pring is in the air, and while the new season blossoms and Riverside County progresses towards transitioning to the orange tier, easing some COVID restrictions, there is a reason to celebrate safely. The Spring on the Love Open-Air Charity Festival will take place on April 3 from 2 p.m. through 10 p.m. at the Coachella Valley Horse Rescue (CVHR) in Indio. The charity festival will raise funds for the CVHR, as their primary purpose is to rescue horses from abuse, abandonment, and slaughter. 80 horses have been rehabilitated and have found their forever homes so far. CVHR connects people with rescued horses to help educate and improve the quality of life for children and adults interacting with horses. Programs offer equine-assisted growth and awareness within the community including Scouts of America, veterans, and seniors, as well as contributing to community service hours for student credit. The event will feature live music, providing local musicians a chance to finally play in a safe outdoor environment amid the pandemic. The bands will be performing
in a drive-in concert throughout the day. The lineup includes The Ghost Notes, who pay homage to the Grateful Dead and other bands of that era; The Red Hot Cholo Peppers who bring their unique and exceptional tribute to the Red Hot Chili Peppers; Coachella Valley’s Academy of Music Performance graduates: Singer/songwriter/recording artist, Brayden Davlantes, and the award-winning youth rock band, Pescaterritory. CV Music Award winning band, Lisa Lynn and the Broken Hallelujahs, will also be bringing their brand of “Y’all-ternative” country rock and soul, along with some surprise guests. “It’s been challenging organizing everything, but worth it now that we can see it coming together. We had this event ready to go in October. We called it ‘Harvest the Love’ but COVID numbers began to rise, and we decided to cancel it. We just did not want to risk putting people in harm’s way. Days after we cancelled, that second wave hit, so it was a good call. This time, everything is trending in favor of the event, and it’s a huge relief. The toughest challenge is having so little time to pull it together. We had to wait to pull the trigger, and once we did, it was all handson deck to try and beat the progressive heat of April. It’s been a long hard year. There
were many losses. We are ready to safely connect and celebrate the work of the rescue and hopefully raise a little money while we’re at it,” said Marketing Director of CVHR, Lisa Lynn Morgan. Morgan is co-producing this event on behalf of the rescue with other volunteers, and she is also the front woman of the desert folk-rock band Lisa Lynn and the Broken Hallelujahs. from her job as Marketing and Entertainment Director at Big Rock Golf & Pub. Morgan had worked with the CVHR over the years as entertainment for their fundraisers and decided to invest herself further with all the newfound time she had. Lisa Lynn and her band have had a steady stream of private bookings, with some booked into next year, and currently hold a Wednesday night residency at Casuelas Café in Palm Desert. Morgan is grateful to perform for live audiences again, as the pandemic has not afforded her many opportunities to do so. “It was hard and pretty depressing to be cut off from an active performance schedule. I realized how much the connection with a listening audience fed my soul. It’s not so much about singing or playing an instrument and having people clap. It’s about sharing a story and connecting with them, seeing the joy on their faces, or the tears. Watching them dance, knowing that this simple thing you’re doing is inspiring them, or taking them to a happier, sentimental place. That connection is pretty intense at times. It’s very special. Life just isn’t the same without it,” explained Morgan.
Some non-profit organizations joining the Spring on the Love Open-Air Charity Festival include the Desert Recreation District, Pegasus Riding Academy, Academy of Music Performance, Boy Scouts of America, Street Life Project, and many others. Activities will include horse demonstrations, horse paintings, live music including a drive-in concert, an “Instrument Zoo” sponsored by the Academy of Music Performance, and an all-safe Easter Egg-stravaganza egg hunt
with sanitized egg painting stations. Guests will also get the chance to be introduced to rescue horses, big and small. There will be many other activities for kids and families, as the CVHR maintains COVID safety measures to control traffic, spacing, and surface sanitation. Guests and staff will be required to wear masks. Hand washing and hand sanitizing stations will be available throughout. Spring hats are also encouraged to be worn and will be awarded.
