Justice Amy Coney Barrett: Senate CONFIRMS Trump appointee to US Supreme Court By Desert Star Staff The Senate has confirmed Judge Amy Coney Barrett as the ninth justice of the US Supreme Court. The mostly party-line vote comes a week before the election and fills

the seat vacated by the death of Ruth Bader Ginsburg. Barrett was confirmed on Monday evening in a largely expected vote, with no Democrats in favor and most Republicans in favor, enough

to clear the Senate in which President Donald Trump’s party enjoys a slight majority. The final vote was 52 in favor to 48 opposed, with only Susan Collins (R-Maine) joining the Democrats to vote “no.”

Her swearing-in ceremony was already scheduled for later in the evening at the White House, presided over by Justice Clarence Thomas. Barrett is expected to join her colleagues on the

Winging it for Bat Week!

We are celebrating this wonderful, winged mammal from October 24 - 31, and it is quite possible there has never been a more important year to acknowledge the vital role bats play in maintaining healthy ecosystems worldwide than 2020. One reason conservationists have dedicated an entire week to bats is to dispel the negative myths and assumptions about these animals. While many people worry all bats are rabid, the truth is the majority of bats are perfectly healthy. Bats are no more rabies-prone than other mammals! And, although they are feared bloodsuckers, most eat insects or fruit. In fact, out of over 1300 species

of bats worldwide, only 3 drink blood, and instead of a horror movie vampire, they actually lap it like a kitten drinking milk. That’s almost cute! Another sweet bat fact—bats are snuggly! To stay warm, several mothers and young pups will often all huddle up together. The biggest threat to these cuddly bats is habitat loss. Human development is destroying the wild spaces used by bats, putting them in closer proximity to us. While bats are not the virus-ridden species we fear them to be, there is still risk. When roads, homes, or farms are built, bat roosts are lost and these creatures are forced to interact with us more often. Ironically, people don’t realize they rely on sustainable bat populations

Plan a Visit to Piraeus, Greece Now

By Anthony Grant Piraeus is the fabled port of Athens and much more. In antiquity, Piraeus was the Athenian navy’s seat, turning out the slender trireme ships that the ancient Greeks used to battle the Persians at Salamis in 480 BC and keep any invaders who might dare to cross the Athenians at bay. Long fortified walls connected the port to the area around the Acropolis of Athens. For these reasons and more, Piraeus is an essential stop on any tour of Greece or the Mediterranean. Start planning your spring or summer trip now!

From its early rise to the present day, Piraeus’s history is inseparable from that of Athens. The Second World War was no exception, and while the capital was spared major damage, the port was more or less blown to bits. Repairing Piraeus at the war’s end was an ultimately successful effort that also ushered in an era of American sailors of the Sixth Fleet infrequently calling at the port. Today nothing embodies the spirit of that time better than the S.S. Hellas Liberty, an authentic “liberty ship” built in the United States in 1943.

These no-frills, steam-powered cargo ships were used to supply the Allied Forces during the war, and afterward, many were purchased by shipping magnates...the famous Greek “tycoons.” The Piraeus Archaeological Museum is a real hidden gem that, despite its small size, contains some definite showstoppers, most notably from the fifth and fourth centuries B.C. Most famous of these are the four bronze statues discovered near the port in 1959 that now inhabit the second floor. They include Athena and

Apollo in the form of a young man (the only known bronze kouros in the world). On the ground floor, you’ll find the vast funerary stele of Pagharos, a soldier who fell in the Battle of Chaeronea in 338 BC. Don’t forget to step outside to inspect the ruins of the Hellenistic theater of Zea. Are you an aspiring skipper, a seeker of all things nautical or, perhaps just in the mood for an excellent Greek coffee? Then check out the labyrinth of little streets behind the Piraeus train station, where you’ll find marine supply stores aplenty, some good bakeries and cafes and a few hotels of faded grandeur that will have you thinking of that 1960 classic with Melina Mercouri, Never on Sunday. In short, lots of atmospheres… Now, it was the wily Athenian general, Themistocles, who had championed Piraeus as the best location for the city-state’s fleet, and he wanted strong walls to help defend it. As you leave the train station, take a right, heading in the direction of the port gates where the large ferries going to (or arriving from) Crete are. You’ll eventually see the hill of Kastraki, which is home to the somewhat brooding ruins of the Ietionia Gate, part of the ancient system of

fortifications. There are two partial round towers atop walls that have been dated to 411 BC. Elsewhere in Piraeus, along the “Themistocles Coast” of the Freatida section, you can see ruins of walls that directly face the sea. Expect to be surprised the first time you see Zea Harbor because you may not believe you’re still in Piraeus. In ancient times this was one of the Athenian war ports, but now the big circular leisure harbor is perfectly calm. The promenade is a ribbon of little restaurants and cafés. The west end turns into the more modern Zea Marina, and that’s where the fancy yachts are. A bit farther down, you’ll find the Hellenic Maritime Museum. The round harbor at Microlimano is where Piraeus turns on the charm. Smaller than Zea Harbor, it’s also more languorous with its upscale cafés and seafood restaurants, most right up against the waterline with views of the fishing boats and Attica coast beyond. This is the spot where Athenians come to soak up some sun and island-style atmosphere on lazy Sundays—finally, the hill of Kastella where Athenian general Thrasybulus routed the Thirty Tyrants in 403 B.C. There are cafes and wonderful sea views from the top.

