Lambert is an American Idol singer who has surpassed some of the Idol winners in his career. Lambert has a fan base that packed the house at The Show. It was a sold-out concert as every seat was filled. As with other concerts, the seats on the main floor were eliminated so fans could stand close to the stage for close-up viewing. Cell phones were
busy trying to get a photo. This concert had a Halloween theme. The stage was darkened, and a light show was part of the concert. Lambert came on stage with their face painted and a massive cape with big shoulders. He wore a large black outfit with many adornments and platform shoes to make his 6 foot 1-inch frame even taller. Two dancers were seen during his show that started in the back and then moved all over the stage.
At one point, he talked to the audience about his love for Halloween. He said that even if he is 40 years old, he loves to dress up like a kid. His costumes showed that. He removed his cape after a couple of songs to show his tattooed arms and vested chest. One of the songs was “Another One Bites the Dust.” His vocal range is something to be admired by all. He spoke about his new song that I loved, showing his lower range and talent as a singer.

Controversy Over Free Speech Roils Berkeley Law School

Pro-Palestinian advocates are speaking out to support student groups at the University of CaliforniaBerkeley Law School who voted not to host Zionist speakers, saying it is a matter of free speech.
In August, Law Students for Justice in Palestine asked other student groups to pledge not to invite speakers who support the Israeli occupation of Palestinian lands, and fourteen out of 100 agreed.
Dylan Saba, staff attorney at Palestine Legal, who is Palestinian and Jewish, said the students’ backlash is unfair and could harm
their future job prospects.
“These students are being smeared in the media left, right, and center,” Saba contended. “I think it’s critical to affirm that these students have the right to do this and to push back against these bad faith attempts to smear this as anti-Semitism.”
The charges of antiSemitism began with an article in the Jewish Journal by Ken Marcus, a former Trump official from the Office of Civil Rights, who claimed Berkeley has established “Jewish free zones.”
Erwin Chemerinsky, dean of the Law School, who is Jewish, called for academic freedom, tolerance, and civility. And wrote in the Daily Beast he would consider sanctions for groups violating “the Law School’s rules ... that no speaker can be excluded for being Jewish or for holding particular views.”
Saba said the bylaw would exclude speakers
based on political expression, not religion. However, he added there’s a double standard regarding groups supporting the boycott, divest, and sanctions
movement, known as BDS.
“A reproductive-justice group would not be expected to host an anti-abortion speaker,” Saba pointed out. “In that same way, groups
committed to Palestinian Liberation should not be expected that they have to host someone who opposes those values.”
Matches Record Low Unemployment

The Clean Water Act turns 50 years old this week, but parts of it are currently under attack in a case before the U.S. Supreme Court. The case could remove protections from some streams and wetlands, making it easier and cheaper to pollute or even eliminate these waterways.
Chanté Coleman, senior vice president for equity and justice at the National Wildlife Federation, said the law was partially motivated by the 1969 Santa Barbara oil spill.
“There weren’t any federal controls on industrial pollution or oil spills,” Coleman explained. “So, many cities dumped largely untreated sewage into the Pacific Ocean or its coastal bays. And the federal government itself dumped 50,000 barrels of radioactive waste into the Pacific Ocean.”
California has strict rules to protect water, but a new report from the National Wildlife Federation said the case, Sackett versus EPA, could allow factories, hog farms, and wastewater plants to pollute waters in other states lacking strong water quality protections.
The report highlights the success in turning Monterey Bay from an ecological disaster caused by pollution and overfishing into a healthy ecosystem and thriving tourist destination and credits the Monterey Bay National Marine Sanctuary. Coleman noted few laws have ever had such a massive impact.
“The Clean Water Act keeps 700 billion pounds of pollutants out of our waters annually,” Coleman reported. “And has slowed the rate of decline of wetland loss and doubled the number of safe waters
for fishing and swimming.”
The report also called on Congress to do more to address agricultural runoff, which is the leading reason bodies of water across the U.S. do not meet water-
quality standards.

No Election, Only Paid Inspectors, and Acclamation

Hello Kelly, our HOA had an election for 2 Board seats, there were 3 candidates. Not enough ballots were returned to make quorum. The quorum percentage decreased over the next few months. Then the current board decided to not even have the ballots counted, and to keep the old board in place. Is this legal? Thanks in advance, WC, Brea. Dear W.C.: If quorum failed, the election failed and there is no election and no counting of ballots. If your bylaws provide for a reduced quorum, then yes, a meeting can be held and votes counted if the procedure
is followed to set an “adjourned meeting” using the lower quorum for the election of directors. However, if the bylaws do not provide for a reduced quorum, the reduced quorum is not met, or the procedure is not followed to set a reduced quorum meeting, then per Corporations Code Section 7220(b) the election fails and the board stays in their seats until the next election (or until resigning). Hopefully, your HOA can attain quorum next time. Best, Kelly
Dear Kelly, at our condo meeting, we were told that the state law has been amended to require associations to adopt election rules and to appoint inspectors of election per Civil Code 5105. We are a small community and have limited funds. The board and manager
discussed the above by stating that they would have to pay a law firm to “inspect our elections” to comply with this law. The way Section 5105 reads, it appears to me that the board can just appoint a trustworthy person to do this job for a small fee. Is this correct? K.L., Carlsbad
Dear K.L.: The legislature massively ramped up HOA election procedures in 2005, and one of those new procedures was requiring all HOAs to have one or three persons act as an “Inspector Of Elections.” This led to the creation of a new business, the professional inspector of elections. However, in addition to a hired professional inspector per Civil Code Section 5110(b) the inspector could be a CPA, volunteer poll worker, notary public, or an
HOA member not a director or candidate or related to a director or candidate. The inspector also cannot be the manager, HOA attorney, or any other current HOA vendor. Smaller HOA boards may be fine by just appointing volunteers as the inspector. Best regards, Kelly.
Kelly: It sounds like the new election by acclamation code section allows for such an election every three years. Is this correct and would a regular election need to be held the other years? C.L., Eureka
Dear C.L.: The election by acclamation statute, Civil Code Section 5103, is new in 2022. Subpart (b) says that one of the requirements for using election by acclamation is that the HOA must have conducted at least one election in the previous
three years. That means that theoretically the HOA could have elections by acclamation three out of four years, but the fourth year must be a regular election with counted ballots. Also, note the other requirements in terms of announcements and timing – to preserve the ability to use election by acclamation, the HOA must start planning its elections six months ahead. Report: Electric Vehicles Jump in Popularity; Prices Leap, Too

