Tombstone tussle ROSCOE, Ill. (NY Times) — The original tombstone of Lee Harvey Oswald may not rest here in peace much longer. Not that it has rested anywhere for very long.

In the nearly 50 years since Oswald, the presumed assassin of President John F. Kennedy, was buried in Texas, the grave marker has been stolen from a cemetery, recovered by the police, hidden away for safekeeping, and passed around among distant relatives of the family that bought the home of Oswald’s mother after she died. Now one of those family members is determined to pursue whatever legal action it takes to get it back from its current home, an automotive museum in this rural Illinois town.

The 130-pound slab of history — engraved with Oswald’s name, dates (Oct. 18, 1939 - Nov. 24, 1963) and a cross — now sits encased and on display at the Historic Automotive Attractions museum in Roscoe, a small town 90 miles northwest of Chicago near the Wisconsin border. The museum opened in 2001 showcasing a collection of race cars, but it has since expanded into a quirky montage of history, politics and Hollywood. Its collection of Kennedy memorabilia is set between the limousines of other American presidents and three Batmobiles.

There, among objects that call up political factoids and fictional plotlines, is the black Secret Service Cadillac that drove behind Kennedy’s vehicle when he was shot during a Dallas motorcade in 1963, the Checker taxi Oswald hailed shortly after, a piece of the fence from the grassy knoll and other items that Kennedy at one time held, wore and bled on.

Just across from Oswald’s gravestone, in a room dedicated to his own murder, sits the ambulance that rushed him to a hospital after he was shot while being escorted by the police two days after being arrested in the president’s death. Wayne Lensing, the owner of the museum, considered buying Oswald’s coffin as well, which was exhumed in 1981 and sold at an auction two decades later for $87,468, but he thought it would be too macabre for the collection.

Lensing, 64, spent far less on the tombstone, paying a little shy of $10,000 — he would not reveal the exact amount — which he considered a bargain, to a woman named Holly Ragan, a distant relative of Card’s. The Card family first stumbled upon the gravestone some 30 years ago when an electrician found it in the crawl space under the house of Oswald’s mother, Marguerite Oswald, which the family bought after she died.

Zimmerman faces second-degree murder JACKSONVILLE, Fla. (NY Times) — The Florida special prosecutor announced a second-degree murder charge on Wednesday against George Zimmerman in the shooting death of Trayvon Martin.

Angela B. Corey, the prosecutor, said Mr. Zimmerman, 28, a crime watch volunteer, will appear before a magistrate within the next 24 hours. He is accused of fatally shooting Martin, an unarmed teenager, in a case that has captivated the country and brought to the fore issues of race, violence and precisely what constitutes self-defense.

“We did not come to this decision lightly,” Corey said. She added: “Let me emphasize that we do not prosecute by public pres-

sure or by petition. “ “We will continue to seek the truth about this case,” she said.

Critical to the prosecution will be whether or not the shooting fell under Florida’s “Stand Your Ground” law, which gives wide leeway to people who claim selfdefense, and which does not require people to retreat before using deadly force.

Earlier this week, Corey announced that she had decided not to convene a grand jury to investigate the shooting and would herself make the ultimate decision as to whether to charge Zimmerman.

Zimmerman has been in hiding for the past several weeks after having received

death threats. He has not spoken publicly since the shooting.

On Tuesday, Zimmerman’s lawyers, Craig Sonner and Hal Uhrig, announced that they were withdrawing from his legal team. They said they were worried about Zimmerman’s state of mind, that he had been in contact with Corey without consulting them, and that they had not been in communication with him and did not know where he was.

A statement on a Web site set up by Zimmerman to raise money called the shooting a “life-altering event.”

It is unclear whether Zimmerman has hired a new lawyer.

China seeks to contain fallout from scandal BEIJING (NY Times) — The ruling Communist Party sought to swiftly close ranks on Wednesday, hoping to move beyond a mortifying scandal that has exposed a leadership split and threatens to lay bare corruption in the party’s highest ranks.

A day after removing a once powerful official, Bo Xilai, from the party’s Politburo and naming his wife as the main suspect in the murder of a British businessman, the party’s conduit for official pronouncements, the People’s Daily, published a front-page commentary ordering its members to “consciously unify out thoughts” and rally around the party’s Central Committee and its general

secretary, President Hu Jintao.

Party censors moved at the same time to scrub the Internet of unapproved references to the affair, blocking all mention of Bo family members and related figures as well as the many nicknames and puns that microbloggers have employed to chat about the scandal while evading censorship.

Bo, 62, had won widespread popularity and become a rival to the party’s mainstream leaders with an aggressive effort to create an egalitarian society with hints of neo-Maoism in Chongqing, the city-state where he was party secretary. But he also enriched himself and his family in the

free-wheeling atmosphere of the economic boom, raising questions of corruption, and he backed harsh police crackdowns.

