QUEENSBURY | Warren County government made a substantial change in their judicial system last week that is intended to protect the Constitutional rights of suspects, uphold the public’s right to witness court proceedings and protect the safety of crime victims. On July 12, the county launched a new system for centralized arraignments of suspects that are being held in custody by police and might be jailed. The courtroom recently constructed for these arraignments, situated on the Warren County Municipal Center campus, was dedicated July 10
with a ribbon-cutting ceremony, and is now being utilized. This new facility, along with the county’s accompanying new arraignment system, means that police officers, prosecutors and defense attorneys will no longer have to drive all over the county at any hour of the day or night to a town court for an arraignment. Also, judges won’t have to be called out unexpectedly in the middle of the night, or on weekends or holidays, to conduct these hearings. The arraignment court sessions are to be held each morning and early evening as needed, and town judges will be scheduled on a rotating basis to preside over these sessions. » Court Cont. on pg. 12

The new store is being built southeast of the existing one, which will be demolished afterward, so no interruption of the business is to occur.

Photos submitted are to be 5x7 or larger in size, or if they are digital, they should be clear and the resolution needs to be at least 300 dpi. Honorees can be living or deceased. A family member of a long-term resident — 20 years or more — may also be featured in the project, and in some cases, two family members may be displayed together on one utility pole. Banners will be displayed four to eight weeks after applications are approved, and they will annually be taken down and stored following Veterans Day, and put back on display by Memorial Day.

This last week, Town of Chester Supervisor Craig Leggett praised the Hometown Heroes initiative. “You can have names on impressive monuments in a beautiful park on the front lawn of the town center, but when you see the image of the service member, that brings it into the present moment,” he said. “Sharing the photo with others in the community really ‘brings it all home.’” ■

NORTHERN WARREN COUNTY | Within a few months, the images of past and present local U.S. military personnel will be prominently displayed alongside main roadways in the towns of Chester and Horicon, as a result of a program initiated by a local veterans group. The Glendale V.F.W. Post 5513 has launched its Hometown Heroes project, which features large banners bearing the names and photographic images of local service personnel — and residents of the two towns have been invited to participate.
‘LIVING MEMORIAL’
On Monday, Glendale Post Commander Harry Brundage said the banners would be a “living memorial” to those who have served our nation. “This program is to recognize and honor the residents and their family members who have served or are presently serving in the U.S. Armed Forces,” he said. The post is now accepting applications for military personnel to be included in the Hometown Heroes display, which has been successful in Ticonderoga and Willsboro. The Sun recently reported that because of the banners on display in these two towns, local residents have learned more about others in their communities, and made new connections: people have shared memories about neighbors and acquaintances,

and lost friends have been rediscovered through the projects. In Chestertown and Horicon, the banners — 20 inches wide and 60 inches tall — are to hang from utility poles in the hamlets of Chestertown, Pottersville, Brant Lake and Adirondack. Brundage predicted that the first series of banners would likely be on display in six weeks or so. Applications are to include proof of honorable discharge, a copy of military orders and a photo of a service member, the honoree’s proof of residency, former residency or local graduation — and a check for $225. Site preparation is to continue for about 14 days, and construction of the building’s foundation is to follow. The structure is to have neo-colonial architecture featuring a stone and clapboard exterior with an Adirondack ambiance, Kiesow said. The new Stewart’s Shop is expected to be complete in about two months and be open for business Sept. 25. In recent years, Stewart’s Shops have been replaced in Warrensburg, Lake George, North Creek and, more recently, Schroon Lake. The Bolton store was remodeled extensively. Plans call for the Stewart’s Shops in Elizabethtown and Peru to be demolished and rebuilt. ■

