Rory Vaden, author and co-founder of Southwestern Consulting, gave leaders strategies for understanding procrastination and how it affects time management and productivity. Dean Zerbe, alliantgroup, managed to engage attendees in the implications of federal tax reform! Tom Kerber, director of IoT at Parks Associates, a research firm, presented research on trends in the home security space. Justin Smith, director of security at KORE Wireless, a global IoT solutions provider that connects devices across carrier networks, approached the topic of IoT device security and key considerations for attendees. The event concluded with a panel discussion on the legal implications of cybersecurity, ranging from how often an end user contract should be updated to opinions on the procedure to follow after a breach. I am honored to write you for the first time as president of The Monitoring Association. At October’s TMA Annual Meeting in Scottsdale, I was inspired by the energy and commitment of the members present, in committee meetings, in education sessions, and engagement with each other. We are all part of such a vibrant and important industry! As I said in Scottsdale, I won’t be called Prime Minister, dues will not be payable in Canadian dollars, and you’ll probably never see me again in a tie. But while I am president of this great Association, I pledge to build on the efforts of my predecessor, Pam Petrow, to provide members with real value for their dues and participation, whether

Our NEW Level 1 Online Operator Training course is now available! The completely revised and revamped course is sure to set a new standard for excellence in training in our industry. We could not be more proud of it, nor more thankful for the volunteers who participated in its creation. We have already received great feedback – read all about it on pages 12-13. To get the most value out of your membership, I urge you to get involved with your association in whatever way works for you. But I believe it’s always beneficial to see your fellow members in person and one of our greatest strengths lies in networking. It’s not too early to save the dates for ESX 2018 (June 19-22 in Nashville) and the 2018 Annual Meeting (October 13-17 in Palm Beach). More Milestones for ASAP:
Johnson Controls Goes Live with ASAP; Tennessee is 11th State to Connect The fall of 2017 capped off a year of impressive growth for the ASAP service. In a new milestone, Johnson Controls Building Solutions, North America went live with the city of Richmond, VA on September 18. “We are looking forward to being part of this industry transformation,” said Tony Mucci, Director of Product Management and Engineering for Johnson Controls Building Solutions, North America, “that will enhance the value of our business and our important relationships with emergency responders through the exchange of accurate data, reduction in dispatch time, and achieving awareness of an entire event from start to finish in a way that we have never had before.” ASAP benefits PSAPs by reducing 10-digit phone call volume from alarm companies; reducing 9-1-1 processing time from minutes to seconds; and eliminating errors and miscommunications from voice calls. These benefits translate to improved public safety outcomes. Union County, NC went live on September 21 with Vector Security, Rapid Response, Affiliated, and Vivint. Union County is the 28th agency in the U.S and 8th PSAP in North Carolina to join the ASAP program. On October 10, Loudoun County became the 29th PSAP in the U.S. and the second in the Washington, DC area to go live with the ASAP service. “This new system will eliminate call volume from alarm companies and transmit alarm information to our emergency communications center in three seconds, ultimately reducing the response times of first responders,” said Loudoun County Sheriff Mike Chapman. “In any emergency, response time and accuracy is critical,” said Chief Keith Brower with Loudoun County Fire and Rescue. “By directly transmitting the information all pertinent information goes directly to Loudoun’s first responders within seconds,” added Chief Keith Brower, Loudoun Fire and Rescue. Loudoun County went live with Vector Security, followed by Affiliated Monitoring, Rapid Response, rotection One, Guardian, Vivint, Monitronics, and ADT. And on November 1, Hamilton County/Chattanooga, TN became the 30th PSAP in the U.S. and the first in Tennessee to implement the ASAP service. Tennessee is the 11th state plus the District of Columbia now open for ASAP traffic. Nashville-based ADS Security was the first alarm monitoring company to go live with Hamilton County. “The district is very appreciative of ADS Security’s support and work in helping us bring this new technology to our citizens,” said John Stuermer, executive director for Hamilton County Emergency Communications District. “ADS demonstrated great leadership and commitment to providing the highest level of alarm service response to their customers. Additional alarm companies following ADS were Vector Security, Rapid Response, Vivint, Protection One, Monitrocis, Guardian Protection, Affiliated, and ADT. AICC REPORT
AICC Ghosts Among Us By Louis T. Fiore I recently read Ron Spiller’s article in the September 2017 edition of the CAA Mirror entitled “Ghosts Among Us” and was struck by it. In his usual eloquent, articulate writing style, Ron gives us a good view of the iconic people that were (and still are in spirit) with us. They were prominent in California and in the industry at large. Ron’s article inspired me to write a similar article regarding AICC. So, I asked him if I could borrow his theme. While it is not up to me to write such a tribute for TMA, SIA or ESA, I thought it appropriate, with Ron’s permission, to conjure up the ghosts that were so instrumental on the communications side of our industry and, therefore, AICC. Of course, I can only cover a few of these pioneers. I hope I do not offend anyone I miss in the process. While my list could be longer, some are still with us and I do not want to greatly exaggerate anyone’s death, to paraphrase Mark Twain. Where to start? Some of you may remember a presentation I made at a CSAA Annual Meeting in Rome some years ago. There I spoke of the influence of Samuel Morse, On September 7, the Alarm Industry Communications Committee hosted its fall meeting in Washington, DC and welcomed Rep. Greg Walden (R-OR), chairman of the Energy and Commerce Committee’s Subcommittee on Communications and Technology, who addressed the AICC members primarily on the issue of Net Neutrality. AICC members noted that they are participating in the comments process. Walden said his committee is “fully committed to finding a legislative solution that takes care of bad behavior but does not suppress innovation.” He noted that reauthorizing the FCC as an agency needs to happen before the Telecoms Act can be addressed. AICC members were able to ask questions and put forward their concerns as an industry of small businesses.

