406 1948 Buick Roadmaster Convertible 76-C Same owner since 1950! Meticulously cared for. This Roadmaster is one of the best color combinations available. Carlsbad black exterior with red leather seating and a tan convertible top with contrasting stitching. Every option offered in 1948 is on this vehicle. Dual fender horns, bumper guards front and rear, power top and the smoothest running inline eight cylinder. The 1942-1948 Buick Roadmaster is considered Buick’s luxury standard bearer, and it’s especially attractive in these years. The Harley Earl styling was distinguished by long, tapering pontoon front fenders; a wide, vertical-bar grille; and a “gunsight” hood ornament. The convertible is the most prized body style, It would take very little to make this a number one condition car. These cars are going up in value and this one is priced correctly. 40 A Very Fine Gilt Bronze Vieille Garde Figure by Armand Le Veel Armand Jules Le Véel (French, 1821-1905). A gilt bronze representation of a member of Napoleon’s Old Guard. He stands at attention with his gaze focused straight ahead and his right leg stepped forward as if preparing to engage some invisible foe, his right hand grasps the barrel of a rifle while his left hand makes a fist, a rucksack, sword, and ammunition case hang on his back, the latter adorned with a spread-winged eagle, titled VIEILLE GARDE. and inscribed E. LEVEEL., impressed foundry stamp SUSSE FRERES EDITEURS PARIS, presented on a stepped marble base with gilt trim around the bottom; ht. 17.5 in. (including marble base). A student of François Rude (1784-1855), Armand Jules Le Véel is best known for his large-scale bronze statue of Napoleon on horseback located in Cherbourg, France. He also produced a number of smaller sculptures many of which depict military officers and soldiers. The Paris foundry of Susse Freres Editeurs is one of the oldest sculpture foundries in Western Europe . Known for its high quality castings, the company worked with some of the most important French sculptors of the nineteenth century including Antoine Louis Barye (1796-1875) and Mathurin Moreau (1822-1912). $8,000 - $12,000

Schinzel l.r., with an impressed KPM and 255_195; 10 x 7.5 in. (sight). Königliche Porzellan-Manufaktur, Berlin’s royal porcelain manufactory, produced highly-glazed, enameled plaques, often using well-known paintings as subject matter. KPM works are admired for their brilliant and rich color, which, unlike paintings on canvas, do not fade with the passage of time. $4,000 - $6,000

Verso retains a label reading Collection: / William Rockhill Nelson Gallery of Art / Atkins Museum of Fine Arts / Kansas City Missouri / 115-1953 / Artist - unknown - probably painted in Kentucky ca. 1811 / “Major General Richard Gentry” / Lent by John M. Gregory. Verso also retains a label with a brief typed biography. Major General Richard Gentry (1788-1837) Richard Gentry was a true hero on the first American frontier. He was born at Fort Boonesborough, Daniel Boone’s outpost in Madison County, Kentucky. As a youth he idolized his father, who fought in the American Revolution and saw Cornwallis surrender at Yorktown. Following the paternal example young Richard enlisted in the 19th Regiment of the Kentucky Militia in 1807, rising to Captain in just three years. Perhaps his greatest hour came during the War of 1812 when, as an officer under General William Henry Harrison, he attacked British forces from the rear, routing them to score a Federal victory. Then, like other first generation Kentuckians, he and his family followed Boone’s example and migrated to Missouri in 1816. For the next four years he traversed the rough roads and rivers between Kentucky and Missouri, to keep in touch with his military compatriots. one of the founders of Columbia, Missouri, where he served as postmaster and state senator. Like Abraham Lincoln he saw service in the Black Hawk War, resisting advances by the Sauk and Fox tribes. And then his luck ran out. Warned by his Columbia friend, Dr. William Duncan, that “if you are in battle you will be killed,” he nevertheless joined expeditionary forces under the command of Zachary Taylor in Florida. On Christmas Day, 1837, he died of wounds received at the Battle of Lake Okeechobee. The portrait resembles the work of Aaron Houghton Corwine. A child prodigy from Kentucky, he worked in Cincinnati from 1817 to 1820 prior to a stint in Philadelphia studying with Thomas Sully. Having had some early training with a Mr. Turner, an itinerant artist in Maysville, Corwine quickly developed some defining characteristics. As in this instance his flesh tones are rich and warm, with a lustrous surface highlighted by a quietly glowing golden cast in the background. Unlike his contemporaries Matthew Jouett and Chester Harding he placed his subjects at a slightly oblique angle, head cast to one side, eyes shyly engaging the viewer from a demure position. Of particular note in this depiction is the triple cape frock coat worn by the subject, a favorite of dashing officers dressed in the Napoleonic fashion. He was most likely painted during one of his trans-Ohio River journeys. 