A limited number of pre-sale tickets will be available online at CVHorseRescue.org as well as on the rescue’s social media pages. Space will be limited for safety purposes. Tickets are $25 per person (children under 5 are free). A family pack of 4 will be available for $60. Drive-in concert parking is an additional $10. Kennedy Memorial Foundation has partnered with some of the Valley’s most popular restaurants to safely raise funds for Ophelia Project, their mentoring program supporting teen girls in 19 schools, across 3 valley school districts. Each week, from March 23rd through April 29th, one restaurant will be featured. Each attendee will have a choice of two different seatings at each restaurant. The participating restaurants will offer a specially designed menu with delicious options for Ophelia Project supporters. For those unable to join us at the restaurant, the meal will be available for pick up during the seating time of choice. The mission of Ophelia Project is “Empowering young teens to increase their sense of self-worth and maximize their potential contribution to society”. POLE FITNESS DISCOVERY NOW OPEN IN PALM SPRINGS

ole Fitness Discovery is now open, offering a way to reclaim a healthy lifestyle and explore your inner potential! Although pole fitness is not a new way to exercise, it is fresh to the Coachella Valley, as Pole Fitness Discovery is the only offering like it in the area. “Once students embrace pole fitness, the physical strength often transcends into an amazing inner strength and self confidence that supports people in all areas of their lives,” said Annmarie Lynn, owner of Pole Fitness Discovery, offered at the Hot Yoga Plus Palm Springs studio. Pole fitness combines aerobic and strength training with self-awareness to burn calories quickly, improve flexibility, develop kinesthetic awareness and reduce stress. Pole Fitness Discovery is offering private lessons and specialty parties, such as birthday and bachelorette celebrations, plus special workshops.
Lynn has partnered with Leslie Gerber and Chelsea Carter, additional pole fitness instructors, to launch an 8-week Pole Fitness Discovery Workshop for only 10 people. The workshop will meet on Sundays from 3-5 p.m. Classes will first work to establish a connection and trust among the small group. Beyond pole fitness, sessions will include body expression, chakra awareness, meditation, dance, trapeze yoga, hair and makeup treatments, plus a fashion show. The workshop will culminate with a special graduation event during the 9th week. “We have been working on this dynamic exercise and wellness program during the pandemic, and now that restrictions are lifted, we are excited to get started,” said Lynn. “We have a safe, supportive and fun environment. If you’re looking for something to energize you as we all get back to ‘normal,’

this will be an amazing opportunity!” Lynn is a former gymnast who found lifechanging pain relief after practicing Bikram Yoga for less than three months. Since then, she has dedicated her life to helping others find the same healing through the practice of yoga, Pilates and now pole fitness. Beyond pole fitness instruction, Gerber is also a yoga and spin instructor, sound bath facilitator, and does reiki energy work. Carter has danced most of her life and has been teaching pole fitness for more than 5 years. All three women want to help others open channels for growth, healing and selfcare. Candy & Toy Safety: To prevent choking, avoid hard, round candy; thick or sticky candy; or candy with nuts. Caramel, sour balls and jaw breakers can be dangerous because children’s airways are higher and narrower than an adult’s, creating a choking hazard. Fake grass is not digestible, so keep it away from little children. Be sure that Easter toys and dolls (such as bunnies, chicks etc.) are free of choking hazards. Pieces that can be removed from a doll or toy pose a potential choking danger to small children. If you are in the front yard or in a park, be careful kids do not wonder into the street. Keep an eye on them at all time! Use caution with candy and nuts that some children may be allergic to. Egg Safety: Eggs are a potentially hazardous food, in the same category as meat, poultry, fish, and milk. In other words, they can support the rapid growth of disease-causing bacteria like Salmonella. Before boiling eggs for Easter
decorating/painting, they must be kept refrigerated. Use only clean, unbroken eggs – check when you purchase. Discard dirty or broken eggs. Cool your eggs in cold water or just in the air. Be careful of hot water/scald accidents Egg Hunting: Do not hide eggs in cupboards or drawers with dangerous products. Do not hide eggs in, on or under glass. Do not hide eggs in pre-existing holes in the ground or trees. Do not hide eggs in any plant that have thorns or sharp stiff leaves, look potentially dangerous or poisonous. (Rule of thumb: If you do not know the name of the plant, do not put an egg in it!) Do not hide eggs in any animal’s home, food bowl or play area. Do not hide eggs where pesticides or poisons have recently been sprayed. After hunting – Eggs that show cracks or damage, throw them away. Drive Safe. Easter Sunday is the 4th most dangerous holiday day on the. Put the cell phone away and drive defensively! “If you keep these few simple tips in mind, you should be able to enjoy a fun, problem-free Easter celebration,” says Chief DiGiovanna. aby Island, or Round Island as it is designated on most maps, is a substantial basalt outcropping about 30 feet high at its center and nearly three acres in surface area. It contains a fertile ecosystem of old alder, Sitka spruce and other native species of flora and shellfish visible from U.S. Highway 101 a quarter-mile south of the Willapa National Wildlife Refuge. From the road, it appears to be a postage stamp-