Guillermo Marconi, Alexander Graham Bell, Reginald Fessenden, William Shockley and many others who began what might be considered a technology revolution. Surely all these spirits pervade our every endeavor. But, for the alarm industry, the beginning for me was that George Smith Jr., who saw the need to use radio as a tool in our business. Working with Jeremiah Courtney, whose law firm later became Blooston and Mordkofsky, he petitioned the FCC and we were granted our current allocation at 460 to 470 MHz. While these channels were at first reserved for voice as primary, soon they asked for additional channels for the data transmission of alarm signals. They lobbied for and were granted an exclusive block of channels at 900 MHz. These were the so-called Multiple Address Channels. Back then this new allocation was way ahead of its time. Equipment was too expensive, so they were never used except for some test systems by ADT. These channels were soon gobbled up by others when the alarm industry lost its exclusivity. George and Jeremiah, in their gentlemanly styles, are making sure our use of wireless prevails. George was my mentor in my days of creating a wireless system for alarm transmission – “long range radio,” as we called it back then. As a newbie at ADT in the early 1970’s, I can remember our Vice President of Engineering, Tony Grosso, recounting the discussions from what was the forerunner of AICC. I was certainly impressed about what was happening. Imagine using radio rather than “Ma Bell’s” phone lines to transmit alarms! Is he at the AICC table chiding me to get our final independence from wire? Stan Lott was among the first to use wireless as a medium to transmit alarm signals. He watches over our frequency coordination effort as the first volunteer coordinator to have that position. Tom Smith later took over the reins of AICC. It was under his leadership that the offset frequencies at our 460 MHz allocation were devoted to data and the somewhat restrictive regulations on them were greatly reduced, making wireless easier to use. Jerry O’Brian, our next AICC chair, was a true visionary in that he saw the use of digital radio long before it took hold. Do Jerry and Tom both sit silently and observe at every AICC meeting? Later came John Pate, Steve Nelson of Honeywell, both of whom who served with me on NFPA 72 and were instrumental in making DACT a leading technology. TMA Releases New Operator Training Course, Sets a New Standard for Industry Training
M
onitoring center operators are the critical link between alarm notifications and first responder dispatch. Their performance level is crucial to positive outcomes. On November 10, The Monitoring Association released its all-new training course for monitoring center operators, created to address the challenges of 21st century monitoring. “We are pleased and proud to launch our new ‘Level 1’ training course,” said TMA President Ivan Spector. “Education has long been one of TMA’s key values to our members and to the industry at large. It’s written into our mission, to advance the professional monitoring industry through education, advocacy and public safety relationships. This new course has been created by TMA volunteers and staff with vast experience in the industry and in training, and it has been reviewed extensively by our industry vetting partners. We expect it to quickly be recognized as the gold standard in monitoring center operator training.” The new course is a manageable introduction to the industry through an absorbing, inspiring e-learning experience. It features current best practices for online

Rapid Response’s Morgan Hertel Honored with Stanley C. Lott Award Morgan Hertel, vice president of Technology and Innovation for Rapid Response Monitoring Services, Inc. was awarded TMA’s highest honor, the Stanley C. Lott Memorial Award for Exemplary Service, Morgan Hertel addresses TMA members at the 2017 Annual following the presentation of the Lott Meeting. Award. This award was created to honor the memory of Stanley C. Lott, a TMA (CSAA) past president renowned for his above-and-beyond efforts to lead and financially support the Association through difficult times. “As always, the Lott Award was presented to a person who has demonstrated above and beyond commitment to our association and to the industry over a number of years,” said Pamela J. Petrow, then-president of TMA, who presented the award. “Morgan is someone who gives tirelessly of his time through committee work, responding on our digital community board, and in one-to-one consultation, all in an effort to improve our association and to educate others in the industry … including his competitors!” “Morgan is a chair or participant on numerous