MORIAH | Localities received early Christmas gifts Tuesday with the annual fundraising haul for infrastructure projects. Essex County towns received at least $5.3 million from the Regional Economic Development Council Awards as part a $64.8 million package. A total of 70 projects across the region will receive funding. Among the biggest local infrastructure awards was $3.2 million for a new sewer system in Moriah. Supervisor Tom Scozzafava said officials will try to obtain an additional $5 million in Environmental Facilities Corporation funding to top off the $8 million project. A chief goal is to keep user fees down for the 3,000 users, he said. Scozzafava praised the Essex County Office of Community Resources and the town’s Wastewater Department for helping prepare the grant application. » REDC awards Cont. on pg. 2

In the last 12 months, we’ve had reporters on the ground covering hundreds of breaking news stories. We’ve reported on court proceedings, crime, new businesses, town, city and county governments, and what’s happening at local schools. Here’s a look at some of the local stories that defined 2018.

Fire gutted a building in downtown Port Henry, but that was only the beginning of the drama as the event sparked a summerlong tussle between the Town of Moriah and the property owner over the property’s status. Three families were displaced, and a business that was just days from its grand opening was lost in the April 4 fire at the ADK Emporium building, which dated back to the 1800s. “This was a team effort,” he said. Westport received $808,793 for repairs for the wastewater collection system in Wadhams. Westport Supervisor Michael “Ike” Tyler said the grant is critical because it’s not reasonable to ask 57 users to shoulder the burden for a repair project estimated to cost in the low seven-figure range. The aging facility is currently under a state Department of Environmental Conservation consent order. Funds will be used to repair filters and install a ultraviolet disinfection system. The installation may also incorporate solar panels, Tyler said. Essex County Manager Dan Palmer said the consolidating funding stream, now in its eighth year, is the main source of funding for critical infrastructure projects in rural communities. “These are important because the only way to leverage (the funds) now through is those types of programs — especially water and sewer,” Palmer said. “There is no other money out there except for municipalities bonding it on their own.” But that can be costly, officials said. “You could never pay out of local dollars,” Scozzafava said. “It would just be impossible.” ■

• Crown Point: The town received $1 million to relocate its wastewater treatment facility to Station Road, installing a new primary treatment process. They will also install an ultraviolet disinfection system at the new plant. This project will reduce the nutrients entering Lake Champlain, including phosphorus that may lead to harmful algal blooms; • Jay: The town garnered $30,000 to complete an engineering report to evaluate options for adding disinfection to the Ausable Forks Wastewater Treatment Plant and any other upgrades that may be needed to facilitate adding disinfection; • Moriah: Among the biggest winners, Moriah received two separate awards: $750,000 was allocated to replace water and sewer main infrastructure on First Street, Oak Lane and Ridge Lane. The town was also awarded $2.5 million in funds to construct five miles of

collection systems,manholes, siphons and pump stations. The work will reduce inflow and infiltration from entering their sewer system, as well as will reduce the amount of nutrients entering Lake Champlain from sewer overflows, including phosphorus that may lead to harmful algal blooms; • Saranac Lake: The village secured $30,000 for an engineering report to evaluate their wastewater treatment plant’s headworks, aeration and solids handling; • St. Armand: The town was granted $100,000 to complete an engineering report to identify infiltration and inflow issues in the wastewater collection system and recommend solutions; • Ticonderoga: The state allocated $30,000 for the completion of an engineering report to evaluate the possibility of using geothermal or geo-exchange systems as part of the wastewater treat-

TEEN SLAIN

A Ticonderoga teenager was charged with the killing of his friend with a machete in what police characterized as a dispute over a girl. Adrian Sawyer, 16, was indicted for the intentional murder of 15-year-old Maverick Bowman on July 26 at an abandoned party house on Lake Champlain in Putnam. Ticonderoga Police discovered Bowman’s body in the early morning hours in a house owned by his grandmother after receiving a call from Sawyer’s family. Sawyer indicated to family members that Bowman had been hurt. Police said Bowman died of a wound to the throat. Sawyer remains in jail awaiting trial.

