Another MTV VMAs, another controversial Miley Cyrus By Mesfin Fekadu Justin Bieber cried, Taylor Swift won most of the awards and Kanye West ranted onstage, but Miley Cyrus still owned the 2015 MTV Video Music Awards. The 22-year-old wild child flashed one of her breasts, wore outfits that showed most of her skin, traded words with Nicki Minaj and closed the show with a performance of a

new song about marijuana. But it didn’t end there: The singer came backstage with a lit joint and passed it around. “I’ve been doing this (expletive) for a while,” she said. “Because you’re all my friends, and my song is kinda, sorta about the love of marijuana and the love of humankind, I brought a little joint if anyone would like any. Anyone?” (It was not immediately

known whether Cyrus has a license to use marijuana legally for medical purposes.) Cyrus also posed for photos clutching a moon man trophy and passed out avocadoes to photographers and reporters. “I didn’t actually win one of these,” she said of her trophy. “They just give it to you for free because you host, so that I just wanted to clarify.”

2015 Candidates Forum

September 10, for the city of Desert Hot Springs By Desert Star Staff Please come out and join us for the 2015 Desert Hot Springs Candidates Forum taking place at the Desert Hot Springs High School Theater on Thursday, September 10, 2015 at 6pm. This event is FREE and open to the public. We will hear from candidates seeking election to the following: • Desert Hot Springs City Council • Mayor of Desert Hot Springs The Desert Hot Springs Chamber of Commerce has a history of involvement in local political activities that predates

the incorporation of the City. In fact, it was through active engagement of the Chamber that both the Water District and the City were established! As a 501(c) (6) organization, the Chamber may participate in political events and may be involved in advocacy. For the 2015 election, the business community, represented through the Chamber, has a particular interest in the policies and perspectives of the candidates as they pertain to the pressing issues faced by the City. As a service to our business partners, the Chamber, with its

co-hosts and event sponsors, has coordinated the 2015 Desert Hot Springs Candidates Forum. Please note that the Chamber is non-partisan and is not currently taking a position for any candidate. However, following the September 10th forum the Chamber Board may vote to endorse. The date and format of the 2015 Desert Hot Springs Candidates Forum has been determined by numerous factors, such as: Continues on Page 7

Sunday’s show comes after Cyrus stole the night at the 2013 VMAs when she twerked on Robin Thicke, causing a frenzy. At last year’s show, she won video of the year for “Wrecking Ball.” But at the 2015 VMAs, Cyrus hit a more controversial stride when she revealed one of her breasts. “MTV isn’t under the

authority of the FCC (Federal Communications Commission), so MTV would not be subject to any broadcast decency fines for that, but if I were a sponsor for the VMAs, I’d probably be pretty outraged,” Melissa Henson, director of grassroots education and advocacy for the Parents Television Council, said Continues on Page 11

Americans Spending More for College Out-of-Pocket

By Desert Star Staff The Bank of Mom and Dad is open for business, as parent outof-pocket spending has become the number one source of college funding. In fact, 62 percent of families did not borrow to pay for college last year, according to a new report. The national study, “How America Pays for College 2015,” from Sallie Mae and Ipsos, now in its eighth year, found that parent income and savings covered the largest share of college costs -- 32 percent -- surpassing scholarships and grants at 30 percent, for the first time since 2010. Families covered the balance of college costs using student borrowing, student income and savings, parent borrowing, and contributions from relatives and friends. While families spent 16 percent more on college in academic year 2014-2015, the report found that fewer families are worried that economic factors would affect their ability to pay for college, fewer eliminated colleges from consideration due to cost, and fewer took costsaving measures to control college costs. “The increase in the amount

families are spending appears to be less about the rising cost of college and more about the choices parents and students are making about how they pay for college,” says Michael Gross, vice president and head of the higher education practice at Ipsos Public Affairs. “Traditional economic concerns, such as job loss, declining home values, and decreased value of savings, are less worrying for parents this year, allowing families greater freedom to concentrate on college.” Still, while the majority of families agree college is an important and worthwhile investment -- and are making such responsible decisions to help pay for it as filing for federal aid, reducing personal spending and working while attending school -- only 40 percent of families have a plan to pay for college. “College remains a priority for parents, and they are feeling more confident as they reach into their own pockets and put their money where their values are,” says Raymond Quinlan, Chairman and CEO, Sallie Mae. “It’s gratifying to see families are borrowing responsibly and making efforts to reduce costs.” In an effort to move that

stubborn statistic and encourage more families to make a college financing plan, the experts at Sallie Mae are expanding their suite of free tools and information. To get started, they recommend these three steps: • Start with money you won’t have to repay. Supplement your college savings and income by maximizing scholarships, grants, and work-study. • Explore federal student loans. Apply by completing the Free Application for Federal Student Aid (FAFSA) form. • Consider a responsible private education loan. Fill the gap between your available resources and the cost of college. To view the complete report, visit SallieMae.com/ HowAmericaPaysForCollege. For free tools, such as a college planning calculator, scholarship search and the College Ahead mobile app, visit SallieMae.com/ PlanforCollege. For many families, college is one of the biggest investments they will ever make. Fortunately, as the cost of college trends upward, so too is the incidence of responsible decision-making when it comes to financing an education. (StatePoint)

In fact, it was a tough night for the DVL all the way around, except for the Palm Springs Indians, who pitched a shutout over Taquitz to begin their CIF title defense with a 37-0 road win. Head coach Bob Moylet said his offense couldn’t find it’s rhythm and that led to his defense getting tired quickly in the heat. Palm Desert let a close game slip away at San Jacinto, 37-27 the final there. Beau Berryhill got in the end zone and it proved to be an exciting game with Division-I recruit, TE Tommy Jacobsson, who was out most of last season with injuries, he was productive and narrowed

the game to 29-27 with a 12yard touchdown catch with less than 6 minutes remaining. But it wouldn’t be enough. San Jacinto pulled away in the final minutes. Being Executor of an Estate can present many challenges