committees — not only TMA’s, but on SIA, ESA, AICC, PPVAR and UL groups,” Petrow continued. “I would guess that the majority of people present when we announced his name at the Annual Meeting have benefited from Morgan’s knowledge and wisdom, which he shares so generously. I am honored to be the president who presented Morgan with the Lott Award — it is richly deserved.” Hertel has been with Rapid Response since 2012. His work has led to many technological enhancements to the company’s infrastructure and the development of its west coast monitoring center in Corona, CA. He is well known throughout the industry, is a contributor to many industry publications and has served in various capacities in its education programs and in the development of standards. He is the chair of TMA’s Contract Monitoring Council and, in June 2017, was elected to the position of Vice President on the TMA Board of Directors. “This is really an honor and a privilege — not only to receive this award but to be here at the TMA Annual Meet-

ing,” said Hertel. “One of the reasons I do what I do is a personal belief in the importance of giving back. I think many in our industry feel the same way. Sascha Kylau, vice president of sales at OneTel Security, was awarded The Monitoring Association (TMA)’s President’s Award for service to the alarm industry at the 2017 Annual Meeting. “Part of TMA’s mission to provide education to our members that helps them meet today’s industry challenges. This year Sascha’s efforts as co-chair of the Technology Committee and member of the Education Committee have resulted in considerable advances toward that goal,” said Pamela J. Petrow, then-president of TMA, who presented the award. “He helped coordinate technology webinars open to all TMA members, spearheaded the Annual Meeting technology sessions that were a big attraction at our event, and assisted in the review of the Level 1 training course.” Petrow continued, “Sascha is a valued member of the TMA community. As the representative of our associate member Onetel, his enthusiastic participation in the initiatives of TMA make him a real partner and well-deserving of the President’s Award.” Sascha Kylau is the VP of OneTel Security and a frequent speaker and educator at industry events. He started as an engineer for Sur-Gard 20 years ago and has worked in the monitoring industry for his whole career. 3. A Veteran of World War II (in which he served on the Battleship USS South Dakota) and the son of a World War I Veteran, Joe was born May 11, 1927 in Birmingham, Alabama. As founder of Security Alarms and Services, he became recognized and honored for his business acumen, serving as president of then-Central Station Alarm Association as well as the National Burglar and Fire Alarm Association. He was named NBFAA’S “Man of the Year” in 1979. He helped found the National Council of Investigative Services, the Tennessee Burglar and Fire Alarm Association and was active in the International Association of Chiefs of Police. The family requests that remembrance in his name be made to Hope Hospice or Faith Presbyterian Church in Cape Coral, FL.

He was a board member of TMA (then CSAA), national president of CANASA, president of SIA, and the intellectual architect of ALAS (Latin America Security Association). “We have all lost a great friend, champion and defender for our industry,” said TMA past president Ralph Sevinor. “I was fortunate to have had Marc as a true friend and also worked with him while he was president of SIA and I was president of CSAA [now TMA]. TMA NEWS TMA Leadership Changes At the conclusion of the 2017 TMA Annual Meeting in Scottsdale, on October 11, Ivan Spector, president of Montreal-based Sentinel Alarm, became the new president of the association. Pamela J. Petrow, president since 2015, assumed the role of immediate past president. In addition, Don Young, ADT; Morgan Hertel, Rapid Response; and Steve Butkovich, CPI Security, became vice presidents of the association and Alan Gillmore IV, Gillmore Security, became treasurer. The board voted to approve the appointment of Dan Jackman, LDS Monitoring, to the position of Proprietary Council Liaison. Jackman, who has served as co-chair of the Proprietary Council for the past year, fills the position vacated by Phil Hempen due to employment change.

TMA and SSI Team Up to Spotlight Monitoring Center Technology with the “Marvel” Award The Monitoring Association and Security Sales & Integration announced “The Marvel” — the inaugural TMA/SSI Monitoring Technology “Marvel” Award. This new award will honor innovations in monitoring center technology. It will be co-sponsored by TMA and Security Sales & Integration (SSI) and coordinated by the TMA Technology Committee.
