…Pot Shops Appeal Closures?

THE LATEST: Two of the three medical marijuana dispensaries red-tagged and closed on January 24 for municipal/building code violations appealed the city’s actions at a six-hour hearing on February 4. The hearing was presided over by retired Orange County Judge Jim Smith at City Hall. Smith was approved to hear the case in a special meeting of the City Council held earlier the same day. The council had previously agreed that the appeals should be heard by an impartial third party in order to avoid the appearance of bias against the dispensaries. Attorneys for Holistic Health and Beach Cities Collective said in the hearing that the city violated their clients’ right to due process by not inspecting the shops before red-tagging and closing them down and alleged that the city’s use of the municipal and building code was a tactic used to unfairly target medical marijuana collectives. They also argued that the city had been given opportunity to inspect their premises before the closures. City officials said that the closures were not related to the marijuana issue or the now 18-month legal volley between the city and the collectives and that in order to be inspected businesses must have a certificate of occupancy. Beach Cities was operating without one and Holistic Health’s was revoked for incorrectly listing the type of business. The city asked Smith to allow the collectives to reopen if they file the required certificate of occupancy and building permit forms. Because city zoning codes do not specifically mention collectives, the sale of marijuana is not a permitted business. A fact that Munoz said would be taken off the table for now since the issue is currently in the court system. At the last council meeting Munoz also announced the city was dropping the battle for business records originally subpoenaed in order to determine whether the dispensaries were operating according to California State law. WHAT’S NEXT: Smith’s decision whether the businesses will be allowed to reopen is expected some time this week but had not yet been announced at press time. www.danapointtimes.com

…Bulky Item Disposal and Recycling Event?

THE LATEST: The City of Dana Point and waste hauler CR&R are hosting a Community Cleanup Day on Saturday, February, 12, from 7:30 a.m. to 2:30 p.m. at Dana Hills High, 33333 Golden Lantern, and Palisades Elementary, 26462 Via Sacramento. Bulky items such as large appliances, furniture, televisions, computers, office machines and green waste will be accepted free of charge. Florescent light bulbs and household batteries will also be collected and Goodwill Industries will be on hand to accept donated items. Household Hazardous Waste such as paint, motor oil, and fertilizers will not be accepted. WHAT’S NEXT: More than half of the items collected at these city events are recycled. …Recycling Program to Benefit High School?

THE LATEST: The Parent Teacher Student Association (PTSA) at Dana Hills High School announced the continuation of a community recycling program to benefit student programs funded by PTSA. One Saturday a month, residents can drive by the high school and drop off plastic bottles and cans which will be collected, sorted and recycled by student volunteers from the school’s chapter of the California Scholarship Federation (CSF). CSF members are required to work three recycling events per semester to maintain their membership. “We are thrilled to have our PTSA partnering with CSF on this important school and community program, said Dr. Robert

Nye, principal. “The events will allow our CSF students who are busy with sports or other after school activities the opportunity to more easily earn their required recycling hours.” WHAT’S NEXT: The next community event is scheduled for Saturday, January 22, on campus at 33333 Golden Lantern Street. Residents can pull up to the curb in their vehicle from 9 a.m. to 11 a.m. and student volunteers will haul out the recyclables. PTSA member Sunita Boddu added that it is the group’s hope that as word gets out, local residents will save their recyclables for Dana Hills and drop them off every month. …CUSD Budget Woes?

THE LATEST: Even after $90 million in cuts over the past three years, the Capistrano Unified School District will need to trim at least $8.4 million more from its 2011-2012 budget, administrators said Tuesday. And that’s in the “best case” scenario. Already the pressure is building to support Governor Jerry Brown’s push to extend state taxes. If that fails, CUSD will likely need to cut $350 per student. Projected enrollment for the next year is 50,523, Superintendent for Business and Support Services Ron Lebs told trustees. The worst-case scenario could see $25 million in cuts, Lebs said. In addition to the state budget’s woes, the district must grapple with a potential $2.8 million increase in mental-health costs for educating students who require special situations, $700,000 for new charter schools and other issues. WHAT’S NEXT: Trustees on Tuesday approved the timeline for getting the budget approved. Lebs warned the district will likely returned to a “qualified” status with its budget, meaning more county oversight because CUSD is admitting it might not have enough cash to pay its bills. Additionally, Lebs said, the budget issue could become so dire that CUSD returns to “basic aid” status, meaning the district is funded by local property taxes instead of state money.

