FISHBONE AT FANTASY SPRINGS RESORT CASINO

August 4 to August 10, 2022

BY TRISHA WITKOWER

F

ishbone is listed as an American rock band, but that description hardly encapsulates the vibe of this unique group that fuses ska, punk, funk, metal, reggae, and soul. They were once aptly described as “one of the most distinctive and eclectic alternative rock bands with sharp social commentary and a sizable cult following.” One of its founding members and Los Angeles native, Angelo Moore, spoke to CV Weekly ahead of their Saturday, August 6 show at Fantasy Spring’s

Rock Yard. Music, Moore tells me, is something he was born into. “Music was always playing in my home, there always some kind of jazz going on, R&B, funk, Motown…That’s what I would hear.” Moore’s father played saxophone and he himself started playing in 1980. His parents put him in band in junior high school and while he wanted to play I the synthesizer and make crazy outer space noises, he settled on the sax (with some nudging from his dad). Later, he spread his

instrument expertise to drums, keys, and guitar. From playing the sax in the band to releasing their first album, Moore tells me the road to success was a steady one, and there wasn’t any immediate ‘aha’ moment. “1984 was when the first record came out. We were playing the club scene around L.A. before the record came out. Columbia (their label) put us more on the map, but we were still a little underground. And then it changed into Sony. We didn’t know the depth of what the record company could have in store

for us. We realized there were racial issues in the music industry - people in high places only want the public to hear certain things - we realized what the record company could have had in store for us, but it was being blocked because of what we chose to put in our music. When you were black, you had certain genres dedicated to people of color – soul, reggae, hip hop. If you wanted to play outside of your lane, you got scrutiny and roadblocks.” Moore’s artistry isn’t limited to music, he also has a collection at a gallery in Jacksonville, Florida (Gallery 725). Avant Presidents and Avant Icons are prints of different icons Moore embellishes with different poetry and phrases and designs. His subjects include the likes of Kennedy, Lincoln, Obama, Billie Holiday, Mel Brooks, Mr. T, Jimi Hendrix, and more. What can Fishbone fans expect this weekend? Moore tells me, “They’re gonna get a full show. We’ve been opening up for George Clinton lately, but that’s just 20 minutes. But this show will be a full Fishbone show. If they don’t know what Fishbone is, it’s all soul-based funk and ska rock reggae and a little bit of jazz sprinkled in there.” Don’t miss Fishbone this Saturday, August 6 at Fantasy Springs Resort Casino as part of their Rock Yard on Steroids lineup. Visit their website for more information: fantasyspringsresort. com/rock-yard.

CONSIDER THIS

A

couple of weeks ago, July 17th to be exact, would have been Kim Shattuck’s 59th birthday. Sadly, she wasn’t here to celebrate herself, she passed away in October 2019, following a two-year battle with ALS (Amyotrophic Lateral Sclerosis). Only family and close friends were aware of her struggle, which was a hereditary condition. Even though she wasn’t here, I celebrated for her. I pulled out my Pandoras’ Stop Pretending” LP and followed up with the first three albums from The Muffs: the self-titled debut, the brilliant sophomore effort, Blonder And Blonder and 1997’s Happy Birthday To Me, I closed out my tribute with their final masterwork, No Holiday, which was released a couple of weeks after she split the scene in October 2019. I was sad at the beginning, but really, it was impossible to remain blue while listening to the boinging and buoyant, endlessly inventive Garage-y Power Pop Punk music. She was with me, I felt, in spirit. Born in 1963, Kim spent her childhood in Orange County before relocating to Los Angeles in her teens. She was immediately drawn to L.A.’s flourishing Punk scene. (Stage) diving headfirst into the action. She quickly became smitten with The Pandoras, the all-girl Garage/Psychedelic band that had begun making a name for themselves. Although Kim played only guitar, when the band was looking for a new bassist in 1985, she bluffed her way in. Learning on the job, she caught on fast, as is evidenced by her contribution to the Pandoras’ melodic Psych masterpiece, Stop Pretending. By 1990, the band moved away from their signature sound, veering into Metal territory. She quit in 1990, following the dismissal of keyboard player, Melanie Vamen. Kim had amassed an arsenal of original songs and joined forces with Melanie, who had recently taken up the guitar. The pair recruited bassist Ronnie Barnett and drummer Criss Crass and voila! The Muffs were born. Following the release of a couple of indie singles, they signed with Warner Brothers Records. Their self-titled debut arrived in 1993. A deft amalgam of jagged Punk and fizzy Pop flavors it was immediately embraced by critics, and the band’s already intensely passionate fan base. Unfortunately, the public at large missed the boat. At the time, Grunge was having its moment in the sun. Pale, flannel-clad boys had concocted a turgid cocktail that blended Black Sabbath sludge and Black Flag aggression. They momentarily cornered the market on adolescent angst. Still, a few musicians were paying attention to The Muffs’ frothy mix of Punk and Power Pop. A year after their debut, new label-mates Green Day enlisted The Muffs’ producer, Rob Cavallo and adopted a poppier sound, achieving commercial lift-off with 1994’s Dookie. Meanwhile, Courtney Love and her band Hole seemed to coopt Kim’s aesthetic sensibility, sui generis vocal style and instinctively hooky melodicism, folding all those elements into their mega-selling sophomore effort, Live Through This. So, The Muffs never graced the cover of Rolling Stone (big whoop), the band put the pedal to the metal and went on to create an indelible body of work. Despite Cris and Melanie’s departure following the first album, The Muffs soldiered on. Initially, local legend Jim Laspesa subbed behind the drum kit, but by the time they were heading into the studio to make their second album, ex-Redd Kross drummer Roy McDonald had joined the fold. Pared down to a trio, they released Blonder And Blonder, a kaleidoscopic blast of fuzz, shag and sunshine, in 1995. A few months later, the band’s profile was raised exponentially when they covered Kim Wilde’s ‘80s anthem, “Kids In America,” for the

