P’burgh lawyer found dead; city PD investigate Attorney Justin Herzog failed to appear in court By Elizabeth Izzo STA FF W RITER

PLATTSBURGH | Plattsburgh City Police have confirmed that attorney Justin Herzog was found dead in his law office Monday afternoon.

“It is not believed that this is a suspicious death,” City Police Chief Levi Ritter said. Police and EMS responded to Herzog’s office at 5139 U.S. Ave. at 5:35 p.m. yesterday after receiving a report of a “male that was not conscious and not breathing” from an employee of the law office, according to Ritter.

An autopsy was scheduled to be performed Tuesday morning. City police are investigating. The Clinton County Sheriff ’s Office issued a warrant for the arrest of Herzog Monday. Herzog, 44, failed to appear in court to face multiple felony charges stemming from an alleged domestic violence dispute in February. Police say Herzog was scheduled to appear in court April 8 to be arraigned on one count of second-degree attempted murder and two counts of first-degree burglary, both

class B felonies; one count of second-degree burglary, a class C felony; and first-degree unlawful imprisonment, a class E felony. Police said at the time that he would likely have been driving a 2011 Chevrolet Impala with a license plate that says “ZOGLAW.”

ACCUSED OF STRANGULATION, RECKLESS ENDANGERMENT

Herzog was initially arrested at a Chazy residence in February for allegedly strangling a woman and threatening her, and an unidentified 13-year-old, with a knife. » Herzog Cont. on pg. 2

FUNDING NEEDED

The Literacy Volunteers of Clinton County asked the county legislature last week to consider contributing $8,000 toward a summer camp designed to help underprivileged children with their reading and writing skills. Photo by Elizabeth Izzo

By Elizabeth Izzo STA FF W RITER

PLATTSBURGH | Luke struggled to read and write. When he left Kindergarten at Northern Adirondack, educators told local mother Ashley Manor that her 6-yearold son’s literacy skills lagged behind other kids his age. At the time, she worried that he’d be held back in school. She worried about his future. “It was a nightmare, to say the least,” she told the Clinton County Legisla-

ture last week. When she learned that the Literacy Volunteers of Clinton County hosted an educational literacy camp for kids each year — a program now seeking $8,000 from the legislature to keep the camp going — she was skeptical. “I was pessimistic that literacy camp would improve his skills in that short amount of time,” she said. But she witnessed a transformation over the span of the two-week program. Suddenly, her son was fi lled with enthusiasm about reading and writing. “He woke up in the morning wanting

Linda Carela, the director of the Literacy Volunteers of Clinton County, said that the group hopes to help more children like Manor’s son. For the last six years, the program has been funded by tuition costs and SUNY Plattsburgh’s Literacy Education program. “The deactivation of that program has put us in a position of seeking outside funding in order to keep camp affordable for families,” said Jean Ann Hunt, president of the Literacy Volunteers of Clinton County board. Every year, Clinton County doles out tobacco settlement money to community projects. This year, the Literacy Volunteers are asking for $8,000 to help fund their summer program, a two-week camp designed to foster a love for reading and writing by aiding children and adults alike with developing their literacy skills. » Funding Cont. on pg. 2

Mooers Free Library vies for funding Library reps eye park, community garden area By Elizabeth Izzo STA FF W RITER

PLATTSBURGH | Representatives of the Mooers Free Library are seeking funding for a proposed park and community garden. Tim Gonyo, president of the Mooers Free Library Board of Trustees, asked the Clinton County Legislature last week to consider granting the library $10,000 toward the development of a piece of property outside their School Street building.

“We want to create greenspace — create a little park there and have raised beds for a community garden,” Gonyo told The Sun. “We want to put in seating for families, and a nice gazebo so we can do some outdoor education.” Altogether, the project is expected to cost roughly $20,000, according to Gonyo. The $10,000 ask would supplement $7,000 from the sale of the library’s previous location on Route 11, along with $3,000 from its ongoing memorial brick fundraiser. “Once we get the funding, we’re looking at this being a spring-summer project,” Gonyo said. The library’s request was one of nine submitted to the Clinton County Legislature for consideration last week.