…Disaster Assistance for Flooding Victims?

THE LATEST: California residents and business owners affected by the winter storms— that happened between Dec.17 through Jan. 4—can access low-interest loans from the U. S. Small Business Administration. The agency declared a disaster following the denial of the state’s request for a major disaster declaration. The disaster declaration includes Orange County. Disaster loans up to $200,000 are available to homeowners to repair or replace damaged or destroyed real estate. Homeowners and renters are eligible for up to $40,000 to repair or replace damaged or destroyed personal property. Businesses and nonprofits may borrow up to $2 million to repair or replace damaged or destroyed real estate, machinery and equipment, inventory, and other assets. SBA can also lend funds to homeowners and businesses to help with the cost of making improvements that protect, prevent or minimize the same type of disaster damage from occurring in the future. The filing deadline to return applications for property damage is April 4. The deadline to return economic injury applications is November 2. WHAT’S NEXT: As of Tuesday, the SBA has opened Disaster Loan Outreach Centers to issue loan applications, answer questions about SBA’s disaster loan program, explain the application process and help each individual complete their application. Velasco, 17, has been a member of the club since 2008 and has volunteered more than 400 hours of club and community service. As the Youth of the Year for the Boys & Girls Clubs of Capistrano Valley, Velasco is among hundreds of local youth across the country recognized by Boys & Girls Clubs of America (BGCA) for his sound character, leadership skills and willingness to give back to the community. Monday, February 7 SUSPICIOUS PERSON Pacific Coast Highway, 34300 Block (5:26 p.m.) One male and one female were observed sitting in the back corner on the front porch of a local fast food restaurant. Two other males and one other female were seen there as well and the caller thought they were all together. He believed the group may have been selling illegal drugs. The informant stated his father was in law enforcement making him (the caller) an expert on drug behavior. The subjects were said to have money and little packages and were making multiple trips to the bathroom. A group of Dana Hills High School students will travel to Las Vegas to compete in the Association of Equipment Manufacturers (AEM) Construction Challenge National Championships March 21-25 at the international CONEXPO-CON/AGG construction industries trade show. Students from Dana Hills High School are advancing to the national finals after finishing third in the Seattle Qualifying Rally on January 15. The Dana Hills team will be the only California representatives at the national competition. Regional rallies across the U.S. and Canada gave students the chance to demonstrate their creative abilities and imagination as they vied to secure a spot to the national competition by building structures that related to transportation and water infrastructure. At the national championships, the top 24 teams that advance from the nine regional rallies will compete for scholarships and other prizes and have the opportunity to meet and learn from leaders in the construction industry. ASSIST OUTSIDE AGENCY Avenida Las Palmas, 26900 Block (4:43 p.m.) A caller reported his girlfriend is mentally ill, out of control and may need an involuntary psychiatric hold. DRIVING Stonehill Drive / Del Obispo Street (10:24 a.m.) A man called authorities to report that he had detained a subject who he had observed falling out of his car and could hardly stand or walk. The 60-year-old male subject said he has arthritis in his leg, hence the fall and difficulty with walking. The caller told authorities that the subject was bruised but refused medical assistance.