By Janice Gough If you are requested to be an executor of one’s will and trust, it means you’ve established a pretty good relationship and

are one who is trusted by the grantor, but not necessarily trusted by the descendents. However, as flattering as it may be to be ask to take on this responsibility, considerations should be made before simply saying yes. You might find that this area can be a minefield, and you may find that you bit off more than you could chew. Before deciding to serve as an executor, one should consider all of the work that goes into it -- and the headaches that can follow. There is a lot of detailed work involved. You may have to sell real estate, cars, securities or other assets which the grantor has requested to be sold. In the case of real estate, a property may need to be brought up to code or repaired in order to sell it. Appraisals may be needed from different companies before sale. Selecting the best realtor, who the family is happy with, can open another can of worms. And

more problems can evolve if the realtor is not that good. You may need to work with annuity or life insurance companies. When beneficiary designations on these types of plans differ from the trusts or will, it could result in a lawsuit among heirs. Since the life insurance or annuity is a legal contract, it may take precedence over the trust; however, you may still encounter family law suits. There may be beneficiaries who will contest the trust, because they don’t feel that they are getting enough. They may not understand the timeframes required of your job, and accuse you of delaying the execution of transfers. You should understand about family issues that might come up after their relative or friend passes away. Before accepting the responsibility, some initial questions for the client could include: “Is everybody getting along in the

family?” “Are there any family members that are estranged from each other that are going to suddenly start arguing over the estate?” An executor and a trustee are not the same. An executorship will generally last for a year or two. The responsibilities would be to collect debts, pay debts, distribute assets and settle problems, especially when assets were not listed in the trust or will. A trusteeship can last multiple generations and result in a lot of different responsibilities. It is important that you meet with the family’s estate planning attorney to discuss any assets that might be involved in the probate, such as jewelry, watches or cars. You want to make sure you understand what’s going on and that all assets have been covered. There is also an additional financial burden linked to the task. The main aspect of being

the custodian is that you may have a surprise annual audit performed of those assets over which you have custody. In some cases, this may cost as much as, $5,000 to $10,000 or more, depending on how many accounts you’re talking about. Although election of an attorney or trust company may prove to be expensive, those who are not connected in any way to the family may be a better consideration, especially when the estate is complicated and the family is not in alignment.

executive session, only two days’ notice is required, per Civil Code 4920(b)(2). The agenda can be announced by several methods, including posting in the locations where written association policy states general notifications are posted, per Civil Code 4045. If a matter is not announced on the agenda with sufficient specificity for homeowners to understand what the subject will be, it cannot be discussed by the board of directors. Avoid general (and evasive) agendas. There are three exceptions, when the board may discuss matters not on the agenda: 1) If a matter is truly an emergency, meaning “there are circumstances which could not have reasonably been foreseen,” (Civil Code 4923) the board can meet with little or no notice. Be conservative in declaring emergences, because not all “emergencies” qualify under this statute. After emergency decisions, make sure the decision

is fully disclosed, including the emergency aspects of the subject, at the next open board meeting. It may also be a good idea to have a motion to ratify the emergency decision. 2) If a matter arises after the agenda’s publication, and requires immediate action, the board may by a 2/3 vote of all directors (or unanimous vote if less than 2/3 of the board is present) act on such a matter, under Civil Code 4930(c)(2). 3) If, no more than 30 days before the meeting, an item was on a previous agenda but was continued to the next board meeting, 4 day agenda notice is not required, under Civil Code 4930(c)(3). Announced executive session agendas can be more general. There is no need, for example, to identify the specific homeowner scheduled for a disciplinary hearing – the announced closed session agenda can simply note “disciplinary hearings,” or “assessment foreclosures,” or

“discussion of litigation issues”. F.C., as to the president’s wife repeatedly engaging the board with e-mails, the board may not discuss HOA business in emails, so the board should not be responding – that is why you have a manager. Best regards, Kelly

By Kelly G. Richardson, Esq. CCAL Hi Kelly - We were recently told that unless you post for all to see that there will be an “Executive Session” at a board meeting, then you can’t have one. (We do, of course, post the items to be taken up in the open session). If it must be posted, how much information do you include, since I thought it’s supposed to be confidential (delinquencies, etc.). P.S. Thanks for your column, it’s really helpful! E.G., Lomita Good morning Kelly: What is the procedure, the agenda was not posted on time. That’s one issue, and another is, we have the HOA president’s wife constantly addressing the complete board via email on issues. I can hear it from the management about her issues, I just don’t want to hear it from her directly, or even have her with my email address. Sincerely F.C., Riverside Dear E.G. and F.C.: The requirement of posted agendas is found at Civil Code 4920. That section requires that agendas be announced to the association at least 4 days prior to board meetings, unless the association governing documents require a longer time (4920(b)(3)). Hurricane Katrina: Back to the disaster zone By Desert Star Staff Ten years after Hurricane Katrina devastated New Orleans, traces of the disaster continue to linger. While some parts of the city have recovered completely, other areas seem to be frozen in the aftermath of the catastrophe. Dubbed a “superstorm, Katrina claimed over 1,800 lives, cost around $150 billion dollars in total damages, and displaced over one million people in the Gulf Coast region. Just a 10-minute drive from New Orleans’ historic downtown, abandoned, overgrown houses are more common than ones that are actually occupied – less than two in five households have returned. Before Katrina, there were more than 5,300 households in the Lower Ninth Ward. In the immediate aftermath of the storm, only 600 remained. The number has steadily grown since then, but with only around 2,000 homes occupied, the neighborhood is far from recovered. There used to be seven schools in the area, but now there’s just one, and the closest grocery store is several miles away. Lydia Lagarde returned to the Lower Ninth Ward, and stark reminders of the storm still surround her home of 35 years. “I try not to think about Katrina. I know she happened and the evidence is still all around after 10 years, she told RT. Lagarde and her family left only a day before the hurricane, and were relocated to Greenville,

