All terms of this lim mited warranty are subje ect to the standard W.S S. Darley & Co. purcha ase contract standard te erms and conditions in effect at the time of sa ale, and to any written m modifications to this standard lim mited warranty agreed to o by Darley and Custom mer (including but not limited l to the Darley Pu ump Premium Protectioon Plan). Any bad faith h invocation of a warran nty claim, or customer’s breach of purchase contract (including OEM breache es), will void Darley obligations to Customer hereunder. h The scope and operation of this limited warranty shall be e interpreted under Illinois law.
THIS LIMITED WA ARRANTY IS THE ONL LY WARRANTY MADE E BY DARLEY, AND IS IN LIEU OF ANY OTH HER WARRANTIES, W WHETHER EXPRESSE ED OR IMPLIED, ANY OF WHICH ARE DISCLAIMED D, INCLUDING NOT LIM MITED TO WARRANT TIES OF MERCHANTIB BILTY, OF FITNESS FO OR A PARTICULAR P PURPOSE, OR FREED DOM FROM THE PATE ENT INFRINGEMENT. CUSTOMER C ASSUME ES ALL RISK OF USING ALL PUMPS FOR ALL A FORESEEN AND UNFORESEEN U PURP OSES. CUSTOMER’S S REMEDIES CONTAIN NED HEREIN ARE EXC CLUSIVE.
This limited warran nty shall be Customer’s s sole & exclusive contrractual remedy for any defect or failure of a Pump P or component, annd as such excludes an ny remedy or cause of action in tort or contract against Darley or any of its suppliers or distributors for liability to Customer or to any other person n for any incidental, connsequential, or other da amages (including but not limited to personal injury; dea ath; property damage due d to fire, water or any y other cause; loss of crops, c timber or wildlife e; loss of time or interruuption of operations or related costs; delays; d demurrage; lost profits; or indire ect or special damages s) arising out of or relatting to the use (includin ng any malfunction) or inability to use any origginal, repaired, replace ed, or substitute Pump, regardless of the reason for su uch damage, loss or injjury. Under no circums stance will Darley’s liability for any claim hereu under, including for breeach of warranty or anyy cause of action relate ed to an alleged breach of this warranty, exceed Customer’s C purchase prrice for the Pump or co omponent thereof which h is the subject of this w warranty.
Within 30 days of Customer’s C receipt of a Returned Goods Auth horization, Customer sh hall return the Pump orr claimed defective com mponent thereof to Darrley F.O.B Darley’s designated plant. Customer C shall bear all of its own costs of dism mantling, removing, shipping, storing, insuring g and reinstalling Pumpps or parts thereof which are submitted to Da arley for warranty evaluation n. Darley shall within a reasonable time exam mine the returned item and a determine whetherr such item is defectivee, and at Darley’s electiion, whether to repair, replace, recondition, or refund the price thereof. The amount of any refun nd shall not exceed Cu ustomer’s purchase pricce. No reimbursement or allowance will be made to Customer for Darley’s labor costs or other expe enses of repairing or re eplacing defective produ ucts or workmanship, all a such costs of which shall be billed to Custoomer. Any repaired Pumps or replacement pa arts shall also be covered by y this limited warranty, subject s to the same oriiginal Warranty Period (which shall not be exttended by reason of anny repair or replacemen nt).
Customer shall nottify Darley in writing witthin the Warranty Perio od of any claim under th his Warranty, to Darleyy’s Itasca, Illinois office (except as otherwise d directed), and the Custtomer shall comply with Darley y’s reasonable claim do ocumentation and proce essing according to Da arley’s Returned Good’s Authorization form annd procedures, which sshould be requested w when making a warranty claim.
The following repaiirs or replacement expe enses are specifically excluded e from the scop pe of this warranty: non n-defective parts worn, exhausted or consumed through normal usa age; consumable parts subject s to routine repla acement, including but not limited to pump pac cking, O-rings, gasketss, intake screens, anoddes or filters; and routin ne maintenance specifiied in the operator’s manual.

This warranty further excludes any covverage of damage or lo oss to any equipment or structures in which a Pump is incorporated or to which a Pump may be atta ached, as well as any damage d to or failure off Pump is caused by orr related to misuse, acccident, failure to mainta ain or service, abuse, neg gligence, applications which w exceed Darley’s recommended limitatio ons, or in the event of Customer’s C unauthorizeed or improper modificcation(s) of a Pump (an nd regardless of any actual or con nstructive knowledge Darley D may have of suc ch modifications), or in the event a Pump has been repaired, alteredd, or treated by anyone e other than Darley-train ned technicians.
W.S. Darley & Co., herein referred to as “Darley”, “ warrants all trruck mounted split shafft midship and PTO Da arley Pumps and accesssories of its manufactu urer to be free from deffects in material and workm manship, under normal use and service, for a period of SIX YEARS from the date placed in nto service, 6 ½ years from date of manufactturer or 6000 hours of usage (unless otherwise specified), s whichever comes first. Under this warranty, Darley will cover labor charges for a period of three yearss from the date the pum mp is placed into servicce. This warranty applies to o any pump shipped aftter July 1, 2007.
