Liquid-cooled, twin plug, 4-valve heads and suspension upgrades – but no new models, yet! arley-Davidson’s much anticipated MY2017 announcement features the much teased launch of the new ‘Milwaukee-Eight’ 45degree liquid-cooled, twin-plug, 4-valve head engine – the ninth Big Twin power-plant in Harley’s 113year history. Initially just being seen in its touring models, CVOs and trikes, it is the first major new Big Twin engine design since the Twin Cam was introduced in 1999. That too was only announced for the touring models initially, with a ‘B’ version making its appearance in the Softails the following year. It is anticipated that Harley will likely follow a similar pattern with the ‘Eight’ eventually migrating it, or a version of it, into its cruiser platforms either for MY 2018 or through mid-cycle introductions early next year. However, the non-appearance of an expected new model showcasing the new engine fuels speculation that there may be further news to come at some stage. Namely news that sees the Twin-Cooled Twin Cam engines staying in the existing cruisers, with a new platform unveiled for the new engine –

maybe something FXR-esque, maybe something to out-muscle the Octane. In addition to power, heat, noise and vibration management have been major and much needed considerations of the engine design, with variants of two displacements being offered to begin with. There is an entry level air/liquidcooled 1750cc/107-incher, and a Twin-Cooled version utilizing the cooling technology that was introduced just a few years ago on the newer, larger

power, performance and innovation displacement Twin Cams – notably on the ‘Rushmore’ tourers. “The guiding principle behind the Milwaukee-Eight engine was our voice of customer research from every region of the world,” said Scott Miller, HarleyDavidson Vice-President of Styling and Product Development Strategy. “Riders asked us to create a new engine designed to enhance their motorcycle

touring experience in every way. Those same voices also demanded that we stay true to our legacy and respect the defining elements of a Harley-Davidson V-twin. It was a big challenge, but one we’ve met. With the Milwaukee-Eight, a new era of Harley-Davidson power, performance and innovation has been forged.” The 107-incher will initially feature on the “standard” models, with an 1870cc/114inch version on the CVO (Custom Vehicle Operations) models. “The Milwaukee-Eight engine carries the legacy of Harley-Davidson Big Twins into the future,” said Chief Powertrain Engineer Alex Bozmoski. “While respecting the essential Big Twin character, we’ve created an all-new motor. Every aspect of performance, durability and styling has been improved as a direct response to the voice of HarleyDavidson customers around the world.” In addition to addressing the power output, heat, vibration and noise issues of its heavy top-end models, the company has announced all-new front and rear suspension components as stock on all its 2017 tourers – components that are said to “enhance the comfort, control and performance.”

