Spring has sprung. Flowers are blooming (ask anyone with allergies), the rugby is on TV and we can almost see the December holidays in the distance. It is interesting how having the prospect of a small break at the end of the year can really help get us through the workweek. If someone irritates you at the office (or something similar) you think to yourself, “I can handle this for a few more weeks. It’s almost December.” Just having that rest period just ahead can motivate and comfort us. It is similar to how having a realistic debt review plan in place can help us reduce our stress about our debts. Sure, we might still get a weird collections call (or something similar) from time to time but the fact that we can say: “I am under debt review” provides us with the peace of mind to get through.

HAVE YOU SAVED ENOUGH? Saving money is hard when times are tough. It often seems that all our money is spent before we even get paid. With the price of everything going up all the time it can be hard to set some money aside for saving. A recent report on saving said that on average South African households saves only 0.2% of their income each month. That is 1/5th of 1%. So, if you earn R5000 you are probably only saving R10 each month. Another report indicated that 72% of women have no savings whatsoever. Clearly South Africans are not known for saving money. Even popular traditional saving schemes like Stokvels have come under pressure with less members than in the past. Among people using stokvels to save, around half actually also borrow money from the stokvel. Stokvel saving is however notorious for being shorter term saving and not meant for long term. For debt review consumers that are focused on paying off their debts it can be a real challenge to also save. You may ask: if a debt review consumer is paying money each month to get rid of their debt why would they try to save anything? Should they not be putting every available cent into paying off their debt sooner?

TARGETED SAVING While it is true that paying off your debts is most important and that no savings account or investment is likely to give you returns higher than that saved by paying off debt with high interest rates, consumers under debt review should be saving. Admittedly, they should not be saving large amounts and they should be saving for specific expenses. We are not talking about some general saving for the sake of saving here. This is targeted saving of smaller amounts each month.

SAVING FOR ANNUAL EXPENSES When a consumer talks to their Debt Counsellor about their budget they will discuss some of the expenses that crop up once a year such as school books and school clothes for their children. They may also think of annual expenses such as a TV license or a vehicle license. However they may have forgotten that if they own a car they will have expenses that come up every now and then such as a vehicle service or tyre replacement. These are not regular every month expenses. Normally, consumers under debt review would probably reach for their credit card when these expenses came around in the past, placing themselves under even more financial pressure. After entering debt review however, making use of credit to cover such expenses is no longer an option. This is why a Debt Counsellor will allocate a small monthly savings amount toward these annual or occasional expenses into the consumer’s monthly budget. Failing to plan for them is simply a plan to fail.

SAVING FOR UNPLANNED EXPENSES It is a harsh reality of life that things do not always go according to plan and we often face unexpected and unwelcome extra costs. It might be a burst geyser or a flat tyre. Perhaps it is an appliance that just stops working and these unplanned expenses can also throw a spanner in the works of a debt review. Even credit providers who are looking to lend to consumers add a small percentage into their calculations of whether to give people credit or not for unexpected events. This is because it is foolish not to. Consumers under debt review are not exempt. They may have to unexpectedly cover the cost of an insurance excess or sudden medical bill while in the process. An experienced Debt Counsellor will also factor a small amount for saving towards these possible costs as well.

SAVING FOR SOME FUN It is also realistic to factor in small pleasures for those under debt review. While this may sound contrary to the intent of debt review it is not when done with reasonableness and restraint. We are not talking about a huge amount but a small figure to set aside towards anniversaries, gifts, donations or something as simple as a little fun for the kids every now and then. Not luxury but a small amount that can contribute towards quality of life. Those who have only work and debt will soon find excuses to drop out of debt review and plunge back into financial troubles.

What can be difficult for consumers is to mentally and in practice see these small amounts (and they may be as small as R50 a month) as set aside for these annual and unexpected expenses and not for spending. There is often a tendency to spend every last penny available every month towards monthly running costs such as groceries and clothing or transport and communication. Another challenge is that the amount set aside for saving starts to grow (eg R100 a month x 10 months = R1000) it can get harder and harder not to spend these funds on something other than what was originally budgeted for.

