City taxi owner calls for rate increase

Higher wages needed to attract drivers By Elizabeth Izzo STA FF W RITER

PLATTSBURGH | The owner of a local taxi company requested last week that the Common Council increase Plattsburgh’s fare limit for cabs operating in city limits. Plattsburgh City Taxi Owner Perry Buck asked the council to raise the maximum ride rate limit within the city. The current rate ranges from $5.50 to $9.25 depending on the number of passengers, length of the trip and time of travel. Buck wants to see an increase of $1.50 per fare. With minimum wage on a staggered schedule of increases in the state, the current city rate makes it difficult to pay drivers a competitive wage, he said. “I’ve been losing a lot of drivers in recent years

Perry Buck, owner of Plattsburgh City Taxi, asked the Plattsburgh Common Council last week to consider increasing taxi rates for companies operating in city limits. File photo who are leaving to take other jobs,” he said. “We’re just trying to keep pace with minimum wage.” The minimum wage in New York state — with the exception of New York City, Long Island and Westchester County — is currently set at $9.70 and is expected to increase to $10.40 at the end of the year. The rate is scheduled to rise to $15 in New York City by the end of 2018, but the rate of increase will be slower upstate, where the rate will rise to $12.50 by the end of 2020

when the effects will be analyzed by the state Budget Division and Department of Labor. Councilwoman Rachelle Armstrong said Plattsburgh City Clerk Sylvia Parrotte was researching the issue and a meeting would be arranged with owners of local cab companies soon. “It’s in the works. We appreciate you raising a very valid issue,” she said. “We can’t wait six months,” Buck remarked. “We’re talking weeks, not months,” Mayor Colin Read said. Plattsburgh City Taxi is one of the largest and oldest cab companies in the city, operating 24 hours a day with a 20-car operation. No fare limit exists in Clinton County outside of the City of Plattsburgh. According to the City Clerk’s office, the last time rates were increased in the city was 2012.

UBER, LYFT MOVE IN

When asked by Read if the company had been affected by the recent arrival of ridesharing apps like Uber and Lyft, Buck said

that he hadn’t noticed that big of a change. “Our company hasn’t,” he said. “Our numbers are pretty solid.” Plattsburgh City Taxi’s base rate is $5.50 and has been for six years, according to Buck, while Uber and Lyft’s are slightly higher. “I’m sure (Uber and Lyft) did their homework before moving to this area,” he said. “They’re a little more expensive than we are. That may be a reason for why we haven’t seen it.” A new state law regulating ride-hailing services like Uber and Lyft took effect in June, opening the door for the apps to operate in upstate New York. With uberX, Uber’s minimum fare is $7.35 with a $2.15 booking fee. For uberXL, a car option for larger groups, the minimum fare is $10.50 with a $2.30 booking fee, according to uber.com. Lyft charges a minimum fare of $5.20 with a $2.15 service fee for all rides. For Lyft Plus, that rate increases to a minimum fare of $8.20 with a $2.30 service fee, according to lyft.com. ■

Millions lost Spreading Holiday Magic in revenue for local water systems, says comptroller

Systemic flaws include leaky infrastructure and lack of oversight By Pete DeMola EDITOR

PLATTSBURGH | A report by the state Comptroller’s Office has revealed local governments hemorrhage millions in revenue from flaws in municipal water systems, including water loss, inaccurate meters and improper billing. The report analyzed the results of audits conducted by the comptroller’s office of 161 local government and seven public authority water systems during the past half-decade. “Across New York, my audits have revealed infrastructure problems, poor budget practices and a lack of long-term planning are straining municipal finances and increasing costs for taxpayers,” said Comptroller Thomas DiNapoli. “If these problems aren’t addressed, the issues plaguing water systems will only get worse.” DiNapoli also cited weak internal control and improper

Scores of local governments across the region have been dinged in past audits for oversight of their wastewater systems, including St. Armand, Westport, Chesterfield, Essex, Jay, Chazy, Black Brook, Champlain and Ausable. The report used Chazy as an example of improper billing.

