A Glossary of Birdstone Terms Describing Prehistoric Art is just as subjective and difficult as describing contemporary painting and sculpture. As humans, we tend to see and react to art in different ways. Most collectors of birdstones are quite happy and content to collect almost any nice birdstone regardless of type or form, as they all have their aesthetic qualities. The Sorgenfrei Collection focuses primarily on Elongated Slate birdstones, commonly called Glacial Kame Birdstones. However, Glacial Kame should be reserved for the culture (8000 B.C. – 1000 B.C.) and not as a specific type. The terminology for the named types and special attributes that are used in the following descriptions within this catalog generally follow the terminology presented in the special birdstone issue of Prehistoric American, Vol. XLIII, 2009 on pages 5-11 by Koup, Sisson and Fuller.
Elongated Birdstones - having a long narrow body, a head and a tail Elongated Fantail Birdstones - having a long narrow body, a head and a tail that expands in width to become wider than the body Elongated long Neck Birdstones - having a long narrow body, a head and a tail with a neck that is longer than the head Saddle Birdstones - generally having an elevated upward curvature of both the head and tail and often with eyes Bust Birdstones - having a head, neck and base and often with eyes Chunky Birdstones - that generally having a wide, thick body, small heads various forms of tails

1 A “CHUNKY” SLATE BIRDSTONE Glacial Kame Culture / Late Archaic Period, 4000-1500 B.C. unknown provenance 4 in. Formed of dark green, banded slate; with a classic form of a small head, nearly vertical tail, and a thick body. This style of the chunky-type birdstone have been found in Indiana, Ohio and Michigan. 2 AN ELONGATED SLATE LONG NECK BIRDSTONE Glacial Kame Culture / Late Archaic Period, 4000-1500 B.C. Wood County, Ohio 5.25 in. Made from dark green, banded slate; having the natural lines of the slate form a concentric circle surrounding the eye on the right side of the head. The banding accentuates the form further, flowing from the top of the head across the back and terminating at the tail. The surface is highly polished by the effort put forth by the prehistoric sculptor. This birdstone was found in the 1940s, east of Bowling Green in Wood County Ohio by an oil driller. It then entered the collection of Eugene Hirzel of Toledo, Ohio. Hirzel was well-known as a highly selective collector of fine artifacts as can be seen in Who’s Who in Indian Relics, Volume II, 1968. 3 A CONCAVE HUMPED BANNERSTONE Late Archaic Period, 5000-3000 B.C. 5.375 in. Made from dark slate with a white contrasting streak; a deep, concave flute or channel runs parallel to the perforation. The Late Archaic Concave Humped Bannerstone is a rare and interesting form. David Lutz, author of The Archaic Bannerstone (2000), illustrates only six examples in his book. Lutz observed that when viewing this bannerstone from the end, it has the appearance of a bird in flight. 27 AN ELONGATED SLATE BIRDSTONE WITH NODULAR EYES Glacial Kame Culture / Late Archaic Period, 4000-1500 B.C. Cuyahoga County, Ohio 5.5 in. An exceptional example, large in size and made from dark, banded slate. This bird features nodular eyes that rise from the head; the natural banding of the slate forms a concentric circle around the left eye; and the slightly expanding tail has a rearward lean. 28 A CHUNKY SLATE BIRDSTONE WITH DRILLED EYES AND MOUTH Glacial Kame Culture / Late Archaic Period, 4000-1500 B.C. Lorain County, Ohio 4.125 in. Crafted from green banded slate and formed with small, drilled eyes carefully placed on both sides of the head; this bird is further detailed with a small, incised mouth. The edges of the base are sharp and crisp. Pioneer collector Berwell B. Thomas (1861-1944) acquired this piece around the turn of the 20th century. The Berwell collection focused primarily on artifacts from the northern Ohio counties of Lorain, Sandusky and Erie. 57 AN ELONGATED SLATE BIRDSTONE Glacial Kame Culture / Late Archaic Period, 4000-1500 B.C. Auglaize County, Ohio 6 in. Formed using a unique and attractive dark red, banded slate. The natural banding of the slate enhances the finished form. The tail is slightly expanding. The eyes are slightly nodular and on the left side, the eye aligns with the natural concentric circle formed by the banding of the slate. This purposeful, prehistoric sculpting, makes this a fine and elegant example. This birdstone was found by Ernie Blank in 1913, near the town of New Knoxville in Auglaize County