The purpose of the Marvel is to provide recognition for monitoring centers creating and/or using cutting-edge technology and to raise awareness of these new technologies. “We are pleased to team up with SSI to spotlight these innovators in our industry,” said TMA Technology Committee Co-Chair Steve Butkovich, who announced the award at the recent 2017 TMA Annual Meeting in Scottsdale, AZ. The Marvel will be presented

2017 Fall Ops Brings Industry Professionals Together TMA’s Fall Operations Management Seminar, “the one industry event for monitoring center personnel presented by monitoring center personnel,” took place November 5-7 in Rosemont, IL. The event’s education program, with the theme “Evolutionary Monitoring,” focused on best practices in monitoring centers, including updates on the latest industry standards, staff management, software and equip-
ment news, and other operational best practices, processes and procedures. Among the sessions offered on November 7 was special preview of the new TMA Level 1 Training Course, officially released November 10 (see page 12). TMA Members Support Hurricane Relief
At the 2017 Annual Meeting, TMA promoted its “Campaign for Harvey Relief” to support the communities affected by Hurricane Harvey and to show solidarity with our ASAP® partner, the Houston Emergency Center. More than $2000 was raised from attendees and donated to the Hurricane Harvey Relief Fund (ghcf. org/hurricane-relief/learn/). This charity was chosen by David Cutler, director of the Houston Emergency Center. The devastation from Hurricane Harvey is being felt across the state by families and businesses who have been impacted in profound and numerous ways. While Houston has shown its typical resolve in getting back to business in the weeks following the hurricane, it will be months, if not years, before the city is back to normal. Brivo’s Van Till Receives Hauhn Award from SIA
On November 15, the Security Industry Association (SIA) presented the Jay Hauhn Excellence in Partnerships Award to Steve Van Till at SIA Honors Night in New York City. The Hauhn Award is given each year to a SIA member who has shown commitment and fostered collaboration between the association and the security industry as well as has advocated for advancements in the industry. Van Till is president and CEO of TMA member Brivo, a SaaS company offering physical access control, video surveillance, and mobile credentials for commercial buildings. TMA. As SIA Standards Committee Chair, Van Till was instrumental in identifying and bringing Open Supervised Device Protocol (OSDP) to SIA. He has served as an effective SIA volunteer liaison to other stakeholders within

Vector’s Amy Simpson Appointed to PA Chiefs of Police Association Alarm Management Committee
Vector Security’s Amy Simpson, District Vice President for the company’s North District, is one of several representa-
tives appointed to the newly-formed Pennsylvania Chiefs of Police Association (PCPA) Alarm Management Committee. The goal of the committee is to reduce false alarm dispatches by researching alarm management issues and making recommendations to PCPA’s Executive Board and general membership for adoption of effective strategies for local agencies. Establishment of the new committee was facilitated by the Security Industry Alarm Coalition (SIAC) working with the PCPA, and the Pennsylvania Electronic Security Association. The committee includes three Pennsylvania police chiefs, a representative from SIAC, and three alarm industry representatives, including Simpson. “This is a wonderful opportunity for the alarm industry to collaborate with Pennsylvania’s police chiefs,” she said. One top priority for the group will be to urge alarm companies to implement electronic call verification (ECV) procedures to be used by monitoring centers prior to requesting law enforcement dispatch on all intrusion signals from customer alarms. Two key projects of focus are an Enhanced Call Confirmation (ECC) procedure and developing a Model Alarm Ordinance. Both are keys to managing alarm systems effectively. Simpson, who has 33 years of experience in the security industry, is District Vice President for Vector Security’s North District, which includes six offices throughout Eastern Pennsylvania, New York and New Jersey.

FCC NPRM re Central Station Channel Restriction In response to an inquiry from the FCC’s staff we are working with AES to develop an acceptable adjacent channel protection protocol. The key is protecting the very low power alarm signaling that will be allowed on both offsets and primaries, in the presence of much higher powered land mobile operations. We will then address these matters with LMCC and will do a supplemental ex parte. The staff indicates that the FCC is looking to issue an order in this proceeding by the end of the year.
Satellite Update Participation in WAC: On October 30, 2017, the World Radiocommunication Conference Advisory Committee (WAC), of which TMA is a member, approved and provided for FCC consideration its draft recommendations on a number of issues that will be considered by the 2019 World Radiocommunication Conference (WRC-19). The draft recommendation for satellite operations in the 460-470 MHz band includes language provided by TMA and LMCC (with TMA’s assistance), pointing out the safety nature of alarm and other terrestrial operations in this band, and supporting power flux density limits to protect such operations. The FCC invited comments on the proposed draft positions by November 10. The comments provided 30 | TMA Dispatch • www.tma.us
by interested parties will assist the FCC in its upcoming consultations with the U.S. Department of State and NTIA in the development of U.S. positions for WRC-19. The recommendations adopted October 30 may evolve in the course of interagency discussions and, therefore, do not constitute a final U.S. Government position on any issue. Geneva: In late October, Lou Fiore attended international meetings in Geneva to advance the drafting process on various proposals, including Resolution 766’s plan to make 460470 MHz available for satellite operations on a primary basis. While there, he helped to address a proposal by the French to modify the inputs to the power flux density calculation, and by Japan to grandfather existing satellite operations in the band. Working Group 5C Efforts: TMA sought to have Working Group 5C, governing terrestrial fixed operations, incorporate into its position paper the technical characteristics of typical alarm radio operations in the 460-470 MHz operations, to enhance recognition for interference protection purposes. Ultimately, NTIA, which is heading up the 5C group, decided that the alarm characteristics were not appropriate to add to its current position paper, and requested a separate recommendation be drafted specific to alarm radios. TMA has provided the initial draft recommendation, which the 5C group will consider this Spring.