Food Now is partnering with local Desert Hot Springs homeless advocate Margaret Webb and Royal Emerald Pharmaceuticals employees to gather the necessary food items needed to make this Thanksgiving memorable for those in need. “We are encouraging our friends and neighbors to come to Grocery Outlet to drop off any food items which can be used to prepare that special Thanksgiving meal,” said Food Now Executive

CARES Act created an abovethe-line- deduction of up to $300 for cash contributions from taxpayers who do not itemize. To take advantage of this provision, taxpayers should make sure to donate before the end of the year. (Under Tax Cuts and Jobs Act, the standard deduction for Singles and Married filing separately is $12,400, Head of Household in $18,650 and Married Joint filers and Surviving spouse is$24,800.) 2. Supercharge investment with opportunity zones Opportunity zones are one of Congress’s most powerful incentives for investing in specific geographic areas. These are economically disadvantaged neighborhoods that need revitalization and offer the benefit of boosting local economics to spur positive growth in these communities for now and in the future. In specific scenarios, not only can an investor potentially defer paying tax on gains invested in an opportunity zone until as late as 2026, but one only recognizes 90 percent of the gain if you hold the investment for five years. Additionally, if you hold the investment for ten years and satisfy the rules, You will pay no tax on appreciating the opportunity zone investment itself. If you are worried about capital gains rates going up under a new administration, this may provide an excellent tax-free investment. There are more than 8,000 opportunity zones throughout the United States, and many types of investment, development and business

estate tax exemptions present a powerful estate-planning opportunity. With the Lifetime Estate Tax exemption currently at $11 Million per person, $22 Million per couple, it is advisable for those with high net worth to put this exemption in a trust to use later since this estate exemption could be lower to a $3-$5Million exemption. Many estate and gift tax strategies hinge on assets’ ability to appreciate faster than the interest rates prescribed by the IRS. In addition, the economic fallout of COVID-19 is depressing many asset values. There is a small window of opportunity to employ estate-planning techniques while interest rates are still low, and the Lifetime Gift Estate Exemption is at an all-time high. The current gift and estate tax exemptions are set to expire in a few years, and a new administration in the White House could accelerate that timeline. Understand the impact of that stimulus check The CARES Act directed the IRS to issue stimulus checks of up to $1,200 per

taxpayer and $500 per qualified child dependent earlier this year. The payments were paid based on 2018 or 2019 return information but are structured as advances of 2020 tax credits. The credits phase out for higher-income taxpayers, so taxpayers want to understand the implications if the check they received based on 2018 or 2019 won’t match the amount of credit they will calculate on the 2020 return. If the 2020 credit calculation is less than they received, there is no clawback. If they received less than the credit calculated for 2020, they could claim it as an additional refund. Old CC&Rs – Expired Documents, and Who Owns the Yards?

I’ve heard 20 years from the time of the recorded filing of the CC&Rs. I ask because I live in a subdivision development of homes that has no common areas but does have an HOA in which the developer transferred the CC&Rs to the HOA and homeowners. The CC&Rs don’t show up in the San Mateo county recorder system and I can only find a single change in the CC&Rs back in 1986. I need to confirm whether the HOA should have renewed and recorded the revitalization of the CC&Rs as they are over 30 years old. Any information would be appreciated. O.M., S. activities can qualify. It provides investors an opportunity to liquidate a wide range of appreciated assets to get generous tax rewards to reinvest all or a portion of gains. 3. Make up a tax shortfall with increased withholding COVID-19 created cashflow problems for many individuals. Taxpayers should make sure their withholding and estimated taxes align with what one expects to pay while you have time to fix a problem. If you find yourselves in danger of being penalized for underpaying taxes, you can make up the shortfall through increased withholding on your salary or bonuses. At the end of the year, a larger estimated tax payment can still expose one to penalties for underpayments in previous quarters. However, when withholding is considered to have been paid ratably throughout the year, it will avoid penalties. 4. Leverage low-interest rates and generous exemptions before they are gone The historically low-interest rates and lifetime gift and

