Town enters nursing home-union fight Bethlehem board responds to staff shortages, conditions By MASSARAH MIKATI
Captain CHS
CLIFTON PARK - The Senior Services Committee of CAPTAIN CHS has started a Clearinghouse website for senior citizens and their caregivers. Included are informational websites as well as virtual programs and entertainment. Studies have shown that Seniors are increasingly vulnerable to social isolation (a fact of life during the pandemic), and we have found a large number of programs which can help alleviate the sense of being alone. There are programs listed which can be accessed anytime and programs which are time sensitive which will be updated as appropriate. Most programs are free, but there are some which charge a fee. The Clearinghouse can be found at the Care Links Resource Page AT captaincares.org/care-links/ resources.html, or directly atcarelinksgoodstuff. weebly.com.We are always looking for additional resources to post on the page and suggestions may be sent to wljozwiak@gmail.

BETHLEHEM - After years of turbulence and complaints about poor working conditions at a Delmar nursing home and assisted living facility, the Town Board will be sending a letter next week to the owners of the privately owned business urging them to meet with union members about their concerns. Employees of the Delmar Center for Rehabilitation & Nursing and the Albany Center Adult Home, located on Rockefeller Road, and representatives of 1199SEIU United Health Care Workers East spoke at a recent Town Board meeting about the dire conditions they say workers have faced even after new owners took over in 2020. “In all my (25) years as a certified nursing assistant, I’ve never seen a situation as bad as I do today,” one employee of the nursing home said at the meeting. “We simply do not have the staff, and when there are not enough staff we cannot deliver care that we are supposed to.” Employees who spoke at the meeting said that with the limited staffing, some residents haven’t been able to get showers, nail care or other treatments as they’re supposed to receive. Workers said they have had to take on responsibilities outside of their job descriptions and certifications to ensure residents get as much care as possible. Employees also said that they are being paid far below market-rate for their jobs. For example, the starting wage for CNAs at the center is $14.50 to $14.80 per hour, compared to starting wages of $16.50 to $19 per hour at other similar facilities in the area, according to the union. “In our meeting with the managers asking them to increase our wages to fair market wage, they laughed at us,” the certified nursing assistant said at the meeting. “They said they might consider it if we would give up our health benefits.” Workers at the facilities have dealt with years of turbulent conditions, particularly leading up to the prior owners of the properties seeking Chapter 11 bankruptcy relief in 2020. In 2019, workers lost their health benefits because the previous owners were not making their contractually required payments to the health benefit fund. But conditions did not improve after new owners took over the nursing home and assisted living facility in 2020, workers have said. Centers Health Care, a for-profit chain from New York City, was appointed receiver of the facilities by the state health department in 2020
as it pursued ownership of them. But shortly after, staff said they were being denied vacation time and struggling to manage the workload. “The sense is that nothing is better,” Tanya Grant, administrative organizer for 1199SEIU United Healthcare Workers East, told the Times Union at the time. “They have not come in and presented a better situation for the workers.” Two years later, union representatives who spoke to the Town Board last month echoed the same sentiments. Representatives pushed back on the owners’ claims that there is a labor shortage, saying the facilities would be able to hire and retain more staff if workers were paid fair wages and treated with respect. The average turnover rate at the center is 96 percent, according to union members. To make up for the staff shortage, the owners have contracted agencies to bring in workers from out-of-state. However, union representatives said those hires have been getting paid more than local staff, despite not being qualified for the work — and union members often end up doing their work for them, they said. “The staff is spread so thin that we don’t have enough time with the residents, and they get anxious,” Mindy Berman, regional communications director for 1199SEIU Healthcare Workers East, said on behalf of another staff member. “You can imagine what that’s like for somebody who’s old and in a nursing home. Our residents are human beings.” There are currently 120 residents at the facilities, and about 35 to 40 union members working there. Town Supervisor David VanLuven confirmed that the town’s director of senior services had echoed the same concerns the union members shared about working conditions at the nursing home. The Town Board unanimously voted to send a letter to the owners urging them to meet with union representatives to reach a fair contract. “We felt it was appropriate because when we were talking to our senior services department, they were underscoring all the problems union members were sharing with us,” he said. “If there’s a way we can help address these challenges, and in the process help residents and improve conditions for the workers there, we need to.” Delmar Center for Rehabilitation & Nursing could not be reached for comment. A message left with facility’s administrator, Rafi Lehmann, was not immediately returned.
Sale grows reach of CSX Rail freight provider acquires Pan Am Railways, allowing service expansion By RICK KARLIN
MECHANICVILLE - CSX Corporation has completed its long-sought purchase of Pan Am Railways, which serves parts of eastern New York and New England and has a railyard in Halfmoon. “We are excited to welcome Pan Am’s experienced railroaders into the CSX family and look forward to the improvements
we will make together to this important rail network,” CSX CEO James Foote said in a prepared statement. The price of the sale, which was approved by the federal Surface Transportation Board in April, wasn’t disclosed. Trains magazine, however, has previously reported that the price was estimated at $700 million. Publicly traded CSX is based in Jacksonville, Fla., and is one of the nation’s largest rail freight providers. They operate a large railyard in Selkirk. It wasn’t immediately clear if the purchase would
impact operations in either of those locations. Pan Am, based in North Billerica, Mass., is privately held, with financier Timothy Mellon as majority owner. It runs a 1,200-mile network throughout New England and has a joint venture with Norfolk Southern for an additional 600 miles of track, known as the Patriot Corridor, between Mechanicville and Ayer, Mass. Through the Patriot Corridor, CSX will be in a joint venture with the rival Norfolk Southern line. The deal allows CSX to expand its service
area into Vermont, New Hampshire, and Maine, as well as to Saint John, New Brunswick. Trains running through the Halfmoon railyard have been a source of complaints, with some of them backing up along West Street in Stillwater for long periods of time. Residents have complained of the idling and odor from some of the trains that haul residential and commercial trash on its way to landfills in South Carolina. Stillwater Supervisor Ed Kinowski said things have improved on that front, but the trains still

