And it was like my dream gown. And I loved it. And I obsessed over it. And I wore it. And it was beautiful,” recalled Gerrad-Hedlund. Now a wife and motherto-be, she went to Alfred Angelo in Riverside to have the dress preserved in celebration of her third wedding anniversary. “They took my dress and they took my money and they
told me it would be preserved and this kind of fiasco fell apart,” explained GerradHedlund. “I’m trying my best to kind of keep it together. “I’m stressed out and any stress that i feel is really bad for my baby but its just so heartbreaking because I love my dress and I don’t know if I’ll ever be able to see it again.” When KMIR News attempted to contact Alfred Angelo, the number had been disconnected. interest development may wish to consider the following tips to enhance chances of a successful proposal. Begin by checking the CC&Rs and association rules. Is the change the kind which requires association permission? Planned development associations are usually mainly concerned with changes to home exteriors or landscaping. However, condominium associations present the additional important issue: Is it common area? Common area in condominiums is typically more than most homeowners understand – it is usually defined by the recorded Condominium Plan as everything behind the paint on the walls and ceilings, and the floor under the carpeting. So, in condominiums, changing interior doorways or interior walls may be a change to common area, requiring association permission. Check the association’s architectural and landscaping rules – Do not waste time proposing something outside
the approved landscaping or color schemes. Homeowners who decide to follow the bad advice that “it is better to ask forgiveness than permission” can create a disaster. One example is the 2010 ruling of Clear Lake Riviera v. Cramer. In that case a homeowner built a two-story home, despite CC&Rs limiting homes to single story. The HOA sued, and the homeowner was ultimately required by the court to dismantle the second story and return the house to a single level. Furthermore, associations successfully suing to enforce the governing documents will normally also receive awards of attorney fees against the homeowner (Civil Code 5975(c)). Review the association’s written architectural modification policies. Civil Code 4765 requires associations to have a fair and reasonable written policy which is distributed annually. Applications should be complete. Include copies of product information,
measurements, sketches, and a full description of the proposed modification so the association can understand the proposal. If the work requires a contractor, provide the contractor’s licensing, workers compensation and liability insurance information. Assure the association that any necessary city permits will be obtained and that work will occur only during business hours and not on weekends. Discuss the proposal with nearby neighbors. Many associations require that neighbors be notified, in case of any neighbor objection to the proposal. Make sure the proposal is consistent with the community’s architecture, both as to style and color. Individuality and creativity don’t work well in associations, for which visual harmony and consistency are key values. If the association denies the application, that denial must include an explanation of the reasons, pursuant to Civil Code 4765(a)(4). Denials may be based upon
reasonable but subjective factors in the association standards, under the appellate court’s 2000 ruling in DolanKing v Rancho Santa Fe. Sometimes association responses will impose conditions or suggestions by which the proposal might be modified and accepted. Associations protect all neighbors, including you, by denying alterations deviating from the community’s esthetic scheme. It may be a creative, artistic and even beautiful idea, but if it doesn’t fit, it isn’t neighborly. The next creative idea might be your neighbor’s proposed purple garage!