PREACHING TO THE CHOIR? hen I came into the motorcycle market in 1989, the Evo had already been “in-play” for some five years. As successor to the leaky-old Shovelhead it first attracted opprobrium from the righteously indignant, followed swiftly by deposit checks. The then much smaller aftermarket was still developing key and strategic new product lines for the Evo even after five years, and continued to do so right up to 1999 (indeed still continues to do so to this day). In 1999 the Twin Cam A engine (followed by the B motor for Softails in 2000) prompted a frenzy of new product development by a (then much, much, much) larger aftermarket that was distracted by the emergence of 100 percent aftermarket customs following Harley’s suspension of its crate engine program some time before. Much changed between 1984 and 1999, and just as much has changed again since. A now smaller again aftermarket, but that is still way larger and, above all, way more capable than the one that was greeting the Evo, will be all over the new ‘Milwaukee-Eight’ (M8) like a rash. We can expect to have seen the first performance parts and accessories by the time we get to the V-Twin Expo at the end of January 2017, and can expect to see the new product development momentum accelerate for some years to come. There’s no question that the new engine represents opportunities, but it spells “challenge” too…a further tightening of the patenting and copyrighting that Harley deployed with the Twin Cam, the M-8 is no doubt sewn-up tighter than a duck’s bottom. The challenges won’t only be legal – is it a coincidence that Harley has settled its lawsuit with the EPA just as a new engine with a new ECU is announced? Probably not. One of the huge changes to have taken place since 1999 is the proliferation and development of the fuel injection management and ECM tuning market. rior to the Twin Cam A in 1999, fuel injection was something exotic with only a handful of “Gurus of Go” pioneering injected delivery on Harley V-twins – just as there were a mere handful of visionaries pushing twin plug conversions (Shovelheads most famously) and 4-valve heads (remember the Jim Feuling developed Rivera 4-valve heads?). Unlike those pioneers, the preachers of the electronic fueling gospel actually had an aftermarket to go after once the Twin Cam was in-play, sales to drive their R&D investments, but with the changes Harley have made to the M-8’s ECU, just how far back to the drawing board are they going to have to go - to say nothing of the legal obstacles. Equally, the redesigned exhaust positioning and configurations, the suspension improvements, the engine changes themselves and improvements to the charging system, and a lot more besides, all have opportunity writ large, but so too they have expense, legal and better-product obstacles writ just as large. A better product? Well yes, actually. Sure the M-8 is flawed, all volume production engines that have to meet rigorous (international, no less) compliance standards, be practically and cost-effectively serviceable, meet a price-point and keep the manufacturer in business for the next 15-year cycle (or longer) absolutely have to have a back story of compromise. But it nonetheless has to be a better product, and the M-8 absolutely is. At last, is this the Harley engine that won’t burn your legs, shake your teeth out and leave you last at the lights? Well, somewhat – in the context of Harley itself, it is a major leap forward; but in the

context of the competitive offerings Harley needs to sell against, and the new market opportunities that Harley needs to sell into, I’m afraid to say this engine barely even gets them a little bit pregnant. he power output ratings of the current Indian and Victory Motorcycle offerings aside, this is an engine that preaches to the choir. It offers a way improved ownership and riding experience to those who wish to buy into the existing Harley offer, but it will only attract a very few for whom the whole concept of the Harley ownership and riding experience is alien. The possible implication in Harley’s own press announcements is that this may in fact not follow the 1999/2000 A/B pattern, and “just” after all be a better can opener for Harley’s existing tourer market. Which would be fine, nothing wrong with that, by all means look after the core customer first. But it is what happens now that is really, really important. The recently almost obligatory deployment of mid-cycle announcements, the much needed “proof of life” where the Softails, Dynas and Sportsters are concerned and, above all, the much, much, much needed real outreach to people for whom the Bar & Shield is just a flag they pass at the side of the freeway, are all causes for optimism that there is yet more to come, much more to come, in the next 6 to 24 months. The irony in Harley’s M-8 PR material is the implicit acknowledgement that the 1990s developed tech of the existing Big Twin and Sportster engines simply are not good enough. The Motor Company appears to be acknowledging that the existing engines simply will not sell in the third decade of the 21st century.The development ground work of what became the Twin Cam was done at least 20 years ago, and the outcome of that process of compromise cannot possibly remain a robust offer five years from now. ith Matt Levatich’s focus on “smart manufacturing”, short lead-times, versatility and flexible response to market opportunities, what we have seen with the Twin Cam, good though it is for what it is, cannot possibly be all there is. Even the investment community appears to understand that, with the M-8 announcement barely measuring on the Wall Street Richter Scale. Indeed, just as the 1999 and 2000 Twin Cams were a start-point, Harley has acknowledged that they have left a lot on the table where this first iteration of the M-8 is concerned. With Screamin’ Eagle Stage I, II and III kits offering up to a 24 percent increase in torque over the stock engine, the charging system only just now starting to be acknowledged as an issue, Harley deliberately and unnecessarily leaving some vibrations in the drivetrain in order to maintain the “feel” of an engine on which the fins are approaching redundancy and the sound approaching track-day, yes, Harley realize they are only starting on a new journey with the ‘Milwaukee-Eight’, not arriving at their destination yet. They also know only too well that combined critical mass of the markets they now need to reach are way bigger than the core touring market, so surely there just absolutely must be way more to come in the next 6 to 24 months?

