Hard-fought battle could be over DESERT HOT SPRINGS This week, the California Fourth District Court of Appeal handed down a significant victory to Mission Springs Water District. The Court issued a ruling in favor of Mission Springs Water District (MSWD) in a case filed by the District in 2011, which challenged two proposed ballot initiatives that would have lowered water and sewer rates below the cost to deliver those services to the customers of the District. Under California law, water
districts must set water and sewer rates at levels sufficient to cover the cost to provide those services to customers as well as service debts, and set aside adequate reserves to maintain district infrastructure. The two proposed initiatives would have cut MSWD’s rates by 40 percent. The district challenged the proposed initiatives on the basis that they would have reduced rates far below the cost to deliver services in violation of California Law.
DESERT HOT SPRINGS – The Living Desert zoo brought some of their wild creatures to entertain and educate children here at the Boys & Girls Club of the Coachella Valley on Thursday, Aug. 8. Nearly 75 children between the ages of six to 17 watched as staffers from the zoo’s Wildlife on Wheels (WOW) mobile program showed the animals and explained their unique qualities. WOW Animal Trainer Renee Barnett and Coordinator Diedre
Ousterhout brought several exotic animals from their controlled zoo environments to share with children who may not be able to visit the zoo or participate in zoo programs. This program was made possible by a $33,753 donation from philanthropist Connie Lurie of Palm Desert. Lurie’s generous donation also allows children to enroll in a Summer ZooCamp or Junior Ranger weekly session that offers behind-the-scenes tours and animal encounters at The
Advocating in favor of the initiatives, the Howard Jarvis Taxpayers Association responded to the District’s lawsuit by filing two motions to dismiss the case. Indio Superior Court Judge, Harold Hopp, ruled in favor of MSWD on both motions, finding that the initiatives were unlawful under California law. Further, the court stated that it found no evidence that the District’s budget is padded or abusive, as asserted by the initiative sponsors. Jarvis appealed the trial court’s ruling and this week, the Fourth District Court of Appeal issued its final

According to Pinkney, the Court found that Mission Springs submitted evidence demonstrating that the initiatives, if passed, would have rendered the District bankrupt and unable to provide essential water and sewer services to its customers. “The Mission Springs Board was correct in its decision to challenge the defective
initiatives,” Pinkney said. “Two courts have now agreed with Mission Springs’ position and it is our hope that the Howard Jarvis organization does not seek review by the California Supreme Court and drag this out any further. Doing so will only serve to run up unnecessary expenses for water district customers.” “The initiatives were poorly drafted and poorly conceived, and the District has prevailed. That should be the end of it,” Pinkney said.

By Dan Mcallister In the fall of 1913 Cabot Yerxa and Bob Carr jumped off a train at Garnet and began their lonely trek into the unknown desert. They headed east and when it warmed up a little they slept on the sand. Their story is the story of all the hardy homesteaders who first came to stake out their claims. At first it seemed a forlorn hope, but these people would persevere, and eventually their heirs would help build a city. Following their snooze in the sand, Cabot tells us, “Daylight disclosed one very small wooden shack in a sandy clearing. Smoke issued from a tin pipe thrust through the roof so we walked that way.”

It can be safely assumed that Cabot and Carr would shortly afterwards be found saying “Howdy!” to petite and frilly Hilda Gray, surprising her as she cleared land with a mattock, or repaired her ten- by twelvefoot pine cabin. It had a black felt paper roof, which, as Cabot observed, “made the interior hotter than Hades….” Hilda, Cabot tells us, “a single woman of good education,” has only praise for the desert, as she cheerfully recounted some of the things she experienced during her first few months as a homesteader. “Nothing but a handful of shacks scattered all around, too far to see from here,” she told the inquisitive men, as her arms swept the ten thousandacre landscape behind her. “But so far I’ve come to meet Jack Riley, and the MacCargars. Then there are the three Green families, and Coolidge and Conway and Grandma Riley. Cabot Yerxa, (1883-1965), historically referred to as the Father of Desert Hot Springs, homesteaded land on Miracle Hill from 1913 to 1918, and later wrote a long series of articles about his desert experiences that were published the Desert Sentinel newspaper. Cabot’s Museum Foundation has reprinted that series of articles in a book, “On the Desert Since 1913,” which is available at the museum trading post and on their website. I had a few tubes of artist’s paint, some old brushes, and a few canvases. On a stormy day, not being able to work outside,

