These reports, the President ordered, have Wednesday, April 24, 2019 as the deadline for submission to the Presidential Audit Committee in the office of the Vice President. Senior Special Assistant to the

President on Media and Publicity, Garba Shehu, on Wednesday, stated that a circular to this effect was issued by Boss Mustapha, the Secretary to the Government of the Federation (SGF). According to Shehu, President Buhari also requested the ministers to “ensure that all outstanding memoranda they intend to present to the Federal Executive Council are submitted to the Cabinet Affairs Office, Office of the Secretary to the Government of the Federation, not later than Tuesday, 30th April, 2019.” The circular also informed members that the “9th and 10th meetings of the Council have been rescheduled to Thursday, 25th April and Thursday, 2nd May, 2019 respectively” in view of the Easter break and May Day celebrations.

Says Spectrum Wireless lacks locus standi to bring suit against EMTS

A Federal High Court sitting in Ikoyi, Lagos, has dismissed a suit filed by Spectrum Wireless Communications Limited against Emerging Markets Te l e c o m m u n i c a t i o n s Services (EMTS), owners of 9mobile, challenging the sale of the company. In his ruling on the preliminary objections filed by counsel to EMTS, CJ Aneke, the presiding judge, upheld the defendant’s prayers that there is no direct shareholding relationship between Spectrum Wireless and EMTS. He also upheld the defendant’s position that there is no privity of contract between EMTS and Spectrum as Spectrum is not a shareholder in EMTS and cannot be said to have been directly affected by the actions of its shareholders – Mubadala Holdings Cyprus Ltd, Myacynth and Etisalat International Nigeria Ltd.

The court further upheld the Defendant’s position that if at all Spectrum has a right of action, its action should be against PTHNV, the company it originally invested in and not EMTS. The court therefore upheld the submission of counsel to EMTS that not being a shareholder of EMTS, Spectrum lacks the locus standi to bring the suit against EMTS on the basis of any decision taken by the shareholders of EMTS. Aneke also held that Spectrum is not a party to the credit facilities which it claims were unlawfully obtained; and it is elementary law that only parties to a contract can make judicial claims in respect thereof. The Court therefore dismissed the suit in its entirety. In his reaction to the ruling, Ore Olajide, the company secretary/ legal adviser, 9mobile, said “this is victory for democracy, victory for the rule of law in Nigeria,

victory for company law legal practitioners, victory for corporate lawyers, academia and students. 9mobile will continue to focus on satisfying our numerous customers and stakeholders who have faith in us and have stayed the course with us”. Spectrum Wireless Communications had sued EMTS and 16 other defendants including United Capital Trustees Limited (‘the Lenders’), the Central Bank of Nigeria (CBN) and the Nigerian Communications Commission (NCC) over the sale of the telco. The company had claimed that it acquired indirect holding of 30% of the shares of EMTS after a private placement and was allotted 4,041,096 Class A shares of Premium Te l e c o m m u n i c a t i o n s Holdings NV (“PTHNV”), which owns 99% of the shares in MyaCynth Coperative UA (“MyaCynth”).

John Dyegh, declared that he would proceed with his ambition to lead the House, in spite of the insistence by the party that it has zoned the position to the South West and has equally adopted Rep. Femi Gbajabiamila as its preferred candidate. Formally announcing his intention to vie for the House exalted office, Rep. Dyegh, at a press briefing in Abuja, said that the North Central remains unconvinced about the APC’s postulations that the post of speaker has been zoned to the South West and as such is final. “I am here today to update you on the latest development regarding the contest for the office

of speaker of the 9th National Assembly. My party, the APC in her wisdom zoned the position of speaker to the South West and even micro-zoned it. “I am a party man and my loyalty to the APC is 100 per cent. However, the North Central zone hasn’t been convinced nor given reasons why their votes should not count and why we should not run and we feel very strongly that there is still room for negotiation because we believe it is not over until it is over. “We are therefore, appealing to the party to have a rethink and rezone the speakership to the North Central for justice and fair play. We pray to God Almighty to touch the hearts of our leaders to reconsider us favourably,” the House member stated. Rep. Dyegh added that he is encouraged by the provisions of Section 14 (3) of the 1999 Constitution (as amended) which states that: “The composition of the

government of the federation or any of its agencies and the conduct of its affairs shall be carried out in such a manner as to reflect the federal character of Nigeria and also to command national loyalty, thereby ensuring that there shall be no predominance of persons from a few states or from a few ethnic or other sectional groups in that government or in any of its agencies.” It will only be fair, he argued therefore, for the position of speaker to be given to the North Central, since the APC has zoned the Senate President’s seat to the North East. Moreover, he said “it is instructive to note that the North Central has neither produced the speaker nor the deputy speaker since 1999. School feeding now in 30 states, 9.5m pupils fed daily -FG Says over 12m Nigerians benefit from programme 10m Nigerians to benefit from Next Level schemes Mathew Dadiya, Abuja President Muhammadu Buhari led administration has disclosed that its Home Grown School Feeding Programme has now covered thirty states in the federation, feeding 9.5 million pupils daily. This, the government said, was in continuation of its efforts to invest in the country’s human capital development, by making significant strides through its National Social Investment Programmes (N-SIP). Senior Special Assistant to the President (Office of the Vice President), on Media and Publicity, Laolu Akande, stated this on Wednesday in Abuja. The Presidency stated that President Buhari administration’s NSIP is aimed at empowering Nigerians and improving their livelihood through several initiatives. According to the government, millions of Nigerians nationwide are currently benefitting from the different schemes under the N-SIP, which is the largest social welfare scheme in the history of the country. “Through its Conditional Cash transfer (CCT) scheme, the administration is supporting the most vulnerable in society, while developing a skilled workforce for economic productivity by providing jobs for millions of Nigerian youths through the N-Power programme, and improving the learning and cognitive skills of Nigeria’s children through the Home-Grown School Feeding programme (NHGSFP).

“Also, the Government Enterprise and Empowerment Programme (GEEP) provide financial support through micro-credit schemes to small traders and businesses at the bottom of the financial pyramid. Beneficiaries include petty traders, women cooperatives, youths, famers and agricultural workers,” Akande stated. The Presidency stated further that in the Next Level of the Buhari administration, about 10 million Nigerians are expected to benefit from GEEP, which includes TraderMoni; MarketMoni and FarmerMoni while the Cash Transfer scheme aims at reaching one million poorest households, one million new beneficiaries are expected to be added to the N-Power scheme, arguably the largest job creation and youth employment scheme in Africa. The administration’s National Home-Grown School Feeding Programme (NHGSFP), which has a target of reaching 12 million pupils, is currently feeding over 9.5 million public primary school (classes 1-3) pupils with one free, balanced and nutritious meal a day in 30 states nationwide; while it has empowered 101,913 cooks in these states. The 30 states currently benefiting from the school feeding programme are Anambra, Abia, Akwa Ibom, Adamawa, Bauchi, Benue, Borno, Cross River, Ebonyi, Enugu, Kaduna, Kebbi, Kogi, Sokoto, and Nasarawa. Others include Taraba, Ogun, Oyo, Osun, Plateau, Delta, Zamfara, Imo, Jigawa, Kano, Niger, Katsina, Ondo, Edo and Gombe. The HGSFP has not only helped

to increase enrollment rates of pupils in these communities, it is also effectively tackling early year malnutrition, while improving the cognitive skills of children. The School feeding programme has also provided sustainable income for local farmers, cooks, which has increased growth and productivity in the local economy. As of March, 297,973 Nigerians in 20 states (including the Borno IDP camps) are current beneficiaries under the National Cash Transfer Policy Programme (Conditional Cash Transfer), which started in December 2017; with over 5,000 savings groups and cooperatives formed as a result. The following states are currently receiving payment: Adamawa, Anambra, Bauchi, Benue, Borno, Cross River, Ekiti, Gombe, Jigawa, Kaduna, Kano, Katsina, Kogi, Kwara, Nassarawa, Niger, Osun, Oyo, Plateau, and Taraba. The government explained that the Conditional Cash Transfer is designed to deliver timely and accessible cash to beneficiary households and so enhance their capacity for sustainable livelihood. The programme provides beneficiaries - poor and vulnerable households - with a monthly transfer of N5,000 with the sole aim of taking them out of poverty. Meanwhile, the Government Enterprise and Empowerment Programme (GEEP), which has the MarketMoni, FarmerMoni and TraderMoni schemes, currently has a combined total of over 1.7 million Nigerians benefiting from these

schemes. So far, since after the national and state polls, 30,000 minimum beneficiaries have been added to the TraderMoni scheme, which provides interest-free loans starting from N10,000 to petty traders nationwide and is payable within six months. In addition, upon repayment of the N10,000 loans, some beneficiaries in some states, including Lagos, Osun, Borno, Ogun and Benue, have now started receiving the 2nd improved interest-free TraderMoni loan of N15,000. Managed by the Bank of Industry, GEEP schemes provide financial support through micro-credit schemes to beneficiaries which include petty traders, women cooperatives, youths, famers and agricultural workers. In the same vein, the Administration’s N-Power scheme, which is designed to provide jobs for unemployed young graduates, and is arguably the largest job creation and youth employment scheme in Africa, has currently engaged 500,000 youth graduates deployed to provide public health services in teaching, health, agriculture and tax and monitoring; and a further 200,000 non-graduates in training or attached to organisations as interns. N-Power beneficiaries across the 36 states and the FCT are provided with a N30,000 monthly stipends, in addition to technology devices with relevant content for continuous learning. Many N-power beneficiaries have gone on to become entrepreneurs who are building successes in their chosen vocations.