Sunday, February 6 MISSING JUVENILE Via Lagos, 33500 Block (11:17 p.m.) Deputies were contacted by a caller who said they did not want to report a juvenile runaway, but felt legally obligated. The subject was a 17-year-old chronic runaway who is a drug addict and alcohol abuser. DISTURBANCE Domingo Avenue, 25900 Block (10:34 p.m.) A caller complained that a neighbor was moving furniture around and the noise was waking the caller’s baby. DISTURBANCE Street of the Golden Lantern / Pacific Coast Highway ( 6:04 p.m.) Two male subjects were heard arguing over a female. One was

described as light skinned with dark hair, a red and white baseball shirt. The other had a dark shirt and was driving a Dodge Cavalier with an unknown license plate. WEAPONS VIOLATION Pacific Coast Highway / Ritz-Carlton Drive (3:06 a.m.) Undercover agents detained a subject on the beach near the restroom. The subject had a knife on him. DISTURBANCE Doheny Park Road, 34100 Block (1:18 a.m.) Deputies were called after a band playing at a saloon was attacked by a large group of Hispanic males yelling San Juan Capistrano gang slogans. The caller, who was a member of the band, did not want contact but asked authorities to help diffuse the situtaion so that the band could get out safely. No weapons were involved, but chairs were thrown. GENERAL BROADCAST Pacific Coast Highway / Camino Capistrano (11:47 p.m.) Authorities were called to investigate a driver who was speeding. The vehicle was headed in a northerly direction on Pacific Coast Highway and was swerving in and out of lanes. The car may have hit the curb and beer cans may have fallen out of the vehicle.

The son lives with his grandmother typically because the mother cannot handle him. He has been known to become violent. DISTURBANCE Seabrook Drive, 0 Block (12:17 a.m.) A caller reported a male and female were knocking on the door and refusing to leave. The caller also stated her son has problems with drugs and he owes a lot of people money so she was afraid to answer the door.

Friday, February 4 CITIZEN ASSIST Pointe Trinity, 24700 Block (8:20 p.m.) A man reported someone threw an egg at his vehicle approximately 20 minutes prior to his call. The egg did not hit the vehicle nor was anybody seen. SUSPICIOUS PERSON Dana Bluff West / Via Verde (1:46 p.m.) Authorities were notified of a homeless camp at the end of Dana Bluffs West over the embankment towards the I-5 freeway. New Street Parking Restrictions for RVs, Commercial Vehicles and Trailers T he City of Dana Point routinely receives complaints from residents regarding vehicles parked for extended periods of time on public streets. Many of the complaints are regarding the “storage” of large recreational vehicles, commercial vehicles, large trucks and trailers on these streets. “Why is that big rig parked here?” or “That guy has three business trucks and one is always parked in front of my house!” In response to these complaints, the city has tried multiple methods to address this issue, from enforcing the state’s 72 hour parking restriction, to prohibiting parking from 12 a.m. to 4 a.m. on problem streets, only to find that the violators were moving their vehicles just enough to avoid a citation or parking on the next street over causing new complaints. Therefore, Public Works staff in conjunction with the Sheriff’s Department and the City Traffic Improvement Subcommittee spent several public meetings developing an ordinance modification to the city’s Parking Code. On January 24, 2011, the Dana Point City Council approved an ordinance amending the Municipal Code to help address parking of commercial and recreational vehicles and trailers on public streets. This ordinance amendment will take effect on February 23, 2011, 30 days after this second reading. Similar restrictions were passed by the City of San Clemente last year. The amended ordinance (Municipal Code 12.08.050) does the following: • Prohibits parking of commercial vehicles on public streets between the hours of 2 a.m. and 6 a.m. at night,

