BALLSTON SPA – Registration is open for Canine Training classes hosted by Saratoga County 4-H. Classes will be held on Monday evenings, beginning May 2nd, at the 4-H Training Center, 556 Middle Line Road, Ballston Spa. 4-H Canine is an 8 week program and is open to both youth ages 8-18, and adults. This program is made possible by dedicated volunteer trainers who allow 4-H to serve over 80 local dog and handler pairs each year. Beginner, Graduate Beginner, Novice, Grooming and Handling, Agility, and Rally classes will be offered. Agility is offered for youth only. Class size are limited to first come, first served; and youth are given priority. Mixed breeds and purebred dogs are welcome. BALLSTON SPA - The Democrat challenging incumbent Saratoga County District Attorney Karen Heggen is accusing the Republican of mishandling a case involving the death of a 20-year-old last July 4 on Saratoga Lake. Michael Phillips said by allowing Blake Heflin to plead guilty to a misdemeanor assault charge and boating while intoxicated after his actions led to Ian Gerber’s death shows a “fundamental inability to grasp the concept of the public trust placed in the office of a county prosecutor in New PHILLIPS York state.” Gerber died after he jumped off the boat and was hit by the propeller as Heflin turned the craft, and then he was struck by another boat, Heggen’s office said in December. Heflin was sentenced to three years probation and a one-year suspension of boating privileges. Phillips had a long list of complaints about her handling of the case that included Heflin being related to members of the Saratoga County Sheriff’s Office, which was the lead in-
vestigator on the case. Phillips said therefore, Heggen should have recused herself. A check with a union official on Friday confirmed Heflin’s sisters are employed by the sheriff’s office and his mother is married to a county correction officer. He also said her office didn’t investigate who bought alcohol for the underage drinkers and didn’t convene a grand jury. Finally, he said her explanation that the witnesses were “uncooperative,” as was reported in the Times Union last December, does not mean she couldn’t have put them under oath. “As our sitting District Attorney, Heggen should understand the function of subpoenas and grand jury testimony is to compel testimony in criminal matters in which witnesses are uncooperative,” Phillips wrote in a statement. “Either she doesn’t understand those basic case trial tenets or in her prosecutorial work one only investigates crimes in which witnesses cooperate.” On Monday, Heggen didn’t directly address Phillips’ criticism about conflicts of interest or handling of witnesses. However, she said in a statement that “while some may have an opinion regarding the prosecution of Blake Heflin, the Saratoga County DA’s Office is the only one who has a burden to prove the ele-
ments of a crime beyond a reasonable doubt.” She said after “a lengthy investigation ... we found evidence of wrongdoing, after review of all the available evidence, we concluded that we could not meet our burden at trial on the felony charge of criminally negligent homicide.” “I, like most residents in Saratoga County, remain deeply troubled by the events that occurred on Saratoga Lake last Fourth of July,” HEGGEN her statement continued. “Drinking underage and operating a boat while intoxicated is a dangerous decision and a recipe for disaster. My office remains committed to prosecuting these cases and to holding those accountable who endanger the lives of Saratoga County residents.” Phillips, who announced his run for district attorney in February, said his decision was prompted by Heggen’s handling of certain cases, including the fatal incident on Saratoga Lake. “There should be one standard of justice,” he said at the time. “Not one for the wealthy and highly connected and one for everyone else.”