Ohio. 64 AN ELONGATED SLATE BIRDSTONE Glacial Kame Culture / Late Archaic Period, 4000-1500 B.C. Putnam County Ohio 4.875 in. A fine example crafted from polished, green banded slate. This piece exhibits sharp angularity in form, especially at the junction of the head and neck, and the neck and base. The vertical tail further accentuates the form. The Bertha Hoffman farm in Putnam County, Ohio was the place of discovery sometime prior to 1927 and originally collected by Harry B. Mapel, the pioneer Northwest Ohio birdstone collector. It should be noted that most of Mapel’s birdstones went to another local northwest Ohio collector named Gilbert Walls. Gilbert Walls, a generation younger than Mapel, lived in Gomer, Ohio, a short distance from Mapel’s home. Around 1980, the Walls/Mapel birdstones were dispersed. 86 A SLATE SADDLE BIRDSTONE WITH POP EYES Glacial Kame Culture / Late Archaic Period, 4000-1500 B.C. Putnam County, Ohio 5.5 in. Made from a dark slate; with oval-shaped, button pop-eyes; each eye having a distinct ridge on the underside. This ridge is a common trait found on birdstones with pop-eyes. The graceful fantail rises only slightly from the body. This, and other birdstones of the type, typically have bridges which extend from the underside of the body, at both the front and rear to facilitate the drilling of perforations. The rear perforation bridge on this piece was broken in prehistoric times. A small repair hole was drilled from the bottom, exiting on the top of the back. 92 AN ELONGATED SLATE LONG NECK BIRDSTONE Glacial Kame Culture / Late Archaic Period, 4000-1500 B.C. Fairfield County, Ohio 5.5 in. Large and attractive birdstone made from dark green, banded slate. The “Long Neck” form is due to the length of the neck being greater than the length of the head. The crown of the head is round and red ochre appears in both perforations. A small paper tag is attached by string to the rear perforation and indicates it was collected in Fairfield Co. Ohio. These tags are found on other Dilley birdstones and other types of artifacts, apparently from an older collection acquired by Dilley. In most regions of North America, the smoking of tobacco was practiced by Native Americans primarily as an offering to supernatural beings to pray for their blessing. Pipes served as the major instrument used for this purpose and were the subject of intricate symbolism. In the Eastern Woodlands, one-piece pipes made of clay, stone, or wood were mainly used in personal rituals, whereas composite pipes consisting of a long and often decorated wooden stem and a separate bowl of stone or wood were also employed in collective rituals. Stems and Bowls, the latter sometimes carved to represent human faces or figures, animals, or artifacts were not necessarily made by the same person, and both played an important role in gift exchanges and trade with other indigenous groups as well as with Euro-Americans. This exquisitely carved and decorated pipe bowl depicts a nearly naked man sitting, his torso reclining, his hands resting on his hips, and his legs extended with slightly flexed knees. His slightly opened mouth shows the tip of his tongue and may indicate the act of speaking or singing. The pupils of the eyes are inset and filled with black pigment. Face painting is marked by engraved parallel lines filled with pigment (two red horizontal lines on the left cheek, two red lines enclosing a black one running diagonally from below the eye across the cheek on the right). His ears are pierced and held a globular ornament suspended on wire (the right ear was broken off in the distant past). The left arm features a broad arm band of lead; the former presence of such a band on the right arms is indicated by a discoloration of the wood above the elbow. Part of the head is covered with slightly corrugated lead inlay extending outward from the interior lining of the bowl, which opens at the top of the skull. Since
