Loved ones offered marriage license chance
New state law allows friends, family members to officiate for day

Wedding season is upon us. And for some happy couples, one step to wedded bliss could become a lot easier. A new state law now licenses friends or family to officiate a wedding for the day.
Lori Sloma-Konicki was the first to receive this license in the city of Poughkeepsie, after her niece and goddaughter Allison Clerkin asked her to officiate her wedding this May, she said.
Clerkin, while raised Catholic, is not very religious. Her aunt, who once drove through a blizzard just to attend her baptism, felt like a much better choice to officiate, she said.
“I really wanted to have that personal touch in our ceremony,” she said.
They considered online ordination, but Sloma-Konickki wasn’t entirely comfortable with it, and Clerkin learned some such weddings have been legally contested. This new state law was, as Sloma-Konicki put it, “the perfect solution.”
“It gives a certain amount of freedom, I would think, to the parties of the marriage,” said Danielle Gillespie, city clerk and registrar for the city of Albany.
The cities of Albany, Saratoga Springs and Hudson each have instructions and applications online for those wishing to take advantage of the new license. But there are still some limitations, Gillespie said. The one-day officiant license does not, for example, give you a chance to speedrun as many marriages as you could possibly officiate within 24 hours. It’s linked to the marriage certificate for the specific couple and expires after the ceremony. That means, while you can get married anywhere in the state, the marriage and officiant’s licenses must both be issued in the same clerk’s office. Applicants must also be over 18 and pay a $25 fee.
The legislation was introduced in January 2021, but versions go back as far as 2006, with legislators calling for it as a way to “modernize” and allow for more intimate ceremonies. It was signed into law in late
December and took effect March 28, joining states like California, Massachusetts and Vermont.
But not every city was as prepared. Sloma-Konicki said when she first went to the city chamberlain’s office this April in Poughkeepsie, they were not aware of the new law. A week later they had the form available, and she credits them with coming up with it so quickly. City Chamberlain Jasmin Davis said the city created the form as soon as they were made aware of the law.
“I think that municipalities are trying as quickly as possible to put it in place,” said Davis, who expects the option to be popular in a city that processes hundreds of marriages a year.
In the nearby town of Poughkeepsie, town clerk Felicia Salvatore said they have created forms for the license, but there has been a lack of guidance from the state. Troy City Clerk Maria DeBonis said the city was still drafting legislation for the license fee. In Colonie, where such legislation was passed on April 20, Town Clerk Julie Gansle said they were working to have a form available. Schenectady Deputy City Clerk Ekram J. Phanisnaraine said their office was waiting on more information from the state.
“It’s a cool thing, I’d like to start it soon,” Phanisnaraine said.
Sloma-Konicki hopes her officiating her niece’s marriage will make the ceremony much more personal. Clerkin and her fiancé Eric Mimnaugh are writing their own vows, and Sloma-Konicki is writing her script for the ceremony.
“No one else could use the script that they are going to use for their wedding,” she said. “It’s going to be very, very special for me and them.”