By Janice Gough Index funds currently depict market sentiment. Index funds have recently gained popularity since actively managed funds haven’t been able to capture investors’ return expectations. An index fund is a type of fund with a portfolio constructed to match or track the components of a market index, such as the Standard & Poor’s 500 Index (S&P 500). An index mutual fund is said to provide broad market exposure, low operating expenses and low portfolio turnover. They are considered to be passively managed. They provide investors with broad market exposure, low operating expenses, and low portfolio turnover. The biggest benefit is that they are less expensive than actively managed funds. For investors with no interest in the market, they are easier to understand and track, over owning bonds or actively managed mutual funds. If you simply put all your savings into an S&P 500 index fund month-after-month for your entire working life, they will beat inflation and will grow your capital. If you save enough – especially early on in your career – you will have enough to retire on using an S&P 500 index fund and nothing else. The market forecast of a pending correction along with the implementation of The Department of Labor (DOL) Fiduciary Rule has caused many advisors and investors to move
money from active management funds to passive management. The DOL rule places impartial conduct standards on financial advisors requiring they always act in their clients’ best interests. That means finding the best investment fund possible, while the older, “suitability standard” required only finding an acceptable option for an investor’s given risk tolerance. The best option, in terms that academic studies have confirmed, is generally the low-cost one. And the lowestcost funds are index ones. In anticipation of the rule change, assets have flocked to index funds, driven by the cultural shift in the financial advisory community. Flows out of actively managed U.S. equity mutual funds leaped to $264.5 billion in 2016, while flows into passive index funds and ETFs were $236.1 billion, according to data provided by Morningstar, an investment research and investment management firm. That was the greatest calendaryear asset change in the last decade, during which more than $1 trillion has shifted from active to passive U.S. equity funds. Yet money is still flowing in the wrong direction. In the first two months of 2017, active U.S. equity funds lost $30 billion, while passive gained $60 billion. Although the rule may be amended, it will not change the ongoing shift in the advisory model. For some time, financial advisers have been shifting from a commission-based structure to a fee-based structure. In other words, while in the past advisors might receive a 5 percent
commission on the sale of a popular active fund, now they work on a percentage of assets under management, usually 1 percent for a traditional financial planner. As that 1 percent fee is ongoing, as opposed to a onetime commission, buying cheap index funds to go with it makes the financial advice affordable

A new report says almost 70 percent of Arizonans live in counties plagued by a double whammy of high ragweed pollen count and excessive ozone days - the 7th worst in the nation for these issues. Researchers from the Natural Resources Defense Council said that’s a big problem for the 490,000
adults and 177,000 children with asthma in the Grand Canyon State. Study author Kim Knowlton, a scientist with the NRDC and a professor at Colombia, called on lawmakers to create an effective climate action plan to combat the problem at its source. “Supporting state and national initiatives to reduce carbon pollution is going to pull us back from the brink of more of these
effects in the future and more and more air pollution challenges,” Knowlton said. The research shows that ozone and ragweed are a significant problem around Phoenix, Prescott and Flagstaff, while Tucson and Yuma battle the smog but not the pollen. The study said that rising temperatures fueled by climate change speed up ozone production. Carbon dioxide, a greenhouse gas,
helps ragweed flourish, while additional hot days mean more pollen over a longer period of time. Knowlton said there are steps people can take to reduce exposure to the allergens. “And if it’s a really high pollen day, save your outdoor activity for a day later in the week when conditions are better,” she suggested. “When you come indoors, you can take a damp
washcloth and towel off your hair, launder your clothes so that you’re not breathing the pollen indoors as well.” Nationwide, the report found that 127 million Americans, or 40 percent of the population, live in counties plagued by ozone and ragweed. Hearing Wednesday on Spread of High-Power Cell Towers
By Desert Star Staff SACRAMENTO, Calif. – Health advocates worried about the impact of wireless radiation are planning a show of force at a hearing tomorrow in Sacramento - on a bill that would smooth the way for telecom companies to put 5G and other cellular technology in neighborhoods across the state. Senate Bill 649 would mean companies would no longer need a local permit for the boxes. Sandy Maurer, the director of the EMF Safety Network, says the technology requires a cell site every few hundred feet - with equipment the size of a refrigerator - on tens of thousands of utility poles and in street-side boxes. “So in 2018 you could awake to a cell tower right outside your bedroom window,” she says. “And over-the-counter permits would eliminate local review and essentially deregulate the telecommunications industry. Overriding any and all environmental laws.”
Last March, researchers from the National Toxicology Program released partial study results showing that rats exposed to 2G wireless radiation developed tumors on the brain and heart. The Cellular Technology Industry Association, which sponsored the bill, insists that there is no proven link to cancer and says the equipment complies with FCC regulations. The bill already has passed the state Senate and goes before the Assembly Committee on Communications and Conveyance at 1:30 P.M. tomorrow. Ellen Marks, director of the California Brain Tumor Association, says other studies have linked wireless radiation to brain tumors, leukemia and electromagnetic sensitivity, which causes tinnitus, heart palpitations and migraine headaches. She believes that state lawmakers are willing to quash dissent - having been won over by promises of superfast internet connectivity.