THE MUFFS

Clueless soundtrack. Their final record for Warner Brothers, Happy Birthday To Me, arrived in 1997. By the turn of the century, Alert Today, Alive Tomorrow was released via Honest Dan’s Records. 2004’s Really, Really Happy arrived through the auspices of Five Foot Two Records. In the ensuing years, a couple of compilations, Hamburger and Kaboodle surfaced. In between Muffs commitments, Kim made time to play in two other bands, The Coolies and The Beards. In 2013, The Pixies asked Kim to assume bass duties, after Kim Deal had quit the band. Within six months, she was dismissed. Apparently, her ebullient attitude clashed with the band’s tight-assed (ahem, dour) demeanor. Apparently, stage-diving and crowd surfing is frowned upon in serious Punk Rock circles. Oh well. Kim didn’t skip a beat, reconvening Ronnie and Roy in 2014 for The Muffs’ sixth album, Whoop De Doo. (The title was apparently inspired by her Pixies experience). Not only was the album critically acclaimed, it also reached #32 on Billboard’s Heatseeker chart. The band toured on and off until Kim’s ALS diagnosis. Their final album, No Holiday, was recorded piecemeal, over an 18-month period, scheduled around Kim’s health issues. Still, it sounded cohesive throughout. Released a couple of weeks after she died, it served as a sweet parting gift. A fitting (albeit unwitting) elegy. The rough edges remained, along with her wicked sense of humor and keen melodic sensibility. The cool kids at Omnivore Recordings have been re-releasing expanded versions of Muffs music since about 2015. The latest in this lovingly curated series is their stellar fifth effort, Really Really Happy. The album originally arrived in 2004, via Charlotte Caffey and Anna Waronker’s Five Foot Two Records. As usual the Omnivore crew have added a surfeit of bonus tracks and demos. The record kicks into gear with three blistering cuts that blast out of the speakers with a supersonic crunch. On “Freak Out,” downstroke riff-age is quickly supplanted as Ronnie and Roy crash the party with knotty bass lines and a walloping backbeat. Kim’s trademark growly vocals are out in front, and she wastes no time letting someone know she has, um, feelings, that are beyond her control; “I don’t care what you think of me, go to hell, I’m wanting you to know I tell the truth, but something inside me freaks out anytime I think of you, anytime and I think I’m going to die.” The song closes with a ringing guitar chord that echoes the exuberant opening note of the Beatles’ “Hard Day’s Night.” “A Little Luxury” explodes with a propulsive drum salvo before settling into a mid-tempo groove. Beneath the bravado, Kim allows a little vulnerability to peek out between thrashy guitar riffs and tensile bass lines, as she reveals; “I need a little luxury, put your arms around me and I’ll feel better naturally.” Stacked, Girl-Group harmonies shadow her scratchy voice on the bridge before she unleashes a spiky guitar solo. Across a teeter-totter arrangement, Kim uses the title track to offer up a declaration of independence. Jaggy guitars partner with slingshot bass and a pummeling rhythm as the opening verse finds her mid-conversation; “And I don’t care what anyone thinks about me, I’m not afraid of what you say or do, it doesn’t hurt me, I’m telling you.” Despite her deadpan delivery, the chorus works hard to convince us that she’s casual and carefree; “I’m really, really glad and really, really, really happy and I’m feeling good, I’m really, really glad and really, really, really happy and I’m feeling good, I’m feeling free and nothing’s bothering me.” A swivel-hipped guitar solo oscillates on the break, as tandem drums and bass walk a tightrope across

BY ELENI P. AUSTIN

the taut melody. Right from the jump, The Muffs exhibited a Punky melodicism that completely outstripped peers like Green Day and Hole. By the time of this, their fifth album, they had perfected that Power Pop/Punk paradigm. Every track on this record truly swings, but several stand out from the pack. Take “Everybody Loves You,” a Fuzz-crusted, Bubblegum-cruncher, powered phased guitars, agile bass and a tick-tock beat. Brittle lyrics confront a recent ex, while attempting to maintain a measure of equilibrium; “On the way out I could see ugly little me, and I’ll say that I’m crushed as crush could be, you messed me up you see.” Woohoo harmonies add to the angst but the heartache is nearly camouflaged by the buoyant melody. “My Lucky Day” puts the power back in Power Trio. Search-and-destroy bass lines connect with stripped-down guitars and a brawny backbeat. Kim’s gritty vocals pogo through the jittery arrangement as she puts another erstwhile swain in his place slyly confiding; “Run away to a place that I love where I hide away from you and your old face, telling me that you know me better then I even know my mixed-up self, I’m laughing, you and your old fantasy of me, every time I think of you, I think my lucky day is when I left and went away.” Taunting “oooh-oooh-oooh-oooh” harmonies and an effervescent handclap beat on the chorus are simply irresistible. A spooky organ outro and slashing guitars underscore her disdain. The diffidence has returned for “How I Pass The Time.” Serrated guitar chords are matched by rubbery bass and a jackrabbit beat on this midtempo groover. Although the lyrics wax dispassion, Kim’s vocal gymnastics betray a morbid fascination and a naked bid for attention; “I’m laying here in my own bile, I’m gonna be here for a while, yeah this is how I pass the time.” A prickly guitar solo is sprinkled with pixie dust, and cushioned by patient piano chords. Meanwhile, there’s “By Myself” which is a bit of a bash and pop. Whiplash guitar riffs ride roughshod over wily bass and a whipcrack beat. The lyrics map out some stalkerazzi moves as Kim shadows her celebrity crush; “You turn around. I’m around, you’re afraid, and I just want to meet ya….I complete you, but you don’t know it yet, I just want to keep you like you’re my little pet.” She cuts loose with a strafing guitar solo on the break, as drums pound at a furious clip. The track unwinds with a final, defiant note of feedback. Then there’s “Don’t Pick On Me” which shares some musical DNA with Sir Douglas Quintet’s “She’s About A Mover,” The Monkees’ “Star Collector” and Little Willie John’s “Leave My Kitten Alone.” Kim’s pugnacious mien is mirrored by ricocheting guitar riffs, boomerang bass lines and a junky, percussive kick. Bellicose lyrics turn the tables on a verbally abusive ex; “I’m not stupid, no, but rather you are, your big mouth is going too far, but I don’t care who you be, don’t pick on me, don’t pick on me, you’re not the whole wide world you see, don’t