Bo’s hopes of joining the party’s top leadership collapsed on Feb. 6 after Chongqinq’s police chief fled to an American consulate with accusations that Bo’s wife, Gu Kailai, had arranged the murder of the British businessman and Bo family acquaintance, Neil Heywood, accusations backed by a technical police file. The chief, Wang Lijun, also apparently revealed a treasure trove of information about the party’s inner struggles at the highest level to the American diplomats.

Launch was factor before U.S. tightens rules on antibiotics use for livestock U.S. pact with N. Korea (NY Times) — Farmers and ranchers will for the first time be required to get a prescription from a veterinarian before using antibiotics in cattle, pigs, chickens and other animals, federal food regulators announced on Wednesday.

Officials hope the move will slow the indiscriminate use of the drugs, which has made them increasingly ineffective in humans.

The Food and Drug Administration has been taking small steps to try to curb the use of antibiotics on farms, but federal officials said that requiring prescriptions would lead to meaningful reductions in the agricultural use of antibiotics, which are given to promote animal growth.

The drug resistance that has devel-

oped from that practice has been a growing problem for years and has rendered a number of antibiotics used in humans less and less effective, with deadly consequences.

Initially, the F.D.A. is asking drug makers to voluntarily change their labels to require a prescription; federal officials said that drug makers had largely agreed to the change.

Michael Taylor, the agency’s deputy commissioner for food, predicted that the new restrictions would save lives.

“We’re confident that it will result in significant reductions in agricultural antibiotic use and reductions in resistance pressure” from dangerous bacteria, Taylor said. “That’s why we’re doing this.”

HONG KONG (NY Times) — Less than six weeks after North Korea signed an accord with the Obama administration to limit its nuclear activities, the rogue nation is poised to launch a long-range rocket — raising questions about why the North went to the trouble to negotiate in the first place.

Even more ominous than the firing of the ballistic missile equipped with a satellite, is the likelihood of a follow-up nuclear detonation that may well be a test of a new weapon built with highly enriched uranium.

In moving ahead with the launch of the rocket, which according to reports was being readied with fuel Wednesday, North Korea was in many respects behaving as usual: willfully, without regard for United Nations resolutions, and paying no heed to its biggest patron, China. Just as the former leader, Kim Jong-il, flouted the Bush and early Obama administrations, so is the new leader, his son, Kim Jung-un, defying the Obama White House.

North Korea insists that the launch is for the peaceful purpose of sending a satellite into orbit, but almost universally the test is seen as a violation of United Nations Security Council resolutions demanding North Korea refrain from firing rockets using ballistic missile technology.

State of cool WASHINGTON — Hillary is not going to President Obama’s Democratic convention in Charlotte.

Evidently, she’s going to wait for her own.

There were intriguing developments on the presidential trail Tuesday, and I don’t mean Rick Santorum dropping out.

Hillary Clinton cemented her newly cool image and set off fresh chatter about her future when she met at the State Department with two young men who created a popular Internet meme showing photos of the secretary of state on a military plane, wearing big sunglasses, checking her BlackBerry and looking as if she’s ready to ice somebody.

The pictures, as Raymond Chandler would say, make Hillary look “as inconspicuous as a tarantula on a slice of angel food.”

A personal brush with resiliency How resilient are you? It’s a question worth pondering. You can increase your resiliency by learning coping skills, changing your attitude, and sharing stories. This, the message, at Scarborough’s first community resiliency meeting held the other night.

It was a gathering of community members with a variety of experiences who volunteered to be on the committee. The goal is to educate the committee so that they, in turn, can educate the community on ways to be more resilient. The teaching is being done in the sharing of stories.

I hadn’t given much thought to the subject, prior to arriving to the class. But as the stories unfolded, I realized that a lived experience this past week was a testament to resiliency in my family.

On Easter Sunday, I called my parents in Massachusetts. It was to be that early morning holiday call to let them know I was thinking of them; to check in on how their vacation was (they had just returned home from the Bahamas), and see what they were doing for Easter. My parents know that when the phone rings very early in the morning, it’s me.

I’m notorious for waking them up. But they’re okay with that, because, they’ve preached to me that the early bird catches the

I quickly realized that all was not well on the home front. My mom, the optimist, notoriously in denial, was forthright in expressing concern. “Your father is not well,” she said. “What’s wrong?”

I asked. “He has no energy — it’s his congestive heart failure,” she explained. Realizing that they had just gotten back from a trip, and knowing my dad is very slow moving because of his arthritis, I suspected that this was more exhaustion than anything else.

But I tuned in.

“The house is a mess; your sister (and family) are coming for dinner; I’m cooking a roast; I haven’t cooked one in 25 years, and I don’t know what I’m doing.”