Mississippi. After three months there, the Federal Emergency Management Agency (FEMA) placed them into an apartment for another 10 months. Lagarde later chose to move into a trailer, right next door to the lot where she had lived for 35 years. “We own this property, we own the lot next door, she said. “We’re too old to try to start over somewhere else when it would be cheaper to just come back here and try to rebuild. Thanks to the spirit of residents like Lydia Lagarde, the Lower Ninth is experiencing a slow but steady revival. “The kind of saying goes, ‘what doesn’t kill you makes you stronger.’ The resilience in this community is stronger than ever, those who did come back, those who still are coming back it’s amazing that in a ten year period that every year, Arthur Johnson of the Center for Engagement and Development told RT. “You see people coming back and that people didn’t forget that this was home. The city’s African-American population has shrunk by 97,000 from its peak of 325,952 in 2000, while the white population has only gone down by 9,000 from 113,428 in 2000, according to Allison Plyer, chief executive of The Data Center, a New Orleansbased organization that has tracked the city’s recovery. This is a staggering difference, even when considering that there are about twice as many black residents as white residents in

Photographer Carlos Barria holds a print of a photograph he took in 2005, as he matches it up at the same location 10 years on, in New Orleans, United States, August 17, 2015 Š Carlos Barria / Reuters the city. Before the hurricane, black people comprised 67 percent of the population. By 2014, that number dropped to 60 percent. This reality of demographic differences translates into a differing view of the recovery along racial lines. A study by Louisiana State University found that 78 percent of white respondents thought that the city had mostly recovered, while only 37 percent of blacks felt the same way. This is partly because black residents were far more likely to live in neighborhoods hit hardest by the storm, such as the Lower Ninth Ward. The almost uniformly black neighborhood only saw 37 percent of its residents return since Hurricane Katrina struck. While the median income

of levees was greenlighted even after the Corps of Engineers ran a study that predicted the likelihood of its failure. The design chosen saved the government $100 million, but the tradeoffs were immeasurable. “At the end of that study, the guys who prepared the study said that additional study is necessary because this test failed. General Whatshisname, Colonel Whatshisname and the other Colonel Whatshisname probably ignored that one line, HJ Bosworth Jr., engineer and researcher for the activist group Levees.org, told RT. Hindsight is 20/20, and the Corps did its best to fix its mistake by installing a much sturdier system of levees that can resist the next Hurricane Katrina. This time they didn’t cut any corners, with the total cost coming to $14.5 billion. Engineers say that the new system’s immediate aim is to be able to stand up against a 100-year storm – that is, a storm so powerful that it is statistically expected to occur only once every 100 years. For comparison, Katrina was a 150year storm when it reached New Orleans. But more than any sturdy engineering, it may be the unique character of New Orleans and its residents that allowed it to weather this storm. “We’ve been through so much, and 10 years after, Hurricane Katrina is just an indicator that we’re still standing, Arthur Johnson with the Lower 9th Ward Center for Sustainable Engagement and Development told RT. “We still believe in ourselves; we still believe in our culture.

has increased since the storm, this metric is divided along racial lines too. The post-Katrina New Orleans has a larger gap between black incomes and white incomes than before. The median income for black residents is about $25,000 a year and hasn’t changed much since before the storm, compared to the $60,000 median income for whites. The National Urban League in the lowest income bracket, making less than $20,900 per year, according to a study releases almost half of the black population. Since the storm, upward mobility has been an almost exclusively white phenomenon. The share of white families earning more than $105,000 per year has grown from 20 to 30 percent, while the figure for blacks is only 7 percent – exactly where it was before Katrina. This is probably because many of those living in the city now are not those who had left. The LSU study found that more than a quarter of the city’s current residents hadn’t lived there before Katrina. These new residents are more likely to be college-educated and white than those who lived in New Orleans before 2005. The recovery of New Orleans is coming not only in the form of rebuilding, but also making the city stronger than before. Much of the flooding the city suffered was a man-made disaster, rather than a natural one, due to an oversight by the US Army Corps of Engineers. Hundreds of miles of floodwalls that protected the city failed in critical areas when Katrina struck, leading to 80 percent of New Orleans being flooded. The inadequate system

Assange says Snowden’s escape to Russia was his idea

By Desert Star Staff Wikileaks co-founder Julian Assange could have played a role in the decision by NSA whistleblower Edward Snowden to seek asylum in Russia, instead of Latin America. Assange says it was he who advised Snowden to turn to Moscow for refuge. Snowden “preferred Latin America, but my advice was that he should take asylum in Russia despite the negative PR consequences, because my assessment is that he had a significant risk of being kidnapped from Latin America on CIA orders…kidnapped and possibly killed,” Assange said in an interview with The Times. Snowden flew to Moscow from Hong Kong in June 2013. A year later, he received a Russian residence permit valid for three years, starting from August 1, 2014. The WikiLeaks co-founder added that the ex-NSA agent “was well aware of the spin that would be put on it if he took asylum in Russia.” The whistleblower faces several charges, including espionage and theft of government property, which could lead to 30 years in

prison if he returns to US. ‘I’ve seen quite a number of threats’ - Assange Speaking to the newspaper, Assange said that he still fears for his life as there are certain “security issues with being on the balcony.” “There have been bomb threats and assassination threats from various people… I’m a public figure and a very controversial one, including in the United States. As a result there have been quite a number of threats by unstable people.” He said he doesn’t believe that he is going to be kidnapped by US authorities or assassinated by a drone, however. “I’m a white guy. Unless I convert to Islam it’s not that likely that I’ll be droned, but we have seen things creeping toward that.” Assange also spoke about Washington’s policies, in particular White House meetings during which Barack Obama approves target lists for drone strikes. “In the United States every Tuesday, Obama meets to decide who lives and dies, according to secret law. Terror Tuesdays,

they’re called in Washington. Secret law. No appeal.” The Australian computer expert, 44, has been living in the Ecuadorian embassy in London since 2012. The 24/7 security around the building where he is residing has already cost British taxpayers a hefty £12 million, according to govwaste.co.uk. Assange hasn’t been charged with any crime, but is wanted for questioning in Sweden regarding allegations of sexual misconduct brought

against him. An arrest warrant was issued for Assange in 2010 in the of wake sexual assault allegations leveled against him by two Swedish women. He denied the allegations of sexual misconduct and rape and managed to avoid extradition to Sweden by seeking refuge in the embassy in 2012. He repeated previous statements that he is ready to answer all questions concerning his sexual assault allegations within the

sanctity of the embassy. In August, Swedish prosecutors withdrew three of four sex crime allegations against Assange after they expired under statute of limitations law. A fourth and final one will remain in force for years to come. But even if Sweden drops the case, Assange still faces arrest by UK police for jumping the bail granted while the British courts considered a European arrest warrant issued by Stockholm.

