27th Annual Palm Springs International Film Festival: January 1 - 11, 2016 Story and Photos by Pat Krause The Palm Springs International Film Festival held its opening night on the first day of the New Year. What a great start, to a new year. The opening night film had so many tickets sold that they needed two venues to screen the film. The Palm Springs High School Auditorium

is undergoing remodeling and will not be available until next year. The Camelot and the Annenberg Theatre in the Palm Springs Art Museum held the opening night film. The Red Carpet for VIPs was held at the Annenberg along with the after party. The line for ticket holders at the Camelot stretched a long way.

These 10 directors were picked for their first directorial debut. These 10 are some of the most and newest exciting talented newcomers to the directing field of filmmakers. And Each Director was announced and photographed by the photographers and TV crews who interviewed each new director. The 10 directors included Deniz Gamze Erguvan, Ciro Guerra, Slavek Horak, Duke Johnson, Peter Landesman, Laszio Nemes, Matt Ross and Elizabeth Wood, Don Cheadle and Alex Garland. These 10 were chosen for their contributions to the business of directing films. Variety and Dr. Bennet Omalu presented actor Will Smith with the Creative Impact in Acting Award and presented by Mercedes-Benz. Variety and actor Jack Black presented Charlie Kaufman with the Variety Creative Impact in Directing Award also presented by Mercedes-Benz. Will Smith brought his beautiful wife Jada Pinkett Smith. strategies you can stick with. It’s easy to think you’re good at investing when the market is doing well, and tempting to make changes when it starts to turn around. In between is the reality that the long term planning is the best way to secure your portfolio. Your resolutions should include keeping on track with budgeting and basic financial management. In our experience, people who set goals for themselves and create strategies to pursue them are much more likely to see success. One study found that investors who leveraged specific financial strategies saw greater long-term financial success. paying off debt and create an emergency fund as part of your financial resolutions. As the Fed begins raising rates, 2016 is the year to commit to reducing consumer debt. Here are some other investment ideas to consider. For those who invest in mutual funds, it may be time to consider selling. One indication that it might be time to sell is if you see that a significant inflow or outflow of dollars. Mutual fund managers must stay fully invested within their mandate. So if an investor is in a large growth fund, the manager shouldn’t be investing in cash. On the other hand, an infusion of too much new cash too quickly can pose a real problem for managers trying to find good investments within a fund’s style. I am not an advocate of the frequent buying and selling of mutual funds or any other investment vehicle for that

HOA Homefront – Reader Questions – Recalling Directors By Kelly G. Richardson, Esq. CCAL

Dear Kelly, I am a new director on (our HOA) board. Some of the new directors are very concerned about the condition of our association and possible malfeasance being committed by certain members of our board. I’ve been researching websites regarding impeachment of directors. I cannot find anything relating to the subject and was hoping you could give me some guidance. Sincerely, G. H. San Marcos Dear G. H.: You refer to the process of recall, in which the association members vote to remove directors without cause. In certain occasions, a board can

become so out of step, or an individual director can become such a problem, that the process of recall becomes important. However, recalls are very negative by their nature, and can be very destructive to community relations, regardless of whether they succeed or fail. Some association bylaws disqualify directors for certain reasons, such as missing multiple board meetings, ceasing to be an owner and/or resident, or being delinquent in assessments. Except for such specifically authorized disqualifications, directors may only be removed by a vote of the membership. The recall voting process is the same as electing directors. Ballots must be distributed to all members at least thirty days prior, must be submitted in two different envelopes, and counted by Inspectors of Election. Recall elections can be set by

the board or by a petition of 5% of the members, under Corporations Code 7510(e). Such minimal support is easy to obtain, which is itself a problem, as many recall elections begin without significant support and then fail for lack of quorum, wasting time and money. Recalling individual directors in associations which use cumulative voting is much more complicated. Where less than the full board is the subject of recall vote, Corporations Code 7222(b) (1) protects individual directors by allowing the “no” votes on the recall to be multiplied so that “no” votes are worth more than “yes” votes. There are differing interpretations of this confusing statute as to exactly how much extra weight each “no” vote receives. Ordinary proxies, even if permitted by the HOA, cannot be used on recalls. In HOAs permitting proxies, Corporations