I asked: “Mom, is there anything I can do for you right now?”

She started to cry. “Would you like me to come down?” I suggested. “Thank you, dear; don’t do that, though.” I said nothing to

her. But mouthed quietly to my husband: “Change of plans; we’re going to Massachusetts today.” I let my mother continue with the conversation, knowing that when I said my good-bye, I would immediately call my sister (who lives next door to my parents) and let her know we’re coming down to surprise mom and dad.

The hints she needed help were clear. Housecleaning has never been a concern for my mother.

The house has always been a mess; she didn’t care. Cooking is not my mother’s forte; a roast is a major undertaking. I’ve only seen my mother cry at funerals. Her tears suggested more was going on with my father than she was telling me. The little voice inside told me to get to Massachusetts.

Cooking is my husband’s forte, and this would not only provide relief for my mother, but joy for all. It would appear as a thoughtful holiday visit, rather than a checking in, checking up call.

As soon as I got off the phone, I called my sister, and told her that we were packing up and coming down. She reported that my dad had voluntarily called the doctor on Friday. This had never happened before. And that walking just ten feet, my father had to stop and take a rest. It was early, and my sister was just getting up. She see VACHON page 5

Whether or not you think it’s appropriate for the president to comment on pending cases (certainly his Justice Department does a lot more than comment; they advocate, and said much the same thing in their briefs), every member of the Supreme Court has to be aware that a decision striking down the health care law would be a political hot potato in an election year. They don’t need the president to remind them of what happened when the court stood in the way of popular legislation in the 1930s.

Health care reform may not be as popular as the minimum wage and milk regulation, but a decision striking down the law would almost certainly lead to commercials with people suffering from cancer unable to buy health insurance and young people thrown off their parents’ policies — because of the Republican court. If the law goes down, it will go down on strict party lines — because all those appointed by a Republican president voted against it. Sure does look like politics.

Striking down the law would thrust the justices and the court into the political process in a way they haven’t been since Bush v. Gore. And that is one of the reasons I’m still predicting 6-3 to uphold the law.

announced that he was quite sure he would be hospitalized the next day, after his doctor saw him. We all watched him closely. But it was so subtle. It was a family gathering, and celebration. He was relaxed and happy. My mother didn’t have to cook. Dinner came together. We cleaned up, and hit the road back to Maine. All of us agreed. My dad would rebound.

He’s resilient.

The next day, my mother reported that my father felt better, his energy was restored He had been to the doctor, but wasn’t admitted. Nobody thought this was necessary.

Reflecting on the holiday event, and my first resiliency class, I realized how far my family had come.

There was a time in my life, when a change of holi-

day plans at the very last minute, would have sent me into a tail spin. My sister and I would fight. My mother would be in denial. And nobody would admit they needed help. None of this happened last weekend. Our actions, reactions, and thoughts toward the situation had matured. We worked together. There was calm. And there was peace. This is resiliency.

When Mitt Romney texts “Any advice?” to Hillary, she replies: “Drink.” She rejects a “friend” request from Mark Zuckerberg, cuts off Joe Biden when he tries to tell a bar joke, instructs a cooing Ryan Gosling to call her “Madam Secretary,” blows off Jon Stewart by saying she’s already booked on Colbert, and wields a put-down from “The Devil Wears Prada” on Anna Wintour.

When the president asks, “Hey Hil, Whatchu doing?” she ripostes: “Running the world.” And when a young woman texts, “It’s 3 am and I think something’s happening,” Hillary snaps: “On it.”

I asked the dazzling Diana Walker — the Time magazine photographer who took one of the totemic pictures of Hillary on a C-17 flight last fall from Malta to Tripoli for a cover story on “Hillary and the Rise of Smart Power” — what made her black-and-white shot such a sensation.

“I don’t think she was meaning to be cool,” Walker said. “She just reached in her bag to get some glasses to read her BlackBerry before the plane took off for Tripoli.”

Walker told me she got a letter from a young woman, a friend of her son’s, who said she stared at the image for a long time. “It truly sent chills down my spine,” the woman wrote, “and I imme-

diately shared it with my daughter because of the power it portrayed.”

With women under attack, that sense of serene toughness has strong appeal.

The Hillary flurry is telling.

During the 2008 Democratic primary, Barack Obama had a lock on young people, technology chic and the press. Hillary was regarded by kids as the lady who’d been around a long time, wearing headbands and pantsuits. She had a paranoid relationship with the press and an antiquated take on technology.

Now she’s quick to laugh at herself and take advantage of the positive buzz, even posting her own captions with trendy argot on the “Texts From Hillary” site.

