By Elizabeth Beaubien KMIR anchors It’s a murder case that has been cold for over 30 years, three people killed — execution style — at a home in Palm Springs. The investigation spanned at least three continents, and yet, no arrests. One former detective is speaking out about the case, and his hopes that it will eventually be solved. In October 1978, the desert sun had the headline — “grisly triple murder

was “execution style.” Police said it was a “horrific murder scene.” And it was. 3 people murdered, shot in the head, in the early evening hours of October 12, 1978. It was a rather affluent part of Palm Springs in the Las Palmas area. Pool man showed up on Monday or Tuesday. Went into carport and passed by kitchen and saw Mrs. Williams on the floor with blood. He called us, and patrol officers went inside and discovered two other bodies. Fred

Donnel is a retired Palm Springs police detective who worked this triple homicide. The house where the murders occurred was here at 893 Camino Del Sur. The home now looks drastically different; those three people were Sophia and Ed Friendly, and their maid. It’s believed that Mrs. Friendly was the target of the murders. The investigation into the murders pointed detectives to a trust that Sophia Friendly would inherit when her ex-husband passed

When Edith Morrey arrived in Palm Springs, from Oregon in the 1940s she opened a children’s clothes store known as The Little Folks Corttage at the Desert Inn. It was the first footprint she made in the desert. She moved on to open a ‘swanky store in, what at the time was known as Palm Village, lending it her name, Edith Morre (and adding the accent!) That’s 1. Where her story as El Paseo’s First Lady of Fashion began, a fashionably chic journey that took a turn when she retired at age 65 according to her niece, Molly Isaia, who threw a fabulously fashionable birthday luncheon for Aunt Edith on May 5th at Desert

Island Country Club. Surrounded by friends and family, Ms Morrey undaunted by age and attired in a fine print chiffon dress which belied her age (102) she held court accompanied by her precious Pomeranian pup, Angel, who behaved as a princess throughout the afternoon. Seated at a long table strew with vases of flowers, surrounded by the lush 18-hold Desert Island Golf Course, on a perfect spring day, Edith surrounded by friends chatted about her career as, what her friends say, is the desert’s First Lady of Fashion. And as the owner of Edith Morre on El Paseo, her clients included

Mamie Eisenhower, a former First Lady along with film stars such as Alice Fay. As time passed Edith added a few things to her menu, aside from her spacious dressing rooms and fashion shows, and that was time set aside for luncheons. Her popularity as the go to women’s dress store for couture remained intact until her retirement at around age 65, according to her niece, Molly Isaia, and which time Edith took up painting and began yet, another journey. Whilst friends honored Edith for her charm and tenacity, it

away. If she died before him, the million-dollar trust went to their two children. Her ex-husband had terminal cancer, and was on his deathbed at the time she was murdered. Investigators honed in on Ed Hutton, Sophia’s son. And one of his friend’s name was Andreas Christensen. Christiansen was from Denmark, and Palm Springs had put the word abroad and worldwide. They were interested in talking

with him about the Friendly murders. They finally caught up with him when he was caught in Copenhagen robbing a bank. Investigators flew there to interview Christiansen while he was in jail. The entire interview was cat and mouse game. We asked him where he was at a certain time, we could counter and prove he wasn’t there. That kind of game. Christiansen said he had been to Palm Springs,

story and Photos by Pat Krause The Arthur Lyons Film Noir Festival ran from May 8th through May 11th at the Camelot Theatre. Twelve Black and White, dark and thrilling movies, were shown with fans coming from all over the west for this festival to see these rarely shown films. Preservation has kept some of these films in good enough condition to be shown in theatres while other films of that era have been lost forever or there are only a few known copies left to exist. The Film Noir Foundation helps to find and keep these wonderful old films preserved for future generations to enjoy. The Film Noir is in its 15th year and was lucky enough to have some actresses attend that were in the films. Opening night had Barbara Hale, best known from the TV show, Perry Mason, arriving to see the show and participate in a Q&A with Producer and Host, Alan K. Rode. Hale said she had not seen the movie, The Window, in 65 years and wanted to see the film with the fans. The theater was filled with fans who were on the edge of their seats during the movie, The Window. Other actresses scheduled as guest appearances were Nancy Olson, who had a role in Sunset Boulevard and Terry Moore from the movie, Shack Out on 101. Both Olson and Moore held a Q&A after the films. Hosts for the Q&As included Alan K Rode and Eddie Muller. Other celebrities attending were author Victoria Wilson, who wrote, A Life of Barbara Stanwyck, Suzie Lancaster, Wife of actor Burt Lancaster, and Susan Andrews, daughter of Actor Dana Andrews. Victoria Wilson and Author Kate Buford were on hand to autograph copies of their books in the lobby of the Theatre. Many thanks for this Film Noir Festival to go Camelot owners Ric and Rozene Supple, Founders of the Palm Springs Cultural Center, that brings many film festivals to the Desert. The short Film Festival will be coming in June.

