•The big news in the Bay Area this week was 3 completely dilapidated homes, two burned out houses in the South Bay and one rattled with mold and rot, all selling well into the million dollar range. The rest of the country must think everybody in California is crazy. Ok, I know they do.

•What they don’t get is, it’s not the house, it’s the land, and as we all know here in Marin they are not making any more of it.

•Several months ago, I talked about the rising cost of construction and how the North Bay fires would have a negative impact on building here in Marin. Several projects recently bid are seeing prices 30-40% higher than projected and that is going to sideline a lot of remodel and new construction plans in and around the bay. •It is a little tough to hire a team of consultants a year ago, design it, get it approved and go to bid and your remodel project you were told was going to be $1,000,000 is now $1,400,000 and climbing, and by the way it is going to take 6-8 months longer because we don’t have any workers. That is a stark reality hitting many people in the Bay Area and I don’t think it is going to change anytime soon. •As one contractor told me this week, the best time to remodel your home was yesterday.

Real Estate Roundup: California Housing Markets Posted the Nation’s Biggest Equity Gains in 2017 Executive Summary: •Sales of homes priced higher than $1 million increased by 30 percent in the Bay Area in the first quarter, with even stronger gains in the South Bay and Silicon Valley. •Demand for homes priced above $3 million remains robust, jumping by 45 percent from last year’s first quarter. •Inventory has declined on average by 10 percent to 20 percent on an annual basis in the last year. •In San Francisco, new listings are down across all price ranges, for an overall 23 percent decline. •Sonoma, Contra Costa, and San Mateo counties saw slight increases in new listings, though mostly in higher price ranges. •Newly constructed condominium inventory in San Francisco is at half the level from a year ago, with about 600 units on the market. •Appreciation soared in March, with the median price in the Bay Area increasing by 19 percent year over year. •Santa Clara County’s median price jumped by 34 percent year over year in March. •The share of homes selling for more than asking price reached a high at 74 percent for the Bay Area and 86 percent in Santa Clara County. Sonoma County saw the lowest number of premiums, with 52 percent of homes selling for more than asking price. Read More.... WEEKLY PRACTICE TIP Power of Attorney How to Handle Mental Incapacity, Trust Sales, Divorcing Parties & POA’s During Escrow I. IN GENERAL A Power of Attorney (“POA”) is a written instrument, executed by a natural person (who has the capacity to contract), known as the “Principal,” who grants authority to act as an “Attorney-in-Fact” (“AIF”), and is sometimes referred to as the “Agent” of the Principal In California, POA’s are governed by the Power of Attorney law (Probate Code 40004545). TYPES OF POWERS OF ATTORNEY: A POA can be a General POA, granting broad powers, or a Specific POA, granting only power for a specific act such as selling a parcel of real Property. A General POA grants to the AIF all the authority to act in all legal matters that the Principal would have. If the Principal dies or becomes mentally incapacitated, then the POA becomes void. However, a POA can also be a Durable POA, meaning that it survives the mental incapacity of the Principal. A Durable POA is valid if: 1. The Principal had the mental capacity to enter into the POA at the time it was created; and 2. It meets the criteria of the Durable Power of Attorney law (Probate Code 4124). TERMINATION OF A POWER OF ATTORNEY: A POA may be terminated by: 1. The death of the Principal 2. The mental incapacity of the Principal unless it is a Durable POA 3. The revocation of the POA by the Principal 4. The resignation of the AIF 5. The mental incapacity of the AIF 6. The death of the AIF 7. The term specified in the POA if there is a time limit 8.