172 Folk Art Chair in Bottle Whimsey with Col. Dexter Photograph American, ca 1890s. A chair-in-a-bottle whimsey sculpture with a locking trick stopper and a hand carved ladderback chair. Tipped inside is an original photograph of the bottle’s maker, Quartermaster Sergeant George Nelson Dexter Sr. (1829-1905) standing beside two flags. The lower is the original 3rd Regiment Georgia Volunteers’ Flag, and the upper is an 1892 Reunion Flag. The photo is inscribed in graphite on the verso: Commodore / G. N. Dexter Sr. / & 3 Ga Battle / Flag / maker G. N. / Dexter Sr. / Madison / Ga; ht. 7 in. According to Dexter’s obituary in the Atlanta Constitution, the Civil War veteran was the founder of the first Confederate reunion in 1874 and played an integral role in arranging the first ever reunion of Union and Confederate veterans in 1889. The included photograph of Dexter is one of only two known early photographs of this battle flag, the other known photograph being in the state of Georgia’s Archives. The lot also includes a hardcover copy of Caroline E. A dated and signed folk art cane with intaglio carved foliage and incised New Mary Houston, the date 1881, and the likely maker’s name Chas. Dowerman; lg. 36 in. This lot also includes two framed images of the steamer Mary Houston, as well as a research file related to the ship and the cane maker’s family history. Dowerman descended in a family richly tied with America’s steamboat heritage. His uncle was Thomas Humphreys, the builder of the famous steamboat Robert E. Lee, and his grandfather Mathias Dowerman built the steamboat Eclipse. Both vessels raced the steamboat Natchez in celebrated races. The family’s shipyards produced over 350 steamboats, and a great-uncle built the U.S.S. Consititution. The Mary Houston was built in 1868 from parts of the Fanny Bullitt (built in 1854). The New Mary Houston was built in 1877 at Jeffersonville, IN from the Mary Houston. She was outfitted for passenger and freight, being one of the larger boats in the Ohio and Mississippi River service. In January 1893, while lying at wharf at Cincinnati, she was struck by ice and sunk. Although raised, she was dismantled, her hull converted to a barge. (Stanton, Samuel Ward. American Steam Vessels. In a letter that accompanies this sideboard, John Bivins, Jr., writing to Mrs. Helenrose Reis, suggests that the sideboard is likely Southern and notes that he saw a similar sideboard from Edenton, North Carolina. Bivins, an architectural carving and decorative arts consultant, authored numerous articles on Southern furniture and interiors. The sideboard was purchased from a farmer by Mrs. Reis’ mother near Charlotte, North Carolina in 1931. 240 Foliate Carved Oak Console Table American (possibly Cincinnati), late 19th century. A foliate carved oak console table with single frieze drawer, having a rectangular top with carved edge, above a frieze and shaped apron with carved grape vines, each corner carved with the initial “C” surrounding a leaf, all above foliate carved bulbous front legs and square rear legs with leaf carving, joined by a box stretcher, on bun feet; ht. 36, wd. 78, dp. 20.75 in. This table was likely purchased by Dr. Auta Groth Bohlender of Cincinnati, Ohio in the 1930s from Alice Roosevelt Longworth. Longworth, the daughter of President Theodore Roosevelt, married Nicholas Longworth IV, a socially prominent Cincinnatian and member of the U.S. House of Representatives (and later Speaker of the House) in 1906. The couple moved to Washington, DC but maintained their Cincinnati residence. In the 1930s, Longworth sold some of the furniture that remained in her Cincinnati home, Rookwood. The furniture was accompanied by a bill of sale that Dr. Bohlender retained. In the 1940s, Betty Greenwood, a leading entertainer and antiques collector in Dayton, Ohio, purchased the table from Dr. Bohlender. The table descended in the Greenwood family. A photocopy of the original bill of sale lists a table “handcarved by Wm [William] Fry” and imported from Italy. Fry was a noted Cincinnati art carver of the late 19th century. 94