By Desert Star Staff Despite the opposition of the US public and lawmakers to NSA surveillance, the courts keep handing the Obama administration the license to snoop. A US appeals court just threw out a 2013 verdict against the NSA, to White House approval. The decision vindicates the government’s stance that NSA’s bulk surveillance programs are constitutional, the White House said Friday. Three judges at the US Court of Appeals for the District

of Columbia Circuit said the plaintiffs, Larry Klayman and Charles Strange, had no standing to file the original claim, since they could not prove the NSA actually collected any of their records. While Klayman and Strange objected that the NSA refused to provide the evidence, the judges said that was working as intended. “Plaintiffs complain that the government should not be allowed to avoid liability simply by keeping the material classified. But the government’s silence regarding the scope of

bulk collection is a feature of the program, not a bug,” Judge Stephen F. Williams wrote. Klayman and Strange initially won their case before US District Court Judge Richard Leon in December 2013, challenging the NSA’s bulk collection program under Section 215 of the USA Patriot Act. The controversial section expired at the end of May, after a bipartisan group of lawmakers filibustered to prevent its extension. Under the subsequently passed USA Freedom Act, the collection of metadata

will be entrusted to telecom companies, and the NSA will be able to obtain the records through seeking a warrant from the FISA court. Within hours of the USA Freedom Act being signed into law, the Obama Administration petitioned to the FISA court to authorize the continuation of NSA’s bulk collections under Section 215, citing the new law’s provision allowing for a 180day transition period. The court ruled in favor of the government, allowing the NSA to restart the program it had to shut down

on May 31, and run it through November 2015. important day” for the company, as well as for Italy and Egypt, as it could fuel Italy’s economic development and “will be able to ensure satisfying Egypt’s natural gas demand for decades.” “It’s a very important day for Eni and its people. This historic discovery will be able to transform the energy scenario

of Egypt,” Claudio Descalzi, chief executive of Eni, said in a statement. The field is located about 80 miles (129 kilometers) off the Egyptian coast, 1,450 meters below the surface. According to Eni’s pressrelease, the discovered gas field, which covers an area of around 100 square kilometers, could contain about “30 trillion cubic feet of lean gas” (849 billion cubic meters of gas or 5.5 billion barrels of oil equivalent). Even more oil could be found at the field during the course of further exploration, potentially amounting up to 40 trillion cubic feet (1.1 trillion cubic meters), Claudio Descalzi told Financial Times. “I think we can discover more,” he said. In June, Eni struck a $ 2

billion deal with the Egyptian oil ministry allowing it to carry out exploration in Sinai, the Gulf of Suez, the Mediterranean and areas in the Nile Delta. Claudio Descalzi stressed that “Egypt still has great potential” in the energy field.” “Important synergies with the existing [Egyptian] infrastructures can be exploited, allowing us a fast production startup,” he added. The Leviathan gas field near the Israeli coast had been the largest discovered in the Mediterranean Sea before Eni found the “supergiant” field in Zahr. This new find is one of Eni’s biggest, although it is still smaller than a gas field being developed by the company near the coast of Mozambique. The final investment decision, which is still to be made, could

Cell Phone Ordinance Challenged in Court

By Desert Star Staff BERKELEY, Calif. - The City of Berkeley is fighting the wireless industry’s trade group

in federal court on Thursday. The city is defending an ordinance that would require cell phone retailers to post a sign warning

By KMIR News Staff PALM SPRINGS, Ca. - Tuesday night’s town hall meeting, hosted at the American Legion Post, was supposed to bring residents of Palm Springs together to meet all of the mayoral candidates. Everything seemed peaceful at the beginning, but unfortunately it did not have such a happy ending. Police are investigating whether an assault occurred during the forum. Palm Springs police responded to the scene. Daphne Barak, mayoral candidate Bill Gustani’s girlfriend, was in the audience when she

was allegedly attacked by another woman who was also in the audience. Barak claimed the woman is a supporter of Councilwoman Ginny Foat. She told police officers that the woman went behind her and began swearing and then assaulted her, “at the end she slapped me ...all candidates were horrified and police was called,” she said. Barak was treated and released by medical personnel at the scene. Police also contacted the alleged suspect, who is yet to be identified. She told police that she was the one that was

people who carry a phone close to the body may exceed federal guidelines on exposure to radio frequency radiation and children are more at risk. City council member Max Anderson says most people don’t know that the manuals recommend you keep the phone as much as an inch from the body, especially your brain. “It’s a public-education campaign,” says Anderson. “To try to stimulate some interest on the part of the public to view these instruments as potentially harmful if not used properly.” In the lawsuit, the trade group, called CTIA-The Wireless Association, quotes the Federal Communications Commission, which found “there is no scientific

evidence that proves wireless phone usage can lead to cancer or a variety of other problems, including headaches, dizziness or memory loss.” CTIA also argues the signs would be a violation of retailers’ First Amendment rights. But Lloyd Morgan, a senior researcher with the Environmental Health Trust in Berkeley, says the FCC is biased when it maintains cell phones are safe. “The FCC is controlled by the cell phone industry,” says Morgan. “The very person in charge of the FCC was in fact the founding president of the CTIA. He worked for industry in his entire career as a lobbyist.” Louis Slesin, editor of Microwave News, notes the

ordinance doesn’t address health risks. “We don’t know how great the risk may be but there’s enough data to suggest there is a risk,” says Louis. “All Berkeley is doing is notifying people there is such a possibility. That’s all.” Two years ago the San Francisco Board of Supervisors withdrew a similar ordinance after a lawsuit by the CTIA. However that ordinance placed more emphasis on the health risks of cell phones, whereas Berkeley’s ordinance was written specifically solely to expand disclosure to consumers. Morgan expects the current case to be appealed all the way to the Supreme Court, regardless of who wins this round.