pick on me or I will torture you.” a scabrous, reverbdrenched solo uncoils on the break, magnifying the threat. “I’m Here You’re Not,” simply snap, crackles and pops. A potent combo-platter of angular bass lines, sinewy guitars and a blitzkrieg beat. Here romantic obsession results in a mental health check; “All day, all time I’m following my crooked mind, I know I’m done for looking at the wicked fun, all through my old funny face, I’m in a lonely place, I’m going round the bend.” Finally, “Oh Poor You” opens with a squall of feedback that folds into a fusillade of fractious guitars, nimble bass and a piledriving beat. Here Kim flips the script, crankily consoling an inconsolable beau whose been given the heaveho; “You cry and cry yourself into the ground, what you’re looking for you’ll never find in me, ooh wee, look into yourself and see and you’ll be free.” Chunky power chords muscle their way in between each phrase, amping up her urgent need to ditch this delicate flower. The action slows on a few cuts. “Something Inside” is a jangly delight in ¾ time. The melody and arrangement echoes the Chamber Pop of the Elvis Costello deep cut, “All Grown Up.” Meanwhile, “Fancy Girl” is surprisingly tender. High lonesome harmonica partners with thrumming bass, plangent guitar and a tinker-toy beat. Kim’s vinegary vocals wash over lyrics like “In my own life I’m swimming downstream, I’ll be whatever I want to be.” Then there’s the acoustic chime of “My Awful Dream” wherein Kim offers her take on the battle of the sexes “Boy meet and often they do not agree but they often go ahead and marry, who could be less free.” Other interesting tracks include “The Whole World” which weds barbed guitars to a walloping beat, the adenoidal swoon of “Slow” and the explosive sludge of “And I Go Pow.” Originally, the album closed with the crisp candy-coated crunch of “The Story Of Me.” Here, Kim seems to make peace with her quirks and foibles, confiding “I used to be a happy terror, now I’m happy just to be me.” The end of disc one rounds up six bonus tracks, from the jaunty “My Whore,” the urgent “UhOh,” the sing-song waltz of “Under The Covers In Jammies,” the distorto buzz of “My Imagination,” the brief victory lap of “Just The Beginning” and slightly sloppy declaration of “I Hate Gym.” The true treasure trove can be found on disc two. Originally released as Record Store Day vinyl a few months ago, New Improved Kim Shattuck Demos offers up songs that were fleshed-out by the band for Really, Really Happy. Make no mistake, these 16 cuts are demos in name only. Kim’s arrangements and instrumentation are only slightly rougher than the finished product. Really, Really Happy was produced and engineered by Kim. The trio received some assistance from Kristen Shattuck on vocals, Greg Saunders provided guffaws and chuckles for “Don’t Pick On Me” and Brian Kehew inserted his organ into “My Lucky Day.’ Kim’s husband Kevin Sutherland was on hand, adding claps, hoots and hollers. The ache of losing someone never really goes away. But thanks to Omnivore Recordings, longtime Muffs fans and newer acolytes can continue to (re)discover Kim’s singular style, her caustic wit, her sly sarcasm, her crisp melodies, economical arrangements and of course, her trademark yowl. It’s all here for the asking.

CRAZY, COOL KOREAN HORROR BY ROBIN E. SIMMONS

THE WAILING Writer/director Na Hong-jin’s The Wailing delivers an extraordinary atmosphere of approaching dread in a cleverly, intricately constructed supernatural mystery whose visceral thrills more than justify its length (156 minutes). Na Hong-Jin merges elements of zombies, black magic, ghosts, and possession stories, but somehow manages to synthesizes these traditional horror tropes in unexpected ways, creating a surprisingly moving experience that is at the same time hideously exquisite, heart-breaking and horrifying.

10

This disturbing film is the ultimate supernatural whodunnit. Suffice it to say, the unique and intricate plot will keep you hooked to the end, When was the last time your were astonished, unnerved and entertained in equal measure? It’s hard to say if this film is an action film – it certainly has superb visceral energy -or a religiously tinged psychological thriller. Technically, it’s both Artfully crafted with an interesting use of color and texture that draws the eye into not only the heart of the frame but the unsettling story as well. Na Hong’s crazy, very Korean and very long (156 minutes) film of murder, diabolism and exorcism is best enjoyed without any prior knowledge of what’s in store. That said, the plot centers on the mysterious visit by a Japanese stranger in a quiet country village. The suspicion of the villagers quickly escalates into full-blown hysteria when the townspeople begin killing each other for in bloody, brutal outbursts.

When the investigating officer, a doofus when we meet him, realizes his daughter is falling under the violent spell he consults a shaman for answers and makes things far worse. The ending is not something your will quickly forget. If ever. This lush looking, amazing film was six

years in the making and smashed box office records in South Korea on its debut. Na Jong Jin’s groundbreaking film is a follow-up to his global hits “The Yellow Sea” and “The Chaser.” If Asian horror is something you like, this is the one to add to your home library. What are you watching these days? I wan5 to hear from you. Share your faves – the more obscure the better – with your fellow CVW movie buffs. WELL GO USA. Blu-ray. robin@coachellavalleyweekly.com