sized spit of land with a few trees. In addition, it is richly imbued with significant cultural history for both the Chinook Tribe and the early pioneers of the Willapa Bay area. ou’ve heard of Aqua Lung and Black Lung, now Dali’s Llama brings you “Dune Lung.” Not so much a condition, it serves as the inscrutable title of their new EP. Desert Rock progenitors Dali’s Llama have been a going concern for nearly 30 years. The nucleus of the band has always been Zach and Erica Huskey. The pair grew up here, got together in high school, experienced life in the big city for a few years before returning to the desert to put down roots, artistic and otherwise. Zach had began playing guitar and making music before puberty hit. In the early ‘80s he cut his teeth in bands like the Sciotics, Cloudy Daze and The Next, the last of which was a Power trio featuring Zach on guitar Dave “Damage” on bass and Tony Brown on drums. Along with Mario Lalli, Herb Lineau and Sean Wheeler, he is an original architect of the Desert Rock sound and scene. Following high school, Erica and Zach relocated to Los Angeles. While she attended college, he began playing in bands like Long, Dead And Gone and My Pain. It was the late ‘80s and clubs that dotted the Sunset Strip adopted a “pay to play” business model. Even so, each group managed to carve out a niche in the L.A. scene. They also returned home often enough to be a part of the clandestine (now legendary) Generator parties organized by Mario Lalli. But Zach quickly burned out being just part of a band. Yearning for autocracy, he began teaching Erica the bass. Following a brief spell living in Orange County, the couple returned to the desert for good in 1993. Recruiting drummer Johnny Moreno, they formed Dali’s Llama. In just under three years, Dali’s Llama recorded three amazing albums, “Pre-Post Now,” “Creative Space” and “Being.” Each album was crisp and compendious, redefining a Punk/Power Pop dynamic that was pithy and punctilious. On “Being” Johnny was out and Ian Dye stepped behind the kit. For the next several years the band would rotate drummers with a ruthless, nearly, Spinal Tapesque efficiency. Zach being Zach, he quickly changed course, adding drummer George Rubacava and Eric Overton on rhythm guitar. Inspired by Free Jazz giant Albert Ayler, he wrote

and recorded the experimental and abstract “Color Of Apples” EP (the hubcap solo remains a highlight), to honor the band’s newly expanded line-up. As their family began to grow, Erica stepped away from her bass duties and Zach shifted focus and formed Primordial Blues, which recorded two albums. Going solo, he released three largely acoustic albums. But by 2005, Dali’s Llama was on the comeback trail, with the additional distaff energy of drummer Robin Crewell and wunderkind guitarist Josh Rowell. Their fifth long-player, “Chordata,” arrived not long after, demonstrating a surprising heaviosity. The next few efforts, “Full On Dunes,” “Sweet Sludge” and “Raw Is Real” leapt headfirst into the murky mire of downtuned gloom. By 2010, the band made a sharp left turn with “Howl Do You Do.” A playful tribute to Garage Rock and Psychobilly, it featured guitarist Joe Dillon, (forever) drummer Craig Brown and production work from Desert Rock renaissance man, Mikael Jacobson. 2012 saw the band slither back to the sludge for their 10th album, “Autumn Woods” and that remained the aural blueprint for “Dying In The Sun” and the “Blossom” EP, which arrived in 2016 and 2017, respectively. There was another paradigm shift with 2019’s “Mercury Sea,” which exhibited a lighter touch even as lyrics seemed to straddle the line between mid-life crises and second childhood. Now Dali’s Llama is back with a four song EP, mystically entitled “Dune Lung.” The opening cut, “Nothing Special,” unfolds slowly, churlish guitars are buttressed by spidery bass lines, lilting banjo notes and a blunted backbeat. Flipping the typical songstructure script, Zach executes a face-melty solo within the first minute. His trademark yowl appears almost two minutes in, as he offers this withering rebuke; “You thought you were special somehow, that you were unique among the rest, but now it’s over, open your eyes, gotta let the truth kill those lies.” Grizzled guitar riffs intertwine on the break, before a slithery guitar solo downshifts into a hypnotic groove. Clocking in at six minutes, it is the EP’s magnum opus. On “Complete Animal,” fuzz-crusted guitars cantilever atop roiling bass, see-saw rhythm guitar and a bludgeoning beat. Although