because of the “rule against perpetuities,” an old legal rule which required a termination date. Although the passage of the Davis-Stirling Act in 1985 may have eliminated that concern, lawyers these days typically write CC&Rs with periodic automatic renewal so the HOA is covered in case a future court rules that CC&Rs still must have termination dates. If CC&Rs expire, the association no longer falls under the DavisStirling Act, which could be a horrible problem particularly for a condominium property. To reimpose expired CC&Rs, one would need 100% written consent not only of all the owners but also all the mortgage lenders – a very difficult task indeed. Older HOAs (‘80s and earlier) should check their CC&Rs and ask members to vote to amend and include automatic renewal, to avoid the possible disaster of expired CC&Rs. articles. I have a question regarding property ownership. Our small complex is a condominium, and we have free-standing houses each with a yard. Our condominium plan has a tract map with boundaries that include the unit with the front yards/ patios along with a description that a unit consists of the dwelling, garage and private yard areas encompassed by the unit boundary line shown on the plan. This might be in conflict with other language in the CCR’s. One owner is of the opinion that based on the tract map that this is his own private yard and he owns it. It is my opinion that this is a condominium and that he doesn’t own the land. However, it is exclusive use common area with input on the project by the HOA. Dear R.A.: Some subdividers create condominiums in which the unit is not the typical airspace block

“surrounded by the unfinished surfaces of floors, walls, and ceilings,” but in which the unit appears to be a piece of land. I call those “lot line condos,” which can provide subdividers a way around zoning setback and minimum lot size requirements. Have an HOA attorney look at the CC&Rs and condominium plan to provide guidance on this. Also, just because the yard possibly is part of the unit does not mean the HOA has no say in how it is used or maintained – the CC&Rs normally would apply to the units and common area. By Desert Star Staff Twitter has slapped a “misleading” label on yet another tweet from President Donald Trump, as it rolls out a new effort to “pre-bunk” criticism of mail-in voting and warns Americans not to expect final results on election night. In a tweet on Monday night, Trump stressed the need to have a final vote tally on the general election day, stating there are “big problems and discrepancies with mailin ballots all over the USA,” reiterating previous complaints about potential flaws in universal distance voting. The post was soon appended with a notice warning users the tweet is “disputed” and “might be misleading,” directing them to a link explaining that “voting by mail is legal and safe,” citing a coterie of favored “experts.” Big problems and discrepancies with MailIn Ballots all over the

Trump Under Twitter’s new “civic integrity policy” updated in September, the platform said it would add labels to tweets “containing false or misleading information” about elections, or even reduce their visibility for other users – a form of “shadowbanning,” a practice the company has repeatedly renounced. Even before the new rule went into effect, Twitter previously ‘factchecked’ other election-related posts from the president and attached a “misleading” label to another missive about the coronavirus earlier this month. The company further bolstered its efforts to combat so-called disinformation on Monday, launching a new feature to preemptively debunk – or “pre-bunk” in the words of Twitter’s head of site integrity Yoel Roth – “common

misleading claims” about the 2020 race, which apparently includes any form of skepticism about mail-in voting. #Election2020 is unlike any other in US history. Though Twitter and its assorted ‘fact-checkers’ have repeatedly challenged claims that distance voting is linked to “fraud,” in particular, Trump’s criticisms have gone beyond

the narrow question of ballottampering. The president and others have also suggested the system will be susceptible to errors, as was seen during New York’s primary race this summer, which even the New York Times described as “botched.” With the “experts” preoccupied with allegations of fraud, however, those other concerns have mostly gone ignored, and that appears set to continue as social media platforms move to purge any and all expression of doubt in the mail-in system.

Claes Bang and Guy Pierce Give Stirring Performances in “The Last Vermeer” refuse. They convene and, in just minutes, render a guilty verdict punishable by death. The courtroom explodes in shock, and what happens in the closing minutes will have you on the edge of your seat. Yes. It’s an intriguing but real cliffhanger. Technically, the film is perfect, from the settings to costumes to the music. Still, I would be remiss if I didn’t mention Remi Adefarasin cinematography, which beautifully captures postwar Holland’s changing physical portrait.

In the meantime, the Dutch government wants him in their custody and sends some goons to snatch him from prison; on hearing this, Joe races back to the prison and takes Han to a loft where he can paint while he continues his investigation. The artist reveals that despite having art critics spit on his work, he knew he was an excellent painter and decided he would pull off the hoax of the century by painting several pieces and then pawning them off as Vermeers. Those transactions made him and his wife incredibly affluent, owning multiple homes and enjoying a lush lifestyle. However, the