NEWS Prompted by an analyst research report, BRP (Bombardier Recreational Products) has confirmed that it is exploring options to enter the motorcycle market. Best known for their SeaDoo PWC line, snowmobile and Can-Am Spyder reverse three-wheeler, BRP once sold Can-Am bikes (1970s) when it was owned by aircraft and train manufacturer Bombardier, and is the owner of Rotax, the Austrian engine manufacturer. Harley-Davidson has approved a cash dividend of $0.35 per share for the third quarter of 2016. The dividend is payable Sept. 23, 2016, to the holders of record of the Company's common stock on Sept. 13, 2016. California has now, finally, legally recognized “lane splitting” by motorcycles. Riding Denis Manning’s legendary “7” streamliner on the 3-mile short course at the Bonneville Motorcycle Speed Trials, Valerie Thompson has become the world’s fastest female motorcycle racer. She recorded a measured mile average speed of 304 mph (489.66 km/h). Thompson made two runs over 294 and 304 mph, with a highest exit speed exceeding 313 mph, which also earned her the event top speed award. Indian Motorcycle confirmed that its all-new Indian Scout FTR750 race bike will make its racing debut on Sunday, September 25 at the Ramspur Winery Santa Rosa Mile AMA Pro Flat Track at the Sonoma County Fairgrounds race in Santa Rosa, California. Debut race rider will be Joe Kopp – one of just 15 riders to complete the Dirt Track "Grand Slam," with victories on short track, TT, half-mile, and mile courses. The United States is Europe’s third largest country of origin for imports of motorcycles and related products, with nearly 16% of the imported motorcycle product in Europe coming from USA. Japan remains the largest source (nearly 42 %) followed by China (20%).

Custom builder community and wider industry reaction to the opportunities provided for doing business at this year’s AMD World Championship, the flagship feature at INTERMOT Customized in Hall 10 in October, continues to be overwhelmingly positive. Indeed, with the number of booths now being taken by aftermarket vendors (and additional custom program booths by OE manufacturers, including HarleyDavidson), overall reaction to the concept that organizers Koelnmesse are successfully developing has been excellent. There are 63 builders confirmed for the AMD World Championship, coming to Cologne, Germany, from 27 different countries (including as far afield as the USA, Japan, South Korea, Israel, Russia and Ukraine); in total some 83 bikes are entered into the five classes. Set-up day for the event is Monday October 3rd, with Tuesday 4th as Press Day, Wednesday 5th as International Trade Visitor and VIP Visitor Preview Day, with public admittance from Thursday 6th through to Sunday 9th. The awards ceremony will be held at 4:00pm on Sunday 9th. Hall 10 at INTERMOT is one of the best attended halls, being right alongside the two primary visitor entrances – in 2014 over 200,000 people visited INTERMOT in total, with the 11th AMD World Championship being won by Belgian Fred “Krugger” Bertrand’s “Nurb’s” – a futuristic 1650cc BMW. www.amdchampionship.com

Corbin awarded U.S. patent for ‘Sparrow’ ZEV design Back in the late 1990s and early 2000s, motorcycle seat designer Mike Corbin was among early adopters where seeing the future potential for 21st century design and production of electric vehicles was concerned. Headquartered at his Hollister, California seat manufacturing facility, and drawing heavily on the materials and production expertise he’d garnered from decades as a leading high-volume motorcycle seat designer and manufacturer, his Corbin Motors off-shoot business designed and prototyped the “Sparrow’ - a lightweight, 3-wheeled, single passenger, zero emissions electric

vehicle (ZEV). It was well received at the time, even among those who were not paid-up to the vision of future transportation