Zach was named “Most Curmudgeonly Front Man” in the latest CV Weekly poll, here, he displays his softer, squishier side. Lyrics like “I need you, I want you, I wanna see you” seem to pay homage to his bass player (who is, conveniently, the mother of his children) and celebrate “another trip around the sun” together. Guitars squall, snarl and shudder on the break, (what, you were expecting Air Supply?) Zach hasn’t completely let down his guard when he insists “Oh fuck it, I’m an animal, and I’m complete.” Duly noted. “Merricat Blackwood” takes it’s inspiration from Shirley Jackson’s gothic mystery, “We Have Always Lived In The Castle.” Jagged shards of guitar are supplanted by tensile bass and a walloping rhythm. The arrangement is sludgy, swirly and suitably spellbinding. Zach’s
swoony croon is necromantic and urgent as he supplicates the object of his affection/ obsession; “Put down your spells and run with me.” The action accelerates on the break as prickly power chords ride roughshod over wily bass lines and a bulldozer beat. The EP closes ‘S.T.D. (Suits),” Distorto guitars fall in lockstep with slippery bass and a brawny beat. Ever the diplomat, Zach takes aim at a music industry which has been colonized by “P.R. firms, marketing twits and heretics.” In case you missed the point, he quickly doubles down; “Big money and sacred cows, flies swarm on the shit that they push/ Don’t listen man, they’ll stone you to deaf.” (Dude, don’t sugarcoat it, say what you think). On the break, keening guitars shiver and quake over the viscous thickfreakness before powering down with a final drone-y tailspin-y note. Recorded at Bassline studios, the EP was produced by Zach, Jake Sonderman and Mikael Jacobson, who also added some banjo to the opening track. “Dune Lung” offers a taste of what has become the band’s signature sound. With Covid 19 hopefully in the rearview (don’t be a wuss, get your vaccine), Dali’s Llama should get the chance to record a new long-player and book some live shows before 2021 bites the dust.

LOCAL WINE STEWARD MAKES GOOD
T
he Italian publication Gamberro Rosso has recently commented, “In our international travels we have often been posed the same question: “Why is there not one Italian among the Masters of Wine?” With reference to the powerful institute born in London in 1953, the Master of Wine program promotes excellence, sharing and knowledge between the different sectors of the global wine community. In answering the dilemma, some reasons came to mind in different aspects: difficulty of the English language; purely Italian and Eurocentric vision, and/or a wine narrative that’s much more linked to humanistic aspects than to commercial or quantifiable ones: Italians drink with their heart; the Brits with their mind. Despite all these arguments, the publication has always questioned the results with doubts. “All doubts were dispelled on February 26th when the institute announced 10 new Master of Wines. Here they are: James Doidge (UK), Susan Lin (USA), Moritz Nikolaus Lueke (Germany), Sophie Parker-Thomson (New Zealand), Álvaro Ribalta Millán (UK), Tze Sam (UK), Melissa Saunders (USA), Kryss Speegle (USA) and Clare Tooley (USA). And finally, Rick Riozza—for the first time, Italy has its own Master of Wine. The Masters of Wine in the world are now 418, with 32 countries represented. Leading the ranking are the United Kingdom (210), United States (56) mainly Australia (28), France (18), New Zealand (15) and Canada (10).” A Master of Wine is the highest wine designation any person can earn, and to some, the designation is even more distinguished than that of a Master Sommelier. The Wine Group chimes in, "Masters of Wine have passed the most difficult wine industry exams in the world, whereas Master Sommeliers have passed the most difficult beverage service exams in the world. Both are the pinnacle of their respective fields." The Master of Wine study program is targeted at people working in the international wine trade. This can include sommeliers and wine writers, as well as winemakers, wine sellers, and others who make their living in the global wine industry. The key requirements for the program are at least three years’ experience in the wine trade at the time of application. The shortest time one can complete the MW program is three years. This consists of the first year “stage one” followed by the “stage two.” The rigorous MW examination at the “stage two” of the program lasts five days. Three half-days are occupied by the wine tasting examination (called the practical exam). In a timed examination, students must observe and taste 12 wines blind. Students may be asked to answer questions relating to each wine’s origins, vintage, market position and the process of vinification used to make the wine. At the end of stage two, a student would

