By KMIR News Staff CABAZON, Ca. -The recent installation of five gates in the center median of Interstate 10 in the critical choke point in San Gorgonio Pass will alleviate total traffic congestion during emergencies, a county supervisor said today. The gates would provide an access way for California Highway Patrol officers to funnel traffic into opposing lanes between Banning and Palm Springs during a traffic jam on the freeway. It would also provide a way to get around fatality investigations or other closures on the freeway

Selecting Legal Council when Accidents Occur By Janice Gough On June 5th, a fatal death accident occurred on Palm Drive in Desert Hot Springs. The victim, Marie Soto Caballeros, was traveling south to go visit her family in Mexico. This was the reason for her getting an early start that fateful morning. The driver who hit her car head on was critically injured, killing Maria Soto Caballeros’s and seriously injuring her passengers. According to police, the driver who hit Caballeros was clearly at fault and charged accordingly. Having worked as a Casualty agent for years, I wish to discuss what things one should consider when

any accident happens. Until the insurance coverage and limits of coverage are verified, it is advisable to find out this information first before signing an agreement with an attorney. An attorney may charge a set fee for handling the case for you, or he could charge you 30 percent of the amount awarded. It is to your advantage to have all the information and understand the amount of work the attorney will need to do before signing on the dotted line. If your case may have an unclear decision to who is at fault, it may be wise to go with an attorney, as he will bring more leverage with the insurance carrier and provide a greater settlement. Towing is an extreme measure which perhaps should be considered a last resort with respect to driveway misuse. A board might first consider holding a disciplinary hearing and fining the member. If towing is to be pursued, make sure the HOA complies with the Vehicle Code towing requirements in Section 22658. The status of the driveway apron depends on the condominium plan (if it’s a condo) or subdivision map (if it’s a planned development). Dear Mr. Richardson: In our CC&R’S and rules we have complete and precise parking regulations. Many feel that they are not being enforced properly. If a resident’s vehicles will fit in the garage, as required by the regulations but they park on their driveway is the association able to legally tow off of the driveway said vehicles after proper notification? Not all townhomes have driveways so this would only be subject to those that do. Is the driveway apron considered common property or exclusive use common area? Will that determine whether a vehicle in violation can be towed? Is the association responsible for its care and maintenance? T.G., Mission Viejo

Dear W.S.: Rule changes, parking or otherwise, must be adopted in compliance with Civil Code 4360, which requires 30 days advance written notice before the board can approve it. However, if the rule change “merely repeats existing …governing documents” language, then Civil 4355(b)(5) exempts the change from the 30 day requirement. My impression Dear S. Nothing has been decided about the proposal, or about three other alternate bypass routes, but the project could carry a price tag of between $50 to $80 million over a three year construction period, depending on what route is selected, Salama said. In this book author John Izzo interviews 250 people selected by their friends and relatives as having lived exceptionally happy and meaningful lives. In a concluding chapter that I reviewed last week, those interviewed were asked to share in their own words their secret to a fulfilling and happy life in one sentence or less. Latest Gadgets Available for Visually Impaired

By Gitzel Puente RANCHO MIRAGE, Ca.Connection Pointe at the Braille Institute in Rancho Mirage offers free instruction of the latest technology to the blind and visually impaired. “I wouldn’t be able to function half as well as I am otherwise,” said Kay Knepp, a student at the center, “Probably very few people in my life ever think of me as having visual problems because I just slip the technology in and use it.” Knepp has macular degeneration, her central vision is slowly getting worse. She said the center is helping her learn to cope with her eye disorder by using available tools. “I use the CCTV which is a magnifier, but I also use a computer, and I particularly use a software called Zoomtext,” explained Knepp. Zoomtext in addition to the CCTV at the center helps magnify words on a screen, making it easier for