By Desert Star Staff SEATTLE -- This week, the Consumer Financial Protection Bureau announced a rule that consumer groups say is a big win for Americans who want to settle corporate wrongdoing in court. The rule bans companies from using forced-arbitration clauses in order to avoid lawsuits, meaning consumers can once again band together in class action suits. Members of Congress already are looking to dismantle the rule. But Larry Shannon, government affairs director at the Washington State Association for Justice, said the rule is necessary. “This rule restores consumer protection,” Shannon said. “It ensures real accountability for these companies and it acts as a deterrent to keep them from engaging in this kind of behavior in the first place.”
Shannon used the example of a cell phone company in Washington that was taking a $35 fee without explanation. A single consumer would have a hard time justifying paying thousands of dollars in legal fees to recoup the money. But a class action lawsuit would make the case more affordable. Opponents of the rule say arbitration is a cheaper and faster way for consumers to get justice. Shannon said forced arbitration clauses also keep cases out of court, making it harder to identify bad actors. A scandal at Wells Fargo involving the opening of fake accounts last year highlighted the need for this rule. In that case, consumers were blocked from suing the bank because of a forced arbitration clause in their contracts. Shannon said nursing homes use these clauses

By Desert Star Staff LONDON, -- Is it possible to make a solid wood bathtub out of a single 3000-kilogram (6600lbs) mass of wood, that didn’t contain glue or epoxy? More importantly, can this be done in a sustainable manner? The general consensus is you can’t even make a kitchen cabinet out of solid wood let alone a nearly 6-feet diameter bathtub. By Desert Star Staff Michelin North America, in partnership with FIA, the world governing body for motorsports and global leader in road-safety advocacy, today announced the achievement of a historic milestone for teen-driving safety in the United States: For the first time, administrators in all 50 states have committed to include consistent information about tire safety in state-mandated training materials for new drivers. Crashes remain the No. 1 killer of teens in America1, with recent federal safety data showing an alarming 12 percent of crashes2 involving inexperienced drivers attributed to improper tire maintenance. Michelin and FIA launched the award-winning program “Beyond the Driving Test” in late 2014 aiming to persuade trafficsafety regulators in every state to include information about tread depth and tire pressure in their mandatory training materials for teen drivers. ‘Spider-Man: Homecoming’--A Young Spider vs A Fierce Vulture
Teenaged Peter Parker is back on screen in the latest Marvel installment “SpiderMan: Homecoming.” In past films, he’s been played by Tobey Maguire and most recently by Andrew Garfield (“Hacksaw Ridge” and “Silence’). This time Tom Holland is the teen-aged arachnid in the bright-red suit who tracks down villains in his Queens neighborhood. His big dream, however, is to join Tony Stark’s team of Avengers. At present, he is still in training with Stark, but attends High School full time. None of his classmates know his special identity, except for his friend Ned (Jacob Batalon) who would love to let them all know that he is SpiderMan’s best bud, but Peter has sworn him to silence. Soon Peter will cross paths with Adrian Toomes, known to his group as the Vulture, played to perfection by Michael Keaton. Toomes, a construction worker, was hired to clean up the radioactive debris left on earth after an alien spaceship crash-landed in New York. In the middle of the clean-up a government
