Debt Counsellors often wonder if the person they are sitting talking to about their financial problems has what it actually takes to get out of debt. You see, most people don’t like dealing with the consequences of having spent more than they have and going into debt. That’s pretty common. Those who reach out for help through a Debt Counsellor prove that they are willing to at least talk about and try to do something about their debt. That’s somewhat uncommon but do they have what it takes to make it all the way through? Every day we, at Debtfree Magazine, speak to people who stopped working along with their Debt Counsellor and ended up dropping out of the program only to find out, months or years later, what a huge mistake they have made. They may have just lost their car or just found out they have judgments against their name or simply that they cannot
get more debt from another credit provider to add to their existing mountain of debt. Debt review was designed to be started and finished. The law makers seemingly never imagined that people would treat it like a ‘pay as you go’ mobile phone plan and think that they could get into the process and then just leave before having paid up all their debts. So far about 600 000 people have proved those lawmakers wrong. So, how do you avoid becoming one of this massive crowd of failed debt review drop outs? There are a variety of things that you can do that will help you increase the chance of making it through and reducing your risk of dropping out. This issue we look at a number of ways that you could begin to work against your own Debt Counsellor and be shooting yourself in the foot financially. WORK WITH YOUR DEBT COUNSELLOR, NOT AGAINST THEM When a consumer starts their debt counselling journey they put a lot of trust in the Debt Counsellor they have chosen to assist them. This professional knows a lot about how banking works, the National Credit Act and also the court system. They are there to create a reasonable plan and see you through the process. It seems unlikely then that a consumer could start working against this very same professional that they are paying fees to each month but strangely it often happens. How can you end up working against the same person that you have asked for help and how can you avoid falling into traps that so many have fallen into in the past?

AT THE START When you begin your debt review the Debt Counsellor that you have asked for help will spend many hours learning more about your debts and your financial habits. They may spend days negotiating with credit providers in advance of your matter going to court. Much like a personal trainer at the gym will try to push their clients to make an effort to get fit, a professional Debt Counsellor will try to motivate you to cut out bad spending habits, adopt new ones and switch to a realistic monthly budget. What are some ways that you may be working against your Debt Counsellor even at this early stage? To effectively help you the Debt Counsellor needs to know all the facts. Now, it is a relief for most people to start to talk about their debts and how it is affecting them and their family. Many of us are very shy about our debts and even somewhat ashamed. It is sadly not uncommon for consumers who are looking for help to downplay certain debts and even to leave out certain expenses or obligations when talking to their Debt Counsellor. This is one way that we can undermine the process right from our first meetings with our Debt Counsellor. So, have you told them everything?

LOW LEVELS OF COMMITMENT For many people starting debt review, they fail to realize that they have been making bad financial decisions for a long, long time. In our minds, we often feel like we are the victim and circumstances alone have put us into his tricky situation. We forget that it was us who spent all that money and failed to live within our means. True, circumstances may have suddenly shifted dramatically leaving us with big expenses but we need to acknowledge that we are still part of the problem. We also have to realize that debt review is a serious solution to a serious situation and that we need to fully commit to the process.
Many people feel like they will start the process and then once their situation gets a little bit better they will quickly leave the process and go back to their debt addiction and bad spending habits. A surprisingly large amount of people seem desperate to go and again take on more debt that they cannot afford, at the very first chance they get. Debt review is a way to get out of debt‌not to get out of some debt and then go out and get another huge amount of debt. It is about changing the way you look at debt and credit use. If you are not 100% committed to getting rid of all your debts then you are already mentally working against your Debt Counsellor since they will be asking you to make sacrifices that you will superficially agree to now but never intend to keep.