Senate passes re-drafted PIGB, Electoral Act, five others bills Tunde Opalana, Abuja In its determination to reform the nation’s political process, as well as the operations of the petroleum industry, the Senate on Wednesday passed a re-drafted version of the Independent National Electoral Commission (INEC) Act 2010 (Amendment) Bill, 2019, the Petroleum Industry Governance) Bill, 2019, and five other Bills to which President Muhammadu Buhari earlier declined assent. Other redrafted Bills passed are: The National Institute for Hospitality and Tourism Bill, 2019; the National Research and Innovation Council Bill, 2019; the Stamp Duties Act (Amendment) Bill, 2019; the National Agricultural Seed Council Bill, 2019; and the Agricultural Credit Guarantee Scheme Fund

(Amendment) Bill, 2019. It should be noted that following the President’s refusal to assent to the aforelisted Bills, the Senate setup a 7-member technical committee headed by Senator David Umaru, chairman of the Senate Committee on Judiciary and Legal Matters, to look into the Constitutional and legal implications of withholding of assent to the Bills by the President and to make appropriate recommendations on the way forward. The Committee reviewed 6 constitutional amendment Bills and 11 private member Bills. In its 34-page report, the Committee recommended that the Senate should reconsider and pass again 11 Bills, including the five Constitutional Amendment Bills; it should override the President’s veto on a Constitutional Amendment Bill, and the Industrial

Development (Income Tax Relief) Amendment Bill, 2018; and that the Senate should entirely withdraw four other Bills. At its unusually extended plenary on Wednesay, the Senate, voting on a Motion moved by the Senate Leader, Senator Ahmed Lawan, in which he noted that the technical committee worked

on President Buhari’s observations and re-drafted the affected clauses, thereby addressing the rationale for withholding of the presidential assent. The Senate, then unanimously, passed the seven re-drafted Bills at the Committee of the whole, chaired by the Senate President, Dr. Abubakar Bukola Saraki.

Bello of the All Progressives Congress (APC), on Wednesday, officially declared his interest to contest for a second term. He made the declaration at the banquet hall of the Government House, in Lokoja during the inauguration of the Kogi State House of Assembly Commission. According to a press statement signed by his Chief Press Secretary, Onogwu Muhammed, Governor Bello said his declaration came after thorough consultations with the leadership of his party, both at the national and state levels and calls from the people of the state on him to run for the second tenure. He pointed out that following the official release of the election time -table by the electoral umpire, it has become necessary for him to make his intentions known. “We have made tremendous progress in the last three years and based on our achievements, the people of the state have been calling on me to run again to consolidate on our first term achievements,” Bello said.

The Federal Government has approved an additional $3.50 billion loan for the Federal Ministry of Transport to execute the ongoing rail project in the country. The approval was given on Wednesday during the Federal Executive Council (FEC) meeting presided over by President Muhammadu Buhari at the Council Chamber of the Presidential Viall, Abuja. Briefing State House correspondents after the meeting, the Minister of Transportation, Mr Rotimi Amaechi, said that he presented two memos and both of them were approved by the council, He said that the first one was an amendment to an earlier approval for an $8.7 billion rail project for Ibadan to Kano to Oshogbo, linking Minna to Abuja, Minna to Kaduna, and Kaduna to Kano. The minister said that what the ministry sought for was the variation because the financing authority wanted to fund just $5.7 billion, adding that “We needed approval to negotiate the remainder as a commercial loan. Amaechi said that the FEC has therefore given the approval to secure the remaining $3 billion and $500 million for the construction of rail from Oshogbo to Ekiti which was not in the earlier plan. He further disclosed that the Council has also approved N474.4 million for the purchase of 22 number operational vehicles for the Nigeria Civil Aviation Authority. “There will be two Hiace vehicle and 21 others,” he said. Also, Minister of Finance, Mrs. Zainab Ahmed, said that the Federal Executive Council has approved three memos for Ministry of Finance. Mrs. Ahmed said that the council first, approved $150 million loan facility from African Development Bank (AfDB) and $50 million loan from African Grow Together Fund to finance the Nigeria rural electrification project. According to her, the project is a nationwide initiative to be implemented by the rural electrification agency. “The project aligns with the strategy of Federal Government on electrifying rural community. “The project has four components, first is solar hybrid mini-grid for rural economic development, the second is productive appliances equipment for up-grid communities and the third is energising education while the fourth component is institutional capacity building. “The impact of the project when fully implemented, about 500,000 people will be able to have access to electricity for about 105,000 households. The maximum power that will be generated will be 76.5 megawatts installed generating capacity part of which is 68,000 megawatts of solar,” the minister explained. Mrs. Ahmed added that eight universities in the country will benefit from the scheme and about 20,000 Small, Micro, Medium Enterprises (SMEs) across different communities in the nation. The Finance minister further explained that Nigeria has the smallest component in this pact, “which is a total loan of $27.3 million IADE facility, it is a concessionary loan.” The minister explained further that the it is a loan that the four countries were taking together, saying: “The other three countries have concluded theirs, so this is one of the final stages for Nigeria to conclude its process.” “The third load approval is $20 million, for the Lagos State Strategic Transport Master Plan, this facility is from the French Development Agency. The objective of the project is to improve the living conditions of the inhabitants of Lagos urban area and to promote urban development sitting by efficient and effective transport system. “The project has two major components, first is to rehabilitate urban roads and the creation of minimum of eight equality bus corridors and the creation of two multi-model inter-changes at Marina and Mile 2. The second objective is to provide technical support for implementation and management,” Mrs Ahmed added. When completed, the minister said the project is expected to impact 1.8 million inhabitants of Lagos State and accumulative 1.5 million users per day for inter-model inter-changes without about 620,000 boarding at Mile 2 and 480,000 boarding at Marina. Also, the Senior Special Assistant to the President on Media and Publicity, Garba Shehu said that FEC approved the bill for the establishment of a Nigeria Army University in Biu, Borno State. “You will recall the council in April 2018 approved the establishment of the university, the bill will be forwarded to the National Assembly for legislation,” Shehu said. On his part, Minister of Federal Capital Territory (FCT), Mohammed Bello, also said that FEC gave the approval for the rehabilitation of 12.6 kilometer of road from the junction Gwagwalada in the abuja Lokoja A1 express way. The road, he said, would pass through Gwagwalada specialist hospital up to Bello village at the cost of N1.3 billion, with a completion period of eight months. He said: “Council also approved the award of contract for the provision of cultural zone at the cost of N1.3 billion with a completion period of nine months. “Council also approved the award of contract for the reconstruction of access road leading the lower Usuma dam, which provides portable water to the residents of Abuja and environs. “This is line with this administration’s stance of twin contract development of the city and satellite towns to make it easier for residence to stay in either satellite towns or city. The contract sum is N1.26 billion with a completion period of six months.”

The directive was contained in a circular with reference no: FMF/PSSD/ HON/32 dated April 8, 2019 and signed by the Minister of Finance, Zainab Shamsuna Ahmed. According to the circular which was exclusively obtained by the Daily Times on Wednesday, permanent secretaries and heads of extra-ministerial

departments and auditor-general of the federation were also directed to send in their handover briefs. Others affected by the circular include, the Debt Management Office, Federal Inland Revenue Service (FIRS), Security and Exchange Commission (SEC), Nigeria Deposit Insurance Cooperation (NDIC), National Insurance Commission, Investment and Security Tribunal, National Economic Reconstruction Fund, Nigeria Export Import Bank, Pension Transitional Arrangement Directorate (PTAD), Assets Management Corporation of Nigeria (AMCON), Development Bank of Nigeria and Nigeria Sovereign Investment Authority. The minister revealed that the development was to ensure a