Lot also includes an engraved brass shoulder-length self-portrait plaque, signed L McL and dated 1887; 3.5 x 3 in. Although known primarily for her ceramic wares, Mary Louise McLaughlin took courses in etching at the University of Cincinnati School of Design. In fact, she won contemporary acclaim for her metal engravings, exhibiting such items for the first time at the Ortiz Restaurant in Cincinnati in 1884. Among these was an etched copper plaque, very similar to the larger plaque offered for sale here, titled Girl Reading which is now in the Collection of the Cincinnati Art Museum. Intrigued by the challenge of working in a new medium, McLaughlin continued etching on copper plates, from which reception invitations for the Cincinnati Pottery Club were printed. In 1889, she won a silver medal at the Exposition Universelle in Paris for similar work and, in 1890, she took a respite from her ceramic career to concentrate on metal engraving. She exhibited her etchings on metal for a second time in 1892 as part of her one-woman show at Frederick Keppel & Co. in New York and again, one year later, as part of the Cincinnati Pottery Club at the World’s Columbian Exposition in Chicago. $1,000 - $1,500

Edition Limited to 500 Copies.” Collection “To be sold by auction, without reserve by order of Henry Hilton, Esq., and Charles Clinch, Esq., executors of the estate of Mrs. Cornelia M. Stewart, Deceased.” Sold in ten sessions between March 23 and 31, 1483 lots. First 38 pages have short artist biographies, when known - birth and death dates, schools and teachers, exhibitions, etc. Catalog is illustrated with 74 etchings, gelatine prints, phototypes, and tipped in photogravures. Born in Ireland in 1803, Alexander Turney Stewart would become one of the (estimated) twenty richest men in United States history, with an estimated wealth in 2012 prices of $90 billion. Stewart’s father died when he was only three weeks old. His mother remarried a couple years later and came to America with her new husband, leaving her small son to be raised by his grandfather. His grandfather wanted him to be a minister, but when his grandfather died when Stewart was only 13, he went to live with a Quaker, Thomas Lamb. Lamb decided the youngster should also receive some business experience, a fateful decision. He went to work in a grocery, saving every bit of money he earned. In 1818, he packed his bags for New York, with the $500 he had earned in his pocket.

He returned to Ireland at some point between 1818 and 1822, although not much is known of this period. He received a significant (for the day) sum from his grandfather’s estate, and used it to purchase Irish fabrics. He took the textiles to New York and opened a dry goods store. As his business grew, Stewart built new stores, and is credited with the first department store, the “Marble Palace” at 280 Broadway. This multi-story building had full-length mirrors so women could view all sides of themselves, the first “fashion shows.” Stewart also developed the first mail-order business when he realized that women from all over the country wanted to purchase his materials, even if they could not get to New York. He also expanded the front end of the business, building mills and factories to produce the goods. As much as the business itself, Stewart appears to have been genuinely interested in creating jobs - he employed thousands. And at the time of his death, was building affordable housing for his Long Island employees. He sent ship loads of food to Ireland at the height of the potato famine [1845-1852], and promised employment to anyone who came back to America on the ships. He also sent flour to France during the Franco-Prussian War and money to the victims of the Chicago fire. With his wealth he also built up one of the finest art collections in the world. But he and his wife, Cornelia Mitchell Clinch, had no children. After his death, the art was sold and his business quickly went under for lack of caring management. $300 - $500

(sight) Achenbach, a prolific and steadfast artist known for his crisply executed landscapes in a realistic manner, is widely regarded as the father of the 19th century German landscape painting. Achenbach began his studies at the Düsseldorf Academy of Painting in 1827. Despite its setting in a small town on the Rhine River, the school attracted artists from not only Germany, but from beyond its borders as well. Achenbach became a revered painter in the long-reigning Düsseldorf School, creating sublime landscapes in which man is dwarfed by the power and force of nature. The example presented is expansive, depicting several figures crossing a bridge above a monumental, cascading waterfall glimmering in the light. 