New Art to view this Holiday Season in Desert Hot Springs

By Janice Gough If you are in Desert Hot Springs, you may see some new sculptures installed on Palm Drive and Pierson Blvd. World-renowned artist, Simi Dabah, created these unique sculptures. He and his wife, Julie, have generously donated these eight sculptures to our city. Simi collects metals from many places and then cuts and welds the art to his design. Sometimes the design is conceived previous to having the materials to create it, and then Simi draws it out. Afterwards, he must find the perfect metal and then design

the sculpture by calculating the weights and measures, so that it will be in perfect balanced. Thus, being a good mathematician is an important part of his work. Simi and his wife live in Los Angeles and have donated many of his works all over the Coachella Valley. Before he retired, he was involved in real estate here in Coachella and owned many properties. In Desert Hot Springs, he owned eighty acres at Skybourne. Simi has never sold his art, because in his own words, “I was lucky to have made a lot of money in real estate and metal sculpting has been my hobby for many years and it is my gift, to give back”. Universities, Schools, Colleges,

Libraries, places of worship, and Cities all over the country have been the benefactors of his gifts. Simi and Jewel bring their completed sculptures down to his ranch in Joshua Tree, monthly, until they are donated. Simi does not name his sculptures because he leaves them open to interpretation. For ease of identification, when I am speaking about an individual one, I have names for them so we could all connect to the same sculpture, since we have eight. One sculpture on his ranch weighs over 30,000 lbs. Now, we would have to put some of our top math students to work, to calculate weight and balance on this one. I refer to this one as

“Balance”. When I contemplate it, I think of the Balance that we all need in our lives to make our trails smoother. The simple beauty of art will uncover our deepest thoughts and emotions. Simi was born in Manchester, England in 1927 and moved to Los Angeles as a young boy. Always interested in Art, he started by making ceramics, oil painting, and creating small mobiles. Forty-five years ago, he began welding metal into sculptures. These abstract sculptures are made from scrap metal, steel bar, plates and pipes obtained from metal scrap yards. When the idea and vision pops into his artistic mind, Simi goes to work. You will notice that these

sculptures grown more beautiful in time and offer a new feeling to our city of Desert Hot Springs, as we grow more beautiful in time. Our city will soon become an art haven. as we expand to welcome all artists to experience the Peace and Clarity of focus, our Jewal of the Desert offers them. Directors- As Chairs, Landlords, Multiple Offices Dear Sir: Our association has an absentee homeowner who owns four rentals in our association. This seems to be a conflict of interest. Can this person run for Dear Mr. Richardson: the Board? Our HOA directors regularly Thank you, S.F., Irvine nominate themselves as chairs of respective committees within Dear S.F.: the community. Needless to say, Some associations have pet projects of individual board bylaws which require a director members get funded, while other to be a resident owner, but it is committee groups not on the rare to have bylaws which ban a board scrape by. multiple unit owner from serving. Some of us within this HOA I often wonder why anyone with believe this practice constitutes more than two memberships a conflict of interest, However, would serve on an HOA Board, we cannot find anything that since under Civil Code 5800(e) specifically addresses the they are disqualified from the situation. So, is this practice immunity which Civil Code illegal or should us “have-nots” 5800(a) gives the other directors just wise up and run for seats on on the board. The idea of this the HOA Board? disqualification is that someone S.L, San Juan Capistrano owning three or more homes in the association is not a volunteer Dear S.L.: but has a business interest. Committees are a valuable HOA resource. They handle ongoing subjects which require more specific focus than can be given in board meetings, and typically provide the board with reports or recommendations guiding the board within the area of the committee’s charter. Committees are also great training ground for future directors. I have no problem with directors serving on committees, because it helps as a further point of communication with the board. However, directors are already usually working hard enough on their board responsibilities, so it may be fairer to have a nondirector chair a committee. Sometimes several directors serve on a committee, so that a quorum of the board is actually part of the committee. This is a bad idea for two reasons. First, it triggers the Open Meeting Act, and is a “board meeting” under the Act. Second, if the board is going to do all the committee work, why bother having a committee in the first place? Best, Kelly By Kelly G. Richardson, Esq. CCAL

December 23, 2015

Anyone who serves on their HOA board should be very careful to understand their immunity and how to preserve it. Thanks for your question, Kelly Dear Kelly: The Association’s bylaws state “Multiple Offices. No person shall simultaneously hold more than one of any of the other offices.” The Board voted to have one person hold the positions of Vice President and Secretary simultaneously. While I initially voted for the appointments, I reread the bylaws and discovered the restriction. What are the consequences of governing in conflict with the Bylaws? S.B., Lake Forest Dear S.B.: The Board is duty bound to follow the Bylaws, unless they