comprehensive handing over notes for the smooth and effective transition to the in-coming administration on May 29. The handover notes she further revealed are to be prepared in soft copies, hard copies must as well contain lists of files under the custody of all the MDAs. The memo reads in part: ‘’Following the recently concluded presidential election, preparations are in place to successfully conclude the current administration come May 29, 2019. As part of the process of transition, all agencies and departments under the Federal Ministry of Finance are directed to prepare their handover notes. ‘’All handover notes should be submitted to the permanent secretary (special duties) on or before April, 23, 2019. The governor said the apex court judgment showed that he resigned in line with the constitutional provision and that the primaries of the party which produced him as All Progressives Congress governorship candidate in 2018 was free, fair and credible. Fayemi, who spoke in Ado Ekiti during the swearing -in of the Head of Service, Ayodeji Ajayi, shortly after the Supreme Court in Abuja dismissed Oni’s appeal against his emergence, said that “Ekiti must move forward. According to him, the country’s Christian leaders have been delving into partisan politics and abandoning their primary assignment of soul-winning. He gave the advice at a two-day international conference on politics, religion and ethnicity in Nigeria, organized by the National Inter-Faith and Religious Organizations’ for Peace (NIFROP). Court declines to stop INEC from issuing certificate of return to Nwoko Andrew Orolua, Abuja The Federal High Court sitting in Abuja on Wednesday declined to entertain the application brought by Senator Peter Nwaoboshi (Delta North) to restrain the Independent National Electoral Commission (INEC) from issuing the certificate of return to Prince Ned Nwoko, who the court had declared the candidate of the Peoples Democratic Party (PDP) and winner of Delta North senatorial election. Justice Ahmed Mohammed of the Federal High Court, Abuja on April 3, delivered a landmark judgment stating that Senator Peter Nwaoboshi was not the winner of the Peoples Democratic Party (PDP) primary held on October 2, 2018 and therefore, was not the senatorial candidate for Delta North in the 2019 general elections. The judge ordered the INEC to publish the name of Prince Ned Nwoko as the rightful candidate of the PDP, having established the fact before the court that Nwoko scored a majority of the lawful votes in the

primary. He also ordered Senator Nwaoboshi to stop parading himself as the candidate of the PDP for the Delta North Senatorial District. Nwoko through his counsel Ahmed Raji (SAN) had dragged INEC, PDP and Nwaoboshi before the court praying for an order to stop INEC from publishing or further publishing the name of Nwaoboshi as the candidate for Delta North Senatorial District. Also, he asked for another order compelling the PDP to forward his name to INEC as the authentic candidate of the party for the senatorial district in the 2019 general elections. Nwoko, who predicated his suit on seven grounds, which were supported by a 20-paragraph affidavit and five exhibits, averred that he was screened and cleared for the Delta North Senatorial District by the PDP electoral committee. He declared among other things, that at the end of the primary election, he scored 453 votes to defeat his closest rival, Nwaoboshi, who scored 405 while Paul Osaji came third with

216 votes. Nwoko, however, maintained that to his surprise, the PDP jettisoned the result of the primary election and forwarded Nwaoboshi’s name as its candidate for the senatorial district. He stated that all efforts to redress the injustice through the party’s appeal panel were frustrated and thus unsuccessful. Yesterday, Justice Mohammed ruled that since the defendants in the suit had appealed the subsisting judgment, he would transfer the motion together with the entire case file to the appellate court. “This court has no further jurisdiction on the matter. In view of this, the first defendant’s (Nwaoboshi’s) motion filed before this court for stay of execution is hereby transmitted to the Court of Appeal,” he held. Judicial analysts view the ruling as a setback for embattled Senator Nwaoboshi who had hoped to secure a restraining order stopping INEC from issuing a certificate of return to Prince Ned Nwoko.

Army, Edo, Delta to give Maj-Gen. David Ejoor befitting burial The Chief of Army Staff, Lt. Gen. Tukur Buratai, says the Nigerian Army is collaborating with the Edo and Delta state governments to give the late Maj-Gen. David Ejoor a befitting burial. Buratai made this known during a condolence visit to the Olu of Warri, Ogiame Ikenwoli in Warri. The army chief accompanied by other top military officers, also visited the family of the late Ejoor and the Monarch of Olomu, Richard Ogbon Oghoro (1), the Ohworode of Olomu, Kingdom in Ughelli South Local Government Area of Delta state. Ejoor, a former military governor of the defunct Mid-Western state and one time chief of army staff, died in Lagos on February 10, 2019 at the age of 87. Buratai said the army has constituted a burial committee that would interface with both the state governments and the family of the deceased to ensure a successful and befitting burial for the late military officer. He described the late Ejoor as a humble and perfect soldier, adding that “the late Maj-Gen. Ejoor was a professional soldier, loyal and contributed to the development of the country. He served Nigeria diligently.” Responding, the Olu of Warri thanked Buratai for the visit and the role of the military in ensuring peace in the Niger Delta region and Nigeria in general.

Senate rejects bills on electric cars, citizenship acquisition Tunde Opalana, Abuja The Senate on Wednesday unanimously rejected two bills sponsored by Sen. Ben MurrayBruce (Bayelsa East) The first bill seeks to phase out petrol cars on Nigerian roads by 2035 while the second one is to allow any interested person of African origin to acquire Nigerian citizenship for purposes of re-integration and development. However, the debate on both bills generated controversies and drama, before they were eventually dropped. On the use of electric cars, Sen. Murray-Bruce said the petrol-powered vehicles are being replaced with electric cars all over the world because the latter are easier and cheaper to maintain apart from being environmental friendly. He argued that Nigeria was spending over a trillion naira on subsidy of fuel annually, just as filling stations would be replaced by solar energy that would automatically end the subsidy regime while the money saved would be channeled to infrastructure. He also explained that he had driven an electric car successfully on Abuja roads, stressing that it was cheaper and easier to maintain. Agreeing with Murray- Bruce, Senator Barau Jibrin (Kano North) said that electric cars are environment friendly and could take away the many hazards associated with petrol and diesel engines.

Regulating Anambra’s obituary economy Anambra, the mercurial pearl of Igbo nation nestling River Niger, is in the news again.

We are not about to revisit the ferment of executive intemperance that led the sitting governor into allegedly calling the whole leader of the pan-Igbo organization, Ohanaeze, “an idiot” for endorsing the presidential candidate of the main opposition party ahead of the just-concluded general elections. Rather, we are confronted by the audacity of a new piece of legislation by the Anambra State Assembly seeking to smash through cultural barriers into some dark necromantic alley. Unambiguously named “A Law To Control Burial/ Funeral Ceremonial Activities” and passed by a majority of the legislature, the act expressly seeks to abolish ostentation and impose a new culture of modesty. All thanks to its sponsor, the iconoclastic Charles Ezeani (representing Anaocha II constituency), who says it “is aimed at cutting down the cost of burial activities in the state”. Should Governor Willy Obiano assent with his golden fountain pen, it then becomes a grave felony “to deposit any corpse in the mortuary or any place beyond two months from the date of the death, while burial ceremonies in the state shall be for one day.” No person, it further forewarns grimly, shall subject any relation of the deceased person to a mourning period of more than one week from the date of the burial ceremony. To confer the sobriety thought appropriate in the circumstance, the law also forbids traditional gunshot salute, praise-singing, blocking of roads/ streets during obsequies or assumed ritual destruction of property. In what could only be targeted at relieving the bereaved of financial burden or unreasonable expectations, another clause states specifically that the family of the deceased “shall provide food for their kindred, relatives and other sympathizers at their own discretion.” Taken together, these proposals are, to say the least, quite earth-shaking indeed. Before arriving at this historic juncture, the report however did not state how much of public buy-in had been secured through the agency of public hearing facilitated by the state assembly over a potentially explosive

proposition. While Ezeani’s motive could hardly be faulted in nobility and public-spiritedness, however, considering that key provisions are framed by a thinking that tends to suggest extremism of sorts, one is persuaded to assume that not much consultation took place with the stakeholders. It is very doubtful if the vested interests in the obituary value chain would have just sat by and allowed an arrangement that seeks to dim their lights or simply take bread away from their tables without raising a voice of dissent. By that single law, a whole universe of professionals will undoubtedly be facing existential threat, if not extinction already. A more austere burial means bearish market for mortuaries and the morticians, for instance. So, how are caterers, “Aso Ebi” (fabric) merchants, event planners, vintners, lessor of marquee/canopy/plastic chairs expected to survive now? What then happens to the familiar hawkers of white handkerchiefs or hand fans? To say nothing about traffickers of mint-fresh banknotes for “spraying”. Or those who thought they had struck gold by stocking milllion units of the rave-of-themoment – the pistol-like cash-spraying machine fabricated in – where else? – China. We have not even considered “professional mourners” on hire to wail louder than the bereaved when the latter become too tired or had lost their voices to too much sorrow. Moreover, big or elaborate funerals also create brisk business for the masters of the two contrasting realms – the cosmic and the secular: rainmakers and alchemists who solemnly prime the canon for traditional gun-salute on the one hand; and native drummers who fall over each other in the driveway to usher you into the party venues with soliciting crescendo. Well, we were also not told whether Ezeani had contemplated a ceiling to the cost of a coffin permissible in Anambra soil henceforth. That may, in fact, drag us into a corpus of morbid details like the apocryphal tale of a thrifty coffin-maker who, upon being pressed for a concession, promised the customer a discount the next time. Or the theatrics of the hyperactive curator of the communal hearse, gleaming from meticulous preservation probably by generations, its utility yet creatively extended by the