Further Rule Change Proposals for FCC’s New Renewal and Discontinuance Rules As reported in the September Wireless Report, the FCC voted on an order in WT Docket 10-112, in which it created unified construction, renewal and discontinuance of operation rules for the various
wireless radio services. The FCC also issued a Further Notice of Proposed Rulemaking in which it will seek comment on a range of additional possible actions to “increase access to wireless communications services” – which includes taking spectrum back from licensees deemed not to making adequate use of their license. It is important to note that the FCC’s action will impact both traditional commercial wireless services and wireless services used by private and public safety entities to meet internal communications needs. The FCC also adopted a further notice in order to seek comment on additional rules which, if adopted, would impose further construction requirements for commercial licensees after the initial license term. Essentially, the FCC is proposing to require commercial licensees, who have already met their build out requirements, to continue to build out their network in increments of at least 10 percent per license renewal term following the initial term. For those licensees that don’t meet this requirement, the FCC is proposing to take back unserved areas and allowing commercial licensees to only keep those areas that are being served. On October 10, BloostonLaw filed comments making the following points: ■■ There is substantial opposition to the imposition of additional, post-renewal build out obligations on licensees that use narrowband spectrum for dispatch and private internal communications. ■■ The record also reflects universal opposition to the outright cancellation of a license that is being used to provide service to the public but falls short on any additional buildout obligations adopted by the Commission. ■■ There is also substantial Winter 2017
REGULATORY UPDATE support in the record that if the Commission proceeds with its proposal that it must be on a prospective basis only.
FCC Notice of Inquiry Regarding 900 MHz Band As reported in September, the FCC has opened a Notice of Inquiry (“NOI”) to examine whether there should be any rule changes in order to increase access to spectrum, improve spectrum efficiency, and expand flexibility in the 896-901/935-940 MHz band (“900 MHz band”) for next generation technologies and services. The 900 MHz band was designated in 1986 for narrow-band private land mobile radio (“PLMR”) communications by Business/Industrial/Land Transportation (“B/ILT”) licensees and Specialized Mobile Radio (“SMR”) providers. In response to concerns raised at the September meeting, we have reviewed the NOI and comments filed in response, which did not reveal any discussion concerning the unlicensed 900 MHz band used by the alarm industry, much less any argument that the unlicensed 900 MHz band should be clawed into the licensed Part 90 900 MHz band as part of this proceeding. Rather, the focus has been what, if anything, the FCC should do with the B/ ILT 900 MHz band.
FirstNet has Competition from Rivada Networks Fierce Wireless and other sources are reporting that Rivada Networks is trying to make things difficult for FirstNet as it prepares for its Oversight Hearing before the House Energy and Commerce Committee. FirstNet is the nationwide public safety broadband network provider, which recently entered into a contract with AT&T to operate the network after Rivada Networks was eliminated from bidding on the contract. Rivada sponsored a discussion Thursday at the Competitive Carriers Association (CCA) meeting in Fort Worth, Texas, featuring Rivada board members (and recent presidential Winter 2017
contenders) Gov. Jeb Bush (R-FL) and Gov. Martin O’Malley (D-MD). During the discussion, Bush stated that “[t] here’s no sunshine, no transparency, no accountability,” and called the process “hidden from congressional oversight”, while O’Malley stated that FirstNet is being “shoved down people’s throats” and is a “pig in a poke.” A spokesman for FirstNet issued the following statement in response to the criticism from Rivada: “It’s unfortunate that some feel the need to resort to name calling instead of having a substantive conversation on the communications needs of our nation’s first responders.” According to the FirstNet website, 27 states and territories out of 56 have elected to opt-in to the federal network being implemented by FirstNet, while none have affirmatively chosen to opt-out. The deadline for states and US territories to Opt out of FirstNet is December 28, 2017. Not only must the Governors’ notices be provided to the FCC, but Opt-out notices must also be filed concurrently with FirstNet and the National Telecommunications and Information Administration (NTIA). In the meantime, Rivada indicates that it is working to team with smaller wireless carriers to create public-safety proposals at the state level that will represent an alternative to the AT&T and FirstNet option. Already Rivada has announced it will partner with U.S. Cellular for such a proposal in New Hampshire. In those proposals, Rivada and its carrier partner would jointly build out coverage for public safety users with 700 MHz spectrum from FirstNet, with Rivada taking the responsibility for meeting a state’s possible coverage requirements. While the alarm industry is focused on forging a relationship with FirstNet and its contractor AT&T, it should obviously stay apprised by the alternative service offerings of Rivada and Verizon, to the extent that it may offer particular alarm service providers with access to a bolstered network suitable for alarm signaling needs. Of course, the question of alarm priority access would have to be addressed.
