Ballot claims end up in court Ex-GOP congressman joins Spa City candidate's defense ByLINE: WENDY LIBERATORE

SARATOGA SPRINGS - A former Republican candidate for city office entered a plea of not guilty last Thursday morning in city court on charges that she mishandled her petitioning ballots. Samantha Guerra, appearing in Saratoga Springs City Court with her attorneys, former Saratoga County public defender Oscar Schreiber and former U.S. Rep. John Sweeney, stood silently in front of Judge Jeffrey Wait who said that the case will be assigned to the Schenectady County District Attorney's office. "This is all about politics," Schreiber said of Guerra's two charges of misconduct in relation to petitions, an unclassified misdemeanor. "This is about the election that just was had and a future election. Ms. Guerra did well in

the election and she is a political newcomer. I think they are worried about her running again. In 37 years of practicing law, I have never seen this charge lodged against anybody." Schreiber said he's waiting to hear from Schenectady County to learn who will be the prosecuting attorney. Guerra, who was running for Commissioner of Accounts but lost, came under investigation by Saratoga Springs police and State Police after her opponent Democrat Dillon Moran claimed that some of the names of her petition ballots for an independent line looked forged. An independent investigation by the Times Union found at least two individuals who appeared on the petition who said it was not their signature. The petitioning ballots also included a nonexistent address and signatures assigned to a vacant house. Despite discrepancies and subsequent objections from Democrats, the Saratoga County Board of Elections validated Guerra's petitions

in April. In June, Saratoga County District Attorney Karen Heggen, also a Republican, was alerted to the questionable signatures by a trio of Saratogians. However, she never responded to their certified letter requestGUERRA ing that she investigate. "A letter was sent to Ms. Heggen in June," Schreiber said. "My client was arrested in (November). I don't know what happened in between, I don't believe a crime was committed." Moran then went to the press and police in September. SWEENEY Guerra was arrested on the Friday after Election Day even though State Police asked Schreiber to bring her in to the Malta barracks on the day before the election. Please see BALLOTS 14

SARATOGA SPRINGS - A public hearing last week to discuss the latest draft of a civilian review board proposal started with the council screening a video from July. It showed protesters and police on Broadway, the city's main thoroughfare. As police advanced toward the protesters, the demonstrators started to move and disperse in the opposite direction. Police ran toward them, tackling some protesters to the pavement. "I'm trying to put a spotlight on the egregious actions taken by SSPD and the city administration responding for pleas for justice for Black community members," said the unidentified Skidmore College student who sent the video to Mayor Meg Kelly and requested it be shown. "At that peaceful protest ... the police presence at this July 14 protest was huge. Over 20 police people and vehicles were there, yet they claim it was the protesters ob-

structing downtown activities. The Black community is falsely punished for SSPD's systemic transgressions. To say SSPD was protecting citizens is subterfuge." The screening of the video last Tuesday, allowed by Kelly, came the night after the state Attorney General's Office confirmed it was investigating city police for alleged civil rights violations. The showing of the video itself seemingly marked a shift in how the city has responded to activists' demands. Typically, at meetings, protesters are limited to express their sentiments about policing to two minutes of speaking by the mayor, or in the extreme, removal from meetings by police. Last Tuesday, Kelly let everyone speak for as long as they wanted. Kelly did not return a Times Union phone call to explain her change of course. But Commissioner of Accounts John Franck speculates that the AG's office investigation and the election, in which Kelly's endorsed Republican candidates lost, prompted her change. "She always cuts people off after two minutes," Franck said. "But at the last meeting about sidewalks in front of the Caroline Street Elementary School, she

A lot of people are angry and (it) can't be sustained meeting after meeting after meeting like that because our first vote was 10:05 last night. But you got to let people speak." The dozen or so who spoke criticized the latest plan for the five-member civilian review board that will consider complaints about police misconduct, including abuse of power and excessive force. Many complained that the proposed review board does not have subpoena powers and the mayor would appoint its members, thus giving him or her too much power to stack the board. COPS, COURTS AND FIRE CALLS Truck damages garage in Albany Warehouse District ALBANY -- A truck struck a building in the Warehouse District Tuesday, causing part of its facade to collapse. Albany police said a truck owned by McCarthy Tire Service was moving tires in and out of the side of the building located at 980 Broadway St., when the driver forgot to put the boom down and hit the overhead of the garage on its way in. Footage shows bricks from the building facade scattered across the ground, and part of the overhang detached from the building. The extent of damage to the building's structure was not immediately known. Rick LaJoy, director of the city Department

of Buildings and Regulatory Compliance, said it is not a building collapse and there is no emergency apparatus. A private engineer is assessing the extent of damage to the building.

