ALBANY — A federal judge has granted class-action status for Hoosick Falls in a legal battle with DuPont Co., putting the small community and one of the world’s largest corporations on a path toward trial over the pollution of public and private water supplies in and around the Rensselaer County village.

The litigation is unfolding in U.S. District Court after DuPont declined to be part of an earlier $65 million settlement involving three other companies: Saint-Gobain Performance Plastics and Honeywell International — which had operated a manufacturing plant in the village — along with 3M.

The four companies are alleged to have had varying roles in the decades-long pollution of the community’s water supplies, which are contaminated with perfluorinated chemicals that were used at various factories in the village. The settlement approved earlier this year secured cash payments and longterm medical monitoring for thousands of property owners and residents, including those who were found to have elevated levels of a toxic manufacturing substance — perfluorooctanoic acid, or PFOA — in their bloodstream.

“We are happy for the Hoosick Falls community and pleased that the court granted us permission to proceed as a class. We look forward

to moving forward against DuPont on behalf of the Hoosick Falls class as we proceed toward trial,” said James Bilsborrow, who with his partner Robin Greenwald from Weitz & Luxenberg in New York City are two of four class counsel appointed by the court.

Stephen G. Schwarz, a Rochester attorney who is another class counsel appointed by the court, said that the first settlement enabled them “to return some of the money lost by community due to the devaluation of their homes” and that the next step in the litigation is intended “to make residents whole by proceeding against DuPont, one of the major producers of the Teflon dispersions used at the Hoosick Falls plants responsible for the release of PFOA into the environment.”

The lawsuit, filed in U.S. District Court in Albany, contends that 3M manufactured the chemicals that were sold to DuPont and other companies and were used to manufacture products such as nonstick coatings and heat-resistant wiring. DuPont also sold the chemical products to Saint-Gobain and Honeywell for use in their manufacturing facilities.

Hadley Lundback, another class counsel in the case, said they intend to “require DuPont to pay for multiple additional years of medical monitoring beyond the 10 years funded by the prior settlement. If we are successful, it will

RENSSELAER — A group looking to take down aging, obsolete dams in the Hudson Valley got a boost on Friday, in the form of a state grant to begin work on removal of the Mill Creek Dam.

And that should go a long way to help restore depleted stocks of American eel and river herring, which travel from the Atlantic Ocean to streams along the Hudson River like Mill Creek.

“We’re trying to restore the creeks for migratory species,” said George Jackman, senior habitat restoration manager for the Riverkeeper environmental group.

“Since colonial times, the creeks one by one got walled off and dammed.”

Riverkeeper is receiving $150,000 from the state Department of Environmental Conservation for a site assessment, surveying structural engineering as well as preliminary design and engineering plans for the dam removal.

Mill Creek flows under Second and Third avenues and runs below the state Office for Children and Family Services headquarters.

The litigation, filed in 2016, has sought to compensate residents in that area for the potential health consequences of their exposure to the chemicals, as well as the potential loss of property value, and to provide a system of early detection for any related health issues they may suffer in the years ahead.

More than 2,500 claims were submitted by residents, who received compensation as well as access to medical monitoring in the first settlement.

A manufacturing plant that Saint-Gobain has operated on McCaffrey Street in Hoosick Falls since the 1990s had been a focus of pollution concerns. The plant is adjacent to the village’s water treatment plant, which pulls water from underground wells that have been polluted with PFOA. Honeywell’s predecessor

American eels are catadromous, meaning they are born in the ocean and migrate to fresh water spots where they spend part of their lives. River herring, or alewives, are anadromous, spending most of their lives at sea, but swimming up rivers and then streams to spawn.

Stock of eels and herring have been depleted due to overfishing, as well as diseases such as the swimbladder nematode, which are believed to have harmed eel stocks.

Hoffman Car Wash Bolsters Food Supplies for Local Food Pantries

CAPITAL DISTRICT - For the second time in 2022 and for the 11th consecutive year, the staff at Hoffman Car Wash will be collecting non-perishable food items to support local area food pantries. On Saturday, October 22nd, and Sunday, October 23rd, Hoffman Car Wash will provide a free Ultimate car wash with a food donation.

Hoffman Car Wash has partnered with 17 different food pantries to provide much-needed assistance for families and individuals in need. Each Hoffman location will donate the collected items to a food pantry in its neighborhood.