needs that Corbin and his group of “fellow travellers” shared. Although that early business iteration succumbed in 2003, Corbin has kept the dream alive, quietly continuing R&D even through the toughest of financial times until 2010, when a new design was ready for development. Now his new and technologically advanced version of the original ‘Sparrow’ has been awarded a U.S. patent for a design that reduces the wind resistance of a vehicle. Still using the original 3-wheeled, single passenger configuration, a lithium ion

power source with an electronic battery management system is said to produce prolonged battery life and greater range. The new model made its debut this summer at the Fourth of July weekend during Corbin’s annual Hollister Rally Open House. In 2017 Corbin plans to produce 100 hand-built ‘Beta Sparrows’, each one displaying an exclusive number, which will also be the individual VIN # 1/100 through 100/100. www.corbin.com/motors

More Harley layoffs Harley-Davidson has confirmed more layoffs – affecting some 200 employees during its third quarter. Union sources said many of the layoffs will take place at Harley’s assembly plant in York, Pa., but that a handful will occur at the engine plant in Menomonee Falls, where the company employs approximately 1,000 people, and there will be approximately 35 layoffs at the plant in Tomahawk. Some 117 of the layoffs will occur at the York plant, in Springettsbury Township, Pa., that employs approximately 950 members of the International Association of Machinists and Aerospace Workers Local 75. For Harley, spokeswoman Maripat Blankenheim said: “The company continually

reacts to industry and market changes to provide the best products and services to our customers. To that end, as we adjust our production plan to align with 2016 guidance, we are making the necessary changes to right-size the company. “As a result, approximately 200 regular and casual union employees will be impacted across our U.S. plants. The majority of impacts are scheduled for the fourth quarter.”

The Speed Merchant to distribute EMD parts designs in the United States In a relationship that started out with a design for a replacement primary for the Triumph Bonneville, parts and accessory designer and manufacturer The Speed Merchant of California has taken on domestic US distribution of French manufacturer EMD’s (Esteves Motorcycle Design) Harley and ‘metric’ parts designs, with EMD becoming a distributor for The Speed Merchant in Europe. That primary was built to match the design of Speed Merchant’s stator and FXR primary and gear box cover

sprocket covers; a rocker cover followed, and over time the relationship between these two emerging parts businesses deepened to where it is today. “Our relationship with Brandon and Dan at The Speed Merchant had gone so well in terms of parts design collaborations and sales of aftermarket parts for Triumph models that when I started to look for someone who could help us to further build our aftermarket product sales in

the United States, especially our Harley parts and accessory designs, The Speed Merchant was the obvious choice,” says Nico Esteves. EMD are best known for their contemporary take on the classic ribbed and finned look that started on primaries back in the ‘60s and ‘70s in the hands of people like Robban’s in Sweden and Randy Smith (of Custom Cycle Engineering fame) in California. EMD sells classically styled, high quality cast parts that have done much

‘Milwaukee-eight’

– tourers only?

At last – is this the Harley engine that won’t burn your legs, shake your teeth out and leave you last at the lights ell, not quite, especially where power comparisons with competitive offerings (Indian Motorcycle aside) are concerned. But that hasn’t stopped Harley from boasting (with justification) that the all-new ‘Milwaukee-Eight’ (M-8) engine delivers more power and an improved motorcycling experience for riders and passengers while retaining the iconic look, sound and feel of its predecessors.” True, it is a mostly all-new design, certainly as far as the heads are concerned, and the look is okay, even if the sound is more race-bike than “potato, potato” now. The M-8 is said to offer “quicker throttle response, more passing power, purer sound, a smoother ride and more of the feeling riders want from a Harley-Davidson Touring motorcycle engine.” In other words, is Harley accepting that the Twin Cam offered relatively poor throttle response, poor power in realworld traffic conditions, and ran too hot with way too much noise and way too much in the way of vibrations? It kind of sounds like that to go by the wording of their press release, and note the possible implications buried in the detail of their remarks here – “more of the feeling riders want from a Harley-Davidson Touring motorcycle engine.” One line of speculation suggests that in a parallel to what happened with the two-stage introduction of the Twin Cam in 1999/2000, there is likely to be a ‘B’ version of the ‘Eight’ next year for the cruisers – or in a new mid-cycle cruiser-esque launch or launches. Alternately, are Harley quite clearly signalling here that, in fact, the ‘Milwaukee-Eight’ is destined to be a tourer engine “only”? In which case, will the cruisers be allowed to trade on the Rushmore hype of the Twin-Cooled motor for some years to come, or (could we be this lucky?) is there in fact another big step in refreshment and refinement of the offer still to come with, whisper it softly, another engine platform also about to emerge at some stage in the next six to 24 months? Either way, the new ‘Milwaukee-Eight’ engines will power every 2017 Harley-