except for the purpose of actively loading, unloading or servicing the adjacent property. During the remaining hours between 6 a.m. in the morning and 2 a.m. at night, parking is restricted to two hours. However, a resident may park one commercial vehicle used for their business in front of Brad Fowler his/her residence as long as it isn’t outsized (i.e. size greater than width of 80 inches, height of 8 feet and length of 25 feet). Also, commercial vehicles are allowed to park on the public street if they are there for construction, maintenance, urgent response such as ambulance or utility, or if they are on an arterial street directly in front of their business. • Allows trailers to be parked on public streets if: 1) It is an attached trailer for the purpose of loading, unloading, servicing or visiting the directly adjacent property for up to 24 hours or with a permit up to 72 hours. 2) It is an attached trailer parked directly in front of the property of the owner or visited residence for up to 72-hours with a city permit. 3) It is an unattached trailer for up to two hours. • Allows RVs, buses or vehicles for living purposes to park on public streets if: 1) It is parked in front of the owner’s property and is used for daily business for up to 72 hours. 2) It is loading, unloading, visiting or conducting business for the immediately adjacent property for up to 24 hours or, with a permit up to 72 hours.

Learning Something New: Ocean Friendly Gardening

Y

ou know the saying, “You learn something new every day?” This is quite true, I think—even when we just live life passively. Stuff happens, we learn something and hopefully apply it in the future. But the learning I want to talk about does not happen passively. I’m talking about the kind that you must seek out. As the mother of a high school senior applying to colleges, recently I have become acutely aware of the high cost of education. Being faced with mind-boggling tuition figures got me thinking about other opportunities for learning that are available without cost and how, all too often, I let them pass me by. I know it’s a bit late to be talking about New Year’s resolutions, but I hadn’t given the subject much thought until now. So here’s mine: I resolve to grab hold of as many free opportunities to learn something new as possible and share them with others—especially if it’s something related to, 1. caring for the environment, or 2. saving money. The Surfrider Foundation South OC Chapter is launching a program they call Ocean Friendly Gardens (OFG for Page 6 • Dana Point Times • February 11–17, 2011

short) that does both. Are you interested in learning more about how to create beautiful eye-catching landscapes at your home or business while conserving water and protecting the health of our beaches and ocean water? Then this program is just the ticket. In a world where fast food rarely means handmade, Las Golondrinas defies the model. All the food at their five local Mexican restaurants is prepared daily from scratch, said General Manager Esteban Galindo. Workers arrive at 5 a.m. to begin preparing the sauces and meats for their meals. Even the eatery’s tortilla chips, salsa and guacamole are prepared on site every day. The flour and corn tortillas are made at their San Juan Capistrano factory and delivered each day. The work doesn’t mean customers must wait for Las Golondrinas’ burritos, flautas, tacos or tamales. The restaurant’s streamlined system of preparation makes service snappy. “People know we don’t skimp,” Galindo said. “Everything is made to order that day.” Las Golondrinas’ tamales are world famous and beef tops the list of menu items that go out the door the most. Every year, especially around the holidays, orders for their seven types of tamales come in from across the country, the general manager said. “Nobody uses a recipe like ours,” he said. Galindo said his father Art Galindo started the business after years of working in restaurants. Art Galindo took his experience to create a restaurant that adhered to his high expectations of fresh ingredients, the younger Galindo said. That attitude gives the restaurant its consistency and keeps customers coming back, Esteban Galindo said. Locals have come to know the restaurant and the family. This year, Art Galindo and his wife Maria Galindo have been named the Grand Marshals of the Swallows Day Parade in San Juan Capistrano.