362 Punting, Cover for the Saturday Evening Post by J.C. Leyendecker Joseph Christian Leyendecker (American, 1874-1951). Hand-colored lithograph on paper of a football player punting the ball, signed and titled in plate, lot includes the American Heritage magazine (September/October 1988 issue), on which the cover is graced by this illustration. The print is published by Close, Graham, Scully, and Company, and copyrighted by both the printer and the original publisher, Curtis Publishing Company; 22 x 14 in. (sheet), 21.5 x 13 in. (sight). Leyendecker was a leading illustrator during the years known as America’s “Golden Age of Illustration.” Leyendecker’s lengthy career, resulting in more than 400 magazine covers and hundreds of advertising images, began near the turn of the century, peaked in the 1920s and early 1930s, and continued beyond World War II. Leyendecker was trained at both the Chicago Art Institute and the Academie Julian in Paris. He is most often associated with the images he created as covers of the Saturday Evening Post and his character “Arrow Collar Man” who was featured in numerous advertisements for Arrow shirt collars. This character’s dashing, handsome elegance symbolized the debonair American man. The example presented here is a hand-colored lithograph that was originally a cover image for the Saturday Evening Post’s November 14, 1908 issue, hence the lack of details in the background behind the figure. Leyendecker’s illustrations often depicted masculine characters such as athletic stars or soldiers, appealing to the widespread popularity of sports amongst the Post’s readers. Football was a hotly debated topic at the time Leyendecker created this image. President Theodore Roosevelt was amongst those pushing for reform to make the sport safer and less savage. Such reform was certainly necessary: in 1905 twenty-three young men died due to injuries incurred on the playing field. Bill Randall (American, born 1911) One of America’s most well-known pinup illustrators, Bill Randall began his artistic career at the Art Institute of Chicago. After serving as a counterpropaganda artist in France during World War II, he took a freelance job at Esquire where he followed in the footsteps of George Petty (1894-1975) and Alberto Vargas (1896-1982), subsequently creating centerfold illustrations for the magazine’s Glamour Gallery. At the same time, Randall submitted his work to a number of other periodicals including Pictorial Weekly and Collier’s Weekly both of which put his illustrations on their covers. In early 1953, Randall began creating what is perhaps his best known body of work. Published by the Kemper-Thomas Company, Bill Randall’s Date Book combined monthly calendar entries with pinup illustrations and commercial advertisements. The original works offered for sale here date from this period and are excellent examples of Randall’s ability to infuse his “Randall girls” with a sense of humor and playfulness while, at the same time, highlighting their seductiveness.

A Greek school rug, the center decorated with large creatures and the border with animals and birds, all in umbers, greys, Venetian red and other earth colors on a sand-colored ground; 2 ft. 8 in. x 4 ft. 5 in. (32 x 53 in., 81.28 x 134.62 cm). These rugs (Lots 395-397) were woven in Greece in the late 1940s or early 1950s using designs from Joice and Sydney Loch that they had copied from churches and monasteries in the Mt. Athos region. The Lochs were authors and humanitarian workers who settled for a time in Ouranoupoli, near Mt. Athos. Terms and Conditions By registering and bidding in an auction conducted by Cowan’s Auctions, Inc. (“Cowan’s”), bidders (whether present in person, by telephone, by agent, by written or telephone absentee bid instruction, or through a live internet connection) agree to be bound by these terms. These are the complete and only terms and conditions on which all property is offered for sale. Cowan’s retains the right to bar any bidder from participating in any auction and to exclude or reject any bid. 1) REGISTRATION. All bidders must register their name, permanent street address (no P.O. Boxes), and telephone number prior to the auction. Unless known to Cowan’s, all registrants are required to present two forms of identification, at least one of which must include a current photograph. Bidders may be required to present a valid Visa or MasterCard. By registering with Cowan’s or submitting an absentee bid form, an individual registrant authorizes Cowan’s to obtain a copy of his or her consumer credit report and authorizes Cowan’s, at its sole discretion, to use the information contained therein to make business decisions regarding the registrant’s participation in the bidding process. 