Blind Owl Band to perform in Thurman
THURMAN | The Blind Owl Band will be in concert at the Veterans’ Memorial Field in Athol on Monday, July 22, at 7 p.m. Hailing from Saranac Lake, they have been playing together since 2010, and describe their music as “freight train string music.” The band members include Erin Munley (mandolin, vocals), Arthur Buezo (guitar, vocals), Christian Cardiello (bass) and James Ford (banjo, vocals). If not now, when?
In 1985 while playing a pickup game of softball, I chased down a foul ball. By Dan Alexander Even though it hit • PUBLISHER • the ground and there was no play to be made, I charged the ball hard and stuck my left leg in the ground and leaned, apparently awkwardly, with my gloved hand to scoop up the ball. The next thing I recall is my knee hitting the ground and my body falling over to the side with my left hip laying on top of the left ankle. In one stupid moment, I had blown out my knee tearing most of the ligaments and much of the cartilage, requiring major reconstructive surgery. Back then, arthroscopic surgery was still relatively new. My operation was performed with a 10-inch incision on one side and a 2-inch one on the other side of the knee. After surgery, I was placed in a cast from the toes to my upper thigh and not allowed to bear any weight on the leg for 10 weeks, at which time I was put in a stable brace for six weeks. Once removed, the leg had badly atrophied, and both my knee and ankle had lost nearly all ability to flex. Four months removed from the incident, I find myself in physical therapy under the care of a short, muscle-bound, sadistic version of Arnold Schwarzenegger. I learned during the first few weeks of light therapy that the therapist seemed to enjoy sneaking up on patients when they least expected it and force that knee joint to bend farther than the Lord had designed for man. Once therapy advanced to the stage where I found myself lying face down on the weight bench doing leg lifts, I would never allow him to come from behind and grab my leg at the peak of its flex to stretch it farther without being prepared to resist with all my might. Through no fault of his, I never achieved full motion back in the knee until some 20 years later, when after a slight sprain in the right knee had me back in physical therapy. Resisting the inevitable only delayed my healing. That seems pretty clear to me now. So does resisting the corrections needed to resolve the crisis on our border. Everyone now seems to agree we’ve got a serious crisis. Sooner or later we are going to fix it, so why wait? We need to insist that Congress quit resisting and do its job. Deal with the pain now, by finding a compromise both sides can live with so we can put this issue, and all the fallout it’s causing, behind us. ■ (

Sometimes, conscionable men must point fingers! Why do we celebrate this special all-American day? Remember? It started as a protest by our ancestors and founding fathers, which included some finger-pointing, and some declarations, and lots of deadly fighting against a tyrant king. We broke-off to form a different kind of government based on the ideas of the people ... a concept which necessitates debate, and argumentation, and finger-pointing and voting. We should not be celebrating our military might, or our elitism, with the type of power-parades that other tyrants are fond of. We should be celebrating our new-won freedom from an (English) tyrant-king, as well as all the checks-and-balances our founding fathers gave us to prevent yet “another.” Opportunity is all around us — let’s use it. There is less purple (more charring) in mountain majesties, fruited plains and amber grains have been genetically toxified, our spacious skies at any given moment are crowded with 5,000 commercial aircraft, we live in a hazardous soup of EMFs, our “shining-seas” are glowing with dumped radiation and plastic, we have made our water unfit to drink and please show me one “alabaster city undimmed by human tears”! God may have crowned our good with brotherhood, but of late, we have downed and caged our brotherhood. God can’t be happy.

» Column Cont. from pg. 8 Voters across all of New York state can thank the Essex County Board of Supervisors for protecting their right to a secret ballot. Why? Because in 2016 the majority of the Essex County board decided that it was worth spending the money to appeal a trial court decision that allowed voted ballots to be obtained by anyone simply by submitting a written FOIL request. To recap, in 2016 a lawsuit was filed by known Democratic activists who some felt were determined to “test” New York election law for reasons we still don’t know. Former Essex Democrat Chairwoman Bethany Kosmider hired Democratic activist attorney and Lake Placid School Board member Bryan “Liam” Kennelly to file an Article 78 petition against Essex County. Kennelly claimed in his suit that Kosmider’s FOIL request for copies of ballots cast in the Rick Meyer versus Brian Barrett judge race was improperly denied. Why did Kosmider want to see the ballots from a race where the loser, Brian Barrett, was defeated by more than 1,700 votes? Nobody knows. Not even Kosmider, who gave different reasons throughout the three years of litigation ranging from “I wanted to look at ballots I had questions about” to “I wanted to study voting behaviors and patterns in Essex County.” Kennelly, who shares a law office with Barrett, in an attempt to publicly advocate for his client authored a letter to the editor titled, “No reason for Essex to litigate FOIL request,” in the Adirondack Daily Enterprise in September 2016 in which he argued “why waste money” that this was “all settled law” based on a 2014 advisory opinion by Robert Freeman, a state agency “official,” and that the practice of handing out voted ballots had been common practice in New York state.
» Trails Cont. from pg. 1 Peter Bauer, executive director of Protect the Adirondacks, called the ruling “historic,” and said it will stop construction of roads in the forest preserve and the resulting motorized traffic. Supervisors, meanwhile, said the ruling seems nonsensical because it counts saplings as “timber,” which is illegal to cut under the state’s storied Article 14 that protects the Forest Preserve. Bauer said the state, including the Department of Environmental Conservation and Adirondack Park Agency, have played fast and loose with this restriction, leading to corridors that are less like trails and more like roads. At the APA’s monthly meeting last week, Bauer asked board members to use the ruling as a reset and work to stop the introduction of motors in the wild forests. His comments drew a cool reaction from the board. Bauer said the ruling does not prohibit taking a limited number of trees for parking lots or footpaths. It does not say specifically how many trees are too many, but that snowmobile trails that are 12 feet wide or more are not consistent with Article 14, he said.
‘ECONOMIC DRIVER’
The snowmobile connector trails were promised by the state dating back to 2013 when it acquired a portion of 161,000 acres of Finch, Pruyn timberland that had been acquired by The Nature Conservancy in 2007. The purchase exempted the land from taxation — a loss for local governments — but supervisors agreed to support it in part because of the promise of increased economic activity brought by snowmobiling. That fit with the state’s plan to build a recreational hub at the former Frontier Town in North Hudson. Snowmobilers could hop off the Northway at Frontier Town and then ride through the Adirondack mountains from North Hudson to Minerva, Newcomb, Indian Lake and Long Lake. But Protect argued the trails would

