As we head into the middle of May, I am still puzzled by the direction we are seeing in certain markets in Marin. • Earlier this year Carole Rodoni talked about today’s buyers want the trendy, hip areas and prefer the flats, off the hills and walking distance to shops, restaurants and services. This seems to be a true prediction in Marin where we are seeing downtown areas of Mill Valley and Larkspur on fire with activity, while other areas are taking a pause. • With inventory rising and homes in hillside areas taking longer to sell or even get showings it is somewhat puzzling. Are we beginning to see a trend develop or is this just a seasonal anomaly? Are buyers more focused on graduations and gearing up for vacation and putting the home purchase on hold? It is most likely a multitude of reasons but it does not make your job any easier when your sellers are asking you what is going on and why their house is not seeing activity when other properties are moving. • We had strong activity in April and May is shaping up to be a consistent month with years past in number of units and volume. As we discussed at our last Estates Meeting keeping an open dialog among all of us will help each of us stay in tune with buyer and seller sentiments, so let’s keep the dialog going. Hat’s off to Caroline and Chris Nelson for their steadfast determination with a recent listing and sale in San Rafael. Not only did they win the listing over Redfin, but once the listing was signed they jumped in and prepped the home for sale, did an excellent job marketing the property, received multiple offers and are in contract well over the asking price. As Caroline says, “Pacific Union made the difference.” Congratulation Caroline and Chris! • Tuesday is our Estates Meeting and we will be discussing improvements and changes to our Premier Services available to you. San Mateo County Overtakes San Francisco for the Highest Bay Area Home Prices in April Executive Summary: •

The Bay Area’s median home price increased by 15 percent year over year in April to reach $980,000.

San Mateo is now the most expensive Bay Area county, with a median price of $1.47 million.

In Silicon Valley, median home prices continue to grow by 20-plus percent from April 2017.

Sales activity also picked up, with a 5 percent increase in sales over last April, driven mostly by more activity in Alameda, Santa Clara, and San Francisco counties.

While lower-priced inventory continues to decline compared with last year, inventory priced above $1 million finally stopped falling on an annual basis

The Bay Area’s incredibly strong spring homebuying season continued its run in April, with another jump in the median home price to $980,000, up by 15 percent on an annual basis. Prices continued rising at the fastest rate in Santa Clara County, up by 29 percent year over year, followed by San Mateo, Alameda, and San Francisco counties. San Mateo is now the most expensive county in the Bay Area, with the median home price — including single-family residences and condominiums — reaching $1.47 million. Figure 1 ranks Bay Area counties by their April median home prices.

Hiring Unlicensed Assistants BOTTOM LINE: Unlicensed Assistants cannot be hired as Independent Contractors. Q: I am licensed as a Broker but I am affiliated with a Brokerage as a Sales Associate. I have developed my business to the point where I need to have some help. I want to have an unlicensed assistant work for me but I do not want the hassle of being an employer. Can an unlicensed assistant be an Independent Contractor? If not, what do I have to do as an employer? A: It has long been the position of employment lawyers that unlicensed assistants cannot be treated as Independent Contractors. The Supreme Court case, Dynamex Operations West, Inc. v. Superior Court, Charles Lee, et al. that was decided on April 30, 2018 solidifies that position. The Court was faced with whether or not the California wage orders applied to truck drivers. The Court applied a new “ABC” test that requires employers to prove that they can meet ALL three of the following points before they can classify their workers as Independent Contractors:

A. Is the worker free from the control and direction of the hiring entity in the performance of the work, both under the contract for the performance of the work and in fact? B. Does the worker perform work that is outside the usual course of the hiring entity’s business, and C. Is the worker customarily engaged in an independently-established trade, occupation, or business of the same nature as the work performed for the hiring entity? Real estate licensees are statutorily allowed to create an Independent Contractor relationship with their Broker under Business & Professions Code Section 10032; and it is believed that the Dynamex decision will not alter that carved-out exception to the employment laws because of the Sales Associates’ license status. On the other hand, individuals who do not have a valid, current real estate license and who function as an unlicensed assistant for a Brokerage or for an individual Sales Associate do not fall within the parameters of Section 10032 and will, in almost every case, not meet the Dynamex ABC test.
