EDITOR’S NOTE April begins with a day people traditionally use to play pranks on one another. A popular theory for the origin of April Fools shenanigans is that it relates to those people who continued to celebrate New Year’s Day on April 1st after the 1582 implementation of the Gregorian Christian calendar. It might not have been a joke but peoples understanding of what it is and what it means for us on a day to day basis is. We take some time to acquaint ourselves with some of the main points of the “amnesty” in this issue. We catch up on changes at African Bank and RCS in our News section and feature an interview with both a credit provider and a Debt Counsellor in this issue. In our LIVING ON LESS section we look at another way to reduce your vehicle expenses and fuel usage. If you want to save then be sure to check it out. RCS gets sold to a French Bank

RCS, a credit provider part owned by Standard Bank and Foschini, has been sold for R2.6 Billion to a subsidiary of BNP Paribas, a French bank. RCS services more than 18 000 different retailers and has a total book of around R5 Billion. Standard Bank who have recently set themselves the goal of expanding their bond market share particularly in the affordable housing market say they see RCS as non essential to their core business and can use the capitol to boost other parts of their operation. Foschini say they will put the funds back into the group and this will help boost their balance sheet. It seems to be working as their share price went up significantly after the announcement. The sale comes at a time when most retailers and banks are reducing their unsecured credit lending. Around 25% of RCS business is in personal loans and the rest is credit card related. The deal will see Foschini make R1.4 Billion and Standard Bank R1.2 Billion.

This year will see the hosting of the first annual debt review industry Awards. Hard work by Debt Counsellors, Credit Providers and PDAs will be recognised at the Debt Review Awards Gala where awards will be handed out to winners. The Gala will be held in July in Cape Town. The National Credit Regulator (NCR) visits Credit Providers and Debt Counsellors country wide each year to ensure that certain levels of professionalism are met by registered individuals and companies. The visits are called monitoring visits. When visiting Debt Counsellors, in particular, the NCR use a quick reference sheet or checklist of points to cover. This is called the NCR monitoring tool. It sets out which items should be considered. NCR Consumer Credit Report

Each quarter the NCR releases statistics about consumer credit. Recently the NCR released new statistics for the time around the end of 2013. The latest report is now out. Some of the highlights are that more consumers (350 000 new consumers) are now getting access to credit and that another 171 000 consumer’s accounts are now significantly behind on payment as they are no longer able to keep up to date with payments. South Africa now has 9 760 000 consumers who are in financial trouble and cannot pay their accounts timeously.

This has been a common thread through all recent reports. More consumers getting access to credit and more consumers not able to pay their credit. Essentially this means more and more people are crossing the line into over indebtedness. These consumers desperately need to seek assistance to resolve their situation. Seeing this the NCR have begged consumers to try live within their means. Basically they are asking consumers not to make use of credit to elevate their standard of living. During the last 3 months of 2013 (compared to Dec 2012) credit providers handed out around R1.45 Billion in new credit. The report also showed that more people than ever have been asking for (but not all getting) new credit. Interestingly there was less short term credit granted as many credit providers have started to reduce their risk in this area after years of exponential growth in this portion of the credit market. The banks own 85% of all the Trillions of Rands owed in the market. CREDIT INFORMATION AMNESTY CONFUSION Confusion over the so called Credit Amnesty is rife at the moment. Does it confuse you? Well don’t feel alone. It seems that hardly anyone knows what this amnesty means.

One Debt Counsellor said of consumers he visited that they told him that they heard on tv news (on SABC1) that the government is going to “grant them amnesty” and they will no longer be “obliged to pay their debts”. To their understanding this credit amnesty means their debts will be written off or “cancelled”. Others claim it is all just a huge political campaign to gain votes from consumers prior to the elections but is actually “meaningless”. It is not only consumers who are confused. One irate consumer says: “ I contacted Transunion and spoke to two of their agents on different days. They both told me that the “Slow-payer” mark will not be removed on my credit profile before two years even if I settled the account. Their implication was that, credit amnesty does not apply to those marked as “slow payers”. It seems that even the staff of well known and respected credit bureaus are confused about what the amnesty means. Why consumers are confused The word amnesty is being used by politicians and the media, which is a very misleading word. It implies that some debt might be written off or pardoned. This is simply not the case at all. The new regulation which (unfortunately) came into effect on April 1st 2014 effects only information shown on credit bureaus and not the actual debts themselves. So why use the word amnesty? Who knows? It was clearly a poor decision based on all the confusion it has caused. What is the Amnesty and how will it effect you? The new regulation is actually called the Removal of Adverse Consumer Credit

The regulation calls for credit bureaus and credit providers to work together to firstly remove any nasty seeming descriptions on your credit bureau reports and then to secondly remove any information about past judgments which you pay off straight way on an ongoing basis in the future. Will my old debts be written off? NO Will I still have to pay my debts? YES If I got a judgment against my name will it be removed from my credit report? Only if you pay up the debt. Once you do pay up the debt though, it will automatically be removed from your credit bureau report rather than you having to have it removed yourself. What if I only pay off the Judgment in a years time - will it be removed then? Yes, This regulation will stay in effect for years to come. If you pay up the debt then the record of the judgment will be removed for you. What information will be removed from my credit bureau report? Words like” Slow Payer” or “delinquent” or “handed over to collections” will no longer be shown. The government feel this makes people think you are a bad person rather than just a bad payer. Any funny marks (which indicate negative things about how consumers pay) will be removed. Information about past judgments that are now paid up will be removed straight away instead of sitting there for years and years.