Golub touted to fill vacancy Spa City Black community seeks person of color to replace official who died

SARATOGA SPRINGS - Members of the city’s Black community are asking City Council to appoint a Black resident to replace the late Commissioner of Public Works Anthony “Skip” Scirocco. Shaun Wiggins, who has run for public office twice, once as a Democrat and once with the strong backing of Conservatives, is leading the effort to convince elected officials to appoint attorney Jason Golub, who co-chaired the city’s Police Reform Task Force. “Jason is very qualified,” said Wiggins, who is president and CEO of Soteryx and has worked with Golub at General Electric. “He will sit down and look at the entire operations of public works. He will find
out what is working well, what’s working not so well and what’s not working at all. He’s a great listener. He will take input from employees and from that he will formulate a more efficient way to operate. I’ve seen him do this time and time again.” Wiggins also said that Black residents helped to get the now all-Democratic council elected and if they chose not to appoint Golub that “would be a slap in the face to the Black community.” Golub told the Times Union he thanks those who put his name forward and said he’s willing to be considered for the job “when the time is right.” “Skip just passed and I don’t want to be disrespectful,” Golub said. Calling hours for Scirocco took place Monday. His funeral Mass is 11 a.m. Tuesday at St. Clement’s Church on Lake Avenue. Still, he added, “I think it would be great for the community and great for the city to have
Black representation on the City Council. I think that would go a long way after what happened over the last few years. There would be a lot of bridge building, trust building if that were to happen.” Since the summer of 2020, tensions between Black Lives Matter protesters and city police have run high — particularly in terms of questions surrounding how police have handled protests. The state attorney general’s office is currently investigating city police for alleged civil rights violations. Mayor Ron Kim said that the council has to carefully consider the replacement for Scirocco, who died from cancer on Wednesday. Scirocco, 74, was the city council’s lone Republican, and worked full-time in the position that only pays $14,500 a year. “They have to be qualified and willing to make the financial sacrifice,” Kim said. “It may be Jason
Golub or somebody else. But I would look at any person who is qualified.” He said the council will be discussing it, but right now its members are more concerned WIGGINS with ways to honor Scirocco who served as commissioner of Public Works since 2008. Prior to that, Scirocco was a Saratoga County supervisor representing the city and was the city’s animal control officer. Still, Kim agrees that Golub is impressive. “I think Jason is great,” Kim said. “What he did with the Police Reform Task Force was astounding. That was a tough job in the middle of a pandemic and with some pretty active opposition even from the city council. It was an amazing job. Instead, the committee is focused on selecting a candidate to run for a special election to fulfill Scirocco’s term, which expires Dec. 31, 2023. “Obviously, Skip left big shoes to fill,” Brandi added. This Week in Saratoga County History - William Sears’ American Hygiene Vegetable (AHV) Medicine Cure or Snake Oil? For the past twenty-five years he has lived in the home originally built by Uriah Gregory in Ballston and has enjoyed researching the family of this early Ballston settler and Revolutionary War pensioner. He is currently finalizing a book to preserve this history for future generation. Matt can be reached via email at mattg47@verizon.net The nineteenth century in America saw the rapid growth of “patent” medicines developed and marketed to a populace longing for relief from the many chronic maladies of life. Newspapers of the times were filled with advertising extolling the virtues of these creations as men tried to make their fortune by selling into this need. The early fall of 1834 found one such man, William Sears, then in his middle fifties, traveling around Ballston and nearby communities in Saratoga County soliciting testimonials from prominent local citizens as to the benefits of the medicines he had produced that were now being offered to the public. William, born in 1780, was a son of Sunderland Sears, an early pioneer in Ballston, and had two more prominent brothers, Dr. Isaac Sears and Reverend Reuben Sears. William’s life is remembered, however, due to a treatise he authored in 1834 which has been preserved in the
archives of the National Library of Medicine. In some biographical notes within the treatise, William states that “at the age of twenty, being a member of Union College, at Schenectady, I was attacked with a bilious fever, which confined me for several weeks”. Although he attempted to continue his studies, after a few months William was forced to return to his father’s home in Ballston where he consulted his brother Isaac, a physician in practice with a “somewhat eminent physician” in Milton. Describing his ailment as an “unyielding dyspepsia”, he was given “mercurial” treatments for a period of six weeks and became so debilitated that he remained mostly confined to his home for a year. William spent most of ten years seeking relief and a curative for his condition, consulting doctors up and down the east coast and as far away as Portugal. Despairing of any relief from the common remedies of the times, William had taken it upon himself to learn as much as possible about the human digestive system in hopes of identifying the source of the symptoms that had tormented him for so long. The treatise consists of a summary of William’s life and struggles with his ailment, his search for remedies, and a description of four natural medicines he ultimately developed and offered for sale at the AHV “dispensary” in New York City. To restore this “digestive apparatus” William, after an exhaustive study of indigenous vegetables, discovered, within Saratoga County, what he claimed to be those that contained the necessary properties that he was now offering for sale to the public in four products.