THE VINO VOICE

www.coachellavalleyweekly.com

BY RICK RIOZZA

CHEZ COOL CHARDONNAY

C

hardonnay is arguably the most important, loved, divisive, and hated grape in the world. Figure that one out! The wine gods over at Google comment: “Few grape varieties elicit a knee-jerk reaction like Chardonnay. It’s characterized as a heavy, opulent white wine, the antithesis to crisp, easy sippers like Sauvignon Blanc and Pinot Grigio. Fans of Chardonnay’s buttery, vanillaladen flavors can’t get enough, while naysayers adamantly refuse to try the wine at all.” (By the way—I just submitted my resume for a wine god position over at Google.) There was a time when the elite wine enthusiasts sat at the wine bar and demanded an ABC wine—that’s to say, “I’ll have Anything But Chardonnay!” Lately though, we’re finding that same group meekly ordering any chilled wine at any wine bar that’s still in business! Nothing like a world-wide pandemic to get our priorities in order. Okay—we can somewhat cut to the Chardonnay chase by differentiating New World Chard (mostly, California Chard) and French Chard, aka, White Burgundy. Further, with the California stuff, there seems to be a three-tier level of Chardonnay: table quality, artisan quality, and then super-premium fantastic quality. In 2021, Chardonnay was the top selling varietal in the U.S. No news here, it’s been that way for decades. The Chardonnay flavor profile has ebbed and flowed from fruity to oaky, crisp to buttery, back & forth, and up & down. And currently, it’s no longer the pendulum swinging from this decade of oaky buttery to a decade of fresh fruit and acidity. But rather now, it’s—hey! Get out of my way! We’re making our wine this way and that! There’s enough room in California and the rest of the world to keep everyone a happy Chardonnay camper. We’re at the point where the flavor profile is all over the charming Chard map! Personally, one who tastes and enjoys a lot of different wine, Chardonnay is not my first, second, or even third choice. But a great Chard from Burgundy or California is always absolutely delicious. And as I’ve mentioned before—and as most vintners will agree, there is nothing so ethereal and lovely as when catching the waft of aromas coming from a winery that is fermenting Chardonnay. Plan a visit sometime to enjoy the experience. “Chardonnay is the ultimate winemaker’s wine” states a recent Wine Spectator article. “The grapes present a blank canvas on which vintners can apply different techniques and explore varying styles, while also expressing their terroir”. Katie Vogt, winemaker at Pahlmeyer, says, “It seems so simple, but Chardonnay responds so well to any imput and decisions . . .[in the wine making process]. As your friendly neighborhood wine steward at the Palm Springs’ Ralphs, I find it interesting hearing all of the different customers emote on the qualities of their charming Chardonnays. It’s my job to keep everyone happy in the wine aisles; so, I’ll now be divulging three California Chardonnays that I know are very tasty, and, the deal of the day for the quality. By the way—I think you’ll notice that this 2020 vintage especially carries peach, mango, citrus flavors. (All wine reviews in quotes are from the latest comments from Wine Spectator, and, all numbers are current Ralphs prices, both single bottle & Mix n’ Match 6-bottle price.)

2020 MacCrostie Chardonnay Sonoma Coast $26/$18. A year before the pandemic, I met Steve Macrostie at one of David Fraschetti’s wonderful Grand Awards Wine Tasting events at the Ritz-Carlton. Steve told me he lets each vineyard’s grapes dictate what they want to become. With deep Sonoma roots stretching back three decades, MacRostie has trusted partnerships with the region’s finest growers, including more than 30 Chardonnay vineyards. Every Chard customer has appreciated this recommendation. “Peach, apricot and mango notes are pure, intense and extremely juicy on a fleshy, succulent frame, with hints of spice, orange blossom, and dried ginger. 92 points.” 2020 Raymond Chardonnay Napa Valley Reserve Selection $24/$13. For those folks who are still love Butter Town U.S.A., I recommend this one: Buttery toast and butterscotch notes complement the core of peach, citrus, and apple flavors, with accents of spice and dried flowers on a supple frame. 91 points. It’s hard to believe that’s it already been 6 years since we attended The International Chardonnay Symposium which brought top global Chardonnay producers to the classic California beach towns of Pismo Beach, Avila Beach and the near-by Edna Valley wine country for an in-depth exploration of the world’s favorite grape and its impact on viticulture, wine makers and the market. At the Symposium, we came to realize that few families have more to do with California Chardonnay than Wente—the First Family of Chardonnay. Founded by Carl Wente in Livermore Valley in 1883, Wente Vineyards was one of the first to label “California Chardonnay” in 1936! Over a period of 40 years, second generation winemaker Ernest Wente selected Burgundy vines that showed favorable traits, great soil potential and re-planted them setting the stage for the creation of the world-renowned “Wente Clone” which has been used in most vineyards in the U.S. and is the foundation of some the most famous white wines in the New World. At the event, it was cool to meet and chat with the 5th generation daughters who are currently involve in many of the winery’s operations. The Wente Riva Ranch Chard always sells off the shelves. 2020 Wente Chardonnay Arroyo Seco Riva Ranch Vineyard $22/$15. “Ripe and generous, with mango, peach and lemon curd flavors that come across as polished and supple, showing accents of salted caramel and spice on the finish. 91 points. Cheers!

ocated inside the Spotlight 29 Casino, the Taproom 29 invites you into a circular bar populated with big screen TV’s and an in-house brewer. The menu is varied and what you might expect in a sport bar/microbrewery. There are 29 beers on tap served in frosty mugs lined up on a strip inlaid into the bar surface and is kept at a constant 29⁰ to keep beverages icy cold. Congratulations on a gimmick that makes sense! I sat at the 360⁰ circular bar and chatted with the bartender asking for recommendations from the menu. I ordered the burger and fries. The burger had an excellent beefy flavor and was moist without being greasy. The fries arrived piping hot and perfectly crisped. They recently added an authentic clay pizza oven to diversify and expand their menu. Taproom 29 offers some enticing affordable weekly specials: twin lobster tails for $24.95, Tuesdays from 4:00 – 10:00 p.m., prime rib dinner, $24.95, Wednesdays from 4:00 – 10:00 p.m., and filet and lobster tail, Fridays from 4:00 – 10:00 p.m.

ailey was adopted from a public shelter when she was an 8-weekold adorable puppy. However, 10 months later her 83-yr-old human suffered a serious stroke and could no longer care for her. No one in the family or circle of friends was willing to take 1-yr-old Bailey. The dog’s future became grim as a family friend desperately called private rescue groups, learning most of them are full due to the endless flow of homeless animals. Fortunately, Loving All Animals was able to find a foster home to take this precious pup. Bailey transformed from a despondent dog into a happy pup living with Eva Fischer and her pups. It was a perfect match when Bailey was soon adopted by a young couple

ESTATE PLANNING FOR PETS – BAILEY’S MESSAGE

with another little dog. Bailey is one of the lucky dogs. Sadly, over 500,000 cats and dogs end up in public shelters every year due to the death or incapacity of their humans. Used to being in family homes, many of these animals become despondent or frightened in a kennel setting, and some end up euthanized for a variety of reasons. Some are senior animals who gave many years of love to their families. Now they are older, often with medical problems, and they are passed over for cute puppies and young frisky dogs. The phone often rings at Loving All Animals with a familiar tale, “My mother died, and she left 3 dogs and 2 cats behind. I leave town tomorrow, and my landlord

doesn’t allow pets. Can you take them?” You may tell yourself, “If anything happens to me, my kids will take my dog.” However, when the time comes, your daughter is married to someone allergic to animals and your son has a full house of critters. If you have an agreement with someone to take your pet, check in periodically to see if their situation has changed. Real estate agents will tell you about the tragedy of animals left behind in empty homes, sometimes deceased due to lack of food and water. Last year a distraught groomer telephoned Loving All Animals about a dog apparently abandoned at her salon. Susan Clark at The Pampered Pup salon soon determined the little dog’s senior humans were both in hospice care with life threatening conditions. No family member was available to take this little one. Once again, Loving All Animals arranged for a foster home to take in the 14 year old pup. She required veterinary care, including expensive dental work, in order to become adoptable to a second chance home. Sophia was happily adopted by a local couple. Consider making a donation to www. lovingallanimals.org for their life saving work. Now is the time for you to make a solid plan should you pass away or suddenly be unable to care for your animals. Palm Desert attorney, Henry Casden Esq. advises, “The California probate code allows one to create a trust and put assets there to fund care for the pets they leave behind. Those expenses can include food, veterinary care and grooming. If they care about their domestic animals, including dogs, cats, horses or birds, people should make a plan