spokesperson (Tyne Daly) informs him that he, and his crew have been replaced by Tony Stark’s company. The sudden dismissal after he spent large amounts of his own money on equipment leaves Toomes bitter, angry and lethal. He secretly removes as much alien debris as possible and uses it to create super weapons that he sells to gangsters in the area. When Spider-Man thwarts an arm’s sale in the area, he finds himself face to face with Toomes’ men. Eventually, he also comes face to face with Toomes. At this point, he is way in over his head, but he wants to handle it to prove to Stark that he his ready to be a full-time member of the Avenger’s team. His sleuthing also gets in the way when it comes to being on his school’s scholastic team competing in Washington, D.C. He misses the competition meet in his efforts to get Toomes, but before he goes after Toomes he realizes he must save his classmates trapped in a rapidly descending Washington Monument elevator. Will he be able to
save them? To get inside he must scale the towering monument in a frantic race against time. That scene is great as he leaps and claws his way to the top. Soon his efforts to thwart Toomes get in the way of his school life. It even affects the school prom even though he is able to snag a date with the older girl of his dreams. What really works in this fast-paced Marvel comics’ tale is Michael Keaton’s performance as Toomes. He is the most sympathetic
villain in any of the SpiderMan films. On the dark side, he is a formidable enemy, but he is also a devoted family man who is doing all of this to protect his family from financial ruin. Despite what he’s done, you can’t help liking the guy on certain levels. And when he flies around in his vulture gear and wings you sense a sly wink to his performance as “Birdman.” While there is action and suspense, we also get to see the frustrations of being a high school kid, even if
you are also Spider-Man (But nobody knows it.) Gwyneth Paltrow makes a small cameo at the end of the film and Jon Favreau plays Happy Hogan who, along with Tony Stark, serves as a mentor to Peter. Don’t leave before the credits end because there is a clever cameo by Chris Evans, as Captain America. “Spider-Man: Homecoming” is rated PG-13 for sci-fi violence and some language. Running time is 2 hours and 13 minute.
The problem occurs when the engine starter is blocked due to engine or transmission damage. pre-notice reimbursement to owners since all involved vehicles remain covered under the vehicle’s New Vehicle Limited Warranty.” Benz owners can check if their vehicles are affected by entering their vehicle identification number (VIN) on either the Mercedes or the National Highway Traffic Safety Administration (NHTSA) websites. The company will begin notifying customers of the recall before the end of the month and again when replacement parts are available, beginning in July. Labor Advocates Lament Lack of Protections in New Foreign-Worker Visas
By Desert Star Staff SACRAMENTO, Calif. – Criticism is coming in from worker’s-rights groups on the Trump administration’s announcement Monday that it will allow an additional 15,000 foreign workers to get visas. The Department of Homeland Security will grant the extra H-2B visas for guest workers in the tourism, landscaping, construction, seafood and other seasonal industries - but not in agriculture, which uses a different visa program. Daniel Costa, director of Immigration Law and Policy Research at the Economic Policy Institute, a nonprofit think tank, says the program ought to be reformed to protect workers from abuse, not expanded. “The way the program is set up, it ties workers to one employer,” he says. “So if they leave that job or if they get fired, they basically lose that visa status and become deportable. And so it gives employers a

lot of power over workers.” The Trump administration says it simply is trying to accommodate requests from employers who are desperate for laborers. The current limit for H-2B visas is 66,000 - so this will bring that number up to 81,000. In a recent report, Costa found there is no nationwide shortage of workers in those fields. In fact, unemployment has been high and wages have been flat in these types of jobs for more than a decade. He argues that expanding the cap on visas will hurt conditions for guest workers and American citizens alike. “U.S. workers have to compete with workers who are exploitable and can be legally underpaid under the terms of the H-2B program,” he adds. “And so that puts downward pressure on the wages and the working conditions of the U.S. workers who are in those same jobs.”