First were the A.H.V. Renovating Pills for restoration of digestive health, which William claimed to have all the good attributes of mercury (the standard treatment of the day) but without the side effects. Among the ailments of the digestive system that these pills can cure were said to be everything from indigestion to headache, liver complaints, various pains and fevers, and even hypochondria. In addition to the Renovating Pills, William was offering a cough syrup suitable for all diseases of the lungs, a diuretic to expel morbid liquids from the system and even an ointment for the treatment of piles. The presentation of the various remedies also contained the usual disclaimers similar to those we often see today in advertisements for drugs; to wit, “obstinate cases may, however, occur which will require a treatment somewhat different from that prescribed….”. In such cases the patient was advised to apply directly to William’s dispensing office in New York City for further advice and direction. To make the case for these medicines all the more compelling, William had spent a few busy weeks in Saratoga County in the autumn of 1834 obtaining endorsements for his character and creations. Character references came from two of the principal men in Saratoga County at the time; John W. Taylor, a member of the US House of Representatives between 1813-1833 who served two terms as Speaker of the House, and Samuel Young, whose long political career included terms in the New York State Assembly and Senate. Both these men confirmed knowing William for thirty years and attested to his moral

character and reputation. Among a long list of other character references included one from his brother, Rev. Reuben Sears, a minister most famous for composing book and poem about the mineral waters of the Ballston Springs. For several years in the late 1830s, New York newspapers contained advertisements for the products of “Dr. Sears” (although he admittedly did not have a medical diploma), along with additional endorsements from satisfied patients. There is no evidence that William’s medicinal enterprise was profitable, however, and the fact that he left New York City and headed west to St. Louis in the 1840’s might suggest otherwise. It is easy with the benefit of hindsight and knowledge of twentyfirst century medicine to dismiss William Sears and those like him as charlatans and frauds seeking to
earn a living at the expense of the suffering masses. A more generous view of William’s efforts, however, might point to an earnest man who, to improve his own life, had devoted years to gaining some relief for his symptoms and, upon achieving some measure of success, took advantage of an opportunity to offer his products to others who were in similar circumstance. Of course, we will never know the motivations behind William’s particular calling, but we can be thankful that his treatise has been preserved to offer an interesting view into domestic life in Saratoga County during the first half of the nineteenth century. ment of Aging and Youth Services is seeking volunteers to deliver meals to homebound seniors in the following areas: Ballston Spa, South Glens Falls, Wilton, Hadley, Schuylerville, and Greenfield. This important program helps many seniors, age 60 and older, remain independent in their homes by providing them with a nutritious ready-to-eat lunch each weekday. Meals are picked up at 11AM and delivered until 1PM. Volunteers’ schedules are flexible to meet their availability. To become a volunteer, individuals must submit paperwork, including references, to the Saratoga County Department of Aging and Youth Services. Volunteers must have a valid driver license and their own vehicle. Training and orientation are provided to all volunteers. Being a volunteer for this program is a gratifying experience as seniors look forward to seeing a friendly face with their meals. HOME SOLUTIONS Explaining easements, setbacks and CCRs Property setbacks as well as easements and conditions, covenants and restrictions (CCRs) must be considered before renovating an existing home or building a new one. Setbacks are mandated buffers between surveyed property lines and permanent structures. Easements are legal designations that enable individuals or entities to use portions of a person’s property for physical access or to build on it for one reason or another. Easements may be owned by utility companies for gas lines or government agencies when sidewalks are on a private property. Additional examples of easements

CCRs include rules established by many planned communities, subdivisions and planned unit developments. CCRs, easements and property setbacks can affect which type of renovations are allowed on particular plots and may affect the issuance of permits. It’s essential to learn about property easements, CCRs and setbacks in advance and discuss them with contractors when drawing up preliminary plans. Your property deed or plat map as well as the local building inspection offices can highlight any regulations that may be in effect on your property and if they may affect future projects.