As Jonathan Darman, who covered Hillary’s campaign for Newsweek, noted: “The speed with which she’s embraced it suggests something has really changed in her. If this were 2008, the conversation around her would have been: 1) What is Tumblr? 2) What is Facebook? and 3) How do we get them to take down the Tumblr and/or how do we destroy Facebook?”

Hillary has a history of being more popular when she seems less in control. The Monica fiasco made her such a sympathetic figure that she glided into a Senate seat. Losing to Obama

and becoming his hard-working subordinate has, at times, won her higher approval ratings than the president.

So now that she seems ready to leave the stage at 64 and take a deserved nap, she is at her least polarizing.

Her savvy public image gambit on Tuesday sent a signal she may not be leaving the stage forever.

She has not only shored up her techie cred and popularity with young people. Hillary, who kept the press at a distance in 2008, is now well-liked by the press corps traveling with her around the world. Unlike Obama, she seems to enjoy going out with reporters and having a cocktail after a hard day of trilats.

In another sign she’s in vogue, she’s the model for a character, Elaine Barrish Hammond, a defeated presidential contender and divorced former first lady who becomes secretary of state, in a new TV show called “Political Animals” scheduled to air this summer on the USA Network. Hillary will be conjured up by Sigourney Weaver, wearing a ruby-red pantsuit in the first scene and described in the script this way: “Even in the pantsuit she’s breathtaking. Brilliant and indefatigable — Elaine is a force and a beauty. ... she has a regal countenance. If America had a queen, it would be Elaine.”

Cause of fifth fire in Gorham deemed to be not suspicious DAILY SUN STAFF REPORTS GORHAM — Investigators have determined that a fire at a County Road home Wednesday was accidental in nature.

State Police reported that a fifth Gorham fire occurred early yesterday morning on County Road but is not believed to be connected to a series of suspicious fires that have occurred in town. Investigators from the Maine Fire Marshal’s Office responded to the scene in the afternoon.

“After locating and interviewing the homeowner, it was determined today’s fire started in an electrical heater that the homeowner had been working on yesterday. As a result today’s fire is not related to the four Gorham arson investigations that are now underway,” said State Police spokesman Steve McCausland.

In the past two weeks, four other fires have been reported in Gorham.

Two fires were reported in vacant houses, one was in a function hall and the most recent was in a garage on Easter Sunday.

Anyone with information regarding the arson fires is asked to contact Gorham Police at 839-5581.

City to begin review of school district budget at meeting tonight Now that the School Board has concluded its review of the proposed district budget, it’s now a chance for the City Council and the public to weigh in.

The city’s Finance Committee will meet tonight to review the proposed school budget for next year and solicit public input about the $94.9 million package.

The meeting starts at 5:30 p.m. in room 2009 at City Hall.

The budget as it was proposed by the superintendent and approved by the School Board reflects a 6.13 percent spending increase — or $4.48 million — over the 2012 budget.

Since the district is projecting a 14.73 percent increase in revenue during the 2013 school year, the amount to be raised through local property taxes is set to increase 3.65 percent. The amount to be raised through taxes is projected at $71.92 million.

Some of the increases in the school budget are related to the priority the district has put on early childhood education, literacy in kindergarten through second grade, elementary world language, high school program, maintenance and technology, according to the district’s budget memo.

The referendum on the school budget is set for May 15.

No confidence vote for Botman at USM likely to occur at end of April A faculty-wide referendum vote of “no confidence” in University of Southern Maine President Selma Botman is expected to happen between April 24 and April 30, based on a faculty panel’s recent review of a petition for the referendum.

On Friday, the USM Faculty Senate took up the petition seeking a vote of all full-time faculty.

The USM Faculty Senate announced formally that members had received the petition and that the number of signatures met the required threshold, according to Bob Caswell, executive director of public affairs for USM. Next will come the specific scheduling of the vote and details of how the vote will be conducted, he said.

The petition was circulated among full professors, the highest faculty rank at USM and was signed by 53 of them, said Jerry LaSala, professor of physics.

“It’s about what we perceive as a serious lack of leadership at the university,” LaSala said in a recent interview.

“This represents a majority of the full professors and 15 percent of the entire faculty,” LaSala explained in a press release. “Signatories include former provosts, former deans, former presidents of the USM chapter of the Associated Faculties of the Universities of Maine (the faculty union) and former chairs of the Faculty Senate.”

LaSala said that those who signed the petition “feel that USM is in a crisis mode; morale is low, anxiety is high, and confidence in the current administration to lead and promote USM with integrity and competence is fragile and weak among all segments of the university community.”

Botman, who was hired in 2008 as the university’s 10th president, met with groups of faculty last week in response to the petition.

