• The best in the business, it’s that time of year when it seems like every realtor and every company is touting themselves as number 1 in this and that. While most folks don’t care and get so confused by the claims that the message is lost. The fact is, backed up by solid statistics, Pacific Union is the top of the real estate world here in Marin. Here is the link to the latest stats I reviewed at the Tuesday Estates Meeting (Marin stats). • The Estates Meeting, you will not want to miss our next meeting February 6. Former Federal Reserve Governor Robert Heller will be our speaker. Governor Heller was not only on the Federal Reserve but also served as CEO of Visa USA. He is a distinguished author and has a Ph.D in economics. Governor Heller will discuss the change in leadership at the Fed and the economy. Learn to Earn. This will give all of us some good insight into the tax changes and future expectations you can all share with clients and colleagues. • Data, Pacific Union’s Big Data provides some amazing insight into where our buyers are coming from. This data is collected and processed from your transactions when you complete the Transaction Form. If you don’t complete it we cannot provide accurate data. So please help us help you by competing as much of the form as possible on each of your transactions. Thursday was our Grand Opening of our New Novato office. The event was very well attended and I want to thank all of you that attended and supported our Novato colleagues. Congrats to Amy Bowes (Novato office Manager) and Candy Bertoli for putting together a magnificent event. The food was outstanding and provided by our very own Henry Hautau, who also happens to own Finnigan’s Marin in Novato. Your staff is here to help you with your CMA’s and marketing projects. Selma Hepp’s Latest Article California’s Unemployment Rate Reaches All-Time Low Posted: January 23, 2018 • In the last two months of 2017, California employers added more than 105,000 jobs, ending the year on an incredibly positive note. In fact, with more than 200,000 jobs added in the last four months of the year, it was the strongest streak of job growth in the state since the data series began almost 30 years ago. • California’s unemployment rate dropped to 4.3 percent, which marks the lowest point since 1976 according to a report from the state Employment Development Department. California’s unemployment rate is now only 0.2 percent higher than the national rate of 4.1 percent. This is incredible progress for California given that the unemployment rate peaked at more than 12 percent in 2010. • Nevertheless, the sharp drop in the state’s unemployment rate is a function of rising household unemployment but also a declining labor force. The decreasing labor force will pose further challenges for employment gains in 2018 as the state’s population growth continues to slow. In 2017, there were 240,200 new residents in California, which is a 0.6 percent annual increase. The long-time average population growth rate has generally been around 0.9 percent. Slower international migration and an increase in domestic migration are two factors that are contributing to lower population growth. We will expand on California’s population changes in a future analysis. • Jobs gains were broad-based across many industries, with the most additions in the administrative support and leisure and hospitality sectors. The other industries with solid additions included transportation and warehousing, construction, financial services, and information. The construction, education, and information sectors, which

Medical Marijuana and Tenants Q: I recently listed a single-family home for lease. The Owner does not want a tenant who smokes marijuana. I am concerned about telling prospective tenants that they cannot smoke marijuana now that it is legal to do so. What should I tell the Owner and prospective Tenants? A: As is detailed in most residential leases, including the C.A.R. Residential Lease (Form LR), Landlords may prohibit any conduct that violates any law (federal, state or local). Although the law in California has recently changed regarding the personal use of marijuana, federal law still considers the use of marijuana to be an illegal activity. Effective January 4, 2018, the Justice Department formally rescinded their prior program under President Obama and they may now have the power to enforce cannabis-related crimes in California. California’s new law regarding marijuana (Prop. 64 which is now Health & Safety Code Section 1362.5) provides that the personal right to possess, process, purchase, obtain, cultivate, plant, and other activities connected with marijuana does not affect the ability of a property owner, such as a landlord, from prohibiting or restricting cannabis use on their property. It should also be recognized that nothing in the new law allows someone to smoke cannabis where smoking tobacco is already prohibited. Landlords are specifically authorized to prohibit smoking tobacco in any portion of their rental property under Civil Code Section 1947. Thus, Landlords can legally prohibit smoking of cannabis regardless of the changes in California’s laws. For more information, see the updated C.A.R. Legal Memo entitled “Marijuana Issues for REALTORS®” at https://www.car.org/riskmanagement/qa/miscellaneous-folder/marijuanaissues 1. Landlords should be advised that if they wish to restrict use, cultivation and selling of marijuana that they should use a rental form which prohibits that activity. See, for example, CAR form “Residential Lease or Month-to-Month Rental Agreement” (ZipForms Form LR revised 6/17). Paragraph 14 prohibits smoking of all substances and paragraph 15A prohibits using, manufacturing, selling, storing illicit drugs or other contraband or “violate any law or ordinance” which would necessarily include cannabis. 2. Landlords should be encouraged to have a written Rules and Regulations handout which details not only the smoking rules but all other rules that the Landlord intends to enforce. Landlords should be encouraged to work with their own local Landlord/Tenant attorney as to what rules can and cannot be included. 3. Prospective Tenants should be provided with the Landlord’s written Rules and Regulations at the earliest possible opportunity and no later than at the time the Tenant is provided with the Lease. 4. In the absence of written Rules and Regulations, Tenants should be advised of the written prohibitions, if any, that are contained in the Lease, including but not limited to those rules regarding Smoking any substances.