are so outdated that the law now overrules them in certain respects. Your board should present this question to its legal counsel, or, better yet, vote to rescind the vote and return to compliance with the bylaws. If the board is not complying with the governing documents, how can the board insist that the rest of the homeowners comply? Best regards, Kelly Kelly G. ‘Most hated man in America’ arrested for securities fraud By Deset Star Staff Martin Shkreli ‒ the pharmaceutical CEO infamous for jacking up drug prices 5,500 percent ‒ has been charged with securities fraud. The arrest is unrelated to his raising the price of life-saving pills exponentially, but to his time at a hedge fund. The FBI arrested the 32-year-old entrepreneur in his Manhattan home early Thursday morning. Prosecutors accused him of illegally taking stock from Retrophin, Inc. to pay off his personal debts from unrelated business dealings as a hedge fund manager for MSMB Funds. Shkreli started the biotechnology firm in 2011, but was ousted from the company in September 2014 and sued by its board of directors. He started the Currently the chief of Turing Pharmaceuticals, Shkreli has been referred to as “the most hated man in America” and a “symbol of defiant greed” after his company purchased the patent for Daraprim , a 60-year-old drug that can be essential to certain AIDS and cancer treatments, and raising its price from $13.50 to $750 in just over a month. Retrophin sued Shkreli in federal court for $65 million, accusing him of misusing the company’s assets, including its stocks and cash, “to enrich himself, and to pay off claims of MSMB investors (who he had defrauded),” the lawsuit said. In 2012, the Securities and Exchange Commission opened an investigation into the hedge fund and into Shkreli. The lawsuit and the securities fraud investigation are related, with the SEC accusing Shkreli of defrauding

MSMB by misappropriating funds from MSMB, making misrepresentations to investors and the executing broker, and “fraudulently induced Retrophin to issue stock and pay cash to disgruntled hedge fund investors,” the criminal complaint said. “Over a five-year period, Shkreli is alleged to have perpetrated a series of frauds on investors in his hedge funds and Retrophin’s shareholders in order to cover up his poor trading decisions,” Andrew J. Ceresney, Director of the SEC’s Division of Enforcement, said in a statement. The SEC accused Shkreli of misleading investors and prospective investors in MSMB Capital Management about the fund’s size and performance, claiming in July 2010 to have “returned +35.77 percent since inception on 11/1/2009,” when it actually generated losses of about 18 percent. In December 2010, Shkreli “falsely stated” that the fund had $35 million in assets under management when it actually had less than $1,000 in assets in its bank and brokerage accounts. In February 2011, MSMB’s accounts had a negative value, so Shkreli then took a short position on a pharmaceutical stock in MSMB Capital Management’s account, which then resulted in losses of more than $7 million to the executing broker who had to cover the short position in the open market, the SEC claimed. He then misappropriated $900,000 from MSMB Healthcare in 2013 to settle claims over the fund’s inability to settle that sizeable short sale.

From September 2013 to March 2014, Shkreli, with assistance from Evan Greebel, Retrophin’s outside counsel and corporate secretary, “fraudulently induced Retrophin to issue stock and make cash payments to certain disgruntled investors in Shkreli’s hedge funds who were threatening legal action” by “misleadingly stating the payments were for consulting services,” the SEC statement said. Federal authorities also accuse Shkreli of using $120,000 from MSMB to unlawfully pay for food, clothing, medical expenses, clothing, office rent and cash withdrawals between October 2009 and July 2011. The FBI arrested Greebel early Thursday as well. The 42-year-old lawyer is accused of aiding and abetting Shkreli’s “fraudulent conduct,” the SEC complaint said.

“Greebel’s alleged role in facilitating Shkreli’s fraud on Retrophin’s shareholders not only crossed legal boundaries but also grossly violated both his professional and ethical obligations,” Ceresney said. Shkreli’s legal troubles don’t end with the federal charges and the Retrophin lawsuit, however. Turing Pharmaceuticals is facing an antitrust probe by New York Attorney General Eric Schneiderman. The state’s top lawyer is concerned that Turing might be trying to prevent generic versions of Daraprim from being produce by restricting distribution of the drug specifically so that generic drug manufacturers can’t get the samples they need to create their own version. Shkreli has previously denied any wrongdoing with regards to both his time at Retrophin and MSMB and his price-gouging of out-of-patent drugs.

Social media has rejoiced at the news of his arrest. Along with being reviled for his questionable business moves, he is also despised for his cavalier attitude about people’s lives. “I probably would have raised the price [of Daraprim] higher,” Shkreli said at a Forbes summit in New York earlier in December, adding: “My investors expect me to maximize profits.” He did not win any fans after paying a reported $2 million for the only copy of the Wu-Tang Clan album ‘Once Upon a Time in Shaolin’. The iconic rap group, upon learning of Shkreli’s business practices “decided to give a significant portion of the proceeds to charity,” Robert Diggs (better known as RZA), the Clan’s producer and de facto leader, said in a statement.

Holiday Mail Increases, So Does Package Theft By Julie Buehler PALM DESERT, Ca. December 14th is the busiest day of the year for US Postal Service. And if you spent any time at a post office, you likely noticed the lines out the door. extra employees nation-wide and bracing for what seems to be endless lines. The Postal Service circles December 14th on the calendar as it’s the last full day that regular ground shipping is guaranteed to reach it’s destination by Christmas eve... And that means locals looking for the most cost effective way to deliver their holiday cheer flocked to the local post offices.