The senate is required by its bylaws to turn the petition over to the faculty for a full referendum, said LaSala, a Faculty Senate executive committee member. Based on Faculty Senate rules, members must wait 20 days before voting. Passage requires two thirds approval. If approved, it will then be forwarded to the chancellor and the University of Maine System Board of Trustees, which would decide whether to act on it.

Two arrested as part of South Portland PD probe of auto burglaries Jason Fudge, 38, of South Portland, and Lauren Burns, 20, of Portland, were arrested Tuesday for theft and theft from a motor vehicle, as part of an investigation of a rash of motor vehicle burglaries, the South Portland Police Department reported.

Shortly after 1 p.m. Tuesday, one of victims of car breaks reported seeing a person carrying a uniquely marked backpack that had been stolen from him, police said. The backpack was being carried by a person getting onto a bus in the area of Cash Corner.

Officers stopped the bus on Broadway, near Evans Street and, after a roadside investigation, arrested Fudge and Burns. Fudge was also charged with violation of bail conditions.

This case is being referred to the District Attorney’s Office for prosecution, but the investigation is continuing. Based on evidence recovered around the time of the arrest, additional charges are anticipated, police said.

South Portland police have received about 51 reports of thefts from motor vehicles year to date, with 11 of those being filed Tuesday and 26 of them being filed since April 1, police said. There were 48 similar carburglary reports filed with the department during the same time period last year, police said.

Portland-based seafood company planning $1 million in upgrades Portland’s Bristol Seafoods announced yesterday the company plans to spend more than $1 million to upgrade its plant.

During the next two and a half years, Bristol Seafoods will invest in upgrades to its facility at the Portland Fish Pier, according to a press release. The company plans to modernize the production line, upgrade defrosting and grading systems and invest in “green” technology.

“This is our investment in the future of our business, our community and the planet,” said Ray Swenton, Bristol Seafood’s chairman and CEO, in a statement. “These new improvements and processing technologies will provide a better product to our customers and are in keeping with our commitment to responsible sourcing and quality assured production practices.”

Bristol Seafoods began operating in Portland in 1992.

Titanic disaster marked by event The Titanic Centennial Remembrance Committee will hold a commemorative service, dinner and presentation to mark the 100th anniversary of the sinking of the RMS Titanic in 1912. The event — one of several marking the anniversary (see page 14) — is on Saturday at 5:30 p.m., at the Maine Irish Heritage Center, 34 Gray St., in Portland. April 14th marks the day the ship hit an iceberg in the North Atlantic before sinking the following morning.

The event will begin with a memorial service following the Order of Evening Prayer used aboard the ship in 1912. The short service will be followed by a dinner in the center’s banquet hall based on the third class menu of the White Star Line. The highlight of the evening will be a presentation by David Brennan, Police Chaplain, whose grandmother and great uncle were on the ship on its last voyage.

There will also be a talk about the building of the ship and the maritime perspective by one of the Port of Portland’s Maritime Chaplains and maritime historian, the Rev. Capt. Jeffrey Monroe, USMM, who will also lead the memorial service. Noted organist, Tracy Gardener, music director at St. Margaret’s Church in Conway, N.H. will provide music for the service. Proceeds from the event will benefit the Maine Irish Heritage Center and the St. Augustine’s Church Community Assistance Fund.

In Massachusetts Senate race, testing the politics of likability

BOSTON — Senator Scott P. Brown posed for pictures with President Obama two days in a row last week, smiling as Mr. Obama signed two bills that Mr. Brown co-sponsored. Never mind that he is a Republican seeking re-election in a season of strident partisanship. Mr. Brown is on a mission to persuade the voters of Massachusetts that he is as independent as politicians come.

His carefully cultivated image — of a genial Everyman beholden to no one, flashing a moderate streak even as his friend and erstwhile mentor Mitt Romney hews to conservative ideas in the Republican presidential primary contest — is at the core of Mr. Brown’s strategy in what has become a tight race against Elizabeth Warren, his presumed Democratic opponent.

Ms. Warren, the Harvard professor and nationally known consumer advocate, entered the race beloved by the national Democratic base and has enchanted party loyalists here. She is also raising far more money than Mr. Brown, including an extraordinary $6.9 million in the first quarter of this year, compared with $3.4 million for him.

But for all her fans and campaign riches, Ms. Warren, has a lot of work ahead to persuade voters to oust Mr. Brown. In a Boston Globe poll released last week, 57 percent of respondents said Mr. Brown was the most likable candidate, compared with 23 percent for Ms. Warren. Asked which candidate was best able to work with the opposite party, 49 percent chose Mr. Brown and 27 percent Ms. Warren.

Over all, the poll found a dead heat, with 37 percent supporting Mr. Brown, 35 percent behind Ms. Warren and 26 percent undecided. But Mr. Brown had a 3-to-1 advantage with independent voters, who make up more than half the Massachusetts electorate. He even won praise from Democrats, 40 percent of whom said he was the most likable candidate.