Master Counterfeiter Should Wake Up US Authorities By Kevin Powell Last week ABC News reported that a convicted Canadian drug dealer had successfully produced and distributed millions of fake $20 bills that were nearly undetectable to the naked eye. His bills first appeared in Michigan in 2010. This should send chills through the Secret Service. Based on their report, he may have printed up to five pallets of near-perfect counterfeit money. He would sell a million dollars of fake bills for $300,000 to criminal groups. There’s no telling how much phony money he put into circulation, but he said he did it to “screw America.”

There have been counterfeiting rings for decades. Most recently, many of our enemies have threatened to flood the markets with fake US currency. If that were to happen, it could quickly destabilize our financial system leading to mass chaos. North Korea is one of the nations suspected of doing this. Some Middle Eastern countries and the old Soviet Union were thought to be engaged in this style of domestic sabotage. Using fake currency as a weapon is nothing new. During the American Revolution, England flooded our fledgling country with counterfeit continental dollars. During the Civil War, a large percentage of Confederate money was fake. In 1942, the Nazis flooded the British economy with counterfeit money. Even worse they forced Jewish laborers to produce the money, and it was nearly indistinguishable from the real currency. Fortunately, counterfeit money is considerably less of a personal risk to Americans (estimated $220 million in circulation) compared to identity theft ($37 billion) and counterfeit

what I can. First, your time to talk to the board is during open forum. If you are commenting during board deliberations, you were out of order, so it was OK for the president to ignore your remarks. To participate in the board discussions of agenda items, get your neighbors to elect you to the board. Second, the president should never say “like it or leave”. You do not work for the president - you are neighbors. Furthermore, the president is only one vote, and normally has very little actual power. Most decisions and actions require a board vote. If the board voted to table an issue, that is one thing, but the president does not have the discretion to unilaterally table an item - that takes a motion of the board. Finally, discussion of an association newsletter should have been in open session, not closed. Closed session should not be used except for closed session subjects. Thanks, Kelly

Dear M.H.: The law does not require CIDs to have professional management, but it is a very good idea. You have immunity as a volunteer director, but do you want to take on the stress and liability of being a free manager? California does not license managers, so anybody can declare themselves a “management company” or “manager”. Business and Professions Code 11500-11505 in 2002 created the “Certified Common Interest Development Manager” title. To call oneself a “CCIDM” requires 30 hours of instruction from a recognized provider of manager education, such as CAI. Section 11504 requires every management contract indicate whether the manager is “Certified” - This latter requirement is often not followed (indicating the company might not

be current on current California CID/HOA laws). You could hire someone who is less qualified and save money, but why? If someone is “Certified” under this law, they almost certainly also hold a credential from a major manager credentialing organization. A manager’s dedication to the management profession and HOA industry can be a good indicator of their devotion to improving their expertise.. and their service to your HOA. Ask for a credential. By Kelly g. Richardson, Esq. CCal Dear Kelly: I have been very unhappy with my HOA board and have attended three meetings these past three months to see if I could encourage more open communication between the board and the owners. This past meeting, I brought up many landscaping issues. During the discussion of landscaping issues, the president said to me: “Like it or leave.” He hurried along the meeting, ignoring comments that he did not want to hear. I suggested we have a newsletter to inform owners about board decisions and he “tabled” that idea. After I insisted he make a decision, he decided the board would discuss the issue in executive session. It is obvious that this president has his own agenda and hurries through the meeting to get it done, his way. Thank you. P. M., Fallbrook

Two Bunch Palms Resort gets Solar-Powered

Collaboration to enhance environmental stewardship at iconic Palm Springs resort and spa

By desert star staff Palm Springs, Calif. – May 8, 2014 – Pear Energy, clean energy provider, and Two Bunch Palms Spa Resort, located outside of Palm Springs, in the City of Desert Hot Springs have partnered to

create the first carbon-neutral wellness resort in North America. Upon completion, the installation will provide enough renewable energy to offset 100% of Two Bunch Palms’ electric power consumption.

By KMIR News staff Los Angeles, Ca. - UPDATE: The ground stop has been lifted and flights are beginning to return to normal. Palm Springs International tells KMIR News the impact on operations was minimal. Original Story: A ``ground stop’’ has been issued at airports across Southern California, including Palm Springs International, Los Angeles International Airport and John Wayne International in Orange County by the Federal Aviation Administration due to unspecified computer issues,

according to the airport. This means planes are not being allowed to take off. Airport spokeswoman Nancy Castles says the Federal Aviation Administration had put a “ground stop” on departures, but arrivals were still being accepted. Castles wasn’t sure what caused the problem. An FAA spokesman did not immediately respond to a request for comment. Passengers are being advised to check with their airlines about possible delays. Courtesy of KMIR www.kmir.com

“Having the first carbon neutral resort in the United States will be a perfect complement to our city’s world-famous natural, healing hot spring waters,” said City of Desert Hot Springs Mayor Adam Sanchez Sr.