PS Police Investigating Alleged Assault at Mayoral Forum attacked first. Barak argues she didn’t start the fight. According to candidate Bill Gustani, incidents like this shouldn’t happen. Ginny Foat declined to provide the name of the support, but she did confirm the woman does not work for her campaign. The investigation is ongoing and no arrests have been made at this time. Police are asking anyone with information on the incident to contact PSPD Sgt. Kyle Stjerne at (760) 323-8144. Source KMIR

Monsanto’s Roundup may damage liver

Long-term intake of the Monsanto’s most popular Roundup herbicide, even in very small amounts lower than permissible in US water, may lead to kidney and liver damage, a new study claims. The research, conducted by an international group of scientists from the UK, Italy and France, studied the effects of prolonged exposure to small amounts of the Roundup herbicide and one of its main components – glyphosate. In their study, published in Environmental Health on August 25, the scientists particularly focused on the influence of Monsanto’s Roundup on gene expression in the kidneys and liver. In the new two-year study, which extended the findings from one conducted in 2012, the team added tiny amounts of Roundup to water that was given to rats in doses much smaller than allowed in US drinking water. Scientists say that some of the rats experienced “25 percent body weight loss, presence of tumors over 25 percent bodyweight, hemorrhagic bleeding, or prostration.” The study’s conclusions indicate that there is an association between wide-scale alterations in liver and kidney gene expression and the consumption of small quantities of Roundup, even at admissible glyphosateequivalent concentrations. As the dose used is “environmentally relevant in terms of human, domesticated animals and wildlife levels of exposure,” the results potentially have significant health implications for animal and human populations, the study warned.

For info, call 760-7781079 or accmuseum.org. “There were more than 4,000 genes in the liver and kidneys [of the rats that were fed Roundup] whose levels of expression had changed,” the study’s leading scientist, Michael Antoniou, head of the Gene Expression and Therapy Group at King’s College London, said, as quoted by the Environmental Health News. “Given even very low levels of exposure, Roundup can potentially result in organ damage when it comes to liver and kidney function,” he added. “The severity we don’t know, but our data say there will be harm given enough time.” The results of the study have received mixed reviews in the scientific community, although many scientists have expressed their concern about possible negative health effects from Roundup use. Taking into account that the team “used very low dose levels in drinking water <…> this study should have some kind of public health influence,” said

Nichelle Harriott, the science and regulatory director at Beyond Pesticides, a Washington, DC based nonprofit organization, as quoted by the Environmental Health News. “We don’t know what to make of such changes, they may be meaningful and may not,” said Bruce Blumberg, a professor from the University of California, who did not take part in the study. “They can’t say which caused what, but what you have is an association – the group treated with a little Roundup had a lot of organ damage and the gene expression findings supported that,” he added. Meanwhile, according to the New England Journal of Medicine, the use of glyphosate in herbicides has increased by more than 250 times in the United States in the last 40 years. Research conducted in 2014 and published in the International Journal of Environmental Research and Public Health

linked the use of Monsanto’s Roundup to widespread chronic kidney disease that took the form of an epidemic in Sri Lanka. Another study showed that Monsanto agrochemicals may have caused cellular and genetic diseases in Brazilian soybean workers. Additionally, the World Health Organization’s International Agency for Research on Cancer has recently determined that Roundup’s glyphosate is ‘number one’ among carcinogens, “possibly” causing cancer. However, Monsanto has continuously and consistently insisted that its products are safe, citing other research supporting their claims. The latest such study was conducted by the German Federal Institute for Risk Assessments (BfR) and deemed that Monsanto’s Roundup was safe. So far, Monsanto has made no comment concerning the research conducted by the group led by Michael Antoniou.

What to Ask Your Doctor Before Scheduling Surgery

By Desert Star Staff If you are planning to have surgery, you may be anxious. Asking the right questions before scheduling surgery can help ensure good care and give you a better idea of what to expect. Here are a few areas you may want to cover with your surgeon in advance of the big day. Reviewing Your Options: The implications of your surgery will extend beyond the day you go to the hospital. Your doctor may www.desertstarweekly.com

PALM SPRINGS Free Family Law and

offer you options when it comes to the type of surgery performed. Find out the length and type of recovery period for each option, as well as the expected outcomes. For example, one option may be typically associated with shorter expected recovery time, but could carry greater risk. Another option may be associated with better long-term outcomes, but increase recovery time or leave larger scars. A third

option may not involve surgery at all. The many factors at play will help you make the decision that is best for your long-term health. Improved Therapies: While great strides have been made to operate using smaller incisions in procedures known as minimally invasive or laparoscopic surgery, controlling bleeding is still a major issue for surgeons. In fact, the task can account for 30 to 50 percent of procedure time, and for those on blood thinners, the bleeding risk is even higher. However, new innovations are revolutionizing this process, making surgery faster and safer for patients. For example, the AC5 Surgical Hemostatic Device is being studied to see if it can one day provide a faster, more effective means of controlling bleeding during operations versus other common methods, such as cautery or the use of biomaterials. This new device, created by Arch Therapeutics, uses AC5, which is made of a synthetic peptide, to safely and rapidly create a physical barrier in the September 2, 2015

nooks and crannies of tissue and promptly stop bleeding. Reduced fluid and blood loss during surgery can improve patient safety, free the surgical team to focus on other tasks, and lessen recovery time. Before your surgery, ask your doctor about medical innovations that may improve your outcome. Surgeon’s Credentials: There may be few times in your life where reviewing a professional’s credentials is more important than when you are picking a surgeon. Luckily, there are many impartial, online rating sites for doctors and surgeons that can help you determine whether your doctor is the best fit for you -- from the years of experience they’ve had to their success rates. You may even consider getting a second opinion on the necessity of surgery. Your health is in your hands more than you may realize. Be sure to seek out the best therapies available. You can help steer the direction of your healthcare with the right questions for your surgeon. (StatePoint)

The Secret Word is…Groucho!