the students to read. “With the small amount of vision I do have, I can read and I can still be able to get the understanding of the article,” shared James Cox, who was diagnosed with glaucoma. So from students with low vision to no vision at all, Connection Pointe helps people stay connected to the world around them. “It’s really taking everything people take for granted and letting them go into the world and letting them do it themselves,” said Patricia Russell, the institute’s Low Vision Rehabilitation Specialist. She added they even travel within Riverside, San Bernardino and Imperial counties to teach the visually impaired how to use the newest devices. ‘The Lego Movie’ Now on DVD I must confess, when it comes to films about toys, my all-time favorites are the “Toy Story” trilogy, three movies about the secret life of toys when no one is around to see them in action. Toys like Woody and Buzz light year, the cowboy and space hero figures, captured my fantasy and heart, but then I am from a generation prior to the Lego phenomenon. Designed in Denmark, these little plastic building blocks can create cities and all sorts of stuff in the right hands. The purists follow the directions while others become like master builders who use the colorful plastic bits and pieces to make their own Lego universe. This concept is part of the plot in Warner Bros. “The Lego Movie,” now available on DVD. Warner Bros. Producer Dan Lin and writer-directors Phil Lord and Chris Miller (“Cloudy With a Chance of Meatballs” and “21 Jump Street”) were able to convince the Lego corporate heads to green light their movie, not an easy thing to do since the Danish corporation is very protective of the Lego image. The result is a sweet, funny and gentle spoof that pokes fun at over-regulation and conformity. The film-makers also assembled a fine and varied voice cast. Lord Business/President Business and The Man Upstairs (Will Farrell) is the man who wants all things done according to plan. One of his employees, a yellow Lego construction worker named Emmet (Chris Pratt), follows a rigid

routine and is happy doing so as he sings the film’s theme song “Everything is Awesome,” which is how my young neighbors Zane (10) and Gracie (8) described their movie experience. I am almost certain my nephew Michael and his son Steven felt the same way since both grew up mastering Lego building skills. In fact, Steven, who couldn’t read at the time, could construct a Lego castle by just looking at the diagrams. Quite a feat. The ubiquitous Liam Neeson also has a prominent part in the film

as the good cop/bad cop. With a spin of his yellow plastic head, he can either be on your side—or not. There is also a secret weapon that can halt a Lego in its tracks known as Kragle, which made me think of another movie starring Neeson, who uttered the film’s most memorable line—”Release the Krackon!” What is Kragle? Well, you’ll find out when you and the kids see “The Lego Movie.” Morgan Freeman’s Lego character Vitruvious looks like a blind biblical figure decked out

in white plastic. He hands down a prophecy that a Special One will come and save the Master Builders who want to design a more fanciful place than the evil President Business will permit... Things get complicated for the very simple, yellow fellow Emmet when he meets a cool motorcycle riding gal named Wyldstyle (Elizabeth Banks) who mistakes him for “The Special.” He falls for her when she tosses her black plastic hair around which is funny since all the Lego folk move and act just like a stiff plastic actual

This movie wasn’t my personal cup of tea, but if you are a Lego fan and know all about Lego construction you will love “The Lego Movie” to pieces...and there are millions and millions of bright colorful plastic pieces in this homage to a Lego world. Rated PG for mild action and rude humor. Also out on DVD, the animated Academy Award nominee “Ernest & Celeste,” a delightful tale about a little artist mouse who befriends a grumpy bear named Bernard. Rated PG.

By Desert Star Staff With passenger levels at Palm Springs International Airport continuing to post record highs, up 9.3 percent compared with 2013, popular airline Virgin America has confirmed it will return to Palm Springs Sept. 11 with direct flights to San Francisco and New York. Service was discontinued for the summer months April 28. Virgin America reported its preliminary operational results for May 2014 and the first five months of the year. The airline’s traffic (measured in revenue passenger miles) decreased 0.6 percent on capacity (measured in available seat miles) that was 2.5 percent lower than in the same month in 2013. Load factor was 84.5

percent, up 1.6 points from May 2013. The number of onboard passengers decreased 1.7 percent over the same month last year. The British actor has portrayed the quirky Belgian detective in all 74 episodes of the Christie canon on PBS Masterpiece Mystery series. Now he sheds his Belgian detective costumes for the robes and red hat of a Roman Catholic Cardinal in the powerful drama “the Last Confession”, written by first-time playwright and lawyer Roger Crane. “The Last Confession” is a tale of intrigue, surrounded by mystery, and wrapped in the panoply and ritual of “great theatre” that is the Catholic Church. Lawyerplaywright Crane sets his play not only, inside the Vatican, but squarely inside the Papal chambers where the disagreements and ambitions of the Princes of the Catholic Church come into sharp focus as various factions within the powerful governing body, known as the Curia, continually lobby each other and align themselves with various cliques in an effort to choose the next Pope, and even succeeding Popes.