“With Pear Energy’s support, Two Bunch Palms is expanding the definition of wellness for our industry beyond the mind, body and spirit connection to include a broader sustainable philosophy that recognizes the interplay between personal well-being and planetary health,” said Kevin M. Kelly, CEO of Two Bunch Palms. “In practical terms, this sustainable approach is good for business: our power purchase agreement with Pear will reduce our energy costs. This allows us to put those operational savings into future wellness programming to enhance our guest experience.” Tw o B u n c h P a l m s ’ sustainability endeavors also include initiatives dedicated to recycling, water reuse, new energy-efficiency hot-water heaters, windows and doors, and the use of nontoxic waterbased cleaning products and natural materials. “Running a world-class

resort and spa requires a lot of energy, and a serious commitment to sustainability is no easy feat,” said Robert Pollin, president of Pear Energy. “By tackling the financial roadblocks of adopting renewable-energy, Pear can do its part to expand access to be renewable-energy for environmentally-minded organizations. We commend the team at Two Bunch Palms for its commitment to both personal and planetary health.” Construction for the groundmounted system is scheduled to occur simultaneously with Two Bunch Palms’ room renovation in summer and fall 2014. Pear Energy provided financing for the project through a 21-year power purchase agreement (PPA), with Lighthouse Solar managing the installation process. Also power went out for nearly 1,800 people in Palm Desert at 4PM Sunday in the area of Portola Avenue and Frank Sinatra Drive. By 9PM Sunday, all but 28 customers had their power back. SoCal Edison says it was caused by a car hitting a transformer. There was another outage in Palm Desert near Country Club Drive Sunday afternoon. Gas Prices Falling...But Slowly By KMIR News staff RIVERSIDE, Ca. - The average price of a gallon of self-serve regular gasoline in the Inland Empire dropped 1.4 cents today to $4.226, one day after recording its largest daily decrease since Oct. 3, 1.5 cents. The average price in Riverside and San Bernardino counties has dropped for eight consecutive days and is 5.8 cents less than a week ago, according to figures from the AAA and Oil Price Information Service. However, it is 13.7 cents more than one month ago and 27.6 cents higher one year ago. ``Wholesale prices have now dropped to levels that will allow retail pump prices below $4 a gallon,’’ said Jeffrey Spring of the Automobile Club of Southern California. ``We encourage drivers to continue to aggressively shop around for the best gas prices because competition should drive prices lower more quickly.’’ Courtesy of KMIR www.kmir.com

the extremely grave nature of the budget issues, and facing the possibility of municipal bankruptcy,’’ according to a city statement. The deficit was created by ``state money grabs’’ and the economic downturn, according to the statement, which says the city had to spend reserve funds ``just to stay afloat,’’ as well as reduce staff by 66 percent and cut employee compensation by 22 to 35 percent. One of the proposed solutions to generate more revenue is Measure F, a vacant parcel tax on the June 3 ballot that would impose a flat tax rate of $372.68 per acre on all vacant parcels in the city. Last November, the Desert Hot Springs City Council approved a resolution declaring a fiscal emergency, after being told that the city was on track to spend millions more than its expected revenue for the current fiscal year. Interim City Manager Bob Adams warned in a report presented to the council on Nov. 19 that if ``significant action is not taken, the projected depletion of the city’s reserves to meet the city’s financial obligations would cause the city to file bankruptcy.’’ Desert Hot Springs previously filed for bankruptcy in 2001, in the wake of a legal judgment. A fiscal emergency is legally defined as a financial crisis, particularly of a government or public entity. Tonight’s meeting was held at the Carl May Community Center, 11711 West Drive. ‘The Invisible Woman’—A Dickensian Tale

“The Invisible Woman,” now on DVD from Sony Pictures Classics, is based on the book of the same name by Claire Tomalin which details the deep friendship and passion that Dickens shared with a young actress named Ellen Turnan (Felicity Jones). The gifted British actor Ralph Finnes ( “Schindler’s List,“ The Grand Budapest Hotel”) directed the film and also stars as author Charles Dickens. Dickens, considered one of the greatest novelists and writers in the English-speaking world, wrote 15 novels that include the perennial holiday classic “A Christmas Carol” as well as “A Tale of Two Cities,” “Oliver Twist,” “David Copperfield,” “Little Dorrit,” “Great Expectations” and “Bleak House.” His works were so popular in his lifetime that the illiterate poor joined in groups to hire someone to read Dickens’ tales to them aloud since Dickens’ stories first appeared in a serialized form before they were published in the full novel form. This technique was something like books on tape today and brought the author‘s words to the masses. Dickens was not only a

beloved writer in England, Scotland and Wales, but in the U.S.A and Australia as well, and he read aloud from his works on countless tours, which added to his considerable fortune. He was born in 1812, died in 1870 at the age of 58 and he and his wife Catherine Thomson Hogarth had