Four kitchen workers were taken to the hospital for treatment. About 50 guests who were at the club escaped unhurt. Firefighters said an explosion preceded the fire and was believed to have involved a propane tank. The club was an iconic spot for residents, who could enjoy a round of golf or a meal in a beautiful mountain setting. The golf course remained open, while Emerald’s moved to a nearby location and became known as Emerald’s II. ■

Following a week-long trial, Cody Cutting was acquitted by a Essex County jury on Dec. 18 of second degree murder charges in the fatal shooting of Derek “Boomer” Sprague on April 22. Cutting was found guilty of second degree manslaughter and second degree menacing and faces between 5 and 15 years in state prison when sentenced by Essex County Judge Richard Meyer on Feb. 4

Renovations were competed on the 37-year-old Moses Ludington Hospital, which saved a facility that was bordering on obsolescence. On Christmas Day 1776, colonists at Ticonderoga were fighting each other, not British By Tim Rowland STA FF W RITER

TICONDEROGA | ’Tis the season for peace, joy and celebration, but 242 years ago at Fort Ticonderoga it twas not. The year was 1776, the first winter of American independence, and perhaps the events that led up to what has become known as the Christmas Riot of 1776 should have come as a warning for things to come. Then, as now, America was a divided nation, said Fort Ticonderoga curator Matt Keagle during a presentation at the fort last weekend, with serious differences among men who

were ostensibly on the same side. The Revolution in full flame by this time, with the tide of the war adding to the tensions in colonial ranks. On the last day of 1775, Americans attacked a British garrison in Quebec and got their hats handed to them, forcing an inglorious, 300-mile retreat back to Fort Ticonderoga. George Washington had rousted the British from Boston, but then got clobbered in New York, forcing the Continental Army to skedaddle back down into Pennsylvania. Benedict Arnold’s ragtag Navy had been wiped out in Lake Champlain in October, and all told, Thomas Paine’s dour observation about these being the times that try men’s souls might have been something of an understatement. Even news of the Declaration of Independence did little to improve morale. It “caused a little buzz, but was soon forgotten,” a soldier wrote. The one glimmer of hope was that Arnold, even in defeat, had been able to delay the British just enough to force them to wrap up their campaign for the year before they could capture the important Lake Champlain outpost.

with determination and a deep dive into records that would seemingly have had no relation to the matter, he was able to tease out the details. On Christmas morning, soldiers were ordered to parade on the frozen lake. Four Yankee officers were not present and apparently back in their snug quarters at the fort — a point not lost on Thomas Craig, a lieutenant from a Scots-Irish family in Northeastern Pennsylvania that is not remembered for its pacifism. Craig stewed all day over the march, and the workbench and the whole lot of Yankees which he felt were little better than the British. That evening, “warmed with wine,” he unsheathed his sword and went looking for Col. Whitcomb. The resulting melee was not deadly, although it easily could have been. Craig jabbed Yankees with his sword, severed part of Whitcomb’s ear and he and his men made off with armloads of Yankee valuables. The Yankees brandished weapons, but apparently did no damage. Craig was court martialed, but was acquitted and continued to serve in the army. The Yankees were compensated for their losses, and Whitcomb was disposed to forgive his adversary after the Craig camp shot a fat bear and offered it up for a feast. Mad Anthony Wayne, himself a Pennsylvanian, made some vague efforts toward reestablishing order, but seemed more interesting in ensuring that word of the disturbance didn’t get out, thus blemishing his reputation. But the lesson in American history remained. “Many of us have this vision of the unity of purpose and cause” in the Revolution, Keagle said. But the reality is that, as today, there were many faces to the American portrait, and they didn’t always get along. But “despite these divisions, American forces were able to come together,” Keagle said. “We can always come together for great things, but sometimes it’s a work in progress.” ■