Kennelly was found wrong on both counts. County attorney Dan Manning surveyed several counties for their policies with most counties responding that they did not release ballot images without a court order. Ironically, Kennelly with only five years of legal experience (admitted to the bar in 2011) also asked in his lawsuit for the court to award him attorney’s fees at $375 per hour to be paid by Essex County. That hourly rate would make most senior attorneys in the Adirondacks blush. After asking for the court to award him attorney’s fees, Kennelly then stated that Essex County should not be wasting taxpayer dollars by paying outside attorneys. He’s right and need not worry, the New York State Court of Appeals ruled that his client Bethany Kosmider is now responsible for paying costs associated with the lawsuit. On the topic of spending taxpayer dollars on this case, the attorney who represented the Republican election commissioner and Essex County, James Walsh, also a candidate for Supreme Court this year, felt so strongly about this case that he decided to move forward with the appeal pro bono, “no charge” to the county. New York state voters owe Jim Walsh a debt of gratitude as well. Kosmider, unfortunately, has a history of questionable interference with election activities in Essex County. On July 30, 2015, Kosmider locked herself and then Democratic Election Commissioner Mark Whitney behind closed doors in a public building and refused to allow a county employee to take part in an official proceeding with his counterpart. This lawsuit raises more questions. Should counties be put in a situation where they need to be the decision-making body in matters of election law? I would hope not. We already have enough frivolous

