ABATE
As I mentioned last month, there was a change to Michigan’s No-Fault law which has devastating implications for motorcyclists. Starting July 1, 2020 persons applying for or renewing their auto insurance are given a choice to cap their medical expense coverage. Those choices include opting out completely; capping at $50,000.00; $250,000.00; $500,000.00; or to keep unlimited benefits.
THE DEVASTATING IMPLICATION: When a motorcyclist is involved in an accident with a motor vehicle, the motorcyclist is bound by the cap that
the motorist chose for himself/herself on his/her own auto policy!
As a trial attorney who represents injured motorcyclists, I have drafted a legislative bill that would allow injured motorcyclists to instead seek payment of their no-fault benefits from their own auto insurance, hence get the benefit of their own choice. The bill was introduced on May 6, 2021 as House Bill 4809. Please contact your legislators and urge their support of the bill!