— Dozens of Capital Region student athletes honored the memory of 23 children killed during contentious divorce and custody proceedings at a track event Sunday, as one parent urged state lawmakers to pass legislation aiming to reform the Family Court system in New York.
The death of Jacqueline Franchetti’s 2-year-old daughter, Kyra, in 2016 at the hands of her estranged ex-partner, sparked Franchetti’s yearslong battle to change judicial
procedure during divorce or separation cases with allegations of abuse or child neglect. “Kyra’s Law” would mandate that judges have domestic and child abuse training, require courts to determine whether there has been any abuse before addressing custody rights or child visitation schedules, and make the health and safety of children the top priority in determining custody outcomes.
Franchetti, flanked by Assemblyman John McDonald (D-Cohoes) and Assemblyman Phil Steck (D-Colonie), called the legislation a common-sense directive that would prevent not just deaths, but the physical, emotional and sexual abuse that many children who are caught up in Family Court cases endure.
Both McDonald and Steck said they are in full support of the bill, while sponsor Assemblyman Andrew Hevesi, a Queens Democrat, has previously said his office has been having conversations with the Office of Court Administration, which oversees Family Court, on the finer
points of the legislation. But the bill has not made it to the floor of either chamber with just one month to go to the end of this year’s legislative session.
“It should pass, but it may not. We’re in jeopardy today,” Franchetti said.
Part of the legislation would require courts to conduct a review of any one parent’s findings or allegations of child abuse, domestic violence, or heightened danger before issuing custody or visitation rights.
The Times Union has previously reported on gaps within the Family Court system in New York, which can fail to prevent killings like Kyra’s. Advocates have estimated that 23 children have been killed by a parent involved in divorce or separation proceedings since 2016.
One factor in these incidents is the delay in contentious custody cases, which can drag on for months without resolution, with each hearing spaced out over months in some cases.
Joan Gerhardt, the director of public policy
at the New York State Coalition Against Domestic Violence, said that the legislation would mandate that judges almost immediately evaluate a child’s treatment by both parents at the beginning of custody cases.
“Not months down the road, not after the case has been punted month after month after month,” Gerhardt said. “But at that first appearance in Family Court, (judges) should think through the safety and well-being of children, month after month after month.”
Steck said the issue has not yet come up in conference with fellow Democrats in the Assembly, with 17 days of session left before lawmakers leave Albany.
He added that some of the disputes over the bill come down to funding for judges to receive increased training, as well as the issue of an under-resourced court system.
But Steck also emphasized the Legislature’s role is in setting legal requirements while the courts must then carry them out.
The legislation would, in part, ensure that judges receive more thorough education on domestic violence and child abuse, and allows advocacy groups and the state Office for the Prevention of Domestic Violence to develop that training.

Franchetti’s daughter had been shot by her father in the middle of a contentious custody battle that was unfolding in Nassau County Family Court, where visitation disputes are typically handled in divorce and separation cases. Roy Rumsey, Kyra’s father, had a history of violence and stalking that led to Franchetti leaving the relationship. But the judge overseeing her case did not take his behavioral history into account, according to Franchetti, and Rumsey shot Kyra during an overnight visit before killing himself.
“Today’s a hard day for me. I miss my daughter so much,” Franchetti said. “And we cannot wait one more day for this to pass. We cannot wait one more year for this to pass. We need our courts to do what they’re supposed to do.”

“We’re honored to host Keynote Speaker Greg Olsen, Director of the New York State Office for the Aging as we gather to discuss the challenges and opportunities facing our community as our senior population grows,” said Andy Gilpin, CAPTAIN CHS Executive Director. “This event aims to bring together community, faith, and business leaders and other stakeholders in a collaborative effort to ensure our seniors have the services and supports that they need to continue thriving here in Southern Saratoga County.”
The event will also feature Luncheon Speaker Blair Horner, Executive Director of the New York Public Interest Group (NYPIRG), and many other local community, business, and government leaders as well as experts in the field of aging.
“As the last of the Baby Boomers enter their senior years, we’re facing many challenges ahead, including transportation and at-home service offerings,” noted Francine Rodger, Chair of CAPTAIN CHS’s Senior Services Committee. “If you think the impacts are limited to the senior population, think again. We have many adults who are active caregivers for their aging parents too who will need our support.”
Throughout the day, participants will hear from the issue experts and leadership and have the opportunity to engage in geographic and issue-specific breakout sessions. DELMAR – RUNforVETS.com on May 28-- a chance to give to those who have given so much.
The Sons of the American Legion Blanchard-Currey Post 1040 and the Bethlehem Memorial VFW Auxiliary Post 3185 host their first 5K race followed by a 2-mile walk. The Run starts at 9 am and the 2mile walk at 10:30 am with the start and finish lines at the American Legion, 16 W Poplar Dr, Delmar.
“All proceeds of this event will support veteran groups in the area,” said Sons of American Legion Commander Joe Benoit.
“This is the first year of the event, which we will become an annual tradition in conjunction with the Bethlehem Memorial Day Parade, which is sponsored by the Legion and the VFW. Help us remember those who have passed and support our current veterans.”
There’s a $40 registration fee for runners and walkers, with all proceeds supporting veteran activities in the area. Donation and sponsorship information can also be found online at RUNforVETS. com. The site also includes a map of the race.