History Center Welcomes 4 New Trustees
BALLSTON SPA - The Saratoga County History welcomes four new trustees to its board, starting in February 2022. The additions are part of the History Center’s exciting growth, and will bring skills and talents key to reaching new audiences and fundraising. William Allerdice has worked on and off for his family’s business, Allerdice Building Supply, Inc., and is currently at his father’s side. A graduate of Saratoga Springs High School, he has sat on the boards of both Friends of Lake George Opera and Universal Preservation Hall. He has a passion for history, the arts, and the Saratoga community. Andrew Collier is a native of Lancaster, PA, and a graduate of Saint Francis University with a degree in U.S. History. Andrew has worked for a variety of organizations and campaigns in the advertising and consulting industry. He is currently employed remotely by the National Public Pension Coalition, located in Washington, DC. An avid runner, biker, and gardener, he settled in Ballston Spa with his wife Molly. They enjoy exploring Ballston Spa’s restaurants, parks, and everything their town has to offer. James Richmond worked in Power Systems at General Electric for forty years, after which he concentrated on his lifelong passion for history. He has published two books: War on The Middleline; and Milton,New York, A New Town in a New Nation (with Kim McCartney). In 2018, Jim was a founding member of the Saratoga County History Roundtable, whose mission is to expand interest in our local history through presentations, research, articles, and tours. In 2021, Jim led the effort to publish Saratoga County Stories, a compilation of weekly articles on Saratoga County history. Frederick E. Sober, Jr. is lifelong resident of Saratoga County. He holds a Bachelor’s Degree from Siena College, and a Juris Doctor from University at Buffalo. He is an avid history enthusiast, and has practiced law for twenty-five years. The board of trustees remains committed to growth and public service. The perspectives and professional experiences of Allerdice, Collier, Richmond, and Sober will allow the History Center to pursue new avenues of historic preservation and community outreach. budget, New York’s tens of thousands of restaurants and bars licensed to serve alcohol for on-premises consumption may again sell it as part of orders for takeout and delivery. Although beer has long been permissible for takeout, similar sales of wine and spirits were illegal for years. They were allowed for 15 months during the pandemic under emergency provisions but lapsed in late June, when the state Legislature ended its session without passing a separate law that would have continued the measure. With the help of strong advocacy from Gov. Kathy Hochul, in the face of opposition from the state’s liquor-store lobby, alcohol-to-go was included in the budget. According to the law (Part P in the online version), food must be included with takeout alcohol orders. The stipulation is for a “substantial food item.” Trying to prevent a recurrence of the confusion around what minimum quantity of food was acceptable when alcohol-to-go was first allowed in March 2020, which resulted in businesses being scolded for selling $1 orders of “Cuomo chips,” the SLA on Monday advised the following: Sufficient: full meals, individual entrees, sandwiches, soups, salads, wings, hot dogs. Insufficient: bag of chips, bowl of nuts or candy, “unreasonably small portion of soup, a serving of canned beans, a handful of lettuce.” “Obvious efforts to circumvent the law,” the SLA said, including “charging a small extra fee for an alcoholic beverage in lieu of a food item not actually ordered or delivered, will be treated as a violation of the law.” Restaurants and bars settled into general compliance after the state’s strong crackdown in 2020 on pandemic-related provisions affecting bars and restaurants, including a task force that at times was making thousands of compliance checks per week and issuing steep fines for

By last spring, it was widely understood by the industry what was expected, and the return of alcohol-to-go with a food requirement will not likely be much of an adjustment, as it is essentially a return to the previous rules. But what’s new is the second half of Monday’s SLA guidance about permissible quantities. The new law allows the takeout or delivery of bottled beer, individual cocktails and glasses of wine, served in a container with secure lid or sealed cap. It specifically precludes the sale from bars and restaurants of full bottles of wine and spirits in their original packaging. This stipulation was included as a nod to liquor stores, which had predicted that allowing full-bottle sales would open the door to some restaurants setting up dedicated areas that turned them into de facto liquor stores. However, the new law mentions no limits on serving sizes. Some earlier bills specified, for example, that orders were limited to two drinks, either as wine or cocktails, with a maximum number of ounces per drink, for each en-tree. The lack of portion limits in the budget prompted speculation from some restaurant and bar owners that they could empty an entire bottle of wine into a takeout vessel of the same size and drop it into a bag with food, or even do the same with a liter of Maker’s Mark Bourbon. The SLA guidance addresses this, saying, “Obvious efforts to circumvent the law, such as transferring the contents of a bottle of wine or liquor to a same or equivalent bottle, will be treated as a violation of the law.” But is a quart-size martini still OK? There is a three-year limit on alcohol-to-go, after which it will need to be ended, extended or made permanent.
