FROM THE EDITOR End of Year – Yay!!! It’s natural to get a little excited when you get close to “holiday time”. For some it will mean a real break from the humdrum of the day to day. It can be a chance to totally reset and recharge your batteries. Even if that only means you get a few days off it is still nice to have something to look forward to. And end of the year relaxing can bring with it optimism for the coming year, both a chance to look back and reflect and look ahead and plan. Do you have some goals or plans for 2024 brewing in your head? Hopefully they are things that you can bring to fruition in the months ahead. But year after year people set themselves goals that they don’t always achieve. How can you turn your goals into reality?
We have a look at some ways you can take what’s in your head and turn it into reality in the months ahead. We look at things that can help you follow through on your plans next year. We also consider the dangers of a lack of follow through when it comes to debt review. Most people minimise the danger of dropping out of the process. This is something you do not want to do. We talk about why. We also consider if saving money while in debt review is actually something realistic or even advisable. December is one of those months where you can easily over spend. So, please be careful not to blow your budget and get into trouble. There are plenty ways to have fun and not break the bank. Just take a moment or two when making plans to consider what the costs really are. There are often cheaper alternatives that won’t leave you stressed out all of January (or “Januworry” as some people like to call it). Our team also have big plans for 2024 and the following year. We look forward to implementing new ways to help our readers be more informed, get access to better savings and ultimately successfully get out of debt. It is not uncommon when nearing the end of a year for people to consider how the year went, and what they would like to do differently in the upcoming year. Setting goals can help us stay focused and motivated. They can help us measure our progress and keep us on track when we start to waiver. What are your goals for 2024?

SET REALISTIC
GOALS
While it might seem great to set yourself the goal of making a million bucks or buying a Ferrari this coming year, that may not be something you can realistically achieve, for a variety of reasons. But that does not mean that you cannot move closer to reaching such goals in the future. You can definitely progress towards achieving those goals. Just as it would be impossible to jump straight from the start line to the end of a marathon, so too reaching really big goals may require you to find smaller stepping stones along the way. So, can you start with some realistic goals that move you closer to your long term goals?

IMPROVE YOUR
HEALTH Many people are still carrying around a few extra Kilos since the covid years. They may find that they are still struggling to get back into a more active lifestyle. Lockdown was not the healthiest time for everyone. Many fell into poor exercise and dietary habits, which they are still dealing with. Maybe you are thinking of changing how you eat and exercise. If so, then consider how you can (without breaking the bank) change your routine to set aside some time for exercise. You can also look at the types of food (or maybe just how much you are eating). While different eating fads come and go, it is often a case of eating a little less than we burn that helps shed unwanted weight in the long run. By improving our physical health it can provide a mental health boost too.

SOMETHING It is easy to fall into the habit of spending every last cent we have access to each month. But this habit leaves us exposed to stress when an emergency comes along. If we have nothing at all saved to help us get through unplanned expenses, it could derail our long term plan to get out of debt. So, during this coming year, could you start saving something each month? For those in debt review, having such savings can be the difference between staying in the process when disaster hits, or dropping out and losing years of progress towards settling their debts.

DEBT
Having debt is like selling your future. You have to do work in the future just to pay for something you already bought. The borrower becomes locked into the demands of the lender. Your time, effort, and all your energy belongs to them, until you settle those debts. Making a decision to get out of debt means changing the way you do things. If you have struggled with this in the past, then why not get someone, a professional, to help you work out how to do it. Did you know your local Debt Counsellor will probably help you rework your monthly and yearly budget to help get out of debt for free? Though it is a common goal few people make progress on actually getting out of debt because making use of credit is just so easy.
Often, we postpone doing anything because we think that something is going to come and miraculously save us from our situation. Sadly, that seldom happens. Can you switch to making use of debit cards rather than credit cards? Can you focus down smaller accounts which have higher interest rates? Once you have done that, can you focus on another one, and then another one? Snowballing debt repayments does work. If your debt situation is “out of control” then think about professional debt counselling. It has helped hundreds of thousands of consumers over the years.

ANTI-GOAL So, maybe you are not a big fan of the “new year, new me” mentality. Setting goals and then adding new items to your already full plate can leave you exhausted, before you even begin. Well, here is one for you: Have you heard of the “Anti Goal”? Anti Goals are all about what you want to avoid in 2024.