YOUR SPENDING & SAVING Your Debt Counsellor will look at how you have been spending money each month and ask you to reduce your spending. They will suggest a budget amount that they feel allows you to cover your daily needs and even save a little towards bigger annual expenses while still paying off your debt. You are not going to like the figure they give you. It is going to seem too little. This is because not only have you been over spending but to get rid of all your debt you are going to need to change how you shop, where you shop, when you shop. You are perhaps going to have to change where you live and how you get around. Fortunately, a good Debt Counsellor won’t just throw a figure at you. They will also sit and talk with you about how you can adjust your habits to fall within that budget.

If you overspend each month during the process and start to use the funds in your budget that are meant to be put aside for annual expenses (like your car license or replacing tyres or paying for new school clothes in Jan) then you are fighting against your Debt Counsellor. They have asked you to make some serious cuts and get smart about shopping and spending and you are refusing to make the big changes needed to stick to your budget. It is like someone reading about a diet and then saying they will try it but then cheating on the diet every chance they get. Will they successfully reach their weight goals? No and neither will you if you refuse to adjust to your new budget figure. You need to mentally and emotionally embrace your suggested budget to make the process work.

TALK TO MY LAWYER Some greedy credit providers and collections agents (who work on a commission basis) may contact you while you are in debt review and try to tell you to leave the process for one reason or another. A common trick is to say that no payments have been received. They try to erode your confidence in the process and your Debt Counsellor. They ignore the fact that debt review is a legal process and should be done via the courts. They do not want to wait until your attorney is present to try to talk to you. Instead they secretly try to offer you what seems like a good deal to draw you away from the legal protection that debt review provides. If you start to negotiate with credit providers on your own without your Debt Counsellor or your attorneys then you are working against them. They have a detailed plan that involves every debt that you have and fits together as one united solution and you may be undoing all their hard work by making arrangements outside of the courts. Avoid doing this. If contacted by a collections agent explain that your matter is at court and they need to talk to your attorneys and should leave you alone. Feel free to record them on your mobile phone if they persist.

COMMUNICATE Many times a debt restructuring plan will be made over several years. Paying off debt over time is pretty normal but under debt review it is not uncommon for debts to be paid over 5 years or so (maybe more). It would be naive to think that so much time can go by without you running into a variety of challenging situations. They may have to do with family member’s health, your accommodation or your work situation. When you run into these challenges along the way you may fall back into bad habits of trying to throw money that you don’t have at the problem. This is because for years you were able to do so while using credit. Now with your changed financial position you should exercise caution. When you run into these challenges you should immediately contact your Debt Counsellor. Your Debt Counsellor will make suggestions on how you could deal with the challenge in such a way that you can still stay under debt review and protect all the progress you have already made. If you do not pick up the phone when these hard times come along then you are working against your Debt Counsellor and sabotaging your chances at financial freedom.

MAKE YOUR PAYMENT This may seem like the most obvious thing to do. If you are thinking about not making your payment or making only part of your payment then prepare for a world of chaos to follow. You are really about to complicate your life and you will be heading back to the old situation where you were getting hounded by collections agents and attorneys all the time. If you miss a payment and then expect the debt review to somehow carry on as normal, you are fooling yourself. If you expect that the Debt Counsellor will, for some reason, “take your side” and help force the credit providers to accept your breaking the court order then you are once again fooling yourself. True, the Debt Counsellor gets a small fee out of your overall repayment each month (which would otherwise go to the credit providers – so it is their money too) but they are not there to help you break a court order. By missing a payment you are directly fighting against your Debt Counsellor and the process. So, always make your payment.

There are many small ways where you can do things to ensure the success of your debt review. If you are regularly communicating well with your Debt Counsellor; if you are sticking to your budget and even saving a little; if you are mentally and emotionally invested in the process and willing to make your payments no matter what, then you will eventually be totally debt free. Like a person who works along with their personal trainer at gym, the results will come. Soon you will look and feel great. Sticking with the debt review process and not getting distracted by empty promises of collections agents or even misleading adverts about ‘getting out of debt review’, will ensure that you break your credit addiction. So, take a moment to think about some of the things we have discussed and ask yourself if there are things you need to watch out for and avoid. Don’t shoot yourself in the foot and sabotage your debt review. Rather focus on your future, pay off your debt and soon all these financial stresses will be a distant memory.