The lines were long to reach the counter and even the selfhelp kiosk got backed up, but everyone seemed to be in the holiday cheer and perhaps, that’s because as the post master said patience was their best virtue... The lines were long but holiday cheer was easy to find. “Just, Merry Christmas everybody!” said Pat Scott, with a laugh and smile. She had been

waiting in line for more than 20 minutes to send her packages off, but her remarks echoed the sentiments of others. The post office prepared for the past few months for this one day, it’s busiest of the year. Employees began training in October for the holiday rush, but it was other customers helping each other at the self-help kiosk. The day ran relatively smoothly considering it’s expected to be more than 10 % busier this year than last. “If you’re out here today, patience is probably going to be your best virtue at this point,” said Postmaster Tom Ongalibang. “The 14th is our greatest mailing day the 21st, is going to be our largest delivery day.” And with the largest delivery day coming next week, local law enforcement is on high alert for mail thieves. Just last week, during a routine patrol, an Indio police officer witnessed a package being stolen from the porch of a resident. Luckily, the thief was caught, and the package

returned to the rightful owner, but Indio Police say this is a common problem this time of year. “It is that time of the year for the Grinches to come out and try to steal Christmas from us,” said Dan Marshall, Indio Police Department’s official. “There are people out there, driving around and looking for the packages that we leave on the porch.” Indio Police released some tips to prevent theft of packages and presents: They recommend specifying time and date of delivery, getting delivery made to place of business, or your work, somewhere you’ll be throughout the day, or even having it delivered to a neighbors house. “Don’t let them take your Christmas, be proactive, look out for your neighbor, if you see something, say something,” said Marshall. Again, this year the post office is looking at a 10 % increase in mail, so they’re extending delivery hours and will deliver on Sunday the 20th as well. Source KMIR www.desertstarweekly.com

Americans Spending More for College Out-of-Pocket

By Desert Star Staff The Bank of Mom and Dad is open for business, as parent outof-pocket spending has become the number one source of college funding. In fact, 62 percent of families did not borrow to pay for college last year, according to a new report. The national study, “How America Pays for College 2015, from Sallie Mae and Ipsos, now in its eighth year, found that parent income and savings covered the largest share of college costs -- 32 percent -- surpassing scholarships and grants at 30 percent, for the first time since 2010. Families covered the balance of college costs using student borrowing, student income and savings, parent borrowing, and contributions from relatives and friends. While families spent 16 percent more on college in academic year 2014-2015, the report found that fewer families are worried that economic factors would affect their ability to pay for college, fewer eliminated colleges from consideration due to cost, and fewer took cost-saving measures to control college costs. “The increase in the amount

families are spending appears to be less about the rising cost of college and more about the choices parents and students are making about how they pay for college, says Michael Gross, vice president and head of the higher education practice at Ipsos Public Affairs. “Traditional economic concerns, such as job loss, declining home values, and decreased value of savings, are less worrying for parents this year, allowing families greater freedom to concentrate on college. Still, while the majority of families agree college is an important and worthwhile investment -- and are making such responsible decisions to help pay for it as filing for federal aid, reducing personal spending and working while attending school -- only 40 percent of families have a plan to pay for college. “College remains a priority for parents, and they are feeling more confident as they reach into their own pockets and put their money where their values are, says Raymond Quinlan, Chairman and CEO, Sallie Mae. “It’s gratifying to see families are borrowing responsibly and making efforts to reduce costs. In an effort to move that

California Latino Advocates File Civil Rights Claim over Medi-Cal By Desert Star Staff California is violating the civil rights of Latinos by underfunding Medi-Cal, the state’s health-care program for low-income families and the disabled, according to a complaint filed in federal court this week. In the complaint, a coalition of Latino advocates argued that Medi-Cal reimbursement rates are so low that many doctors refuse to take it, which impedes access to health care. Catha Worthman, an attorney on the case, said the fact that almost two-thirds of Medi-Cal recipients are Latino makes this a civil rights issue that violates the equal protection

clause of the Affordable Care Act. “You have a system that has been created which is separate and unequal in health care,” said Worthman, a partner with Feinberg, Jackson, Worthman and Wasow. “Access is inferior in Medi-Cal compared to the general population and the law requires that it be equal.” One of the plaintiffs is a Los Angeles woman, Analilia Jimenez Perea, whose son has cerebral palsy. She said they had to wait a year and a half to find a neurologist who accepts MediCal. Right now, Worthman said, the Golden State only reimburses doctors who treat Medi-Cal

patients about half of what the state pays for treating seniors on Medicare. “We’re seeking very particular remedies, which include raising the reimbursement rates,” she said. “So. while the case charges discrimination, the remedies would benefit everybody on Medi-Cal.” The complaint does not speculate how much it would cost California to raise reimbursement rates enough to convince more doctors to take Medi-Cal. The Office of Civil Rights, part of the federal Department of Health and Human Services, is expected to open an investigation

What to Know about Tuberculosis Testing for Your Children

By Desert Star Staff Tuberculosis (TB) is a serious, highly contagious disease that kills about 1.5 million people each year worldwide and has become the world’s leading infectious disease killer, according to a new report from the World Health Organization. TB usually begins as a latent infection, which can be silent for weeks, months or years before developing into an active contagious disease characterized by chronic cough, fever, unexplained weight loss, night sweats and coughing up blood. With this in mind, regular testing for the early stage of TB infection is important, especially in children whose immune systems are not fully developed and thereby have a higher risk of it progressing into an active and possibly deadly disease. However, “inaccurate,” “time-consuming” and “outdated” are the three terms

most often used to describe the 110-year-old TB skin test, which is the most commonly used test to aid in the diagnosis of the infection. The TB skin test requires an injection of antigens to see how the patient’s body reacts, multiple doctors’ visits and can result in false positives, especially in those who have been vaccinated for TB in the past. Luckily another option for the detection of TB infection -- a TB Blood Test -- is now being offered and represents a major scientific advance over its predecessor, giving greater accuracy and a more dependable result. Reliable results from the TB Blood Test can be obtained within 24 hours and provided by telephone, offering the convenience of a single visit, www.TheTBBloodTest.com. and confidence in an objective, As a parent or caretaker, laboratory-based result. Oil flaring at a plant in Bakersfield. A new report finds millions of acres of public land in the West are tied up in unused oil and gas land leases. (Chris Jordan-Block/Earthjustice) By Desert Star Staff SACRAMENTO, Calif. – Oil and gas companies are stockpiling leases on public land in California, sometimes for many years, without developing it – or