AVOID GETTING
BURN-OUT Maybe you have reached December 2023 feeling exhausted. Would you like to avoid that in 2024? If so, then an Anti-Goal would be to avoid over-working resulting in feeling tired all the time. Once you have what you want to avoid in mind, you can identify the things that make you feel that way, and then plan to eliminate them in 2024. So, for 2024 you could set a cut-off time for work: No work after 5pm or no work on the weekends, for example. You identify what you want to avoid, figure out what it is that currently makes you feel that way, and then consider how much better things would be if you could avoid such things, then working out how to avoid that thing in 2024.

AVOID RUNNING OUT OF MONEY
AT MONTH END
If you identify bad shopping habits at the start of the month as the cause, then you can take a moment to think about how much better it would be to be able to get whatever your family realistically needs, at any time of the month. Now, how do you achieve that? Can you make better shopping lists and stick to them? Can you do bigger shopping trips after planning out your meals for the week or month? Can you shop at better priced places instead of impulse buying at over-priced convenience stores? Can you do a meal prep evening (maybe Sunday) to ensure you have snacks and things to take to work/school, so you avoid unnecessary spending? You give the problems some thought, and find ways to avoid the problem in the future. This is the power of the Anti-Goal.

PROGRESS IS
PROGRESS You may have once set yourself the goal of getting out of debt. This is a vital first step if you want to build future wealth, but it is not an easy one. It normally means cutting down the spending at home, and focusing more on settling your debts as a priority. If you have entered debt review, then you have already made excellent progress towards this goal. But there is a danger. Paying off debt can take time and like many long term goals, we can easily lose motivation during the process. It can take a year, 2 years or even 5 years. This is why it is good to track your progress. It helps you stay focused. But even if you have been tracking your progress, it might start feel like it is going very slowly. This is where the right mindset is vital.
You must realise that you are making progress. Firstly, if you had not set that goal, if you had not started to do something about it, then your debt would be even bigger right now. Think back to how fast your debt was growing in the past. Maybe it was growing by 10% or 20% a year, or more. Instead, because you are doing something about it, your debt has not just stayed the same size, it has actually shrunk. It may have shrunk by 20% (if you are planning to pay it off over 5 years). Think back to how quickly your debt was growing or how you were only ever paying off the interest, and were basically stuck in debt. Now, you are making progress, your debt is shrinking, well done! And this principle can apply to all our goals. If you go for a jog every day, you will not turn into a star athlete overnight but… if you were gaining 5Kgs every year, you may have stopped that from happening this year - Progress. Maybe we even start to lose a few centimetres - Progress. Tracking your progress can help you stay motivated, and keep your goals top of mind.

You may want to get healthier, or more financially stable, or you may plan to avoid bad habits. Whatever goals you set, if they are realistic, if you can figure out how to use short term goals to help you reach long term ones, and if you track and acknowledge your progress, you will be one step closer to where you want to be. Figuring out the right amount to keep in your emergency fund depends on your unique financial situation. You obviously can’t keep a mountain of cash around when you are focusing on paying off your debt, and living on less. One way to estimate this amount, is to recall previous surprise bills and how much they cost, and then use that as a way to set a goal. Even if money is tight, starting with small, regular contributions can give you a sense of financial security. Your Debt Counsellor will have advised you to save a little in your monthly budget. DO IT There are a number of different ways to build an emergency fund, but they all come down to the act of putting some money aside in a savings pocket, or a separate bank account and not touching it until it is absolutely necessary. Once you have paid your debt review instalment for the month, immediately take some funds and move them into your emergency fund.
Tip: Don’t wait till the end of the month to see if anything is left over, there wont be. If you regularly do this, then when that rainy day does come, you will have a cushion to help absorb the blow. Even if what you have saved is not enough to cover 100% of the extra cost, it will help you cover some of it, while you make a plan for the rest. An emergency fund can help you keep your financial future on track.
DEBT REVIEW WHAT IS A COB? A Certificate of Balance or CoB is a fancy form provided by a credit provider with information about your debts with them. It will show when the debt began, how much is owing and if there are any special fees attached to the account (like insurance). The CoB can help in planning how to restructure debt repayments or in updating balances on the Payment Distribution Agent systems from time to time.

STOP If you have a serious heart problem, your doctor may send you to hospital to have heart surgery. During the surgery, the operating team will have to open your chest to work directly on your heart. This is scary and serious stuff! But during the surgery, your heart problems may not be obvious. Would it make sense for your family to stop the surgery half way through (while your chest is wide open), simply because the symptoms have temporarily stopped?