Code 7613(g) requires proxies used in recall to specifically state it includes permission to vote on recall. The board cannot fill vacancies created by recall. Only the membership can do this, under Corporations Code 7224(a). So, if the association sets a recall election, a conditional election of replacement directors should be set for the same election. If the recall fails, the conditional election of replacement directors does not occur. If the recall succeeds, the old board is immediately removed. The recall ballot should include an additional section for conditional election of directors, so the HOA can continue to function. Association vendors, including the manager and attorney, should NEVER support or oppose a recall. That is a violation of their professional ethics. Recalls are ugly business and often fail. When recalls succeed, oftentimes a new board takes over and simply perpetuates the mistakes of the removed board. Consider not only if the community will rally behind a recall effort, but if volunteers are available who will learn how to govern properly and with the proper attitude of service. Medical Marijuana Grows Up in California

By Desert Star Staff LOS ANGELES - California’s medical marijuana industry is growing up fast, so to speak, because a new law professionalizing the growth, sale and taxation of the plant goes into effect on Friday. The California Medical Marijuana Regulation and Safety Act establishes a new state agency, the Bureau of Medical Marijuana Regulation, that will gear up and start issuing permits. Dale Gieringer, director of the California division of the National Organization for the Reform of Marijuana Laws (NORML), says patients eventually will see more dispensaries set up shop. “I think it’s going to result in more access, partly because it does allow for-profit operation,” says Gieringer, “and local governments are going to feel more comfortable with allowing

state-regulated facilities than with unregulated facilities.” Dozens of local municipalities are now moving to either allow or forbid medical marijuana sales within their borders. By some estimates, the state and cities stand to make $1 billion a year in taxes once the industry builds out. Gieringer says the industry has evolved enormously, just in the past few years. “The industry itself has taken a lot of steps to increase testing of products, maintain certain standards with regards to pesticides,” he says. “But a lot more has to be done, and it’s going to be done with state guidance.” Next November, voters will weigh in on a ballot measure to legalize marijuana for recreational use.

Unfortunately, even the Centers for Disease Control and Prevention cannot predict the timing, severity and length of a seasonal virus. Luckily, there are steps you can take to ward off illness and better monitor symptoms when you’re sick. Check in with Your Doctor: Make an appointment with your primary care physician to get a look at the family’s vitals. These are good indicators of overall wellness. Plus, it’s a great time to schedule that annual flu shot, if you haven’t already done this. If you’re pregnant, have kids, or are a caregiver to elderly parents, it’s an even better idea to get vaccinated, as these are the most at-risk groups for complications from flu. If you don’t have time to schedule a full exam, many pharmacies like CVS offer quick, in-store vaccinations. Practice Healthy Living: Maintain a healthy lifestyle. Get enough sleep, eat the right foods

to ensure proper nutrition, drink plenty of water and exercise regularly. Avoid close contact with sick people, and maintain a safe distance from others when you are sick. If necessary, stay home from work or school to keep your germs from spreading. Cover your mouth and nose with a sleeve or tissue when coughing or sneezing. Sanitize doorknobs, light switches and work areas with germ-killing soap. Also, don’t forget to wash your hands or use an alcoholbased hand sanitizer throughout the day to combat contamination. By Desert Star Staff Bullying outside the home makes headlines daily, but sibling bullying can happen under one’s own roof, and can be misperceived as normal, say experts. “Sibling rivalry and sibling abuse are two separate things,” says Pam Franklin, author of “My Five Sisters,” a memoir of the author’s challenging childhood. “Mental health issues are both at the root of these problems, and can also perpetuate them.” Franklin, who was psychologically and physically abused by her mentally ill older sister, has turned her story into a unique exploration of how dangerous sibling abuse can become if not addressed. She feels her story could help others and is offering insights to those attempting to identify whether behaviors they have witnessed are normal or problematic: • While all siblings are inclined to bicker or compete, a supreme imbalance of power that threatens the mental or

physical safety of a particular child is not acceptable and should be addressed. Observe your children and ask other responsible parties, such as babysitters and relatives, for feedback on what they’ve seen or heard. • Keep in mind that many children won’t normally share problems occurring at home, fearing retribution from abusers or possessing anxiety that no one will believe them. Many such children become masters at hiding their feelings. Don’t ignore signs. Pursue the matter until you discover the truth. Even if there are no visible issues, regularly talking to your children about their thoughts and feelings is fundamental. • Write down troubling symptoms to share with your child’s doctor or therapist. Crowd of ‘Arab origin’ blamed for mass sexual assaults in Cologne on NYE