6

paying rent on it – according to a report out today from the Wilderness Society. The authors say that’s a problem because the land can’t be leased to another company

or used for anything else to benefit the public. Nada Culver, senior director for agency policy with The Wilderness Society, says taxpayers are losing out on $80 million, just in rental fees on suspended leases across the West. “That doesn’t look at what could have been generated in royalties, if those were developed oil and gas, rent and other payments if they were developed for wind or solar, or the benefit to local communities, and outfitters and others, if they were managed for recreation or conservation,” she points out. The report says California has more than 22,000 acres tied up in undeveloped leases, but the problem is much bigger, 3.25 million acres, in at least 1,000 suspended leases nationwide. Culver says short-term December 23, 2015

suspensions on leases are legitimate for an environmental review or a drilling permit that’s been unavoidably delayed. But the report found that companies are improperly stockpiling unused leases, and the Bureau of Land Management (BLM) isn’t stopping them. “Unfortunately, there is no mechanism really, for ensuring that those suspensions end,” she says. “We saw numerous

situations where the reasons for the suspension ended, but the suspension didn’t end – often for years and years and years. And some, they still haven’t ended at all.” The report calls on the federal government to do an investigation and asks the BLM to review any long-term suspended leases.

The group’s cover of Laura Nyro’s “Wedding Bell Blues,” featuring Marilyn’s prominent vocals, topped the Hot 100 charts in 1969. Other chart toppers included “One Less Bell to Answer,” “Stoned Soul Picnic,” “Last Night (I Didn’t Get to Sleep At All,” among others.

After more than a decade with The 5th Dimension, Marilyn and Billy decided to leave the group and establish themselves as a duo. They had immediate success with the #1 single, “You Don’t Have to be a Star (To Be in My Show),” which earned them their 7th Grammy Award for Best R&B Vocal Performance by a Duo or Group. Among their many honors as a duo, they received the Grand Prize at the Tokyo Music Festival. They have also enjoyed solo pursuits. For five years, Marilyn hosted the groundbreaking, worldwide television music series “Solid Gold,” which featured the top recording artists of the time. BY: John Fensterwald Republican legislators are continuing to push for passage of three California teacher reform bills, but it’s unclear what the status of the bills will be when the Legislature convenes in January. The Assembly Education Committee spent three hours discussing the bills last week, with no indication about whether the bills might come up for a vote next year. That lack of clarity frustrated the Assembly Republican leader and sponsor of one of the bills, Kristin Olsen, R-Modesto, who questioned why the majority of Democrats on the committee had voted to send the bills to “interim study,” a parliamentary tactic sometimes used when members don’t want to go on the record on controversial legislation. Interim study is an indefinite status that gives Education Committee Chairman Patrick O’Donnell, D-Long Beach, wide discretion to determine what, if anything, happens to a bill. “In an effort to avoid casting ‘no’ votes on these worthy, important bills, the chairman and other members of this education committee invoked

an obscure procedure that sent these bills to this interim study,” Olsen said. “And it truly saddens me that here we are, two weeks before Christmas, when people are out busy preparing for the holidays, that we’re holding a hearing when nobody is paying attention.” The hearing was webcast but sparsely attended by the public; two of four Democrats on the committee were absent. Assembly Republicans proposed the three bills as a package in response to the 2014 ruling in Vergara v. California, in which a Los Angeles County Superior Court judge overturned five California teacher protection statutes. Judge Rolf Treu ruled that the state’s two-year probationary period for new teachers, a layoff system based on teacher seniority and dismissal statutes that can make it difficult to fire the worst performing teachers, violated students’ constitutional right to an equal education. Democrats in the Legislature are letting the lawsuit, now before the State Court of Appeal, run its course. The Republican sponsors called on legislators to fix laws that

Treu said are harming children. They expressed willingness last week to work with Democrats on amendments to their bills. Assembly Bill 1248, authored by Assemblyman Rocky Chavez, R-Oceanside, would extend the probationary period to three years. A teacher would have to receive three consecutive positive reviews before receiving “permanent status” or tenure, which grants additional legal protections to new teachers.

Republicans keep pressing for tenure, layoff, and evaluation reforms

AB 1044, by Assemblywoman Catharine Baker, R-Dublin, would repeal the “last-in-first-out” statute that requires all teacher layoffs, with exceptions for teachers with specialized training or those who fill high-needs jobs, to be based on seniority. Districts would negotiate new criteria with their teachers unions. Seniority could be a factor, but a “significant” component must be based on a teacher’s evaluation rating. Olsen’s bill, AB 1078, would

update the 40-year-old law on teacher evaluations, the Stull Act. Democratic and Republican legislators generally agree it needs changes to reflect new challenges, such as the use of technology, new approaches to discipline and the substantial growth in the number of English learners, although after several years and multiple versions of bills they have yet to agree on how.