START WITH SMALL WAYS TO SAVE Being savings conscious is not only about the amount of rand you are able to set aside every month from your budgeted amount. It is a mind set. Leaving a room? Turn off the lights. Feeling cold? Put on a jersey rather than a heater. Heading to the shop? Talk a walk rather than the car. Going shopping? Make a list at home to avoid unnecessary impulse buying. Being savings conscious can be about where you shop, how often you shop, how you shop and which items or brands you buy. When the City of Cape Town wanted to save millions of litres of water each month they first asked Capetownians to turn off the flowing water while brushing their teeth. This small step helped pave the way for huge savings. So, start small and try to save in a dozen different small ways each day.

SAVE IN BIGGER WAYS There are also some changes you can make to your lifestyle that can help you save more. These require some more effort and may require that you change some ingrained habits. Can’t head to the expensive movies any more? Why not read a book? Feeling like you need some retail therapy as a ‘pick me up’? Rather volunteer your time helping others for the feels. Subscribed to an expensive Satellite TV package? Consider downsizing or switching to only the free channels. Investigate online streaming options or visit your friends who have satellite to watch sports games. Are you on a fancy mobile phone package? Could you live with a more modest phone and adjust your call and internet usage habits? It could really save you a lot of money each month.
Were you paying a lot to go to gym? Could you use a public free workout facility or work out at home? Could you try jogging or running instead? Rather than spending time with friends partying and drinking or doing expensive activities consider cheaper alternatives like a hike or day at the beach. These things tend to cost very little and can be a lot of fun. These bigger changes are sometimes difficult to make but bring the biggest savings. The money that you save on these items can be put aside towards your annual or unexpected expenses or even a little fun every now and then. The idea is to beat your monthly budgeted savings amount.

HAVE YOU SAVED ENOUGH? It is clearly important to save according to the amounts and goals your Debt Counsellor set for you when you first had your debt reviewed. If possible, it is best to save even more than they suggest so that you can build up an emergency reserve as soon as possible. You need to plan for the unexpected! Many consumers find that December is a tough month and can overspend if they are not careful. Most debt counselling firms will suggest making your debt review payment earlier in December if you are paid earlier. This helps remove any temptation to spend your debt money on other things. January too presents many people with challenges as extra back to school expenses come along. These bills can quickly add up. If you have not been saving much during the year so far then you should now really look to make some drastic moves to save as much as you can for the annual expenses that are coming at the end of the year.

SAVE YOUR DEBT REVIEW If you suddenly realize that you need to set aside more than you think you can comfortably manage then you should realize that to get the funds needed you are going to have to get extreme for the next few months. It might be time for a yard sale or to find some additional work to help make up the shortfall. Baked beans on toast anyone? Do whatever it takes. Even better, make sure that you continue to save a little each month throughout your debt review. Whatever you do, don’t fall into the trap of not making your full debt review payment as this can derail everything you have worked for over the months and years throwing you back into the harsh collections process outside debt review.

DID YOU GET A RECEIPT? When we pay for things we are used to receiving a till slip or receipt. It is very common. We might need these receipts for tax purposes or to check on our budgeting. It also serves as proof of a purchase. Even debt review has a requirement that Debt Counsellors give new consumers a receipt. The National Credit Act(NCA) Section 86 discusses the process a Debt Counsellor will follow when they receive an application for debt review from a consumer. It says in part: NCA SECTION 86(4) 4) On receipt of an application in terms of subsection (1), a debt counsellor must(a)
provide the consumer with proof of receipt of the application;

DEBT COUNSELLORS ARE YOU COMPLYING WITH THIS REQUIREMENT? As Debt Counsellors who stick to the requirements and direction of the NCA and regulations it is necessary to stick to this particular requirement as well even if in the past you may have ignored it. Many Debt Counsellors feel that a Form 17.1 may fulfill the requirements of this portion of the Act however these forms are often only sent out a day or more after receipt of an application and serve a totally different function. Note that the NCA says nothing about whether the Debt Counsellor intends to proceed with the matter or not. Simply that the consumer has applied. Being forced to issue this receipt will also help you avoid accidentally signing up a consumer who is only enquiring about the process and costs but who is not yet ready to actually apply. This will save you a lot of wasted work and even possible legal or NCR backlash later.