FCC Imposes $13k Fine for Failure to Narrowband The FCC has imposed a $13,000 fine against Global Paratransit, Inc. (Global) for operating its private land mobile radio (PLMR) station in violation of the FCC’s narrowbanding rules, which required all license operating in the 150-174 MHz and 421-512 MHz band to operate with 12.5 kHz or narrower bandwidth. The narrowband requirement was effective January 1, 2013. Alarm company licensees that have not yet installed narrowband equipment as required should do so expeditiously to avoid a similar fine. The FCC’s field office had received an anonymous tip asserting that Global had not narrowbanded its transmitting equipment, as required by the FCC’s Rules. In response, the FCC inspected the station and confirmed the validity of this tip. In addition to the technical rule violations for failing to (a) narrowband its radio equipment and (b) transmit its station identification, the Commission also found that Global violated the FCC’s Rules by ignoring the Enforcement Bureau’s Notice of Violation. While a violation notice can seem daunting, it is important to note that bad news will not get better with time. It is critically important that alarm company licensees that receive an FCC inquiry contact our office or take other steps to respond, especially if it is an enforcement matter or if it specifies a deadline within which to respond.
Beware of Solicitations to Modify Your License for Narrowbanding Several licensees have received solicitations from Business Radio Licensing and Federal License Management concerning the need to remove wideband emissions. These solicitations make it seem like the licensee is under the focus of the FCC for being out of compliance with the FCC’s narrowbanding requirements. Under the FCC’s narrowbanding policy, a licensee is not obligated to immediately remove the wideband www.tma.us • TMA Dispatch | 31
REGULATORY UPDATE emission designator from its license, if the license already reflects the narrowband emission for the transmitter and (b) the transmitter is being operated in a narrowband configuration. The wideband emission designator does not have to be removed until a request is made for the FCC to take further action on the license (e.g., license renewal, modification, transfer/assignment, etc.). The FCC’s staff has confirmed that if you are operating with compliant narrowband equipment and have added the narrowband designator to the license, you can wait to delete the wideband designator from your license the next time you do a filing for another purpose (such as a renewal application, address change, etc.). This saves the Company the cost and hassle of having to do a separate filing. Pursuant to this understanding with the FCC, we are routinely removing the wideband emission designator from client licenses with each renewal or other filing we do, and we will do the same with any licenses covered by a retainer arrangement with the firm.
Legislative Update New Bills: H.R.3994 – ACCESS BROADBAND Act Introduced 10/06/2017 Latest Action: House - 10/13/2017 Referred to the Subcommittee on Communications and Technology This bill requires the Department of Commerce to establish the Office of Internet Connectivity and Growth within the National Telecommunications and Information Administration. The office shall: ■■ connect with communities that need access to high-speed internet and improved digital inclusion efforts, ■■ hold regional workshops to share best practices and effective strategies for promoting broadband access and adoption, 32 | TMA Dispatch • www.tma.us
develop targeted broadband training and presentations for various demographic communities through media, ■■ develop and distribute publications providing guidance to communities for expanding broadband access and adoption, and ■■ track construction and use of any broadband infrastructure built using federal support. In the event this office is developed, it may be an entity with which the alarm industry will want to interface. ■■
H.R.3895, S.1904 – Smart Cities and Communities Act (Introduced 10/02/2017) Latest Action: House - 10/06/2017 Referred to the Subcommittee on Digital Commerce and Consumer Protection. This bill establishes a council of Federal agencies to coordinate efforts on smart city or community technologies; establishes a regional demonstration grant program for the demonstration of projects focused on advanced smart city or community technologies and systems in a variety of communities; establishes a pilot program to provide to eligible entities, on a competitive basis, grants for technology-based job training and education programs that provide industry-recognized credentials; and develop global smart city or community ‘best practices.’ The alarm industry will be interested to monitor and potentially participate in helping to develop best practices in the smart city/community space. S.1682 – AIRWAVES Act (Introduced 08/01/2017) Latest Action: Senate 08/01/2017 Read twice and referred to the Committee on Commerce, Science, and Transportation. This bill requires the Federal Communications Commission (FCC) to complete auctions during each of the next three calendar years that will grant new broadcast licenses for specified frequency spectrum bands.