FILM ‘STAR WARS: The Force Awakens’ BY THEDA KLEINHANS REICHMAN

Thirty eight years ago, in 1977, George Lucas transported us all to a Galaxy far, far away inhabited by Jedi knights, Obi wan Kanobi, Yoda, the formidable force of evil Darth Vader, Luke Skywalker, his sister Princess Leia and the lovable Han Solo who captivated us with his bravado and sense of humor. To date there have been six films celebrating the strong forces of Good versus Evil and now, after a ten year wait, “Star Wars” returns to the big screen. The long awaited sequel, “The Force Awakens,” directed and co-written by J.J. Abrams, reunites many of our old galaxy friends with a new generation of characters who will lead this beloved franchise into the future. Abrams was only 11 years old when he saw the first “Star Wars” film, but even at that tender age, he was struck by the film’s powerful messages. For him then, and now, the Star Wars saga was about love and

the power of good versus evil. According to Abrams, “The heart and soul of each film is the love of family, related or not. It is also about discovery, alliances, loyalty and friendship” He continued, “The heart of Star Wars is not just about action, it’s not just about core design or space ships, it’s about the hearts of the individual characters, and anyone who knows and cares about Star Wars will agree with that. The stories are thrilling because you love the characters.” Abrams’ sequel opens with the familiar onscreen crawl stating “A long time ago in a galaxy far, far away...” Following the written update we find ourselves on the desolate planet Jakku where crack Resistance pilot Poe Dameron (Oscar Isaac) is conversing with Lor San Tekka (Max von Sydow) who gives Poe a map device that will help him find the last living Jedi, Luke Skywalker, who has

gone missing. Suddenly Kylo Ren (Adam Driver). A conflicted Darth Vader wannabe, lands on Jakku with an army of Storm Troopers. They too want to find Skywalker. In the bloody battle that follows, Poe is captured and taken to the planet ruled by the First Order, which has replaced the evil Empire of the past. Fortunately for the Resistance forces, Poe is able to place the map inside his adorable roly-poly droid, BB-8. He tells the frantic little droid to hide, assuring BB-8 that he will eventually return. In the meantime, the droid must stay out of trouble. In his screenplay, co-written with Lawrence Kasdan (“The Return of the Jedi”) Abrams introduces us to the feisty, very capable female heroine, Rey (British actress Daisy Ridley), a Jakku scavenger who earns money by selling scrap metal. She is befriended by Finn (John Boyega), a Storm Trooper with a conscience who has deserted

Pegasus 21 annual Riders Awards Luncheon

Story and Photos by Pat Krause Pegasus Therapeutic Riding presented its 21st annual Riders Awards Luncheon on Sunday Dec. 13th at the Renaissance Esmeralda Emerald Ballroom. It took the large ballroom to accommodate the over 700 people attending. This is the largest gathering of people at the awards luncheon. They broke records in attendance and monies raised. Vendors selling items made by the clients of Pegasus were a big hit. Regina McGrath had a booth, Reggies Rack, selling many of her jewelry at an inexpensive price and a few designer clothes and all money raised went to Pegasus. What a novel idea and she was very busy selling. Dan McGrath was the emcee and Alicia Gomez translated everything into Spanish for those attending. The stage was set with a beautiful Christmas tree and a ramp for those clients in wheelchairs to come on stage to get their medal. The first, starting at 6 PM and presented by LIVE Magazine put the spotlight on Boo 2 Bullying, founded by Dimitri Halkidis, at Elena Bulatova Fine Art Gallery. The event benefited art therapy

This football season: Turn up your tailgate

Whether watching at home or at the stadium, big games provide ample opportunities for entertaining and nothing brings friends together like grilled dishes, flavorful sides and delicious drinks. For many, watching the game is only half the experience. The tailgate is the main event and www.desertstarweekly.com

the fun and rivalry it brings is just as important as watching the game. Just as players work hard to prepare football formations, fans are just as focused on preparations for the big party. When it comes to planning your tailgate menu, grilled fare is always a winning choice. While beer has historically reigned supreme as the game day beverage pairing, more fans are looking to mix things up. Here are some tailgate pairings sure

to score big with guests at your next game day celebration: * Beef: Classic selections such as juicy ribs and hamburgers are common fixtures on many tailgating menus. Try creating your own marinades with ingredients like honey, sweet chili sauce, ground ginger or Creole seasoning. December 23, 2015

Put a personal spin on classic hamburgers by serving them with interesting toppings like cherry chutney, smoky chili or creamy beer cheese. For side options, consider slow-cooked baked beans, j a l a p e n o cornbread muffins or crunchy slaw tossed with a f re s h l e m o n dressing. Bring out the richness of red meats with a glass of Yellow Tail Big Bold Red, which serves up flavors of dark fruits, a hint of spice and bold oak notes. * Chicken: Whether its wings or sandwiches, chicken is typically on the game day menu, but that doesn’t have to mean boring. Add some extra zing to everyone’s favorite white

meat with a spicy curry rub or Asian-inspired marinade blend. Serve these dishes with a side of cucumber or cold pasta tossed with roasted red pepper, mozzarella and cherry tomatoes. Not sure of a beverage selection? Pair your poultry with a sweet moscato or bottled sangria. * Seafood: Some fans may need a break from the fried foods that grace the tailgate spread. Give guests the option of lighter fare with grilled seafood entrees such as salmon filets with avocado relish or grilled tequila-lime shrimp skewers. As a side, pair your favorite seafood selections with easy-to-grill veggies like corn, zucchini and yellow squash. Refresh your palate with a glass of crisp white wine such as Yellow Tail Pinot Grigio, which features refreshing green apple and pear flavors. Whether celebrating at home or away, remember you can still impress your tailgating teammates with a championship-worthy spread. Leave the competition in the dust by putting your own spin on some grilled favorites, and you’re sure to be the game day MVP. For more entertaining ideas, visit yellowtailwine.com. Family Features