By Desert Star Staff New Year’s celebrations in the western German city of Cologne descended into chaos with a series of sexual assaults, including a rape, blamed on an uncontrolled crowd of intoxicated men of “Arab or North African” origin. The mass attack on women “in the middle of the city” around Cologne Central Station on New Year’s Eve was “an intolerable situation,” Chief of Police Wolfgang Albers told reporters. So far the authorities have received 60 complaints. The crowd, which consisted of around 1,000 men, attacked people in the city center in what Albers described as a “crime of a whole new dimension.” According to reports, heavily intoxicated men of “Arab or North African” origin flooded the city’s famous square between its central train station and Gothic cathedral. Aged between 15 and 35, individuals in the crowd began throwing firecrackers and setting off fireworks as the new year arrived. With the festivities in full swing, some men began sexually assaulting women and pick pocketing revelers. Among the criminal complaints officially filed is at least one allegation of rape. Authorities expect more

victims to come forward in the next few days. Local media meanwhile reported that at least 80 people fell victim to the gangs, 35 of whom were subjected to sexual assaults. One of the victims, named only as Katja L, told Der Express about her ordeal with the crowd of men who grabbed her buttocks and breasts. “I was groped everywhere. It was a nightmare. Although we shouted and beat them, the guys did not stop. I was desperate and think I was touched around 100 times in the 200 meters,” she said. “Fortunately I wore a jacket and trousers. A skirt would probably have been torn away from me.” To quell the New Year’s disturbance in Cologne, the police deployed more than 200 officers, involving 143 local policemen in addition to 70 federal officers, The Local reported. On Sunday, police arrested five men at the station who had been accused of threatening and robbing females. New Year’s attacks have sparked a wave of criticism of Germany’s handling of the opendoor migrant policy, introduced by Chancellor Angela Merkel in Septembe,r which resulted in more than a million refugees entering the country. The Big Short “The Big Short,” directed and co-written by Adam McKay, is based on the 2010 book of the same name by Michael Lewis. The clever, but complicated storyline follows three groups of people who first discover the impending financial crisis in the housing market in 2007-2010 that ended in the housing market collapse. In the end, these men were able to make an enormous profit when the housing bubble burst. Michael Burry (Christian Bale), an eccentric hedge fund broker, actually reads every word in every contract. As a result he discovers that the U.S. housing market is extremely unstable based on subprime loans that are high risks, providing fewer and fewer returns. He realizes that he can make a huge profit by creating a credit default swap market. Banks go along with his idea because they are confident that the housing market is secure if this sounds confusing to you, it was for me as well. Then I heard Steve Carell, who plays Mark Baum, another hedge fund manager with a pivotal role in

the film, talking on PBS. Before Carell got the role he was as clueless the rest of us, including the banks at that time. In the film Baum learns about the credit default swap market when he receives a misplaced phone call from trader Jared Vennett (Ryan Gosling). Later two young, inexperienced investors (played by John Magaro and Finn Wittrock) discover a flyer by Vennett and decide to become involved in the credit default swaps as well. They then seek the aid of retired banker Ben Rickert (Brad Pitt). On TV’s “CBS Sunday Morning” author, Lewis recently joked that his mother probably never read his book, but he’s sure she will see the film because it has an all-star cast. He also credits the screenwriters use of clever comic inserts throughout which help clarify banking terminology with laugh out loud humor. For example, a well-known chef holds up an expensive fish that didn’t sell on his menu that day. The next day he cuts the big fish into small pieces and makes fish stew.

Voila, now he still makes a profit. These funny “Ah ha” moments never get in the way of the plot, but they do consistently provide us with humorous clarity. We still may not fully get it, but we feel that we kinda, sorta do. The film, released late in December, is now coming into its own with wider distribution. It has been nominated for countless