the man’s hair is represented by burn marks on the back of the head (as are the eyebrows), the lead inlay probably indicates a headdress. A sash of two rows of glass imitation wampum strung on sinew and woven on a warp of three plant fiber strings (probably Apocynum sp.) is worn over the left shoulder, runs across the chest and passes under the right elbow to the back, where the ends of the sash are tied together. The man’s genitals are covered with a rectangular lead inlay, probably representing a breechcloth or apron, but no belt is indicated, and the buttocks are bare. The end of the shaft, where the pipe stem was inserted, is covered with a simple band of lead inlay. The unsustainable backward inclination of the torso and the open mouth convey a sense of action that is absent from nearly all other examples of effigy pipe bowls from the Eastern Woodlands of the historic period. The pipe bowl has no documented history beyond the approximately fifty years during which it had been in the possession of its previous owner, Clemens Caldwell (1918–2007), but it can safely be dated to the last quarter of the eighteenth century, when glass imitation wampum was especially popular for the manufacture of belts, pouches, and pouch straps. The designation of the object as “Tecumseh’s pipe” may be fanciful, but it may have been associated with the pipe before it came into the possession of Clemens Caldwell. It suggests a more or less local origin south of the Great Lakes and may at least contain a hidden grain of truth. In eastern North America, wooden pipe bowls were made from southern New England throughout the Great Lakes region to Minnesota, but only relatively few specimens (less than one percent of the number of those made of stone), collected between the seventeenth and twentieth century, have survived. Most of them are without documented date and place of origin. Exceptions include specimens collected on the midAtlantic coast or its hinterland in the seventeenth century, the Delaware of Pennsylvania and the Mississauga of southeastern Ontario of the eighteenth century, and the Ottawa of Michigan and the southwestern Ojibwa of Wisconsin and Minnesota of the nineteenth century. Other have been attributed, with varying degrees of likelihood, to the Iroquois, Wyandot, Anishnaabe, Santee, Creek, and Cherokee. Despite this unsatisfactory documentary situation, it is useful to compare the Caldwell pipe to other wooden and stone pipe bowls in search of clues for its origin. The closest affinity among wooden pipes is shown by an undocumented bowl featuring a man’s head from the Steven Michaan collection, attributed to the “Great Lakes, ca. 1760” (see figures 1 and 2). ¹ In addition to similarities in the rendering of the nose, eyes, and ears, the Michaan pipe shows a strikingly similar treatment of the lead inlays above the face, including a similar state of corrosion of the lead. The similarities are close enough to suggest the two pieces were made by same maker. There are only three other known examples of somewhat simpler lead inlays above the face extending to the back of the head: two of them are found on a pair of closely related wooden pipes in an otherwise different style, dating to around 1800 and attributed to the “Anishnaabe,” 2 and a catlinite pipe collected in 1836 from the southwestern Chippewa of La Pointe, Wisconsin. 3 The two “Anishnaabe” pipes are also among the few to

feature ear ornaments (wire-wrapped slit ear lobes), otherwise found only on a catlinite pipe attributed to the Santee, in this case resembling those of the Caldwell pipe. 4 A nearly identical, although much smaller version of the Caldwell pipe in black stone, is preserved in the British Museum, which acquired it in 1949 from the prominent dealer William Oldman, and which has since been attributed to the “Wyandot, 19th century.” 5 The Wyandot attribution may have been due to the fact that in this version the reclining figure is holding a barrel and a glass on his lap and that other depictions related to the use of alcohol had been assigned to the Wyandot (although they clearly are found all over eastern North America). Except for this additional feature, the British Museum pipe is strikingly similar to the Caldwell pipe: rectangular shaft, reclining trunk, flexed knees, open mouth, incised representation of a sash running across the chest, horizontal incisions on the face to indicate painting. The British museum pipe also features a belt and leggings, missing on the Caldwell pipe, the ears of differently shaped, and the elaborate decorative features above the head are absent. The similarities and differences suggest that the two pipes were made by different makers, but that they referred to a shared underlying narrative. Depictions of alcohol use on effigy pipes and wooden ladles has often been interpreted as social commentary on pervasive feature of culture contact that had become part of the set of stereotypes associated with Native Americans. There is, however, ample evidence, especially also from northeastern North America, that inebriation was often considered as a method to reach an altered state of consciousness analogous to the one sought in the vision quest. The Caldwell pipe and the