“The town lacked effective water billing, collection and enforcement procedures,” the study reported. “There was no review to ensure that all water customers were properly billed. Some customers were not billed in accordance with rates, and delinquent customer accounts did not always include late payment penalties.” » Water Report Cont. on pg. 7

Firefighters raise cash for kids Funds going to North Country Cancer Fund By Elizabeth Izzo STA FF W RITER

PLATTSBURGH | Local law enforcement and public safety workers are helping out in more ways than one this holiday season. The Plattsburgh Professional Firefighters’ union donated $1,820 to the North Country Cancer Fund last week. The firefighters sold nearly 100 t-shirts during Breast Cancer Awareness Month. The union’s donation will assist the families of at least three

local patients with costs incurred during their treatment. The North Country Cancer Fund was founded in 2007 and operates on a volunteer basis. All funds raised benefit residents of Clinton, Essex and Franklin counties. “We like to keep the money local,” said according to Union Vice President Jamie Schwartz.

CITY POLICE DONATE TOYS

Plattsburgh City Police last week donated $1,200 worth of toys to the Clinton County Christmas Bureau, a nonprofit that provides toys to children countywide. The department thanked everyone who donated toys and contributed to their bottle drive earlier in the season in a post on their Facebook page. “Hoping to bring some smiles to the local children this holiday season,” the post read. ■

Local mother produces CD to honor late son

A holiday album, “North Country Christmas,” is being sold at locations around the region to benefit the Cody Sarbou Memorial Fund.

Proceeds from Christmas album will benefit Cody Sarbou Memorial Fund

The result is a collaboration between a number of local musicians, including Roy Hurd, a renown singer-songwriter from Redford. “Once they knew it was Cody, they were all happy to do it,” she said. Songs include holiday classics like “Do You Hear What I Hear,” “Let It Snow,” “Winter Wonderland” and more. Cody’s memorial fund has evolved from a scholarship program for Saranac Central School students into a more diverse community-support fund. Just this year, money from the memorial fund went toward a new stage in Champlain’s Bill Earl Park. In the past, the fund has helped local families whose homes have burned, families that have children with medical needs, and more, according to Sarbou-Jubert. The memorial CD, titled “A North Country Christmas,” is selling for $15. Anyone interested can pick up a copy at Global Fitness in Champlain, Northeastern

MOOERS | Cody Sarbou is remembered, to this day, as a kind and well-liked kid. His mother, Joy Sarbou-Jubert, said that when he passed away after an automotive accident in 2010, over 700 people attended his funeral. “I miss him terribly,” she said. A memorial fund was established in memory of the late 21-year-old not long after his passing, and his loved ones have held a fundraiser in his honor nearly every year since. This year’s fundraiser comes in the form of a Christmas album. “As time goes on, it gets harder (to raise money),” SarbouJubert said. “Less people contribute. “So I knew I had to think of something. That’s when I said, ‘I wonder if I can produce a CD.’”

City to update sexual harassment policies, training

Councilors clarify policies in wake of national reckoning By Elizabeth Izzo STA FF W RITER

PLATTSBURGH | The City of Plattsburgh will seek to ensure all employee sexual harassment training is up to date this year. A discussion of city policies and training surrounding harassment claims surfaced at last week’s Common Council meeting, in light of the news earlier that day that Senator Al Franken (D-Minn.) planned to resign following allegations of sexual harassment or indiscretions from multiple women. All city-employed workers are required to take standard training regarding sexual harassment, violence in the workplace and

HARASSMENT CLAIMS

In the past all sexual harassment claims were processed by the city’s Human Resource Department (HR), which was one of four departments abolished by the council on July 27. Kasper asked how claims are being processed now that the department is closed. “Given that we don’t have an HR department right now and given current events, what mechanism is there for people who would like to offer a claim of sexual harassment in the city?”