ten children, but the screenplay by Abi Morgan only deals with Dickens’s later years, focusing on his relationship with the young actress Ellen Turnan. As the film begins we meet Nellie, as she was affectionately called, who is working with a group of young performers who

are about to present a play. The little lion in the piece is played by her son. She seems troubled and distracted, a fact that is noticed by a clergy man at the rehearsal, who offers to counsel her if she would like. We then switch from the present to the not so distant past when Ellen first meets Dickens in 1875. He has hired additional actresses to appear in the play “Frozen Deep” which his protégé and friend Wilke Collins has written. Dickens, who enjoyed acting, will be appearing in the play as well. It is said that Dickens became smitten by the lovely young woman at this time, and his feelings for her lasted until his death. Ellen’s mother(Kristen Scott Thomas), an actress who appeared in plays with her daughters, soon becomes concerned about their possible attraction since this is Victorian England and divorce is not permitted, particularly in the case of anyone as prominent as Charles Dickens. The book, and screenplay, deal with the relationship but history cannot prove if their passion developed far since Dickens did everything possible to protect Ellen. He denies it in the press, which is brought out in the film, and all to prevent any

farther speculation; he burns all of his correspondence, retaining only letters pertaining to his business dealings. In the film, Finnes captures the charm and wit of Dickens, who was like a literary rock star in his day. People read his novels, short stories and essays voraciously and flocked to his appearances. In the film, as in life, we also see how devoted Dickens was to the cause of the poor as he raises money by lecturing and performing on their behalf. The look and style of the film take us back in time to the mid 1800s and give us a chance to see Dickens’ life and times come to life on the screen. In fact, after screening “The Invisible Woman,” my husband and I decided to find out more about Dickens’ personal life by going to Google to learn more. The film, while slow moving and at times introspective, sheds light on the life of a great writer whose works revealed the plight of the poor and helped bring about needed social changes. “The Invisible Woman,” from Sony Pictures Classics, is rated R.

Special Report – Rehab Racket

By KMIR’s angela Monroe Alcohol and drug treatment is booming over here in the valley. In fact, the number of treatment centers here has doubled in only the past two years. While that can mean more treatment options, it also means a greater number

of businesses. Some of these businesses may just be looking to emptying your wallet. In this special report, KMIR’s Angela Monroe tells us how to avoid a rehab rip-off. Alcohol and drug treatment is a life-or-death matter. And its

en vogue right now, but for some treatment facilities... It’s just business. In fact, according to a market research report. It’s an eight billion-dollar industry. However, experts say the most expensive treatment isn’t always the best

treatment. Addiction recovery is hot right now.... it’s gone Hollywood, with shows like celebrity rehabintervention, and sober house... rehabs are even advertising on t-v....some showing their luxurious facilities. “For me its a life-or-death situation and today i want to live my life to the fullest that I can, so I can be there for my family and for my children.” Stacy entered treatment, more than four months later, “I feel great; I feel great. My life has changed tremendously.” According to the CDC, 88,000 people die each year due to excessive alcohol use alone. There were more than 1-point-2 million e-r visits in 2006 for alcohol-related problems and an estimated economic cost of 223 billion dollars. Dr. Harry Haroutunian treats many patients at the Betty Ford Center, “this is a deep-seated disease, a chronic organic disease of the brain. You don’t stop treatment anymore than a diabetic would stop treatment after 3 or four months, it’s for life.” With the huge scope of the problem, the business of recovery is booming, but with that, growth comes the concern, there is lax oversight of the recovery industry. “It’s hard to say how much of it is fraud, and how much of it is just a lack of quality services.” CEO of ABC recovery center David Likens, says health care reform is part of the reason treatment facilities have doubled in the desert in the past two years. “Along with the affordable care act, have made it accessible for people to have treatment paid for not only in a more expansive way, but for longer periods of time.” A large pool, luxury rooms and gym don’t necessarily equal quality care. “Good recovery is not about thread count or a beautiful view. Accommodations should be clean and perfect and comfortable where you can do the work of recovery, but don’t