ACCOUNTING Is this a good thing? While some creditors feel it will make it harder for them to see if someone has in the past been bad at paying or honouring their debts it will no doubt help when people who are unfamiliar look at your bureau report in the future. For example, a rental agent or prospective employer. If they know a bit about credit reports they will still see whether you are paying each month but at least there will not be any nasty description which call your character into question. Also the fact that some creditors will not be scared off by past judgments (which you have paid off) which they will no longer be able to see on your report will help some consumers get credit who before might not have appeared reliable.

ACCOUNTING Is this a good thing? I have made a number of submissions to the DTI and the NCR with regards amendments to the NCA. What are your personal goals for the next few years? What would you like to do? I believe we all have a calling in life and it is from this we derive our passion . Mine is helping people through Debt Review and for this reason I would like to see a functional and seamless industry evolve. In the near future my contribution will be serving on CIF subcommittees to help play a part in resolving

In your view how have things recently improved in the industry? The last few months have seen long awaited legislative changes to the National Credit Act published and broadcasted in the media. We saw the adoption of the National Credit Bill by parliament and Adverse information Amnesty [regulation]. I believe the victories that the consumers and DCs have achieved in these two milestones, was paved by hard work and dedication of all role players in the industry and in our case, contributions and submission made by DC associations. Only one association, however, was representing all Debt Counsellors at industry forums for the most part over the years... This was noted by the NCR during last year and the Credit Industry Forum was created to involve all role-players in the Credit Industry to find solutions to the implementation of operational challenges. Both the Alliance of Professional Debt Counsellors (AllProDC) and the Black Debt Counsellors Forum (BDCF), were also invited by the NCR to join the CIF forum.

Do you feel belonging to an association is important for Debt Counsellors? Over the past 5 years I have been practising as a DC in KZN and belonged to an association. During this period I participated in the associations’ activities and got to know many DCs personally. As a regular contributor to different Forums, meetings and conferences, I have learned a lot about the challenges as well as successes the DC industry experience. The DC industry has small sized, medium and large Debt Counsellor firms, all contributing to the success of the industry in their own way. The different size [practices] also experienced different challenges … I believe that it is these shared challenges and successes that bind people together and cause us to associate with each other to pursue shared goals and objectives. As Lance Armstrong said: “Anyone who imagines they can work alone winds up surrounded by nothing but rivals, without companions. The fact is, no one ascends alone.”

Any particular reasons? In my opinion, the difficulties that a large number of practising Debt Counsellors experience have not been heard in the past at Industry meetings, e.g. Task Team etc., and the opportunity is now created for such Debt Counsellors to have their voice heard directly at the CIF. I believe I can better contribute to this voice by changing association. Any hard feelings? None whatsoever. The Credit Industry is vibrant and the Debt Counselling Industry still developing. I have only the biggest respect and admiration for my previous association and the work that was done by them in the Industry. What do you hope to achieve/do/get from your new association? To find a home where my voice is heard, to support fellow members of the association in building their debt counselling practices and participate in the development of our Industry.

Credit Industry Forum - update End Balance differences continue to be a problem for our members and thier clients. We are working hard on this issue as we feel current the proposals made do not meet the needs of our members or clients. We are also busy with submissions on other Credit Industry Forum matters. We are particularly pleased that our representitive has managed to get the topic of Section 103(5) of the NCA. THis section has largely been ignored over the years as various creditor bodies have different opions about when the date of default is. Members are asked to make submissions in regard to the application of NCA Section 103(5) before the first of May (01/05/14). We urge all members to get involved in this one as it has huge ramifications. New NEC members Two new members have joined our team of volunteer members on the National Executive Committee First off we welcome Zune Coetzer to the NEC. She will be representing the Free State. We also welcome Martin Snyman. He will be representing KZN. His experience and input is of great value to us. We want to say a big thank you to all our NEC members who work so hard on our behalf.

The Online Forum In many ways the forum began it all for us at AllProDC. We have found recently with the use of the Facebook page that the forum has taken something of a back seat. We will now be relaunching the webforum in weeks to come. Be sure to visit and post. Debt Review Awards Debt Review continues to become more and more professional. We are very happy that our industry will now have the chance to recognise the hard work of all parties in making debt review work. As an association we are supporting and contributing to the Debt Review Awards. Members will get to have their say about candidates for nomination and might be up for nomination themselves. We will feature more information about how our members can do so on the Facebook page and Forum. Nedbank AllProDC attended the Nedbank workshop and found it to be very positive. It is good to see that Nedbank is actually interested in trying to encourage settlement through the debt review process. Nedbank acknowledge that debt counselling is the best collections method for banks possible! Our members have some concerns they wish to raise with Nedbank which we will assist them in doing.