be required to take the MW exam. This is the theory and practice. After passing stage two, the student would then embark on the third stage of the program. This third stage is writing the research paper (RP). “Having lived in both, Italy and the U.S., Rick Riozza was born and raised in Montalcino. In 2004 he founded Brookshaw & Riozza, a communications, video and photography agency focused on the world of wine. In 2015 he founded a sales and marketing consultancy firm focused on the Asian market, KH Wines. He is both a designer and an excellent communicator, with invaluable international knowledge, including a degree in foreign languages. On a journey that started in 2014, with a lot of work, method and organization, he got to where no other fellow countryman had gone. “Rick Riozza’s final thesis, the one that concluded the long road that leads to the title of MW, was on the precipitation of quercetin, a flavonoid belonging to the flavonol group, and on the organic clarification options in order to prevent this phenomenon from occurring in the bottle, in Brunello di Montalcino especially. “Rick’s immediate comment was, “Historically, the role of the Masters of Wine is certainly not to bend the production of wine to the prevailing taste. On the contrary, it’s to make excellence accessible and understandable to all, featuring and creating added value for them throughout the supply chain. It is essential that a complex country like Italy, from an ampelographic, historical, stylistic point of view, can count on an ambassador who represents it internationally,” Correction! I
t was a watershed moment in my young life, and if I recall it correctly, I had just cut my first upper teeth about a month before. My Mother placed a paper plate on my high chair tray with two pieces of white bread seemingly glued together. It seems we both were giddy with anticipation. As it turns out, the bread was glued together…with creamy peanut butter and Smucker’s Strawberry Preserves. The crust had been lovingly removed with a paring knife, forming the bread slices into a nearly perfect square. I swear that the angels were singing as I took that first bite; my mouth was bathed in sticky peanut butter perfectly contrasted by sweet, juicy strawberries. It was my very first food combination and I don’t even have to tell you how great that glass of ice-cold milk went with the sandwich. Food, like music, has the ability to evoke very powerful memories from the past. Since the sense of taste and smell are conjoined, our experiences with both form very powerful triggers acting as gatekeepers to memories of our formidable years. I urge people to recall those flavors and scents that were part of growing up and to utilize them when describing the flavors in modern day brews. For example, many Belgian beers will have more than a hint of bubble gum while Bavarian Hefeweizens carry strong banana and clove overtones. There will always be a place for an ice-cold beer next to a hot dog at a baseball game, while mowing the lawn, or cooking over the grill in the back yard. These are situational pairings which go back generations and there will always be a place for such traditions. While the type of beer in these scenarios is generally a lager from a mega brewer, this new age of beer can serve to heighten the moment. Replace the ULTRA at the baseball game with a hand-crafted pilsner from a respected brewer and suddenly the hot dog tastes better. Crack open an Anchor Steam with that barbeque and the ribs, along with the corn on the cob enter another dimension of taste. Beer, quite literally, is liquid bread. As a matter of fact, it was a major form of

nutrition even as late as 200 years ago. If you pair a nice hunk of aged cheddar with a German Rauchbier (translation: Smoke Beer), you would swear that you were eating a ham and cheese sandwich. In fact, in many food and beer pairings, the beer may act as a replacement for bread. The actual act of pairing beer with food need not be intimidating, in fact it should be exciting. Beer and food go together like copy & paste or Adam & Eve. There are virtually no rules to memorize and only a couple of guiding principles you need to know. Once you’ve refined your tasting skills (see my last column), it’s time to experiment. Guiding Principle #1: Drink what you like. If you are not a fan of Old Ale or Barleywine, all the Bleu Cheese crumbles in the world aren’t going to make it palatable for you. Start with beers you are most familiar with and then begin to branch outward. It also makes sense to begin with foods you enjoy as well. Guiding Principle #2: Match the intensities of the beer with the food. Should your first course include a Strawberry Salad, pairing with a nice pilsner or even a Saison will work quite nicely because they both resonate with a low intensity. Pair that Salad with a Russian Imperial Stout and suddenly all the subtle flavors of the greens and fruit disappear as the beer runs roughshod over the dish. Guiding Principle #3: The food is the star of the show; the beer is merely a supporting cast member…an accoutrement. The food is the lady and the beer a gentleman, and in polite society, one always introduces the lady first. Thus, you want the food to hit your palate prior to introducing beer into the equation. There it is! Simply put, drink and eat what you like, match the intensity of the food and the beer, and always chew before you drink. In the over 200 beer dinners which I have hosted, I do have one favorite pairing I’d like to tell you about. I worked with the Chef and manager at Rock & Brews in Buena Park and hit them with the crazy idea of not only pairing food and beer, but because of their extensive library of music videos, I wanted to pair food & beer directly with sight & sound in an attempt to engage all of the senses. The