Frank Ferrante as Groucho. Photo by Michael Doucett

By Pamela Price “An Evening with Groucho” after having wowed audiences for three nights, Aug 28,29 and 30 at the Coachella Valley Repertory Theatre ( CVRrep), hit a high note on several levels. Part of the CVRep’s Summer Cabaret Series, the spotlight was on Frank Ferrante, who has spent most of his professional life bringing Groucho Marx, one of the five Marx brothers, into focus. He has performed the Groucho role over 2500 times in more than 400 cities. Many in the audience of 80 remembered Groucho’s laugh a minute television show, “You Bet Your Life,” which Ferrante didn’t have to explain, as the audience was not the same you would see for a Miley Cyrus concert. Dreyer Weber directed this 90-minute production, which embraced just the right amount

of audience interaction, involving passing a cup of coffee down Row B to keep the audience awake. Thanks to Ron Celona, CVREPs’ Founding Artistic Director, a new generation was treated to the inimitable sense of humor and timing that put the “L” back tin laughter. “Groucho is the Shakespeare of timing, his quick wit catches you off guard,” said area writer Anthony Grant. The production was 90 minutes of laughs, interspersed with Groucho ‘history’ from his upside-down relationship with Louis B. Meyer in the 1930s (they were not fans of one another) to famously silly songs such as Lydia the Tattooed Lady.” Ferrante as Groucho shared literary insights about Groucho such as his meeting with poet T.S. Elliot and his antics with Margaret Dumont, who played ‘straight man’ to his

quick quips and comebacks. Double entendres and innuendos aside, Frank Ferrante accompanied by pianist Mark Rabe drew laughs and applause nonstop. It was a revival of America’s marvelous vintage humour. This 20152016 season, themed “Identity, Lost and Found” features The Happy Hour, A Class Act; I am My Own Wife and 4,000 Niles. In addition, CVRep offers Conservatory classes such as a Writer’s Workshop meeting the 2nd and 4th Saturday of the month from 10 am to 1 pm, along with Theatre Kids Acting Classes. MTV said the clip will be removed from all future broadcasts. West admitted he “rolled up a little something” before rambling onstage after accepting the Michael Jackson Video Vanguard Award from Swift. He covered a range of topics in nearly 13 minutes: He bashed MTV, apologized to Swift for taking her microphone in 2009 and claimed he would run for president in 2020. He also admitted, “I don’t understand awards shows,” and said he was upset that Justin Timberlake and Gnarls Barkley lost album of the year to the Dixie Chicks at the 2007 Grammy Awards. Swift, who won video of the year for “Bad Blood,” left the awards show drama-free. She was gracious as she handed West his award and stood close to Kim Kardashian as the rapper grew wordy onstage. She also joined Minaj during the rapper’s opening set to sing “The Night Is Still Young” and “Bad Blood.” They wore similar red outfits and finished with a hug. But Minaj had another bone to pick at the show - with Cyrus. Minaj called out the singer after winning best hip-hop video for “Anaconda”: “And now back to this (expletive) that had a lot to say about me a lot in the press. Miley, what’s good?” The cameras cut to Cyrus, who fired back with “we all know www.desertstarweekly.com

Then Cyrus told the audience about voting for the artist to watch category, which later was awarded to Fetty Wap. “I lost this award in 2008 and I was fine with it. Whatever! I N S I D E H O L LY W O O D “A Walk in the Woods” With Robert Redford & Nick Nolte WITH BEVERLY COHN

Robert Redford is one of Hollywood’s most treasured actor/producer/director. In addition, he has been an outspoken voice on social and environmental issues and is responsible for the enactment of key legislation aimed at protecting the environment, including the Clean Air Act. Redford’s films often reflect his liberal political views for which Time Magazine dubbed him of one of the 100 Most Influential People in the World. He also received the #17 spot in “Premiere Magazine’s” list of the Greatest Movie Stars of All Time. This extraordinary man was also a recipient of the Kennedy Center Honors, and was also awarded the American National Medal of the Arts by the National Endowment of the Arts in Washington, DC. Redford’s film and producer credits are too vast to list, but here are some of the most memorable ones: Best Picture Academy Award winners: The Sting, which received a total of seven Academy Awards, and Out of Africa, and Ordinary People, which he directed. On the American Film Institute’s list of “100 Heroes & Villains,” Redford’s performance as Bob Woodward in All The President’s Men and is ranked #27, which he shares with Dustin Hoffman, who played Carl Bernstein. The film was also nominated for Best Picture. Quiz Show received a Best Picture Oscar nomination, as did Butch Cassidy and the Sundance Kid, which became the name of both the Sundance Film Festival and the Sundance Institute in Salt Lake City, Utah, where he lives with his wife Sibylle Szaggars. From over 250,000 films, AFI created their Top 100 with Butch Cassidy and the Sundance Kid and All The President’s Men occupying the 73rd and 77th spot, respectively. In their latest film, A Walk in the Woods, Redford plays Bill Bryson, a successful travel writer and Nolte, plays his old friend Stephen Katz, a serial philanderer who is down on his luck. Ken Kwapis directs the film written by Bill Holderman, based on a book by Bill Bryson. The story revolves around two aging friends who decide to hike the 2,200-mile Appalachian Trail, beginning in Georgia and ending in Maine. While Bryson’s reasons for embarking on this journey it to face a new challenge, Katz’s reasons for joining him are dubious and much is comically revealed along the way. Emma Thompson, Nick Offerman, Kristen Schaal, and Mary Steenburgen complete the cast. Redford and Nolte recently sat down with a select group of journalists to discuss the film and more personal subjects and the following has been edited for content and continuity for print purposes.

