Given this was a short week with Monday’s Holiday it did not stop Pacific Union Marin from having a banner week. On Tuesday alone we had 17 escrows close. Now that’s impressive. Total new listings for the week was 38 and 23 closings. Nice work everybody! • Next Wednesday February 28 is our Marin Kickoff to March Madness (spring market). This will be at Farm Shop in Larkspur from 5-7pm. We will be joined by several East Bay agents and this will be a great opportunity to network with your colleagues. Please RSVP if you have not done so. • Pacific Union recently signed an enterprise agreement with Disclosures. IO. It is part of your Premier Services at no additional costs to you. California Housing Prices Straining Even Highly Paid Tech Workers Posted: February 20, 2018 Executive Summary: Software engineers at major Bay Area tech companies bring home an average of $210,500 per year, compared with those in Los Angeles, who earn $157,000 per year. Programmers who work at Santa Monica’s Hulu face California’s most challenging affordability conditions, with 44 percent of the average salary needed to purchase the median-priced home. In the Bay Area, the least-affordable housing markets for software developers are near Apple’s headquarters in Cupertino. Apple headquartersThe Golden State’s housing affordability crunch has reached the point where even well-compensated software engineers at some of the biggest tech companies could have trouble purchasing a home. That’s according to a recent report from Open Listings, which analyzes the impact of home prices on software engineers in both Silicon Valley and Southern California’s Silicon Beach. The report calculates the percentage of average salary needed to afford the median-priced home within a 20-minute commute of 13 major California technology companies. Open Listings uses 28 percent of income as the affordability threshold and assumes a 30-year, fixed-rate mortgage at a 4 percent rate. Of those 13 tech firms’ housing markets, six are considered unaffordable for engineers, three are in the middle of the road, and four are deemed affordable. In the Bay Area, software developers could expect to spend anywhere from 22 percent to 32 percent of their salaries to buy a home relatively close to work, while in Los Angeles, that figure ranges from 15 percent to 44 percent. On average, Bay Area engineers earn higher annual salaries than their counterparts in Los Angeles — $210,500 compared with $157,000. But Northern California workers also face higher median home prices than those in Southern California, a respective $1,203,750 compared with $895,625. Salary and housing discrepancies aside, Silicon Valley and Silicon Beach-based companies are equally represented in Open Listings’ study. California’s least-affordable housing market for software engineers is in the vicinity of Santa Monica-based Hulu, where software developers would spend 44 percent of their average $129,000 salary to afford the median-priced $1,052,500 home. That’s about three times pricier than the most affordable tech housing market of Hawthorne, where the average developer at SpaceX would spend just 15 percent of his or her $179,000 annual income to buy the median-priced $493,250 home.

Weekly Broker Tip WEEKLY PRACTICE TIPS Potential Pitfalls of Buyer Paying Commission Q: I am the Listing Agent on a home in the MLS and we received multiple offers. One potential buyer represented by another broker stated in the Offer that: “Buyer will pay all commission obligations outside of escrow and Buyer would pay all customary fees and charges normally paid by Seller.” The seller consulted with a qualified California real estate attorney who recommended against accepting that offer because potentially the seller could be accused of participating in a conspiracy to commit tax fraud. Is that a realistic possibility? Why would the buyer want to pay the commission and seller’s costs – ultimately that does not really reduce the amount of money the buyer is paying to acquire the home? A: Yes, there is a potential claim that the buyer is attempting to defraud the county assessor’s office regarding the valuation of the home (depending upon how the buyer completes certain required forms) and, although sellers are generally not blamed for these schemes if it is proposed by the buyer, there is a potential argument that the seller and both brokers knowingly aided and abetted the false reporting of the purchase price to the assessor. If a buyer requests a change to the normal commission structure by paying the commission for one or both brokers, it may be an attempt to artificially lower the purchase price to minimize the real property taxes that will be owed by the buyer. These schemes increased after the passage of Prop. 60 which facilitated transferring the tax base of the buyer’s prior home to their new home for people over 55. Prop. 60 specifies that to transfer the tax base, the value of the new residence must be equal or less than the value of the prior residence. Unfortunately, a buyer paying the brokerage commission and/or any other taxes or charges that are normally paid by the sellers (such as the transfer tax) -- so as to artificially lower the purchase price -- is NOT an effective mechanism to lower anyone’s taxes. Worse, this effort can ultimately lead to potential, significant liability for all parties concerned in the transaction.
