More than four months after hearing oral arguments on the City's motion to dismiss, Judge Pelikan issued this three-page order dismissing the Duffners' Petition. Note that the grounds the judge relied upon for the dismissal were not actually presented in the City's motion and that the "facts" the judge recites either directly contradict the Duffner's Petition or regard matters upon which there is no evidence whatsoever.