One of the biggest challenges an actor can have is to be the central point of an entire hour-and-a-half film. Last fall, we got neat panic attacks from Ryan Reynolds stuck in a coffin six feet under with only a cell phone to save him in Rodrigo Cortés’ Buried. Two months later, Danny Boyle brought us the same paranoia and suspense with James Franco trapped under a boulder of a canyon in 127 Hours. Based on the shocking true story, a mountain climber named Aron Ralston (played on screen by Franco), goes hiking through a Utah canyon one weekend without telling his family or friends. Only one day into the trip, and he accidentally trips over a rock, resulting in being trapped in an isolated canyon with his hand crushed by a boulder. For the next 94 minutes (or almost six days in Aron’s world) we experience him trying to escape back to society. While trying to conserve water and preserve his sanity, Aron reflects on moments of his life: His childhood with a younger sister (Lizzy Caplan) and intellectual parents (Treat Williams and Kate Burton); a former relationship with a French girl (Clémence Poésy), as well as just fantasizing about being in town again and carrying on with his life. An hour into the film he (and we, the audience) realize the only way to survive is without the hand. British director Boyle has made a reputation of displaying many popular, socially conscious themes in his films over the last two decades: Heroin addiction in Scotland (Trainspotting), morals amid the currency switch in the United Kingdom (Millions), poverty and the teens in the slums of Mumbai (Slumdog Millionaire) and now life and death of an American hiker underneath a canyon. Perhaps as an attempt to intrigue young American viewers, Boyle chooses to style the film almost as if it were an MTV video program. With product placement and triple-split screens, the method honestly takes away from the emotion and feel in a few parts of the film. Franco has come quite a long way from comedies such as Freaks and Geeks and Pineapple Express and has shown he can carry a film memorably. How to Win Sports Awards Without Lifting a Muscle I

recently learned that I had earned a state first place science award for my two-part column in this newspaper about grunion hunting. There is a long story connected to that. I first wrote about those slippery beach invaders years ago—and that article took first place in the Orange County Press Club contest—sports story category. Yes, sports story, because I wrote as if it were a football contest, with the backfield in motion, waiting for the kickoff, etc. I was more than awed when my name was called for the beautiful plaque that article earned. I rose from my seat in my very short Doris I. Walker silver lamé dress, and timidly made my way to the podium—past the table of open-mouthed Orange County sports reporters—all male. They never forgave me. But that wasn’t the end of my sports reign. Bruce Penhall won the Speedway World Championship in Europe in 1981—first American to do so in 44 years. Therefore, by tradition, the following year’s competition would be held in the winner’s home country—the USA. Word got around about my top sports award, and I got a call from the promoter of the about-to-be-staged world race. He asked if I had experienced speedway racing. “Of course,” I said—and I had! “And you are a published historian?” “Yes.” So he hired me to write the lead feature on the history of the sport for the official commemorative program of the highly-hyped world-class event coming to the Los Angeles Memorial Coliseum. But here is the untold story of my “acquaintance” with the dirt-track motorcycle

sport. Speedway races are held regularly at the Orange County Fairgrounds. During the OC Fair there, my teen son wanted to see them. I didn’t. So I left him at the track and went my way through the fair’s floral nursery and gem exhibit—delicate walking sports. The race was to end at 11 p.m., when I had arranged to meet him at the track gate. I was a few minutes early, and the race sounded like it was still going—full blast. The doorman told me that since it was the last race of the night, I could go in free to locate my son. “’Cause when it’s over, they’ll all blast through here like hell broke loose,” said he. As I stepped down the aisle to the front of the stands, I heard the brakeless bikes roaring even louder as they rounded the turn, coming toward me. Then—suddenly—many dirt clods hit me smack in the face, temporarily blinding me. After the motorcycles had moved beyond me, and I had rubbed my eyes clean, I realized that the spectators in the front rows around me had watched that dramatic turn through pieces of plexiglass held up in front of their faces. Boy, I had stumbled into the sport at just the wrong moment at the wrong spot. But I had been honest in saying that I “had experienced the sport”—right up front! So I did my research as a historian, with the help of

my sports-savvy son, and wrote the bylined piece that was highlighted in the souvenir booklet sold for an impressive price at the L. A. Coliseum World Championship. I assume those OC sports writers read it. And would you believe it? For that piece I earned a national first place sports award—from the National Federation of Press Women (they do have male members). That beefy plaque still hangs in my office among other memorable awards.