The FCC and the National Telecommunications and Information Administration are directed to identify frequencies in specified spectrum bands that may be utilized for: (1) non-federal unlicensed use; and (2) commercial licensed use. Spectrum identified for these auctions may include unlicensed spectrum that may impact alarm operations. The FCC is also required to conduct a study on how unlicensed frequency spectrum bands can be utilized for: (1) the provision of healthcare in rural areas, (2) distance learning, and (3) facilitating innovations in agriculture. Updated Bills: S.123 - Kari’s Law Act of 2017 Latest Action 08/04/2017 Held at the desk in House. This bill amends the Communications Act of 1934 to require multiline telephone systems to have a default configuration that allows users to directly initiate a call to 9-1-1 (without dialing any additional digit, code, prefix, or post-fix, including any trunk-access code such as the digit “9”) from any station equipped with dialing facilities. Businesses installing such systems must configure the systems to provide a notification to a central location at the facility where the system is installed when a person at the facility initiates a call to 9-1-1 using the system, provided that the system is able to be so configured without an improvement to the hardware. The alarm industry will want to ensure that, if this legislation is enacted, any configuration changes made to comply do not interfere with existing arrangements between central stations and PSAPs. S. 134 - Spoofing Prevention Act of 2017 Introduced 01/12/2017 Latest Action: 08/04/2017 Held at the desk in House. This bill expands the prohibition on misleading or inaccurate caller identification information to include any voice service or text messaging Winter 2017
REGULATORY UPDATE service, the definitions of which are slightly broader than in the current rules, and capture recent advances in technology (primarily VoIP). Some AICC members have expressed interest in an FCC proceeding regarding spoofing in 911 and other emergency apps. This legislation does not cover such spoofing, and the alarm industry may consider addressing the issue here. S.19 – MOBILE NOW Act Introduced 01/03/2017 Latest Action: 08/04/2017 Held at the desk in House. This bill requires the National Telecommunications and Information Administration (NTIA) and the Federal Communications Commission (FCC), by December 31, 2020, to make available at least 255 megahertz of federal and nonfederal spectrum below the frequency of 6000 megahertz for mobile and fixed wireless broadband use. At least: (1) 100 megahertz shall be made available on an unlicensed basis; and (2) 100 megahertz shall be made available on an exclusive, licensed basis for commercial mobile use, pursuant to the FCC’s authority to implement licensing in a flexible manner, and subject to potential continued use of such spectrum by incumbent federal entities in designated geographic areas indefinitely or for a length of time stipulated in transition plans approved by an NTIA technical panel for those incumbent entities to relocate to alternate spectrum. S.88 – DIGIT Act Introduced 01/11/2017 Latest Action: 08/11/2017 Referred to the House Subcommittee on Communications and Technology. The Department of Commerce must convene a working group of federal stakeholders to provide recommendations and a report to Congress regarding the IoT. The bill establishes a steering committee to be composed of stakeholders outside the federal government to advise the working group. The working group must: (1) Winter 2017
identify federal laws and regulations, grant practices, budgetary or jurisdictional challenges, and other sector-specific policies that inhibit IoT development; (2) consider policies or programs that encourage and improve coordination among federal agencies with IoT jurisdiction; (3) implement recommendations from the steering committee; (4) examine how federal agencies can benefit from, use, prepare for, and secure the IoT; and (5) consult with nongovernmental stakeholders. S.102 – Securing Access to Networks in Disasters Act Introduced 01/11/2017 Latest Action: House 09/12/2017 Held at the desk. This bill expresses the sense of Congress that the voluntary policies outlined in the Wireless Network Resiliency Cooperative Framework should be adhered to by all parties to aid consumers, 9-1-1 professionals, first responders, and local governments in accessing communication services during times of emergency. The framework is a voluntary initiative announced by wireless providers and the CTIA after receiving recommendations from government-private sector partnerships including the Federal Communications Commission’s (FCC’s) Communications Security, Reliability and Interoperability Council and the CTIA’s Business Continuity and Disaster Recovery Certification Program. The bill requires the FCC to publish a study on the public safety benefits, technical feasibility, and cost of providing the public with emergency access to 9-1-1 services, when mobile service is unavailable during certain presidentially declared emergencies or major disasters or during gubernatorially-declared emergencies, through: ■■ telecommunications service provider-owned WiFi access points and other communications technologies operating on unlicensed spectrum, without requiring any login credentials;