“The Walk,” now available on DVD, is the compelling true story of a young Frenchman, Philippe Petit (Joseph GordonLevitt) who in 1974 walked between the Twin Towers of New York’s World Trade Center on a high wire. Twelve people have walked on the surface of the moon, but Petit will always be the only man to ever travel from one twin tower to the other via a high, high wire since the magnificent World Trade Center’s Twin Towers were destroyed on September 11, 2001. The film, directed by Robert Zemeckis (Best Director “Forrest Gump” 1994) is not only a love letter to Paris and New York in

the 1970s, it is a loving tribute to the World Trade Center’s Twin Towers, now only a memory. In the story Petit is enamored by the challenges, he must face when carefully walking on a high wire. He is guided by his real life mentor, Papa Rudy (Ben Kingsley), an aerial artist who teaches him the tricks of the trade. His first wild adventure on the high wire came in Paris when he walked between the two towers of Notre Dame Cathedral. Later he is inspired by a newspaper article he reads in a dentist’s office about the World Trade Center under construction in New York that will have the two tallest towers in the world. He is aided in his daring efforts not only by Papa Rudy’s advice and expertise, but also by a band of friends and coconspirators. Joshua Tree National Park jumping with fourth graders this year

By Pamela Price The one hundred year old National Park Service (NPS), established by an Act signed by President Woodrow Wilson on August 25, 1916, will be celebrated this year at 130 National Historic Parks and Sites, 90,000 venues on the National Register of Historic Places and 2,500 National Historic Landmarks. That’s a lot of territory to cover, especially for fourth graders who are eligible for a free pass to visit these sites, now through August 31st of this year. This ambitious anniversary project covering more than 84 million acres of America’s majestic land is an opportunity for the next generation to respect, preserve and experience all that the National Park Service maintains so well. The NPS is present in every state plus Guam, American Samoa, the Virgin Islands and the District of Columbia. Joshua Tree National Park in Twenty Nine Palms, CA is the ideal place to

start, with a mesmerizing range of boulders, bluffs, cacti, and eponymous Joshua trees, making California’s high desert the ideal location for launching exploration. The Colorado and Mojave deserts meet in the park, which spans an area, nearly the size of the state of Rhode Island, providing countless opportunities for young explorers. This was all brought to my attention by my fourth grade grandson, Harris, visiting this December from Washington, DC. Elementary school). Fourth grade park passes can be printed from the NPS website (https://www. everykidinapark.gov/get-yourpass/fourth-grader). The pass granted our whole family access to Joshua Tree National Park, saving us the $20 entry fee. Once at the Park we headed for The Joshua Tree Visitor Center, where exhibits and information are the perfect place for children to begin their NPS explorations. Boulders of all shapes and sizes that abound

in the park particularly fascinate children. Harris noted that “if you want to have fun, climb Jumbo and Skull Rocks!” The NPS is cultivating new fans with its ambitious Junior Ranger program, created for children ages 5 to 13 and valid at 250 National Parks. Upon completion of the program children, receive a certificate plus a patch or a plastic badge in the shape of

the park ranger badge, which is different at each park. “We are creating the next generation of park visitors, appreciation leads to stewardship,” says Mike Litterst, public affairs officer at the National Mall in Washington, D.C. The Centennial celebration of the NPS has started at Joshua Tree National Park with Ranger programs such as a Mastodon Peak Hike, a Cholla Garden Chat, Full Moon Hikes and more.

The film was well done and the audience seemed to enjoy it. There was an after party in the Palm Springs Art Museum. Hundreds of people that attended the films at the Annenberg Theatre and the Camelot Theatre were allowed entry. Drinks flowed and food was everywhere. There

was a buffet of meatballs, pasta, salads and beef. There was a cheese, cracker and vegetable table and another table loaded with sweet treats. Trays of shrimp, hotdogs, crab cakes and other appetizers were served. Pianist Patrick Karst entertained with his music. Valet parking made it easy to park and pick up your car. Palm Springs International Film Festival Red Carpet Story and Photos by Pat Krause The Palm Springs International Film Festival had all the Glamour and Glitz of Hollywood as some of the top mega stars walked the Red Carpet on Sat. Night, January 1st. What a wonderful way to start the New Year with an awards gala that saw so many iconic stars of film. The women were dreamy in their beautiful gowns and of course, the men were so handsome in their tuxedos. The cream of the Oscar and Golden Globe nominations were here in our Valley. The PSIFF was held early so it would not interfere with the Golden Globes or Oscars. The Gala raised almost 2.5 million dollars for this sold out event that grows bigger each year. The PSIFF has a record of picking the Oscar nominated actors and actresses and winners. The same goes for the Golden Globe nominations and winners as they have been to Palm Springs and the PSIFF Gala as award winners or presenters. The Festival has become an internationally known event. Directors, Producers and actors are thrilled to be to be a part of it. The Awards given each year is a feather in the cap of all the honorees. Major sponsors this year were Mercedes Benz and Bighorn. Chairman Harold Matzner spoke about the Festival. Matzner mentioned Jerry Weintraub who was a big supporter of the PSIFF and will be missed. Others mentioned founder Sonny Bono and how he would be so pleased at how far this festival has grown. This is the 27th annual festival. Mary Hart did her usual magnificent job as Emcee for the Gala again this year. Hundreds of photographers and TV crews from around the country came to film the Red Carpet and all its illustrious VIPS. Another several hundred people were across the street hoping to get a glimpse of the stars as