Such numbers suggest that Mr. Brown may be having some success in his effort to define Ms. Warren as a Harvard elitist and a partisan “rockthrower.” Meanwhile, he is playing up

his Average Joe qualities on the campaign trail, using not only his famous pickup truck but also the same barn jacket that helped him beat a much better-known Democrat in the 2010 special election for what he called “the people’s seat.”

His recent schedule has been full of pickup basketball games, chili cookoffs and other events that showcase that persona.

Without the advantage of incumbency, Ms. Warren often relies on local Democratic officials or labor leaders to introduce her around. And while she is poised and energetic on the campaign trail, giving a stump speech that details her rise from the daughter of a maintenance man in Oklahoma to a “fancy professor” who champions the middle class, hers is a different kind of interaction with voters.

She is new at it, and learning on an unusually prominent stage. Despite her folksy approach, the response of those who meet her for the first time is often polite formality, not the warmer, more familiar type of exchange that voters tend to have with Mr. Brown.

At a St. Patrick’s Day lunch in Quincy, Ms. Warren gamely joined a dais full of local politicians and offered a few jokes that promptly fell flat.

“I’ll get there with you guys,” she ventured after a joke about Rick Santorum fizzled.

Yet two days later, at a much larger breakfast in South Boston, Ms. Warren breezed through a comedy routine, drawing particular laughs when she said she had heard that Mr. Brown’s barn jacket cost $600.

“Wow, here’s a guy who could use a consumer advocate,” she said.

Like Mr. Brown, she is also using social media to share personal details that might help her connect. On Saturday, she posted a picture of herself on Facebook dyeing eggs with her young granddaughters. She has posted on Facebook and Twitter about her golden retriever, Otis, and about the fact that she bakes “a wicked apple pie.”

While may voters who meet her are noncommittal, Ms. Warren frequently encounters one or two people who know her background and are already loyal fans.

Parents, police seek leads in 2008 fatal assault

The death of 37-year-old Frank Williams III has been shrouded in silence since the early morning attack at 1:40 a.m. on a summer morning in the soccer field at Kennedy Park.

That attack in East Bayside ended his life on Aug. 16, 2008, and the case remains unsolved.

Frank Williams Jr. and his wife Rhonda, the victim’s stepmother, have met recently with Portland Police Det. Rich Vogel. They want to reignite interest in a case that happened almost four years ago, hoping that some new leads may be generated by posters they’re planning to put up in the areas frequented by “Frankie,” as he is referred to by relatives and friends.

Williams was beaten and stabbed by a group that possibly contained as many as eight to 12 young men, in two separate altercations. This group included whites, blacks and Asians, police said. Williams was white.

According to police, the first attack occurred near the playground, followed by a melee in the soccer field.

Labor board head dismisses union complaint The executive director of the Maine Labor Relations Board, Marc Ayotte, dismissed a complaint filed by the Maine State Employees Association in February against Gov. Paul LePage’s administration, the governor’s office reported.

The Maine State Employees Association is the largest of the four state employee unions.

The MSEA filed a motion with the Labor Board as part of the underlying complaint asking the board to immediately stop the state from contracting out work that is typically done by union members, a press release from the governor’s office reported.

Portland, known as a foodie town, now has a hometown ballpark with more than burgers and hot dogs for sale. Hadlock Field today will unveil new menu options, so fans can get a veggie wrap as well as a pretzel at the Portland Sea Dogs' home opener.

Along with the new options are higher prices for fans, as the Boston Red Sox affiliate adjusts its menu pricing after three years of freezes.

No ballpark favorites are being cut, but a few new options are available.

"We're introducing a Healthy Food Line in our new Shipyard Grill, located down the third base side," said Portland Sea Dogs General Manager Geoff Iacuessa.

"We'll be offering two different kinds of Italians, chicken and veggie wraps, and two different salads. Shane's of Maine frozen yogurt will be at all concession stands, and as far as the healthy line goes, we're happy to try it again."

The Sea Dogs' food service department attempted healthy options in the past and after one season, the items were phased out due to lack of sales, Iacuessa said. He believes this time will be different.

to the ball park. But a large percentage of fans said they want healthy options, so we sat down and looked at everything, every angle from the minute people buy their tickets to the minute they leave the park, and this surfaced as something we should do," Iacuessa said.

Citing the food service department as "the best in the business," Iacuessa said the Shipyard Grill menu was carefully designed to appeal to traditional ballpark diners as well, featuring hot subs and burgers.

Stating policy as a reason for not disclosing actual cost of the changes, Iacuessa said the larger,

better equipment installed in the new grill area will help prevent long lines. Along with the new and improved brew house featuring 11 beers, the grill improvements marked one of the largest expenditures to the park during the off-season.