That number included saplings that the court ruled counted as timber. “In my mind this is so frivolous it’s ridiculous,” Indian Lake Supervisor Brian Wells said. “We have put so much work into this over the past 13 years, talking about how we are going to recoup lost (tax) revenue.” Wells said the network would be an “economic driver” for small Adirondack towns, and would open up other areas of recreation, such as horseback riding.
MEANING OF TIMBER
Newcomb Supervisor Robin DeLoria said the meaning of timber is clear, as defined by Webster as trees that can be sawn into structural uses. And to use the park, trails need to be built. “To believe our Conservation Department should not be allowed to build trails for hiking, biking, mountain climbing, access for hunting trails, fishing trails to state owned waterways, brook and streams or even winter use by cross country skiers, snowshoeing or snowmobile enthusiasts who use the trails only a few short months, defies logic simply by definition,” he said. Both sides might appeal the ruling, which Bauer said was a “split decision” because the court did not accept Protect’s argument that structural improvements such as bench cuts, fill and rock removal were not legal, as well. The DEC might be less likely to appeal if it fears that it might lose on this point as well at the state’s highest court. In a statement, the DEC said, “The New York State Department of Environmental Conservation is reviewing the court’s decision and working to determine the best option going forward.” DeLoria said it will have the supervisors’ backing if it does. “I can confidently say, the local governments of the Adirondack Park stand unified and ready to support the DEC legal team, the attorney general’s office and Gov. Andrew Cuomo in reviewing the decision and the options available,” he said. ■
lawsuits clogging up our courtrooms. Every American wants transparency and fair elections; it is a sacred right that many have fought and died for. Just as sacred to Americans is the protection of the “secret ballot.” Many of our 42 election districts in the 18 towns in Essex County are very small, and in some elections only a few voters cast a ballot in a primary election in a specific election district. Viewing those ballot images could potentially expose the individuals’ confidential voting decision. So much for your secret ballot if Kosmider had gotten her way. Small counties like Essex with tight budgets (and there are many) should not be used as a testing ground for statewide election law politics. As predicted, this issue played out on a larger stage and in the highest court. In the end, the highest court in New York reversed the lower court rulings based on election law, not an opinion. It’s too bad Essex County had to be the laboratory for questionable purposes and disingenuous motives. Perhaps in the future, the progressive downstate-controlled state legislature will decide to amend this section of election law. For now, this matter is “settled law.” For those New York voters who expect their votes to be kept secret, they will be, thanks to Essex County supervisors and the New York State Court of Appeals. » Banners Cont. from pg. 1 On Monday, seven banners, as large as 11 feet long and 5 feet high were affixed on the fence, many of them without permission of town officials. Although most of the signs displayed recently on the fence have been to publicize town and village events, many have been to promote events sponsored by businesses. Some have borne political messages. Lake George Town Supervisor Dennis Dickinson said he’s seen signs advertising a local event hanging on the fence for up to six weeks before the event was scheduled and a few weeks afterward. “I don’t want to micromanage, but we have to limit the signs’ size, delineate where the signs can be placed on the fence and limit the length of time they can hang,” he said. Dickinson added that the privilege of draping banners on the fence is primarily granted by the town to civic groups and not for private enterprises. In other business, the town board heard a report from town buildings and grounds superintendent Jim Martino that seasonal renters are again populating the Diamond Point Beach, which is to be reserved for Lake George town property owners. “The homeowners who are renting their houses out are advertising their properties saying renters have (access to) a private beach,” Martino said in a report to the board. “I am doing my best to uphold the rules for the residents of Lake George and Diamond Point.” In recent years, local residents have complained about nonresidents on the beach creating disturbances or crowding out Diamond Point residents. Martino also reported that his department’s laborers, along with highway workers, replaced a collapsed roof at the town highway garage; and that a new electric service line has been in-

PUMP REPLACEMENT, PAVING
Board member Dan Hurley reported that a 10-horsepower pump that pressurizes water for the Diamond Point Water District burned out, and needed replacement. He said that failure of pumps in water systems was to be expected, unless they were variable-frequency drive pumps that were part of a constantpressure system. Such an upgrade would cost the town $15,278 instead of the $11,000 or so for the basic pump. The board authorized purchase of the variable-frequency version. Also, board members read a report from new town Highway Superintendent Rob Lanfear that paving had begun on 3,300 feet of Wall Street and 3,500 feet of Dixon Hill Road. Lanfear noted that since it has been determined that the town owns Beatty and Cedar roads, paving is to be accomplished soon after a stormwater plan is conducted. In other business, the town board approved authorizing Dickinson to submit several grant applications. One of them is to bankroll an engineering analysis and report on the Caldwell Sewer District’s wastewater collection system — particularly the lateral service pipes that allow infiltration and inflow. Another of the applications is for a state grant to develop a new recreational park on French Mountain, to be called the McPhillips Preserve in recognition of the former owners’ philanthropy. The 317-acre McPhillips Preserve park is to feature recreational trails, educational facilities and perhaps low-impact tent camping. Dickinson said the grant application would be submitted to the state Office of Parks, Recreation & Historic Preservation requesting $150,000 — with the town to match this sum with an equal value of labor and equipment use. ■

Local angler set for Lake Champlain event

PLATTSBURGH | There’s two reasons local angler Ben Wright likes f ishing Lake Champlain. Sure, it’s his hometown lake. But it also boasts a quality that Wright finds special as he hits the water for this weekend’s Costa FLW Series Northern Division event, set for July 18-20 on Lake Champlain. “Lake Champlain is special not only because it’s home but because it’s the type of place you can win with smallmouth, you can win with largemouth, or you can win with a combina-
tion of the two,” Wright told The Sun. “Most fisheries that we travel to, one species is sort of dominant. You’re either fishing for largemouth or you’re fishing for smallmouth. Here, you will very likely see guys in the top 10 that weigh both largemouth and smallmouth. And I find that to be pretty special because not a lot of places you can go have the quality of fish that we do.” “They are certainly places that have larger fish, but there are very few places — I’ve been to a lot of different lakes across the country — that you can catch a winning bag of smallmouth and a winning bag of largemouth.”
TOURNAMENT TIME
Wright, 39, started fishing “when I was probably 5 or 6 years old with my dad.” About a decade ago, the Cumberland Head resident and Saranac native started tournament bass fishing. He has fished Lake Champlain countless times personally, but now has a foundation of tournament experience to go along.