As well as Mike Driscoll, Joe Baunhorn, and many others who came seeking desert life. …On a distant fall I painted a picture of an Indian on a horse going to a water hole in a desert. A friend took this to Hollywood, and it was sold for a modest sum. With these few dollars dropping unexpectedly out of a clear sky, the big question then was: What could be the greatest good accomplished by their expenditure? Many things were needed, starting in with extra food, clothing, and so on, ending with some improvements to the cabin. But the sensible choice finally settled down to a new well. Water was of paramount importance. The very first thing every day, water had to be carried home sufficient for the day. In the beginning, walks had been 14 miles to the railroad, then cut to less than two miles, after that one mile to Bob [Carr]’s well. The Indian well was closer, but its water too bad for full use. [The] new sand-hole well currently in use was not too far, but the water had to be carried up

Originally written fOr the Desert sentinel quite a steep hill. Every desert man’s dream of heaven on earth is “water at the door of his cabin.” So I visualized water at my cabin door. . . . The few dollars from the painting would buy a little lumber. I could dig down as far as this lumber would reach and then perhaps I could sell another painting or write something to bring in the cost of more lumber. I had written and sold small stories to the new industry of moving pictures then just starting in Hollywood. Covering a big sheet of paper with figures and diagrams, it finally appeared that boards eight feet long would be the
cheapest to buy. They would also work out for the smallest hole possible to work in, thus making the picture money reach deepest into the earth. The eight foot boards two inches thick were cut into pieces of two feet and three feet. When put together, they left a hole for me to work in 27 inches wide by 32 inches long. In this space was a pick, shovel, well bucket, digging bar, and canteen. A ladder nailed to the wall at one end cut off five inches of the original space, leaving me net working room of 24 by 27 inches.

With the torrid pace the markets have set recently, is there anything that can push them to higher levels? Or is another major correction the next logical move? The markets broke a sixweek winning streak last week and that prompted the usual doom and gloom rabble-rousers
to raise their heads once again. It’s hard to ignore them as the markets have come a long way from the depths of the Great Recession in 2008. The global banking crises that lead to those turbulent times have been eradicated. Banks have never looked stronger. Don’t take that to mean that there won’t be more trading scandals and damage from the overzealous executives. The most likely “oomph” for the markets going forward remains the easy money policies of nearly all the major banking systems in the world. The global real estate implosion appears to be well on its way to a recovery. The European crisis has quieted although a great deal of work remains with many countries still teetering on the brink of the
abyss. Even though we aren’t hearing a lot of news out of the EU lately, there have been improvements such as England climbing out of recession and better trade reports. Europe is very important because it is the largest combined economy in the world. We are about five weeks away from what could be the biggest driver of global markets for the next few months and those are the September 22nd German elections. Angela Merkel is running for her third term as German Chancellor. It’s unlikely any party will win complete control of the Bundestag. What is much more likely is that the iron fist austerity policies of Merkel and her party for the past couple of years will quickly wane and we will see a new round of bailouts for those struggling European countries. There is no telling what impact this will have on the German electorate since they are responsible for footing the cost for much of the aid and have been ardent supporters for austerity over other forms of stimulus in the past. It’s going to be very important to watch the turnout among younger voters. Unemployment across Europe has been more than 50% for the youngest voters. A Thick-Billed Parrot, which can live to be 80 years old captured the children’s attention and some asked if they made good pets. “Be careful when choosing a pet,” Ousterhout warned the children, “because if you get a Parrot at the age of 10, it will be with you when you graduate college, get married, start a family and could outlive you.” The Thick-Billed Parrot also is on the endangered species list and has become part of the
zoo’s Species Survival Plan that is more like an exotic animal dating website designed to pair up endangered animals from around the world to increase breeding opportunities, Ousterhout explained. And finally, Sundance, the star of the show appeared after rattling his covered cage during the entire show creating excitement and a little bit of tension among the children who wondered what creature was inside. Sundance is a two and a half pound Red-tailed Hawk with a fierce look and expansive wingspan. He stole the show.