The latter discovers a treasure trove of photos and cash hidden under Han’s studio floorboards, which included pictures of Joe’s wife attending parties where Nazis were in attendance. He confronts her, and she insists that although she worked for a German officer, she could funnel information that saved the lives of many people. They separate, and an attraction begins to heat up between him and widowed Minna, played by Vicky Krieps, who is also assisting him in the investigation. Han is now on trial, and all the Vermeers that he claims he painted are displayed in the packed courtroom. Unfortunately for him, the one person who could back up his claim is deceased. With dramatic flair, he testifies that the art world treated him with disdain, and he deliberately painted the forgeries that fooled some of the best authenticators in the art world, bragging that one of his counterfeits hangs in Washington’s National Gallery of Art. Experts are called to testify, all of who had authenticated the paintings as being genuine. The accused explains in great detail how he painted the fakes – from the kind of brushes, paints, and canvases he used, as well as the chemicals applied for the aging process. Joe, who is acting as his co-attorney, begs the judges to let him perform an acid test to prove the paintings are fraudulent, but the judges

He starred in The Square, The Burnt Orange Heresy and currently co-stars in The Last Vermeer, written by James McGee, Mark Fergus and Hawk Ostby, based on the book “The Man Who Made Vermeers” by Jonathan Lopez. This whodunit mystery, inspired by a true story, is well directed by Dan Friedkin, who makes an excellent directorial debut. Each of Bangs’ characters is well developed, especially in “The Burnt Orange Hersey,” where it does a surprising 360. What is most fascinating about costar Guy Pierce’s work is that he allows his characters to completely take over, leaving no traces of himself. He is one of only a few transformative actors and delivered memorable performances in Memento, L.A. Confidential, and Lawless. Pierce does it once again as the notorious Dutch painter Han Van Meegeren, an effete bon vivant artist. The latter was

famous for his decadent soirees during World War II. Top Nazi officials enjoyed overflowing food, wine, and nights of debauchery at one of his over 500 properties in Amsterdam. He also sold Dutch treasures to top Nazi officials, including Hermann Göring. While Van Meegeren enjoyed his lifestyle, Bang’s Captain Joseph (Joe) Piller, a Dutch Jew and a former tailor who loved to play the piano, fought in the Resistance. His record was spotless, and after the war was assigned to tracking down and identifying stolen works of art, mostly from Jewish people, to return them to survivors or their families. It is now May 29, 1945, three weeks after the fall of Hitler’s Third Reich. While Joe searches for stolen treasures, there are public executions by firing squads for people guilty of collaboration with the enemy in the streets. Some Covid-19 vaccines may increase HIV risk By Desert Star Staff A group of researchers in the US is sounding the alarm over several coronavirus vaccines currently undergoing clinical trials, warning that they may increase the risk of contracting HIV in subjects who take them. At least four of the current batch of Covid-19 vaccines in development at the clinical trial stage might increase patients’ risk of contracting HIV, according to a team of scientists led by Susan Buchbinder, a University of California San Francisco professor and head of HIV Prevention Research at the San Francisco Department of Public Health. One of the vaccines is on the verge of phase 3 studies in Russia and Pakistan. Buchbinder and her colleagues have firsthand experience of this particular vaccine side effect from their previous research into an HIV vaccine. Their most promising candidate vaccine had the exact opposite effect to the desired outcome, leaving people even more vulnerable to the disease

Doctors’ Open Letter Urges Action on Climate Change

By Suzanne Potter SACRAMENTO, Calif. -More than 4,300 doctors and nurses have just published an open letter to patients urging them to demand action on climate change. The letter, which is backed by 16 national and statelevel medical organizations, declares that climate change is a health issue. Dr. Amanda Millstein is a pediatrician from Richmond and co-founder of the group Climate Health Now. She said extreme weather events worsened by climate change are impacting access to health care. “Twice in August, we actually made the decision to close our clinic because, even with the use of an air filter, our indoor air quality because of wildfire smoke was so poor

She said wildfires and flooding can overwhelm hospitals with an influx of patients - or force them to evacuate altogether. AT&T Discontinues DSL, Throwing Rural Residents Into Uncertainty

Critics say as more

companies phase out phoneline services, rural residents could be left stranded with no access to reliable internet. AT&T is the first telecommunications giant to announce it’s retiring DSL. Harold Feld, senior vice president of the communications advocacy group Public Knowledge, said

He said shelving DSL without implementing a reliable substitute will disrupt rural economies. “Often in these small rural areas, the copper DSL line

it off without permission from the FCC,” he said. “When the Trump FCC reclassified it as an information service, as opposed to a communications service, the FCC eliminated its own authority.” The Federal Communications Commission maintains the high cost of broadband regulations discourages companies from investing in these rural areas. Feld said for most of the country’s history, telecommunications services were viewed as critically essential for everyone. “Imagine if we said, ‘Well, you know what? We don’t have to provide electricity to everybody in the country. We’ll only provide it to the 85% of people where you get a good financial return, and that other 15 % are just out of luck,’” he said. More than one-third of Kentucky students don’t have adequate access to the internet at home, and it’s estimated that around 34% of households in the Commonwealth lack reliable internet access.