be misled by all the fancy stuff, the substance of the program is what you’re looking for.” “Some of the worst treatment centers I’ve had the experience of connecting with have been beautiful treatment centers.” Instead, David says it matter more how many of the staff is licensed or certified. He says the state only requires 30 percent. “I find these figures just mind-blowing, the fact that organizations are able to provide services with such minimal actual certified or licensed staff.” Residential treatment centers must be licensed by the state, but not outpatient centers or sober living houses. He says few rehabs go that extra step, instead, David says many facilities spend a lot of money on advertising, looking for that next customer. When that’s the way that business is being done in this industry, and it seems like more and more that’s the way it’s being done, it kind of sours people on the entire industry. And when we’re talking about something as important as addiction, when people’s lives are on the line, people die from this disease all the time. We’re not just talking about a customer in terms of well if they don’t come back, we don’t sell another pizza. We don’t rent another video, if they don’t come back, they may never come back because they may die of this disease.” Both ABC recovery center and Betty Ford have an extra level of accreditation, for their in-patient and out-patient programs. Each one of those programs should have the characteristics of accreditation, patient staff ratio, good qualified medical services available for those issues that may come up, qualified psychiatric and psychological services of course are very important as well.” Larger treatment centers are also expanding... “Like Hazelden, like Betty Ford are expanding outpatient services, you’ll find us expanding to Los Angeles area, possibly to orange county; we have plans to go to San Diego, maybe even Phoenix area.” Likens says overall people should ask questions if they are considering a rehab, or looking into one for a loved one. “The reality is that there are tons of organizations out there those are really excellent organizations providing marvelous service to many people across this state; you almost have to look for that.” “Being born and raised over here in the desert I had heard so much about the ABC Club and coming here and attending meetings, and I’ve been in treatment here before, and I got a lot out of it and precisely the curriculum and the techniques that they teach you here; it is just amazing.” Courtesy of KMIR www.kmir.com

PALM DESERT – In an exciting extra-inning game last Friday, the Palm Springs Indians defeated the Palm Desert Aztecs and find themselves in a threeway tie for second place and only a game behind the La Quinta Blackhawks. After losing to the Aztecs at home last Wednesday, the Indians went to Palm Desert High School prepared to compete and try to stay in the race for the DVL title. Much was on the line for the Aztecs, as well, with next week’s matchup against La Quinta looming Down 3-1 to the Aztecs in the top of the third inning, after a Kaylnn Bedwell infield single and Claresha Clemens walk, the Indians tied the game on a runscoring error and a Genevieve Marruffo sacrifice fly. The Aztecs plated another run in the bottom of the fourth to go up 4-3, but the Indians answered immediately in the fifth inning. Maruffo and Anna Petras each doubled and combined for three RBIs, which gave the Indians the 6-4 lead. Palm Springs trotted its starting pitcher, Samantha Guttierez, back on the mound

to try to close out the win in the seventh inning. Unfortunately for the Indians, Gutierrez was not fooling anyone. Guttierez gave up a Jamiana Gateb double, a Maya Pollard triple and a Shawna Aguerrebere single, and just like that, the Aztecs had tied up the game at 6-6. In extra innings, the Indians overcame the emotional low of blowing the lead in what should have been the last inning. Three consecutive base hits gave way to a Claresha Clemons line drive single up the middle and the Indians took a 7-6 lead. Despite getting pushed around in the seventh inning, Indians head coach Deb Cormier elected to stay with her senior starting pitcher – which ended up being a smart idea. “She came out and had a rough first inning but settled in, and its all about hitting spots, everybody can hit fast pitching these days,” Coach Cormier said. “It’s about hitting spots, moving the ball, changing it up – making those batters really work to get the hits. I think she did a great job, especially in that last inning.” Gutierrez shut down the top of the Aztecs’ lineup in an easy

one-two-three eighth inning before the entire Indians team mobbed Gutierrez in celebration of still having a chance to be crowned league champs.

“We had a rough game on Wednesday,” Coach Cormier said. “We made a lot of mental errors; a lot of fielding errors. You have to come and play against Palm Desert and today (we were) ready.” In an eight-inning, completegame effort, Gutierrez finished with seven strikeouts (two in the ninth). Offensively, Claresha Clemons – the DVL leader in batting average (.560), home runs (7) and RBIs (25) – finished going 2-4 with an RBI, two runs scored and three walks. Gutierrez also helped her cause by getting on base three times including an RBI double in the first inning. By defeating Palm Desert, Palm Springs has become one of three teams (Palm Desert and Coachella Valley Arabs) that are a half-game back of the seventime defending DVL champion La Quinta Blackhawks. Additionally, the Arabs, Aztecs and Indians have not finished higher than third in the last 10+ DVL seasons. With the loss to the Indians, the Aztecs must sweep the dynastic Blackhawks to become league champs outright. Had they won, the Aztecs would have only needed to win one of the two

games against the Blackhawks this week to share the title with the Blackhawks. If Palm Desert does pull off the difficult sweep of the defending champion Blackhawks, and Palm Springs and Coachella Valley sweep their respective series’ this week, the Arabs, Aztecs and Indians will all share the DVL championship. If the Aztecs only win one game against the Blackhawks, the Indians and Arabs must still sweep their upcoming series’ to still share the DVL championship with La Quinta. “It’s interesting,” Coach Cormier said. “This is the first time we’ve been involved in it – which is awesome – but our league has always come down to the last week. It really is pretty crazy but great at the same time. A lot of good softball.” The craziness started Tuesday with Palm Desert at home against La Quinta, and Palm Springs on the road at Cathedral City. Palm Springs finishes its season against Cathedral City at home on Thursday at 3:15 pm. Palm Desert ends its season on Thursday at La Quinta at 6:30 pm.