CONSUMER DID YOU GET YOUR RECEIPT? This receipt can also help new consumers to have a written record of their Debt Counsellors details even before a Form 17.1 is issued to all credit providers (and a copy provided to the consumer). It is amazing how easy it is to lose the contact info of your own Debt Counsellor. Some Debt Counsellors may also turn down an application as they may feel that the consumer has too little to pay towards their debts each month. The consumer however may need to prove that they did apply for help at court at a later stage (due to Section 129 or Section 130 letters). Thus it is important to get a receipt or acknowledgement of having handed in your application.

THE DIFFERENCE BETWEEN AN APPLICATION AND AN ENQUIRY FOR A QUOTATION Some consumers who have simply asked for an idea of the costs of a debt review may later find they have been added to the National Credit Regulators database as being under review when this was not their intent. If you have asked for a quotation of what debt review will cost and suddenly the Debt Counsellor wants to give you a receipt for your application it will help you stop things from getting out of control and going further than you intended.

POINTS TO PONDER Since a small payment of an application fee may apply when a consumer hands in an application for debt review, it is good to ponder possible issues that may arise. Many Debt Counsellors have been given terms & conditions of registration that say that the Debt Counsellor is not to handle or accept payments directly from consumers. To ponder: 1. Is this in direct contradiction to the wording of the NCA? 2. If such a Debt Counsellor does accept any such payment should they be deregistered for breaking the NCRs T&Cs? 3. Do such Debt Counsellors then need to make use of a PDA specifically to collect these application fees (even if the consumer does not make use of a PDA to handle their monthly debt repayment distribution)? 4. Similarly, would such a Debt Counsellor need to accept after care payments from the consumer via a PDA or be in breach of their NCR issued T&Cs?
DEBT REVIEW SCHOOL If you suddenly leave debt review before paying all your debts off you will be chased by credit providers and their collection agents. They will probably summons you to court.

DEBICHECK HOW DEBIT ORDERS ARE CHANGING Changes are coming to the way that you will approve of new debit orders in the future. The new way of doing things is called Debicheck. If you sign up for a new contract or even to make monthly payments with a debit order for your debt review you may be asked to authenticate the amount to be debited off your bank account each month. To ‘authenticate’ the debit order means to say that it is really a payment that you want to go off your account each month. There are going to be many ways to approve of a new debit order. The banks want to make it as easy for all of us as possible. It might be on your banking app, on a small hand held card machine at the shop or service provider. It could be done via your mobile phone (ussd) or by walking into a bank branch. The idea is that the banks want to make sure than any new debit orders coming off your account are only ones that you want to be going off. You won’t have to give permission over and over every month just once at the start (or if you need to make any big changes to the amounts or when the debit gets made). If you run a business and your clients are debited each month then eventually you will also need to make use of the new Debicheck process. NEWS DEBT COUNSELLING FIRM HELPS SCHOOL A no fees Western Cape school received a real boost for their students when a Debt Counsellor, Mr. Sebastien Alexanderson equipped their empty computer department with over 20 computers. One of the teachers at the school was a former employee of National Debt Advisors which is run by Mr. Alexanderson. He reached out to his former employer and explained that the school did not have internet access or computers for the kids. NDA came to the rescue and helped provide the needed equipment and helped organize the needed internet access.
CHANGES AT THE NCR, NEDBANK, FNB AND STANDARD BANK DEBT REVIEW Several key staff at the various major banks’ debt review departments are changing. At Standard Bank Ms Claire Mordaunt will be heading to a new department within the bank. Nedbank are saying goodbye to Ms Denise Hartely who will now be moving over to FNB into the collections space (including debt review). At the National Credit Regulator, Ms Shannel Subbiah will now caring for the responsibilities formerly handled by Mr. Morris Maluleke who is busy at the Regulator in a new post.
DCRS VEHICLE CHANGES “GO LIVE” The long awaited changes to the way computer system DCRS works out proposals for vehicles with ‘balloon’ repayment amounts are finally live. For a long time it became almost impossible for Debt Counsellors to use the system to calculate proposals that would automatically be accepted by credit providers due to the way that cars with balloon repayments caused consumers monthly debt repayments to increase. Now the amount of months over which a vehicle can be repaid via DCRS has been extended all the way to 100 months (from purchase). This will mean that DCRS will assist in lowering
the consumer’s debt repayments in such matters. Many parties now hope this will motivate Debt Counsellors to once again make use of DCRS. The NCR and now the DTI have come out in strong support for DCRS. The DTI have even published possible plans to force all Debt Counsellors to help pay for the system.
CAPITEC BANK GET GO AHEAD TO BUY MERCANTILE
COIN IT & COMMEX MINER ALS – IS IT A PONZI SCHEME?
A while ago Capitec Bank announced that it was looking to buy Mercantile Bank from its Portuguese parent company. This would allow Capitec to provide a business solution to many of their clients who, at present, can only enjoy personal banking solutions from Capitec. Recently the Minister of Finance and other regulators gave their official thumbs up for the deal to be finalized. Capitec Bank is expanding and is taking on staff at a time when many other banks are having to let staff go. At first, Mercantile will retain all its staff and branding with changes gradually being introduced over time.
The Financial Sector Conduct Authority has been issuing warnings to the public about Coin It and Commex Minerals. These two related firms have been widely advertising an offer of 200% returns on investments but it seems that the people running the scheme are not registered and the whole thing might actually be a Ponzi scheme. Recently Coin It told investors (many of whom are not getting their scheduled payouts) that they are moving their contract to other entities. This is seen as a possible sign that the scheme is now collapsing and the owners may soon run off with the funds invested. The Hawks and Asset Forfeiture Unit raided the
homes of people related to the scheme and seized computers, documents and more. It seems that the house of cards is now collapsing and many investors may find themselves out of pocket to the tune of many millions of Rand.