WOULD IT MAKE SENSE TO STOP
HALF WAY THROUGH? No, of course not, that would be short-sighted and have catastrophic consequences. The surgeon needs to finish the heart repair, and close you up using their expert skills to ensure you survive, and go on to enjoy a long life. With debt review, once a Debt Counsellor has begun the process of opening up your finances, and begins repairs, it would be very, very foolish to think you can just stop at any point and walk away and everything will be ok. In fact, it would be even more dangerous than ever before. This is the time to fix the problem, not back out half-way through. Sadly, some people let others convince them that they can have good financial health if they leave debt review, before it is complete.

WHY YOU SHOULD NOT STOP
THE PROCESS
Some uninformed credit provider sales people do not understand that by interfering with the debt review process, they are placing the consumer at risk, and it will end up costing them thousands of Rand (and years of turmoil). Others foolishly think that if they leave debt review with lots of debt remaining, they will somehow magically qualify for new credit (which they still can’t afford). Some people in debt review forget that they will then have to go back to their original repayment obligations from years ago (which they are now very, very far behind on payment for). They do not realise that they might lose their home or car. If you are frustrated with how long it is taking to pay off your debts (even though you know exactly how many months it will take), please speak to your Debt Counsellor rather than walking out of the financial “heart surgery” half way through.

ABSA DEBT COUNSELLOR WORKSHOP 2024 ABSA have already published the date of their first industry workshop for 2024. The workshops help discuss ABSA’s internal policies regarding certain steps of the process and also help provide an opportunity for Debt Counsellors to engage with them directly about issues that have come up. The workshops held in 2023 were well attended, very informative and popular. The online workshop will take place on the 15th of March 2024 via MS Teams. FSCA SHUT DOWN MASSIVE PONZI SCHEME The Financial Services Conduct Authority has fined an unregistered person R143 Million for tricking consumers into a Ponzi scheme. Jacobus Geldenhuis and Classic Financial Services got into trouble for offering to invest client’s money (which they didn’t actually do, it seems) while not registered with FAIS. Apparently, Mr Geldenhuise got himself disbarred back in 2009 for dishonesty and was operating illegally ever since. It appears that since 2019 Mr Geldenhuis conned people into “investing” over R495 million through his company Classic Financial Services. He has been reported to the criminal authorities.

WILL TRANSACTION CAPITAL UNBUNDLE WEBUYCARS? Transaction Capital is thinking about separating WeBuyCars from its overall business and listing it independently on the JSE stock exchange. Transaction Capital’s CEO, Jonathan Jawno, has said that they are currently looking into this option in collaboration with WeBuyCars founders Faan and Dirk van der Walt. WeBuyCars is the most valuable part of Transaction Capital’s business and has been doing really well despite what can only be described as challenging market conditions.
CREDIT INDUSTRY FORUM 2023 The National Credit Act (NCA) and its regulations form the foundation of the debt counselling industry. The Act sets out the broad strokes of the debt counselling process (including doing a debt review and then restructuring debt). Still, there are many areas in the NCA where things are a little vague or unclear. So, the National Credit Regulator (NCR) have set out over the years to consider these “gaps” and to come up with helpful (non binding) guidelines of how such things might be handled. Over the years, these non binding guidelines have helped most parties get on the same page and though some like them and others do not, they have helped move the industry forward through some tough times of uncertainty. Note: The courts and NCT seldom, if ever enforce such guidelines since they are by their very nature as set out in the wording of the NCA a non binding opinion about some aspect of the NCA or process. In an effort to bring greater consensus to their guidelines up front, the NCR have tried to bring several industry leading parties into a forum where they can discuss matters and try reach consensus and make suggestions to the NCR that helps them formulate guidelines on such topics.
This is a way to try engage with a sample of the industry and gauge what the general response will be and an effort to gather a wide range of input on topics before formulating their own opinions. Consultation is always a good way to go. This forum is called the Credit Industry Forum or CIF. The CIF was conspicuously quiet or even entirely missing for quite some time since Covid hit. After some pressure from the industry late in 2022, the NCR fired up the CIF again and got the ball rolling in 2023. 2023 Feedback Unlike past years, the NCR decided to focus on fewer issues this year due to time and other constraints. Also, several topics naturally interlink and so are dependant on discussions on those other topics being dealt with first. This year the main focus was on (1) Reckless Lending and (2) a possible change to the timing of the release of funds for the initial restructuring fee that Debt Counsellors charge (the Sub Committee has a different name about “fees” but this is somewhat misleading given the scope of the discussions).