current custodian to double as family car to church service on Sundays. And lo, the king of them all – the musician who makes a fortune from performing at the big parties which the new Anambra law seeks to outlaw. At a time piracy has virtually made album sale unprofitable, who does not know that most artistes now hustle for live performances for subsistence, aside endorsement deals with rich corporate bodies. Of course, praise-singing is the short-cut. As an editor some fifteen years ago, I remember being approached by one of our star reporters (Emeka Eyinnaya) saying a famous Igbo musician was aghast at the headline given his interview we had published the previous week. While responding to a specific question, the iconic entertainer had stated rather casually that he was not in a position to know whether the provenance of money sprayed on him by those he usually eulogized at soirées was tainted or not. I cast the said headline to reflect such selfacquittal from possible complicity on account of a murky source. Apparently, a good number of his big spenders – most probably bigtime conmen or money ritualists – had rang him up to express bitterness at his impudence to speak so uncomplimentarily of the hands feeding him. But note, the respondent didn’t disown or dispute any portion of the transcript which could have been cited as basis to fault the “offending” title, but was simply unhappy that the interview he was reluctant to grant in the first place was now going to pour sand in his garri. Such is the sensitivity that sometimes underlines the rendition of eulogy at social parties and the tightrope musicians have to walk thereafter to remain in business. But while all the foregoing merely pertains to the consequences, the new Anambra funeral act would also appear to be in cold contempt of something more substantial – cultural sensibilities or habits. While it is much easier to fix damage at the material level, altering things at the cultural realm is never an easy task. Those already thinking the proposed law will suddenly usher the desired change in social behavior in that jurisdiction will, therefore, need some reality check by simply recalling the anti-spraying law similarly pushed by the Obasanjo

administration in 2007. Despite that section 21 subsection 1-4 of the CBN bill passed by the sixth National Assembly prescribes heavy penalties beginning with arrest and a prison term of six months or N50,000 fine, Nigerians have not stopped spraying crisp Naira notes at social parties. Let us face it: the Igbo in Anambra are certainly not alone in turning burial to carnival of sorts. In most African societies, loud funerals are not only deemed fitting finale to an illustrious life but also considered one last debt owed the dead. Therefore, the common prayer among folks is not just the grace to die not faraway from one’s wardrobe only but also in the arms of one’s offspring who should be in material position to meet often high expectations of the community. So, whereas the bereaved in, say, western societies might consider as parting gift memorializing the departed by instituting a foundation to propagate the idea they cherished while alive, the average African would rather preserve the memory of their dead by hosting a shindig to be remembered as the grandest in a generation. In Yorubaland, such jollification falls under the rubric of “Owambe”. In Edo, it is called “Obito”. It is, therefore, doubtful if this age-old lifestyle can be legislated out of existence overnight like the Anambra’s funeral act envisages. The “Owambe” industry in Lagos is reportedly worth a whopping N26b, for instance. While the culture of ostentation must be seen as constituting ready normative offence, one would rather suggest the adoption of a civic engagement approach to wean the society off such hang-over. The underling mindset speaks to what psychologists call the edifice complex. It partly explains the obsession for bogus things – big cars, big houses, long convoys. We also see this showoffishness manifesting in the knack for titles that make many insist that their names be prefixed with “Sir, Chief, Dr, Engineer…” There is an urgent need for a re-orientation of the society to begin to see the nobility in simplicity. The crusade is not for government alone but also the traditional and religious institutions as well. Meanwhile, rather than prohibit loud parties, what stops the authorities from imposing punitive taxes on those who choose to exceed the threshold considered modest?

Nigeria: How not to fight corruption

Between fighting corruption with bare knuckles in an inspired manner and wearing wellpadded gloves to do half-hearted battle with a monster that has literally crippled the country, the Buhari administration has to make up its mind on which style to adopt. And because time is not on its side, it had better do so now. Although Buhari says he is fighting corruption, the question to ask is, how is he fighting it? It is true that waging war against corruption was at the top of his agenda in 2015 and he set up a thinktank of seasoned eggheads as well as introduced a couple of novel anti-corruption strategies to match the resolve. But it is also true that in spite of these supposedly virtuous schemes, corruption in various shades, propelled by its more virulent evil partner, impunity, is still rampaging through the land. A more dispassionate scrutiny of the ongoing anti-corruption campaign would undoubtedly reveal a huge gap between the performance of government and perception. Such awkward disproportions should not be the case in this matter of prosecuting the anti-graft war. What ought to be happening—at least as an enduring index of the promised change—is that citizen perception would largely correspond with the government’s side of the story. That is, government should be seen to be genuinely dealing hard blows on corrupt people and corrupt practices in the country. Unfortunately, this is not the case. Government says it is winning the war, but a large segment of the populace doubts this assertion. The problem is that the political will mobilized to fight corruption is itself severely enfeebled by the corruption it is summoned to confront. There is no way corruption can be defeated when Buhari seems to be engaging with it wearing blinkers. In all honesty, his fight is puerile; lacking all the firmness, decisiveness and, more importantly, the even-handedness required to secure confidence and belief. Given Buhari’s reputation for toughness, who could have thought that reports of investigation of alleged corruption would be lying on the desk of whosoever in the presidency or outside of it for ages, gathering dust in a Buhari presidency? Has he, all of a sudden, forgotten that his lead campaign

promise to fight corruption to the bitterest end, not to mention his acclaimed integrity, is the major reason the people elected him in 2015? Sometime in October 2017, Abdulrasheed Maina, the civil servant who absconded after being declared wanted for corruption, suddenly surfaced and was reinstated and promoted to a higher position in the civil service. The news of the recall reverberated across the country and was accompanied by widespread condemnation. Seemingly furious, Buhari, on October 23,directed Winifred Oyo-Ita, Head of Service of the Federation, to submit a report of the circumstances of Maina’s recall to the office of Abba Kyari, Chief of Staff to the President, before the end of that day. That report indeed got to the table of Abba Kyari before the end of that day. In another six months, it will be two years since the report of that investigation was received at the presidency. But, up till now, no word has come from the presidency regarding the report. It must be on somebody’s desk or shelf, submerged in cobwebs perhaps. No one needs be told that this sends a wrong message about the fight against corruption. The fury of what the media aptly dubbed “Mainagate” promptly spread to the National Assembly where the House of Representatives launched its own investigation by setting up a 10-man adhoc committee headed by Aliyu Sani Madaki, a member of the ruling APC from Kano State. At the end of two weeks, the committee laid a report at the plenary which indicted Abubakar Malami, Attorney General of the Federation and Minister of Justice. The report said Maina’s recall was “fraudulently masterminded” and that Malami “pressured all that mattered” to force Maina back into the service. s the Senate was also plunging into an investigation of the scandal, Malami rushed to court to stop the probe, showing clearly that he had something to hide. But what do you make of Attorney General, the chief law officer of a country who held secret meetings with a wanted citizen outside the country? Ordinarily, anyone would think this is a fugitive whose extradition Malami should be working hard to perfect. Even ItseSagay, professor of law and chairman

of Presidential Committee Against Corruption (PACAC), was horrified by Malami’s action and urged Buhari to do something about it. Nothing happened. Not one person among all those found culpable by the House of Reps probe in the reinstatement of a fugitive into the civil service has been punished by this government. From the AGF, to officials of the Federal Civil Service Commission, Minister of Interior, Abdulrahman Dambazau, and the permanent secretary, all are still sitting pretty in their cozy positions, none visited with the consequences of such grievous wrongdoing. Again, a wrong signal in the fight against corruption. And there is yet another. Also in six months’ time, it will be the first anniversary of the presidency’s announcement of investigation into allegations of infraction and financial malfeasance levelled against Usman Yusuf, professor and head of National Health Insurance Scheme (NHIS), by the governing council. Yusuf, according to a statement by the presidency, was directed to proceed on administrative leave November 5, 2018, to make way for an investigation by a 7-man panel headed by Hassan Bukar. Although the panel had two weeks to submit its report to the office of the Secretary to the Government of the Federation, the report was not turned in until seven and a half weeks later on December 24, 2018. It is about four months now since that report was submitted but nothing has been heard about it. Recently, one top official of the office of the SGF said government was unable to release the report because of the general election that was just concluded. Pray, what does election have to do with making public the report of an investigation into allegations of corruption against the NHIS boss? There are many allegations of corruption involving top government officials, including those very close to the presidency, among them a serving governor and even Buhari’s chief of staff, where the president blatantly refused to take action, or reluctantly did so after intense public outrage, as in the case a former secretary to the federal government, Babachir Lawal.This, certainly, is not how citizens expect that corruption would be fought anywhere in the world, least of all in Nigeria under

a Buhari presidency. Only recently, at the request of Ade Ipaye, deputy chief of staff in the presidency, the Independent Corrupt Practices and Other Related Offences Commission (ICPC) sent to Vice President Yemi Osinbajo a preliminary report of its findings on allegation of corruption against Marilyn Amobi, MD/CEO of Nigerian Bulk Electricity Trading Plc. (NBET).Limited as it was in its findings and conclusion, the report dated March 6, 2019 indicted the NBET boss and said the Commission would prosecute her and others for violating the ProcurementAct 2007 and ICPC Act, 2000. Significantly, the report stated that two whistleblowers who reported Amobi’s corrupt practices—Waziri Bintube, former head of finance and Abdullahi Sambo, former head of audit, were wrongfully dismissed. Since December 2017 these officers have not been paid their salaries and entitlements even after Raji Fashola, Minister of Power, Works and Housing whose office supervises NBET, had directed Amobi to reinstate the officers and pay their salaries and entitlements. That is just one of the many instances of insubordination she had shown to Fashola. It is more than five weeks since the presidency received the Commission’s report on the NBET boss but nothing has been done. You would wonder why the presidency is still sitting on the damning report. With it, a government that is really committed to fighting corruption would promptly direct Amobi to step aside as MD/ CEO and encourage the Commission to begin prosecution. In addition, that government would also immediately direct that the whistleblowers (Sambo and Waziri) return to work and all their outstanding salaries paid without any further delay. Clearly, this government realised, and rightly so, that it can never make meaningful headway in the fight against corruption without the input of the citizens. That must have informed the introduction of the whistleblower policy in December 2016. Yet, it cannot claim to be seriously fighting corruption when whistleblowers are not protected; and so far, there is no demonstrable political will to hold wrongdoers accountable.