2) ACCEPTANCE OF TERMS. Bidding on any item, whether in person, by phone, by absentee bid or via a live internet auction indicates the bidder’s agreement to be bound by these Terms and Conditions for Bidders. Any right of bidder under this agreement shall not be assignable and shall only be enforceable by the original buyer. The rights and obligations of the parties shall be governed by the laws of the state of Ohio. All bidders submit to the personal jurisdiction of the state and federal courts in Ohio. 3) TERMS OF SALE. Announcements made the day of auction take precedence over any previous communication. The auctioneer reserves the right to withdraw any lot at any time before its final sale and to reject any bid for any reason. The highest bidder for each lot acknowledged by the auctioneer shall be the “buyer”. If any dispute arises as to any bidding, or between two or more bidders, at the sole discretion of the auctioneer, the successful bidder will be determined or the disputed lot shall be put up again at the last undisputed bid and resold. 4) BUYER’S PREMIUM. (a) Buyer’s Premium for “Antique and Modern Firearms” auctions; the Auctioneer will collect and retain from the Buyer, as additional commission, a premium equal to 15% the Sale Price of each Lot up to and including $200,000, plus 10% of the amount by which the Sale Price exceeds $200,000. (b) Buyer’s Premium for “American History” and “the World at War” auctions; the Auctioneer will collect and retain from the Buyer, as additional commission, a premium equal to 17 ½% of the Sale Price of each Lot up to and including $200,000, plus 12 ½% of the amount by which the Sale Price exceeds $200,000. (c) Buyer’s Premium for “Fine and Decorative Art”, “Modern Ceramics”, and “American Indian and Western Art” and any other specialized auctions; the Auctioneer will collect and retain from the Buyer, as additional commission, a premium equal to 20% the Sale Price of each Lot up to and including $200,000, plus 15% of the amount by which the Sale Price exceeds $200,000. (d) Buyer’s Premium for online, timed and other third-party bidding platforms may vary. 5) ESTIMATES AND RESERVES. Presale estimates are intended to be guides and may or may not reflect the ultimate hammer price of a lot. Cowan’s retains the right to change estimates on any lot up to time of sale. A reserve is a confidential minimum price agreed upon by the seller of the lot and Cowan’s. In the case of reserved lots, the seller has authorized Cowan’s to bid on seller’s behalf until the reserve price is reached. In no case will the reserve be higher than the low presale estimate. Cowan’s standard house reserve on all property at auction is one-half of the low estimate. 6) WARRANTIES AND DISCLAIMERS. Cowan’s makes a limited warranty only to the original buyer of record concerning the authenticity of each lot for a period of 14 days after bidder’s receipt of the purchased lot. If a buyer is not satisfied that the lot purchased is genuine, the buyer may, at his or her own expense, obtain the opinion of two mutually agreed upon recognized experts in the field of the disputed lot. If these experts determine that the item is not genuine, the buyer’s sole and exclusive remedy shall be the rescission of the sale and refund of the amount paid for the item. It is specifically understood and agreed that the rescission of the sale and refund is exclusive and in lieu of any other remedy which might otherwise be available as a matter of law or in equity, and such remedy is conditioned upon the buyer returning the property in the same condition as at the time of sale. Cowan’s shall not be liable for any incidental or consequential damages. All sales are final, with no returns or refunds except as provided in this limited warranty. Except as provided in the immediately proceeding paragraph, EVERY LOT IS SOLD “AS IS”, without any representations or warranties by Cowan’s or the seller as to merchantability, fitness for a particular purpose, condition or value of the property, or the correctness or completeness of the catalogue or other description of the property, and no statement, whether written or oral, shall be deemed such a representation, warranty or assumption of liability. Cowan’s makes no representation or warranty that the buyer of manuscript material, photographs, prints or works of art will acquire any copyright or reproduction rights. Cowan’s does not guarantee the working order of any clock, watch, electronic or mechanical device. Dimensions given in the catalogue descriptions may be approximate. 