It also was about friendship – another subject that I thought was always good to work with. Then the idea of working with Nick felt very compatible. So that was what drew me to it. What took so long to get the film made? Redford: That’s just the nature of our business. It goes like this. Studios don’t do as many films as they use to. We don’t have a stable of directors, actors, and scripts, so the business depends on a couple of things, one of which is the people who are financing the film must have certain guarantees, such as foreign sales. Foreign sales demand stars and I think that puts an unfair stress on the project. So, a lot of projects don’t get made and that’s why a lot of independent films are getting made because they’re free of that pressure.

fall flat. Try to elaborate with something like, “You did a great job today and your enthusiasm made our whole team shine.” Shift Yo u r Focus: Compliments that include putdowns often leave the receiver feeling less than flattered. Try to stay away from saying things like “You look so good for your age” or “You’re an awesome parent considering how busy you are all the time.” Shift your focus to the compliment itself -- it’s more meaningful on its own. Dig Deeper: According to

a recent poll, individuals want to hear compliments that dig deeper into who they truly are, such as ones about their personality, about being a good friend, about what they do, about their intellect and about being a good parent. Focus on these traits when giving compliments and the receiver will be much more receptive to hearing them and believing them. All it takes is a little practice. (StatePoint)

Why is it So Hard to Accept Compliments? By Desert Star Staff Try a little experiment. Think of someone you love or respect, and offer her a compliment. Chances are high that she’ll deflect your kind words, if not outright tell you you’re just plain wrong, suggests a new study, which finds that nearly 40 percent of women have

trouble accepting compliments. Why is it so hard to accept a compliment? Experts say it can often be associated with societal expectations that women appear humble or demur; and other times it’s because of one’s own negative self-image. In an effort to encourage women and girls to lean in and

Men Accused in Street Racing Death Being Arraigned

By KMIR News Staff INDIO, Ca. - Two men accused of causing the death of an 81-year-old woman while street racing their BMWs in Rancho Mirage nearly two years ago are scheduled to be arraigned today on felony charges. Scott Daniel Bahls, 30, of Palm Springs, and Wade Wheeler, 33, of Rancho Mirage, are each charged with one count of vehicular manslaughter with gross negligence, unlawfully engaging in a speed contest on a highway, and reckless driving causing injury or death. Bahls is additionally charged with hit-andrun causing death. Following a preliminary hearing July 24, a judge ruled there was enough evidence to order them to proceed to trial for allegedly causing the June 18, 2013, crash that killed Barbara Schmitz and seriously injured her husband, Gerald.

Bahls is free on $80,000 bail and Wheeler on bond of $200,000. According to a declaration filed in support of an arrest warrant, Wheeler was seen on Highway 111 in Rancho Mirage ``revving his vehicle’s engine to gain the attention of the driver of another BMW, Scott Bahls. Witnesses said the two BMWs had been traveling in excess of 70-80 mph at times.’’ According to another declaration, witnesses reported seeing both drivers swerving through traffic and ``communicating to each other through their windows. Both vehicles were seen either side by side or within a car length apart.’’ Wheeler, who was eastbound on Highway 111, crashed his BMW into the passenger side of a vehicle driven by Gerald Schmitz as he was turning left at Dunes View Road, according to authorities. The car launched into

the air and rolled several times. Barbara Schmitz died at a hospital about two hours after the crash. Her husband was seriously injured, according to the declarations and criminal complaint. Wheeler had been driving 74 mph before the crash and

suffered a broken leg. Bahls, who allegedly left the scene, was also driving over 70 mph, according to court documents. Riverside County District Attorney’s Office spokesman John Hall has said that prosecutors ``carefully examined all the evidence in this case

before making our decision on what charges were the most appropriate to file.’’ He added that the case involved ``complex crash reconstruction’’ and many witness interviews.

that invented glass bottles here in Los Angeles, but that family moved to the mid-west during the 1940s. There was a specific reason why the mid-west because in Omaha there was a large Jewish population, who were very wealthy, very secure, and very comfortable, so that was the safest place you could possibly be during World War II. Do you have memories of the war? Nolte: I remember World War II. Bob remembers World War II. I’ve been really thinking about this now that I’m in my solid seventies. It had an extreme effect on a lot of people. My English friends that are my age deny that they knew anything about the war. Those kids were moved to the country, but they

just deny it. I remember the rationing. We had no butter so we had this white stuff in a package that I use to fight my sister over. She was bigger than me so she always won. I couldn’t outrun my sister until my senior year in high school. She would have gone on to the Olympics as a swimmer had she not tried to be a woman for midwest guys. She finally couldn’t and went back east where she found acceptance and freedom and became a buyer for Lord & Taylor. My mother was a fashion buyer and very rebellious. She got mad at Women’s Lib and said that if a woman couldn’t figure out how to get around in a man’s world, she’s not worth her salt. She was tough. Did this affect your relationship

with Bob vis-à-vis your respective characters? Nolte: There was kind of an unwritten script going on between Bob and I, and I think it’s this World War II experience. Redford: I think so. Like Nick, my World War II memory was rationing. I would go to the bottom of the cereal box to get the special Captain Midnight ring. There was no television, so we listened to the radio. I remember lying on the carpet and looking at this little green light on the radio. We also did paper drives. We would go out into the community and get as much paper bundled up as possible for the drive. It was a big, thrilling thing. We had relatives that were in the war some of whom were killed in the war. That had a big impact on a kid four or five years old. When you’re working on a film as an actor where you’re

School against the Titans (0-1 overall, 0-0 Mountain Pass). With the core team returning, the head coach Dan Murphy will likely have his team right back in the thick of things at the end of the season. With senior starting quarter back Will Olvera and two amazing, do-everything athletes Franklin Miller, Taylor Hawkins returning, the Palm Springs offense is supposed to kick on

all cylinders in 2015 but in the season opener, the defense drove the bus. Miller and Hawkins and sophomore Cameron Koehler each came away with one interception that ended Titan drives and stole momentum that ended up contributing to the shutout. Olvera finished the game going 13-21 passing, with 156 yards and an interception. Probably just first game jitters but the league’s best quarterback will certainly settle down. Franklin Miller wound up with 54 receiving yards on five catches with a touchdown. The Indians were the only team out of the DVL that took home a victory in the season opener. The Aztecs, Lions, Arabs, Saints, Rajahs and Blackhawks all lost. The Indians next game is this Friday at home against Redlands High School. The game starts at 7 pm. September 2, 2015