Nearly 350 residents turn out for holiday film screening to benefit toy drive By Elizabeth Izzo STA FF W RITER

PLATTSBURGH | What started as a mother’s challenge to her kids to change the world has become, for one local 16 year old, a joyful holiday tradition. Beekmantown Central School student Emily Estes started her first charity drive over five years ago in the wake of Hurricane Sandy. “When I started, I thought, ‘I want to help, but I’m only 12,’” she said.

Employees seeking to file a claim now have to report them to the Finance Department, who now shares HR duties with the Clinton County Department of Personnel. Once a claim is filed, the Finance Department will assess the circumstances surrounding the claim per city policy and determine what to do from there, Marks said, whether it involves counseling with EAS or a referral to the Plattsburgh City Police Department. “I think that all the attention on this issue is appropriate,” Mayor Colin Read said. “So we have to make sure that we’re up to date on that issue.” As the council spoke, news broke that Rep. Trent Franks (R-Ariz.) would resign after discussing surrogacy issues with female staffers, making him the third lawmaker to announce plans to resign last week, according to Politico. Rep. John Conyers (D-Mich.) resigned last Tuesday after reports of paying off a staffer who alleged that he’d sexually harassed her. “It’s definitely not the year to have office Christmas parties,” Marks remarked. When the councilors laughed, Marks continued: “Seriously. There’s just too much going on. Avoid every situation you can.” ■

other topics, according to City Chamberlain Richard Marks. “Training is provided by EAS or the (North Country) Chamber of Commerce and complies with the city’s policies, along with state and federal regulations regarding employee conduct,” Marks told The Sun. Though no harassment claims have been filed with the city in recent memory, according to Marks, all employee training is updated periodically. “I would encourage that we’re very aware and up to date,” Councilwoman Becky Kasper said last week. “As we’ve seen, there’s now an empowerment for that. So we want to make sure that the city is safe as well as our workers.”

Her mother, Carol Estes, challenged her to help out. “My mom suggested doing something locally,” she said. That’s when Teens for Marines and Toys for Tots was born. It’s under this name that Estes both collects toys for local children — which she donates to the Clinton County Christmas Bureau — and signs cards for U.S. Marines stationed overseas in collaboration with Holiday Mail for Heroes. For her, these philanthropic endeavors have become a passion. “It feels so nice just to help out,” she said. Last Tuesday marked the third year that Estes has collaborated with Cumberland 12, a locally-owned theater in Plattsburgh, for a family-friendly movie screening to support her toy drive. The special screening of the 2004 holiday film “Polar Express” last year brought countless toys, which residents donated in exchange for movie tickets.

“We donated over seven shopping carts full of toys (to the Christmas Bureau) last year,” said Carol Estes. Over 300 people turned out for this year’s screening. Speaking with a reporter while simultaneously passing out tickets for the show, Estes looked touched as a group of employees from the Clinton County Correctional Facility handed over a few bags of toys. The county employees said that through their Make A Difference Day, they were able to raise $300 to purchase toys for Estes’ drive, along with $250 for the North Country Honor Flight, who were also in attendance that night. Estes grinned ear to ear, thanking everyone for their contributions as the pile of toys behind her grew steadily larger. Stefanik signs letter expressing Arctic refuge drilling concerns U.S. should look elsewhere for energy needs, say federal lawmakers By Pete DeMola EDITOR