One doesn’t have to be Catholic to understand the core story. One can easily identify with the various characters because the Curia is structured along the same lines as an American business corporation. The Pope is like the chairman of the Board, and the men who actually write and implement the policy decisions in the day to day running of a worldwide Church are the Pope’s college of cardinals, and in particular, the Curia, the Pope’s inner circle of advisors. In the production currently on the boards of LA’s Music Center’s Ahmanson Theatre, David Suchet portrays Cardinal Giovanni Benelli, a friend and advisor to the recently crowned caretaker Pope John Paul I, the successor to the conservative Pope Paul VI. By KMIR News Staff INDIO, Ca. -A judge in Indio today turned down an attorney’s request to dismiss the case against a man accused in a 2006 triple murder in Pinyon Pines. Cristin Conrad Smith and co-defendant Robert Lars Pape were arrested in March and charged with the Sept. 17, 2006, killings of Vicki Friedli, 53, her boyfriend Jon Hayward, 55, and her 18-year-old daughter, Becky, at their Alpine Drive home. The defendants face three counts of murder, with special circumstance allegations of committing multiple murders and two sentence-enhancing firearm-use allegations. Smith, 25, had two hearings scheduled this morning: a trial-readiness conference and a hearing on a motion to dismiss his case. The trial readiness conference was rescheduled to Aug. 1, and the request to dismiss was turned down. The dismissal motion

filed by Smith’s attorney in April contends there was no reasonable or probable cause to order Smith to stand trial. It also took issue with the prosecution’s evidence and the testimony given at his preliminary hearing. A judge ruled after the March preliminary hearing that there was enough evidence for Smith, who has pleaded not guilty, to proceed to trial. Pape, an ex-boyfriend of Becky Friedli, was indicted by a grand jury, so a preliminary hearing was not required in his case. The 26-year-old Pape has an arraignment and bail hearing scheduled June 27. Firefighters who responded to a blaze at the victims’ home the night of Sept. 17, 2006, found Becky Friedli’s burned body in a wheelbarrow about 70 feet from the house. After firefighters doused the blaze, they found the bodies of Hayward and Vicki Friedli inside the house. Both had been shot. According to testimony and court documents, a cousin

While waiting for police to arrive, someone smashed the car’s window. “If it appeared the dog was under stress, panting heavily I think that I would take the chance and I would go ahead and break the window,” said Temecula resident and dog owner, Melanie Jones. Officers gave the dog’s owner, a woman from Burbank, a $375 citation. Police say a hot car can be a death sentence for a dog. “The normal body temperature for a dog is around 101, 102 degrees and at 108 degrees the dog can suffer brain damage or heat stroke and can die as a result,” said Sgt. Harvey Reed with the Palm Springs Police Department. Temperatures rise very

quickly in a closed vehicle. On just a 90 degree day, if you have the car closed for 20 minutes it will rise 30 degrees so that it’s 120 degrees inside. “I think it should be harsher penalties on people leaving their animals unattended and especially if the temperature is high,” said Jones. However, if you do break someone’s window to rescue a dog you could face charges. “Possible criminal prosecution and civil litigation, however having said that, it is a judgment call,” said Sgt. Reed. Sergeant Harvey Reed said you should first call police or animal control. Even if they faced charges, some pet lovers would still smash a window to save a pet. “I would still do it, absolutely, to save a dogs life,” said Stacey. Coachella Valley – The MLB’s midway point is right around the corner and due to Time Warner Cable and DirecTV’s greedy discord, 25 percent of the Coachella Valley is still unable to watch the Los Angeles Dodgers. In January of 2013, the Dodgers organization decided to sell its broadcast rights to Time Warner Cable for a lump sum of $7 billion. In return, Time Warner Cable received the distribution rights for the next 25 years, meaning all Dodger games will air on Time Warner Cable’s SportsNet LA – a network owned by both the Dodgers and Time Warner Cable. Now, just how DirecTV held out on Time Warner Sports Net – Time Warner Cable’s all-Southern California (but mostly Lakers) channel that DirecTV eventually bought – Time Warner Cable is, once again, at a stalemate with the satellite company that prides itself on offering the best sports packages. A total population of 346,518 in the Coachella Valley means roughly 90,000 Coachella Valley residents with DirecTV are unable to hear “It’s time for Dodger’s baseball” – the famous phrase the Dodgers’ 86-year old hall-of-fame broadcaster, Vin Scully, proudly announces before each game. Dodgers fans only hope the agreement comes sooner rather than later.