British Museum pipe may thus be interpreted as images of a man engaged in a spiritual encounter—with or without the use of liquor. Two other features of the iconography of the Caldwell pipe merit further consideration. Single bands of wampum or imitation wampum were generally not worn as sashes in the manner shown here, but served as straps of rectangular pouches. It is at least possible that a pouch was originally here attached as well, especially since black commercial thread has later been used to hold the ends of the imitation wampum band together, which would have become loose after the less of the pouch. More puzzling are the lead inlays on the head. They are probably not representations of hair, which is indicated by burn marks, but of a headdress, whose appendages were hanging over the cheeks and the back of the head. Of the headdresses known to have been worn in the Central Ohio Valley region around 1800, the one that is the most likely candidate is the cloth turban, adopted primarily by the Shawnee during their prolonged sojourn among the Creek.6 The most extensive source of information on dress and ornament of both the Shawnee and Creek in the early nineteenth century is provided by the lithographs after paintings by Charles Bird in Thomas McKenney and James Hall’s History of the Indian Tribes of North America (1838–1844). They illustrate, especially 56

for the Creeks, turbans with appendages hanging over the ears, and both for the Creeks and Shawnees face paintings consisting of horizontal and/or diagonal red and black or blue lines. While offering no proof for a Shawnee origin of the Caldwell pipe, they at least suggest the possibility to explain the assumed association of the pipe with the Shawnee leader of the early nineteenth century in the absence of any extant examples of Shawnee wood or stone carving. 1 Steven S. It was donated by Richard Miksch (1816-1875), a blacksmith and resident of

Richard Miksch, from Ohio, to Cantonment Leavenworth, where 500 to 600 mounted dragoons of the United States army are stationed, to preserve peace and order among the different tribes of Indians... 225 CREAM ANTELOPE (BLACKFOOT, d. 1936), BEADED HIDE WAR SHIRT thread and sinew-sewn on softly tanned hide; canvas strips placed on the arms and shoulders are beaded using colors of cobalt, white, pony trader blue, and rose; ermine hang from hide thongs along neckline and sleeves and are embellished with blue beads, brass bells, bison hair, dyed red feathers, and purple yarn; body of shirt coated with yellow and orange pigment and decorated with painted designs, length 36 in. x chest 48 in. fourth quarter 19th century Cream Antelope (Blackfoot, d. 1936) was a leader among the Blackfoot in the late 19th and early 20th centuries. He became a focus of a federal expedition, in which Walter McClintock (1870-1949), a photographer for the US government, recorded Cream Antelope singing traditional songs and photographing him in front of his tipi. James Mooney describes Cream Antelope’s tipi, as the Thunder Tipi. The zigzag lines represent lightning, and is reference to the guardian spirit its original owner had received in a vision (Nabokov, Easton 1988: 161, 162) The image illustrated, was taken by Walter McClintock in 1904, and shows Cream Antelope wearing this shirt. The leggings in lot 226, can be seen hanging from the travois poles behind him. John M. Phillips (1861-1953), a cunning engineer and industrialist, was a leading conservationist in Pittsburgh and the state of Pennsylvania. He expanded his love of nature and wildlife to the West and spent much time in British Columbia. In 1901, his passion for preservation resulted in the creation of the first game sanctuary of British Columbia, Goat Mountain Park. Nabokov, Peter and Robert Easton. Native American Architecture. 503 YUPIK CARVED WALRUS IVORY DANCERS 10 figures are expressively carved of walrus ivory and embellished with blue and black glass bead labrets and eyes; red pigment enhances each figure’s mouth, figures range in size from 2.75 in. to 3.5 in. fourth quarter 19th century This set depicts a dance which would be held in the Qasgiq, or community house. Typically a space for males, women occasionally would be allowed to participate in certain activities. Examples of dancers placed in model Qasgiqs are curated with the collections of Sheldon Jackson Museum, Sitka (II.S.1,) and the Hearst Museum (2-4573). These have been recorded as having been collected around 1898. Both men and women take part in dances, each having a characteristic kind of movement and style. Women dance