PLATTSBURGH | Rep. Elise Stefanik (R-Willsboro) has co-signed a letter expressing concern over drilling in Alaska’s Arctic National Wildlife Refuge (ANWR). “We have concerns over any proposal that would implement an oil and gas leasing program in the refuge,” said the letter, which was signed by 12 federal lawmakers. Stefanik was among the moderate GOP House members targeted by the Wilderness Society in an advertising campaign pressuring them to strip the provision for Arctic drilling from the tax bill. The Senate version passed last week, and Stefanik voted against the House version last month. The two bills will now enter conference, where differences will be hashed out before a final vote. Opening the 19.6-million acre refuge to oil and gas drilling has been a longstanding Republican priority. “The U.S. Geological Survey estimated in 1998 that part of ANWR could hold up to 12 billion barrels of oil, and President Donald Trump and Alaska Republicans have called it essential for their plans for American energy dominance,” Politico reported last month. The plan has taken on increased saliency as one to help pay for proposed tax cuts. Drilling is projected to create $2 million in

revenues. The budget includes $1 billion in revenue from drilling leases over 10 years, with the other half going back to Alaska. Democrats oppose the measure, citing the impact to the environment, the need to focus on sustainable energy development and questionable revenues. U.S. Sen. Lisa Murkowski, a Republican from Alaska, said drilling can be done safely with new technology, the AP reported, “while ensuring a steady energy supply for West Coast refineries.” The acreage has long been home to a wide array of wildlife, including caribou, wolves and polar bears. The National Audubon Society is also opposed to the effort, citing skepticism over projected revenues and the potential impact on nearly 200 species of migratory birds, many of which are from New York. The letter signed by Stefanik also raises concerns over seismic testing and said the reserves aren’t necessary for the U.S. to reach energy independence. Lawmakers also cited the costs of potential lawsuits, and said energy exploration efforts should be conducted elsewhere — including the National Petroleum Reserve, located just west of the ANWR. But the letter appeared to stop short of a full-throated objection. “The fate of the Arctic Refuge and its sensitive Coastal Plain lies in the hands of Congress and we must ensure robust debate on this highly-controversial issue,” the letter said. Stefanik believes the drilling issue should be debated separately from the tax bill. “She supports an all-of-the above approach to energy production in the United States that

increases American-made energy, reduces our dependency on foreign oil, protects the environment, and brings down energy costs for New Yorkers,” said Tom Flanagin, a spokesman. “Additionally, she is a strong advocate for unleashing the power of renewable energy across the United States.” Wilderness Society President Jamie Williams thanked Stefanik for objecting to the Senate tax bill rider. Preserving the refuge has the “overwhelming support” of Americans across the political spectrum and in New York’s 21st Congressional District, Williams said, citing a poll conducted last month by the Global Strategy Group and Bellwether Research that revealed 62 percent of district voters opposed the plan. “We urge Rep. Stefanik to keep fighting for the Arctic Refuge and to vote against

any tax bill that would open it to oil drilling,” Williams said. But 70 percent of Alaskans support drilling, according to the Alaska Oil & Gas Association. “Allowing access to federal lands for responsible development increases the prospect for more oil flowing through the Trans Alaska Pipeline, Alaska’s economic artery,” said AOGA President and CEO Kara Moriarty in a statement following the passage of the Senate plan. ■ Physicians Mutual Insurance Company

Thoughts from Behind the Pressline

Fair play Playing by the rules has always been considered a core value in the way we By Dan Alexander conduct ourselves in this free society. • PUBLISHER • At school, on the playground, in a court of law, at work or the field of play, we expect each encounter to be governed by proper behavior. We’ve introduced instant replay to sporting events and are now using cameras on our streets and roadways to observe the actions of passersby. We have law enforcement wearing body cameras to ensure encounters adhere to these rules to be fair to both the officer and the alleged offender. Golfers play with honor and keep track of their scores. Even when playing matches for significant prize money, golfers have been known to add a stroke to their score for the tiniest infraction when only they realized their club-head ever so slightly touched the ball. Can you imagine any football, baseball or basketball game where the referees/umpires declare before the game who they favor, and they go out of their way to call strikes, penalties or fouls to tip the score in favor of their contestant? If the standard for accuracy and fair play is assumed without question in these areas, why would we not expect the same from our government officials and the media who are supposed to be our watchdogs? In recent years, we continue to see government officials bending the rules and making a mockery of our values. Sadly, when the media operate in a biased manner and proves to be untrustworthy by slanting their reporting to aid one side or thwart those they disapprove of, then we have failed to meet the test of fairness by condoning such action. Just like spectators at a sporting match, we all appreciate an accurate call even if it’s against your team. Nothing is more damaging than when a referee, even with the aid instant replay, fails to make the correct call, and that call decides the outcome of the game. We need to trust those in a position of ensuring fair play in all areas but especially those in charge of our government. Those who can’t respect and honor their role should be removed from serving in such a capacity. We must reaffirm our need for these values. Until then, not much will change, and sadly the anger from both sides will continue to rise causing greater disruption and resistance. ■