DANGEROUS Dangers for Consumers If you do not watch your spending you could find that you spend more than you planned as you get swept along in the holiday mood (and holiday gift shopping) that happens in December. Before you know it, you may not have enough funds to pay your regular debt repayment. If you ‘short pay’ or miss a payment you face the danger of credit providers starting new legal action against you to collect debts, since you are not cooperating with the debt review. You could lose all the progress you have made and even lose your assets. It will certainly cause you a lot of stress and great hardship. Please avoid this by making sure to watch your budget and spending in December. If you get paid early then try pay your debts sooner.
DECEMBER Dangers for DCs Your clients may fail to make payments in December and you may need to abandon them and terminate your services due to their non cooperation. You may also need to advise credit providers that this former client is not cooperating with the process. This will leave them without your help and send their debts spiraling out of control as creditors pounce. It will also leave them trapped outside the credit market for years or even decades. Reduced client payments can also affect your aftercare revenue. Can you help your clients to avoid putting you in this awkward situation? Your PDA system may enable you to send reminder messages via sms or email during the start of the month to warn them of the danger and to encourage payments. Some smaller DCs organize staff to call many clients and remind them to make their payments. Others ask clients if they would like to make their regular payment slightly early during December to remove the temptation to overspend part of their debt review payments. Since sales are normally slow in December you may find your team has the time needed to make some extra effort to help consumers stay focused during dangerous December.
DCRS & INITIAL INTEREST DCRS changes which are aimed at reducing end balance differences Starting in late November 2019 the DCRS system will now begin to add interest to the consumer’s balances from the date of the Certificate of Balance (provided by credit providers to Debt Counsellors). This will run until the proposal start date. The system will automatically do this in the background. The idea is to reduce the differences between what is shown on PDA systems and the credit providers systems. It can be very disappointing for a consumer to think they only have one month left to go repaying a smaller debt only to find out that due to end balance differences caused by interest calculations right from the start of the process they actually are going to have to pay for an extra month or two. More than that, these delays can then affect when other credit providers can expect to get some of the debt repayment that is freed up by paying off the first debt. Most Debt Counsellors advocate using these freed up funds to speed up repayment of the other debts helping consumers get out of debt sooner.

UNDERSTANDING THE ONGOING CONFLICT SURROUNDING DCRS Many years ago an organisation called the National Debt Mediation Association came up with a rule set for calculating how to repay debt in a way that credit providers would be happy with (mostly). This was called the NDMA rule set. Since this organisation was set up or funded by credit providers to divert people away from debt review initially, it was not super popular with most Debt Counsellors. This NDMA rule set later became the foundation of an almost identical set of rules promoted by a task team on debt counselling organized by the National Credit Regulator. The task team suggested that all Debt Counsellors try to use these rules which credit providers liked. Most Debt Counsellors were unhappy that a rule set seemingly formed by credit providers was being thrust upon them and refused. Especially some Debt Counsellors who pointed out that there may be mathematical issues with the calculations and the fact that Section 103(5) was not included. Many years later the NCR issued a guideline that promoted the findings of this very old 2009 task team.
UNDERSTANDING THE ONGOING CONFLICT SURROUNDING DCRS CONT’D
Many of these concerns were progressively addressed and additional features were added to the system over the years. The NCR ultimately became a fierce supporter and advocate of the system and it seems as of 2019 that the DTI are now following suit. There are plans underway to force Debt Counsellors to help pay for the upkeep of the DCRS system. Some Debt Counsellor still refuse to use the system, while many others have simply grown weary of the systems many past errors and limitations. Some credit providers (like Wesbank and other VAF credit Providers) had issues around cars with balloon repayments which seriously negatively impacted on DCRS use. New changes have already been made (eg with Balloon repayments) and other pending changes may address other concerns. The NCR and Credit Industry Forum hope that more Debt Counsellors will eventually make use of the system despite its checkered past.
DEBT REVIEW SCHOOL If you get a call from a collections person tell them to talk to your lawyer. Debt review is a legal process via court. Don’t negotiate without your lawyer.