California bill would require cops to release body cam video

(AP) - Police video recordings can’t help with public oversight of law enforcement agencies if they are kept secret, a California legislative panel decided Tuesday. State lawmakers advanced legislation that would require law enforcement agencies to generally release body camera video and recordings of fatal police shootings and other significant incidents. But it’s still a long way from final legislative approval. “Public oversight is not possible if the videos are never released to the public,” American Civil Liberties Union lobbyist Lizzie Buchen testified in favor of the measure. The proposal comes amid a nationwide push for body camera recordings to be released quicker after fatal police shootings. It would establish a statewide policy on when body camera footage and other audio and video recordings should be released. The state Senate’s Public Safety Committee advanced Assembly Bill 748 on a 7-2 party line vote, with Republicans opposed. It is expected to be considered by two more Senate committees before it could go to the full Senate and then the Assembly. It would amend California’s
public records statute to limit the discretion that police departments have for withholding body camera videos. The proposed measure would require police departments to release video in cases where law enforcement officers use force or in incidents where it’s believed there is a violation of law or public policy. However, it would allow law enforcement agencies to withhold recordings if they can demonstrate that the public interest in disclosure is outweighed by other factors. They could also blur or redact certain images to protect citizens’ privacy. California News Publishers Association attorney Nikki Moore told the committee that the measure “strikes that balance in protecting privacy.” But more than a dozen law enforcement organizations oppose what California State Sheriffs’ Association lobbyist Cory Salzillo called a “one-size-fits-all” policy. He and other opponents said it should be left to local police departments to determine when, if ever, body camera footage should be released. There should at least be more flexibility on when videos must be released and what images can be redacted or blurred to protect investigations, said Randy Perry, a lobbyist for the Peace Officers Research
Association of California. State lawmakers have failed to pass a handful of bills in the last few years that addressed body-worn video, including establishing policies on when officers should turn their cameras on and off and when the public would have access to videos. The Los Angeles Police Department is among several California departments that deny the disclosure of body camera videos and consider the footage to be investigative records that are exempt from the state’s open records law. Assemblyman Phil Ting said the state currently has “a patchwork of policies and in some instances, very little policy” on releasing recordings. “Body cameras were created to improve greater
public trust between law enforcement and community members and without access to that video footage we’re not really able to achieve those goals,” the San Francisco Democrat said in an interview. Ting noted his bill allows police departments to withhold videos if there’s more of a public interest in not disclosing the recordings and to withhold recordings that are part of an ongoing investigation for up to 120 days. He amended the bill from the original 90day release deadline and said other changes are likely as negotiations continue. “This is an area where California law really lags behind the rest of the country in allowing transparency,” said Peter Bibring, the director of policing practices at the

The committee also advanced AB284 that would require Attorney General Xavier Becerra to study law enforcement agencies’ use of deadly force during 2015 and 2016 and make recommendations for reducing the toll. Becerra, who supports the bill, said his office’s analysis would “go beyond the snapshot that we often see on the news” and “take a close look at the nature and circumstances leading up to the shooting.” He said the study would be the nation’s first such statewide evaluation of officer-involved shootings. “We’re going to figure out how and whether future incidents like these can be prevented,” Becerra said.

By Desert Star Staff A man has been handed a 16 year jail term for killing 21 cats in California. He also faced an allegation of sexually abusing a dead cat. Robert Roy Farmer, 26, was sentenced at Santa Clara County Superior Court, Friday, after pleading guilty last year to 21 felony counts of animal cruelty and one count each of misdemeanor battery and being under the influence. The cats began vanishing from San Jose’s Cambrian
Park neighborhood in September 2015 and were later found dead, according to the Mercury News.That month, police received home surveillance footage of a white man luring a cat from its owner’s residence before grabbing the feline and running away. The footage prompted police to carry out “follow up investigations” into the pet’s abduction. On October 8 2015, Famer, the son of a retired San Jose Police Department
captain, was found sleeping inside his car at a Home Depot parking lot. Police searched the car and found a dead cat “concealed within the vehicle”, according to a statement on Farmer’s arrest. Chunks of fur and streaks of blood covered the interior of the vehicle. Police also found a backpack with a pair of fur-covered gloves and a hunting knife in a sheath. During the court case, a necropsy report from Animal Services documenting
signs of sexual abuse on the dead cat inside the car, including dilated genitals, was presented as evidence. Crime laboratory reports also stated a match was discovered between Farmer and DNA found under claw clippings. Farmer’s attorney denied the prosecution’s argument that the cat was sexually abused. The conflicting accounts triggered a debate about whether Farmer should be
required to register as a sex offender upon release from prison, reported the Mercury News. The judge did not make it a requirement for the defendant to register as a sex offender on release, stating that the prosecution’s arguments “did not meet that burden” for such an order. However he ordered him to stay away from cats for 10 years after his release and from the locality where he committed the offenses.