From the Editorial Board

Cuomo should sign FOIL bill It’s been a tough year for the press. The media is under increased scrutiny, in part, due to ongoing political upheaval. Paired with an uptick in public skepticism, we’re continuing to navigate a changing landscape in which press outlets are dropping like flies for economic reasons. LAist, Gawker, Gothamist and DNAinfo in New York City have all proved to be indispensable for providing groundbreaking local coverage. And they no longer exist. Despite the trends hemming us in from both sides, media outlets across the country are continuing to engage in excellent investigative reporting. We rely on the state’s Freedom of Information Law to access the information we need for many of these stories. Sending a FOIL request to a government agency can be as simple as requesting financial information from a local town hall, or as complex as trying to pin down the state on more complex issues — like studying traffic collisions at dangerous local intersections, for instance. Or official malfeasance.

Surface Transportation Board may be key to killing railroad storage plan

To the Editor: In reference to the proposal by Mayor Blais of Lake George to legally remove Iowa Pacific’s oil tanker junkyard on the Tahawus rail spur, the Adirondack Council and its consulting lawyers might have found a way. Following the lead of the council, the Long Lake Alliance sent a letter on Nov. 28 to the Surface Transport Board (STB), the Federal agency which oversees use of the nation’s rail lines, requesting that the STB remove the “common carrier” status Iowa Pacific currently enjoys from North Creek to the terminus of the line in Tahawus. We argued that the STB had awarded “common carrier” status allowing IP to carry freight on the Tahawus spur, not to rent storage on the tracks to out-ofservice tanker cars. We are now awaiting a response. The Adirondack Council has since determined that IP is a subsidiary of Berkshire Hathaway and the 80-plus rail cars currently stored on the Tahawus spur are owned by

Some agencies are expedient, some drag their feet. And outright denials are not entirely uncommon. Like other facets of our legal system, there is an appeals process. But if a media outlet challenges the decision and wins, our legal costs aren’t necessarily covered. For small local newspapers, the story could end there if hiring a lawyer becomes too expensive. That could change if the governor signs a pending bill. The proposed legislation would amend the law to pay legal fees to applicants who prevail in FOIL lawsuits challenging open records requests that have been denied. The bill, which has been approved by the Senate and Assembly, would mandate the payment of legal fees to anyone who prevails in a lawsuit challenging a denial of an open-records request if the judge determines the agency had “no reasonable basis” for denying access, or the agency failed to respond to a request or appeal within the statutory timeframe. We join our newspaper colleagues across the state in asking Gov. Andrew Cuomo

We urge organizations and individuals opposed to IP’s use of the Tahawus spur to keep the pressure on. to sign this bill. The benefits aren’t just one-sided. The Reporters Committee for Freedom of the Press pointed out that adopting a “meritbased mandatory fee provision” would also create financial incentives for compliance, motivating agencies to avoid litigation in the first place by “promptly and properly” fulfilling FOIL requests, and adopting more effective and efficient methods for the dissemination of public records. Keep in mind that media outlets aren’t the only stakeholders who seek open records: Private citizens and good government groups also rely on documents to hold agencies and officials accountable. In this uncertain political climate, ensuring a clean and open government has never been more important. During his tenure, Cuomo has worked to position New York as a national leader on a wide array of issues, including raising the minimum wage, developing clean energy programs, providing free college education and investing in infrastructure. Ensuring a transparent government should be a natural addition to that list. ■