non-telecommunications service provider-owned WiFi access points; and ■■ other alternative means. The Robert T. Stafford Disaster Relief and Emergency Assistance Act is amended to expand the categories of essential communications service providers that may access a disaster site to restore and repair essential services in an emergency or major disaster without being denied or impeded by a federal agency. Services to be considered essential are wireline or mobile telephone service, Internet access service, radio or television broadcasting, cable service, or direct broadcast satellite service. ■■
S. _____ - Next Generation 9-1-1 Act Introduced 11/1/2017 This bill: ■■ Implements an Office under NTIA focused on organizing and coordinating the development and deployment of NG911 services at all levels; ■■ Creates an advisory board for NG911 interoperability; ■■ Requires an update to the definition of ‘next generation 911 service,’ which must take into consideration internet protocols, support for all forms of emergency communications technologies, seamless interoperability, and supply secure connections; ■■ Commissions a study on the resiliency of public safety answering points. On November 1, U.S. Sens. Bill Nelson and Amy Klobuchar released a draft bill, the “Next Generation 9-1-1 Act of 2017,” to further deployment of “Next Generation” 911 (NG 9-1-1) services upgrade the nation’s 9-1-1 services. Nelson is the ranking member of the Senate Commerce, Science and Transportation Committee, and Klobuchar is a co-chair of the Congressional NextGen 9-1-1 Caucus. The draft also recognizes the need to reserve governance and control to states and localities, and the imperative of cybersecurity. “The text of this bill closely tracks NENA’s recommendations for an NG 9-1-1 legal framework, first filed with the FCC almost five years ago, and we’re grateful to Sens. Nelson and Klobuchar for listening to the voice of our members,” said the National Emergency Number Association (NENA). The alarm industry will obviously want to monitor and support legislation expanding NG911 services, as well as ensure key issues like the sending of unscreened alarms and interoperability are addressed appropriately.

AICC filed reply comments in the FCC’s Open Internet proceeding, in which the FCC is considering the regulatory treatment of broadband internet access services. In its reply comments, AICC stated that its members compete directly with certain large broadband internet access service (BIAS) providers in the provision of security monitoring, installation, and other service. At the same time, these companies are dependent upon the BIAS carriers’ transmission services. Therefore, AICC urged the Commission to maintain regulatory provisions that promote non-discrimination and fair play in the market. To this end, in the event that the FCC reclassifies BIAS as a Title I information service, AICC urged the FCC to maintain its Bright 34 | TMA Dispatch • www.tma.us
Line Rules, which prohibit BIAS providers from blocking or throttling traffic and also prohibit paid prioritization for broadband Internet access service. AICC argued that these protections are necessary because, as the FCC has recognized in the past, communication providers have the ability and incentive to discriminate against alarm companies because of their dependence on the last mile facilities of communication providers. AICC argued that the Bright Line Rules are an effective way of ensuring alarm communications are able to get through, consistent with basic non-discrimination precepts, while fostering a level playing field for all companies in the security monitoring market. AICC also argued that the FCC should maintain Section 275 of the Act, which was adopted as part of the Telecommunications Act of 1996 as a compromise between the alarm industry and the Bell operating companies (BOCs) to protect the alarm industry from discrimination by the former BOCs. Section 275 provided four main protections for the alarm industry: first, it prohibited the BOCs from entering the alarm industry market for five years (which provision has since expired); second, it requires any incumbent local exchange carrier (ILEC) that is engaged in the provision of alarm monitoring services to provide nonaffiliated entities the same network services it provides to its own alarm monitoring operations on nondiscriminatory terms and conditions; third, it prohibits an ILEC from subsidizing its alarm monitoring services from telephone exchange service operations; and fourth , it required the Commission to establish expedited procedures for the receipt and review of complaints regarding Section 275. AICC asked the FCC to adopt an expedited complaint process for complaints alleging blocking, throttling, or other unfair practices by broadband Internet access providers, as well as mobile Internet access providers, as proposed by ADT.
AICC echoed ADT’s assertion that smaller alarm companies could go out of business waiting for their complaints to be heard if there is no expedited process. Finally, AICC urged the FCC to treat fixed and mobile broadband providers the same. The FCC has recognized that mobile broadband is increasingly used by Americans. Further, mobile carriers have entered the security market through mobile devices and are now a significant competitor for security companies. Mobile broadband providers have as much incentive and ability to discriminate against alarm service providers and have the ability to inflict financial harm when network changes made by mobile providers force alarm companies and their customers to replace wireless devices and equipment at great cost. Therefore, competitive safeguards should apply to mobile broadband providers as well as fixed broadband providers. AICC’s efforts in this proceeding continue.