Forgive sinners, but punish crime

“When lenity and cruelty play for a kingdom”, Shakespeare wrote, “it is the gentler gamester that is the soonest winner”. Nigeria, it appears, is fast becoming a self-harming, ‘lenient’ but ‘cruel’ society whose softness on crimes hardens the hearts of outlaws. A law-governed society, ironically seems more adept at toasting rather than roasting its gangsters. By the wanton let of the many, the few have unleashed life-threatening crimes and misdemeanors. The wrongs that now menace our societies are no longer the analogue, ‘your-life-oryour-money’ kinds of crime. Now we have sadistic, bloodletting daredevils, so obsessed with killing that they give their victims no option: it is now ‘your life and your money’! The nation is now littered with trigger-happy killer-zealots, of a religious, ethnic or merchantilic type: from the free-reigning, ransom-taking killer-kidnappers who are now so bold they knock on the doors of their victims, to the murderous, gold-digging Zamfara bandits with senses numbed by tramadol and other classes of across-the-counter, mind-bending stuff, to the notorious, optionally-radicalizing killer-machine, the boko-haram. And that is not to mention the huge army of cattle-rustling rogue communities of the middle belt whose un-assuageable taste for others’ belongings feeds the army of would-be killer herdsmen and kidnappers. These murderous classes of criminals we allow to get away with murder. A principle of law warns that no one should be allowed to profit from their own wrongdoing. But we allow criminals to do more than just profit from their own wrongdoing. We let them profit even from the proceeds of their wrongdoing. When a criminal escapes the rigors of the law and is not punished he has already profited from his wrong doing. But when he also gets to keep the proceed of his crime, he even profits more. A nation that regales in wanton lawlessness cannot hope for salvation even from the bounty of her own gratuity. Letting criminals get away with murder does not curb crime. It encourages it. Forgiveness of sin has its place only in religion; and punishment for wrong, in the body of man-made laws. Yet rather than punish wrong, we self-righteously make a selfharming virtue of forgiving wrong doers. We want looters not only to be forgiven, but we want them to keep the loot. In fact as proof that we have forgiven them, we even want them back into political office to misgovern us again. If we have our way, Evans the kidnapper should be pardoned. The Dubai five and the numerous Saudi drug peddlers on death row, should too. When the law will do no right, Shakespeare wrote, “let it be lawful that the law bars no wrong”. If the law will not punish offenders the law has no business criminalizing offences. Because people affrighted by wrong doers are always bound to take the law into their hands when they know that the law that should affright all, will not take them into its protective sanctuary. And so when a nation foolishly makes a ‘scarecrow’ of its laws, like we do, letting it stay mute in statute when it should be brute in action, the birds of prey that the dummy should scare, may soon make the law their idle perch and not their terror. When evil deeds have their permissive pass and not their strict punishment, a breakdown of normative values ensues and a nation is said to be in a season of anomie to everyone then, his own statute. We murder while we smile. Yet we frame our faces to each mournful occasion –wetting our cheeks with artificial tears. We are so villainous we deceive easier than Ulysses could –Ulysses, the Greek legend who sold to Troy the dummy of the Trojan Horse, to win a crucial war for the fatherland. But the Ulyssess of our own nation today are not those who plot for the nation. They are dissembling bigots in plots to

harm the fatherland. The so called patriots are those who array their cunnings to deny the nation a Trojan victory, preferring instead, to put her through an Athenian defeat. These false ‘patriots’ are bent on drowning the nation in the flood of her own blood. Enemies of state, obdurate at heart, malevolent in intent, motivated only by personal gains, are now up in arms against one and all. We are assailed on the one hand by deviants engaged daily in high crimes and misdemeanor, and on the other, by traitors bent on making capital out of everyday criminality. Tribes and tongues now take the law into their hands, because the law being mute in statute and lame in action, does no right. The army of venal politicians, making the law their perch and not their terror, now freely stoke the fire of mischief. The sectionalized public is reduced to schismatic mutual self-loathing –debating what ‘grievous wrong’ shamelessly to defend or what ‘noble right’ wickedly to debase. And the question is asked: ‘is this at last the sullen presage of our nation’s final decay?’ -that we are now condemned foolishly to array our might against ourselves; or that we are now determined make a shameful conquest of ourselves! Our so called men of God happily now are prophets of a new calling –of gloom and of doom. They speak no longer of peace because they have themselves become the harsh and boisterous tongue of woe. Woe betides every subject that they lay their evil tongues on! Our so called men of God have now turned the ‘word’ to ‘sword’, their ink to blood, their pens to piercing lances and their mouths to trumpets and beagle of war. If we persist in taking no heed, then the blood of innocents shall continue to manure the ground; and future ages will bear the brunt of our inaction. We must not allow our grief minister unto our reason -as it is evident now it does- making us seek always to heal the inveterate canker of one wound by making many. Our fault must not be our folly. We must not afford always to find out ‘right’ with ‘wrong’. Because two wrongs, as every Jack should know, will not make a right! And to all and sundry, it should be said: sheath thee thy swords. He that steeps his safety in blood shall find but bloody safety in return. Just as he who lives by the sword, shall die by the sword. For there is no sure foundation set on blood; no certain life achieved by others’ death. In a false quarrel there is no true valor. But in peace there is victory for all. For peace, they say is of the nature of a conquest; for then both parties nobly are subdued and no party loser. Pray, no more the thirsty entrance of this soil should daub her lips with her own children’s blood. No more should trenching war channel her fields, nor bruise her flowers with the armed hoofs of hostile rebellion. President Buhari must not spare the instruments of chastisement; lest his power, like to a fangless lion, is disdained and disregarded. He must be great in act as we know him to be in thought. He must stir with the times and be fire for fire! To gain the popular mood, he has to threaten the threatener and must outface the brow of bragging horror. Mr. President has to put on the dauntless spirit of resolution. He has to glister like the god of war when he intends to become the field! He must not allow our dreadful laws to be slighted or the dignity of our state so wantonly profaned. Buhari has to break some bones! Yes, advantage, as they say, is a better soldier than rashness. But even as the President is right to be ‘slow and steady’, it is expedient that he makes haste to keep us merry. It may be great that he does not have the scholar’s melancholy, but it is unacceptable that he should not have the jauntiness of a soldier. Yes, let’s be gratuitous with forgiveness of sins; but we must be severe in punishing wrong!

OUR POSITION Medical brain drain and matters arising

T

he reported massive brain drain in the medical sector in recent years where many medical doctors are leaving Nigeria on a daily basis for greener pastures is now a source of concern to Nigerians. Incidentally, Nigerian doctors have been migrating to the United States, United Kingdom, Canada, Saudi Arabia and many other nations across the globe. Though relevant medical agencies in Nigeria could not provide official data on emigrant doctors, statistics from General Medical Council (GMC) UK, as at July 2017 showed that over 4,765 Nigerian doctors are working in the UK. This is 1.7 per cent of the total of the UK’s medical workforce. The Association also revealed on Monday that over 80,000 registered medical doctors in its database but, regrettably, less than 50 percent of them currently practice in Nigeria. It also confirmed that no fewer than 12 Nigerian medical doctors leave Nigeria weekly for greener pastures in US, UK, Canada and other developed countries including African countries, due poor working conditions and other unhealthy labour practices in Nigeria. This trend has been having negative effects on the nation’s health sector. The major factors responsible for the unhealthy development are; poor remuneration, poor facilities and working condition, and job satisfaction. Many of our health professionals are over worked. A doctor is supposed to see a maximum of 20 patients a day but they are seeing about 150 in a day. Certainly by the time he gets to 50 patients, he is already exhausted. Even a nurse that is supposed to see about four patients has to take care of 50 patients in a ward. Certainly, he/she will get tired. The truth is that in Nigeria, the working environment for many doctors is very hostile. Many doctors see patients that they can treat or intervene on their issues die before them because the hospitals they are working in do not have the necessary equipment to take care of them. Also, the remuneration of doctors is very poor. If you go to other climes, what we are paying in Nigeria is just 10 per cent of what they collect and they respect doctors. It is instructive to note that we don’t have good funding maintenance for hospitals in the country. The few doctors that we have are over worked and are not appreciated. These reasons and others might not be unconnected to the ongoing brain drain in the country. We must know that relocation of one medical doctor from Nigeria affects over 5,000 citizens that could have benefitted from his or her medical expertise. The relocation automatically deny thousands of patients access to quality health care from a trusted medical practitioner. There are also indications that Africa loses $2 billion annually to medical tourism and medical brain drain while Nigeria contributes the larger percentage of the medical tourists. Nigeria is using her resources to train doctors and professionals that will leave to work in foreign countries. What are those things attracting these professionals outside? Can we duplicate them here?” We are of the opinion that government should provide adequate remuneration for our medical