Annual screenings are instrumental in detecting early stage cancers, when they are most treatable. Now with the Affordable Care Act, annual screenings are free through your health insurance. Peru Church plans Christmas services Events slated to run until New Year’s Eve

PERU | The Peru Community Church is celebrating the coming of Christmas with a series of worship services with a common theme: “Coming home.” On the third Sunday of Advent, Dec. 17, worship services are at 8 a.m. and 10:30 a.m., with communion at the 8 a.m. service and nursery care provided during both services. Coffee and fellowship hour follow each service.

At 9:15 a.m. in the chapel the “Journey from Nazareth to Bethlehem” video series finishes with “The Manger,” an informational video vignette retracing the actual path of Mary and Joseph’s journey to Bethlehem. On Wednesday, Dec. 20 at 6:30 p.m., a “Blue Christmas” service will be held in the chapel. Held on the longest night of the year near the end of the Advent season, this service is offered as a quiet and reflective respite from the hustle and bustle of the season in recognition that Christmas is not always joyous for those who mourn loved ones no longer here, and for those who have much

sadness in their lives. On Christmas Eve, one morning service will be at 10 a.m. with “Lessons and Carols,” a retelling of the story of Christmas and the birth of Jesus through Bible readings interspersed with hymns and carols sung by the congregation and by the choir. At 6 p.m. and at 8 p.m., Sunday evening Dec. 24, traditional Christmas Eve worship services are at 6 p.m. and 8 p.m. in the sanctuary. Both services end with the singing of “Silent Night” in the darkened sanctuary illuminated only by candles lit from the Christ candle

City of Plattsburgh reminds residents of snow removal ordinance Property owners responsible for clearing sidewalk

PLATTSBURGH | The City of Plattsburgh is reminding property owners to follow the city’s sidewalk snow removal policy. Owners of property that border a sidewalk are responsible for removing snow/ice within 24 hours of the end of the snowfall. If there is more than 12 inches of snow piled up as result of plowing the street, the city is responsible for removing that snow. However, the owner will remain responsible for maintenance after removal. If unable to remove snow/ice with hand operated device, owners are asked to ensure the sidewalk is covered by a substance to prevent slippery conditions. In owner and occupant settings, the property owner is solely responsible for snow removal. If the snow has not been removed within 24 hours of public notice » Water Report Cont. from pg. 1 (Chazy officials, in their formal response penned in April, said they agreed with the recommendations and had already implemented most of them.) In another recent audit, the state determined the Town of Ausable did not enter into a written agreement with the Town of Chesterfield, which bills, collects and enforces charges for two water and one sewer district, including a unit formed following the dissolution of the Village of Keeseville in 2014. The audit revealed Ausable officials could not monitor each district’s financial operation because the town board did not develop individual budgets for each of the districts. And for their part, Chesterfield did not assess penalties to delinquent accounts, the audit determined. The office has expanded its focus in recent years to include issues regarding local water supplies. Of the audits compiled as part of the study, » Letters Cont. from pg. 6 This has been a great inspiration to all of us, especially those who worked with E. L. 22 pointed to water loss as an issue and estimated that fixes could yield as much as $2.2 million in savings. A common culprit for water loss is caused by leaks from broken or aging underground pipes. Other problem areas include inaccurate meters or improper billing, which affect water system operating budgets. “As a result, some customers are paying too much and others too little,” the report determined. “Efficient operations would require that officials upgrade meters or improve the accuracy of the billing process.” Auditors also found that several local governments had insufficient revenues to operate their water systems, which was aggravated by incorrect billing. Other localities were chided for shifting funds between accounts to mask revenue shortfalls. During the five-year period, a review of 16 municipalities with revenue or billing deficiencies revealed that corrective action could increase revenues by more than $400,000.