The “strategic cooling” of the “TwinCooled” concept (namely liquid and air) allowed the classic finned look to remain functional rather than just being visual and brand value. However, the concept is destined to struggle to keep up with the increased heat generated by the increased power. That is why Harley has embraced the reduction in combustion chamber surface area geometry that the eight-valve chamber redesign requires. The new engine is said to produce 10

percent more torque than the engine it replaces in Touring models. In addition to increased displacement, it features a higher compression ratio and 50 percent more intake and exhaust flow capacity. The valve train is said to require no adjustment as the design of the rocker arms enables valve lash to be set at the factory for life; dual spark plugs for each cylinder (and advanced ignition timing) contribute to more efficient combustion. Weighing the same as the lowerpowered engine it replaces, the power-to-weight ratio of the ‘Eight’ is another of the significant factors in delivering increased power - there can be no doubt that even as you read this, the aftermarket will be busy working on lighter weight, higher strength components to push that ratio way further. The 107-inch version of the ‘Eight’ is said to accelerate 11 percent quicker 0-60 mph (equal to a two to three bike length improvement), and 11 percent quicker from 60-80 mph in top gear (equal to a one to two bike length improvement), compared to the Twin Cam High Output 103. The 114-inch version is said to accelerate 8 percent quicker 0-60mph, and 12 percent quicker 60-80mph than the Twin Cam 110. Heat has always been the big issue for

the Twin Cam. Harley describe the ‘Eight’ as offering “improved rider and passenger thermal comfort due to reduced heat absorption, increased heat rejection and a redesigned exhaust system. With a precision cooling strategy [developed for the Rushmores] based on the specific demands of the motorcycle model, using a targeted flow of either oil or liquid coolant around the hottest areas of the cylinder heads. “A new knock sensor for each cylinder enables more precise timing control. The rear exhaust pipe is repositioned and the exhaust catalyst is relocated to move heat away from the passenger. Idle speed is lowered from 1,000 rpm to 850 rpm.” The new sensor is based on reading acceleration to enable the ECM to manage ignition timing rather than the ion-sending knock detection of the Twin Cam. The mapped (command) based system of the Twin Cam ECM has been

The engine intake and air cleaner are designed to reduce intake sound while ensuring maximum air flow. As a result, the new engine is mechanically quieter, “enabling a richer exhaust tone, meeting all global noise and emissions standards, while allowing the unmistakable rumble of its exhaust note to resonate.” The charging system delivers 50 percent more output to the battery at