Every year, the legislature doles out tobacco settlement funding for community-level projects. The nine applications submitted asked for a total of $113,000, according to Deputy County Administrator Rodney Brown. County Administrator Michael Zurlo said that as much as $89,000 in funding is available. Legislators were expected to decide which projects would receive funding on April 10, after this edition went to print. ■

“Funding from the legislature would help us provide materials to keep children engaged in literacy all summer long — lessening the chance that they will experience the ‘summer slide’ in their literacy skills,” said Hunt. The group plans to use the funding to buy backpacks, t-shirts, books and other supplies they need to keep the program running. All told, the camp is going to cost $14,550 to put on this year. SUNY Plattsburgh has already donated the use of Sibley Hall, along with some administrative services. The United Way has donated $500 to foot the bill for two students’ tuition. Services, the Rotary Club, One Work Source and the Childcare Coordinating Council are all involved. Carela estimates that roughly 8,800 Clinton County residents age 16 and older lack basic literacy skills and read below a third-grade level. Last year, 58 percent of children here tested not proficient on the English language assessment, according to Carela. In the group’s application for funding, the literacy volunteers underscored their desire to curb this trend, which the group directly linked to job readiness and employability. “It is essential that our students acquire the skills necessary to obtain jobs in the North Country which will directly contribute to the economy and the health of area businesses,”

Juniors invited to learn about SUNY Plattsburgh

City police arrested Fabian last June. He was convicted by a jury in Clinton County Court of two counts of third-degree criminal sale of a controlled substance and two counts of third-degree criminal possession of a controlled substance, all class B felonies. He was sentenced to seven-and-a-half-year determinate sentence, two years post-release supervision and a $20,000 fine. He’s been in custody since his arrest June 21, 2018. Fabian’s case is being prosecuted in federal court by Assistant U.S. Attorneys Douglas Collyer and Troy Anderson. His case was prosecuted in Clinton County Court by Clinton County District Attorney Andrew Wylie. City Police Chief Levi Ritter did not immediately respond for comment Monday. ■

Thoughts from Behind the Pressline

The story behind the story: Part III

suncommunitynews.com/opinions

AND HERE IS YOUR APRtL 1Stn FoRECAST

The past few weeks I’ve been addressing issues with the newspaper industry and this column will continue along that same line. My thought this week was to focus on the free newspaper model we’ve been developing here at The Sun and why I believe it has greater sustainability moving forward than the traditional paid model, which has been in decline for the last By Dan Alexander 15 to 20 years. • PUBLISHER • Unfortunately at this weekend’s annual New York Press Association Conference, a surprising story was unfolding regarding the Watertown Daily Times and its sister publications including the Malone Telegraph. An editorial in last Thursday’s paper written by Alec E. Johnson, managing editor for the northern New York newspapers, disclosed some alarming news. Citing a Pew Research Study as a backdrop that generally finds newspapers throughout the country were in good financial shape, he reports that the past decade had been the worst on record for many newspapers including those in their group.

Letters

Thankful for ‘dynamic pharmacist duo’

To the Editor: Editor’s note: This letter references Berneice Conlon’s letter, “Grateful for help at Walgreens,” which appeared in the April 6 edition of The Sun. Last week, one of your readers wrote about the wonderful job Christine Williams, pharmacist at Walgreens in Chestertown, was doing. Could not agree more. But it would be remiss not to also recognize Lori Mosher the other regular pharmacist working with Ms. Williams. Together they provide outstanding service. The community is fortunate to have this dynamic pharmacist duo. Thanks to both for their service. - David Gottesman, North Creek ■

More disturbing was the announcement that he and his cousin had just informed their employees that paychecks expected that day would be delayed due to sharp declines in advertising and circulation revenue. The Johnson family, fourth generation steward of the Daily Times, is a well-respected organization throughout the industry and this news as you might expect put quite a hush on the attendees at the conference. Mr. Johnson goes on to explain that in the coming weeks, the organization will be forced to re-evaluate all their properties and attempt to recreate their business model.