DiCarlo’s Gentlemen’s Club, one of the region’s most venerable strip bars, will close temporarily after business on Saturday, according to a note posted Thursday on its Face-book page. Losing the lawsuit, filed in January 2020 in U.S. District Court in Syracuse, prompted the bar’s insurance carrier to decline to renew its coverage, and it has been unable to find a new provider, according to the note, which says, “for right now we can not operate as an uninsured entity.” DiCarlo’s owner, Larry Davis, a local entrepreneur who has holdings in varied fields including hospitality and communications software, said Thursday that he is legally precluded from discussing the conclusion of the suit. The club’s founder, Sal DiCarlo, who died in 2012, was a decades-long friend of Davis. DiCarlo’s estate sold him the club

He noted that he’s been talking with all three lines, CSX, Pan Am and Norfolk Southern, and they are working through the steps needed to keep the idling trains away from the neighborhood. “It’s being worked on,” Kinowski said. “They’ve been very cordial but it’s a bit of struggle in that it’s a big organization,” he said of CSX. “There are so many engineers involved that have to know the situation.” rkarlin@timesunion.com — 518-454-5758 — @RickKarlinTU
property, at 1165 Central Ave., and a building next door with ground-floor retail space and upstairs apartments. Davis said he is willing to consider selling DiCarlo’s. When he took over, in 2014, the operators of DiCarlo’s were announced as Tess Collins, whom Davis also backed in McGeary’s Pub in downtown Albany, and Shahila Abbasi, then the head chef at McGeary’s. Their involvement made DiCarlo’s one of only a handful of strip clubs in the country owned and operated by women. Abbasi, who is no longer involved, has left McGeary’s. Collins, initially named in the lawsuit, had its claims against her dismissed by a judge. She said Thursday she has ended her affiliation with DiCarlo’s. A potential reopening date for DiCarlo’s was unclear. According to the Facebook note, “We will be working on the situation, and upgrading the club in the meantime.” The note said the final three days of business for now are Thursday through Saturday this week. Still feeling the effects of the pandemic, DiCarlo’s recent hours have been limited to 8 p.m. to 2 a.m. Thursday to Saturday. The note seemed to acknowledge misappropriating the images of Electra and her co-plaintiffs, Lucy Pinder and Irina Voronina, for use in racy ads on social media. “We made the mistake of using the likeness of a famous actress in one picture on our website,” the note says, adding, “She and a group of Please see DICARLO’S 8

