Spa City worker threatens to sue

Safety director alleges hostile work environment

SARATOGA SPRINGS — Alleging she endured “a discriminatory and hostile work environment,” the city’s risk and safety director has filed a legal claim announcing she intends to sue three of the city’s top elected officials.

As first reported by the Foothills Business Daily, Marilyn Rivers points an accusatory finger at Commissioner of Accounts Dillon Moran, Mayor Ron Kim and Commissioner of Public Safety James Montagnino in her Sept. 27 notice of claim, in which she seeks undisclosed damages for being “continually violated by the public airing of malicious and false accusations” over an insurance settlement with a former city employee.

While Rivers indicates in court papers that she had issues with the city officials since they took office in January 2022. Her problems became public in May when Kim tried to move her position out of Moran’s department into his own in a dispute over a $100,000 insurance settlement with a Moran political ally, fired city engineer Tim Wales.

A notice of claim is to notify all parties involved that a court case might be imminent.

Court papers allege that leading up to that, Moran repeatedly told Rivers, who handles insurance claims, “that the City Council members were out to get you,” that “Kim was setting her up to be fired” and that Kim was “intent on firing her and/or defunding her.” Moran also allegedly told her Montagnino wanted her fired, too.

While she wasn’t transferred, at least not immediately, nor fired, Rivers’ name came up in an Aug. 2 City Council meeting where a $25,000 insurance deductible for the settlement with Wales was buried in a laundry list of payments to city vendors.

Wales, a former city engineer, said he was wrongfully fired in 2019 for supporting Moran over the late Commissioner of Public Works Anthony “Skip” Scirocco. Wales eventually settled the case for $100,000.

At the August meeting, Kim asserted city officials did not know the city was settling the case, which he said had no merit.

Kim said the City Council only learned of the Wales settlement when they discovered an insurance deductible payment allegedly camouflaged on Page 52 in a long list of $1.16 million in payments to city vendors.

Kim demanded the removal of the $25,000 deductible payment to Travelers Insurance and said he suspected “someone purposely hid” the payment because the settlement was never approved by the City Council. He didn’t mention Rivers, a review of a recording of the meeting shows, but she alleged in the claim that he accused her of hiding it.

Meeting minutes suggest Moran implicated her, saying the buried payment “wasn’t me.” When asked where the payment originated, he said “the director of risk and safety.”

Kim praised Rivers at that meeting saying, the minutes show, Rivers “had been very capable” and that he “had no intention of firing anyone.”

After that, Rivers was transferred to work in the mayor’s office, which she described in the claim as “retaliatory.”

“Commissioner Moran continued and perpetuated the negative political discourse surrounding the move of risk and safety to the mayor’s office perpetuating physical and emotional anguish for Ms. Rivers for his own political advantage,” court papers indicated.

Moran said he wouldn’t comment on the claim.

Rivers, when reached by the Times Union,

hung up the phone without speaking. The veteran city employee, who is expected to retire in the spring, also did not answer follow-up questions sent by text.

The mayor said he “vehemently denies creating any hostile environment.”

“I stand by my record, employing women (when I was) a commissioner of public safety and now as mayor,” Kim said.

The court papers alleged Montagnino accused her of “reprehensible” action and “pulling a fast one” at the Aug. 2 meeting. The recording of the meeting shows he said not knowing about the settlement was reprehensible and that he needed to look through the pages of payments “to just make sure someone is not pulling a fast one and slipping something by us.”

Among the list of other accusations in the court filing, Rivers alleges Montagnino screamed at her and Kim knew of the settlement with Wales.

All this, her claim noted, “created a hostile work environment, defamation and slander, negligence, violation of due process and other statutory and constitutional rights” and as a result, she has suffered “psychological and reputational harm, both of which have permanent effects, the nature of which is not yet known to her.”

Rivers’ attorney, Benjamin Hall, did not respond to a Times Union request for comment.

Moreau GOP’s family ties

Two former panel members say they were ousted for not endorsing Todd Kusnierz

MOREAU — Two former members of the Moreau Republican Committee say they were ousted from the committee because they were not enthusiastic supporters of town Supervisor Todd Kusnierz and the family members who dominate the party panel.

The two, who don’t want to be identified for fear of retribution, said they were removed without notice. They say that’s no surprise as the committee, which is now seeking six new members, includes seven members of the supervisor’s family: his daughter Jacqueline Kusnierz is the chair of the committee that also includes the supervisor’s

wife, three of his sisters and two of his brother-inlaws.

“We wanted to stay on the committee,” said one of the former members. “But I don’t want to anymore just because I would have to (publicly) endorse Todd. If I didn’t, I would be kicked off anyway because it goes against their rules.”