Councilman Jack Rogers Reports to the Town of North Greenbush

The Town of North Greenbush annual Halloween parade will be held on Sunday, October 30, 2022 at 2 pm. Line up for the parade will be at the Family Dollar on Main Avenue. The parade route will be down Main Avenue to Town Hall.

Residents voiced their concerns at the public hearing regarding the rezoning application for Points North Holding, LLC. The two resolutions on the agenda were tabled due to their questions and concerns regarding the proposed building.

A brief presentation was held on the Partridge Hill Apartments.

Marty, a Senior at Columbia High School, presented the Town Board with a poster “Kindness Rocks North Greenbush.” The poster will be displayed at Town Hall.

Town of North Greenbush Update

Happy Fall! Supervisor Joe Bott worked together with departments to put together his 2023 budget which can be found on the town website. The board will hold public hearings for special district assessment rolls, for operation and maintenance charges and the 2023 preliminary budget on November 10th starting at 6:00 pm.

Councilman Jim Gordon, working with Supervisor Bott and members Hoffman and Merola, introduced legislation to consider a moratorium on multi-family dwellings in town. There will be a public hearing on the matter on November 10th at 6:15 pm. There will be public hearings for the board to consider

The event is part of Hoffman Car Wash’s “Practice Kindness” initiative to spread positivity and goodwill in the communities it serves. In 2022, Hoffman Car Wash has supported Interfaith Partnership for the Homeless (IPH), Juvenile Diabetes Research Foundation (JDRF), and the ALS Regional Center. Additionally, Hoffman Car Wash held its first Food Drive in early June and a free wash event for all First Responders and Hospital Personnel on September 11th. Still to come this year, Hoffman will host its annual Veteran’s Day free wash event in November.

Hoffman Car Wash also supports many non-profits and youth organizations through its Helping Hands Fundraising program.

Community Day was a success and we thank all who participated, including Len Johnson and Bonnie Pangburn for helping organize the event. Many residents participated in Recycling Day so we will continue holding these events for our residents.

Brown Bag Auction

Back after 2 years! On October 22, 2022 , the Nassau Resource Center will hold its annual Brown Bag Auction at St. Mary’s Church Hall in Nassau.

The auction is the only fund raiser for the food pantry each year. It is a fun and inexpensive event held right in the community.

Samuel Bonesteel • SCHOLAR ATHLETE •

This week’s Scholar Athlete is Samuel Bonesteel. Sam is a Varsity runner for the cross country team, and also runs for indoor and outdoor track.

Sam began running with Road Runners, a youth running program, when he was younger. In middle school Sam joined the modified track team, and later joined the cross country team in his junior year. To prepare for his season Sam followed a running plan over the summer, logging the distances and paces he ran. However, a sprained ankle made it difficult for Sam to train as much as he would have liked throughout the summer. Sam found a way around his injury by biking for exercise, and joined the team when they went to lift in the weight room. Sam’s favorite part about his sport is the ability to challenge himself to keep doing better every week. He also noted that, “it’s very fun to go to invitationals and hang out with my team on Saturdays, whether we’re ex-

He explained that, “although it’s an individual race, you’re responsible for your team’s score. It can be very discouraging when you have a bad race, especially when you don’t know why.” Sam is proud that he has managed to improve his time throughout his seasons, and always feels accomplished when he beats a runner in the final kick of a race. This year Sam hopes to drop a minute off of his 5k time by sectionals, and is hoping the team can earn a patch at the sectional race. He has similar goals of dropping time and earning a patch for indoor and outdoor track.

In addition to his athletic success, Sam excels academically. Sam has a 97.83 GPA while taking a very rigorous course load this year, including Advanced Placement Biology, AP Physics, AP Government and Politics, AP Language and Composition, and French 5. Sam also writes for the school newspaper and participates in Youth and Government and Masterminds. Sam is also a member of the National Honor Society. Recently, Sam was also named a commended student for his score on the PSAT. In his free time, Sam enjoys spending time outside and hanging out with his teammates and friends. To help balance his time between school and sports Sam tries not to think of running during school, and vice versa. He also noted that “I have off days for both, on Saturdays I

The parade will lineup at the Family Dollar Plaza on Main Ave in Wynantskill and kicks-off at 2pm. Come participate and walk in the parade in your BEST and most unique costume while your neighbors watch the parade march down Main Avenue to Town Hall.

After the parade, come join us for cider, donuts and treats. There will be prizes for the top three best costumes! The parade is being organized by Deputy Town Supervisor Kelly Hoffman and Councilwoman Jessica Merola, Chair of the Youth Committee.