Supreme Court Rules on Prayer at Civic Meetings

By Emanuela tala Last week, a Supreme Court clearly divided along ideological lines, issued its opinion in Town of Greece, New York v. Galloway, 572 U.S. (2014). Right-leaning swing-vote Justice Kennedy delivered the opinion of the Court for the conservative majority, over Justice Kagan and the liberal minority’s dissent. Beginning in 1999, the town of Greece began its monthly town board meetings with a prayer. All but four of its sessions, all four of which occurred in 2008 after the practice had already caused controversy, were led by Christians, and many involved direct reference to Jesus Christ. Articulating the legal question in the case as “whether the town of Greece, New York, imposes an impermissible establishment of religion by opening its monthly board meetings with a prayer,” the majority answered that it does not. Relying heavily on Marsh v. Chambers, 463 U.S. 783 (1983), Justice Kennedy explained that “Marsh stands for the proposition that it is not necessary to define the precise boundary of the Establishment Clause where history shows that the specific practice is permitted.” And one such instance is prayer prior to a legislative session (legislative prayer). True to the passage quoted above, the opinion provides no “precise boundary” for determining what is and what is not constitutionally allowed.

Apparently allowed is nongeneric and sectarian prayer; in other words, references to Jesus, to Jehova, to Allah, or to any other specific deity are permissible). This, at least, is the most reasonable inference from the majority’s language that wrote, “The contention that legislative prayer must be generic or nonsectarian derives from dictum in County of Allegheny [v. American Civil Liberties Union, Greater Pittsburg Chapter], 492 U.S. 573, that was disputed when written and has been repudiated by later cases.” Apparently not allowed is a public agent or agency’s redaction of a prayer: “Because it is unlikely that prayer will be inclusive beyond dispute, it would be unwise to adopt what respondents think is the nextbest option: permitting those religious words, and only those words, that are acceptable to the majority, even if they will exclude some…. Once it invites prayer into the public sphere, government must permit a prayer giver to address his or her own God or gods as conscience dictates, unfettered by what an administrator or judge considers to be nonsectarian.” Finally, and most importantly, apparently not allowed is a discriminatory policy. Coming closest to a “precise boundary” is the following language, “Absent a pattern of prayers that over time denigrate, proselytize, or betray an impermissible government purpose, a challenge based

solely on the content of a prayer will not likely establish a constitutional violation. Marsh, indeed, requires an inquiry into the prayer opportunity as a whole, rather than into the contents of a single prayer.” As the excerpts above indicate, the majority opinion is at best vague, and at worst uninstructive. But the general standard set by the Supreme Court seems to be that, as long as it comports with tradition, reflects a policy of nondiscrimination (such as by allowing a member of any faith to speak, even though, in practical

effect, members of only one faith actually speak) and is not used to denigrate, proselytize or for an impermissible government purpose, legislative prayer is constitutionally permissible even if it is non-generic and sectarian. Keeping in mind the fact-intensive nature of an establishment analysis, and the fact that a challenge under the California Constitution may be analyzed differently than a challenge under the Federal Constitution, despite the California Supreme Court’s deference to the United States Supreme Court, the constitutional

standard established by the majority opinion undoubtedly condones legislative prayer, as long as it comports with all the requirements above. As such, inviting a Christian minister for an invocation before a legislative session is permitted, even if the minister’s address explicitly includes Christian references, as long as the address is not used to denigrate, proselytize or for an impermissible government purpose, and as long as any person, of any or no religious persuasion, is similarly permitted to deliver an invocation.

Jobs and Grocery Options Coming to Coachella By desert star staff COACHELLA, CA.– Walmart will open a new Walmart Neighborhood Market Wednesday, May 14, after a brief ribbon-cutting ceremony at 7:30 a.m. The new store, approximately one-quarter the size of a Walmart Supercenter, is located at 83053 Avenue 48 in the Jackson Square shopping center and is open 6 a.m. to midnight, seven days a week. The new store will provide local customers with a new, convenient option for their grocery shopping needs, including fresh produce and pharmacy services. “ T h i s n e w Wa l m a r t Neighborhood Market is a welcome addition to our City,” said Coachella Mayor Pro Tem Steve Hernandez. “The store will not only allow our residents to shop for quality groceries at affordable prices, but it will anchor a neighborhood shopping center that has long been without a tenant and help provide much needed tax revenues for our City.” Smaller Store, More Convenience The Walmart Neighborhood Market format offers quick and convenient shopping, with a fullgrocery department, including organic and natural selections. The store features prepared food options, fresh baked breads, self-serve deli and a bakery. The Coachella store is also tailored to the community, offering local favorites and Latino-oriented products. Foods available at the Coachella Neighborhood Market will help further Walmart’s effort to provide families with healthy food options they can afford. In 2011, Walmart committed to make a difference on one of the biggest issues facing American families: how to