clothed, with the feet solidly fixed on the ground while their upper bodies sway with an undulating motion and their hands gesticulate in tie with the music... Men often dance nude, moving their arms and hands vigorously. They may occasionally crouch and leap about, sometimes crying out periodically in time with the music. In other dances, the objects to show their lightness, agility, and speed, and in these they may be flanked by women dancers whose smooth and swaying movements contrast strongly with the men’s (Fitzhugh and Kaplan 1982: 204). The people sit on all three tiers of benches and on the floor except for the front side, which is left for the performers. The men occupy the benches; some are without their parkas, some altogether naked. It is hot and stifling. Two oil lamps on the “proscenium,” that is, in the corners of the front side of the fire pit,
and four additional ones in different parts of the kazhim though a dim light on the motley crowd of spectators. There are grass mats hanging from the front edge of the lowest benches and they separate the actors’ dressing-room. Four shamans are sitting on this bench holding drums 2-1/2 feet in diameter in their teeth. Two old men in tattered parkas and with smeared faces appear on the stage from time to time to ease each other and make fun of the spectators, saying that the latter in vain have come together hoping to see the new dance which they themselves, the old men, stole from the man who made it up. This is in place of an overture. (Zagoskin, in Michael 1976: 226-227 as quoted in Fitzhugh and Kaplan 1982: 204). $10,000 - $12,000

A reserve is a confidential minimum price agreed upon by the seller of the lot and Cowan’s. In the case of reserved lots, the seller has authorized Cowan’s to bid on seller’s behalf until the reserve price is reached. In no case will the reserve be higher than the low presale estimate. Cowan’s standard house reserve on all property at auction is one-half of the low estimate. 6) WARRANTIES AND DISCLAIMERS. Cowan’s makes a limited warranty only to the original buyer of record concerning the authenticity of each lot for a period of 14 days after bidder’s receipt of the purchased lot. If a buyer is not satisfied that the lot purchased is genuine, the buyer may, at his or her own expense, obtain the opinion of two mutually agreed upon recognized experts in the field of the disputed lot. If these experts determine that the item is not genuine, the buyer’s sole and exclusive remedy shall be the rescission of the sale and refund of the amount paid for the item. It is specifically understood and agreed that the rescission of the sale and refund is exclusive and in lieu of any other remedy which might otherwise be available as a matter of law or in equity, and such remedy is conditioned upon the buyer returning the property in the same condition as at the time of sale. Cowan’s shall not be liable for any incidental or consequential damages. All sales are final, with no returns or refunds except as provided in this limited warranty. Except as provided in the immediately proceeding paragraph, EVERY LOT IS SOLD “AS IS”, without any representations or warranties by Cowan’s or the seller as to merchantability, fitness for a particular purpose, condition or value of the property, or the correctness or completeness of the catalog or other description of the property, and no statement, whether written or oral, shall be deemed such a representation, warranty or assumption of liability. Cowan’s makes no representation or warranty that the buyer of manuscript material, photographs, prints or works of art will acquire any copyright or reproduction rights. Cowan’s does not guarantee the working order of any clock, watch, electronic or mechanical device. Dimensions given in the catalog descriptions may be approximate. 7) DEFINITIONS OF AUTHORSHIP. “By” or “Maker/Artist” — in our opinion, the work is by the artist or maker stated “Attributed to” — in our opinion, the work is probably, but not definitely, by the artist or maker stated “Signed” or “Marked” — in our opinion, the signature or mark is that of the stated artist or maker “Bearing the signature (or mark) of” — in our opinion, the signature or mark is probably, but not definitely, that of the artist or maker stated “Circle of” — in our opinion, the work is of the period and by an artist or maker closely associated with the stated artist or maker “School of” — in our opinion, the work is by a pupil or follower of the stated artist or maker “Manner of” — in our opinion, the work is of the period and done in the style of the stated artist or maker “After” — in our opinion, the work is a copy of a work by the stated artist or maker 8) INSPECTION. Except for Online-Only Auctions, all lots are available for inspection prior to the auction. Condition reports for most items can be found online at Cowan’s website, www.cowans.com, and prospective bidders are encouraged to contact Cowan’s directly for additional information regarding the condition of any lot. Cowan’s does not warrant the condition of any item. