Buyer, as additional commission, a premium equal to 20% the Sale Price of each Lot up to and including $200,000, plus 15% of the amount by which the Sale Price exceeds $200,000. (c) Buyer’s Premium for online, timed and other third-party bidding platforms may vary. 5) ESTIMATES AND RESERVES. Presale estimates are intended to be guides and may or may not reflect the ultimate hammer price of a lot. Cowan’s retains the right to change estimates on any lot up to time of sale. A reserve is a confidential minimum price agreed upon by the seller of the lot and Cowan’s. In the case of reserved lots, the seller has authorized Cowan’s to bid on seller’s behalf until the reserve price is reached. In no case will the reserve be higher than the low presale estimate. Cowan’s standard house reserve on all property at auction is one-half of the low estimate. 6) WARRANTIES AND DISCLAIMERS. Cowan’s makes a limited warranty only to the original buyer of record concerning the authenticity of each lot for a period of 14 days after bidder’s receipt of the purchased lot. If a buyer is not satisfied that the lot purchased is genuine, the buyer may, at his or her own expense, obtain the opinion of two mutually agreed upon recognized experts in the field of the disputed lot. If these experts determine that the item is not genuine, the buyer’s sole and exclusive remedy shall be the rescission of the sale and refund of the amount paid for the item. It is specifically understood and agreed that the rescission of the sale and refund is exclusive and in lieu of any other remedy which might otherwise be available as a matter of law or in equity, and such remedy is conditioned upon the buyer returning the property in the same condition as at the time of sale. Cowan’s shall not be liable for any incidental or consequential damages. All sales are final, with no returns or refunds except as provided in this limited warranty. Except as provided in the immediately proceeding paragraph, EVERY LOT IS SOLD “AS IS”, without any representations or warranties by Cowan’s or the seller as to merchantability, fitness for a particular purpose, condition or value of the property, or the correctness or completeness of the catalogue or other description of the property, and no statement, whether written or oral, shall be deemed such a representation, warranty or assumption of liability. Cowan’s makes no representation or warranty that the buyer of manuscript material, photographs, prints or works of art will acquire any copyright or reproduction rights. Cowan’s does not guarantee the working order of any clock, watch, electronic or mechanical device. Dimensions given in the catalogue descriptions may be approximate. 7) DEFINITIONS OF AUTHORSHIP. “By” or “Maker/Artist” — in our opinion, the work is by the artist or maker stated “Attributed to” — in our opinion, the work is probably, but not definitely, by the artist or maker stated “Signed” or “Marked” — in our opinion, the signature or mark is that of the stated artist or maker “Bearing the signature (or mark) of” — in our opinion, the signature or mark is probably, but not definitely, that of the artist or maker stated “Circle of” — in our opinion, the work is of the period and by an artist or maker closely associated with the stated artist or maker “School of” — in our opinion, the work is by a pupil or follower of the stated artist or maker “Manner of” — in our opinion, the work is of the period and done in the style of the stated artist or maker “After” — in our opinion, the work is a copy of a work by the stated artist or maker 8) INSPECTION. Except for Online-Only Auctions, all lots are available for inspection prior to the auction. Condition reports for most items can be found online at Cowan’s website, www.cowans.com, and prospective bidders are encouraged to contact Cowan’s directly for additional information regarding the condition of any lot. Cowan’s does not warrant the condition of any item. Buyers interested in the condition of an item are encouraged to contact Cowan’s and, to the best of our ability, we will document for the prospective bidder the condition status on any lot. Condition is always a subjective evaluation and final responsibility rests with the buyer to assess the condition of any item sold by Cowan’s. ABSENTEE, TELEPHONE AND INTERNET BIDDING Absentee and telephone bidding is offered as a free service to our customers and prospective bidders. Cowan’s shall not be responsible for any errors or failures in executing bids, either absentee, telephone or via the internet. 9) ABSENTEE BIDDING. Absentee bids are accepted via mail, fax, email and on Cowan’s website. Such bids will be posted with the time and date of arrival, with ties being awarded to the earliest bidder. Absentee bids that are faxed or emailed to Cowan’s need to be in the office at least 2 hours before the sale begins. An absentee bidder unknown to Cowan’s may be required to submit a bank letter of credit prior to the auction, or, using a credit card, deposit with Cowan’s a fee equaling 30% of the absentee bid. All absentee bids are executed competitively by a member of the auction staff. The auction staff will try to purchase the lot for the lowest price possible and will bid up to the amount designated by the absentee bidder only if necessary. Cowan’s does not accept “buy bids,” or absentee bids which have no limit. In the event of a tie bid between a floor and an absentee bidder, the floor bid will be honored.