put healthier, more affordable food on the dinner table each night. During the first few years of Walmart’s healthier food initiative, the company has made tremendous progress, including saving customers $2.3 billion on fresh fruits and vegetables; providing more than $26 million to support nutrition education programs; and reducing sugar and sodium in Great Value brand products by 10 percent. The pharmacy offers a full range of products and services. Pharmacy team members can answer product and prescription questions and customers can ask about health and wellness solutions. New Store, New Jobs The first Wa l m a r t Neighborhood Market opened in 1998, and today there are approximately 350 Walmart Neighborhood Market stores nationwide. The new store employs up to 65 full- and part-time associates. Walmart provides competitive wages,

along with a high quality benefits program for eligible full- and part-time associates. For example, the company provides a variety of affordable health and well-being benefits, including health care coverage with no lifetime maximum. Walmart also offers matching 401(k) contributions of up to 6 percent, discounts on general merchandise, an Associate Stock Purchase Program and company-paid life insurance. Additionally, associates are eligible to receive a quarterly incentive based on store performance. Store manager Mark Vasquez began his Walmart career in 2012 as an assistant manager. He brings more than 28 years of retail and grocery management experience to the job. “I’m excited to bring this new store and Walmart’s everyday low prices to Coachella. I have spent much of my career in Coachella, and I love this community,” said

Vasquez. “All of our associates have worked hard to prepare for the grand opening, and now we look forward to meeting shoppers.” The grand-opening celebration will include presentations of more than $30,000 in grants from Walmart and the Walmart Foundation to local community groups, including a $25,000 Walmart Foundation grant to FIND Food Bank for its Kids Summer Feeding Program, furthering Walmart’s commitment to hunger relief. FIND Food Bank is the only regional food bank serving eastern Riverside and southern San Bernardino Counties and it distributes 8 to 9 million pounds of food assistance annually to an average 80,000 individuals each month. Other grant recipients include Coachella Valley High School, Boys & Girls Clubs of Coachella Valley and Christ is Salvation Church’s food ministry program. “I am pleased to see how

quickly Walmart has become a community partner,” said Becky Flores Valadez, executive director of the Coachella Chamber of Commerce. “This store marks the beginning of many positive economic and charitable giving benefits for the City.” In addition to the grants given as part of the grand opening, the new store will continue to further Walmart’s pledge to fight hunger in America. As part of Walmart’s and the Walmart Foundation’s $2 billion commitment to fight hunger through 2015, Walmart stores in California donated approximately 10.2 million pounds of food, in fiscal year 2013, or the equivalent of 8.5 million meals. Additionally, Walmart and the Walmart Foundation gave more than $26.3 million in fiscal year 2013 in California alone. the property around it,” Tribal Chairman Jeff L. Grubbe said.” It’s the place where it all began— the site of our natural hot mineral spring. And, for which our Tribe and the City of Palm Springs were named. It has been more than 50 years since we’ve made significant investments in and around this valued cultural resource. They are long overdue. And, the time is now.”

About 150 team members will be affected by the closure. “We are working with our team members to provide resources through this transition,” said CJ Graham, chief operating officer. He said that includes assisting in identifying new employment with other nearby resorts or identifying other opportunities within our organization. “We are hopeful the period of time between this announcement and the closure will allow many team members to make a smooth transition,” Graham said. “We do not enter into this lightly and we are grateful for our team members who have been dedicated to making the hotel and spa a popular Palm Springs destination for our guests. We sincerely appreciate

the longstanding service and dedication by our team members over the decades. They have truly been at the center of operating this legendary downtown destination.” The Tribe’s vision is to continue to invest in its downtown locations and make this site a major anchor for the future of Palm Springs. With the local economy showing signs of recovery, the Tribe is confident that this location will continue to be a cornerstone for Palm Springs visitors for decades to come. “We have a responsibility to respect our environment and play a leadership role in the future of Palm Springs,” Chairman Grubbe said. “We are working to make a positive and lasting difference in our community.”

Olympians Teach Children to Swim in Palm Desert

By KMIR News staff Nine Olympians were on PALM DESERT — The hand to teach kids how to swim second annual Just Add Swim and the importance of water event took place at the Palm safety. Desert Aquatic Center Saturday. It was a great day for a lot

kids to be in the water and get a chance to learn from some of the best swimmers in the world. “We have nine Olympians. Eight-Team USA Olympians, and one international Olympian. We have dozens of life guards who represent thirty Olympic medals, one-hundred eightythree world records and fourteen NCAA titles right here at the aquatic center teaching our community children how to swim,” said Stephen Little, Swim to Win Foundation CEO. Close to two thousand children were at the aquatic center Saturday, with some learning how to swim and putting their head under water for the first time, to other more experienced swimmers looking

forward to learning more. “Ultimately, I guess, it’s just for those who want to learn how to swim; we teach them how to swim. For those who want more of an instructional kind of thing, we do that as well,” said Olympic swimmer, Aaron Peirsol. Aaron says that it was great to see such a big turnout, with so many eager and excited to learn. “It’s madness. It’s controlled madness; it’s beautiful. And, for us, we’re kind’ve been harnessing that. If theirs is a lot of excitement to get in the water, then half of our job is over,” said Peirsol. Along with learning more about swimming, children and

parents are also learning the importance of water safety. “Something’s kids have grown up hearing about these Olympians and certainly the kids on swim teams have grown up looking at these people as champions, and the champions are out today to give back to our community. And, we’re united in giving back. We’re united in making sure that we’re drawing our line in the sand, and the epidemic of preventable drowning deaths and injuries ends right here right now,” said Little. With the success of Saturday’s event, Stephen says that next it will be even bigger. Courtesy of KMIR www.kmir.com