7) DEFINITIONS OF AUTHORSHIP. “By” or “Maker/Artist” — in our opinion, the work is by the artist or maker stated “Attributed to” — in our opinion, the work is probably, but not definitely, by the artist or maker stated “Signed” or “Marked” — in our opinion, the signature or mark is that of the stated artist or maker “Bearing the signature (or mark) of” — in our opinion, the signature or mark is probably, but not definitely, that of the artist or maker stated “Circle of” — in our opinion, the work is of the period and by an artist or maker closely associated with the stated artist or maker “School of” — in our opinion, the work is by a pupil or follower of the stated artist or maker “Manner of” — in our opinion, the work is of the period and done in the style of the stated artist or maker “After” — in our opinion, the work is a copy of a work by the stated artist or maker 8) INSPECTION. Except for On-Line Only Auctions, all lots are available for inspection prior to the auction. Condition reports for most items can be found online at Cowan’s website, www.cowans.com, and prospective bidders are encouraged to contact Cowan’s directly for additional information regarding the condition of any lot. Cowan’s does not warrant the condition of any item. Buyers interested in the condition of an item are encouraged to contact Cowan’s and, to the best of our ability, we will document for the prospective bidder the condition status on any lot. Condition is always a subjective evaluation and final responsibility rests with the buyer to assess the condition of any item sold by Cowan’s. ABSENTEE, TELEPHONE AND INTERNET BIDDING Absentee and telephone bidding is offered as a free service to our customers and prospective bidders. Cowan’s shall not be responsible for any errors or failures in executing bids, either absentee, telephone or via the internet. 9) ABSENTEE BIDDING. Absentee bids are accepted via mail, fax, email and on Cowan’s website. Such bids will be posted with the time and date of arrival, with ties being awarded to the earliest bidder. Absentee bids that are faxed or emailed to Cowan’s need to be in the office at least 2 hours before the sale begins. An absentee bidder unknown to Cowan’s may be required to submit a bank letter of credit prior to the auction, or, using a credit card, deposit with Cowan’s a fee equaling 30% of the absentee bid. All absentee bids are executed competitively by a member of the auction staff. The auction staff will try to purchase the lot for the lowest price possible and will bid up to the amount designated by the absentee bidder only if necessary. Cowan’s does not accept “buy bids,” or absentee bids which have no limit. In the event of a tie bid between a floor and an absentee bidder, the floor bid will be honored. 174

10) TELEPHONE BIDDING. Bidding live via the telephone is available on a first come, first served basis for those lots with a low estimate of $500 or greater. In order for Cowan’s to efficiently serve the needs of those who wish to bid by phone, please note the following: • To participate in the auction by telephone, potential bidders must complete and sign the absentee bid form and check “I WISH TO BID BY TELEPHONE” for the designated lots. Potential bidders may also reserve a phone line on Cowan’s website. If faxing or emailing requests for phone bidding, they need to be in Cowan’s office 2 hours before the sale begins. Once the auction begins, requests left on Cowan’s website may not be retrieved by the staff. • Telephone bidders are advised to indicate an “insurance bid”, which amount will become an absentee bid, pursuant to the absentee bidding process set forth above, if Cowan’s can not reach the bidder by telephone for a particular indicated lot. • Telephone bidders must disable any caller ID or other call blocking mechanism. • Cowan’s sells about 100 lots per hour, so telephone bidders should plan accordingly. Cowan’s will attempt to reach each telephone bidder, but Cowan’s is in no way responsible for missed calls. 11) INTERNET BIDDING. Internet bidding is available through our website; additionally, Cowan’s may post certain auctions on Live Auctioneers (liveauctioneers.com) or Proxibid (proxibid.com). There may be terms which apply solely to internet bids that should be reviewed online at the time of sale. Cowan’s is not responsible for any failure to execute a bid and shall have no liability to any bidder for any technical or other failure associated with an internet auction. 12) BIDDING INCREMENTS. The following increments are used at the auction. Absentee bids must fall within these increments. Cowan’s will automatically reduce any absentee bid to the closest increment if the bid falls outside the published range of increments. For Bids Falling Between Bidding Increment $0-500 $25 $501-1,000 $50 $1,001-3,000 $100 $3,001-5,000 $250 $5,001 and up $500 or at the discretion of the auctioneer Cowan’s reserves the right to modify increments at any time during the auction. AFTER THE AUCTION 13) BUYER’S RESPONSIBILITY. Upon the fall of the hammer, title to the offered lot shall pass to the buyer and the buyer immediately (a) assumes full risk and responsibility for the lot, including liability for loss or damage and (b) is liable for payment of the Purchase Price (as defined below) to Cowan’s. It is the buyer’s responsibility to ask specific questions on condition related concerns prior to the auction. Cowan’s will not rescind sales with buyers that have disputes regarding firearm’s bore condition. 