Now 2010 has brought me another grunion award—two columns’ worth—this time for best article in the field of science, from Southern California Media Professionals. They also gave me three other first places. One was in education, for my two-part history of our local high school districts. Another was for my columns on the construction of Dana Point Harbor, as it paralleled major moments in my family’s lives. All of these appeared in the Dana Point Times. A couple of other awards came this year for my history articles—about the Doheny House and the San Clemente Casino. Another prize was for my book, Orange County, A Natural History. As you can see, I have tried to be a well-rounded writer—not just a sports specialist. By the way, Bruce Penhall, the much heralded Speedway champion, was born in Orange County—Balboa—and learned his winning sport at the Orange County Fairgrounds—like I did. After several more spectacular championships, he was named to the Motorcycle Hall of Fame. Then he moved his talents to television, starring in such series as CHiPS, and did a dozen or so movies, including The Savage Beach. In contrast, I switched back to grunion hunting on this not-so-savage beach and whale watching off romantic Dana Point. Oh, I did appear in the speed-race movie, Death Race 2000, but that is definitely another story that also happened once upon this coast. DP © 2011 by Doris I. Walker

BOYS BASKETBALL • The Dolphins (1-7 SCL, 10-15) lost another two straight games to bring its losing streak to four games after getting dismantled 75-31 against El Toro on February 4 before another 60-47 loss to Capo Valley on Tuesday, February 8. In the loss to the Chargers, Dana Hills was forced to single digit scoring in the first, second and fourth quarter aside from a 13-point third frame. The Chargers meanwhile took care of business early heading into the half up 48-11 before cruising to victory. Alex Brown led the Dolphins with five points, while Jeremy Bass, Jared Moore, David Rohr and Dylan Schumacher scored three points each. The boys then hosted Capo Valley in its loss and could not find an offensive spark to spur on a rally. Though Dana Hills led 18-17 after the first period, the final three quarters were wrought with missed opportunities and low scoring. In the end, the Cougars proved too much for the home team. Bass and Brown each led with 13 points each in the loss. On Thursday, February 10, the Dolphins hosted San Clemente as each team closed out the regular season. The girls hit a rough patch at the start of the game and despite keeping the score relatively close in the second and third periods of play, with Dana Hills only trailing 35-27 entering the fourth, El Toro boosted its level of play in the final frame outscoring the Lady Dolphins 14-5 to spur on the key win. Haley Nordbak led the squad with 10 points while Allyson Ward and Katherine Chastain chipped in nine points and seven points, respectively. The team went on to face Mission Viejo at home on Wednesday, February 9, in its final game of the regular season. In the beatdown on Aliso, the team led 7-0 at the half and never looked back scoring four more in the final two periods while giving up a meager three goals. After beating Laguna Hills 2-1 on January 24, the team shutout Capo Valley 3-0 on February 5 before cruising past San Juan Hills 5-1 on Wednesday, February 9. The team entered

the half up 1-0 before scoring two more times in the second half. In the win against the Cougars, Desiree Bramlette netted a team high two goals while Haley Fedden knocked in a goal as well. Kaitlin Dickmann, Fedden and Emma Gullickson each had one assist while Kelly McCormick totaled four saves at goal. Closing out the regular season on the road Wednesday, Dana Hills was in total control against the Lady Stallions and had no problem dispatching its opponent. WRESTLING • The Dolphins claimed the Sea View League title with a first place finish at the Sea View League Finals on February 5. Dana Hills blew away the competition with 218 points and seven of its wrestlers taking the honor as league champions. Aliso Niguel (second place, 179 points), Tesoro (third place, 120 points) and El Toro (fourth place, 48s points) rounded out final league placements. Carr (second place, 103), Osorio (third place, 112), Merritt (second place 119), Kianipey (second place, 125), Grimsley (third place, 130), Tizmado (first place, 140), Seefried (first place, 145), Toavs (first place, 152), Devone (first place, 160), Abedi (first place, 171), du Chase (first place, 189), Rodriguez (first place, 215) and Botts (third place, Heavyweight) all finished with medals at the end of the duals. All qualifiers advance to the CIF-SS Eastern Divisional at Oak Hills High School of Hesperia, February 18-19.