they got out of their limos. Many stars walked over to greet all their fans and even sign autographs for the lucky ones who were thrilled beyond words. Cameras and phones were held high to record the event. Some fans had even spent the night before in line to make sure they got the best spots to see the stars. Cars and limos drove up to the valet where all guests walked one of the two Red Carpets. Security was exceptionally tight as everyone was asked to walk thru the metal detectors, K9 dogs checked out the area and the local police were there in force to make sure everyone was safe. The added security didn’t seem to dampen the festivities. Johnny Depp and Kate Winslet hugged as they met each other on the Red Carpet. Michael Fassbender was on the Red Carpet when he saw Matt Damon and they greeted each other with a hug. Other stars were happy to see some of their fellow actors that they hadn’t seen for awhile. PSIFF is like Old Home Week to some as they were here before to either get an award or present one. Winners this year was: Rising Star Award-Alicia Vikander, Tom McCarthy-Sonny Bono Visionary Award, Brie Larson-Breakthrough Performance Award, Spotlight Award went to Mara Rooneyactress and Brian Cranston- Actor. Michael Fassbender-actor and Saoirse Ronan-actress took home the International Star Awards. Actor Johnny Depp-actor and Cate Blanchett-actress won the Desert Palm Achievement Awards. Matt Damon took home the Chairman’s Award and “The Big Short” movie won the Ensemble Performance Award. Presenters were big stars like

Israeli cinema shakes up Hollywood

By Anthony Grant In Southern California we may dread earthquakes but we also make a certain accommodation with them — and it has to be said, the landscape might look a lot duller were it not for millennia of Mother Nature’s coldhearted fury. Arid terrain defines much of Israel too, as does conflict. And though the Middle East would be a lot better off were not so much of it a chronic war zone, the geopolitical tremors that have torn the place apart do much the same for cinema. Which is why among the 413 screenings of more than 176 films during the 11-day stretch of the 27th Annual Palm Springs International Film Festival, it’s worth looking past some of the glitz and glamour to focus on flicks from faraway lands like the Holy Land. Start with Oriented, the debut film by British film director and producer Jake Witzenfeld. He capably chronicles identity crisis issues among a group of young Arab Israeli friends living in the mixed and soulful Jewish-Arab Jaffa section of Tel Aviv. You think your relationships are complicated?

Watch as this trio etches both their national and sexual identities against the canvas of Israel’s capital of cool, in the run-up to the awful Israel-Gaza war fought in 2014. There’s also the fight against small-town blues and stifling family life as you meet handsome Khader, conflicted by his desire for change despite the elusiveness of hope; Fadi, an ardent Palestinian nationalist who wrestles with guilt-ridden Jewish love and quiet Naeem who confronts his family with some verities that encounter less resistance in the big city. The intersecting situations and friendships are as messy but also as delicious as a real Israeli falafel sandwich, which brings me to a film as wacky as its name: Atomic Falafel. Heard about that little Iran nuclear deal thing? One of Obama’s milestone foreign policy accomplishments/ failures (depends who you ask) plays very differently in the Middle East, but this movie turns all the serious stuff on its head for some much-needed comic relief. The fast-paced satire with a propeace message features star

turns by Shai Avivi as well as one of my favorite Israeli actors, Yossi Marshek. I was taken with Yuval Delshad’s sly smile at one of the gala after-parties so was all