Sam’s role model is his older brother Noah. Noah ran throughout high school and is still a strong runner at the collegiate level. Noah also managed to balance good grades, and gave Sam his love of running. Sam’s parents have helped him excel in his sport by constantly supporting him and attending almost every one of his meets.

Sam’s teammates also help push him in workouts and make the sport more fun. Sam would advise a younger runner that, “everyone has good days and bad days running, and a young runner shouldn’t get discouraged when they don’t do as well as they wanted. If you stick with it and work hard you’ll always see improvement, even if it’s not immediately obvious.” After high school Sam plans on attending college, but is undecided what he wants to study. We wish Sam the best as he finishes his senior year and prepares for college.

Rensselaer Elks Lodge #2073 held a Master Chef Junior cooking event for two lucky local aspiring chefs.

Dan Raymond of Zachary’s Pastry Shoppe in Rensselaer, NY served as the judge for the event. Dan competed on the Food Network’s Holiday Baking Championship in 2018. He offered ideas and feedback and whipped up a delicious dessert for the children and audience. The Lodge gave each chef cooking tools and equipment and obtained tickets for the participants and their families to see a real live Master Chef competition.

Trunk or Treat at Gilead Lutheran Church

Halloween is actually Monday, October 31, 2022 but we made the decision to celebrate it a day early. It gives our “truckers” more time to get ready for our visitors.

That is a good point for us but it also frees up time for our little friends to go out again on Monday for more loot. Our trunks open at 3:00 PM and will close at 5:00 PM. If you enjoy watching the little one dress up but don’t have children of your own to take around, please feel free to come and hand out candy and goodies with us. Just to let you know, we have had close to 200 little visitors each year.

In 2021 we had some of our canine friends stop by, some in costume and other just stop by for a pat on the head.

We will be found in the parking lot behind Gilead Lutheran Church. You can’t miss us because Gilead is located at the intersection of Routes 7 & 278 in Center Brunswick.

NYS Youth Snowmobile Safety Class

On Saturday, November 12th, the Grafton Trailblazers Snowmobile Club and the Grafton Lakes State Park will host a NYS Youth Snowmobile Safety Class for youth ages 10-17. Students must be at least 10 years old the day of the class.

Parents are encouraged to attend and participate. The course will be held at the Grafton VFW/Fire Hall on South Road from 8:30am to approximately 4:30pm. The course will be taught by NYS certified volunteer instructors Jim Blessing and Dominic Jacangelo. The course will cover topics such as NYS laws and regulations, riding skills, trail emergencies, protecting the environment, trail etiquette, maintenance and repair, trailering, etc.

Rensselaer County Legislature Majority’s October Meeting Report

After observing Columbus Day on Monday, the Legislature held its monthly Honor A Deceased Veteran program on Tuesday, October 11th ahead of its monthly meeting. The Legislature honored the life and service of Robert E. Miller of Troy. Bob was a US Army paratrooper during the Vietnam War, and returned to Troy to start the Uncle Sam’s Boxing Club that trained countless young men and women in the Capital District and beyond. Bob worked with many amateur and professional boxers, and was credited with helping Mike Tyson become a professional boxer. Chairwoman Kelly Hoffman read Bob’s biography that outlined Bob’s dedication to his family and the sport of boxing.

On Tuesday night, the Legislature held its monthly meeting. Among the notable actions taken by the Legislature included authorizing the purchase of 1,000 winter coats for local children. The funding was raised by the County’s golf fundraiser for the Coats for Kids program. The Legislature also took steps towards continuing the construction of the new Troy Senior Center. Legislators Tom Choquette and Leon Fiacco sponsored legislation that provides the funding for new furniture in the senior center that will be located at City Station on 6th Avenue near the current county office building.

Vice Chair Bob Loveridge and Majority Leader Ken Herrington sponsored several resolutions to provide funding for the purchase of new snowplowing equipment, road salt, and parts and equipment to maintain our highway department’s fleet in anticipation of winter.

As another season of our County’s robust paving program winds down, the Legislature approved additional funding for road improvement and new paving for Pershing Ave in North Greenbush. This well-travelled street will benefit from better drainage and stability for the newly paved roadway.

The Legislature adjourned their meeting in memory of Colonel Peter Goebel who served as the County’s Director of Veterans Services. Peter passed away in September.

A big Thank You goes to B. Lodge for their continued support of Rensselaer County youth.

Aging: The legislature unanimously approved a resolution put forth by the Department of Aging to purchase furniture for the new Troy Senior Center. Due to supply chain issues, the estimated new opening date is planned for early 2023.