By Jackie Devereaux PALM SPRINGS – The U.S. Supreme Court handed down a historic ruling on Wednesday, Jun. 26 to grant same sex marriages across the nation. In their ruling on DOMA and California’s Proposition 8, the justices overturned a previous lower court ruling which declared same sex marriage unconstitutional. Within minutes of the landmark ruling, local hoteliers and wedding planners scrambled to promote Palm Springs as a premiere wedding destination. “The Supreme Court’s

historic action today overturning DOMA and dismissing the appeal of California’s Proposition 8, clearing the way for same-sex marriage in our state is a huge victory for the LGBT community. This is about equal rights and I am gratified that the court has recognized that we are all the same,” said Palm Springs Mayor Steve Pougnet. “My husband Christopher and I look forward to same-sex weddings commencing again in the state of California – and rest assured the City of Palm Springs will continue to be a destination committed to celebrating the

institution of marriage, both heterosexual and same-sex,” Pougnet said in a prepared statement “Riverside County is prepared to issue marriage licenses to same-sex couples and record their marriages immediately after the anticipated direction is received from the state and the Ninth Circuit Court of Appeals. Hopefully that day will be here soon,” said Supervisor John J. Benoit. “The U.S. Supreme Court has ruled on the matter of Hollingsworth v. Perry, making

Local Men Charged in Vanderbilt Rape Case By Jackie Devereaux PALM DESERT - The attorney for one of the men charged with allegedly tampering with evidence in a Vanderbilt rape case said his client, Joseph Dominick Quinzio, 20, of Palm Desert, received a video of the alleged rape through his phone as a text message. Criminal Defense Attorney Brett Greenfield with the Los Angeles law firm of Kenner and Greenfield admitted that his client, Quinzio, “saw the video

and became very disturbed.” Quinzio, along with Miles Finley, 19, of Bermuda Dunes are friends of Brandon Vandenburg, 20, of Indio. The three young men played football together at Xavier College Preparatory High School in Palm Desert. Vandenburg was arrested for five counts of rape and two counts of sexual battery against an unconscious 21-year-old female Vanderbilt student. Vandenburg is also charged with videotaping the female victim

and passing on those videos to others. The alleged rape and video tapping took place on June 23 in Tennessee. Greenfield said the video was sent to his client. Quinzio and Finley both are charged with tampering with electronic evidence and scheduled to appear in separate courtrooms on Tuesday, Aug. 20 for extradition hearings. “He’s (Quinzio) being accused of somehow tampering with or destroying evidence, and

German son seeks reunion with father By Jackie Devereaux Emin Bernd Alihodic was born on July 21, 1951 in Siegen, Germany and immigrated to the United States sometime in the late 1980s. Alihodic left behind two children and an ex-wife. His son, Jens (Alihodic) Luschnt, 35, came to Palm Springs on Monday, Aug. 12 to search for his biological father with only a

newspaper article describing how his dad was rescued twice off Mount San Jacinto on Feb. 9, 2009 and then again on May 13, 2010. Jens, who speaks little or no English, was adopted by his stepfather at the age of 10 and only knows a little about his biological father from stories his mother told him through the years. “I’d like to know more

about him. How’s he been living all these years,” the younger Alihodic said through a German/ English interpreter. Jens said he started looking for his father about a year and a half ago after meeting the love of his life, Karin Huebers. He and Karin want to start their own family soon and through her urging, they traveled to Palm Springs to search for his biological father. Continues on Page 4

nothing could be further than the truth,” Greenfield said. Nashville, Tennessee Metro police traveled to California in July to interview both Quinzio and Finley about their involvement with the cover up. Greenfield said his client was so disturbed by the video, that he went to the Riverside County Sheriff’s Department on Friday, Aug. 16 and reported everything he knew. “Doing the right thing was what prompted him to go to the sheriff,” Greenfield said, knowing an investigation was going on. Greenfield said only when

Quinzio showed up to talk to investigators did he find out that there was a warrant for his arrest in Tennessee. “He (Quinzio) was simply sent a text message, unwanted, unsolicited, out of the blue, put in a terrible situation by someone who he thought was a friend,” Greenfield said. Quinzio is being held without bail at the Southwest Detention Center. Finley is being held at the Larson Justice Center in Indio without bail and is also expected to appear in court Tuesday.