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Buyers interested in the condition of an item are encouraged to contact Cowan’s and, to the best of our ability, we will document for the prospective bidder the condition status on any lot. Condition is always a subjective evaluation and final responsibility rests with the buyer to assess the condition of any item sold by Cowan’s. ABSENTEE, TELEPHONE AND INTERNET BIDDING Absentee and telephone bidding is offered as a free service to our customers and prospective bidders. Cowan’s shall not be responsible for any errors or failures in executing bids, either absentee, telephone or via the internet. 9) ABSENTEE BIDDING. Absentee bids are accepted via mail, fax, email and on Cowan’s website. Such bids will be posted with the time and date of arrival, with ties being awarded to the earliest bidder. Absentee bids that are faxed or emailed to Cowan’s need to be in the office at least 2 hours before the sale begins. An absentee bidder unknown to Cowan’s may be required to submit a bank letter of credit prior to the auction, or, using a credit card, deposit with Cowan’s a fee equaling 30% of the absentee bid. All absentee bids are executed competitively by a member of the auction staff. The auction staff will try to purchase the lot for the lowest price possible and will bid up to the amount designated by the absentee bidder only if necessary. Cowan’s does not accept “buy bids,” or absentee bids which have no limit. In the event of a tie bid between a floor and an absentee bidder, the floor bid will be honored.

10) TELEPHONE BIDDING. Bidding live via the telephone is available on a first come, first served basis for those lots with a low estimate of $500 or greater. In order for Cowan’s to efficiently serve the needs of those who wish to bid by phone, please note the following: (a) To participate in the auction by telephone, potential bidders must complete and sign the absentee bid form and check “I WISH TO BID BY PHONE” for the designated lots. Potential bidders may also reserve a phone line on Cowan’s website. If faxing or emailing requests for phone bidding, they need to be in Cowan’s office 2 hours before the sale begins. Once the auction begins, requests left on Cowan’s website may not be retrieved by the staff. (b) Telephone bidders are advised to indicate an “insurance bid”, which amount will become an absentee bid, pursuant to the absentee bidding process set forth above, if Cowan’s can not reach the bidder by telephone for a particular indicated lot. (c) Telephone bidders must disable any caller ID or other call blocking mechanism. (d) Cowan’s sells about 100 lots per hour, so telephone bidders should plan accordingly. Cowan’s will attempt to reach each telephone bidder, but Cowan’s is in no way responsible for missed calls. 11) INTERNET BIDDING. Internet bidding is available through our website; additionally, Cowan’s may post certain auctions on Bidsquare (bidsquare.com) or Proxibid (proxibid.com). There may be terms which apply solely to internet bids that should be reviewed online at the time of sale. Cowan’s is not responsible for any failure to execute a bid and shall have no liability to any bidder for any technical or other failure associated with an internet auction. 12) BIDDING INCREMENTS. The following increments are used at the auction. Absentee bids must fall within these increments. Cowan’s will automatically reduce any absentee bid to the closest increment if the bid falls outside the published range of increments. For Bids Falling Between Bidding Increment $0-500 $25 $501-1,000 $50 $1,001-3,000 $100 $3,001-5,000 $250 $5,001 and up $500 or at the discretion of the auctioneer Cowan’s reserves the right to modify increments at any time during the auction. AFTER THE AUCTION 13) BUYER’S RESPONSIBILITY. Upon the fall of the hammer, title to the offered lot shall pass to the buyer and the buyer immediately (a) assumes full risk and responsibility for the lot, including liability for loss or damage and (b) is liable for payment of the Purchase Price (as defined below) to Cowan’s. It is the buyer’s responsibility to ask specific questions on condition related concerns prior to the auction. Cowan’s will not rescind sales with buyers that have disputes regarding firearm’s bore condition. 