Fans can expect an average price increase of 6 percent on most food and beverage items.

Iacuessa points out associated food cost, including transportation and paper goods, "have gone up close to 12 percent over the past two to three years and we have resisted raising our prices." see MENU page 16

Today’s Highlight in History: On April 12, 1862, during the Civil War, Union volunteers led by James J. Andrews stole a Confederate locomotive near Marietta, Ga., and headed toward Chattanooga, Tenn., on a mission to sabotage as much of the rail line as they could; the raiders were caught, and eight of them, Andrews included, were executed as spies.

On this date: In 1606, England’s King James I decreed the design of the original Union Flag, which combined the flags of England and Scotland.

In 1811, fur traders employed by John Jacob Astor began building Fort Astoria in present-day Oregon.

In 1861, the American Civil War began as Confederate forces opened fire on Fort Sumter in South Carolina. (The Union troops holding the fort surrendered the following day.)

ANNIE’S MAILBOX Dear Annie: My wife and I were both married before. Last year, she confessed that she’d had a 35-year affair with a married doctor. At the time, she was in her early 20s and he was in his early 40s. After 35 years, she decided he was too old for her and ended things.

She told me the doctor’s name, but when I did some checking, I discovered it was a fake name. I am not upset about her past. But I am terribly unhappy that she is lying to me. She met this doctor in his office, so she knows his name. How can she expect me to believe she didn’t know the identity of a guy with whom she had a 35-year affair? I no longer trust her and don’t like the dishonesty. Is there any way to trust her again, or do I move on? -- Lost in El Paso Dear Lost: She may be protecting this man’s identity because she doesn’t want you to confront him. Or you may know him.

Or she could be lying about the affair. She obviously didn’t expect you to check the veracity of her story. Now you need to discuss it with her. Tell her what you discovered. Ask her why she lied. Quite frankly, it serves no purpose for you to know this man’s name, and you should say so (and mean it). She is less likely to hide information when she believes you will not judge her or go looking for old boyfriends. It might help to have this conversation with a counselor who can mediate.

Dear Annie: My in-laws divorced 10 years ago because of my father-in-law’s homosexual infidelity. Shortly after the divorce, my mother-in-law attempted suicide.

I don’t think she has ever sought therapy for her emotional pain. To this day, she continues to badmouth her ex-husband in front of her children and grandchildren. She seems to vent mostly to me, probably because I’m related by marriage and she figures I’ll be more receptive. Sometimes she’ll make up

stories about him.

I believe she wants me to hate him. The truth is, I don’t. In spite of what happened, he has been a wonderful father and grandfather, and we love him.

How can I get her to stop bashing him without seeming to take sides and hurting her feelings? -- Dumped Upon Dear Dumped: It is perfectly OK to tell your mother-in-law that you don’t want to hear such criticisms and simply ask her to stop. Or get up and leave when she starts in. But you might also say with genuine concern that she seems obsessed with her ex and you are worried about her mental health. Suggest she seek therapy not only to vent to a professional, but to learn how to move forward with her life.

Dear Annie: I’d like to share how my family handled a situation similar to that of “Old in Indiana,” the 90-year-old woman who wondered how to divide her possessions among her daughters and daughters-in-law.

I’m one of three siblings, and the folks had several generational heirlooms that none of us wanted to see sold or given to one of us as a show of favoritism. Our parents put numbers on each item, and then we drew matching numbers from a bowl. We agreed that if one of us wanted an item someone else had drawn, an offer could be made to trade or pay its monetary value. Anyone who didn’t want something they were given had to give notice to the other two siblings before putting it up for sale, allowing the others to buy it and keep it in the family.

All of this was written down and agreed to in the presence of a lawyer, and added to the will. There have been no regrets or disputes. -- A Happy Heir in Nebraska

Justice Dept. sues Apple and publishers over e-book pricing; three publishers settle

The Justice Department jumped directly into the fight over the future of digital books on Wednesday — and Amazon came out the winner.

In an action that could lower the price of e-books and shift the growing market in Amazon’s favor, the Justice Department slapped Apple and five of the largest book publishers with a civil antitrust lawsuit, charging that the companies colluded to raise the price of e-books.

The announcement, made in Washington by the Attorney General, Eric H. Holder Jr., and Sharis A. Pozen, the acting assistant attorney general of the Justice Department’s antitrust division, capped a months-long investigation that hinged on the question of whether publishers, at the urging of Steven P. Jobs, then Apple’s chief executive, agreed to adapt a new policy in 2010 that in essence kept the price of newly released e-books at the price offered in Apple’s iBookstore — typically between $12.99 and $14.99.