tion in which we take great pride. We are not alone in this, as these transitions are happening throughout the country. Although saddened by the inevitability of this situation, we are pleased to be able to carry on the tradition of quality care in our new locations. of the end of the snow emergency, and is not exempt from removal, city employees will remove the snow at the expense of the property owner, and a fee will be imposed. Once a snowfall or a snow emergency ends, City Code 233-32 gives property owners 24 hours to clear the width of their sidewalks so that all sidewalk users can safely navigate the city. Snow emergencies are called based on street conditions after a snow event. Total accumulation is a factor, but the city also takes into account the amount of snow already on the street prior to the storm, and whether another storm is forecast in close proximity to a snow event. The city’s primary concern is safe passage on streets, as well as parking needs in neighborhoods with little or no off-street parking. Mike Brodi, Department of Public Works superintendent, would like to remind everyone to heed the parking ban signal lights and check the city website for an emergency alert notification. If a parking ban is in effect, remove cars from city streets, he said. “When the lights are on, the cars should be gone,” he said. ■

Numerous local governments across the region are in the process of shoring up their systems, including Lake Placid, Tupper Lake, Saranac Lake, Crown Point, Chazy, Ticonderoga and Lake George. The City of Plattsburgh has also cited the need to make large-scale improvements to its water delivery system in order to avoid a deluge of broken pipes. The Adirondack Council said fixes to local water systems in the Adirondack Park alone may exceed $100 million. The state continues to issue grants to localities as part of a $2.5 billion five-year initiative to bring systems statewide into compliance. The comptroller’s office said a series of upcoming audits will examine the cybersecurity of computer-based systems used to “monitor, modify, regulate or manage municipal water facilities” in the wake of recent cyberattacks that have disrupted a number of local governments, including a municipalowned dam in the Hudson Valley. ■

With one exception, our physicians and physician’s assistant will continue to see patients in Adirondack Health’s health center locations in Saranac Lake, Tupper Lake and Lake Placid. Dr. Kristen Frank-Dixon has elected to pursue other opportunities in the region. We intend to honor existing appointments, but appointment locations may differ according to individual provider schedules.

From the Mayor

A long run plan? When I need advice, I assemble a number of very thoughtful people who I know have a great diverBy Colin Read sity of perspectives. • COLUMNIST • They all seem to have one thing in common, though. They are willing to look at things from the long view. I enjoy the diverse discussions these people bring. In the end, I’m usually swayed by their arguments. The outcome is often different than where I thought we might end. I certainly enjoy the path every time. Of course, not everyone is happy with every direction I’m drawn. Criticisms are usually centered around the present, because that’s where we all reside. Some think I worry too much about the future, am pessimistic about the present, or should take more responsibility for mistakes of the past. There’s surely some truth in any well-meaning criticism. I bet, though, that if we all thought more about our children’s future, more of today’s challenges would fade away. For instance, last week I shared my concern that the value of all the taxable properties in the City, when adjusted for inflation, has stagnated since our last major city revaluation, almost three decades ago. In fact, if we include a Payment in Lieu of Taxes (PILOT) property belonging to the Clinton County Industrial Development Agency (CCIDA) and used to generate power in land behind Georgia Pacific, the inflationadjusted value of taxable property has fallen from a peak of more than $1.2 billion to about $1 billion today. Meanwhile, inflation-adjusted property taxes per person have risen by 71 percent. How long can we survive with a tax base eroding and per-capita tax rate climbing steadily? If most of our costs are payroll related, and annual contractual, step, inflation, and longevity increases, accumulated sick leave, health care, and pension costs all rise far faster than inflation, how can we contain costs without forever raising taxes faster than inflation? Or, if these costs conspire to rise 3 percent or 4 percent faster than inflation, can we lay off 5 percent to 7 percent of the workforce each year to keep taxes level, but still retain a strong workforce? After all, rising costs arise more significantly from our more senior and higher paid workers, but seniority requires us to lay off the least paid workers first. That’s unsustainable. To balance the present with the future is hopeful. It’s a desire to ensure another generation has the same privilege we’ve enjoyed. City sustainability is uplifting and optimistic, at least for me. ■ — Colin Read is the Mayor of Plattsburg