Captain Community Human Services Kicks Off Free Summer Meals Program MECHANICIVILLE - CAPTAIN Community Human Services (CHS) and its partners are kicking off this year’s Free Summer Meals Program at 11:00am on Tuesday, July 5th, at the Park Avenue Playground in Mechanicville (711 Park Avenue, Mechanicville, NY 12118). “The hunger crisis in our community hits kids the hardest,” said CAPTAIN CHS Executive Director Andy Gilpin. “The Free Summer Meals program is one of the tools we use to get food to those kids that need it the most.” Managed by the NYS Department of Education under the direction of, and
Senior July Dining Events at Colonie Senior Service Centers COLONIE - Please note, you must have all three vaccinations to sit in our dining room. Thank you for doing your part to keep everyone safe by getting your vaccination and wearing a mask! Join us for a hot meal at The Beltrone Living Center Monday – Friday at noon. This program is funded in part by the Albany County Dept. for Aging, NYS Office for the Aging, Administration for Community Living, Town of Colonie and participant contributions. through funding from, the USDA, along with supplemental funding from our local United Way of the Greater Capital Region, the Free Summer Meals program provides meals to qualified youth ages 18 and under at locations throughout Saratoga County. For the past two years, the USDA has issued a waiver to allow the program to serve all youth. That waiver expires on June 30th. “While we remain proud to offer Free Summer Meals this year as we have in the past, we’re disappointed that the federal USDA waiver will not remain in place to ensure all kids have access to free lunch throughout the difficult summer months,” continued Gilpin. “We saw a near 60% increase in the number of meals served during the pandemic years and I expect many more
kids will struggle without universal access like we’ve been able to offer the past two years.” The nutrition waivers provided by the USDA allowed programs such as CAPTAIN CHS to offer meal pick-up and the opportunity for families to pick-up multiple meals at once, ensuring the most flexibility and allowing those kids who cannot access sites to receive the food they need. Without the waiver, youth must visit the meal site in-person and consume the food on-site. This can be a real challenge for working families, and those without access to transportation. “The waivers didn’t just allow more kids to access food,” continued Gilpin. “They also allowed funds to make up for rising food and delivery prices – something that our organization must find
other ways to afford now that Congress has failed to act.” On average, Free Summer Meals programs have the funding and reach to support just 16% of the kids in need according to No Kid Hungry, a national nonprofit focused on eliminating child hunger. According to data from Feeding America, over 18,000 Saratogians are food insecure – many of them children.

HOME SOLUTIONS Explaining Easements, Setbacks & CCRs Property setbacks as well as easements and conditions, covenants and restrictions (CCRs) must be considered before renovating an existing home or building a new one. Setbacks are mandated buffers between surveyed property lines and permanent structures. Easements are legal designations that enable individuals or entities to use portions of a person’s property for physical
access or to build on it for one reason or another. Easements may be owned by utility companies for gas lines or government agencies when sidewalks are on a private property. Additional examples of easements include greenbelt conservation easements, beach easements or view easements, according to The Spruce, a home and lifestyle resource. CCRs include rules established by many planned communities, subdivisions and planned unit developments. CCRs, easements and property

setbacks can affect which type of renovations are allowed on particular plots and may affect the issuance of permits. It’s essential to learn about property easements, CCRs and setbacks in advance and discuss them with contractors when drawing up preliminary plans. Your property deed or plat map as well as the local building inspection offices can highlight any regulations that may be in effect on your property and if they may affect future projects.

Volunteer to Be Part of a Pictorial/Oral History Exhibit COLONIE - Colonie Senior Service Centers, Inc. was recently awarded a grant to implement a wonderfully timely project entitled “A Moment in Time – What are you looking forward to?” This basis for the proposed pictorial exhibit is simple. Realizing how detrimental and isolating the COVID-19 pandemic has been to everyone throughout the Capital Region, this project, with a committed team of photographers, oral historians and makeup artists, along with CSSC staff, is intended to capture and highlight the insight and hope from our seniors for the future. We believe that those who participate in this project as well as those who view the exhibit will be inspired.
We are looking for volunteer seniors from the community who will allow to be photographed and briefly interviewed so that we may capture that moment in time. The question that will be poised in the interview is “What are you looking forward to” From these interviews, an exhibit will be created and displayed both hardcopy as well as electronically. CSSC plans on scheduling approximately ten sessions over the next several months at different locations throughout the Capital Region at such locations as churches, senior centers, historic sites and libraries to photograph and interview participants. If you or your group is interested in learning more about this project, please call Diane at 518459-2857 ext. 305. This project is made possible with funds from the Decentralization Pro-
gram, a recent program of the New York State Council on the Arts with the support of The Governor and the New York State Legislature and administered by The Arts Center of the Capital Region.