Photo provided “I’ve fished probably 25 tournaments on the lake over the years, but these larger tournaments are usually one to two a year over the last 10 years, so I would say professional level tournaments - 10 or 12 times. State, regional, federation type tournaments another 10 or 15 times.”

For Wright, he thinks of these tournaments as getting paid to pursue his hobby. He works in IT and likes to spend as much time as possible with his loved ones — including longtime girlfriend Melissa, daughter Hannah and stepchildren Ben, Emma and Grace — forgoing last weekend’s FLW Bass Fishing tournament here in town to attend a family event. “I fish regionally at the Costa level and I fish some BFLs here and there, but I work as an IT project manager at a hospital. Fishing is absolutely a hobby for me, it’s not something

where I’m out chasing the dream trying to become a professional angler that pays my bills doing it. That said, I’ve been very fortunate over the last several years. I’ve had some successes that have put me in a position where I’ve made a little bit of money, and I’m also fortunate that I have some good sponsor support (Chamber of Commerce) that helps with my entry fees and my travel expenses. “Fishing doesn’t really cost me a lot of money, so fortunately any return I do get is money that goes right in my pocket.” Take-off for the Costa event — hosted by the City of Plattsburgh and the Adirondack Coast Visitors Bureau — is at 6 a.m. all three days at the Plattsburgh City Marina. Weigh-in will be from 2-6 p.m. each day at the same location. “I absolutely love this lake and I can’t wait to get out there,” Wright said. ■

WARRENSBURG | Guided tours of gardens, a presentation by Charlie Nardozzi and bee tea are some of the attractions featured Saturday, July 20, rain or shine around Warrensburg. Programs/tour and raffle tickets will be available from 10 a.m. to noon at the Warrensburgh Museum of Local History. The tour of the private/public gardens is from 10 a.m. to 2 p.m. The presentation and bee tea is at 2 p.m. at Warren County Fish Hatchery Pavilion. The event is sponsored by Warrensburgh Beautification Incorporated. All proceeds will benefit the Warren Tannery Park and Heritage Trail. This self-guided tour will feature both public and private
gardens in the Town of Warrensburg. Brief descriptions of the gardens will be provided to enhance the experience of the tour. Refreshments will be provided at some locations. Nardozzi, nationally recognized garden writer, speaker, radio and television personality, will discuss a topic that is of concern to gardeners worldwide — the blight of pollinating bees, butterflies, insects and other creatures. Growing a pollinator garden or integrating pollinator-friendly plants into your landscape can help create the food, shelter and habitat these creatures need to survive. The presentation will describe the importance of pollinator gardens, different types of pollinators, and the best types of annuals, perennials, shrubs and trees to integrate into the garden.

Young girl vanishes, parents prostrated Since June 20, 1919, nothing has been seen or heard from Maud Ryther, a Stony Creek girl who went to New York City early last spring to work as a domestic. Her parents, Mr. and Mrs. Warren Ryther, of Stony Creek, fear that their daughter might have met with foul play, died unknown in the great metropolis, or have fallen a victim to white slavers who traffic in young women for immoral purposes. The police in the city and the state constabulary have been asked for help to solve the mystery of her strange disappearance. Miss Ryther left Stony Creek last spring for Glens Falls where she received employment as a domestic in the home of Adolphus Bronne, a shirt manufacturer. Later the Bronne family moved to New York City for a short period and the girl accompanied them to the city where she resided and worked for them. In the forepart of June the family returned to Glens Falls bringing Miss Ryther back with them.
A few days later the girl left for New York stating that she liked that city and had employment promised to her by people she had met while formerly in the city. Regular correspondence was kept up by her with her parents and friends at Stony Creek for a couple of weeks and letters were received up to June 20, 1919. After that date any letters mailed to her at the home of her new employer, Mr. Bruse Moss, were returned “unknown at that address.” Since that date nothing has been heard from the girl and the family has instituted a desperate search. Miss Ryther, who had just reached her 19th year, has always borne a good reputation and was very jolly and lively, Her mother, Gladys Ryther is employed at Arbuckle’s boarding house in Stony Creek and is very disquieted and beyond being consoled in the matter. The girl is described as being about 5 feet, 6 inches in height, weight of about 120 pounds, jet black hair, gray eyes and she has a birth mark resembling a burned
or scalded spot of about two and one half inches square on one of her cheeks.