Nick Nolte wearing multiple hats, how do you stay focused so that you don’t worry about the technical aspects, such as lighting, camera angles, or the budgets? Redford: Some of that has to do with trust. You’re going to trust the director and the technicians. I’ve had the pleasure of working with crews over the years and they’re kind of underappreciated. It takes an entire crew to make a film. They don’t get credit. They don’t get special attention. They don’t get profiles. They don’t do press conferences or things like that, but without them, there would be no film. There are people who park the cars and people who scout locations. Also, they show up earlier than the actors and leave long after the actors have left, so they deserve a lot of credit. Nick and I both share that respect of crews. In this case, with A Walk in the Woods, these guys had a rough go. They had to shoot locations that were weird. I never figured out why we used some of these locations,

which were miles apart. How long were you on the Trail and how much of it did you actually walk? Redford: We weren’t on the whole trail. We were only on parts of it. The reason you felt like you did hike the 2,200 miles was because you would be going up hill, and there would be a take, and then you would go uphill again, and there would be a take. Then the director would say, “Cut. Now let’s do it again.” You would do it again, and again, and again, all through the film so by the time you did six or seven takes, it felt like you had walked the whole trail. Some of the shots looked pretty treacherous. Did you do all of your own stunts? Redford: I think most of it. Nolte: Most of it, but not the fall. We only fell half way. Haunting Jeanine Tesori musical at San Diego Rep

Jacob Caltrider and Hannah Corrigan Photo by Daren Scott. By Jack Lyons Theatre and Film Critic Forty years ago San Diego REPertory Theatre co-founders Sam Woodhouse and D.W. Jacobs opened the doors of their theatre whose Mission Statement in part read ”… produce intimate, exotic, and provocative theatre that celebrates the multiple voices of our region and feeds the curious soul.” Under the steadfast forty-year leadership of Sam Woodhouse, this vitally important urban theatrical space in Horton Plaza, has indeed fed the many curious souls of its audiences as well as its actors, directors, playwrights and creative artists. The REP launches Season Forty with the evocative Jeanine Tesori musical “Violet”, with book and lyrics by Brain Crawley; solidly staged by Sam Woodhouse. Tesori, winner of the 2014 Tony for Best Musical (‘Fun Home’), delivers a haunting musical score with poignant lyrics to match from lyricist Crawley, however Crawley’s libretto/ story doesn’t quite match the ambition of the creative team. His script is a very simplistic, down-home, country approach as it tells the story of a young, disfigured woman who embarks on a journey by bus from her farm in North Carolina, all the way to Tulsa, in order to be “healed” by a Televangelist, only to be crushed once again when she realizes there has been no change in her outward appearance. Losing her mother to cancer at 13, growing up with a father who loves her but who can’t seem to understand or come to grips with the unfairness of the world that he and his daughter live in is compelling indeed, but there is something naïve and a little too simplistic in the unfolding of Violet’s story by librettist Crawley. It’s not a linear story (not that it has to be). In “Violet”, the actors frequently break the fourth wall, and employ the instant flashback technique where the young version and the grownup version of Violet are on stage simultaneously singing and acting together; then they go forward to the present and the narrative moves on. The convention merely sharpens our focus and concentration, but it jars slightly at first. www.desertstarweekly.com

One distraction that does jar my credulity concerns is the reference to “a disfiguring scar” on Violet’s face; the result of an accident when her father’s axe slipped while cutting wood, and struck her. All on-stage characters appear to react or recoil at the sight of it. It’s been a source of Violet’s teasing by classmates, which accounts for her on-going self-image and low esteem problems. Why then is there no visible evidence of a scar on Violet’s face that the audience can see? It’s a key character element that drives all of Violet’s self-conscious behavior and her outlook on life. I’m just wondering that’s all… Having said all of the above, the actors in “Violet”, however, are outstanding in their performances. A non-scarred and lovely Hannah Corrigan, as grown-up Violet, sports a powerful set of pipes with a wide vocal range and is sweetly and convincingly portrayed. A poised and confident 13 yearold Katelyn Katz as young Violet, holds her own with all of the adult performers in her scenes. Rhett George as Flick, an African American army Sargent that Violet meets on her bus trip to Tulsa delivers a strong, compelling and poignant performance both as an actor and as a singer. His army buddy Monty played by Jacob Caltrider is a G.I. who plays all his female relationships safely – he’s only only interested in one-night stands - also has a nice singing voice. The two and threepart harmony numbers by the principals is nicely done thanks to Tesori’s appealing sounding score under the musical direction of talented Korrie Palliotto, who did such as fabulous job on “Everybody’s Talkin’: The music of Harry Nilsson” that was recently heard and seen at the REP. Strong support also comes from Melinda Gilb as the old lady; Jason Maddy as Violet’s conflicted and guilt-ridden father; Jason Heil as the Preacher and local favorite Kurt Norby playing several characters as does Bryan Banville are all first rate. If energy or electricity is in short supply during the heatwaves cooking the San Diego area of late, I suggest we all tap into the electric and high-

Hannah Corrigan Photo by Daren Scott. octane performances and energy generated by cast members Anise Ritchie as a Music Hall singer, and Tanika Baptiste as Lula Buffington, respectively. They generate enough energy to light half of San Diego with the Gospel singing number led by Baptiste and is the wildest 11 0’clock spot I’ve seen in a long time. It brought down the house at the performance I attended. It rocked! Out of the 23 musical numbers featured in this nicelypaced musical, I feel there about six songs that really hit home: the poignant ‘Water in the Tank’, by the two violets; the upbeat ditty

about gambling called ‘Luck of the Draw’ by Young Vi, her father, and Violet; the serio-comical ‘A Healing Touch’ by the Preacher, Young Vi, the Gospel Choir, and Violet, also the tender and sweet ‘Let It Sing’ by Flick to Violet, plus the moving ‘Hard to Say Goodbye’ by Flick and Violet, and of course, the high octane number ‘Raise Me Up’ performed to the hilt by Lula Buffington and the Gospel Choir. The ensemble cast of mainly Equity performers, make this touching 90 minute, no intermission production about the fragility of life and the quixotic-

like hopes and dreams required to cope with its many difficult choices, a production not to be missed. D i re c t o r Wo o d h o u s e and his creative team led by Scenic Designer Guilio Perrone, Costume Designer Jeanne Reith, Lighting Designer Trevor Norton, and Sound/Projection Designer Kevin Athenill earn high marks for a solid technically proficient production. “Violet”, the musical, performs at San Diego Repertory Theatre on the Lyceum Stage and runs through to September 13, 2015.