doctors. Though we are not saying they should pay them so much, government should pay them for the job they are doing as and when due. We are also of the opinion that the Federal Government should make the National Insurance Scheme (NHIS) compulsory for all citizens. We believe that the development would provide enough funds to improve the conditions of service and working environment for health professionals. It is unfortunate that our medical doctors are leaving Nigeria because of poor conditions of service, working environment and after service package. The development indicates that the physician-patient ratio has worsened, maybe from 1:3,000 to 1:5,000. When you compare, those countries that have better physician-patient ratio have better treatment environment. If the the doctors know they will have a house after 20 years of training, the lure to leave Nigeria would be reduced. What are the benefits attached to the job? What are the provisions for the doctor’s family? What are the long-term prospects for the staff? We submit that government must improve the work environment in terms of financing, make it work-friendly and not crowding of 10 persons in one office. We must ensure electricity supply and avoid a situation where doctors come to work and scheduled to do a surgery but there is no electricity. We are of the opinion that there is the need for the country to be more drastic and re-organise the funding of health service. The government must adopt a more holistic approach to halt the dangerous trend of medical brain drain.

Court orders arrest of Etete, Adoke, Short News Bring killers of female student to justice, others over Malabu Oil dam Andrew Orolua, Abuja

Justice D.Z. Senchi, of a Federal Capital Territory (FCT) High Court, sitting in Jabi has granted the prayers of the Economic and Financial Crimes Commission (EFCC) to issue an arrest warrant against a former Minister of Petroleum, Dan Etete and a former Minister of Justice and Attorney General of the Federation, Mohammed Adoke, who were both implicated in the Malabu Oil scandal. According to the EFCC Facebook handle, also declared wanted by the court are Raph Wetzels, Casula Roberto, Pujato Stefeno and Burrato Sebastiano. They were meant to be arraigned before Justice Senchi on

April 17 to face charges related to the Malabu Oil scandal, but failed to show up. At yesterday’s proceedings, Justice Senchi, granted the prayers of the EFCC and ruled that the police, the INTERPOL and any other law enforcement agency should arrest them anywhere they were found, including outside the jurisdiction of the Federal Capital Territory (FCT) High Court. Our reporter recalls that the EFCC had since 2017 pressed charges against Shell Nigeria Exploration Production Company Limited, Nigeria Agip Exploration Limited, Eni Spa, Raph Wetzels, Casula Roberto, Pujato Stefeno, Burrato Sebastiano, Duazia Louya Etete (aka Dan Etete),

Mohammed Bello Adoke, Aliyu Abubakar and Malabu Oil & Gas Limited. All the defendants declared wanted had repeatedly failed to appear before the court. In view of their persistent absence in court, the EFCC had through its counsel, Aliyu Yusuf, brought a motion ex parte praying the court for a warrant of arrest and an order for leave to execute the warrant outside of the jurisdiction of the court. Etete and Adoke, who the federal government are seeking to arrest have been on self-exile since 2015 when President Buhari took over the reins of government. The matter was adjourned to July 11, 2019 for further hearing.

Nosa Akenzua, Asaba The National Association of Delta state Students (NADESSTU) on Wednesday appealed to Governor Ifeanyi Okowa to ensure that justice prevails in the murder of late Miss Elozino Ogege, a 300 level student of Delta state University, Abraka (DELSU). Elozino was allegedly murdered in cold blood by suspected internet fraudsters in November 2018. The student body in a statement signed by the acting President, Imalah Ugochanum a copy made available to our correspondent in Asaba, charged the state government to live up to its promise to the family of the victim by ensuring justice is delivered on time, adding that the suspects have allegedly been boasting that the case will go nowhere. The statement reads: “Many may have forgotten so soon how the young and promising student, Miss Elozino Ogege was murdered and slaughtered; the culprits have been arrested and we want justice in the case because the suspects are currently boasting on the streets that nothing will happen to them.” Furthermore, the statement averred that the mother of the victim has continued to cry for justice and is presently undergoing emotional pains based on the judgment by a high court in Asaba on March 8, in which one of the suspects who was indicted in the murder freed on grounds of Noelle Prosecui because she is a minor.

Court shifts N2.5bn fraud trial of Moddibo, others to May 2 Justice Folashade Ogunbanjo-Giwa of the Federal High Court sitting in Abuja, on Wednesday adjourned the arraignment of the Director General of the National Broadcasting Commission (NBC), Ishaq Kawu Modibbo and three others to May 2. Modibbo, Sir Lucky Omoluwa, Chairman of Pinnacle Communications Limited, Dipo Onifade and Pinnacle Communications Limited were to be arraigned on 12-count charge for alleged complicity in the digital switch over project of the federal government. But, when the court resumed hearing of the matter yesterday, Onifade was absent while Omoluwa and Modibbo were present in court. Counsel to Onifade, Dr. Alex Izinyon (SAN) told the court that the second defendant had informed him through a text message that he left Kaduna in the early hours of Wednesday to attend the court proceedings. However, Izinyon was apprehensive over the absence of Onifade and was infuriated because his phone lines were not reachable. “My lord, I have a serious challenge in respect of the second defendant. This

morning, he sent a text message to me that he had left Kaduna en route Abuja for his arraignment. “My lord, the second defendant was in court on the first day even when he was not served; on March 12, he was also in court. I pray nothing has happened to him,” Izinyon told the court. In view of the development, Izinyon pleaded for an hour stand down to wait for Onifade’s arrival. After the stand down, which eventually stretched to more than two hours, Onifade was nowhere to be found. On resumption of sitting, Izinyon said, “my lord, I regret to state that the position has not changed. I hope it is well with him. I have tried his line and it’s saying not reachable.” Izinyon therefore, craved the indulgence of the court to have the matter adjourned, hoping to know what actually happened to his client. Reacting, prosecution counsel, Henry Emore, confirmed seeing the phone chat between Onifade and Izinyon, adding that “we sincerely hope that all is well with the second defendant. We concede to the plea for

an adjournment.” In a short ruling, Justice OgunbanjoGiwa adjourned the matter to May 2 for arraignment. It would be recalled that Justice Ogunbanjo-Giwa had on March 12 directed that Modibbo, who had been absent on two previous occasions be produced in court. Modibbo’s counsel, Abdullahi Mustapha (SAN) had told the court that his client was absent in court based on health grounds. “My lord, let me apologize for the absence of the first defendant in court. He is hospitalized. He had a major surgery 10 years ago and is ill. “I have a medical report from the University of Ilorin Teaching Hospital to confirm that he is currently ill and I shall be filing it before the court registry,” Mustapha told the court. The prosecuting counsel did not oppose the oral application for an adjournment as pleaded by the defence, but however, posited that it should be on record that the defence has taken one adjournment out of five as stipulated by the Administration of Criminal Justice Act.

Minister of Women Affairs and Social Development, Hajia Aisha Abubakar has commended the United Nations (UN) for their efforts in securing and providing relief materials for the rescued girls. The minister was also grateful to other philanthropists that provided various forms of support for the well-being of the girls and their families during the period of captivity and after. Hajia Aisha, speaking in Abuja on Wednesday at the 5th anniversary of the girls’ kidnap from their school in Chibok, said that after all efforts by previous administrations at the federal, state and local levels to rescue the girls failed, the present government came to their rescue. “All efforts by previous governments at both federal and state, including concerned individuals and organizations to secure the release of the school girls proved abortive, until the coming of the present administration. “On May 18, 2016, having been in captivity for two years, the present government of President Muhammadu Buhahi rescued one of the adducted girls, Amina Darsha Nkeki, with her four- month- old baby girl. “This feat was repeated, seven months later when the federal government secured the release of 21 other Chibok girls on October 13, 2016. Maryam Ali Maiyanga, one of the abducted Chibok girls and her baby boy were rescued on January 5, 2017. “The rescue of 82 Chibok girls on May 7, 2017 crowned the efforts of the present government in its resolve to protect and secure the lives and property of Nigerians,” she said. On April 14, 2014, 276 school girls said to be preparing for their senior certificate examination were abducted from their school, Government Girls Secondary School Chibok, a village in Borno state.