Beekmantown candidate to appeal court decision Norman Davis says he wasn’t invited to absentee ballot count

“It was an open door,” said Lloyd. If absentees and affidavits counted Nov. 15 had revealed that Dyer had been up by one vote, “it would have been the end of it,” Davis said. Davis also cited a law that requires any ballot with extra writing on either side to be voided, and another that says if a ballot is voided it cannot be brought back. The Beekmantown Republican Committee has set up GoFundMe campaign to help Davis with legal fees. As of Tuesday afternoon, $1,500 had been raised with a goal of $15,000.

County Legislator Sam Dyer (Area 3) may have secured a victory over opponent Norman Davis for the vacant Beekmantown Supervisor seat. But Davis is appealing the decision.

DAY IN COURT

The race between Dyer, a Democrat, and Davis, a Republican, came before the state Supreme Court on Dec. 1, with Supreme Court Justice Mark Rogers ruling in Dyer’s favor. Two ballots, one with a stray mark on the back and one with a vote for Davis but a light mark near Dyer’s name, came under scrutiny in court as Rogers heard arguments from representatives of each candidate regarding the validity of each ballot. Three New York State Board of Elections attorneys had previously determined that based on state Election Law, one of those ballots had been invalidated in its entirety due to a stray mark. The second ballot also contained a stray mark. But only the proposition on the reverse side of the ballot was thrown out — not the whole ballot. Rogers’ decision was sent to the Clinton County Board of Elections, who certified the results for Dyer on Dec. 6. “When the election is certified and official, I’ll be happy. I’ve wanted the job for a long time and I’m ready to take office on the first of the year and do a good job for the town,” Dyer told The Sun.

BEEKMANTOWN | The Clinton County Board of Elections last week certified Sam Dyer as the winner for the open Beekmantown supervisor seat. But his opponent, Norman Davis, said Monday he planned to appeal a State Supreme Court ruling declaring Dyer the winner. “I will not sit back and watch the board of elections disregard the election laws without challenging it in a court of law,” Davis told The Sun. “I’m not above being beaten. I just don’t want to be run over.” The vote stands at 706 for Dyer and 705 for Davis out of 1,313 votes cast in-person and 100 absentee and affidavit ballots.

‘OPEN DOOR’

Davis said the Clinton County Board of Elections failed to follow proper election rules by not allowing him to attend a hand count of absentee ballots and affidavits on Nov. 15. “Which, by law, is my right,” he said. Deputy Democratic Commissioner Brandi Lloyd told The Sun on Monday that the absentees were hand-counted during business hours, and all candidates were told that the count would continue until completed regardless of the length of time. “No one was told, ‘Okay, your town is done you can leave now,’” she said. “He chose to leave when he did.” Because the race was so close, the board of elections obtained approval from the state to hold a public recount the next morning. But Davis did not attend on time. “Voice mails by (Republican Commissioner Gregory Campbell), a couple of them, were left on his phone,” she said. Staff then delayed their recount Nov. 16 for 30 minutes in order to wait for Davis to arrive.

DYER MAY LEAVE VACANCY

Dyer serves on the Clinton County Board of Legislators, and his new job would leave the Area 3 seat vacant. According to Local Law #5, a resident of the district — which encompasses the Town of Beekmantown — may be appointed by the legislature to fill the vacancy until the 2018 general election. If the legislature doesn’t appoint someone within 30 days, there may be a special election in early 2018. Dyer’s term on the legislature was set to expire in 2019. ■