The ‘Wedge II’ fairing for mid-sized motorcycles

Last year we featured Blackmore Manufacturing’s new ‘Wedge’ frame mount fairing for Dyna, FXR and Sportster models. The company has now updated its design, using TPO rather than fiberglass in the construction of the ‘Wedge II’. TPO (thermoplastic olefin or olefinic thermoplastic elastomers) is an advanced form of ABS that has significant manufacturing process and durability advantages. The ‘Wedge II’ has the same stability and wind protection as the original, but it weighs less, offers increased storage, easy installation of radio and speakers, a finished surface that requires very little preparation before painting, and improved resistance to the effects of solar UV radiation. The ‘Wedge II’ offers four windshield options from 7 to 18 inches and headlight rings and turn signals that come in standard black or optional chrome. Bill Blackmore, who designed and manufactures the ‘Wedge II’, says the design and concept for a framemounted fairing goes back to a very well known fairing that was extremely popular in the 1970s and 1980s. “As a young man I sold Hondas at a big dealership, and I was exposed to the ‘Vetter’ fairing at the same time. I sold a lot of Hondas, and a lot of those left the

store with a Vetter fairing fitted. Since then I’ve had a frame-mounted fairing on most of my motorcycles. “I like the stability and the comfort that a good frame-mounted fairing offers. I bought a secondhand FXRT that was fitted with the ugliest fairing I’ve ever seen, the bike looked like a pretty girl in need of a new dress. So I built a fairing from fiberglass for the FXR. When I started to ride that bike, people always asked where they could get one of their own, and that’s how the ‘Wedge’ came about. “A frame-mounted fairing is inherently more stable. It offers more wind protection and storage, and is less affected by side winds and the kind of pressure wave that every biker experiences when an 18-wheeler passes them on the Freeway.” Each ‘Wedge’ fairing is supplied with a complete mounting kit, including all necessary brackets, fasteners and a wiring harness, in a finish that needs minimal preparation for paint. Updated ‘Steel Kore’ rake kit Dyna mid controls MC Baggers have updated their ‘Steel Kore’ rake kit for ’14 and up touring models with 26” wheel setup, making it possible to complete a 26” build without the need to make any changes to the inner components of the factory fork. In other words, there is now no need to extend the factory forks. Included with every kit are the extended fork cans, pre-cut and measured Goodridge brake lines, and their patent-pending MC Baggers ABS bearing. The installation leaves a total rake of 38 degrees, with a 5.85-inch trail number. From the rear axle to front axle, the wheelbase length is only 5 inches longer than the stock/factory. The ground clearance will be 0.5 inch lower than the stock/factory clearance. Tension reliever manual primary chain adjuster Twin Power continues to add to their growing line of aftermarket parts and accessories for V-twin motorcycles. The newest addition is this tension reliever manual primary chain adjuster, designed to eliminate previous issues with keeping the primary chain at the right tension. “An overtightened primary chain is known to cause premature failure of the engine, transmission and primary bearing as well as to cause other complications,” says James Simonelli, Brand Manager for Twin Power. “This problem plagues 2006 Dyna and 2007 and later Big Twin models. These motorcycles came equipped with an automatic ratcheting primary chain tensioner, which is the culprit.” Twin Power has developed a solution, which keeps the problem of overtightening from occurring. BRIEFS According to data from the IVM, the motorcycle industry trade association in Germany, Harley-Davidson had sold 8,583 units for the first seven months of the year for a sixth placed 7.43 percent market share – up from the 7,638 units for the same period in 2015. The Softail Slim is their bestselling model in Germany so far in 2016. Top Dog there is BMW with a 16.36 percent market share; their R nineT cruiser is now their second best-selling model in Germany. “Chopper” style bikes are reported as accounting for some 12.79 percent in total of the German market with 910,624 units for the YTD. As at August 30, Orlando, Florida based AIMExpo (October 13-16) say advance dealer registrations were up by +148 percent over 2015. S&S has appointed former Vance & Hines and White Bros exhaust development engineer Hunter Klee to its Exhaust Design/ Manufacturing team in the role of Director of Exhaust Development. “Hunter brings a decade of powersports exhaust design and manufacturing expertise and will help manage the recently created state of the art facility at our La Crosse, WI, complex.” The United States remains Europe’s largest market for exports of motorcycles and related products with nearly 30% of European production being imported in to the USA. Japan is Europe’s second largest market, followed by Australia, Canada, South Africa and Brazil.