14) PURCHASE PRICE AND PAYMENT. The discounted “Purchase Price” for each lot shall equal the hammer price, buyer’s premium, sales tax and, if applicable, all packing, handling, insurance and shipping costs. Payment may be made with cash, personal or traveler’s check or credit card. Cowan’s reserves the right to hold a purchased lot until a check has cleared. A convenience fee of $15.00 will be assessed to all transactions made in the alternate payment channels: Phone payments are made available as a convenience outside Cowan’s Auctions customary payment channels, therefore these payments are qualified as payments made in the alternative payment channel. All forms of payment made using this method will be assessed the convenience fee. Please call Cowan’s Auctions if you have any questions regarding this policy. PLEASE NOTE: A surcharge of 2% will be assessed to all credit card transactions. This surcharge is not greater than our cost of acceptance. Buyers who are present at the auction must pay the full Purchase Price at the time of the sale. Buyers who bid by telephone or who are absentee bidders will be invoiced within 5 days after the close of the auction and must pay the full Purchase Price for each purchased lot within 14 days after the date of the auction. By signing the absentee bid form or placing a bid by telephone, an absentee bidder authorizes Cowan’s to charge the Purchase Price for each lot for which such bidder is the successful bidder to the credit card number provided by telephone or on the absentee bid form, unless payment in full or alternative payment instruction is received within 14 days after the date of the auction. No property will be released by Cowan’s unless the Purchase Price has been paid in full. Institutional billing may be available, and should be arranged prior to the auction. Cowan’s may impose late charges of 1.5% per month (or the highest interest rate allowed) on any amount owed to Cowan’s that remains unpaid after 30 days. Buyer shall be liable for any collection costs or attorney’s fees incurred by Cowan’s to collect payment, to the extent permitted by law. 15) SALES TAX. Buyers are required to pay any applicable state and local sales tax. 16) SHIPPING. At the request of the buyer, Cowan’s will authorize the shipment of purchased items usually within two weeks after payment has been received. Shipment is generally made via UPS or Fed-Ex Ground. Unless buyer gives special instructions, the shipping method shall be at the sole discretion Cowan’s Auctions. Cowan’s is in no way responsible for the acts or omissions of independent handlers, packers or shippers of purchased items or for any loss, damage or delay from the packing or shipping of any property. ADVICE TO INTERNATIONAL BUYERS. Cowan’s will not ship any package containing a firearm to any location other than within the United States. Buyers outside the United States must make their own shipping arrangements taking full risk for the transportation of any firearm. Property made of or containing certain plant or animal materials, such as coral, crocodile, ivory, whalebone, baleen, tortoiseshell, etc., may require a license or certificate before exportation from the United States and importation to another country. If you are purchasing items that contain these materials, you need to check the government wildlife import requirements in the countries from which and to which the item is being shipped prior to bidding. Purchasers are responsible for making timely payments on items won at auction, even if a license is delayed or denied. 17) SHIPPING CHARGES. Buyers are required to pay for all packing, shipping and insurance charges. Overseas duty charges are the responsibility of the successful bidder. Be aware that for larger and/or valuable items, shipping charges can be substantial. 18) REMOVAL AND STORAGE OF PROPERTY. If purchased property has not been removed, or Cowan’s has not received shipping instructions within 21 days after the auction date, a $10 per item per day storage fee may be charged to the buyer. 19) CANCELLATION OF SALE. If purchased property remains in the custody of Cowan’s for a period of 60 days following the auction, Cowan’s may, at its option, cancel the sale, retaining as liquidated damages any payments made by the buyer, or resell the property at auction or by any other commercially reasonable means, for the account and at the risk of the buyer, and in such event, buyer shall be liable for the payment of all deficiencies plus all of Cowan’s costs, including but not limited to storage and costs of both sales. This right of cancellation is in addition to any and all other remedies available to Cowan’s.