The last will and testament of Miss Delilah Parker, late of the town of Thurman, has been declared by surrogate George S. Raley to be null and void and her estate, valued at about $10,000 will therefore be divided among her next of kin the same as though she had left no will at all. Miss Parker made her will on the day of her death, after having been given a hypodermic injection of morphine. She did not name as beneficiaries several persons whom she had previously stated she intended to remember. The disinherited relatives instituted proceedings to have the new will set aside and the judge declared that the morphine had made the lady incompetent. Mr. Orley Hazelton was named as her executor.

The great monastery was built in the middle of the 16th century and the dogs were known the world over as they were used to find frozen victims in snow drifts. Citizens share fond memories of Andy Sprague

WARRENSBURG | Renowned community activist Andrew C. “Andy” Sprague died July 5 at age 71, and this week his friends and co-workers offered thoughts about his positive impact on area families, local culture and public safety. Sprague served as director of Cornell Cooperative Extension of Warren County from 1972 to 2007, and during that time, he organized the annual Warren County Fair — which decades ago was a three- and four-day event. In his role with Cooperative Extension, he lead 4-H programs and established the agency’s Adirondack Guides program. His civic service included work serving as captain of the Warrensburg Emergency Squad during pivotal years in the 1990s. A firefighter since his youth, Sprague joined the Warrensburg Volunteer Fire Co. in 1985, and served on the organization’s board of directors from 2005 to 2016. Through the Adirondack Guides program, Sprague taught many dozens of teenagers backpacking, adventure camping and canoeing skills.

Justina Sweet Beswick of Queensbury was one of those teens. She shared memories of how Sprague lead her and her older sister Jessica on survivalist camping trips — several of which were three to four days long. “We went deep into the Adirondacks carrying all our camping gear, and we slept in tents or lean-tos,” she said. “Andy taught us tree identification, how to tie knots, and all the safety stuff you need to know camping in the wilderness.” Beswick added that it was “amazing” what she was exposed to through 4-H and Adirondack Guides, noting that Sprague taught her all sorts of skills, including how to shoot black-powder guns, how to give effective public presentations, as well as how to survive the brutal cold of overnight winter camp-outs. “The experiences and Andy’s guidance really gave me self-confidence to believe in myself and know that I could go in any direction I wanted to in the future,” she said, relating memories of the trips he led to New York City and to the New York state capitol. Beswick said Sprague was a role model for her — how he reached out to others — and it lead to her career as a su-

‘AN EXTRA FATHER’
Other members of the Adirondack Guides and 4-H also shared their memories this week on an online memorial “guest book.” “I’ll never forget his guidance and leadership on those amazing 4-H summer canoe trips in the Adirondacks. Andy was like an extra father to me and countless others in the area. He’ll be greatly missed, but his legacy lives on in all of us,” wrote a man from Malta. A Salem resident offered similar thoughts. “I will cherish the great memories, of fishing, hunting and camping with him — He had amazing patience with kids.” A man from South Glens Falls recalled his younger years with Andy, going to the state fair, and on the trips into the wilderness. “He always loved what he was doing teaching and sharing what he knew with us kids — I learned so much from the time with him,” the man wrote. “He was a great man who left a lot of memories with a lot of people.” Another man, from Wilmington, N.C., wrote this: “Andy was the best kind of person — tolerant and goodhumored. I have fond memories of him in school classes, on scouting trips, and hunting.”