Do you want your beloved pet to end up in a public shelter, heartbroken, alone, at risk of catching a contagious disease, and even euthanized? Make a solid agreement with a friend or relative to take custody of your pet and check in periodically to see if their situation has changed. Make sure their housing situation allows for another animal. Consult with an attorney about a pet trust. Whether you are 33 or 83 years old, have a plan in place for the pets you love in case you can no longer care for them. Most people assume they’ll outlive their pets, says Barry Seltzer, a Toronto-based estate lawyer and co-author of Fat Cats & Lucky Dogs: How to Leave (Some of) Your Estate to Your Pet. Death and disability are topics many people refuse to face. The situation prompted Seltzer to pen a modified version of the Bible’s Proverbs 29:18: WHERE THERE IS NO VISION, PETS PERISH. WHERE THERE IS PROCRASTINATION, PETS PERISH. AND WHERE THERE IS NO PLAN IN PLACE, PETS PERISH. Janetmcafee8@gmail.com

DEAD CAT BOUNCE?

J

uly was the best month of the year for stocks as the Dow was up 6.7%, the S&P 500 +9.1% and tech-heavy NASDAQ 100 +12.3%. Dow and S&P 500 results were the best that we have seen since November 2020 while the NASDAQ had its best month since April 2020. For comparison, the Dow was down 6.7% in June, the S&P 500 8.4% and the NASDAQ 8.7%. July’s strong performance was welcomed relief from a year that has posted the worst results since 1970. Following July’s rebound, the Dow is off 9.6% for 2022 with the S&P 500 down 13.3% and the NASDAQ 20.8%. Was the July rally something we can build on or might it have been the proverbial ‘dead cat bounce’? The morbid saying refers to the price action of a stock or market. A dead cat bounce occurs after the market has moved down swiftly. The bounce is usually half of the original loss. At some point, gravity comes back into play and the cat falls back to (and sometimes past) the original low. The market’s move higher coincided with the Fed’s second 0.75% rate increase in three months. At present, the Fed Funds rate is 2.25%-2.50%. According to Chairman Jay Powell, we are 0.50% to 0.75% from the 3% Fed Funds rate that the Federal Reserve Board targets. The implied Fed Funds rate levels as forecasted by the market suggests that we can expect a peak Fed Funds rate in the 3.25%-3.50% area. While the Fed increased rates, interest rates paid in the bond markets fell. The Fed Funds rate went up 0.75% but the yield paid on bonds went down. This seemingly counter-intuitive decline is due to a belief

BY HADDON LIBBY

that the economy is slipping into a recession. Jeffrey Gundlach, founder of DoubleLine and David Kelley, Chief Global Strategist at JP Morgan have stated that they hope that the Fed takes a breather on rate increases at one of the next two meetings. Both are concerned that the Fed could overdo it when increasing rates. Both feel that the economy can handle another 0.50% in rate increases. Anything more could have a more profound impact on demand. Remaining Fed meetings this year are on September 20-21, November 1-2 and December 13-14. What does all of this mean for my 401k or investment account? As it relates to bond returns, we may be nearing peak interest rates over the next 3-6 months. As it relates to equities, we will need a catalyst if we want recent rallies to stick. China returning to a normal operating

DALEGRIBOW ON THELAW

environment would help smooth supply chains. The disruption to global food and fuel supplies caused by the Russian invasion of Ukraine is another challenge hurting global markets. While market concerns over food and fuel have receded with summer crops, it still appears that many countries will struggle this winter as natural gas and grain supplies look insufficient for expected demand. As stock markets typically price to expectations in twelve to eighteen months, we should expect the end of this downward bias toward equities over the next few quarters so long as supply chains begin to normalize. Do not be surprised if the market retests June lows as markets are prone to overreacting to both the upside and downside. At present, companies are revising earnings estimates to reflect slowing sales and higher operating costs

caused by inflation. A strengthening U.S. dollar (up 10% this year) is also causing multinational companies to post lowered results as activity in other countries is converted to U.S. dollars. As an example, currency translation reduced Microsoft’s 2Q results by 3%. Currency translation is another factor that will slow U.S. exports. Once these extraordinary events begin to fade into the past, we should return to a normalized business environment. For now, investors need to be prepared for more volatility and lower valuations. Use the current market recovery as a chance to rebalance your portfolio. Now is a great time to sit down with your investment advisor and assess whether your current mix of investments is the right mix of assets for you at present and for the future. LEGAL REPRESENTATION OF THE INJURED & CRIMINALLY ACCUSED

WHAT IS THE VALUE OF MY CAR ACCIDENT CASE?