“One wonders what would have happened if the British had captured Fort Ticonderoga,” Keagle said. But for a few days’ delay in October, the colonies might have been split down the middle and the outcome or the war radically changed. But within the colonial ranks, there was already a split, particularly between the industrious, egalitarian Northeast and the “Buckskins” from points south who valued order and convention. Officers from the Mid-Atlantic wrinkled their noses as “the miserable behavior of the Yankees,” noting that their ranks, which included blacks, whites and Indians, created “a most shocking spectacle.” When the son of Asa Whitcomb, a 57-yearold Massachusetts colonel, was caught passing the time by making shoes, it was considered by the Pennsylvania Buckskins to be a horrible breach of military protocol. Adding to the tension was the fact that that precisely no one wanted to be in this frozen outpost, least of all the overall commander, “Mad” Anthony Wayne, who felt he was cut out for more high-profile work than as a glorified drill sergeant in a frozen wilderness. Christmas Day at the fort in 1776 would have been just another day, with no particular reason for celebration. Christmas was not widely recognized in America until the middle of the following century, and since there was no specific mention of it in the Bible it certainly would not have gained currency with the puritanical Northeast. Yet the date adds modern-day irony to violence that happened that evening. Keagle said not much was known about the event until recently, only some opaque historical references that something took place that night, More curious, when Keagle went to the military record, there was the notation “Head Quarters Dec 25 1776.” But the page is blank. “Sometimes an omission raises as many questions as actual words on a page,” Keagle. An initial detour — which would have caused a major inconvenience — was replaced with a light that restricts the road to a single lane. The light might delay a motorist for a couple of minutes, but in not a terrible burden, said Supervisor Edna Frasier. Frasier said the bank had collapsed before, in 2012. She said she’s talked to highway engineers but has not been given an indication of when the road will be fixed. State Department of Transportation spokesman Bryan Viggiani said the lane reduction — between Dock Road and Route 8, just south of the Hague town beach park — will allow the state agency to make repairs to a retaining wall. ■

It should come as no surprise to anyone that we live in turbulent times, and while some areas By Dan Alexander seem to be improv• PUBLISHER • ing, others continue to spin out of control. As far as this nation is concerned “The Guy” (someday hopefully “The Gal”) in the big white house has always been a lightning rod for public opinion. But in recent years, we’ve seen the divide, resentment, resistance and yes, even outright hatred growing for whoever has sat in the big chair. No one seems very pleased about it: families squabble during the holidays over it. Friends avoid the subject altogether while others avoid making a misstep by uttering political incorrectness during casual conversation that might offend someone. Right now, it seems communication in nearly all forms must be carefully crafted to avoid offense at all cost. Even clothing can cause an unintended public disturbance. There will always be people who approach things from different perspectives and whose views may differ from yours. It’s been true since the beginning of time, and nothing will ever change that simple fact. But there is a lesson to be learned from all this, and it’s one we’ve known but has a habit of sneaking up on even the best of us. It’s as clear as the sky is blue. Simply put, hatred is corrosive. Like rust underneath a car, it slowly eats away at the sturdy, metal fabric, and before you know it, it’s spreading everywhere. If not put into check, pieces start falling off and over time what was once a shiny prize is now nothing but an ugly bucket of bolts. As we head into the new year, our elected officials, the media and the voters have some choices to make. Allow our hatred to continue to fester and eat away at our union, or seek solutions to find mutually acceptable paths to solving problems with our health care, budget, immigration, infrastructure, education, drug addiction and so many more issues plaguing our nation. Looking back in the past will do nothing to address the core issues facing the nation except waste more time, dollars and continue to feed the corrosive beast that is driving us further apart. The recent coverage of President Bush’s passing and the service he rendered to the nation should serve as a reminder to us that we can learn to overlook our difference and seek the solutions for the good of the nation. ■