Kusnierz defended the committee, now with 16 members, and his family members’ role on the committee, saying they have served there a long time. And those who are no longer on the committee, including former chair Rich Morris, who is still listed as the chair on the Saratoga County GOP website, didn’t circulate petitions to be on the committee.

“Just showing up is not good enough,” Kusnierz said in a text.

Furthermore, he said that his family “has an extensive history of service to our community span-

ning multiple decades and three generations, whether on the town board, planning board, school board or in the fire company.”

The removed members, however, say the committee has become clannish. And they were also told that they didn’t have to circulate petitions to remain seated.

Regardless, the committee is now working on endorsements. The supervisor has unanimously secured his spot for a fourth run as supervisor. Kusnierz also was recently named to his third term as chairman of the Saratoga County Board of Supervisors. The board is made up of municipal leaders from across the county. The town committee will also back political newcomer and Radici Kitchen and Bar restaurateur Carly Mankouski to run against the Town Board’s only Democrat, John Donohue.

On Saturday, Donohue

said he welcomes a challenger.

“I don’t think anyone should run unopposed,” Donohue said. “If you run unopposed, there is no accountability. I want to be accountable to the people of Moreau. If they don’t think I’m doing a good job, so be it. If they don’t think I’m fighting hard enough for them, they can elect somebody else.”

Donohue said that the problem in Moreau is that Kusnierz has run opposed for the town’s top post and therefore “does whatever he wants.” And with the committee controlled by the Kusnierz family, they only chose “enablers.”

“He’s already got two on the Town Board,” Donohue said. “And he wants a third one and that’s what this is about.”

He also said Democrats

won’t have a full slate, but expects that the supervisor will have a challenger this year.

Kuznierz has a contentious relationship with Donohue and recently suggested that Donohue should step down. He said Donohue has had “a pattern of deceit and lies” because in 2019, his petition signatures to run for office were thrown out. The supervisor also accused Donohue of using the Town Hall’s copier for personal reasons.

Donohue said there were clerical errors on his petition and thus they were discarded. As for the copier, he said he paid the clerk for the copies.

“Those are his bullying tactics and I’m used to them,” he said.

Wilton Wildlife Preserve & Park Offers Traveling Programs

WILTON - Since not everyone is able to travel to visit Wilton Wildlife Preserve & Park for an in-person program, they offer traveling programs to improve community access to environmental education in the region. Their mobile courses allow schools, senior centers, recreation centers, summer camps, scout groups, afterschool programs and more to participate in dynamic programs that involve hands-on learning for all ages and abilities. The programs bring activities, artifacts, and can even incorporate nature walks. Wilton Preserve has brought its traveling classes around the region for many years and is currently scheduling programs for the upcoming months.

Some of the recent programs were Lake Avenue School’s Outdoor Education Program at Camp Wakpominee, Project Life with the Skull and Fur Science program, the Dorothy Nolan Elementary School and Charlton School for Journaling Ecosystems, the Mechanicville Senior Center for Owl Adaptations, the Mechanicville Community Center and Saratoga Spring Public Library for Turtle Discovery, and the Saratoga Independent School for the Monarch Butterfly Program. They will be traveling to Dorothy Nolan and Ballard Road Elementary Schools for programs on the endangered Karner blue butterfly and to plant wild blue lupine seeds, which will be transplanted at Wilton Preserve to help with habitat restoration. In addition to these programs, they provide a range of curriculums about beavers, reptiles, endangered butterflies, freshwater food webs, and more.

To schedule a visit, email info@wiltonpreserve.org or call 518-450-0321. To download their program brochure or for up-to-date trail conditions or program information, please visit the Preserve & Park’s website at wiltonpreserve.org. Bacon Hill Hamlet is the Focus of History Center Video

Forgotten Crossroad Video Release In March

BALLSTON SPA - The Saratoga County History Center today announced that the Bacon Hill community is the subject of an upcoming local history documentary, which will premiere in special screenings in March. The documentary is part of the Forgotten Crossroads series of videos which tells the history and stories of people living in still-existing communities that started in the early days of Saratoga County.

This episode of Forgotten Crossroads highlights Bacon Hill, a small crossroads 2 miles northwest of Schuylerville along New York State Route 32 in the town of Northumberland. The hamlet center is the Reformed Church which celebrated its 200th anniversary three years ago and is home to several large farms owned and operated by families who can trace their ownership back many generations.

“Bacon Hill is a special place with special people,” explains SCHC’s Jim Richmond, volunteer director of the film. Richmond has enjoyed working closely with a group of local residents since the summer of 2022. “From our first meeting, they embraced the challenge of telling the story of the community they love. They brought binders of pictures and scrapbooks at each meeting that helped tell their stories.”

Richmond, along with History Center volunteer videographer, Dave Waite, recorded 25 interviews. They are now in the process of editing the film. “Selecting the clips to use is hard,” said Richmond, “there are so many great stories to tell.”