first three courses went well, and then it was on to the finale, Dessert was a beautiful banana split covered in whipped cream, warm drizzled chocolate, and the traditional maraschino cherry. Guests were instructed to eat only banana on the first bite and to thoroughly coat their palate. The beer pairing was Karl Strauss’ Peanut Butter Porter and we all took a sip simultaneously…and at that exact moment the DJ hit the magic button and Elvis appeared on the monitors in all of his glory singing Love Me Tender. The smiles and laughter brought joy to my heart as I watched over 40 people get the connection and they were still buzzing about the quadruple pairing as they headed to the exits later that evening. As we wrap things up this week, I will leave you with one word of caution. Not every pairing will be a home run. Remember my Mom? The woman who so lovingly cut the crust off my first peanut butter & jelly sammy? Fast forward eight years and as I was running out the door to catch the school bus, she stopped me in the dining room to insist

et’s help beautiful Sunshine find a second “second chance” home! This amazing dog has triumphed over the worst of circumstances, but sadly her human now has serious medical problems and can no longer care for his dogs. Rod reports this magnificent German Shepherd brings sunshine into his life every day. Here is her story. In 2014, local dog rescuer Kim Hardee found a 4-month-old German Shepherd puppy wandering the streets of Thousand Palms. She was in horrific medical condition. Kim contacted Rod about fostering the pup. Rod recalls, “I told Kim I was going out of town, but when I set eyes on the puppy it broke my heart. She had almost no hair on her body due to an extreme case of mange, and her skin was covered with oozing sores from this infestation.” “We took the puppy to Country Club Animal Clinic where Dr. Lillian Roberts and her knowledgeable staff became Sunshine’s veterinary term. I cancelled my plans to leave town, and for the next couple months,

I took the dog to Dr. Roberts for observation, medication, and special medicinal shampoo. Eventually the mange was cured. However, I soon noted that Sunshine could not hear well. Dr. Roberts brought in a hearing specialist to evaluate Sunshine, and we learned she has a 90% hearing loss.” Dr. Roberts recalls, “Sunshine had one of the worst cases of Demodectic Mange I’ve ever seen. This condition can be hard to control, and the secondary infections really complicate things. I presume her deafness could be related to a congenital malformation of the ear that we can’t see, but I don’t have any way to know for sure.” No one was surprised when Rod fell in love with Sunshine and adopted her. She appears to still have some residual hearing, jumping to alert and barking as soon as Rod’s truck approaches his driveway. She always responds when he claps his hands to get her attention. Rod tells us more about how he communicates with his dog. “I developed some hand signals to communicate with Sunshine. When she barks thinking an
unknown intruder might be approaching our property, she recognizes a particular hand signal from me letting her know all is okay and she is a ‘good dog’. She is extremely intelligent, and is presently working with a library of about a dozen hand signals. Sunshine would go everyone with me, including when I used to work.” If Sunshine gets a few steps ahead of him, she responds to the hand clapping, stops, and looks for instructions. Dogs with hearing impairments like Sunshine get along better in the world than one might think. Dogs view the world differently than humans, and communicate with their environment in the following order, (1) smelling, (2) seeing, and (3) hearing. In humans this order is reversed. Once a dog loses some hearing, his ability to see and smell becomes more enhanced. Dogs physical senses are far greater than those of humans. Some deaf dogs have learned many dozens of commands through American Sign Language. A hearing impaired dog, or any other animal with a disability, should never be pitied. Dogs don’t dwell on what they don’t have. They live in the moment, joyfully greet each day, and focus on what is happening in their world. Dogs have an extra sense that humans often lack, the ability to read people’s energy and emotions. Sunshine instinctively senses that Rod is not feeling well. Sunshine loves other dogs. She looks to her sister Pit Bull, Magdelina “Maggie” for companionship. (Rod rescued Maggie from a beach in Mexico.) Sunshine cuddles with Rod’s cat, she happily greets the neighborhood children, and she “talks” to the local seniors. Sunshine is in excellent health….active, but with a sense of middle age calmness. She is spayed and vaccinated. I met Sunshine and experienced her wonderful personality and lovely spirit. ARCHEGOS IMPLODES