Today, all insurance companies use a computer program called Colossus, to determine value. It plugs in the injuries, bills and loss of earnings, and spits out an amount the adjuster can offer. Believe it or not, I have received hundreds of calls asking the question over the phone of what determines the value of a car Accident case. I know it sounds silly, but people who have been in an accident, will call right after the accident and ask that question. One interpretation used by the defense, is that the party is in it for the money only, and not interested in getting medical help or even needing it. I was taught to look at the Liability and Damages and try to compute a ball park figure. For instance, after you are rear ended, I would look at the likelihood of proving Liability … with 90% being the highest. There is a 10% chance of losing the best slam dunk case. Thus, we might have a 90% chance of proving liability, and we then look at damages. What is the percentage (likelihood) that we would be able to settle/get a verdict of X dollars, with 90% being the highest percentage. Then we meld the two together. Common sense would dictate that a lawyer needs to know how bad the injuries

August 4 to August 10, 2022

were, and how long a victim has treated with medical providers. Some medical providers have greater importance than others, and some medical bills are more important than others. For instance $10,000 in Ortho and Neuro treatment bills are worth more than $10k of MRI and XRAYs etc. Many years ago, the insurance company on a soft tissue case, would just multiply the medical bills by 3 or 4 and offer that amount to settle. Then they realized a bill of $5,000 for MRI or X-rays etc. was not worth as much as $5,000 of physical therapy. Because of this program, it is more important than ever before, that you hire a lawyer who focuses on accident cases… to guide you and your medical providers. An accident victim needs a doctor, who specializes in Treating AND Writing a Medical Legal Report. Though it does not seem right, there is a difference between a doctor who says there is a 50% chance of a full recovery, and saying a 50% chance the patient will not make a full recovery. For many years, I lectured to the International College of Surgeons at their annual medical seminar, teaching them How to Write a Medical/Legal Report.

A patient needs a doctor who does not say, “go home and soak in a hot bath and call in a month …and to take aspirins if there is any pain.” When you call in a month, it takes another 2-3 weeks to get a doctor’s appointment. Thus after a few months, there is very little in medical bills. Thus Colossus and the insurance company argue that if the patient was really injured they would have treated on a regular basis. That is why a good lawyer assists clients in finding the right doctor. When a client comes into the office, I explain that a lawyer can no more tell you what your case is worth when s/he meets you, than a doctor can diagnose you without treatment and tests etc. A good PI lawyer will not even attempt to evaluate your case until your treatment has concluded and we know not only what the total amount of the bills are, but also are advised what your med condition had been in the past and what it will be like in the future. Even then it is not a precise formula or process as we have to look at whether our client was partially at fault. You are an individual and your injuries are as unique and as individual as are you. We can only assure you that our office will obtain the maximum amount of settlement possible given the individual facts of your personal situation.

CYBER CORNER

HEY APPLE USERS. . MACS AND IOS DEVICES NEED ANTI-VIRUS APPLICATIONS AND SECURITY UPDATES TOO!

F

or many years, most Mac and iOS users believed that their computers were immune to viruses that attacked other computers and mobile phones. That was true for a while, however, malicious actors are already developing malware that targets Macs and may take control of your computer and steal your personal financial information. Traditional defenses are no longer as effective as they once were due to the changing nature of cyber threats. Antivirus software along with other security measures is your best option. Xprotect, Apple’s antivirus XProtect, Mac’s virus detection program, runs in the background invisibly and is enabled by default. When you open downloaded programs, Apple checks against a list of dangerous software. Apple updates XProtect frequently, and it updates in the background, so you should always be protected. This is identical to having antivirus software from a third-party software developer running on your Mac, with the added benefit of being built into the operating system and so not slowing down your Mac. If you download and open malware-infected files, you may receive an explicit warning that the files may “destroy your computer,” along with a reference to the type of malware. Apple Devices Need Antivirus Software Too While most antivirus specialists believe that Apple’s security software is adequate

yet it is not perfect. XProtect does not detect as many forms of possible malware as third-party antivirus software, and gaps in its harmful program library might endanger users. The program relies primarily on Apple recognizing and classifying malware and viruses, and because Apple isn›t a specialized security firm, it doesn›t keep track of nearly as many threats as third-party companies. According to Malwarebytes, the frequency of significant malware assaults detected on Macs climbed by 61 percent between 2019 and 2020, but less malicious adware rates decreased, indicating that installing dedicated antivirus software is a sensible move.

SAFETY TIPS

TAKE THE PLUNGE FOR SWIMMING POOL SAFETY!

T

hough we are reaching the peak of summer, it seems like it’s been an “endless summer” as it’s been hot for so long. Many people are spending their time in pools to beat the heat. Unfortunately, there is the dangerous side to summer and swimming pools. Drowning incidents are dramatically on the rise locally and nationally. Parents whose children have drowned say the day of the tragedy started out just like any other day. No matter how the drowning happened or where it happened -- pool, spa, or any other body of water -- one thing was the same, the seconds that claimed their child’s life slid by silently, without warning, it happens just like that and can never be brought back. Drowning is preventable! This is a great time for you and your agency to start a Swimming Pool Safety Campaign in your community! Children drown without a sound. Drowning is a quiet event. There is no splashing, no screaming, and no noise at all. What can you do to prevent drowning incidents? Follow the ABC’s of water safety: A = Adult Supervision. Assign an adult Water Watcher to keep their eyes on the water at ALL times. Never swim alone! B = Barriers such as fences, self-closing and self-latching gates, pool motion sensors, window and door alarms. C = Classes. Parents and Caregivers should

take CPR and First Aid, and swimming courses that are available for both children and adults. Visit: poolsafely.gov for more drowning prevention and safety tips. Remember: When paddle boarding, ocean or lake swimming, or surfing make sure you tell someone when your destination, when you are leaving, when you are returning. If you are missing, it gives us a place to start our search & rescue!

Security Updates Apple releases security upgrades for the Mac regularly, yes pesky, but necessary! Because these security updates are distributed as part of a larger macOS update, which frequently requires a reboot of the system during the installation process, some Mac users may be less likely to apply the update immediately, again yes pesky, even if these updates may be set to install automatically. In macOS Ventura, Apple will separate the security update from macOS upgrades and roll them out automatically, allowing the update to take place in the background, without requiring a restart, and users will be unaffected. How to keep your Mac safe from malware Apple takes several measures to keep your Mac safe, but you must cooperate by installing those again pesky updates when they become available, not clicking on suspicious links in emails, not installing Flash, and so on. Here are some things you should do: 1) Keep macOS updated 2) Avoid using public Wi-Fi networks 3) Do not install Flash 4) Keep Java on your Mac up to date 5) Avoid falling victim to scam emails 6) Be wary of Facebook scams What to Look for in Mac Antivirus Software It might be difficult to choose the best antivirus software for your Mac. Here are a few things to keep a look out for:

BY DENNIS SHELLY • Automatic file download scanning • Scans regularly to look for existing viruses or malware • Continuously updated library of threats • Detection of adware • The ability to fix your computer or undo any malware-induced changes As previously said, installing antivirus software on your Mac is not an essential requirement, but extremely recommended. Apple does a fantastic job of staying on top of vulnerabilities and exploits, and patches to macOS that will safeguard your Mac will be pushed out extremely fast via autoupdate. However, Apple does not always reply as quickly as Mac users would like. In such a situation, there are various free and premium antivirus programs available that may provide you with some peace of mind. SWAG FOR THESOUL “It is our soul mission to learn and explore for the purposes of moving onward and upward. Creativity keeps our minds engaged in the learning and the wheels of progress in motion.” Mastering the Game of Life, coauthored by Aimee Mosco, page 31. e are creative beings by nature. We all have the ability to “create” because we are wired that way. What and how we choose to create is up to each one of us. We can choose to take the reins on our manifestations and be engaged in the process or we can choose to disengage and passively let things unfold. When you decide to take charge of your creation process, it is important to understand that the moment that matters most is the one happening right now. Like everyone, you have memories of both good and bad moments that have happened before this now moment but unless you are a time traveler, you cannot change what transpired in the past. You can look forward to what will happen in the future and even plan for it, but how each future moment unfolds greatly depends on what happens now. The now moment represents a unique opportunity for you to exercise your innate creatorship skills with a peak degree of effectiveness. When you focus your attention on the present moment with the aim to exercise your highest degree of creativity, you put yourself fully in charge as the creator of your reality. If you are lamenting what has happened in the past, or worrying about what will happen next, you disconnect from the opportunity to be fully present with your thoughts and exercise your creativity in the moment at hand.

Each new moment is a precious resource. If you are fully present and mindfully infusing each new moment with energies based on conscious thought, you are functioning as an empowered creator and your soul is doing a happy dance. Make no mistake, this practice takes some getting used to because while each of us is a creator by nature, we are also creatures of habit! As you are making the transition to integrate the practice of intentional and empowered creatorship, it is imperative that you make an effort to rectify habits that shut down your creativity. When you find yourself regretting the past, think about what you learned from the associated experiences and how you can apply that knowledge to whatever it is you are creating now. If you are prone to worrying about what will happen next, try visualizing a favorable outcome and using the present moment to generate supportive thoughts that build an energetic foundation for that new outcome to manifest. Remember, you are wired to create, and you will connect with the most powerful creatorship opportunities when you keep yourself in the “now”. FREEWILL ASTROLOGY

WEEK OF AUGUST 4

ARIES (March 21-April 19): Aries poet Ada Limón advises us to notice and love “the music of the world.” She says that praising and giving attention to the good things “are as important and necessary as witnessing and naming and holding the grief and sorrow that comes with being alive.” This is always a crucial principle to keep in mind, but it will be extra essential for you in the coming weeks. Your ability to attract the influences and resources you need most will thrive if you focus on and celebrate the music of the world. PS: I encourage you to sing more than usual, too. TAURUS (April 20-May 20): Here’s my hope for you in the coming months: You will cultivate a specialty for connecting people and situations that need to be affiliated but aren’t yet. You will regard your flair for blending as a gift you offer generously. Can you picture yourself doing that? I think it will be fun and will also benefit you in unexpected ways. So here’s my proposed plan: Conspire to heal fragmentation and schisms. Unite heavenly and earthly things. Keep the far side and the near side in touch with each other. Never let the past forget about the future, and vice versa. One more thing, Taurus: Be gleefully imaginative as you mix and conjoin and combine. GEMINI (May 21-June 20): In a play by Gemini philosopher Jean-Paul Sartre, a character says, “Hell is other people.” What did he mean by that? One interpretation is that our fellow humans always judge us, and their judgments rarely align with who we really are and who we imagine ourselves to be. Here’s my solution for that problem: Choose allies and companions whose views of you match your own. Is that so hard? I suspect it will be easier than usual for you in the coming months, Gemini. Take advantage of life’s natural tendency to connect you with cohorts who appreciate you. Be picky as you avoid the hell of other people. CANCER (June 21-July 22): The people most likely to succeed as entrepreneurs are those with a high degree of analytical intelligence. Right? Well, it’s more complicated than that. Reasoning ability and problem-solving skills are key skills, but not as important as emotional intelligence: the power to understand and manage feelings. I mention this, Cancerian, because the coming months will be a favorable time to advance your ambitions by enhancing and expressing your emotional intelligence. Here’s some reading to foster your powers: 1. tinyurl.com/EmotionSmarts 2. tinyurl.com/SmartFeeler 3. tinyurl.com/WiseFeeler 4. tinyurl.com/BrightFeeler LEO (July 23-Aug. 22): In the coming weeks, Leo, I urge you to always be confident that YOU ARE THE PARTY! Everywhere you go, bring the spirits of fun and revelry. Be educationally entertaining and entertainingly educational. Amuse yourself by making life more interesting for everyone. At the same time, be kind and humble, never arrogant or insensitive. A vital part of your assignment is to nourish and inspire others with your radiance and charm. That formula will ensure you get everything you need. I foresee bounty flowing your way! PS: Regularly reward your admirers and followers with your magnanimous Chesire-cat grin. VIRGO (Aug. 23-Sept. 22): In my Astrological Book of Life, here’s what I have inscribed about Virgos: You may not always find the perfect solution, but you are skilled at finding the best solution available. This will be an especially valuable knack in the coming weeks, both for yourself and others. I trust you will scan for practical but compassionate answers, even if they are partial. And I hope you will address at least some of everyone’s needs, even if no one is completely satisfied. You can be the master of creative compromise that we all need. Thanks in advance for your excellent service! LIBRA (Sept. 23-Oct. 22): Everyone knows that “balance” is a keyword for you Librans. However, there are many interpretations of what balance