Plattsburgh School Board should walk to school

To the Editor: As a parent in the Plattsburgh School District, I am challenging the entire school board and administration to gather at the Ted K Center and walk to the high school. This is not the furthest point our children walk from, but it will give them an idea of how it feels on a 6 degree day to get to school. Then I want them to think of taking gym, math and science first period. Four hundred and fifty thousand dollars has been acquired to fi x the walk bridge and they are discussing tearing it down. We have no bus system in place, and it is obvious they have no concern that weather people say do not be exposed to the outdoors and bring pets in. Our children walk for 40 minutes at times in this weather to get to and from school. The board and administration have ignored my challenge three years in a row. I feel this is because they know it is tortuous and do not care our children have to do this five days a week. - Patricia Blanchard, Plattsburgh ■

Giving billions of our borrowed cash to small countries around the world will not cause them to use less fossil fuel. But that’s the Paris plan. China, the worlds biggest air and ocean polluter, won’t even talk about this for another 12 years. China needs to be part of any solution towards improvement. I don’t deny that climate change occurs, but it has occurred through tens of millions of years of volcanic activity and other earthly events that we only guess about. How can they be certain about the future while we only guess about the past? If you want an interesting story regarding the unintended consequence of liberal, progressive, environmental stupidity dig into the ethanol/gas hoax. Its origin, results and worldwide impact, which are massive carbon dioxide releases as tropical forests have been burned seeking the corn oil substitute, palm oil. Slaughtered orangutans and tigers are also a byproduct. The U.N. will have you believe there are only 10 years left before climate catastrophe, which is what they said 20 years ago. Even if true, giving them our borrowed billions won’t change that. Rowland’s article, “Split decision?” which ran in the Dec. 15 edition of The Sun. I find it necessary to comment on the cover story in your Dec. 15 issue regarding the possible dissolving of the Minerva-Newcomb sports merger. When I first heard talk about this, I wrote Minerva Central School (MCS) Board President Michael Corey on Dec. 6 to voice my concerns how this decision would undoubtedly create it impossible for Newcomb Central School (NCS) students to participate in sports. After reading your article and the statements made by MCS Superintendent Timothy Farrell and MCS Board President Corey, I was left feeling angry, disgusted and sickened. The focus of MCS breaking away from NCS and joining Johnsburg Central School appears to be wanting to win. I know I cannot remember the games my team won when I was in high school, and my children can remember a couple. However, what I do remember is learning teamwork, sportsmanship, time management and making friends. These are the true wins of playing sports. Another big win is when your child is accepted into a college because of their participation in sports. Why? Because it shows that college the student is disciplined, confident and works well with others. The discrimination statements by Corey in the article directed the international students are unethical, short sighted and shameful. When I wrote Corey, I had no idea he felt this way. If I had, my letter would have addressed my concern. Again, winning is the focus. Charter fined $174M in recordsetting internet speed settlement By Pete DeMola EDITOR

ALBANY | Charter Spectrum will pay $174 million and refund customers $62 million in a settlement over claims it engaged in a “systematic scheme” to defraud and mislead internet subscribers by promising to deliver service that it knew it could not deliver. The settlement announced Tuesday by the state Attorney General’s Office is believed to represent the largest-ever payout to consumers by an internet service provider in U.S. history. Attorney General Barbara Underwood said the settlement should serve as a “wakeup call” to any company serving New York consumers and sets a new standard for how internet providers should fairly market their services. “Fulfill your promises or pay the price,” said Underwood in a statement.

INCAPABLE HARDWARE

The state Attorney General’s office filed a complaint in New York State Supreme Court last year alleging that Charter, originally known as Time Warner Cable, had failed to deliver on internet speeds and the reliability it had promised subscribers. The company marketed, and charged more for, download speeds of 100, 200, and 300 megabytes per second while failing to maintain enough network capacity to reliably deliver those speeds to subscribers, said the attorney general’s office. And the provider leased older-generation modems known to be incapable of delivering the promised speeds, according to the lawsuit. Some subscribers were getting speeds that were more than 80 percent slower than what they had paid for. Charter falsely represented speeds as equally available, whether connecting over a wired or wi-fi connection despite the fact that speeds are routinely slower via the latter. The provider also guaranteed subscribers would enjoy “seamless access to their chosen internet content while engaging in hardball tactics with Netflix and other popular third-party content providers that, at various times, ensured that subscribers would suffer through frozen screens, extended buffering and reduced picture quality,” according to the attorney general’s office.