Occupancy tax will harm local businesses

To the Editor: Editor’s note: This letter references Elizabeth Izzo’s article, “Essex County seeks occupancy tax hike,” which appeared in the April 6 edition of The Sun. I am commenting on the article in a recent edition, “Essex County seeks occupancy tax hike.” First of all, people must realize the occupancy tax is not paid by people visiting Essex County. It is paid by local businesses, waiters and waitresses, store owners, etc. When a person or family goes on vacation, they usually budget a certain amount for that vacation. Let’s say that’s $5,000. That $5,000 will be spent in and around the vacation area. Those funds will be paid to hotels/motels, restaurants, stores, rental agencies, etc. If you listen to the “supervisors,” these vacationers decide to come to Essex County and decide to spend $5,000. Then, the vacationers say “We need to bring an extra $200 because the Essex County Board of Supervisors just raised the occupancy tax from 3 percent to 5 percent!” You think that happens? Or do you think the vacationers just deduct the new tax amount from their total vacation budget? Another comment is that any promotional material for Essex County should come with the following warning: “Vacationing in Essex County, New York will expose you to

In the editorial, Mr. Johnson notes that without the lost revenue, to maintain their current levels, the newspaper’s subscription cost would likely need to go from $291 per year to about $1,000. This will be no easy task for the venerable publishing group, but if any organization of their size and scope can accomplish this task, they certainly stand the best chance of creating a profitable new business model. The difficulty they face developing a new model on the fly is much like the re-engineering an airplane engine in flight before they land. The Sun weaned itself of circulation revenue long ago and learned to operate strictly on advertising income. It has allowed us to operate more like the Wright Brothers at Kitty Hawk when they perfected the new mode of air transportation. We wish our neighbor to the west the very best and are rooting for their quick return to profitability. ■

These diseases can last a lifetime…come to Essex County at your own risk…and the governor of the state just wiped out the research budget for this very serious condition.” Gov. Cuomo just passed a budget that eliminated the $1,000,000 that was in last year’s budget for tick/lyme research. One million wasn’t enough, but this year the amount is “zero.” Shows you what Cuomo thinks of the North Country! Resources available for those impacted by ‘Unplanned’

To the Editor: My response to the movie “Unplanned”: I was given the opportunity to coordinate a prerelease of “Unplanned” thanks to the hard work by 40DFL National Team. We had a full house and everyone I spoke with was very grateful to be able to see the movie. “Unplanned” was produced quite simply and truthfully, following the book of the same title. The movie is bloody — as is abortion. Two abortion procedures were shown: 1) Medical, where the child is sucked out of the womb at 13th week of pregnancy. 2) Chemical, done prior to the ninth week, first pill destroys the baby, second pill expels the baby. Most people aren’t aware there are doctors trained to do abortion pill reversal, a baby’s life can be rescued if the mother changes her mind after that first pill. The movie did not go into too much detail of what happens to the mother of the baby that has been aborted. Many of the women looked sad, confused, angry, betrayed. Post abortion syndrome can go on for years, silently, leaving women and men feeling they are alone, unable to find forgiveness. There are many healing programs available for women, men, grandparents, anyone who is negatively affected from an abortion. Because the movie affects everyone in many different ways, contact information was made available at the end of the movie. If you would like to speak to someone, just call or text to 855801-4673. Someone who cares is waiting to speak with you. - Nancy Belzile, Willsboro ■

Cadyville Family Dollar slated for grand re-opening Company to unveil renovated store this Saturday By Elizabeth Izzo STA FF W RITER

CADYVILLE | The Cadyville Family Dollar has gotten a facelift. The store has been renovated, and a grand re-opening cel-

ebration is set for April 13 from 10 a.m. to 1 p.m. “Family Dollar is proud to be a part of the Cadyville community and we’re excited to welcome existing and new customers to our newly renovated store,” Heather Briganti, a spokesperson for Family Dollar, said in a statement. The store remained open as it underwent renovations. The shelving and layout of the store is now streamlined. Additional freezers and coolers have been added for a greater variety of groceries, including seasonal offerings. The checkout area has been reconfigured, and there are now snack

displays there, according to Briganti. “We have expanded our selection of food, beauty and essentials, household products, and seasonal items. Our renovated store should provide even greater value and convenience to our shoppers,” she said. As part of the store’s grand re-opening the company plans to raffle off gift baskets and provide free samples of products. The first 50 people in the door will get a gift card and reusable shopping bag, according to a news release. The store is located at 953 state Route 374. ■