ears to hear about the director’s Baba Joon, a coming-of-age drama set in a Persian-immigrant “moshav” in Israel’s Negev Desert in the 1980s. There, three generations of the Morgian family struggle to manage, of all things, a turkey farm. Delshad’s canny oeuvre, starring Navid Negabhan (you might recognize him from Homeland) is Israel’s first-ever major film in Farsi and won the country’s Ophir Awards (like the Oscars) for Best Film, Cinematography, Art Direction and Score. Hollywood is starved for woman directors so I was glad to have a chat with young director Yaelle Kayan about her unusual cinematic debut Mountain, a deft portrait of domestic discontent in the set in Old Jerusalem. Tzvia is an Orthodox Jewish woman who lives at the edge of the cemetery on Jerusalem’s iconic Mount of Olives and one night she observes a whore servicing

a john amid the gravestones. The next night she brings the pimps some chow. I know, wow. Variety may have said it best: “Mountain conveys the sense of a living woman entombed.” As great cinema is about breaking the rules allow me to follow that tradition by mentioning an Israeli film sadly not screened in Palm Springs this year: Thru You Princess, produced by the talented Liran Atzmor. In the words of Variety’s Chief International Film Critic, this is an “astounding account of an artistic collaboration between an Israeli remix artist and a gifted New Orleans-based vocalist he discovers half a world away” and “puts talk-show fairy godmothers Ellen or Oprah to shame.” With that in mind, I suggest you power down your depressing cable news broadcast and dip into as many of these unexpected Israeli screen delights as you can today.

Mrs. Clinton also promised to expose the aliens and “get to the bottom of it,” a vow that might endear her to scientists, space geeks and UFO enthusiasts. The Democratic presidential hopeful has like-minded people in her team. As she told the newspaper, John Podesta, the chairman of her campaign, is obsessed with UFOs and aliens. “He has made me personally

pledge we are going to get the information out,” said Clinton. “One way or another. Maybe we could have, like, a task force to go to Area 51.” She added that she would like to look into Area 51, a secret military base in Nevada that has long been rumored to contain aliens. She initially called it Area 54 but quickly corrected herself. However, as Bill Clinton told Kimmel, he had already looked in the secret base, but failed to find space invaders there. He had promised not to keep people in dark if he ever found them. “There are no aliens there,” said Mr. Clinton. Coachella Valley weather forecast By Desert Star Staff The first of several storms to hit Riverside County this week brought rain and the possibility of light mountain snow today, but a second and stronger storm system is right around the corner. A National Weather Service winter storm watch for the mountains is scheduled to take effect late tonight and expire late Thursday. Forecasters said the initial small storm system would bring occasional moderate rain and little to no snow, but a more powerful storm is set to arrive Tuesday. ``The weather pattern in SoCal will be very active this week with several storm systems moving through the region,’’ according to the weather service. ``The most impactful storm is expected to arrive Tuesday afternoon and persist into Wednesday morning. This storm will bring moderate to heavy rainfall over the coast, valleys, foothills and deserts, with heavy snowfall occurring in the mountains above 5,500 feet.’’ Forecasters said up to 1

1/2 to 2 inches of rain would be possible Tuesday through Wednesday. Snow levels are expected to drop from around 6,500 feet today to 5,000 feet on Wednesday and to 4,000 feet late Thursday, although there could be periods between the storms with little or no snowfall. Subsequent storms are expected to bring heavy snow -- possibly up to three feet on the highest peaks --- through Friday, forecasters said. US sues VW over emissions-cheating software in diesel cars By Michael Biesecker And Eric Tucker WASHINGTON - The Justice Department sued Volkswagen on Monday over emissions-cheating software found in nearly 600,000 vehicles sold in the United States, potentially exposing the company to billions of dollars in penalties for clean air violations. The civil complaint against the German automaker, filed on behalf of the Environmental Protection Agency in U.S. District Court in Detroit, alleges the company illegally installed software designed to make its “clean diesel” engines pass federal emissions standards while undergoing laboratory testing. The vehicles then switched off those measures in real-world driving conditions, spewing harmful gases at up to 40 times what is allowed under federal environmental standards. “Car manufacturers that fail to properly certify their cars and that defeat emission control systems breach the public trust, endanger public health and