Victim of biking collision was 59-year-old of Schenectady SCHENECTADY -Police said Monday night that the man killed while riding his bicycle Saturday afternoon near Veterans Park was Elton Garvey, 59, of Schenectady. Schenectady police said at about 2:30 p.m. Saturday Garvey was riding in the area of State and Lafayette streets when he was hit. The car that struck him was driving east on State Street, and left the scene. However, police said they located the driver, and the person is cooperating with the investigation. Garvey was taken to Ellis Hospital, where he was later pronounced dead.

Watervliet teen charged with attempted murder in Albany ALBANY -- A Watervliet teen is facing an attempted murder charge and recovering from a gunshot wound after he allegedly shot a 17-year-old in the city before accidentally shooting himself in the leg, police said. Albany police were called around 7:45 p.m. to North Allen Street on Saturday for a reported shooting. When they arrived they found a 16-year-old with a gunshot wound to his leg. Shortly after that, a 17-year-old was found inside a nearby home with gunshot wounds to his leg and back. Police said they believe the younger teen shot the older teen as part of a dispute. The 16-year-old was also charged with criminal

possession of a weapon. His name was not released due to his age. Both teens were taken to Albany Medical Center Hospital. Police said their injuries are not life-threatening. Police also charged a 36-year-old man in connection with the incident. The man allegedly took evidence from the shooting and put it in another apartment to prevent police from finding it. He was charged with tampering with evidence and arraigned in city criminal court.

Telephone solicitation warning issued by police GUILDERLAND -Town police said Tuesday a phone solicitation has been targeting Guilderland residents. Police said that a caller, who claims to be "Media All Stars," has been contacting residents asking for donations for the school district's athletics program. The Guilderland Central School District does not fundraise through the company, police said.

The 32-year-old Rensselaer man was apprehended after local, state and federal authorities investigated the Oct. 23 incident, North Greenbush Police Chief David M. Keevern said. A woman told police the armed suspect and another man kidnapped her in the middle of the night, Keevern said in a news release. The woman knew the suspect and agreed to get into his car. At some point, the second person popped up from the back seat with a gun, Keevern said. She was able to escape when she saw police cars parked in a parking lot. The two fled; the woman was treated for non-life-threatening injuries and released from a hospital. The accomplice was arrested within days of the incident, Keevern said, but he is a youth so no information about him is being released. The U.S. Marshals Service found the driver in Colonie. He was charged with kidnapping, robbery, unlawful imprisonment,

menacing, criminal mischief and petit larceny, arraigned and jailed without bail, due back in town court at a later date. The suspect has an extensive criminal history and is wanted by the state parole department, Keevern said. His intent that evening is unknown, the chief said. The investigation is continuing and further charges are possible, he said.

AROUND YOUR COMMUNITY Saratoga Automobile Museum to Host Lost Speedways SARATOGA SPRINGS - After a hiatus due to the pandemic in 2020, the annual Lost Speedways program returns to the Saratoga Automobile Museum on Saturday, Nov. 27, 2021. Highlighting the event will be an exclusive video interview with Ronnie Johnson discussing his late father Jack Johnson’s career and their relationship, produced by videographer and former Syracuse University professor Dow Smith. The program will feature a varied slate of presentations, starting with the “Motorcycle Guy,” Mark Supley, discussing the Wall of Death caged motorcycle attractions seen at fairs and carnivals. He will be followed by longtime racer Dick Hansen, who has put together a talk about the end of the midget days and the introduction of stock car racing to the Rhinebeck Fairgrounds Speedway. Following intermission, Ken Parrotte will return with an assortment of vintage racing photos and the stories behind them. Closing out the program will be event organizer Ron Hedger’s traditional interview session, which will be devoted to memories of the late DIRT

superstar “Jumpin’ Jack” Johnson. “Jack’s longtime friend and crew member Joe Bellomo and his brother Jeff Johnson will go back in time and talk about both the man and his career,” said Ron Hedger, even organizer and Museum Board member, “Then we’ll close out the program with a terrific video of Ronnie Johnson, Jack’s son, discussing his father’s influence on him and his memories of his dad’s career.” As part of the memorabilia display, attendees are encouraged to bring their Jack Johnson photos and memorabilia to share at the pre-talk display.