Charles Ponzi, the Father of Fraud
By investigator lance Colmer Most of us are familiar with the term “Ponzi scheme” through high profile cases, such as the one involving New York financial advisor Bernie Madoff. Despite the phrase becoming part of the American economic vernacular, many people remain unaware of origins of the Ponzi scheme. The Ponzi scheme is named after Charles Ponzi, an Italian immigrant born in 1882 in Parma, Italy. Ponzi came to America in 1903 and settled in Boston. According to Biography.com, Ponzi moved to Montreal in 1907 and was hired as a teller at a bank catering to Italian immigrants. Ponzi’s first foray into criminal life occurred when he was convicted of forging a check. He spent three years in a Quebec prison. In 1918 Ponzi returned to Boston and it was during this time that he devised the scheme that bears his name. Ponzi’s plan involved buying international postal coupons through his overseas contacts. He later sold the coupons in the United States and reportedly garnered more than 400 percent profit on many of the sales. Realizing the potential for
more money, Ponzi began seeking investors and promised returns of 50 percent in as little as 45 days. Ponzi paid these investors using money from other investors, rather than with actual profit. Ponzi’s scheme fell apart in 1920, when The Boston Post began to investigate his business. Investors became worried and began pulling their money out of Ponzi’s company and the truth behind his “profits” was revealed. Ponzi was arrested and charged with 86 counts of mail fraud. He subsequently spent 14 years in prison and later died a broke man in 1949. Fast forward to the present and the scam is still alive. In 2012, the FBI announced the arrest of three Coachella Valley residents for allegedly operating a $25 million investment scheme. Ronald Lee Brito and Bonnie Brito of Rancho Mirage and Thomas Winston Moore of Palm Springs were indicted on 64 counts, including their participation in a Ponzi scheme between 2005 and 2012. The defendants promised lucrative returns on investments and used several corporate names to attract up to 500 investors. The
Charles Ponzi originated the “Ponzi scheme” in the early 1900s. government has stated that the scheme brought in investments totaling more than $25 million. As of the writing of the FBI press release, the case is still pending trial.

The series includes eight two-hour sessions for a small group led by a trained facilitator. The class will be meeting on Mondays and Fridays in August from 8:30 to 10:30 a.m. According to the Centers for Disease Control, each year, one in every three adults age 65 and older falls. This can lead to tragic and life-threatening injuries. In California, 25 percent of Older Adults who fall and break a hip die within one year. These tragic injuries are preventable. Center had a total of 3,567 hospital and emergency room admissions due to fall related injuries in recent years for adults age 55 and over. Nationally, falls among older adults is the most common cause for injuries and hospital admissions for trauma. This is only the tip of the iceberg, since according to the most recent Coachella Valley Health Assessment Resource Center Report an estimated 20,000 residents over age 65 reported at least one or more falls with an estimated 6,400 reporting an injury in 2010. In addition, an estimated 32,000 residents fear falling and limit their activities as a result. The Mizell Senior Center Program course is designed to teach Older Adults several
steps they can take to protect their independence and reduce their chances of falling. The classes will include education on fall risks, medication management, vision checking and improvement, home hazard assessment and modification coupled with a variety of exercise programs. Disney’s ‘Planes’ Is High Flyin’ Family Fun
By theda Kleinhans reichman It’s hard to believe that summer has flown by and the kids are back in school. I remember when school didn’t start till Sept. So to perk up the kids as a final summer fling, take them to see Disney’s high flyin’ film about a little crop duster with big dreams. Dusty, voiced by standup comedian Dane Cook, dreams of being a highflying air racer but even his dear friend, the tell-it-like-it-is forkliftmechanic Dottie (Teri Hatcher ABC’s “Desperate Housewives”) tries to discourage him, fearing he will get injured or crash if he tries to compete with world class racers from all over the world. He does have one booster who believes in him, the green fuel truck Chug (Brad Garrett TV’s “Everybody Loves Raymond”). In fact Chug has been coaching him with the help of airport manuals and books on air racing so Dusty will know just what to do. They also elicit help from Navy Corsair Skipper (voiced by Stacy keach “The Bourne Legacy” and
“Nebraska”) who is reluctant at first, but eventually is won over by the little crop duster’s spirit and drive. According to klay Hall (director/original story), “I think people will really relate to ‘Disney’s Planes’ because it’s a great underdog story. It has a lot of heart and a message we can all use: If we can believe in ourselves, step out of our comfort zones and get past whatever fear is holding us back, we’d be surprised with the results. And that’s exactly what happens to Dusty in this movie. He’s a crop duster who’s never flown above 1,000 feet, but he dreams of being the fastest air racer in the world. He has a lot of obstacles to overcome and needs to dig pretty deep to find the courage to become more that what he was built for.” Disney animators and the director also bring great detail to all of the flying sequences. My husband, who was in the Air Force, was impressed with all the flying sequences in the film
because they were so flawlessly detailed. Countless aviation experts and consultants were used for all the flight scenes and the attention to every detail pays off. Another plus is the director/writer who comes from an illustrious line of flyers. He began drawing airplanes at an early age and his father and grandfather were both aviators, the former serving as a pilot in