10) TELEPHONE BIDDING. Bidding live via the telephone is available on a first come, first served basis for those lots with a low estimate of $500 or greater. In order for Cowan’s to efficiently serve the needs of those who wish to bid by phone, please note the following: • To participate in the auction by telephone, potential bidders must complete and sign the absentee bid form and check “I WISH TO BID BY TELEPHONE” for the designated lots. Potential bidders may also reserve a phone line on Cowan’s website. If faxing or emailing requests for phone bidding, they need to be in Cowan’s office 2 hours before the sale begins. Once the auction begins, requests left on Cowan’s website may not be retrieved by the staff. • Telephone bidders are advised to indicate an “insurance bid”, which amount will become an absentee bid, pursuant to the absentee bidding process set forth above, if Cowan’s can not reach the bidder by telephone for a particular indicated lot. • Telephone bidders must disable any caller ID or other call blocking mechanism. • Cowan’s sells about 100 lots per hour, so telephone bidders should plan accordingly. Cowan’s will attempt to reach each telephone bidder, but Cowan’s is in no way responsible for missed calls. 11) INTERNET BIDDING. Internet bidding is available through our website; additionally, Cowan’s may post certain auctions on Bidsquare (bidsquare.com) or Proxibid (proxibid.com). There may be terms which apply solely to internet bids that should be reviewed online at the time of sale. Cowan’s is not responsible for any failure to execute a bid and shall have no liability to any bidder for any technical or other failure associated with an internet auction. 12) BIDDING INCREMENTS. The following increments are used at the auction. Absentee bids must fall within these increments. Cowan’s will automatically reduce any absentee bid to the closest increment if the bid falls outside the published range of increments. For Bids Falling Between Bidding Increment $0-500 $25 $501-1,000 $50 $1,001-3,000 $100 $3,001-5,000 $250 $5,001 and up $500 or at the discretion of the auctioneer Cowan’s reserves the right to modify increments at any time during the auction. AFTER THE AUCTION 13) BUYER’S RESPONSIBILITY. Upon the fall of the hammer, title to the offered lot shall pass to the buyer and the buyer immediately (a) assumes full risk and responsibility for the lot, including liability for loss or damage and (b) is liable for payment of the Purchase Price (as defined below) to Cowan’s. It is the buyer’s responsibility to ask specific questions on condition related concerns prior to the auction. Cowan’s will not rescind sales with buyers that have disputes regarding firearm’s bore condition. 14) PURCHASE PRICE AND PAYMENT. The discounted “Purchase Price” for each lot shall equal the hammer price, buyer’s premium, sales tax and, if applicable, all packing, handling, insurance and shipping costs. Payment may be made with cash, personal or traveler’s check or credit card. Cowan’s reserves the right to hold a purchased lot until a check has cleared. A convenience fee of $15.00 will be assessed to all transactions made in the alternate payment channels: Phone payments are made available as a convenience outside Cowan’s Auctions customary payment channels, therefore these payments are qualified as payments made in the alternative payment channel. All forms of payment made using this method will be assessed the convenience fee. Please call Cowan’s Auctions if you have any questions regarding this policy. PLEASE NOTE: A surcharge of 2% will be assessed to all credit card transactions. This surcharge is not greater than our cost of acceptance. Buyers who are present at the auction must pay the full Purchase Price at the time of the sale. Buyers who bid by telephone or who are absentee bidders will be invoiced within 5 days after the close of the auction and must pay the full Purchase Price for each purchased lot within 14 days after the date of the auction. By signing the absentee bid form or placing a bid by telephone, an absentee bidder authorizes Cowan’s to charge the Purchase Price for each lot for which such bidder is the successful bidder to the credit card number provided by telephone or on the absentee bid form, unless payment in full or alternative payment instruction is received within 14 days after the date of the auction. No property will be released by Cowan’s unless the Purchase Price has been paid in full. Institutional billing may be available, and should be arranged prior to the auction. Cowan’s may impose late charges of 1.5% per month (or the highest interest rate allowed) on any amount owed to Cowan’s that remains unpaid after 30 days. Buyer shall be liable for any collection costs or attorney’s fees incurred by Cowan’s to collect payment, to the extent permitted by law. 15) SALES TAX. Buyers are required to pay any applicable state and local sales tax. 16) SHIPPING. At the request of the buyer, Cowan’s will authorize the shipment of purchased items usually within two weeks after payment has been received. Shipment is generally made via UPS or Fed-Ex Ground. Unless buyer gives special instructions, the shipping method shall be at the sole discretion Cowan’s Auctions. Cowan’s is in no way responsible for the acts or omissions of independent handlers, packers or shippers of purchased items or for any loss, damage or delay from the packing or shipping of any property. ADVICE TO INTERNATIONAL BUYERS. Cowan’s will not ship any package containing a firearm to any location other than within the United States. Buyers outside the United States must make their own shipping arrangements taking full risk for the transportation of any firearm. Property made of or containing certain plant or animal materials, such as coral, crocodile, ivory, whalebone, baleen, tortoiseshell, etc., may require a license or certificate before exportation from the United States and importation to another country. If you are purchasing items that contain these materials, you need to check the government wildlife import requirements in the countries from which and to which the item is being shipped prior to bidding. Since the export and import licenses are independently issued by the countries of origin and destination, obtaining one does not guarantee that you can obtain the other. Purchasers are responsible for making timely payments on items won at auction, even if a license is delayed or denied. 17) SHIPPING CHARGES. Buyers are required to pay for all packing, shipping and insurance charges. Overseas duty charges are the responsibility of the successful bidder. Be aware that for larger and/or valuable items, shipping charges can be substantial. 18) REMOVAL AND STORAGE OF PROPERTY. If purchased property has not been removed, or Cowan’s has not received shipping instructions within 21 days after the auction date, a $10 per item per day storage fee may be charged to the buyer. 19) CANCELLATION OF SALE. If purchased property remains in the custody of Cowan’s for a period of 60 days following the auction, Cowan’s may, at its option, cancel the sale, retaining as liquidated damages any payments made by the buyer, or resell the property at auction or by any other commercially reasonable means, for the account and at the risk of the buyer, and in such event, buyer shall be liable for the payment of all deficiencies plus all of Cowan’s costs, including but not limited to storage and costs of both sales.