FCT minister warns agencies against rejecting corps members Ukpono Ukpong, Abuja

The Federal Capital Territory Minister, Muhammad Bello has urged all government agencies and other employers within the territory to accept corps members posted to their organizations and to create an enabling environment for them to contribute meaningfully during their primary assignment. Bello made this known at the closing ceremony of the orientation course for the 2019 batch ‘A’ corps members yesterday, at the NYSC FCT Permanent Orientation Camp, Kubwa. The minister who was represented by his Chief of Staff, Mohammed Bashir Mai-Borno, reiterated that the FCT administration on its part will provide the opportunities for corps members to participate and contribute in the administration’s programmes spread across the area councils. “As you proceed to the next stage of the programme for your primary assignment and community development across the FCT, I enjoin you to accept your postings in good faith and be worthy ambassadors of the scheme by being committed to your work and contribute positively to your respective host communities,” he stated. Similarly, the FCT NYSC coordinator, Bello Ballama instructed the corps members to be pungent and avert every ignominy associated with everyday life wherever they are posted. “Bear in mind, that your responses, special contributions and resourcefulness during the service year is actually what stands you out for recognition, honour and award at the end of the service year,” he advised. Ballama also hinted that the federal government is expecting corps members to be involved in the fight against corruption, fake news and hate speech, adding that “I urge you to be a dependable vanguard to bring about the needed change in the system. “You must be disciplined in all your dealings with your host communities in order to impact positively on the lives of the FCT youth who would be looking up to you for credible guidance.”

Passing a resolution at plenary, the House requested President Muhammadu Buhari to order the Minister of Finance, Zainab Ahmed and the Accountant General of the Federation, Ahmed Aliyu to release all first line charge funds meant for the legislature and judiciary without further delay Debating a motion of urgent public importance sponsored by Rep. Edward Pwajok, who also doubles as the chairman House Committee on Rules and Business, the lawmakers accused the Presidency of breaching the constitution. They noted that the non-transfer

of funds to government institutions under the first line charge was an illegal act that should be condemned. In his lead debate, Rep. Pwajok stated that time and again the nonrelease of funds to the National Assembly has been raised before the finance minister when she appeared before an ad hoc committee of the House, but regretted that the statusquo hasn’t changed. He said that by that singular act, the executive has violated the 2018 appropriation Act, adding that “the implications of the brazen flouting of the Appropriations Act 2018 and the constitution which may make the National Assembly and the judiciary to be subservient to the executive, thereby, negating the letters and spirit of the constitution and the law with dire consequences on the practice of democracy in Nigeria.” Pwajok listed other affected statutory bodies to include, the Independent National Electoral Commission (INEC), Niger

Delta Development Commission (NDDC), Universal Basic Education Commission, the Public Complaints Commission and the National Human Right Commission. Adopting the motion, the House resolved to direct the leadership of the National Assembly and relevant committees on appropriation, finance, and legislative compliance to ensure compliance and report back to the House in two weeks. Meanwhile, the House before adjourning to April, 23, laid the reports of the 2019 Appropriation Bill, which is expected to be passed next week. The House also urged President Muhammad Buhari to intensify efforts to release the Chibok girls and others still in captivity. In commemoration of the 5th year of abduction of Chibok girls, the lawmakers in a resolution following a motion sponsored by Rep. Asabe Bashir, urged the federal government to urgently release all captives in abductors den, especially the Chibok and Dapchi girls.

Customs intercept 113 cars worth N1. 3 billion DPV Chioma Joseph, Lagos In a renewed effort to stop the activities of smugglers, the Nigeria Customs Service (NCS), Federal Operations Unit, Zone ‘A’ has intercepted 113 luxurious vehicles with a Duty Paid Value of over N1. 3billion. Giving an update on the activities of the zone from February 6 to April 16, 2019, the Zonal Controller, Comptroller Aliyu Mohammed said that over 23 trailers of rice, 600 cartons of codeine syrup, 1,000 sachets of tramadol and many other contraband goods were also seized by the zone. On how the vehicles were intercepted, the controller revealed that the vehicles which included a 2019 Range Rover Autobiography and other bullet proof vehicles were hidden by smugglers in bushes, while other were intercepted in car shops through intelligence that had filtered to the men. According to Mohammed, “A total of 113 vehicles were intercepted during the period under review. They are all exotic vehicles and some were even bullet proof cars. We have a 2019 Range Rover Autobiography amongst the seized vehicle.

Fake visa agent faces N900, 000 fraud charge A 34 -year-old fashion designer, Gabriel John, charged with defrauding a woman of N900, 000 has been arraigned before an Ikeja Magistrates’ Court. The defendant, who resides at Gbagada, Lagos, was arraigned before Magistrate M.O Tanimola on a two-count charge of stealing and obtaining money under false pretences. John, however, denied committing the offences and was admitted to a bail of N200, 000 with two sureties in like sum. The magistrate held that the sureties should be gainfully employed and show evidence of two years tax payment to the Lagos State Government. Earlier, Police Prosecutor, Insp. Aondohemba Koti, told the court that the defendant committed the offences on Jan. 13, at Mushin, Lagos. He said that the defendant presented himself to be an American Embassy agent to defraud Miss Elizabeth Eromosele of her money. “The defendant collected the money from the complainant to help her process Canadian visa after claiming he is an agent of American Embassy,”Koti said.

NAF Special Force “neutralises’’ 2 bandits in Zamfara

The Nigerian Air Force (NAF) has revealed that its Special Forces had “neutralised’’ two bandits in Zamfara. Director of Public Relations and Information of NAF, Air Commodore Ibikunle Daramola who disclosed this in a statement in Abuja on Wednesday said that the operation that led to the development was conducted on Tuesday. According to him, the special team also secured Rafi and Doka villages in the state. Daramola explained further that the operation was in response to reports that high profile bandits were gathering around communities Mada District in Gusau Local Government Area, which is under Area of Responsibility (AOR) of 207 Quick Response Group (207 QRG). He said, ‘’a Nigerian Air Force Special Forces (SF) Team was dispatched to the area on Tuesday to secure the two settlements and thwart the bandits’ plans. “On arrival at the location, the NAF team encountered resistance in the form of heavy gunfire from the bandits. “However, the brave SF personnel employed superior tactics to outlast the bandits, who were soon low on ammunition, before engaging and overpowering them.

The statement added that investigation has clearly implicated the suspect for aiding and abetting the commission of several highprofile armed robbery and kidnapping operations in the North West and North Central States of the Country. The Notre Dame cathedral was begun in 1160 under Bishop Maurice de Sully and was largely complete by 1260, though it was modified frequently in the ensuing centuries. Interpol says criminals converge unhindered in West Africa Joseph Inokotong, Abuja Secretary-General, International Police (Interpol), Jurgen Stock, has said that criminal networks in narcotics, weapon and migrants’ smuggling were settling in West Africa to carry out their nefarious activities unhindered due to lack of information sharing system by security agencies in the region. The Interpol chief warned that transnational criminal gangs were converging on the sub-region and feeding off one another. He disclosed this in Abuja during the signing of an agreement for the implementation of the West African

Police Information System (WAPIS) by the Federal Government and Interpol. He said that the signing of the agreement was a bold step forward in the collective fight against crime. In his commendation for the West African states for coming together to respond to the threats in the region, Stock said collective will was needed to ensure the success of the WAPIS programme, which he said would enable West African countries to have access to the global 24/7 communication network. NCC blames unstable electricity supply for poor quality service Joseph Inokotong, Abuja The Nigerian Communications Commission (NCC) said the epileptic power supply by electricity distribution companies in the country should be blamed for poor telecom services being experienced by customers. This was stated by the Manager, Technical Department (NCC), Mr. Musa Diabu, in Okene, Kogi State when the commission held a sensitization programme on the need for citizens to collectively protect telecom infrastructure in the country rather than leaving them to security personnel only. Mr. Daibu, said Nigeria needs about 158,000 metres of optic fibre to provide adequate broadband across the country, adding that what the country currently has is 38,000 metres. He blamed inadequate power supply for being a major factor responsible for poor services provided by the service providers. AGF inaugurates 13-man committee for Treasury Journal Finance Mathew Dadiya, Abuja The Accountant-General of the Federation, Mr Ahmed Idris has inaugurated a 13-man committee on the Treasury Journal Finance, tasking them to work assiduously to bring innovative ways that will ensure that funds are available for the production and publication of the 5th Edition of the Treasury Journal. Mr Idris gave the charge on Wednesday in Abuja, where he stated that the Treasury Journal is a source of pride to the Office of the Accountant-General of the Federation, and represents our determination at showcasing the role of the OAGF in Government programmes and activities. He, however, regretted that its funding has not been as expected as it has largely been through advertisements and other supports from MDAs which usually affects the production of the Journal as at when due. The AGF also charged the Editorial Board of the Journal to ensure highest standards and quality of inputs and publication of Treasury Journal. He therefore expressed his confidence on the committee to deliver on the task assigned to them by assisting the Editorial Board to achieve its mandate. Zenith Bank announces N50.2bn profit in Q1 2019 Motolani Oseni Zenith Bank Plc has announced Profits After Tax (PBT) of N50.23 billion in its unaudited financial results for the first quarter (Q1) ended March 31, 2019, representing an increase of 7 per cent compared to N47 billion recorded in the corresponding period of 2018. Looking at the first quarter unaudited result of the bank, The Daily Times observed that the lender recorded an improved numbers across key metrics, driven by good performance across the business segments. The Group profit before tax increased to N57.29 billion in Q1 2019 from N54 billion in the Q1 2018, representing an increase of 6 per cent. Profit growth was aided by a 23 per cent improvement recorded in the group’s Net Interest income which closed the period at N86.13 billion from N69.99 billion in Q1 2018. The Group reported an increase in its earnings per share to N1.60 during the period under review, better than the figure declared in Q1 2018. Also, the lender reduced its risk and asset quality continues to improve as cost of the risk dropped significantly by 52 per cent from 0.9 per cent in the prior year to 0.4 per cent for the period. This was achieved as impairment charges declined by 54 per cent (N2.5billion year on year reduction). According to the bank, its cost of funds also improved, declining by 25 per cent from 4 per cent in Q1 2018 to 3per cent at quarter-end, which was supported by a 22 per cent decrease in interest expense of N10billion over the same period, affirming the Group’s robust treasury and liquidity management.