HOW DEBIT ORDERS ARE CHANGING Changes are coming to the way that you will approve of new debit orders in the future. The new way of doing things is called Debicheck. Over recent years, debit orders have been processed in 2 different ways called AEDO and NAEDO (one is authenticated and the other is not). These current forms of debit orders will still be able to run for some time but you will find that companies will now ask you to authenticate new debit orders by means of Debicheck. Eventually AEDO and NAEDO debit orders will disappear and have to be replaced by the new system. To try to incentivize companies to use Debicheck, all debit orders that are authenticated with the new Debicheck process will get first priority when it comes time to actually take the money out of peoples’ bank accounts. This is called the “early processing window” in the payment industry. Once those Debicheck authenticated payments have been made only then will the other types run. A Protection Against Fraud The good news for consumers is that once they have authenticated a new debit order once they do not have to do so again and again every month. They would only be asked to authenticate the debit order again if the details change dramatically. Eg. If you were paying R100 and suddenly it shoots up to R500 or something. Then the fact that the bank contacts you to ask if the amount should suddenly go up from now on will alert you to possible fraud. NEWS S&P DOWNGR ADE OUTLOOK ON SA’S ALREADY ‘JUNK’ STATUS International Rating Agency S&P Global has followed suit with other industry role players like Moody’s and changed what is called its ‘outlook‘ (what they think is going to happen) on SA’s sovereign credit rating from ‘stable‘ (which mean they think things will stay the same) to negative (things are going to get worse) this month. S&P already rate SA Sovereign credit as “junk” status.
NEDBANK: NEW HEAD OF DEBT REVIEW After many years at the helm former Debt Review head Ms Denise Hartley has moved from Nedbank over to FNB. The team will now be led by Laurien Kemp. Colleagues describe Laurien as having “great experience” and as knowing both “the people and the process well”.
REPO R ATE UNCHANGED Despite the hopes of some economists the Repo Rate remained unchanged in November at 6.5%. Though some people were rather disappointed and had expected a small drop to help fuel end of year spending etc. the MPC did not feel there was room for a drop in the rate and would like to see a little stability across the economy.

Hierdie is direk verwant met aansoeke vir skuld, waar n finansiële dienste verskaffers n kredietnavrae op verbruikers doen – moet dit nie verwar met kredietverslae wat jou krediettelling weerspieël nie.
Ek sukkel om sin te maak van hierdie syfer, het die mensdom heeltemal die kluts kwyt geraak? Kan verbruikers nog steeds, ten spyte van al die waarskuwingstekens, onder die wanindruk verkeer dat nog skuld n oplossing kan bied? As die een kredietverskaffer negatief antwoord word daar net voortdurend aansoek gedoen by ander kredietverskaffers in die hoop dat iemand tog gaan ja sê? Dit blyk so want daar is nie genoeg krediet aktiewe verbruikers met n goeie krediettelling om hierdie syfer gestand te doen nie. Is dit een van die redes waarom verbruikers n DC nader, luister na die voorwaardes, teken en daarna besluit miskien is nog skuld die oplossing – daar is mos plekke wat adverteer al jou skuld word gekonsolideer dus betaal jy net n enkele paaiement – of self herhaaldelik aansoek doen (sonder sukses) en wanneer alles gefaal het, terug gaan die DC met die hoop dat die kastaiings nou uit die vuur gekrap gaan word en dan die DC wil blameer. Ter afsluiting wil ek die syfer herhaal 748 miljoen kredietnavrae, malligheid, en dan lê Black Friday nog voor! Groete, Christo