SKYT AFRICA Hi Almal, Daar is twee dinge wat my die afgelope tyd opgeval het. Die eerste is die vernederende geploeter van die Protea krieketspan in Indië. Om so n loesing te ontvang is n skreiende skande, dit het blykbaar 84 jaar gelede ook met ons gebeur teen Australië. Wat het egter fout gegaan? Na die afgelope onsuksesvolle Wêreldbeker poging was daar besluit dat die afrigter swak is en moes hy maar gedwee sy tassies pak. Nou is daar n nuwe afrigter en dinge het vererger instede van verbeter. Myns insiens sal elke beampte en speler self ondersoek moet doen en onvoorwaardelik daadwerklik optree om hierdie toedrag van sake reg te stel. Die frustrasie was ooglopend toe spanmaats opmekaar begin skel het. So ook met te veel skuld, iewers en hopelik so gou as moontlik moet daar besef word dat dinge nie so kan aangaan nie en dat optrede nodig is. Indien nie gaan daar n bakleiery en onenigheid in die huis wees en voor jy jou oë uitvee is jy uitgeboul vir n ronde nulletjie.
Die tweede ding wat ek wil aanraak is die geneigdheid om te weier om vir sekere dinge te betaal. Reeds in die vroeë 80’s was daar gemeenskappe wat besluit het dat hulle weier om vir enige dienste te betaal, toe die Munisipaliteite optree het die gemeenskappe afvaardigings na die banke gestuur en die banke blameer. Sommige het in hul onkunde summier besluit om hul maandelikse paaiemente te staak – groot fout. Nou meer as 35 jaar later sit die land in n krisis (Eskom) omdat hierdie groepe steeds weier om te betaal, inteendeel hierdie groepe wanbetalers het ontsaglik gegroei in hierdie periode. Wie gaan vir die gelag betaal? Natuurlik die was reeds betaal, ons! Wat word eintlik hierdeur bereik? Niks n ronde nulletjie. Soos met skuld, as jy skuld het moet dit terugbetaal word. Kamp opslaan voor die bank en jou lot bekla of te dreig gaan nie vrugte afwerp nie. Gaan skuld oordeelkundig aan. Wat duidelik is, is dat elke besluit of optrede n nagevolg het. Dit is moontlik lekker om in die koor saam te sing van hoekom sekere dinge gratis moet wees maar die koor gaan nie help om kos op die tafel te sit nie, die voorsangers in die koor het gewoonlik hulle eie agenda.