Veganism is kindness. You do not hurt anybody. As the Bible says, “Be ye blameless and harmless, as a child of God, without rebuke.”

CONTINUED FROM 1 corporation, Allied Signal, operated the facility from 1986 to 1996, one of five companies that ran the plant since 1956.

The payments under the initial settlement were divided among roughly 2,000 qualifying property owners. The amounts received depended on multiple factors, including the number of certified class members. Some are entitled to medical monitoring if the level of PFOA detected in their blood was more than 1.86 parts per billion. Others have been compensated based on the loss of their property value, which would be measured against the value of their residential property in 2015 — before

the stigma of the pollution had arguably damaged the local real estate market.

Another portion of the settlement — categorized as the “nuisance settlement class” — set aside $7.7 million to compensate those who had a private well contaminated with PFOA, if the pollution was detected on or after Dec. 16, 2015. That portion of the settlement applies to individuals and may include more than one person per household, including tenants. That payout was about $10,000 per person.

The 10 adult plaintiffs in the lead case — all of them current and former residents of the village of Hoosick Falls or town of Hoosick — split an additional $250,000 under the

proposal.

Those individuals had answered extensive discovery questions and were required to produce numerous documents, including emails, texts and other social media data. They also prepared for and participated in lengthy depositions at which they were questioned by attorneys for the companies.

The first settlement was reached after the companies had lost a series of court rulings over the past four years, including their arguments for having the case dismissed and excluding long-term medical monitoring.

In late August, the nearby town of Petersburgh filed a similar lawsuit against 3M, DuPont Co. and several other chemical manufacturers seeking compensation for the contamination of their community’s groundwater and drinking water supplies with man-made chemicals that were used at a local plastics company.

The town’s legal action is unrelated to the class-action settlement involving a Petersburgh plastics company, Tonoga Inc. (Taconic Plastics), which agreed to pay $23.5 million to settle its case.

The first round of payments in that case were scheduled to be distributed in August, although eligibility for the hundreds of residents whose drinking water supplies — and in many instances, their blood — were contaminated with the toxic manufacturing chemical was still being finalized several months ago.

That class-action settlement in Petersburgh was approved earlier this year by state Supreme Court Justice Patrick McGrath.

Turn Over November Ballot for Bond Proposal

The November 2022 ballot will include candidates for multiple offices, but also a vote on the “Clean Water, Clean Air, and Green Jobs Environmental Bond Act of 2022.” The bond act is known as Proposal 1 and is on the backside of your ballot.

This new bond allocates funding accordingly: - 35% for air / water pollution reduction, storm surge, flooding; - 25% for flood-risk reduction, coastal and shoreline restoration, relocating and repairing flood-prone infrastructure and roadways, and ecological restoration projects; - 15% addresses land conversation and recreation; and - 15% deals with water (waste, sewage, storm, runoff) infrastructure [Ballotpedia].

This bond addresses many current and forthcoming problems. Water-related events from Pakistan to Florida demonstrate why we to better address flooding and storm surges. Much of the water infrastructure in Troy is over 100 years old [News 10]. Periodic failures from aged water infrastructure are common. The bond provides funding for zero-emission school buses. There are many more examples and issues addressed by the bond, but insufficient space here to discuss them all.

New York state is home to more than 7,200 dams, including some that pose flood hazards. Mill Creek dam is not considered a hazard, however.

In 2016, Riverkeeper workers removed the Wynants Kill Dam in Troy and within days thousands of herring could be seen migrating upstream to spawn for the first time in 85 years.

Jackman said Riverkeeper is focusing on dams that present the first barriers that fish swimming up the Hudson might encounter after they head upstream.

“Those are the ones that are strategically important to us,” he said.

Riverkeeper restorers are awaiting word on additional federal grants that would help pay for the Mill Creek dam removal.

Ciprioni of Comprehensive physical Therapy Solutions will speak on keeping your joints healthy and how to prevent falls. Then on Thursday Oct. 27th at 11:00 am, Carol Rosbozom, the Rensselaer County Commissioner of Aging will be holding a public forum. Immediately after will be our Halloween Special Dinner! Costumes are welcome!! The Menu will be Eggplant roll with meat sauce, Spaghetti,Malibu blend vegetables, Italian bread, fresh fruit, and a

special dessert! this month we will be entertained by the very popular Gone Gray Band!! Finally on Friday October 29th we will be playing BINGO at 10:00 am.