the Plattsburgh Common Council authorized the mayor to execute a $500,000 purchase agreement for the company’s Margaret Street building. The city plans to raze the structure to build a new public parking lot there, one portion of an overarching plan to replace parking displaced by the pending redevelopment of the Durkee Street parking lot. Jillian Cutrone, a spokeswoman for Glens Falls National, said that the Durkee Street outpost will house the company’s branch, lending and business development team. Insurance operations will be moved to the bank’s U.S. Avenue loca-

tion, which is being renovated. “This is all part of our bigger initiative to optimize our entire Plattsburgh branch network,” she said. All three of the Glens Falls National Bank branches in Plattsburgh are either being relocated or renovated. The company’s Cornelia Street operations are moving roughly one mile east, to a new building on Smithfield Boulevard. That location is expected to open in September, according to Cutrone. ■

The free event will feature performances and displays celebrating French-speaking culture including skits, short plays, puppet shows, songs, dances, cultural displays, informational segments, poems, etc. The event is made possible through sponsorship by the Adirondack Foundation and the Foreign Language Enhancement Fund Grant. ■

Tickets are $15. CAC will present the play “Cry, Havoc!” May 10 at 7:30 p.m. Tickets purchased at the same time for both are $12.50 for each show. All ticket sales, including service fees, are final and non-refundable. To book, call the box office at 518-563-1604 (ext. 105) or visit strandcenter.org. ■

Section VII/CVAC hockey all-stars honored By Keith Lobdell SPORTS EDITOR

PLATTSBURGH | Kaden Kowalowski of Beekmantown and Lydia Bullock of SLP were named as the Most Valuable Players this season in Section VII/CVAC hockey. Kowalowski was an explosive player who led the league with 63 points. “He has the ability to change the complexion of a game every time he is on the ice,” Beekmantown and CVAC coach of the year Justin Frechette said. “He is a solid two-way player, who takes great pride in doing all the little things really well that often do not show up on the score sheet. He has developed into one of the most complete all around players in the state earning all-state honors this season for his work.” First-teamers also included: Nate Boule (PHS): “One of the best leaders to ever come through the Hornet Hockey Program,” said PHS coach Jamie Reidy. “His stats are always at the top of the CVAC, but its his second to none drive and work ethic that he has both on and off the ice that separate him from most other players.” Rhett Darrah (Saranac Lake): “Rhett was an offensive threat this year finishing with 28

goals and 15 assists,” said coach Will Ellsworth. “He created offensive scoring chances every time he was on the ice.” Alex Dukette (Saranac Lake): “Not only was Alex our Captain this year-he was our go to guy,” said Ellsworth. “He played all three zones of the ice well and played every shift like it was his last.” Ethan Kay (PHS): “Ethan was outstanding this season at both ends of the ice,” said Reidy. “A shut down defenseman, who moves the puck well and Quarterbacks the power play.” Carter Sturgeon (Saranac Lake): “Carter is a skilled offensive defenseman who has great vision on the ice for a freshman,” said Ellsworth. “Carter had the ability to create much needed offense at times and control oppositions forecheck with escape moves to generate our breakout.” Ethan Garrand (NCCS): “Ethan Garrand led the pack this year with 331 saves in league play, with a save percentage of .907,” said coach Scott Lafountain. “Ethan was also the captain of the Cougar hockey team. He’s a great goalie, teammate and leader on and off the ice.” Second-team awards went to Kagan Livsey (Beekmantown), Greyson Giroux (PHS), » Hockey Cont. on pg. 11

Work on the town’s Main Street project, which was set to include streetscape and landscaping updates, was expected to be completed last November. The town had already spent at least $22,940 in preparing for that construction phase — $6,960 on a survey; $14,750 on a contract with Place Alliance, a planning and engineering firm; and $1,230 on Engineering Ventures. Now, the town’s Community Development Coordinator, Adele Douglas, is looking for ways to salvage the project. Douglas did not respond to multiple requests for comment over several days seeking information on the status of the project, and proposed plans on how the town may choose to proceed. But Douglass indicated that the town was exploring multiple avenues forward. Of the money that’s left, the town may seek to repave a street leading to Heyworth-Mason Park, according to Douglass. “Any of that money that we can (use) — for me, I don’t want to lose it,” he said. “We’re going to try to capitalize on all we can.” ■