A
rchegos Capital Management, a family office with more than $10 billion in assets, imploded last week. Using sophisticated derivative contracts, the company held positions that total $50 million through the use of equity derivative contracts. When the underlying equities fell in value, the fund was forced to liquidate tens of billions in stocks to cover margin calls as the underlying investments held in the equity derivatives declined in value quickly. The stock brokerage firms that lent to Archegos are estimated to be exposed to $6 billion in losses. This situation brings up lots of questions. How could Sung Kook ‘Bill’ Hwang have avoided regulatory scrutiny as he drove up the prices of a number of Chinese stocks, ViacomCBS and Discovery without regulatory disclosures? Hwang paid a $44 million fine and was banned from the securities industry in 2012 after being caught at insider trading by Hong Kong and U.S. regulators. Family Offices like Hwang’s do not have to disclose their derivative exposures. Where Hwang held more than a 10% interest in ViacomCBS through these sophisticated products, the firm made no disclosures as required. The core issue here is that there is little oversight of family offices making it easy for firms like Hwang’s to evade regulatory scrutiny when using sophisticated derivative contracts. As a result, Hwang manipulated the prices of ViacomCBS, Tencent Music, Discovery Networks, Baidu and others hurting many other investors in the process.
A Family Office is a private wealth management advisory firm that serves some of the wealthiest investors. Where a family office differs from other investment managers is that they serve the entire needs of an affluent family. Family offices often serve only one family although they can serve many. They differ from Registered Investment Advisors and Investment Brokers in that they are not regulated. The $6 trillion Family Office is essentially unregulated. Derivatives are sophisticated contracts between the buyer and a prime broker like Credit Suisse. The prime broker typically finds another party to offset the underlying contract risk although the prime broker is exposed to the default risk of the counterparties they work with. While these investment banks that write the derivative contracts are heavily regulated, there is really no way for one investment bank to know whether a competitor is writing a similar contract to the same borrower. As most of these contracts have cross-default language, once margin calls start at one firm, a downward spiral on heavily levered funds like Archegos can happen quickly. Margin calls occur when the

value of the underlying collateral supporting the derivative contract falls too low causing the issuing broker to request additional collateral by a specific time or begin liquidating the underlying collateral to protect their firm from the counterparty. It is estimated that Credit Suisse will lose $1-4 billion because of the Archegos blow-up while Nomura Securities is estimated to lose $2 billion, MUFG (Union Bank) $300 million as well as significant losses to Morgan Stanley, UBS, Deutsche Bank, Wells Fargo and Goldman Sachs. As Goldman Sachs liquidated their collateral prior to the other firms, their losses are described as ‘insignificant’. The Financial Stability Oversight Council was scheduled to have its first meeting under the Biden administration on March 30th to discuss hedge fund issues that arose during the pandemic. The council consists of the heads of the U.S. Treasury, Federal Reserve and other governmental agencies. It is expected that Archegos meltdown will be added to a list that includes trading irregularities coming from Reddit users who manipulated the prices of Gamestop, AMC, Tilray and other equities that were heavily shorted by hedge funds. Expect the $6 Trillion Family Trust industry and its 10,000+ Family Offices to face tighter supervision going forward. In a market rampant with speculation, these types of things will happen. The challenge is in properly staffing the SEC to pursue market manipulators. Over the last four years, the budget of the SEC was cut causing staffing

Sung Kook “Bill” Hwang is the son of a Korean pastor who moved to the United States to attend UCLA before getting a graduate degree from the Carnegie-Mellon University. He started his career working for Julian Robertson’s hedge fund Tiger Management before starting Tiger Asian Management and breaking away in 2001. The Tiger Asia was forced to close by US and Hong Kong regulators in 2012 following illegal insider trading with the China Construction Bank and Bank of China. Shortly thereafter, Hwang formed Archegos Capital Management as a Family Office. In scripture, Archegos is a prince or leader serving Jesus Christ. After paying a $44 million fine, Hwang set about rebuilding his credibility with investment brokers. Hwang attributes much of his success following 2012 problems on God and his faith. While few will pity the plight of the investment brokers or Mr. Hwang, other investors who bought any of the stocks that Hwang was manipulating were financially hurt. LEGAL TERMS EXPLAINED AS COVID WINDS DOWN AND TRIALS WIND UP