Harley busted – Federal penalties “agreed” for “defeat device” violations Harley-Davidson has settled a dispute with the EPA (Environmental Protection Agency), which will see it pay an agreed civil fine of $12 million and stop selling illegal aftermarket devices that cause its motorcycles to emit illegal levels of pollution. The dispute centers on sales of some 340,000 “super tuners” that enabled motorcycles since 2008 to pollute the air at levels that are outside of the parameters that Harley should be observing in the context of their EPA product certification approval – in essence, Harley has been caught selling what the EPA regards as “defeat devices”. According to the U.S. government, the sale of such “defeat devices” violates the Federal Clean Air Act. Harley was also accused of selling more than 12,600 motorcycles that were not covered by an EPA certification governing clean air compliance. The settlement calls for Harley to stop selling the super tuners by August 23, and buy back and destroy all such tuners in stock at its dealerships. EPA said the modified settings increase power and performance, but also increase the motorcycle’s emissions of hydrocarbons and nitrogen oxides. Harley will also spend $3 million on an unrelated project to reduce air pollution, the U.S. Justice Department said. In a statement, John Cruden, Head of the Justice Department’s environmental and natural resources division, said “Given Harley-Davidson’s prominence in the industry, this is a very significant step towards our goal of stopping the sale of illegal aftermarket defeat devices that cause harmful pollution on our roads and in our communities.” The statement went on to say that “Anyone else who manufactures, sells or installs these types of illegal products

should take heed of Harley-Davidson’s corrective actions and immediately stop violating the law.” Since January 2008, Harley-Davidson has manufactured and sold two types of tuners, which when hooked up to Harley-Davidson motorcycles, allow users to modify certain aspects of a motorcycle’s emissions control system. The announcement comes amid greater scrutiny on emissions and “defeat devices” by U.S. regulators after Volkswagen AG admitted to using illegal software to evade U.S. emissions standards in nearly 600,000 U.S. vehicles. “This settlement immediately stops the

sale of illegal aftermarket defeat devices used on public roads that threaten the air we breathe,” said Cynthia Giles, assistant administrator for EPA’s Office of Enforcement and Compliance Assurance. Harley must obtain a certification from the California Air Resources Board for any tuners it sells in the United States in the future. For any super tuners that Harley-Davidson sells outside the United States in the future, it must label them as not for use in the United States. EPA said it discovered the violations through a routine inspection and information Harley-Davidson submitted. In its own statement, Harley-Davidson sought to play the “good corporate citizen” card, while disagreeing with EPA’s interpretation of the law.

“This settlement is not an admission of liability, but instead represents a good faith compromise with the EPA on areas of law we interpret differently, particularly EPA’s assertion that it is illegal for anyone to modify a certified vehicle even if it will be used solely for off-road/closed-course competition,” said Ed Moreland, Harley-Davidson’s Government Affairs Director. “For more than two decades, we have sold this product under an accepted regulatory approach that permitted the sale of competition-only parts. In our view, it is and was legal to use in race conditions in the U.S.” Harley-Davidson, one of many suppliers in the aftermarket performance parts industry, has safeguards in place to educate dealers and customers on the implications of installing HarleyDavidson performance products on their Harley-Davidson motorcycles. This includes clear product labeling of competition-only products and detail on what performance enhancements are considered street legal and for competition-use only, the legal consequences of tampering with emission controls and components, and what enhancements would void the vehicle warranty. “Concern for our U.S. customers and dealers weighed heavily in reaching this compromise with the EPA,” said Moreland. “By settling this matter, we can focus our future attention and resources on product innovation, rather than a prolonged legal battle with the EPA.” At one stage Harley’s share price had fallen as much as 8 percent after news of the allegations had surfaced in a U.S. lawsuit filed in Washington before the settlement was announced. On Monday 22nd Harley’s shares opened trading at $53.65 – only a tad off the preannouncement level.