from 2021, according to the latest data from the California Energy Commission.
Right now, low-income buyers can get up to $9,500
in grants and rebates.

Froden wristed the puck over the shoulder of netminder Dustin Wolf for his second goal of the season. Coachella Valley extended their lead with a powerplay goal thanks to a Kole Lind blast from the right circle. Lind was set up by Brogan Rafferty and Austin Poganski for his third goal of the season.

The Artist Council Community Exhibition
The Artists Council in Palm Desert held its Juried Artists Council Members Community Exhibition and Sale on October 21st. More than 200 art lovers came to see this exhibition of local artistic talent. Several art pieces were purchased that very night. The first piece of art sold was by the youngest member of the Art Council,
Oscar Solano, for his painting, Grown Man. Sold pieces were marked with a big red dot. The night held refreshments thru local Eight4Nine Fine Catering and Events. The exhibit was held at the Artists Center and Galen’s Gardens.
Patrons walked thru this beautiful art center to see such talented artists in our valley and the art they produce. The show
incorporates all mediums, oil, watercolor, photography, acrylic, and other mixed media. The artists show their creative styles thru all this art. Guests were treated to music by DJ minus at the reception in the back garden area. The jury consisted of Consuelo Montoya and Nicholas Orozco, who chose the winning art and announced it at the end of the evening.
Both jurors are well versed in the field of art from Los Angeles. The emcee was news anchor Joe Smith. The excitement grew as they awaited the results of the winning art.
The winners were announced from the 84 entries. 157 members entered, but only 84 were chosen for this event. Out of the 84, only three awards were given. Eric
H.F. Law for his art, Photo Language Community. The next award winner was Karin Skiba for her piece, Loretta Had 4 Brothers. The last winner was Terry Hastings for his Palm Springs Pool Party artwork. The jurors said it was hard to award only 3 because so many were close to winning. There are over 500 Artists Council members. They provide classes in art. The new classes in November include Mardi Alexis, a two-day Abstract Mixed Media redux: acrylic, oil, cold wax, and collage. Also, Wallace Colvard, Lighting Basics for Artists, Jeni Bates, Painting for Absolute Beginners, and Joe A. Oakes, Heaven Has It. A Class for all who consider painting as a hobby or career.

Officials Call for Windfall Tax on Companies That Overcharge for Gas

Gas prices have soared recently, and local officials are speaking out to support a windfall tax on companies engaging in price gouging.
Gov. Gavin Newsom has called a special legislative session on the topic for Dec. 5.
Eduardo Martinez, vice mayor of the city of Richmond, home to a Chevron refinery, said he supports a windfall tax and a drilling tax similar to one charged by the state of Alaska.
“It’s apparent that this situation is the consequence of the five big oil refiners in California who make 97% of the gasoline - controlling the supply to artificially drive up prices,” Martinez said. “A windfall profits tax solution that takes excessive profits out of the hands of oil corporations and puts money back into the hands of consumers surely deserves a special session.”
In a recent blog post, the Independent Petroleum Association of America wrote the price is determined by supply and demand. In addition, oil-producing countries recently cut production, and several refineries have also gone down for planned maintenance.
Igor Tregub, Elected Official to Protect America and environmental caucus chair for the California Democratic Party, said it still would not account for the large gasoline price spikes in California.
“In 2019, several refineries shut down simultaneously,” Tregub said. “The price spike at that time was a mere 34 cents. So refinery pre-scheduled maintenance is not a credible explanation for the sudden $1.54 increase in what refineries charge for every gallon of gas.”
A recent report from Consumer Watchdog found California consumers paid
$2.61 per gallon higher gas prices than the average U.S. price as of early October.

September, California matched the record low unemployment rate of 3.9% set in July 2022. The state also added jobs for the
twelfth consecutive month and has now recovered 99.1% of the jobs lost to the pandemic-induced recession:
• California’s unemployment rate fell from .2% to 3.9% in September,
matching the state’s recordlow rate and dropping 2.5% from September 2021.
• The state’s job increase from August 2022 was revised upwards by 16,100 jobs to a 36,000-job
gain, followed by a 6,500 job increase in September.
• September was the twelfth consecutive month the state added jobs – Education and Health Services showed the most
significant month-over gains.
• California has recovered 99.1% of the 2,758,900 jobs lost during the February 2020 – April 2020 pandemic-induced recession.