The video will premiere at Brookside Museum in Ballston Spa in late March and the Bacon Hill Church in mid-April. Forgotten Crossroads – Bacon Hill has been made possible in part through funding secured from Welcome Stock Farm, King Brothers Dairy, Clear Echo Farm, Thomas Poultry, and Stonebridge Iron and Steel, Inc.

Each episode of Forgotten Crossroads builds on the history of bypassed Saratoga County communities of the 19th and 20th centuries and the stories of the people still living in the community. The first episode in the series focused on Rock City Falls in the town of Milton. Rock City Falls started as a mill town along Kayaderosseras Creek. The first episode was released in April 2022 and is available on Saratoga County History Center’s YouTube channel.

This programming is part of a multiyear, multiplatform initiative from the Saratoga County History Center that explores every aspect of Saratoga County History. The comprehensive focus represents SCHC’s biggest-ever commitment to explain that a greater Saratoga starts with understanding its history. SCHC is installing an immersive exhibition on the history of Saratoga County to open in spring 2023. In addition to the Brookside Museum, the History Center provides various innovative, exciting, and educational programs online and in-person across the county. For more information about Saratoga County History Center and program updates, please visit www.brooksidemuseum.org or the Center on Facebook or Twitter @SaratogaCoHistory for updates and announcements.

EMPLOYMENT

The Importance of Using Vacation Time

How many employees have wished for a shorter work week, especially when it’s only Tuesday and Friday is nowhere in sight? Though many professionals wish they worked fewer days each week, those same individuals likely aren’t taking advantage of their hard-earned vacation time.

According to the “2018 State of the American Vacation” report from the U.S. Travel Association, more than half of all working Americans have unused paid vacation days. According to the USTA’s Project Time Off, Americans are taking roughly one less week of vacation per year than they did in the mid-1970s, and the trend continues to decline. It’s not much different in Canada. A 2020 ADP survey found that 49 percent of working Canadians were taking less or no vacation time during the holiday season. Fifty percent of women and 37 percent of men reported that they took less than half of their alloted time off that year.

For more information on the Schenectady City School District recruitment and hiring plan, please contact the O ffice of Human Resources The Schenectady City School District does not discriminate on the basis of age, color, creed, disability, marital status, veteran status, national origin, race or gender. This policy is in compliance with the Title IX of the Education amendments of 1972, Section 504 of the Rehabilitation Act of 1973, and the Regulations and Bylaws of the Board of Education of the Schenectady City School District

Workers cite several reasons for skipping vacations, including feeling an obligation to employers or worrying that taking time off may make them stack up poorly against coworkers when being reviewed for promotions or raises. However, failing to take vacation has notable consequences that should not be ignored. Here’s why individuals should make vacations priorities.

Avoid health consequences

A study published by the National Center of Biotechnology Information found that men who were at risk for heart disease and skipped vacation were 30 percent more likely to have heart attacks than those who took extended time off during the year. Similar effects occur in women. Taking little or no time off also could put individuals at increased risk for anxiety, depression, obesity, insomnia, and other stress-related illnesses, particularly among females. Simply taking a vacation or two per year can help tame stress and improve individuals’ long-term health outlook.

Get a brain break

Focusing attention on new scenery and activities for a week or more can improve performance upon returning to work. The USTA also indicates having a vacation to look forward to can motivate individuals to finish a project or report in a timely manner.

Enjoy higher job satisfaction

The Society for Human Resource Management said that 78 percent of human resources directors found that employees who took more vacation days reported higher job satisfaction. That could be because vacations help people feel less stressed and generally happier, which can extend to the workplace.

Develop strong bonds with family

Having fun with the family away from the distractions of daily life is a major advantage of vacationing. Few families have consistent time to spend together, but vacations enable everyone to take a break from the routine frenzy and focus on one another.

It’s tempting to skip vacations to be more productive, but workers actually may be doing their productivity a disservice by failing to rest and recharge.

The Rise in All-Electric Homes

When asked to think of modern homes, many people might think of minimalism, neutral colors, open concept floor plans, and large windows without treatments. While each of those features are components of modern homes, just what qualifies as “modern” is ever-changing and often a reflection of what buyers are looking for. And lately, many buyers are looking for all-electric homes.

A 2015 study by the U.S. Energy Information Administration found that the number of all-electric homes had increased over the previous decade. In fact, the EIA study found that 25 percent of homes in the United States used only electricity. All-electric

homes are generally considered more environmentally friendly because they lessen homeowners’ carbon footprint by reducing their need for fossil fuels like natural gas. Electric heat pumps, induction stoves and electric fireplaces are just some of the technologies that can be found in all-electric homes.

Though the design style of all-electric homes needn’t be modern, there’s no denying that the growing popularity of such homes makes them an option for homeowners with modern sensibilities.