entails. Here’s how I define it for you during the coming weeks: 1. an openness to consider several different ways to capitalize on an opportunity, but to ultimately choose just one way; 2. the ability to see and understand all sides of every story, while also knowing that for pragmatism’s sake you must endorse a single version of the story; 3. the capacity to be both constructively critical and supportively sympathetic; 4. the facility to be welcoming and inviting while still maintaining healthy boundaries. SCORPIO (Oct. 23-Nov. 21): “Life is enchanting for me because I have so much control over what I think,” my Scorpio friend Daria told me. “If I decide to flatter myself with comments about how attractive I am, I can do just that. If I would like to imagine a good fairy visiting me while I sleep and giving me a dream of having an orgasm with my lover while we fly over the Serengeti Plains, I can.” I asked her about the times when worries gush forth unbidden from her subconscious mind and disturb her joy. She said, “I simply picture myself shoving those worries in a hole in the ground and blowing them up with an exploding rose.” I bring Daria’s mind-management expertise to your attention, Scorpio, because the coming weeks will be an excellent time for you to raise your mastery over what you think. SAGITTARIUS (Nov. 22-Dec. 21): People might impatiently advise you to relax and settle down. Others might tell you to stop dreaming such big visions and formulating such adventurous plans. Still others might give you the side-eye because they imagine you are having too much fun and brainstorming too wildly and laughing too loudly. If you receive messages like those, give the complainers a copy of this horoscope. It will tell them that YOU WILL NOT COMPLY WITH ANY INHIBITING DIRECTIVES. Your astrologer, me, authorizes you to be as vast and venturesome and enterprising and spontaneous as you dare. In doing so, I am speaking on behalf of the cosmic rhythms. Your plucky audacity has been heavenly ordained. CAPRICORN (Dec. 22-Jan. 19): In accordance with astrological omens, I hereby authorize you to worry, worry, and worry some more. Stew and simmer and ferment as you weigh all the options and mull the correct actions. But when the time is right, end your fretting with crisp decisiveness. Shake off any residual doubt that still clings to you. And then undertake robust action to transform the situation that provoked your righteous brooding. In my astrological opinion, what I have just described is your best plan for success in the coming days. AQUARIUS (Jan. 20-Feb. 18): “I was looking for a love unlike my parents’ love or my sister’s love or the love on a foreign kitchen floor,” writes Rebecca Dinerstein Knight in her novel The Sunlit Night. “I wanted to forgive my mother and father for their misery and find myself a light man who lived buoyantly and to be both his light and his dark.” I offer you her thoughts, Aquarius, in the hope of inspiring you to expand and deepen your ideas about the love you want. The coming weeks will be a favorable time to revise and reinvigorate your definitions of intimacy and togetherness. You will have extra power to see new truths about how best to create maximum synergy and symbiosis. PISCES (Feb. 19-March 20): “Even raw and messy emotions can be understood as a form of light, crackling and bursting with energy,” writes Jungian psychoanalyst Clarissa Pinkola Estés. For example, “We can use the light of rage in a positive way, in order to see into places we cannot usually see.” Likewise, confusion might be a healthy sign that a long-held misunderstanding is dissolving. Disappointment may herald the demise of an unrealistic expectation. So let’s unleash a big cheer for raw and messy emotions, Pisces! I suspect they will soon be your gateway to clarity and renewal. Homework: Ask for something you’ve never had the clarity or chutzpah to ask for until now. CANNABIS CORNER

I

have written previously about synthetic cannabinoids and how dangerous they are during the vape crisis of 2019. Now they are gaining notoriety among chemists, medical researchers, pharmaceutical companies, law enforcement, legal experts, public-health officials, and drug users. Research is revealing more dangerous chemicals that mimic 10 times the effect of THC. There are three types of cannabinoids endogenous or endocannabinoids, which we make ourselves, phytocannabinoids which are from the plant, and finally synthetic cannabinoids, (which do not occur in nature), and are made in a lab. These are novel molecules that are providing good research but unfortunately are adding more volatile damage to street drugs. Is this research, which is investigating novel approaches for specific disease entities, creating a crisis for the non-legalized drugs being produced? I will try to shed some light on that question in this article. THC and JWH-018 Projectcbd.org writes: “The molecule known as JWH-018 (named after its founder John W Hoffman), is a potent synthetic cannabinoid with an affinity for the CB1 receptor five times greater than that of THC – meaning, roughly speaking, that onefifth of the dose elicits a similar effect.” Just like the Wuhan virus escaped from the lab in China, new chemicals produced by chemists are now escaping the lab and being found in street drugs. The Netherlands’ research at Maastricht University attempted to evaluate the JWH-

018 compound’s effects on neurocognitive and psychotomimetic alongside the effects of THC. The new study, published in May 2022 in the journal Frontiers in Psychiatry, indicates that at equivalent subjective intoxication levels THC and JWH-018 are actually not as different as they seem, except in one category, dissociative effects. Dissociative effects were considerably more pronounced for JWH018 than THC. Dissociative effects mean the person has a feeling of being separate from reality. They are different people in different contexts. Some can commit a crime during a dissociative episode. MEPIRAPIM & SPICE Japan in 2013, detected Mepirapim, another synthetic cannabinoid in illegal compounds. It is structurally similar to JWH018, a controlled Schedule 1 substance in the United States. Korea-based authors published a paper in June 2022 in the journal

Pharmaceuticals showing Mepirapim has a high potential to exhibit psychotropic effects and dangerous side effects. It can cause cardiac deaths in subjects that combine it with other drugs. Two individuals created a conundrum when Mepirapim was laced with acetyl fentanyl, an analog of fentanyl. One individual inhaled it and died. The other individual took it intravenously and did not. What does all this mumbo-jumbo mean? It means more studies on synthetic cannabinoids to better understand the negative effects. Just like the dangerous lab leaks from the gain of function research, so can lethal synthetic cannabinoids leak into illegal or quasi-illegal street drugs. A small class of molecules designed expressly to evade legislation passed in China in July 2021 banning synthetic cannabinoids containing one of seven general core new chemicals, called OXIZID cannabinoids. These

BY RUTH HILL R.N. alternative core structures are technically legal – or at least not explicitly illegal. Prohibition creates the market for completely unheard-of drugs that can be talked up as marijuana-like. While media tends to refer to these drugs merely as “fake pot,” there is some important scientific nuance that gets left out of conversations about cannabinoid synthetics. It’s the brass tacks of what is called the “potency problem.” Potency is not the same as efficacy which the media, legislators, and “say no to cannabis promoters” cannot or will not understand. Receptors are not simply off-on switches. They are more like light bulbs on a dimmer switch. A full agonist will crank the receptor to its full level of “brightness” which is not possible with THC. The black-market synthetic cannabinoids are full agonists causing medical emergencies, including adverse cardiovascular events, stroke, and death. While there is voluminous research on all types of cannabinoids there is not equal education about the scientific difference between potency and efficacy. The crisis of illegal consumption of synthetic cannabinoids and death will continue until the FDA stops denying the safety of plant medicine. Tell me what you think.