The settlement comes after years of legal wrangling, with the state Attorney General’s Office staving off motions by the company to move the case to federal court; to dismiss the action and a subsequent appeal at the Appellate Division. Several provisions of the deal will crack down on how the

provider markets broadband speeds. The company must stop making “unsubstantiated claims” in its advertising and must substantiate speeds using industry-accepted testing methodology while discontinuing any speed plan that cannot be substantiated. Charter will also be prohibited from making unsubstantiated claims about the reliability of their internet service — promising no buffering or slowdowns, for instance — as well as availability of the promised wi-fi speeds. And they will be forbidden from describing internet speeds as “consistent” without fully satisfying the FCC speed requirements and must make “commercially reasonable efforts to deliver access to all online content and services featured in its advertisements.” Underwood said the reforms will be precedent-setting. “These reforms set the stage for major marketing and business reforms across the broadband industry,” she said. Charter has also agreed to make “substantial network enhancements to improve its internet service in New York.” “We are pleased to have reached a settlement with the Attorney General on the issue of certain Time Warner Cable advertising practices in New York prior to our merger, and to have put this litigation behind us,” said a Charter spokesperson. The spokesperson said the provider has made, and continues to make, “substantial investments enhancing internet service across the state of New York since our 2016 merger, as acknowledged in the settlement.” “We look forward to continue providing the best TV, internet, voice and mobile products to our customers, and to bringing broadband to more homes and businesses across the state.”

Michael Francis Arthur

TICONDEROGA | Michael Francis Arthur, 53, of Portland, Maine passed away peacefully on Monday, Dec. 17, 2018 surrounded by his family. A firecracker baby, he was born on July 4, 1965 in Ticonderoga. He was the son of Richard and Elizabeth (Pond) Arthur, of Ticonderoga. Michael spent his adventurous childhood growing up in Ticonderoga where he enjoyed bowling, skiing and snowmobiling. He graduated from Ticonderoga Central School in 1984. In 1988, Michael and his wife, Tammy, moved to Portland, Maine where he created many lifelong friendships through bowling, riding his Harley Davidson motorcycle and eating at Portland’s local restaurants. Michael enjoyed his career as a courier driver, spending time at the ocean, playing with his dog ­— Miss Harlie, boating on Lake George and traveling. Most recently, Michael was able to vacation in Thailand and Hawaii which he loved. He also loved his annual birthday celebration vacation on Lake George. His greatest love was that of family. His sense of humor, smile, ability to make anyone laugh and his “life of the party” spirit will

direct restitution of $62.5 million for over 700,000 active subscribers, each of whom will receive between $75 and $150. The $75 refund will be allocated to customers who leased an inadequate modem, wi-fi router or subscribed to a Time Warner Cable legacy speed plan of 100 mbps or higher. An additional $75 refund will be available to approximately 150,000 subscribers who had an inadequate modem for 24 months or more The company will also offer free streaming services and premium channels with a retail value of over $100 million for approximately 2.2 million active subscribers. Charter is required to notify subscribers of their eligibility for refunds and disburse them within 120 days, according to the settlement. The company has already disbursed over $6 million in refunds for inadequate modems to date as part of a settlement unrelated to Tuesday’s announcement. Charter will offer all subscribers currently receiving internet and cable television from the company a choice of either three free months of HBO or six free months of Showtime. All other active Charter internet subscribers will receive a free month of Charter’s Spectrum TV Choice streaming service — in which subscribers can access broadcast television and a choice of 10 pay TV networks — as well as a free month of Showtime. Charter will notify subscribers of their eligibility for video and streaming services and provide details for accessing them within 120 days of the settlement.