Following the singing and hand clapping, Paul, the head pastor well played by Andrew Garman, takes center stage and begins his sermon, which lasts about one-half hour – seriously, one-half-hour. With his microphone in hand, he moves around the stage whipping the long cord out of his way. He talks about the growth of his congregation, which started out with just a few parishioners and today there are 3,000 members. Pastor Paul has something very important on his mind and

after a while says, “There is a crack in the foundation of this church.” He tells the story of a young boy who goes into a burning building to save his sister. The boy winds up dying from the burns and a missionary comments that it’s too bad the boy was not a Christian as he was not eligible to get into heaven and therefore was doomed to an eternity in hell. So even though this young child acted without thought to his own safety, his reward for heroism was being sent to hell for being a non-believer. Apparently, those comments caused Pastor Paul to experience an ephinany and while seated on his toilet, he hears the voice of God tell him there is no hell. Now for Christians, who live a good life with the expectation they will be transported to heaven, hell has a big meaning as in that’s not place to spend eternity. An organ recital comes at the end of this long sermon, followed by a rebuttal from Joshua, the associate pastor, passionately played by Larry Powell. He challenges the notion that there is no hell and refers to passages in the bible, which Paul points out don’t actually say hell, and could have other meanings.

Joshua insists that Paul is going against God’s word and wants the congregation to cast their vote on staying or leaving the church. Their preference is scribbled on a piece of paper placed in the collection plate and out of the huge congregation, only fifty people choose to leave. So, the pastor wins by a majority vote. Joshua decides to leave that particular church, as he can’t abide by Paul’s new direction. By removing the notion of hell, the pastor has really upset the liturgical apple cart and the ramifications will follow over the course of time. If there is no threat of hell, what will motivate people to live good lives? While it looks like the remaining congregation will accept the pastor’s new beliefs, all is not well. His wife Elizabeth, ably played by Linda Powell, is not happy at the turn of events. They met on a flight from California to Florida. Paul saw her walk down the aisle and was immediately smitten with the lady in pink. He sent her a note delivered by one of the stewardesses and the rest is history. Elizabeth is appalled at her husband’s new ideas and is not sure she wants to stay with him. However, she

Pastor Paul (Andrew Garman) agonizes over trying to justify his beliefs. Photo by Craig Schwartz ultimately agrees to stay, but says she will continue conducting her Bible Study classes, teaching the accepted tradition of the devil and his hell. You know how someone starts with a compliment only to give you the old one-two punch? Jay, a church elder appropriately played by Philip Kerr, delivers such a punch. He starts out by complimenting Paul on his new path, but after a while tells him that the church misses Joshua and wants Paul to consider taking him back saying, “Did you have to be so quick in letting him go?” Speaking on behalf of the board of directors, he voices their concern about the schism in the church and are fearful that more people will leave, “What good is a church that no one goes to.” Jenny, a young church congregant is particularly disturbed and asks Paul if Hitler would go to heaven. She also wants to know if someone killed her son, would the murderer go to heaven? Paul answers yes on both counts. Jenny says, “That’s really hard to swallow.” She is also suspicious that his new revelation came the day after the building has been fully paid for, questioning his timing as being self-serving. Joshua reappears confessing that his own mother didn’t share his beliefs and he feared that she went straight to hell and was sad that he would never see her again. He begs Paul to show him that hell doesn’t exist to which Paul replies, “You can’t show the absence of something.” All does not end the way this rogue pastor wants and one is left with some serious questions.

At the top of the play, I found myself scribbling a note saying “is this really a play?” as it was a long sermon that one could hear in any church. As far as the direction by Les Waters, the staging was acceptable but the use of microphones, with their long, dragging cords throughout the entire play, became redundant. Even when the characters were sitting side by side and talking to each other, they held their microphones, which didn’t make any theatrical sense. There was also the use of a “narrator” occasionally who would comment on the next action. This was way out of place and totally out of character with the rest of the narrative. I suppose the bottom line is that this is not a well-written play but more an evening of diatribe. Perhaps Mr. Hnath used this play as way to sort out his own religious conflicts, but that’s only conjecture on my part. At one point, as I said earlier, Jenny, after hearing that even Hitler would go to heaven, says, “That’s really hard to swallow,” which encompasses my sentiments about the entire production. Arkansas massacre of more than 60 dogs By Desert Star Staff A gruesome discovery has been made in rural Arkansas: Some 60 dogs were brought to a tract of land, poisoned with sleeping pills and shot. Nearly all of the canines died. Six survivors had to be euthanized because their wounds were too severe to overcome. Two men from a lumber mill were looking at timber tracts in a remote forest area off Arkansas 254 in the Chimes-Trace Ridge Area south of Marshall. Instead, they saw a disturbing sight: Scores of dead dogs scattered throughout the woods, KYTV reported. The men notified the Arkansas Game and Fish Commission on Thursday, who then brought in the Searcy County Sheriff’s Office, Sheriff Joey Pruitt told the Harrison Daily Times. A total of 56 dead dogs were found; one more was shot and wounded had to be put down by a game warden. There was no hope of saving the dog that had to be euthanized because of its injuries, John Magruder, the shelter manager for the Searcy County Humane Society, told KYTV. “I don’t really have any words

for what it makes me feel like. I’ve worked with dogs all my life and I love them a whole bunch and I just don’t deal well with this, but I’m doing my best so I can save the ones I can,” he said. By Monday, five more dogs had to be euthanized because of severe injuries, Jean Passmore, the Humane Society treasurer, told the NBC affiliate. The canines were fed hot dogs laced with sleeping pills before they were gunned down, she added. Magruder managed to rescue four dogs from the forest, bringing them back to the Humane Society. “We caught these two little female dogs. We brought them in this morning. This dog in here has been shot,” he said over the weekend, referring to a male with a bullet hole in his shoulder that is already beginning to heal. Three of the four rescued survivors were skittish and difficult to catch, but one little guy came right to Magruder, eager for love, he told KYTV. “He saw us, and that I had a bag of treats, and he took a treat and he was in the truck [immediately]. He said, ‘I’ve had enough of this’,” Magruder said.

