This lawsuit seeks to vindicate the constitutional rights of Carl and Janice
Duffner, a couple that owns residential property in the City of St. Peters (“the City” or “the Defendant”), on which they have created a well-tended, beautiful flower garden that covers their entire yard. The City requires owners of residential property to dedicate a portion of their property to cultivating and maintaining turf grass, a plant Carl and Janice do not want in their yard, and the City has also attempted to dictate where in the Duffners’ yard they must plant the required turf grass. The City’s Turf Grass Mandate violates property owners’ right to decide for themselves what harmless plants they will grow on their property, and the City’s effort to specify where in their yard the Duffners 1