disadvantage competitors,” John C. Cruden, the assistant attorney general for the Justice Department’s Environment and Natural Resources Division, said in a statement. “The United States will pursue all appropriate remedies against Volkswagen to redress the violations of our nation’s clean air laws alleged in the complaint,” he said. The company is in the midst of negotiating a massive mandatory recall with U.S. regulators and potentially faces more than $18 billion in fines for violations of the federal Clean Air Act. The company and its executives could also still face separate criminal charges, while a raft of private class-action lawsuits filed by angry VW owners are pending. Volkswagen Group of America spokeswoman Jeannine Ginivan said Monday that the company “will continue to cooperate with all government

agencies investigating these matters.” In past statements, highranking VW executives have sought to blame only a small number of software developers in Germany for the suspect computer code designed to trick emissions tests. The company has hired a U.S.-based law firm to conduct an internal investigation into the scheme. The findings of that review have not yet been made public. The company first acknowledged in September that the cheating software was included in its diesel cars and SUVs sold since the 2009 model year, as well as some recent diesel models sold by the VWowned Audi and Porsche brands. Worldwide, the company says cheating software was included in more than 11 million vehicles. The federal lawsuit alleges that Volkswagen intentionally tampered with the vehicles sold in the U.S. to include what regulators call a “defeat device,” a mechanism specifically designed

to game emissions tests. Under the law, automakers are required to disclose any such devices to regulators. Because Volkswagen kept its suspect software secret, the lawsuit alleges the company’s cars were sold without a valid “certificate of conformity” issued by EPA to regulate new cars manufactured or imported into the country. In addition to producing far more pollution than allowed, experts say the excess nitrogen oxide and particulate emissions from the more than half-million VW vehicles had a human cost. A statistical and computer analysis by the Associated Press estimated the extra pollution caused somewhere between 16 and 94 deaths over the last seven years, with the annual toll increasing as more of the diesels were on the road. “With today’s filing, we take an important step to protect public health by seeking to hold Volkswagen accountable for any unlawful air pollution, setting

us on a path to resolution,” said Assistant Administrator Cynthia Giles for EPA’s Office of Enforcement and Compliance Assurance. “So far, recall discussions with the company have not produced an acceptable way forward. These discussions will continue in parallel with the federal court action.” Justice Department officials said on Monday the case was filed in the Eastern District of Michigan because that is where “significant activity” related to the company’s cheating scheme occurred. EPA’s primary emissions-testing lab is located in Ann Arbor and Volkswagen also has facilities in the Detroit metro area. However, as the legal case proceeds, the venue is expected to move to Northern California, where hundreds of the class-action cases have been consolidated and state regulators played a key role in uncovering VW’s deceptions. By Vivian Salama And Scott Bauer BOONE, Iowa (AP) - The sprint to the Iowa caucuses opened Monday with nearly a dozen presidential candidates in motion, a rather restrained Bill Clinton stepping up for his wife and a pledge by the only billionaire in the race to start spending serious money. From Iowa to New Hampshire - on the air, on the bus and on the stump - candidates vying to become America’s next president roared out of the holidays in full force with less than a month to go before voting begins. The coming weeks are especially crucial for Republicans as voters look to weed through the thicket of choices to determine who will represent and attempt to reunite a bickering party. This, as contentious issues over terrorism, security, civil liberties and gun ownership reverberate, giving candidates plenty to argue about. Democrat Hillary Clinton and Republican Donald Trump have been the consistent favorites in polls overall. But they have very different strengths. Clinton also has an impressive organization behind her while Trump’s ability to pull off a winning ground game is in question and his frugal spending to date has stood in stark contrast to his vast personal wealth. He says he’s opening the money spigot now. Early voting is often deemed critical in races, like this one, when the path to a nomination is so unclear. As mystery shrouds the Republican race, the Democratic one hangs on whether Bernie Sanders, an independent socialist senator from Vermont, can turn his months of large, passionate rallies into enough votes to upset the former first lady. In Iowa, the first of the early voting states, Republican contender Ted Cruz launched a bus tour through the state where his campaign feels he is wellpositioned to win. Cruz called on Iowa voters to bring nine of their friends and family members with them to vote for him in the Feb. 1 caucuses. Cruz made the plea Monday in the first of 28 planned stops in Iowa over the next six days. “Now is the time that the men and women of Iowa step up and make your decision,” Cruz said during his stop in Boone, Iowa.