La Jolla Playhouse Stages Fuzzy Headed Dramedy “At The Old Place”
Heidi Armbruster as “Angie” Photo by Jim Carmody By Jack Lyons Theatre and Film Critic It appears that the famous North Carolina novelist and writer Thomas Wolfe, was correct in his observation about ‘one not being able to go home again’. I’ve often mused over the verity of that phrase. However, after seeing a production of “At the Old Place” at the prestigious La Jolla Playhouse, by playwright Rachel Bonds, I’m of the mind that perhaps, there are reasons why even biblical prophets were not honored in their hometowns. It’s possible that the people didn’t understand what the storytellers were saying. Ms. Bonds’ dramedy/ nostalgia piece, directed by Jaime Castenada, leaves one perplexed even to the point of what is this playwright trying to tell us about the four characters she has created for this play? What are we supposed know about them in order to engage with them and their reasons for being onstage? After all, the idea behind writing a play, movie, or book is to communicate the author’s the ideas and feeling with one’s readers, viewers, or live audiences. N’est-ce pas? In “At the Old Place”, the story, set in rural Richmond, Virginia, centers around Angie (Heidi Armbruster) who is trying to come to grips with any guilt and closure that occurs following the death of her mother and the unrequited issues that linger and eventually fall to her for resolution. One unfinished piece of business that takes her back is the sale of her mother’s house. Children usually see life and family events through a different lens than adults. When adults finally do ‘go home again’ either to grieve, or handle the estate as in Angie’s case, we often bring our old family memories and our old baggage with us. Angie returns to the home to check on final details on the selling of the house, only to find two young people drinking and snacking in her front yard. one lives there because the For Sale sign has no Sold banner across its front. Twenty three year-old Will (Marcel Spears) and potty-mouth eighteen yearold Jolene (Brenna Coates) are non-threatening, but resent having been asked to leave what they have come accept as their hangout. A fourth character Harrison (Benim Foster) turns up later in the play, to become the only ‘adult sounding’ person in room. It’s not very clear where this very thin storyline - where nothing happens or anything of substance takes place - is going and the banal dialogue that is spoken doesn’t provide any indication either. To make matters worse the set design by Lauren Helpern, doesn’t do the cast any favors by placing the house way up stage center, to the effect that a great deal of the dialogue is lost to the audience. Director Castenada is complicit here. Why didn’t he and his designer merely move the house closer to the audience? The blocking would remain the same, but at least the audience would able to hear the dialogue, which at times is swallowed or mumbled so low by Angie and Will in their exchanges that it becomes a chore just trying to remain focused on the action taking place on stage. Jolene, on the other hand, has the vocal power to drown out everyone on stage. Her excitable, potty-mouthed dialogue that the teenagers of today love to deliver at warp speed is full of expletives – I stopped counting the F-Bombs that Jolene hurls from the stage at fifty plus, in the first 15 minutes of the play – robs the audience from staying engaged. I don’t care that this is how some teenagers speak these days. It’s offputting; making the audience tune out when expletive-driven dialogue and story points made, go on ad nauseam. Have today’s playwrights given up the trusty old Thesaurus as a means for coming up with synonyms? It makes one

Back in the Roman days some playwrights wrote for their own pleasure, not to be performed by actors, it was called ‘closet drama’. It was a format that never caught on… I mentioned earlier that Harrison (Benim Foster) appears to be the only adult in the play, however, even he cannot (in only a few on stage moments) bring any clarity to this 89 minute, no intermission, theatrical adventure. My
disappointment is with the playwright and the director both of whom have credits galore. The actors and the technical team very rarely disappoint, despite the narrative text. This time I’m afraid the dark and murky side carries the day. One might ask out loud: What were they thinking? The creative team led by Castenada has a set design by the above mentioned designer Lauren Helpern, with
lights by Lap Chi Chu, and sound by Melanie Chen. “At the Old Place”, performs in the Mandell Weiss Forum and runs through July 30, 2017. The La Jolla Playhouse is one of the country’s leading Regional theatres. Congratulations go to Artistic Director Chris Ashley and the Playhouse on winning a 2017 Tony Award for his splendid direction of the musical “Come From Away”.