CUOMO FIGHT

The provider continues to tangle with Gov. Andrew Cuomo’s administration over broadband expansion efforts as part of the company’s merger with Time Warner in 2016. The state Public Service Commission rescinded the provider’s approval earlier this year. The original decision handed down by the regulatory agency forced Charter to sell its operations to another provider who could legally operate in the state. But the two sides continue to negotiate a settlement following the extension of several deadlines. Cuomo blasted the provider earlier this month when he joined striking IBEW LOCAL 3 workers at a rally in New York City. “Charter Spectrum didn’t just mistreat you and lie to you,” Cuomo said. “Charter Spectrum lied to the people of the State of New York. MINEVILLE | The Ticonderoga Sentinels scored a pair of 4-0 wins against rival Moriah in their first regular season meeting of the winter season on the lanes of the Mineville VFW Tuesday. In the boys match, Zach Bush had both the high game of 235 and high series of 669, adding games of 220 and 214.

Gavin Fleury combined games of 205, 200 and 193 for a 598 triple; with Axel Dedrick rolling games of 203, 178 and 174 for a 555 triple; Gavin Tucker rolling for games of 222, 167 and 148 in a 537 triple; and Nate Trudeau a 480 triple with games of 187, 156 and 137. For Moriah, Ethan Madill had the top game of 178. In the girls match, Jade Frasier led Ticonderoga with a high game of 177 with games of 165 and 134 for a 476 series. Overall, Ticonderoga coach Donna Fleury said it has been a mixed year for the teams. “The boys have only lost one match so far and that was to last years state champions, Ausable Valley,” Fleury said. “We have a couple kids that are struggling but heading into the

second half I hope they get straitened out. The girls are all still very young and are still learning what their abilities are.” Moriah was led by Shyann Hargett’s 126 high game along with scores of 126 and 107 for a 362 series, while Hannah Slattery combined games of 121, 109 and 103 for a 333 triple. ■

Watts voted out as chief Ticonderoga fire chief has been an officer for past 17 years By Tim Rowland STA FF W RITER

TICONDEROGA | Ticonderoga Fire Chief Matthew Watts will leave his post Jan.1 after he was defeated in a membership election this month by challenger Jason Parent. “We had our elections and unfortunately I was not re-elected,” Watts said. “I’m actually OK with it, it is a lot of work and almost a full time job. I did the best I could with the best interests of the community and the department at heart.”

Watts said firehouses are known for their palace intrigue, but still he was surprised by the vote. He said he will continue to volunteer at the station where is finishing his third year as chief. Watts, who works as manager for Lamoille Ambulance Service, has been an officer in Ticonderoga for the past 17 years. He will turn over duties to Parent on Jan. 1. Ticonderoga Supervisor Joe Giordano said Watts has been an asset to the community. “The town thanks Matt Watts for his service and leadership of the Ti Fire Department in cooperation with town services over the course of his tenure,” Giordano said. Watts said the job isn’t easy, and requires six to seven hours of time a day. “I will now have a chance to pursue other opportunities,” he said. “I have enjoyed my time as Chief and wish the new officers luck.”

Watts said he is proud of his accomplishments, including the purchase this year of new Ferrara engine tanker that replaces a 1992 truck that had become a safety hazard. The $595,000 engine has a 1,500 gallon water tank, a deck water gun and an LED tower to light up emergency scenes. The truck will be placed into service as soon it it is fitted with new, lighter and safer air tanks for the fire fighters. Watts said the department has also become more community oriented, helping to hang Christmas lights and participating in local festivals. But like many volunteer companies, it has been losing members and now has 44. “It’s been in a steady decline for 30 years now” he said. “That’s happening all over the place.” The department also got a black eye this summer when one of its members was ar-

rested for a series of arsons. As companies struggle to attract volunteers, Watts said calls are increasing. We’ve had 300 calls this year, and we’d usually have 220 to 230,” he said. “It’s been uncharacteristically busy.” ■