Clinton also kicked off a twoday swing in Iowa, where she was scheduled to attend several organizing events in preparation for the caucuses. In New Hampshire, former President Bill Clinton launched his own tour on behalf of his wife, talking both about Hillary Clinton’s campaign promises and his own experience in the White House. What the scrappy political veteran did not talk about was Trump, who’s baited him in recent days by bringing up his impeachment and decades-old sex scandal. As Clinton mingled with a lunchtime crowd at a popular Manchester restaurant, news station above his head ran captioned video questioning whether he could avoid Trump’s flagrant attacks. He did just that, focusing on the race at hand. “They have to choose a nominee and we have a primary to win,” he said when asked about Trump and the broader Republican field. “One of my many rules in politics is don’t look

past the next election.” The event marked the former president’s debut solo appearance for his wife’s campaign. Sanders also campaigned Monday in New Hampshire, which votes Feb. 9. In 2008, Hillary Clinton suffered a stringing defeat in Iowa, rebounded with a win in New Hampshire and waged a grinding campaign across the country before Barack Obama claimed victory in the nomination race on his way to the presidency. Trump debuted his first television ad in both Iowa and New Hampshire, featuring dark images of the San Bernardino, California, shooters, body bags, and people apparently streaming freely across a border. But the images of border security were of Morocco, not the U.S. The Trump campaign insisted in a statement: “The use of this footage was intentional and selected to demonstrate the severe impact of an open border and the very real threat Americans face if we do not immediately build a wall and stop illegal immigration.” The ad reinforced remarks he made last month proposing a temporary ban on Muslims looking to enter the United States, which sparked outrage from Republican and Democratic rivals alike. The comments threatened the party’s drive to attract minorities, an effort already complicated by Trump’s negativity toward Mexican immigrants. Trump says he plans to spend at least $2 million per week on television ads in Iowa

and New Hampshire overall. He was heading to Massachusetts late Monday before catching up to many of the other candidates flooding into New Hampshire this week. New Jersey Gov. Chris Christie’s presidential campaign kicked off the new year by hiring several new people in New Hampshire, where his campaign is banking on a strong finish to propel his campaign forward. Devon Manchester will serve as deputy political director in the state, campaign spokeswoman Samantha Smith said Monday. The addition will boost Christie’s paid staff in the state from four to six with just over a month to go before the primary. Former Florida Gov. Jeb Bush, by contrast, currently has 20 full-time paid staffers in the state and plans to grow that number at least to 40 in coming weeks. And Marco Rubio criticized his Republican rivals in a New Hampshire speech focused on national security. A conversation with pakistani actor Shaz Khan

By Jack Lyons Theatre and Film Critic As a theatre and film critic, I have the good fortune of being able to attend various festivals around the country. I get to see and review films from many counties and expand my cultural horizons, so to speak. One of the largest film festivals in North America is the annual Palm Springs International Film Festival (PSIFF), now in its 27th year. This year my focus is “Award Buzz” film entries. These films have an opportunity to be considered as candidates for Oscar nominations in the category of “Best Foreign Film for 2015. “Moor”, is a Pakistani drama that gives a much needed lift to its moribund film industry (Pakistan has been on a war zone footing for some ten years). I had the opportunity, via telephone, to interview Shaz Khan, one of Pakistan’s up and coming talented actor/writer/directors. Khan is an America-born (Oxnard, CA) actor who as a child returned with his parents to their former country, only later to return to the USA. Shaz attended Penn State University, earning a Business degree. He worked on Wall St. and had a successful career in finance before being bitten by the ‘acting bug’. He went on to get a Masters degree in Acting from the Actor’s Studio in New York City. A year or so ago he returned to Karachi to visit relatives, where he saw an announcement in the local paper of auditions being held for a new Pakistani movie. Jack Lyons: The Palm Springs International Film Festival is a very prestigious festival. Can you share the feeling of being

a star in this new movie and tell us a little about its story? Shaz Khan: First let me say its exciting just being in this movie. I auditioned for it as a lark while visiting relatives in Karachi. At their urging I went to the audition never thinking I would be cast. But the movie business is a business where strange and wonderful things can happen. As to the storyline, it’s about the bonding between a father and son amid the problems of graft and corruption in their rural village in the remote province of Balochistan. On a larger scale, it deals with the deliberately engineered decline of a once famous railway system at the hands of a network of people with other plans. The conflicts drive the father and son closer together when it comes time to make life altering decisions. No spoiler alerts from me beyond this.