“Who could hurt him? Why would you hurt him?” Three days after the massacre was discovered, there were two more dogs who needed to be rescued. Magruder was trying to lure them with food. One, a female, was still too skittish to approach the food, KYTV reported. Instead, she lurked in the woods, remaining close to the massacre site, which is only accessible by a logging road. The surviving six dogs were fairly healthy and not necessarily aggressive, but not extremely friendly either, Pruitt told the Harrison Daily Times. “They could have found homes for these dogs. Why? Just why?” Jean Passmore, the Humane Society treasurer, told KYTV. The sheriff believes someone brought the dogs to the forest, fed them poison and opened fire. “Systematically just start shooting and just leaving them lying and not even making sure that they’re dead. I just can’t imagine somebody doing that,” he told KYTV. “This is my first in 25 years of law enforcement. I’ve never seen anything like this.” The sheriff and state

investigators have recovered some evidence from the massive crime scene, but they’re still processing it. The remains were found in two areas, a couple of hundred yards apart, Pruitt told the Washington Post. “Those dogs were more scattered out into the wooded area,” he said. “The first bunch were just all ‒ I won’t say they were in a pile ‒ but they were all just there close together.” None of the dogs had collars or name tags, and they could have been on the uninhabited property for two or three days, the sheriff told KATV. Investigators, including some from the Arkansas State Police, are unsure if the dogs were from Searcy County or another location. They could have been hauled in already dead, Pruitt told the Post, and disposed of in the woods. Authorities have no suspects or leads so far. “Just right now, you know, my thought is it was probably someone that was maybe rescuing dogs or some sort of rescue operation that probably just ran out of funds and couldn’t feed them,” Pruitt told the Post. “I

don’t know. I don’t think it’s some kind of organization that’s going around stealing people’s pets. Most of the dogs appeared to be in good health. There were a few that appeared to be malnourished. But for the most part, they were healthy-looking dogs.” Although a dog rescue operation was shut down in Searcy County a few years ago, Pruitt believes the suspect in that case had moved on from the area, he told the Harrison Daily Times. “Right now, I’m going to say we don’t have any leads that have checked out,” he said Friday evening. The Searcy County Humane Society needs donations to help cover medical costs and maintenance of the shelter, Magruder and Passmore told KYTV. The person or people responsible for the gruesome massacre could face felony charges, Pruitt told the NBC affiliate, asking for any tips. Anyone with information that may be helpful to the investigation has been asked to call the Searcy County Sheriff’s Department at (870) 448-2340.

You should also be aware that the lien being auctioned off may be a junior lien. If you are the highest bidder at the auction, you are or may be responsible for paying off all liens senior to the lien being auctioned off, before you can receive clear title to the property. You are encouraged to investigate the existence, priority, and size of outstanding liens that may exist on this property by contacting the county recorder’s office or a title insurance company, either of which may charge you a fee for this information. If you consult either of these resources, you should be aware that the same lender may hold more than one mortgage or deed of trust on the property. NOTICE TO PROPERTY OWNER: The sale date shown on this notice of sale may be postponed one or more times by the mortgagee, beneficiary, trustee, or a court, pursuant to Section 2924g of the California Civil Code. The law requires that information about trustee sale postponements be made available to you and to the public, as a courtesy to those not present at the sale. If you wish to learn whether your sale date has been postponed, and, if applicable, the rescheduled time and date for the sale of this property, you may visit this Internet Web site www.hoalaw.com/foreclosureinfo for information regarding the sale of this property, using the file/TS number assigned to this case: 1492P450-001101. Information about postponements that are very short in duration or that occur close in time to the scheduled sale may not immediately be reflected in the telephone information or on the Internet Web site. The best way to verify postponement information is to attend the scheduled sale. More Women in Prison Bad for Families, Communities

Experts say an increasing incarceration rate for women is having negative effects on their families and communities. (Lauren J/freeimages.com). By Desert Star Staff NEW YORK – Women are the fastest growing segment of the U.S. prison population with their numbers rising steadily for three decades. The American Civil Liberties Union attributes the trend partly to the war on drugs and incarceration of nonviolent offenders, which describes more than 80 percent of the female prison population in New York. Amy Fettig, senior staff counsel with the ACLU’s National

Prison Project (NPP), says poor mental health can be a pathway to prison, and many women end up in jail because they lack mental health resources. Fettig says these trends have been detrimental to the communities and children of these women, both in the state and nationally. “They tend to do worse in school,” she states. “They have behavioral problems, and research is making connections between parental incarceration

and the subsequent incarceration of children. “Taking the primary caretaker away from a child at a critical point in their development has negative outcomes both for the child and the family, but also for the community at large.” More than 40 percent of women in New York prisons reported having a serious mental illness in 2007 research. Fettig says it isn’t only women of color who are affected by the criminal justice system.