14) PURCHASE PRICE AND PAYMENT. The discounted “Purchase Price” for each lot shall equal the hammer price, buyer’s premium, sales tax and, if applicable, all packing, handling, insurance and shipping costs. Payment may be made with cash, personal or traveler’s check or credit card. Cowan’s reserves the right to hold a purchased lot until a check has cleared. A convenience fee of $15.00 will be assessed to all transactions made in the alternate payment channels: Phone payments are made available as a convenience outside Cowan’s Auctions customary payment channels, therefore these payments are qualified as payments made in the alternative payment channel. All forms of payment made using this method will be assessed the convenience fee. Please call Cowan’s Auctions if you have any questions regarding this policy. PLEASE NOTE: A surcharge of 3% will be assessed to all credit card transactions. This surcharge is not greater than our cost of acceptance. Buyers who are present at the auction must pay the full Purchase Price at the time of the sale. Buyers who bid by telephone, by internet, or who are absentee bidders will be invoiced within 5 days after the close of the auction and must pay the full Purchase Price for each purchased lot within 14 days after the date of the auction. No property will be released by Cowan’s unless the Purchase Price has been paid in full. Institutional billing may be available, and should be arranged prior to the auction. Cowan’s may impose late charges of 1.5% per month (or the highest interest rate allowed) on any amount owed to Cowan’s that remains unpaid after 30 days. Buyer shall be liable for any collection costs or attorney’s fees incurred by Cowan’s to collect payment, to the extent permitted by law. 15) SALES TAX. Buyers are required to pay any applicable state and local sales tax. 16) SHIPPING. At the request of the buyer, Cowan’s will authorize the shipment of purchased items usually within two weeks after payment has been received. Shipment is generally made via UPS or Fed-Ex Ground. Unless buyer gives special instructions, the shipping method shall be at the sole discretion Cowan’s Auctions. Cowan’s is in no way responsible for the acts or omissions of independent handlers, packers or shippers of purchased items or for any loss, damage or delay from the packing or shipping of any property. ADVICE TO INTERNATIONAL BUYERS. Cowan’s will not ship any package containing a firearm to any location other than within the United States. Buyers outside the United States must make their own shipping arrangements taking full risk for the transportation of any firearm. Property made of or containing certain plant or animal materials, such as coral, crocodile, ivory, whalebone, baleen, tortoiseshell, etc., may require a license or certificate before exportation from the United States and importation to another country. If you are purchasing items that contain these materials, you need to check the government wildlife import requirements in the countries from which and to which the item is being shipped prior to bidding. Since the export and import licenses are independently issued by the countries of origin and destination, obtaining one does not guarantee that you can obtain the other. Purchasers are responsible for making timely payments on items won at auction, even if a license is delayed or denied. 17) SHIPPING CHARGES. Buyers are required to pay for all packing, shipping and insurance charges. Overseas duty charges are the responsibility of the successful bidder. Be aware that for larger and/or valuable items, shipping charges can be substantial. 18) REMOVAL AND STORAGE OF PROPERTY. If purchased property has not been removed, or Cowan’s has not received shipping instructions within 21 days after the auction date, a $10 per item per day storage fee may be charged to the buyer. 19) CANCELLATION OF SALE. If purchased property remains in the custody of Cowan’s for a period of 60 days following the auction, Cowan’s may, at its option, cancel the sale, retaining as liquidated damages any payments made by the buyer, or resell the property at auction or by any other commercially reasonable means, for the account and at the risk of the buyer, and in such event, buyer shall be liable for the payment of all deficiencies plus all of Cowan’s costs, including but not limited to storage and costs of both sales.