W
e have all been homebound for most of the last year with COVID, which hopefully will continue to dissipate. According to the Desert Sun on 3/30/21, we may move into the Orange Tier next week. Our courts were closed for a long time and interrupted for most of the year. Some days you are the pigeon and some days you’re the statue. That statue day is coming sooner than later. That should mean more business’s opening and a resumption of jury trials as they were. To understand how trials work, and the terms involved, I have prepared this treatise, which follows a previous article explaining what legal terms mean. If you are ever unfortunate enough to be involved in a legal case here are some of the things that will come up, in all likelihood. I will continue where I left off: Impeachment: This is the process of calling a witness’s testimony into doubt. For example, if the attorney can show that the witness may have fabricated portions of his testimony, the witness is said to be “impeached”. If you are watching the George Floyd trial on TV this week you will see the both sides trying to impeach testimony that is contrary to their case. Interrogatories: A form of discovery consisting of written questions to be answered in writing and under oath. Issue: The disputed point between parties in a lawsuit. Jury: The group of persons selected to hear the evidence in a trial and render a verdict on matters of fact. In a Civil matter it takes 9 jurors

and with a criminal case all jurors have to agree on guilt. Jury instructions: A judge’s directions to the jury before it begins deliberations. Lawsuit: A civil legal action started by a plaintiff against a defendant, based on a complaint that the defendant failed to perform a legal duty which resulted in harm to the plaintiff. Mistrial: An invalid trial that is caused by a fundamental error. When a mistrial is declared, the trial must start again with the selection of a “new” jury. Motion: A request by a litigant, to a judge, for a decision on an issue relating to the case. Motion in Limine: A pretrial motion (thus one a jury can’t hear) requesting the court to prohibit the other side from presenting, or even referring to, evidence on matters said to be so highly prejudicial that no steps taken by the judge can prevent the jury from being unduly influenced. Opinion: A judge’s written explanation of the decision of the court. Oral argument: An opportunity for lawyers to summarize their position before the court and also to answer the judges’ questions. Peremptory challenge: Each side can exclude a certain number of prospective jurors without cause or giving a reason. Plaintiff: A person or business that files a formal complaint with the court. Pleadings: Written statements filed with the court that describes a party’s legal or factual assertions about the case. Pro per: A slang expression sometimes used
to refer to a pro se litigant, in other words, one without a lawyer. Pro se: Representing oneself. Serving as one’s own lawyer…which is always dangerous. Record: A written account of the proceedings in a case, including all pleadings, evidence, and exhibits submitted in the course of the case. Sequester: To separate. Sometimes juries are sequestered from outside influences during their deliberations…such as the News. Service of process: The delivery of a writs or summons to the appropriate party. Settlement: When the parties to a lawsuit resolve their dispute, without having a trial. Statute of limitations: The time within which a lawsuit must be filed or a criminal prosecution begun. Subpoena: A command, issued under a court’s authority, to a witness to appear and give testimony. Subpoena duces tecum: A command to a witness to appear and produce documents. Temporary restraining order: Akin to a preliminary injunction, it is a judge’s shortterm order forbidding certain actions until a full hearing can be conducted, often referred to as a TRO (Temporary Restraining Order). Testimony: Evidence presented orally by witnesses during trials or before grand juries. Tort: A civil, not criminal, wrong. A negligent or intentional injury against a person or property, with the exception of breach of contract. Transcript: A written, word-for-word record of what was said, either in a trial or a hearing. Unlawful detainer action: A lawsuit brought by a landlord against a tenant to evict the tenant
from rental property – usually for nonpayment of rent. Venue: The geographic area in which a court has jurisdiction. A change of venue is a change or transfer of a case from one judicial district to another. Verdict: The decision of a jury trial or by a judge, that determines the guilt or innocence of a criminal defendant, or that determines the final outcome of a civil case. Voir dire: Jury selection process of questioning prospective jurors, to ascertain their qualifications and determine any basis for challenge. Witness: A person called upon by either side in a lawsuit to give testimony before the court or jury. I hope these explanation assist you in understanding the Floyd Trial on TV and others you will watch or read about in the future.
