2. Conclusion of Contract

Consequences of Withdrawal

Offers made by DARIO’S are subject to confirmation and are conditional upon DARIO’S receiving correct deliveries on schedule from its own sub-suppliers. Customers submit orders by returning the fully completed online order form or by submitting all the requisite order data by post, telephone or fax. The customer is bound by his/her offer submitted in the manner above.

The right to set-offs on the part of the Customer is only possible in relation to counterclaims declared valid by a conclusive court judgement or which are undisputed or acknowledged.

The Customer only has a right of retention, if his/her counterclaim relates to the same contractual arrangement.

In the case of valid withdrawal, the mutually received services are to be returned and any revenues (e.g. interest) surrendered. If you are unable to return the received services and goods to us in whole or in part, or only in an impaired condition, you will be liable to pay us equivalent compensation. This does not apply if the returned good’s loss of value can be traced back exclusively to checking – as would have been available to you in the retail store.

In addition, you can avoid the obligation to pay compensation for deterioration due to the use of the goods as intended by not using the goods as if it were your property and by refraining from doing anything that could impair its value. Goods which can be despatched as parcels are to be returned at our risk. You have to bear the costs of the return if the delivered good corresponds to that ordered and if the value of the good to be sent back does not exceed 40 euros or if, in the case of goods of a higher price at the time of the withdrawal, you have not yet rendered a service in return or made a contractually agreed part payment. In all other cases, the return is free of charge for you. Goods which cannot be returned as parcels will be collected from you. Obligations for refunding payments have to be fulfilled within 30 days.

The deadline begins for you at the time of despatch of your declaration of withdrawal or the goods; for us, it is the time of their receipt.

Exclusion from right of withdrawal

The applicable prices are those valid at the time of the order. DARIO’S reserves the right to change the prices stated in the catalogue or online shop. All prices of goods or services include the VAT applicable in Germany at the time of the order.

There is no right of withdrawal for goods manufactured to customer specifications or tailored to suit their personal requirements. This applies also to goods which are not suitable for return, which perishes rapidly or whose use-by date expires within the withdrawal deadline, as well as to audio or video recordings (e.g. CDs, video-cassettes, DVDs) unsealed by the customer.

7. Shipment Shipments to inland customers will usually be performed by the parcel delivery service of DHL or by another parcel delivery service company. Deliveries of bulky goods and large amounts by shipment companies will be made to the ground floor/building entrance (behind the first ground-level lockable door). The shipment company will give notice by telephone of the delivery.

For deliveries to recipients in Germany we will charge an inland flat-rate shipment fee of € 8.95 incl. VAT. For bulky goods we will charge a bulky goods surcharge totalling € 19.95 incl. VAT. 9. Processing Return Deliveries We ask that you adequately package the goods for the return transport – preferably in the manner you received them. Please use the adhesive label contained in the invoice for addressing the return shipment. Severability Clause If any provisions of these General Terms and Conditions are wholly or partially legal invalid, or become so in the future, this circumstance does not affect the validity of the remaining General Terms and Conditions. What was the most beautiful gift you ever received?

My mother gave me a diamond necklace to my 21st birthday which was a gift to her from my father on their 10th year anniversary. It was an exquisite piece and my first important piece of jewellery.

My wife gave me for a decadal birthday one of Blancpain’s masterpieces. This extremely flat watch has the potential of becoming a heirloom. I love wearing it every day, but I also see the day when I will pass it on to my son.

When I was 15 my parents asked me for my birthday to either have a big party or a trip to a foreign country. I decided to go for the flight. The trip was from Peru to Chile and my first long journey that broadened my horizon and awoke my passion for travelling.