This centralized arraignment system is relatively rare — it is the second one in the state’s Fourth Judicial District, which spans 11 counties in northeastern New York from Schenectady County north to the Canadian border. In years past, these off-hour and weekend arraignments may have only hosted a judge, a suspect and the arresting police officer. But in 2010, the Court of Appeals affirmed the Constitutional requirement to provide for a defense attorney to be present at every arraignment for a serious crime. Then in 2016, the state legislature approved
Sprague hired Amy Sabattis in 2000 as Cooperative Extension’s marketing coordinator, and she offered her memories of him this week, noting he had “great leadership skills.” “He gave you guidance but never micromanaged you,” she said. “He was quick with praise and encouragement, which made you always want to do your best.” She added that he was very organized and had high expectations, but had a lighthearted approach. “Andy ran a tight ship, almost military style, but he wouldn’t stress over the little things,” she said. Longtime Cooperative Extension agent Ruth Fruda offered her thoughts. “He loved the outdoors, and one of his greatest joys was
a measure that allows counties to create the arraignment courts. Since then, dozens of people involved in Warren County’s public safety, its facilities and the area’s judicial system have been formulating a plan to establish the centralized arraignment court. Glens Falls Judge Gary Hobbs, who supervises local court justices in the area, oversaw the efforts to develop the new arraignment system. At the court’s dedication, however, he deferred credit to others. “We had groups come from different state agencies, local municipalities and the county, who had differing views, interests and responsibilities that all worked together to make this happen,” he said.

Navy Chief Petty Officer Les Macura of Granville served with Sprague for 25 years in a Navy Seabees battalion. “You could always depend on Andy,” Macura said. “Whatever he did, he did Andrew C. “Andy” Sprague (March perfectly, every time.” 5, 1948 — July 5, 2019) Warrensburg SuPhoto provided pervisor Kevin Geraghty recalled how Sprague lead the local emergency squad during a crucial time in which it was preparing to spin off from the fire company. Sprague was assistant captain of the squad from 1992 through 1994, and captain from 1995 through 1997. “And kept the squad on the rails for us,” Geraghty said. “He was a great guy — he was a tireless worker and would do anything for anybody.” During the last several years of his life, Sprague was afflicted with ALS. Sprague grew up in Gouverneur, and developed a love of outdoors in Scouting. In his teen years he earned the rank of Eagle Scout. After his high school graduation, he attended Syracuse University where he earned a degree in Forestry. Fairly late in his career with Cooperative Extension, he served in the Navy during Operation Iraqi Freedom. Sprague’s memorial service was held July 9 at Alexander Funeral Home in Warrensburg, following calling hours that drew many dozens of people. Interment with full military honors was conducted July 10 at Gerald Solomon/Saratoga National Cemetery in Schuylerville. The Sprague family has requested that expressions of sympathy take the form of donations to the ALS Regional Center at St. Peter’s Hospital. ‘NO SMALL FEAT’
The new arraignment court is located in the old county jail’s booking area, which in recent years has been used as a storeroom. Sheriff Bud York noted that this is an ideal location, as it is adjacent to a secure “sally port” or garage — in which a police officer can securely deliver suspects directly into the court through an entrance with a fortified door. Hobbs said that with a centralized arraignment court, all people who have interest in the proceedings — including victims’ and defendants’ families as well as media representatives, can now conveniently attend the sessions, as they are held on a set schedule. “This means a much more open government, which is what we should be striving for,” he said. County Administrator Ryan Moore, who emceed the dedication ceremony, noted that the new court would save time for the county’s public safety and judicial personnel, and it would also save taxpayer dollars previously spent on overtime and travel expenses. Chester Supervisor Craig Leggett and former Queensbury at-large Supervisor Ron Montesi were both praised for their successive roles in planning for the transition to a centralized court. Leggett credited dozens of others in county
government as well as area judicial officials. “This was no small feat,” he said.
ORDERS OF PROTECTION
Another prominent aspect of this new centralized arraignment court is that if the presiding judge institutes an order of protection, area police agencies will be notified within minutes of the decision, Hobbs said. Under the prior system, such notification might have been delayed for hours or even days — until the town court clerk returned to work. Hobbs also said that a new state computer program immediately alerts all courts and law enforcement agencies statewide of such orders. Hobbs noted that the new arraignment court has a secured conference room, where suspects can meet and talk confidentially with their defense attorney — unlike most local town courts. After the dedication ceremony, county board of supervisors chairman Ron Conover of Bolton hailed the new arraignment court as a major accomplishment. “We’ve found the best way to ensure that we have efficient administration of justice while protecting defendants’ and victims’ constitutional rights — and access for the media — all of which are very important in our democratic and judicial process,” he said. ■