When Allen Lee rented a 2013 Nissan Pathfinder from Alamo at the Palm Springs Airport on May 26th, he never imagined 24 hours later he would be stopped by three Texas State Troopers in Hudspeth county that clocked him speeding at 94 miles an hour. In “ticket terms” that’s $257.
The rental car had been making intermittent shuddering movements resembling driving over a rumble strip since departing the desert for Austin, Tx. It didn’t help that the Pathfinder was rental car with Arizona license plates and he had a California driver’s license. “It was a Bonnie and Clyde

When Costco Travel was contacted about Alamo’s lack of disclosure they had Alamo service the Pathfinder and forwarded a copy of the invoice to Lee. “They completely missed the point,” he moment,” he said, “being chased said, “had I known about this safety on the I-10 by three Texas State Troopers!” What Lee didn’t know, because it was not disclosed by Alamo to him prior to the Pathfinder leaving the lot that the vehicle had a dismal safety history due to a chronic problem called ‘shuddering’. PALM SPRINGS – Assistance Program (AAP) has received a matching $100,000 grant from Wells Fargo Foundation in support of its annual Jeannette Rockefeller Angel Program fundraising drive. Tim Hanlon, President of Wells Fargo Foundation, gave the good news to AAP CEO Mark Anton, who says the funds will be used to support the organization’s food voucher program, which helps feed more than 500 people per month. “I am hopeful this generous and much needed donation will encourage others to follow the lead of Wells Fargo Foundation, which has been a steadfast and constant supporter and partner
for many years,” said Anton. “ All funds generated through the Angel Program help contribute to the $50,000 AAP needs each month to continue its core services. The organization encourages new supporters, and appreciates those members who have remained dedicated to the Angel Program throughout the years. Depending on their contribution level, Angels receive benefits, including tickets to the iconic “Evening Under the Stars” gala. In the experience of this writer, who has attended many conferences and meetings about Unidentified Flying Objects in the last fifty years, no other similar gathering has expressed such confidence in immediate disclosure of alien contact. The basic remaining question for the several dozen speakers and packed audiences of more than 700 participants at the Joshua Tree Retreat Center seemed to be whether the aliens will be friendly or hostile? There seemed to be agreement that the aliens would be humanoid. However, there was discussion whether or not the “Little Green Men” (and women) will use their superior technology to dominate the planet or will they cordially and peacefully welcome Earthlings as equal partners in a Galactic Federation? Although no vote was taken, my impression is that the great majority of both speakers and audience at Contact 2013 believe
that the aliens will be friendly. For example, Carol Rosin, former Corporate Manager of aerospace company Fairchild Industries and advocate of a United Nations treaty banning weapons in space said at her workshop that if aliens were going to take over the planet, “they would have done so by now.” Nevertheless, my own observation is that no one at the conference presented sufficient evidence to justify either point of view or even whether disclosure was really imminent. Nevertheless the speakers were an amazing group of people with a considerable background in investigation of the strange unidentified flying objects that have been seen in the sky of our planet for many centuries. Understanding the Growl
Dog Language Part Two So, if you’re not supposed to punish your dog for growling, what are you supposed to do? Time for a little dog psychology and detective work – start with these 5 steps: 1) Stop. Whatever you’re doing, stop! Wait until your dog relaxes, then move away, so you’re rewarding the relaxed behavior rather than the growl.
2) Analyze the situation. What elicited the growl? Were you touching or grooming her? Restraining her? Taking something away from her? Making her do something? 3) Figure out a different way to accomplish your goal. Lure him rather than use physical force. Offer yummy treats for his co-operation.
Treats used in a reward based system can be very effective – never condition your dog to become a free-for-all beggar! 4) Keep in mind that stress causes aggression, and stressors are cumulative. It may not be just the immediate stimulus that caused the growl, but a combination of all the stressors she’s experienced in the past few days. Here is another tip for you to help dogs. Animal Control reports that the majority
of dogs they find WITH microchips are NOT registered to the owner. The microchip
is registered to the facility (shelter) that implanted them. New owners are instructed or given a booklet to register the pet via computer then, to themselves. It appears, in the joy of adopting, this bit of information doesn’t register. When adopting or purchasing a pet remember to register the microchip number your name and address. There is a fee to do it, generally $10 to $25 dollars. If the new pet owner does not know what agency implanted the microchip, any vet can scan the dog can see what manufacture chip belongs to.