At the time, Apple with its blockbuster iPad was attempting to take on Amazon’s hold on the e-book market. Amazon, the online retail giant, had become a kind of Walmart for the e-book business by pushing down the price of most new and best-selling e-books to $9.99 — a price designed to stimulate sales of its own own e-reading device, the Kindle.

Publishers, looking for leverage against Amazon, saw Apple as their white knight. The Justice Department complaint, using language that could have been inspired by a best-selling crime novel about shadowy eastern elites, describes how executives from the publishing companies met to discuss business matters “in private rooms for dinner in upscale Manhattan restaurants,” tried to hide their communications by issuing instructions to “double-delete” e-mails, all the time complaining of Amazon’s growing influence over the e-book market.

Ultimately, the Justice Department alleged, the publishers and Apple conspired to limit e-book price competition, increasing Amazon’s e-book retail prices and causing “consumers to pay tens of millions of dollars more for e-books than they otherwise would have paid.”

Three publishers that were investigated, Hachette Book Group, Simon & Schuster and HarperCollins, have already agreed to a settlement that will likely overturn their pricing model. Macmillan and Penguin Group USA, which were also named in the suit, did not settle. For consumers, the suit and settlements could ultimately pave the way for lower e-book prices.

Under the settlement, the publishers are required to terminate their e-book contracts with Apple and any other retailer with a “most favored nation clause,” which says that no other retailer can sell e-books for a lower price. For two years, the publishers are also prohibited from restricting any retailer’s ability to discount e-books.

For Amazon.com, which has seen its share of the e-book market erode from 90 percent to roughly 60 percent since the publishers’ actions, the Justice Department action is a major victory over one of its bitterest rivals, Apple. In anticipation of the announcement, Amazon already appeared poised to drop prices on e-books in response to the day’s events.

“This is a big win for Kindle owners, and we look forward to being allowed to lower prices on more Kindle books,” said Andrew Herdener, a spokesman for Amazon, in a statement about the settlement.

An Apple spokesman declined to comment. A spokeswoman for Barnes & Noble, whose popular Nook reader captured a greater share of the market after the new pricing plan wounded Amazon, said the retailer had no comment. The Justice Department investigation has set off worries among authors who feared Amazon’s huge influence over the market.

Wayside Food Programs food drive 9 a.m. to 7 p.m. Wayside Food Programs will hold a threeday food drive hosted by Whole Foods Market in Portland from April 12-14. Running from 9 a.m. to 7 p.m. each day at Whole Foods’ 2 Somerset St. location, the drive will collect food that will be distributed to families and individuals through Wayside’s network of mobile food pantries, free community meals, kids’ healthy snacks program, and among its 43 partner agencies across Cumberland County.

Wayside staff and volunteers will be at the store to distribute copies of Wayside’s food drive “wish list” and to collect donations. This food drive comes at an important time of year for the hunger relief agency. In agriculture, the spring months are often referred to as the “hunger gap,” the time between harvests when fall’s root vegetables have been exhausted, and early spring crops have yet to come to maturity. Food pantries face a similar phenomenon in the spring, when the bounty of the holiday food drives has dwindled, and there are still several months before donations of local produce start to come in. Wayside Food Rescue collects and distributes food to 43 agencies, including soup kitchens, food pantries and other social service providers across Cumberland County. Wayside Food Programs also runs free community meals at five host sites in Portland and Westbrook each week, four of its own mobile food pantries, and supplies healthy snacks for kids through a program with Portland Community Policing. Portland High School held its 33rd induction ceremony for the National Honor Society on April 4, highlighting students chosen on the basis of scholarship (a 93 or above grade point average), leadership, character and service to school and community, Portland Public Schools reported.

Also new is a revised sky box menu and the Oxford Networks Corporate Corner.

According to Chris Cameron, vice president of media relations, "Sky boxes typically sell out, and the Corporate Corner is a group alternative that includes box seats. It's an exclusive picnic area for corporate groups and individuals."

In an area accommodating 60-150 people, the new menu choices at the Corporate Corner are standard picnic area fare, chicken and steak,

and a lobster bake.

For the diehards who perceive healthy ball park food as an oxymoron, the Sea Dogs are implementing an All-You-CanEat menu in 100 of the outfield pavilion seats, and tickets are already selling well.

"The price of $24 includes a $9 seat and fans can eat hamburgers, hot dogs, pulled B.B.Q. chicken sandwiches, Seadog Biscuits and Coke products," says Iacuessa. "For $96 a family of four can come to the ballpark, and that's so much more affordable then a major league game. We want to keep the game affordable."

The expanded food service menu has resulted in hiring extra staff of 12 to 18 people, and the Sea Dogs are a major source of employment for area teenagers, with strong retention from year to year, Iacuessa said. Also holding off on raising ticket prices, the admission price remains at $9.