Afreximbank becomes adviser for $130m Sierra Leone Bauxite Mine expansion project Motolani Oseni and Joseph Inokotong The African Export-Import Bank (Afreximbank) has been awarded the mandate to serve as the exclusive financial adviser and mandated lead arranger for the $130-million bauxite mine expansion project by Sierra Mineral Holdings 1 Limited (Vimetco) in Sierra Leone. The mandate, which was announced in Freetown earlier in April during a working meeting hosted by Sierra Leonean President Julius Maada Bio with representatives of Vimetco, the chief sponsor of the project; VI Holdings, the parent company of Vimetco; and Afreximbank. This was contained in a statement signed by the Head of Communications, Afreximbank, Obi Emekekwue, stating

that under the terms of the mandate, as captured in an engagement letter signed between Vimetco and Afreximbank during the working meeting with President Bio, Afreximbank is given the authority to provide financial advice and to take the lead in arranging the raising of capital for the project. The African lender, stated that the signing ceremony marked the official launch of the expansion project, which will see the construction of a new plant commencing in 2020, with production scheduled to start in mid-2022. The Vimetco bauxite mine will produce aluminium and alumina trihydrate which is used in the refractory and ceramics industries and for water purification. Other uses of alumina trihydrate include as a flame retardant filler and as a polishing compound. The construction of the new plant equipped with modern technology will

mark a first in Sierra Leone in terms of the development of the mining industry. The project will create jobs and lead to the development of infrastructure through the construction of schools, hospitals, roads, bridges, etc. Vimetco currently employs more than 1,500 people and contributes 1 per cent of its revenue to community and social development projects, including orphanages, schools and major social events. The company is a globally integrated aluminium group and operates bauxite mines in Sierra Leone, coal mines, aluminium production and processing facilities and electricity plant in China and an alumina refinery and aluminium smelter in Romania. The company’s strategy is focused on expanding added value areas of its business and securing its raw material and energy needs. The Sierra Leone

Telcos: What Nigeria needs for adequate broadband, Improved QoS - NCC Ladesope Ladelokun The Nigerian Communications Commission (NCC) has identified stable power supply and provision of not less than 158000 metres of optic fibre as crucial to boosting the Quality of Service (QoS ) by telcos and adequate broadband respectively across Nigeria. The Manager, Technical Department, NCC, Mr Musa Diabu, made this known during a sensitisation programme on the need for all hands to be on deck to ensure the safety of telecoms infrastructure across Nigeria instead of leaving them to security personnel alone.

Diabu said the current 38,000 metres of optic fibre was 120000 metres shy of the 158000 metres of optic fibre Nigeria needs for adequate broadband. He, however, blamed electricity distribution companies for the poor telecom services suffered by customers. Diabu says the importance of adequate power supply cannot be overemphasised as it is crucial to the provision of better services by service providers. PTAD offsets 33% Pension Increment Arrears of Railway Pensioners Mathew Dadiya, Abuja The Pension Transitional Arrangement Directorate (PTAD) has paid the sum of N375, 936,732.49 million to 13,754 pensioners of Nigeria Railway Corporation (NRC). This, the Executive Secretary, Sharon Ikeazor, said was in fulfilment

of President Muhammadu Buhari’s promise to clear outstanding pension arrears for pensioners under the Defined Benefit Scheme. Ikeazor, on Wednesday, stated that the payment was the final instalment of the 30 months arrears of the 33% pension increment that was confirmed by the management of NRC. PTAD inherited outstanding 33 per cent pension increment liabilities from various agencies at the time of its takeover of payment of Parastatals pension in 2015. Removal of subsidy will have negative effects on vulnerable Nigerians - Minister Says FG has not found a formula to end fuel subsidy Mutiat Alli The Minister of Finance, Zainab Ahmed on Wednesday, has said that the removal of fuel subsidy will have negative effect on vulnerable Nigerians. The minister, also, said that federal government is yet to devise a workable formula for the removal of fuel subsidy, even as she refuted media reports that the Federal Government had agreed with the International Monetary Fund’s (IMF) advice on the removal of fuel subsidy. Speaking at the federal executive council meeting, yesterday in Abuja, Ahmed noted that the government could only remove subsidy on fuel after having enough buffers to cushion the negative effects of the removal on ordinary citizens. She, however, pointed out that Christine Lagarde, managing director of the IMF, had advised Nigeria and other countries to remove fuel subsidy, saying the money spent on subsidy can be redirected to health and education. Four days after making the suggestion, Ibe Kachikwu, minister of state for petroleum resources, said the landing cost of petrol is now N180 per litre, with the federal government spending N1.86bn on subsidy daily.

Ahmed explained that while the country appreciates the advice of the IMF, what works for others may not be operable within Nigeria’s context, describing the country as unique. She said the government is still considering various options and until a decision is reached, no action will be taken. “In some countries, they provided buses to transport people, in some countries they provide subsidies in a manner that the people that are directly requiring the subsidies,” Ahmed said. “We have not found a way to do it. What we are doing now, the subsidy, it is everybody that it benefiting, whereas it is the people who are really vulnerable that need subsidy. “So, in the executive with the support of the legislature, we have to find a formula that will work for Nigeria. And until we do that, we should not be contemplating removing the subsidy because, indeed when we do, there will be people that will suffer. So, we are not yet there. “We discussed this periodically under the Economic Management Team but we still haven’t found a formula that works for Nigeria. And you know that Nigeria is unique. What works for Ghana might not work here. “So, it’s still work in progress for and there is no intention to remove fuel subsidy at this time.”

GTBank declares 8.3% increase in PBT to N57bn in Q1 Temitope Adebayo Guaranty Trust Bank (GTBank) plc has released its unaudited Financial Results for the first quarter (Q1) ended March 31, 2019, to the Nigerian and London Stock Exchanges. The Bank recorded positive performance across all financial metrics with profit before tax improved to N57billion in 2019 from N52.6billion recorded in the corresponding period of March 2018, representing a growth of 8.3per cent. Also from the income the statement, gross earnings for the period rose by 1.2per cent to N110.3billion from N109.0billion posted in March 2018. Customers’ deposits also rose by six per cent to N2.410trillion in March 2019 from N2.274trillion in December 2018, whilst the Bank’s Loan book grew by 1.6per cent from N1.262trillion as at December 2018 to N1.282trillion in March 2019. Balance sheet remained strong with the Bank closing the quarter ended March 31, 2019, with Total Assets of N3.556trillion and Shareholders’ Funds of N627.2Billion. In terms of Assets quality, NPL ratio and Cost of Risk closed 7.03 per cent and 0.05per cent in March 2019 from 7.30per cent and 0.34per cent in December 2018 respectively. Arik Air says it still has its sights set on recommencing it’s suspended international operations but that the plans may take some time given that the processes are complex and coupled with issues inherited from past management. Anthony Joshua’s opponent Jarrell Miller fails drugs test Anthony Joshua’s world title fight against Jarrell Miller is now in doubt after the latter tested positive for a banned substance in a Voluntary Anti-Doping Association test. The bout is scheduled for the New York Madison Garden on June and would have been Joshua’s debut in the United States. Both camps have been informed which was discovered after Voluntary Anti-Doping Associationconducted (Vada) urine test on 20 March. Recalled Miller accused Joshua of using performanceenhancing drugs during their

build-up towards the fight. “We are in the process of obtaining further information about Vada’s finding and will have more to say soon on this developing situation. In the meantime, Jarrell continues to train,” said Miller’s copromoter Dmitriy Salita. Joshua’s promoter, Eddie Hearn, added: “We have been informed by Vada that there has been an adverse finding in Jarrell Miller’s sample collected on March 20th, 2019. “We are working with all relevant parties and will update with more details soon. AJ’s preparation continues for June 1st at MSG (Madison Square Garden).”