More white women also are being sentenced, in part because of the methamphetamine and opioid epidemics. The majority of women in state prisons are mentally ill, according to the Justice Department, and many have experienced physical or sexual trauma. Soffiyah Elijah, executive director of the Correctional Association of New York, says a new model is needed to address dysfunctional behavior in society, particularly in communities of color. “A disproportionate number of black and Latino women who are incarcerated in New York state, we find that similarly across most of the country,” she explains. “And the communities from which they come, the services they provide – as far as being caretakers as far as being economic pillars – all of that is diminished.” The advocacy group The Sentencing Project says the number of women in prison has risen at nearly double the rate of men since 1985. Currently, more than 1 million are under some type of supervision by the criminal justice system.

1 dead, 37 injured as woman plows into crowd

By Desert Star Staff Over 30 people were run over in Las Vegas when a woman drove her car into a crowd opposite the luxurious Paris Hotel. Police say at least one person has died and four are in critical condition. The driver has been detained and the motive is being probed. The incident took place on Las Vegas Boulevard in front of the Paris Hotel & Casino and Planet Hollywood. The woman had a 3-year-old in the car with her. Las Vegas police said that the crash might have been “intentional” and that the investigation into the incident is continuing. A Metro Police spokesperson has confirmed that one person was killed and 37 people were injured, including four critically. The driver was detained on site and is currently being interviewed and tested for impairment, the spokesperson told reporters. Police are still not aware of a motive or cause for the incident and is investigating “all possibilities.” Police said the street has been closed to traffic in both directions between Flamingo and Harmon Roads. At least seven people are in critical condition, said Peter Boffelli, of the Las Vegas Metropolitan Police Department. “This is a huge tragedy that occurred on our strip,” Boffelli said. Initial reports claimed were more than 20 victims. However, it was not immediately clear if the victims were dead or alive,

Reports are saying that she tried to flee the scene, but was detained by police and are currently undergoing sobriety test. Palm Springs launches 27th International Film Festival

Cate Blanchette By Jack Lyons Theatre and Film Critic When the Holiday season arrives in December that sends a signal that the 27th Palm Springs International Film Festival (PSIFF) can’t be far off. In fact, the 27th PSIFF kicks off its screenings of approximately 175 films beginning Friday, January 1, 2016 and runs through to January 11, 2016. The city of Palm Springs girds itself every year for an invasion of 135,000 plus festival movie fanatics and film junkies. Movie fans travel from far and wide to spend their time in movie theatre seats, restaurants, and favorite watering holes hoping to catch sight of actors, directors, producers, writers, and anyone connected with the movie industry. The Palm Springs International Film Festival is one of the largest film festivals in North America and treats its attendees to some of the finest in new and celebrated international feature films and documentaries during the eleven day event. The festival is also known for its annual Black Tie Awards

Gala, honoring the best achievements in movie-making and performances of the year by a celebrated list of creative talents who in recent years, have included Ben Affleck, Javier Bardem, Cate Blanchett, Sandra Bullock, Bradley Cooper, George Clooney, Daniel-Day Lewis, Leonardo DiCaprio, Clint Eastwood, Tom Hanks, Matthew McConaughey, Julianne Moore, Brad Pitt, Eddie Redmayne, Julia Roberts, David O. Russell, Meryl Streep, and Reese Witherspoon. According to Film Festival Chairman Harold Matzner, this year’s festival will honor: Cate Blanchett and Johnny Depp respectively, with the Desert Palm Achievement Awards. Blanchett for her work in two films, “Carol” and “Truth”. Depp for his work in “Black Mass”. Rooney Mara is receiving the Spotlight Award for her performance in “Carol”. Alicia Vikander receives the Rising Star Award for her work in “The Danish Girl”, and for her mesmerizing performance in “Ex Machina”. Michael Fassbender and Saoirse Ronan are to receive the International Star Awards.

Fassbender for his role as Steve Jobs and Ronan for her bold turn in “Brooklyn”. Brie Larson is receiving the Breakthrough Performance Award for her work in the film “Room”. Film Director Tom McCarty is being honored with and will receive the Sonny Bono Visionary Award, and the Chairman’s Award for 2016 is being awarded to Matt Damon for his body of work that includes his recent role in “The Martian” (these are the honorees at the time we went to press). Every year I put the same question to Festival Director Darryl Macdonald. How do you and the festival continue

to top last year’s outrageously successful event? His reply is always preceded by a sincere smile. “Hard work by a ton of people that includes staff, supporters, and volunteers. And you can throw in a little luck in the bargain, adding “Just like the movies we present, it’s a collaborative effort”. Jokingly, I ask if he’s made any ‘rest and rehab-following-the-festival’ reservations? The management team is usually sleep-deprived by the end of the festival. Macdonald shoots me that enigmatic smile again … and we move on. The eleven day festival will be exciting, hectic, crowded,

rewarding and worth all the effort on the part of the over five hundred volunteers required to stage it and the theatre patrons and ticket-holders who can’t wait for the 2016 Festival to begin, and who are already and eagerly looking forward for the 2017 festival to arrive. Now that’s what I call loyal festival fans. For Box Office and general ticket information or for various festival Pass/Badge options call the Festival Office Monday through Friday, 9 am through 5 pm at 800-898-7256 or 760778-8979. Tickets go very fast for this festival so don’t delay. See you at the festival.
